		<official-title>To disqualify any individual who engages in or is
		  convicted of human smuggling from operating a commercial motor vehicle or
		  holding a commercial driver’s license and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Putting the Brakes on Human
			 Smuggling Act</short-title></quote>.</text>
		</section><section id="idEE1B9A71514F4561A86DE00881CFFE43"><enum>2.</enum><header>Disqualification
			 from operating commercial motor vehicle by the Secretary of
			 Transportation</header>
			<subsection id="ID3c74bac52c52482e80e3087fd4251714"><enum>(a)</enum><header>First
			 violation</header><text>Paragraph (1) of section 31310(b) of title 49, United
			 States Code, is amended—</text>
				<paragraph id="id56AE1F0A12244526884D4720CB54A869"><enum>(1)</enum><text>in subparagraph
			 (D), by striking the <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea844f7ac83746b1a8651be674a88ee5"><enum>(2)</enum><text>in subparagraph
			 (E), by striking the period at the end and inserting a semicolon and
			 <quote>or</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF9A945FBC69147F59B0821F56E9F906E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id43580B7AF01E41AD815670D4069E1C26" style="OLC">
						<subparagraph id="IDe9a14d5776634f579389f144a16e96f7" indent="up1"><enum>(F)</enum><text>using a commercial motor vehicle in
				willfully aiding or abetting an alien’s illegal entry into the United States by
				transporting, guiding, directing, or attempting to assist the alien with the
				alien's entry in violation of section 275 of the Immigration and Nationality
				Act (8 U.S.C. 1325), regardless of whether the alien is ultimately fined or
				imprisoned for an act in violation of such
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID74035b27d08241f19718112888d78c4e"><enum>(b)</enum><header>Second or
			 multiple violations</header><text>Paragraph (1) of section 31310(c) of title
			 49, United States Code, is amended—</text>
				<paragraph id="IDc1e5e6ed02e0469cb860becf5fe46258"><enum>(1)</enum><text>in subparagraph
			 (E), by striking the <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="IDf99edd18d49f498d9c599986534a8c2a"><enum>(2)</enum><text>by redesignating
			 subparagraph (F) as subparagraph (G);</text>
				</paragraph><paragraph id="ID501561c18ee64227b56fb32df94e29d4"><enum>(3)</enum><text>in subparagraph
			 (G), as so redesignated, by striking <quote>(E)</quote> and inserting
			 <quote>(F)</quote>; and</text>
				</paragraph><paragraph id="ID511005226b78466fad165110a48357d6"><enum>(4)</enum><text>by inserting
			 after subparagraph (E) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6A6859D4891641689A702EBD79ABDF60" style="OLC">
						<subparagraph id="ID66800d0ea016455db079d279a2f79bd4" indent="up1"><enum>(F)</enum><text>using a commercial motor vehicle on
				more than one occasion in willfully aiding or abetting an alien’s illegal entry
				into the United States by transporting, guiding, directing and attempting to
				assist the alien with alien's entry in violation of section 275 of the
				Immigration and Nationality Act (8 U.S.C. 1325), regardless of whether the
				alien is ultimately fined or imprisoned for an act in violation of such
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID4b547beacc9d46a08ad863568bde843a"><enum>(c)</enum><header>Lifetime
			 disqualification</header><text>Subsection (d) of section 31310 of title 49,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id7171D45467074DB39964BE7B9C357585" style="OLC">
					<subsection id="ID6788c6e8db7f4d45b84434471a9e81b1"><enum>(d)</enum><header>Lifetime
				disqualification</header><text>The Secretary shall disqualify from operating a
				commercial motor vehicle for life an individual who uses a commercial motor
				vehicle—</text>
						<paragraph id="idBFB56F163B4240BC9EAAC934C593A754"><enum>(1)</enum><text>in committing a
				felony involving manufacturing, distributing, or dispensing a controlled
				substance, or possessing with the intent to manufacture, distribute, or
				dispense a controlled substance; or</text>
						</paragraph><paragraph id="id643B420273BE44ECB86CC96C7A0633CC"><enum>(2)</enum><text>in committing an
				act for which the individual is convicted under—</text>
							<subparagraph id="idC3F6B6778AAB493B980B44B17F49C27F"><enum>(A)</enum><text>section 274 of
				the Immigration and Nationality Act (8 U.S.C. 1324); or</text>
							</subparagraph><subparagraph id="idE4027689438A4E9999AF389BC5A777F5"><enum>(B)</enum><text>section 277 of
				such Act (8 U.S.C.
				1327).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id52C292EA4ACD49EBBAEEB175168D0237"><enum>3.</enum><header>Reporting
			 requirements</header>
			<subsection id="idB5135B07456E4A7ABE05F7150F845DE8"><enum>(a)</enum><header>Commercial
			 driver's license information system</header><text>Paragraph (1) of section
			 31309(b) of title 49, United States Code, is amended—</text>
				<paragraph id="idC71256256A1E454C89719A4C8FF76838"><enum>(1)</enum><text>in subparagraph
			 (E), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="idE7D3B4E85A23422693507D76054185E8"><enum>(2)</enum><text>in subparagraph
			 (F), by striking the period at the end and inserting a semicolon and
			 <quote>and</quote>; and</text>
				</paragraph><paragraph id="id844E941596FB40E4BE20C1AA4CDDAED2"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id1CDF4E95D6584FDBA6AD4E29272B9C2F" style="OLC">
						<subparagraph id="idA22B63B0B75148E88880E941112FBBBC" indent="up1"><enum>(G)</enum><text>whether the operator was disqualified,
				either temporarily or for life, from operating a commercial motor vehicle under
				section 31310, including under subsection (b)(1)(F), (c)(1)(F), or (d) of such
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id0EFDCEDABA444B56B4460030510A863E"><enum>(b)</enum><header>Notification by
			 the State</header><text>Paragraph (8) of section 31311(a) of title 49, United
			 States Code, is amended by inserting <quote>including such a disqualification,
			 revocation, suspension, or cancellation made pursuant to a disqualification
			 under subsection (b)(1)(F), (c)(1)(F), or (d) of section 31310,</quote> after
			 <quote>60 days,</quote>.</text>
