		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Oregon Surplus Federal Land Act of
			 2008</short-title></quote>.</text>
		</section><section id="id849502AAA8544E959D8CE543BCF93F25"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idDF4C15F268F3416A80FDD8A8D29AF6C1"><enum>(1)</enum><header>Commandant</header><text>The
			 term <quote>Commandant</quote> means the Commandant of the Coast Guard.</text>
			</paragraph><paragraph id="id6C47C88E31B04B9AB6C6BD879EBFE3B2"><enum>(2)</enum><header>Light
			 Station</header><text>The term <quote>Light Station</quote> means the Cape
			 Arago Light Station on Chief's Island in the State of Oregon.</text>
			</paragraph><paragraph id="idAC8902BEB40A432B8CC103FE63FF19AA"><enum>(3)</enum><header>Maps</header><text>The
			 term <quote>maps</quote> means the maps filed under section 3(d)</text>
			</paragraph><paragraph id="id3A154EEF61574CBCB611F0EE24182E7B"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id1A7EC3A89E9A4101BF01526E26466F3D"><enum>(5)</enum><header>Tribes</header><text>The
			 Term <quote>Tribes</quote> means the Confederated Tribes of the Coos, Lower
			 Umpqua, and Siuslaw Indians in the State of Oregon.</text>
			</paragraph></section><section id="id56743A34E5BA49EF975ECAF745720A11"><enum>3.</enum><header>Transfer of
			 administrative jurisdiction</header>
			<subsection id="ID92d82957df77483c955712d0290f5a2f"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act and subject to subsection (c), the Commandant shall transfer to the
			 Secretary, to hold in trust for the benefit of the Tribes, administrative
			 jurisdiction over the Federal land described in subsection (b).</text>
			</subsection><subsection id="id2522F556312C4D93B65E10363734FB54"><enum>(b)</enum><header>Description of
			 land</header><text>The Federal land referred to in subsection (a) consists of
			 the parcels of Coast Guard land (including any improvements to the land)
			 comprising approximately 24 acres, located in Coos County, Oregon, in the areas
			 commonly known as <quote>Gregory Point</quote> and <quote>Chief's
			 Island</quote>, as depicted on the maps.</text>
			</subsection><subsection id="IDd16ff51aa0844ef8968754291d887b99"><enum>(c)</enum><header>Conditions</header>
				<paragraph id="ID066ed469abdd4fff85ece6dd52509167"><enum>(1)</enum><header>Compliance with
			 applicable law</header><text>Before completing the transfer of administrative
			 jurisdiction under subsection (a), the Commandant shall execute any actions
			 required to comply with applicable environmental and cultural resources
			 laws.</text>
				</paragraph><paragraph id="IDd13d490a87fb46de8d5423124e79e78e"><enum>(2)</enum><header>Trust
			 status</header><text>On transfer of administrative jurisdiction over the land
			 under subsection (a), the land transferred to the Secretary shall be—</text>
					<subparagraph id="id88F2B279EC3E4B50885EE7827C4DFF6A"><enum>(A)</enum><text>held in trust by
			 the United States for the Tribes; and</text>
					</subparagraph><subparagraph id="idD58CD24698C0468EBEFD78423F9C4D3C"><enum>(B)</enum><text>included in the
			 reservation of the Tribes.</text>
					</subparagraph></paragraph><paragraph id="IDb38eee3a0b214b56b50ec9e9089acd4e"><enum>(3)</enum><header>Maintenance of
			 Cape Arago Light Station</header>
					<subparagraph id="IDefd478ac692149bba8f47c3c1b37c9c5"><enum>(A)</enum><header>In
			 general</header><text>The transfer of administrative jurisdiction over the
			 Light Station under subsection (a) shall be subject to the conditions that the
			 Tribes—</text>
						<clause id="IDd907d5bd49d7442595dd90197ade03d5"><enum>(i)</enum><text>shall—</text>
							<subclause id="id1DD832278CFF443B9844B0191A504B8A"><enum>(I)</enum><text>use, and make
			 reasonable efforts to maintain, the Light Station in accordance with—</text>
								<item id="id2791530169B14EF7B46C923CCA7C3C5F"><enum>(aa)</enum><text>the
			 National Historic Preservation Act (16 U.S.C. 470 et seq.);</text>
								</item><item id="id16B94F8D978E41A4A1DD9B821EF0F66A"><enum>(bb)</enum><text>the
			 Secretary of the Interior's Standards for the Treatment of Historic Properties
			 under part 68 of title 36, Code of Federal Regulations; and</text>
								</item><item id="id1E0AADFF5DD74ABA995A412F241A8FE8"><enum>(cc)</enum><text>any
			 other applicable laws; and</text>
								</item></subclause><subclause id="id0B3CABC44A3A42E7BEF43FC70B62B0BB"><enum>(II)</enum><text>submit any
			 proposed changes to the Light Station for review and approval by the Secretary,
			 in consultation with the Oregon State Historic Preservation Officer, if the
			 Secretary determines that the changes are consistent with—</text>
								<item id="id6BF478E1E6EE421C88C9CA6AF484208B"><enum>(aa)</enum><text>section
			 800.5(a)(2)(vii) of title 36, Code of Federal Regulations; and</text>
								</item><item id="id1D225DD5DB424473B6DFABB165EE99E4"><enum>(bb)</enum><text>the
			 Secretary of the Interior's Standards for Rehabilitation under section 67.7 of
			 title 36, Code of Federal Regulations;</text>
								</item></subclause></clause><clause id="IDa94483848603432fb99b70d626275db8"><enum>(ii)</enum><text>shall make the
			 Light Station available to the general public for educational, park,
			 recreational, cultural, or historic preservation purposes at times and under
			 conditions determined to be reasonable by the Secretary;</text>
						</clause><clause id="IDc3a559ba8d8942839129d870b9c01fd9"><enum>(iii)</enum><text>shall
			 not—</text>
							<subclause id="id4C81259822FD4B7DBAD4353D7CAFBF01"><enum>(I)</enum><text>sell, convey,
			 assign, exchange, or encumber the Cape Arago Light Station (or any part of the
			 Light Station) or any associated historic artifact conveyed in conjunction with
			 the transfer under subsection (a), unless the sale, conveyance, assignment,
			 exchange, or encumbrance is approved by Secretary; or</text>
							</subclause><subclause id="ID517ba5a919de4d8cbaab857ff07f256e"><enum>(II)</enum><text>conduct any
			 commercial activities at the Cape Arago Light Station (or any part of the Light
			 Station) or in connection with any historic artifact conveyed in conjunction
			 with the transfer under subsection (a) in any manner, unless the commercial
			 activities are approved by the Secretary; and</text>
							</subclause></clause><clause id="ID4f5e2d0627134c4e9f5f2f521681de19"><enum>(iv)</enum><text>shall allow the
			 United States, at any time, to enter the Light Station without notice, for
			 purposes of ensuring compliance with this section, to the extent that it is not
			 practicable to provide advance notice.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5915324774fc412180f38e8bf8c573a5"><enum>(B)</enum><header>Reversion</header><text>If
			 the Tribes fail to meet any condition described in subparagraph (A), the Light
			 Station, or any associated historic artifact conveyed in conjunction with the
			 transfer under subsection (a), shall, at the option of the Secretary—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7064D5D9A7984F7A8884904E131922DE"><enum>(i)</enum><text>revert to the
			 United States; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id72EC9E2F5B7E49088F34C317A65DD404"><enum>(ii)</enum><text>be placed under
			 the administrative control of the Secretary.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID956b9902263a4f9bae363e3892de0ffa"><enum>(d)</enum><header>Maps and legal
			 descriptions</header>
				<paragraph id="ID8b908ec1043045acbfba5bca29b4c47a"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Commandant shall file the maps entitled <quote>Confederated
			 Tribes of the Coos, Lower Umpqua, and Siuslaw Land Transfer Maps</quote> and
			 legal descriptions of the parcels to be transferred under subsection (a)
			 with—</text>
					<subparagraph id="ID034f1669b21647f48360d1ae0208e6f2"><enum>(A)</enum><text>the Committee on
			 Commerce, Science, and Transportation of the Senate;</text>
					</subparagraph><subparagraph id="ID0ecaf7b601db409985a1802a120a293f"><enum>(B)</enum><text>the Committee on
			 Transportation and Infrastructure of the House of Representatives; and</text>
					</subparagraph><subparagraph id="ID301eabb16c6a43f89f684daf107d19bd"><enum>(C)</enum><text>the
			 Secretary.</text>
					</subparagraph></paragraph><paragraph id="ID9cb99774a8864ad28d0851fea9b803e0"><enum>(2)</enum><header>Force of
			 law</header><text>The maps and legal descriptions filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Commandant may correct any errors in the maps and legal
			 descriptions.</text>
				</paragraph><paragraph id="ID2f334c1ae282421bb5560b90a3eddcae"><enum>(3)</enum><header>Availability</header><text>Each
			 map and legal description filed under paragraph (1) shall be on file and
			 available for public inspection in the appropriate office of the Department of
			 the Interior.</text>
				</paragraph></subsection><subsection id="ID4ababebf7448488282949bbb488e6500"><enum>(e)</enum><header>Easements</header><text>The
			 Coast Guard may retain easements or other property interests as may be
			 necessary across the property described in subsection (b) to operate, maintain,
			 relocate, install, improve, replace, or remove any aid to navigation located on
			 the land for such period as the aid to navigation may be required by the Coast
			 Guard.</text>
			</subsection><subsection id="ID9b06f7b03a424e22b6d29e0235267c23"><enum>(f)</enum><header>Tribal fishing
			 rights</header><text>No fishing rights of the Tribes that are in existence on
			 the date of enactment of this Act shall be enlarged, impaired, or otherwise
			 affected by the transfer of administrative jurisdiction under subsection
			 (a).</text>
