		<official-title>To amend title 11, United States Code, with respect to
		  the priority of certain high cost credit debts.</official-title>

		<section id="id814B02D257B04111898241E48CB306A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Credit Fairness
			 Act</short-title></quote>.</text>
		</section><section id="idF0CF42F72C864CE0AE14BD8A06064334" section-type="subsequent-section"><enum>2.</enum><header>Effects of high cost
			 credit on bankruptcy proceedings</header>
			<subsection id="ID8f38b172c35b40d69385b471967d620e"><enum>(a)</enum><header>Definitions</header><text>Section
			 101 of title 11, United States Code, is amended—</text>
				<paragraph id="IDed69982a43e64db8a507b0f4e022dc3e"><enum>(1)</enum><text>by redesignating
			 paragraph (27B) as paragraph (27C); and</text>
				</paragraph><paragraph id="IDe87d3913af5c403b9f34a5021aa13808"><enum>(2)</enum><text>by inserting
			 after paragraph (27A) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idE65F81EADE8E416486A94E7F1ECDEF0C" style="OLC">
						<paragraph id="ID3bb22de8a36146178e6a991181626573"><enum>(27B)</enum><text>The term
				<term>high cost consumer credit transaction</term> means an extension of credit
				by a <quote>creditor</quote> (as defined in section 103 of the Truth in Lending
				Act (15 U.S.C. 1602(f))), resulting in a consumer debt that has an applicable
				annual percentage rate (as determined in accordance with section 107(a) of the
				Truth in Lending Act (15 U.S.C. 1606(a)), and including costs and fees incurred
				in connection with the extension of such credit) that exceeds the lesser
				of—</text>
							<subparagraph id="id5B13218FE2294BEF9E2B4CE643C803B2"><enum>(A)</enum><text>the sum of 15
				percent and the yield on United States Treasury securities having a 30-year
				period of maturity; or</text>
							</subparagraph><subparagraph id="id559DABE9809B43C1B25A7BB93D4F6D8E"><enum>(B)</enum><text>36
				percent.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID09c3b6009ecd4b3fbf51220a59df86a4"><enum>(b)</enum><header>Subordination</header><text>Section
			 510 of title 11, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id187DAC89FC6545A18BC86E899BDC0D5F" style="OLC">
					<subsection id="IDa91e63f15117448d8a4e0c85c704feba"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id99C14B06E2094C2CB9ADB197F02AE169"><enum>(1)</enum><text>For the purpose of
				distribution under this title, an allowed claim arising from a high cost
				consumer credit transaction shall be subordinated to all other claims.</text>
						</paragraph><paragraph id="ID22cd071c2a394b588e586cc4f69410fe" indent="up1"><enum>(2)</enum><text>Any lien securing a claim
				subordinated under paragraph (1) shall be transferred to the
				estate.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID5dc319bfca51419abeed6012e2e47b47"><enum>3.</enum><header>Exclusion</header><text display-inline="no-display-inline">Section 707(b) of title 11, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id46C657DDE3914DEC9515D7102A940395" style="OLC">
				<paragraph id="ID79e249134f854f9596f02970e106f4cd" indent="up1"><enum>(8)</enum><text>Paragraph (2) shall not apply if the
				debtor's petition resulted from a high cost consumer credit
				transaction.</text>
