		<official-title>To amend title VII of the Civil Rights Act of 1964 to
		  clarify the filing period applicable to charges of discrimination, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="H857C3BA308964BB6AF6E9969BA063F8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Title VII Fairness
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="id0D2DC5DE4F204C6E8EB3BE4281EDD4FF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID2dcc71d75aeb40f3b044a2082216f87c"><enum>(1)</enum><text>Filing
			 limitations periods serve important functions. They ensure that all claims are
			 promptly raised and investigated, and, when remediation is warranted, that the
			 violations involved are promptly remediated.</text>
			</paragraph><paragraph id="idFB5C0966510742FFB0DA7121EFDA02E1"><enum>(2)</enum><text>Limitations
			 periods are particularly important in employment situations, where unresolved
			 grievances have a singularly corrosive and disruptive effect.</text>
			</paragraph><paragraph id="id96C55E55A1884CDA87CE4412C0E479AA"><enum>(3)</enum><text>Limitations
			 periods are also particularly important for a statutory process that favors the
			 voluntary resolution of claims through mediation and conciliation. Promptly
			 raised issues are invariably more susceptible to such forms of voluntary
			 resolution.</text>
			</paragraph><paragraph id="idB815FF696CC44614B7DAA6D22E59064F"><enum>(4)</enum><text>In instances in
			 which that voluntary resolution is not possible, a limitations period ensures
			 that claims will be adjudicated on the basis of evidence that is available,
			 reliable, and from a date that is proximate in time to the adjudication.</text>
			</paragraph><paragraph id="ID0db07abb021c4aa28033f592dd4228f0"><enum>(5)</enum><text>Limitations
			 periods, however, should not be construed to foreclose the filing of a claim by
			 a reasonable person who exercises due diligence regarding the person's rights
			 but who did not have, and should not have been expected to have, a reasonable
			 suspicion that the person was the object of unlawful discrimination. Such a
			 person should be afforded the full applicable limitation period to commence a
			 claim from the time the person has, or should be expected to have, a reasonable
			 suspicion of discrimination.</text>
			</paragraph></section><section id="H774463EF2E6046D490F8D44E48CC8F7C"><enum>3.</enum><header>Filing period for
			 charges alleging unlawful employment practices</header><text display-inline="no-display-inline">Section 706(e) of the Civil Rights Act of
			 1964 (42 U.S.C. 2000e–5(e)) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idB1E1C57E5EB645D0AC37F01F599D1AE4" style="OLC">
				<paragraph id="H3A40BCE4553C468C81B8CCC93C36F848" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7C4AD9EA3A5748C100B1FFFD45E01E45"><enum>(A)</enum><text display-inline="yes-display-inline">This paragraph shall apply to a charge
				if—</text>
						<clause id="id8461E6DC4D084ABAB7B6F795A1876FCE" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">the charge alleges an unlawful employment
				practice involving discrimination in violation of this title; and</text>
						</clause><clause id="id263F41FC01A24B6A9A97B3EB5C22B954" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the person aggrieved demonstrates that the
				person did not have, and should not have been expected to have, enough
				information to support a reasonable suspicion of such discrimination, on the
				date on which the alleged unlawful employment practice occurred.</text>
						</clause></subparagraph><subparagraph id="id14A0565A50EB4579B3F33261885F1A35" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of such a charge, the
				applicable 180-day or 300-day filing period described in paragraph (1) shall
				commence on the date when the person aggrieved has, or should be expected to
				have, enough information to support a reasonable suspicion of such
				discrimination.</text>
					</subparagraph><subparagraph id="id76E3042D4EB742C09ECA8A80B3442403" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this paragraph shall be
				construed to change or modify the provisions of subsection (g)(1).</text>
					</subparagraph><subparagraph id="id37BEC8B004D14912BB2EE1A478A11A4F" indent="up1"><enum>(D)</enum><text>Nothing in this paragraph shall be
				construed to apply to a charge alleging an unlawful employment practice
				relating to the provision of a pension or a pension
				benefit.</text>
					</subparagraph></paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
		</section><section id="id6C410B2F24474C1BAC279D9B9DD2943A"><enum>4.</enum><header>Filing period
			 for charges alleging unlawful practices based on age</header><text display-inline="no-display-inline">Section 7(d) of the Age Discrimination in
			 Employment Act of 1967 (29 U.S.C. 626(d)) is amended—</text>
			<paragraph id="IDCAA592AEADA942EAB9F8E6260EC93EB9"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text>
			</paragraph><paragraph id="ID5401C69FCF604BFCB53C875F4FCE0C2F"><enum>(2)</enum><text>by striking
			 <quote>(d)</quote> and inserting <quote>(d)(1)</quote>;</text>
			</paragraph><paragraph id="ID19F1A9CFDFA64BA6826D3552BE3EAFF5"><enum>(3)</enum><text>in the third
			 sentence, by striking <quote>Upon</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="IDC883FE170C2C4F63966827DB140F40A1" style="OLC">
					<paragraph id="ID14A03887E74B40B39C4517DFAF746B44" indent="up1"><enum>(2)</enum><text>Upon</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="IDAB4E17D897DC4E73A1C7C083C07C1FE4"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="ID684ABEC62710491F8BA2FB04A286246D" style="OLC">
					<paragraph id="ID7C72AF43C1954FF487FE5F23BB70BA19" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1D5551C0F42F4D88BE708AA4A3253782"><enum>(A)</enum><text>This paragraph shall
				apply to a charge if—</text>
							<clause id="id41E254CAA24E4FFAB645017C40FC2D41" indent="up1"><enum>(i)</enum><text>the charge alleges an unlawful
				practice involving discrimination in violation of this Act; and</text>
							</clause><clause id="id3CC4D3A3DCB5489C9BB1D21EC3C89F2D" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the person aggrieved demonstrates that the
				person did not have, and should not have been expected to have, enough
				information to support a reasonable suspicion of such discrimination, on the
				date on which the alleged unlawful practice occurred.</text>
							</clause></subparagraph><subparagraph id="id39A5D7EBC9694D0995F6AC4E6920E3C7" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of such a charge, the
				applicable 180-day or 300-day filing period described in paragraph (1) shall
				commence on the date when the person aggrieved has, or should be expected to
				have, enough information to support a reasonable suspicion of such
				discrimination.</text>
						</subparagraph><subparagraph id="id351A74F3934E4651B8B246B38D732EB0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this paragraph shall be
				construed to change or modify any remedial provision of this Act.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id005F7CE835E74B04B22B92F6049E4FD7" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">Nothing in this paragraph shall be
				construed to apply to a charge alleging an unlawful practice relating to the
				provision of a pension or a pension
				benefit.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID18556FD3FF5246C6935D1329F0196787"><enum>5.</enum><header>Application to
			 other laws</header>
			<subsection id="IDEA77CFD87B30466188301E3F1D177663"><enum>(a)</enum><header>Americans with
			 Disabilities Act of 1990</header><text>Section 706(e)(3) of the Civil Rights
			 Act of 1964 (42 U.S.C. 2000e–5(e)(3)) shall apply (in the same manner as such
			 section applies to a charge described in subparagraph (A)(i) of such section)
			 to claims of discrimination brought under title I and section 503 of the
			 Americans with Disabilities Act of 1990 (42 U.S.C. 12111 et seq., 12203),
			 pursuant to section 107(a) of such Act (42 U.S.C. 12117(a)), which adopts the
			 powers, remedies, and procedures set forth in section 706 of the Civil Rights
			 Act of 1964 (42 U.S.C. 2000e–5).</text>
			</subsection><subsection id="ID1C3F093B7D4445E697EA4F10A7679A9D"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="ID048B4D8F4C024692AE97B489D2D25622"><enum>(1)</enum><header>Civil Rights
			 Act of 1964</header><text>Section 717 of the Civil Rights Act of 1964 (42
			 U.S.C. 2000e–16) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID54570BD9499243C089503FFC9003CD3C" style="OLC">
						<subsection id="ID54D7FF7FD2654023BB6B449C3ADF3AF8"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idEE58A077D8C4426BAADA5A86D192AE10"><enum>(1)</enum><text>Subject to paragraph
				(2), section 706(e)(3) shall apply (in the same manner as such section applies
				to a charge described in subparagraph (A)(i) of such section) to complaints of
				discrimination under this section.</text>
							</paragraph><paragraph id="id3EE8E45084F34D1B9CE208AE61EFF852" indent="up1"><enum>(2)</enum><text>For purposes of applying section
				706(e)(3) to a complaint under this section, a reference in section
				706(e)(3)(B) to a filing period shall be considered to be a reference to the
				applicable filing period under this
				section.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBEF482EDA20C45B7BA6ABEC8856D9ACB"><enum>(2)</enum><header>Age
			 discrimination in employment act of 1967</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC8A170E9CFA246878E2BEB6914AE38BB"><enum>(A)</enum><header>In
			 general</header><text>Section 15(f) of the Age Discrimination in Employment Act
			 of 1967 (29 U.S.C. 633a(f)) is amended by striking <quote>of section</quote>
			 and inserting <quote>of sections 7(d)(3) and</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id100112C33630423EAAFFCA7EE483DA0C"><enum>(B)</enum><header>Application</header><text>For
			 purposes of applying section 7(d)(3) of the Age Discrimination in Employment
			 Act of 1967 (29 U.S.C. 626(d)(3)) to a complaint under section 15 of that Act
			 (29 U.S.C. 633a), a reference in section 7(d)(3)(B) of that Act to a filing
			 period shall be considered to be a reference to the applicable filing period
			 under section 15 of that Act.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
