		<official-title>To provide for the application of sections 552, 552a, and
		  552b of title 5, United States Code (commonly referred to as the Freedom of
		  Information Act and the Privacy Act), and the Federal Advisory Committee Act (5
		  U.S.C. App.) to the Smithsonian Institution, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Open and Transparent Smithsonian
			 Act of 2008</short-title></quote>.</text>
		</section><section id="id237224215EB04788A7E730FEC9664D24"><enum>2.</enum><header>Application of
			 open government statutes to the Smithsonian Institution</header>
			<subsection id="idA8BD4FCC44764ECBAE0177BB4318A495"><enum>(a)</enum><header>In
			 General</header><text>The following provisions shall apply to the Smithsonian
			 Institution:</text>
				<paragraph id="idB90E8A0281D04890934CBF4D52BA3C42"><enum>(1)</enum><text>Section 552 of
			 title 5, United States Code (commonly referred to as the Freedom of Information
			 Act).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB62D397F932C415EBC2CEF48289E6C1A"><enum>(2)</enum><text display-inline="yes-display-inline">Sections 552a of title 5, United States
			 Code (commonly referred to as the Privacy Act).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E5F295F2A474E4EB4CC50782F5351A5"><enum>(3)</enum><text display-inline="yes-display-inline">Sections 552b of title 5, United States
			 Code (relating to open meetings).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA24E0F78F28F49828FCE8AA97F67ED4D"><enum>(4)</enum><text>The Federal
			 Advisory Committee Act (5 U.S.C. App.).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEB17ACB0C3F94114AEA9AD6AE7BB5FFC"><enum>(b)</enum><header>Agency</header><text>For
			 purposes of each provision of law under subsection (b)—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id9DBB26B1A41E44D1B6BCAD51B9FBF5B7"><enum>(1)</enum><text>the Smithsonian
			 Institution shall be an agency; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47F9706EC54C45CABBAA504EE18FD420"><enum>(2)</enum><text>the Secretary of
			 the Smithsonian Institution shall be the head of the agency.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB1613327013B4D6FA1D94EDD43558AED"><enum>(c)</enum><header>Effective date
			 and application</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id34FA6C7B32254873B3FC515594EFAAEC"><enum>(1)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">This section shall take
			 effect on the date of enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id576A254C4C654CBD9809A5DFA693EAC3"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">This section shall apply to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5360C0AF676D4F74853886E5836167F5"><enum>(A)</enum><text display-inline="yes-display-inline">all actions taken by the Board of Regents
			 of the Smithsonian Institution or any officer or employee of the Smithsonian
			 Institution before, on, or after the date of enactment of this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id761392FE20104510AA92811EF966A69F"><enum>(B)</enum><text display-inline="yes-display-inline">any record created before, on, or after
			 that date; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4E08FE1106C744FCA4FB6AD86DED3530"><enum>(C)</enum><text>any meeting held
			 before, on, or after that date.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9051410FAF8147718EF9C7074FFADDDD"><enum>3.</enum><header>Disclosure of
			 information to Chairperson or Ranking Member of Committee of
			 Congress</header><text display-inline="no-display-inline">Section 552a(b)(9) of
			 title 5, United States Code (commonly referred to as the Privacy Act), is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id90DB7C538DF949F7910D305D9222227B"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(9)</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id985E932D4DDF47E0854A3B0CC53742FD"><enum>(2)</enum><text>by adding
			 <quote>or</quote> after the semicolon; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69A189DAFCA2404CB0CCC0C19877E6BD"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4A5088BCB9A348A7891AF4A5A8DC8047" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id359ADDA489664C6A87DDC949E4B34BCA"><enum>(B)</enum><text>to the
				chairperson or ranking member of a committee, subcommittee, or joint committee
				described under subparagraph (A) upon the request of that chairperson or
				ranking
				member;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
