									<subparagraph commented="no" display-inline="no-display-inline" id="idBC509DFB1D06480DA9FC9EEE28DA6AE0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>affected unit</term> means
				an electric generating facility that—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDe2dcf8c2340544aea4f2a7259aeca242"><enum>(i)</enum><text display-inline="yes-display-inline">has a nameplate capacity greater than 25
				megawatts;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id79DBFE5A63CA4B68AB403009A2734520"><enum>(ii)</enum><text display-inline="yes-display-inline">combusts greenhouse gas-emitting fuels;
				and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDeeb41e4fe7bf46359c3b8240d251ba6f"><enum>(iii)</enum><text display-inline="yes-display-inline">generates electricity for sale.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF097D17C7F6D4BE0890AEDBF9D02EEC4"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <quote>affected unit</quote>
				includes—</text>
										<clause commented="no" display-inline="no-display-inline" id="idDDAB9A6E0AC94ECEB90E5723981FB09D"><enum>(i)</enum><text display-inline="yes-display-inline">a cogeneration facility; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id76A42835F57944D495D9059390C430B1"><enum>(ii)</enum><text display-inline="yes-display-inline">a facility owned or operated by any
				instrumentality of—</text>
											<subclause commented="no" display-inline="no-display-inline" id="idD1CAA9ED985D4A628D142DABCCC4A0E5"><enum>(I)</enum><text display-inline="yes-display-inline">the Federal Government; or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="idC6F7D8AA53B547F8AD629348A9E51B14"><enum>(II)</enum><text display-inline="yes-display-inline">any State, local, or tribal
				government.</text>
											</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID35be29be1c834eb9ab81644c569b8f15"><enum>(2)</enum><header display-inline="yes-display-inline">Afforestation</header><text display-inline="yes-display-inline">The term <term>affor­es­ta­tion</term>
				means the conversion to a forested condition of land that has been in a
				nonforested condition for at least 15 years.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID97c410a0ceb5483cae1404c95301d196"><enum>(3)</enum><header display-inline="yes-display-inline">Allocation</header><text display-inline="yes-display-inline">The term <term>allocation</term>, with
				respect to an allowance, means the issuance of an allowance directly to covered
				units, at no cost, under this title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10dd6cc09a9e4769a78da42fb4f1e0a8"><enum>(4)</enum><header display-inline="yes-display-inline">Allowance</header><text display-inline="yes-display-inline">The term <term>allowance</term> means an
				authorization under this title to emit 1 metric ton of carbon dioxide (or a
				carbon dioxide equivalent), as allocated to a covered unit pursuant to section
				716.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe850f257e11f4238916194602270a265"><enum>(5)</enum><header display-inline="yes-display-inline">Carbon dioxide equivalent</header><text display-inline="yes-display-inline">The term <term>carbon dioxide
				equivalent</term> means, with respect to a greenhouse gas, the quantity of the
				greenhouse gas that makes the same contribution to global warming as 1 metric
				ton of carbon dioxide, as determined by the Administrator.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8e55785912934045a86bc42eddb0bf58"><enum>(6)</enum><header display-inline="yes-display-inline">Cogeneration facility</header><text display-inline="yes-display-inline">The term <term>cogeneration facility</term>
				means a facility that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID442d5163253742249421d2dbe8165df6"><enum>(A)</enum><text display-inline="yes-display-inline">cogenerates steam and electricity;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2dde6dcc0b34b39a0cce0496989a43c"><enum>(B)</enum><text display-inline="yes-display-inline">supplies, on a net annual basis, to the
				electric power grid—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID7f5f8923f08044cbbdbe5d8dc0ea3ffa"><enum>(i)</enum><text display-inline="yes-display-inline">more than <fraction>1/3</fraction> of the
				potential electric output capacity of the facility; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID9a2bd1266b4046e398cb528950e87cc8"><enum>(ii)</enum><text display-inline="yes-display-inline">more than 25 megawatts of electrical output
				from the facility.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8514d774729b4bccab1382c0cf7d20b1"><enum>(7)</enum><header display-inline="yes-display-inline">Covered unit</header><text display-inline="yes-display-inline">The term <term>covered unit</term>
				means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID8e3316a6af50450895e33b2b62fea054"><enum>(A)</enum><text display-inline="yes-display-inline">an affected unit;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfd191d92f4f74f5898a563de3dc809da"><enum>(B)</enum><text display-inline="yes-display-inline">a nuclear generating unit (including a
				facility owned or operated by any instrumentality of the Federal Government or
				of any State, local, or tribal government), but only to the extent of
				incremental nuclear generation of the unit; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID565a7c70ca1a4e8195551ca26b99e490"><enum>(C)</enum><text display-inline="yes-display-inline">a renewable energy unit (including a
				facility owned or operated by any instrumentality of the Federal Government or
				of any State, local, or tribal government).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A2CDA4619A74CD79C16D8CF43670A2F"><enum>(8)</enum><header display-inline="yes-display-inline">Credit</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID6cc5d8c3a2ec461790eac7d9b983bb02"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>credit</term> means an
				authorization under this title to emit greenhouse gases equivalent to 1 metric
				ton of carbon dioxide.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7ac9a9dbcd0a46e488d57980f0cf4c2f"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>credit</term>
				includes—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID85806ae6bc0e473ead92cd7724683996"><enum>(i)</enum><text display-inline="yes-display-inline">an allowance;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDc5daf998706c48a786ca1dfc00e8dbfa"><enum>(ii)</enum><text display-inline="yes-display-inline">an offset credit;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID3f02febe6da649499cf3abce91d04f51"><enum>(iii)</enum><text display-inline="yes-display-inline">an early reduction credit; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID604b75d6d8b646b39cb9e85dd712b8b5"><enum>(iv)</enum><text display-inline="yes-display-inline">an international credit.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa874bbb51cc0498fa1840299746ed327"><enum>(9)</enum><header display-inline="yes-display-inline">Early reduction credit</header><text display-inline="yes-display-inline">The term <term>early reduction
				credit</term> means a credit issued under section 718 for a reduction in the
				quantity of emissions or an increase in sequestration equivalent to 1 metric
				ton of carbon dioxide.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C5293704DAC4CB5B55587658C1773B1"><enum>(10)</enum><header display-inline="yes-display-inline">Fund</header><text display-inline="yes-display-inline">The term <term>Fund</term> means the
				Climate Action Trust Fund established by section 717(a)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDec7e3756ad5b424bbbcf44e225eff71b"><enum>(11)</enum><header display-inline="yes-display-inline">Greenhouse
				gas</header><text display-inline="yes-display-inline">The term <term>greenhouse
				gas</term> means—</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5cb771507e34429ea89d54f525a5df2d"><enum>(B)</enum><text display-inline="yes-display-inline">methane;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0c54c714a1e048a783fce622fa232d49"><enum>(C)</enum><text display-inline="yes-display-inline">nitrous oxide;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb62c203fbac444c5a20db193791f0c82"><enum>(D)</enum><text display-inline="yes-display-inline">hydrofluorocarbons;</text>

				representative</header><text display-inline="yes-display-inline">The term
				<term>greenhouse gas authorized account representative</term> means, for a
				covered unit, an individual who is authorized by the owner and operator of the
				covered unit to represent and legally bind the owner and operator in matters
				pertaining to this title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe627e947d8984358994ff6977a706774"><enum>(13)</enum><header display-inline="yes-display-inline">Greenhouse gas-emitting fuel</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id8237D681BFCE44349F95E96F51FE6A8D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>greenhouse gas-emitting
				fuel</term> means any fuel that produces a greenhouse gas as a combustion
				product.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E2979BD5F1149BCB65B22CA2EA8AA49"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>greenhouse gas-emitting
				fuel</term> includes—</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="idE02CBAAA296E45BCB10DBE6B9548671D"><enum>(ii)</enum><text display-inline="yes-display-inline">municipal waste;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idF031E15179CB4E658C5B97306204E28E"><enum>(iii)</enum><text display-inline="yes-display-inline">industrial waste;</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC115D5424F34E5AB68F4113B8E73A09"><enum>(C)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>greenhouse gas-emitting
				fuel</term> does not include biomass that is grown using sustainable
				techniques.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0d35dc6ed22e4584a30e0ab894694b68"><enum>(14)</enum><header display-inline="yes-display-inline">Incremental nuclear
				generation</header><text display-inline="yes-display-inline">The term
				<term>incremental nuclear generation</term> means, as determined by the
				Administrator and measured in megawatt hours, the difference between—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID2929d8efae7e458c88968fdde864c02c"><enum>(A)</enum><text display-inline="yes-display-inline">the quantity of electricity generated by a
				nuclear generating unit in a calendar year; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9c56a01dd0d84c419f3dbb6139d75605"><enum>(B)</enum><text display-inline="yes-display-inline">the quantity of electricity generated by
				the nuclear generating unit in calendar year 1990.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84ACDF30004744B099F91EC0E02A8DF1"><enum>(15)</enum><header display-inline="yes-display-inline">Industry sector</header><text display-inline="yes-display-inline">The term <term>industry sector</term> means
				any sector of the economy of a country (including, where applicable, the
				forestry sector) that is responsible for significant quantities of greenhouse
				gas emissions.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83aedc25f20b4758aef48b19f41c5853"><enum>(16)</enum><header display-inline="yes-display-inline">International credit</header><text display-inline="yes-display-inline">The term <term>international credit</term>
				means a credit recognized for a reduction in the quantity of emissions or an
				increase in sequestration equivalent to 1 metric ton of carbon dioxide
				that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idEB259F0F023B45719D83944225784A80"><enum>(A)</enum><text display-inline="yes-display-inline">arises from activities outside the United
				States; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4437936258804B33B0B8A0B3523EF76A"><enum>(B)</enum><text display-inline="yes-display-inline">is authorized for use under section
				719.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcc0cd25412eb4bc1991bb5c58ab9feb4"><enum>(17)</enum><header display-inline="yes-display-inline">Invasive species</header><text display-inline="yes-display-inline">The term <term>invasive species</term>
				means a species (including pathogens, seeds, spores, or any other biological
				material relating to a species) the introduction of which causes or is likely
				to cause economic or environmental harm or harm to human health.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2292b6b873c54ebba20a29f83f97ff99"><enum>(18)</enum><header display-inline="yes-display-inline">Land-grant colleges and
				universities</header><text display-inline="yes-display-inline">The term
				<term>land-grant colleges and universities</term> has the meaning given the
				term in section 1404 of the National Agricultural Research, Extension, and
				Teaching Policy Act of 1977 (7 U.S.C. 3103).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa45f8053faa4ad9aad0bfc93ea7264d"><enum>(19)</enum><header display-inline="yes-display-inline">Leakage</header><text display-inline="yes-display-inline">The term <term>leakage</term> means an
				increase in greenhouse gas emissions or a decrease in sequestration of
				greenhouse gases that is—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id90706E5D13D84303ACE8DCDF18BEBEE7"><enum>(A)</enum><text display-inline="yes-display-inline">outside the area of a project; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC76F08BF4F34C85A2D060E3E30BB20B"><enum>(B)</enum><text display-inline="yes-display-inline">attributable to the project.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98fa263cc8fd40c38625fe59c437a0ef"><enum>(20)</enum><header display-inline="yes-display-inline">Native plant</header><text display-inline="yes-display-inline">The term <term>native plant</term> means an
				indigenous, terrestrial, or aquatic plant species that evolved naturally in an
				ecosystem.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53bdaed5cc934ea685b2313978620581"><enum>(21)</enum><header display-inline="yes-display-inline">New affected unit</header><text display-inline="yes-display-inline">The term <term>new affected unit</term>
				means an affected unit that has operated for not more than 3 years.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCABD84FEEEF44960996EFBFFFCEA5BD4"><enum>(22)</enum><header display-inline="yes-display-inline">New covered unit</header><text display-inline="yes-display-inline">The term <term>new covered unit</term>
				means a covered unit that has operated for not more than 3 years.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc6182249a43b46b4a7d8b42632da41f7"><enum>(23)</enum><header display-inline="yes-display-inline">Noxious weed</header><text display-inline="yes-display-inline">The term <term>noxious weed</term> means a
				plant species that is—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idABD3790EAF5045B690AD4972EC678B08"><enum>(A)</enum><text display-inline="yes-display-inline">characterized by being—</text>
										<clause commented="no" display-inline="no-display-inline" id="id6072F666086B4C42B4B7841407820F08"><enum>(i)</enum><text display-inline="yes-display-inline">aggressive and difficult to manage;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idEEF38969DB8741A6B878BCC01909DE0C"><enum>(ii)</enum><text display-inline="yes-display-inline">poisonous, toxic, parasitic, or a carrier
				or host of insects or disease representing a serious threat to native species
				or crops; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id22EF507F6DEF44F496F7782EE6467A66"><enum>(iii)</enum><text display-inline="yes-display-inline">nonnative to, new to, or not common to, the
				United States (or a region of the United States); or</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3A7073A3D3BF4AC8A231C425124EBC18"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise designated as a noxious weed by
				the Secretary of Agriculture or an appropriate State official.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0e403f420b574087b3533068332d08e3"><enum>(24)</enum><header display-inline="yes-display-inline">Nuclear generating unit</header><text display-inline="yes-display-inline">The term <term>nuclear generating
				unit</term> means an electric generating facility that uses nuclear energy to
				generate electricity for sale.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID09bf17ddb1f94431a1ce2e86bb66995f"><enum>(25)</enum><header display-inline="yes-display-inline">Offset credit</header><text display-inline="yes-display-inline">The term <term>offset credit</term> means a
				credit issued for an offset project pursuant to subtitle B certifying a
				reduction in the quantity of emissions or an increase in sequestration
				equivalent to 1 metric ton of carbon dioxide.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14db7ffdffef4594938e0a4a11b9806b"><enum>(26)</enum><header display-inline="yes-display-inline">Offset practice</header><text display-inline="yes-display-inline">The term <term>offset practice</term> means
				a practice that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idF601D9282CFD4E58932EF9C9EE4D39F1"><enum>(A)</enum><text display-inline="yes-display-inline">reduces greenhouse gas emissions or
				increases sequestration other than by reducing the combustion of greenhouse
				gas-emitting fuel at an affected unit; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2DFBF416DCA4DADBC373CF7C5AAAAA4"><enum>(B)</enum><text display-inline="yes-display-inline">may be eligible to create an offset credit
				under this title.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID436264ff3ab447fcb383b3670de61054"><enum>(27)</enum><header display-inline="yes-display-inline">Offset
				project</header><text display-inline="yes-display-inline">The term <term>offset
				project</term> means a project that reduces greenhouse gas emissions or
				increases sequestration of carbon dioxide or a carbon dioxide equivalent by a
				method other than reduction of combustion of greenhouse gas-emitting fuel at an
				affected unit.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4D96D19D14F743A2AF91367620FCC9C8"><enum>(28)</enum><header display-inline="yes-display-inline">Panel</header><text display-inline="yes-display-inline">The term <term>Panel</term> means the
				Climate Science Advisory Panel established by section 712(b)(1).</text>

				means an electric generating unit that exclusively uses renewable energy to
				generate electricity for sale.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDddf8d50ad8604534aaf68696f23f5878"><enum>(32)</enum><header display-inline="yes-display-inline">Restoration</header>

				assisting the recovery of an ecosystem that has been degraded, damaged, or
				destroyed.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF6375A3BDA39424081B1346E5B121617"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>restoration</term> includes
				the reestablishment in an ecosystem of preexisting biotic integrity with
				respect to species composition and community structure.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd60b58b0755c4bb7a2abb47c95eba777"><enum>(33)</enum><header display-inline="yes-display-inline">Sequestration</header><text display-inline="yes-display-inline">The term <term>sequestration</term> means
				the separation, isolation, or removal of greenhouse gases from the
				atmosphere.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53b1079077e14845a8352f0bc067ba02"><enum>(34)</enum><header display-inline="yes-display-inline">Sequestration flow</header><text display-inline="yes-display-inline">The term <term>sequestration flow</term>
				means the uptake of greenhouse gases each year from sequestration practices, as
				calculated under section 732.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5440301b516403c951c833cd17450fa"><enum>(35)</enum><header display-inline="yes-display-inline">Sustainable technique</header><text display-inline="yes-display-inline">The term <term>sustainable technique</term>
				means an agricultural, forestry, or animal husbandry technique that does not
				result in—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idC3AB39ED85C843558729585E3D08FDFE"><enum>(A)</enum><text display-inline="yes-display-inline">a long-term net depletion of natural
				resources; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84342DA0B891454F83B744A87E50B927"><enum>(B)</enum><text display-inline="yes-display-inline">a net emission of greenhouse gas during the
				lifecycle of biomass production, harvest, processing, and consumption.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe1bbc86349cb409ebca7caa0a7ed93b4"><enum>(36)</enum><header display-inline="yes-display-inline">UNFCCC</header><text display-inline="yes-display-inline">The term <term>UNFCCC</term> means the

								</paragraph></section><subtitle commented="no" id="id3775B83A7AC64D1197B96F1B59CE758C" level-type="subsequent" style="OLC"><enum>A</enum><header display-inline="yes-display-inline">Stopping and reversing greenhouse gas
				emissions</header>
								<section commented="no" display-inline="no-display-inline" id="idF2A101E46DD24FF280858EE93D39F9A8" section-type="subsequent-section"><enum>711.</enum><header display-inline="yes-display-inline">Regulations; greenhouse gas tonnage
				limitation</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID863a1a92312a4c97a9a876ff65335c65"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				establish an allowance trading program to address emissions of greenhouse gases
				from affected units in the United States.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID66c506b68d924fb7aa8eee3715f6d71e"><enum>(b)</enum><header display-inline="yes-display-inline">Greenhouse gas tonnage
				limitation</header><text display-inline="yes-display-inline">Beginning in
				calendar year 2011, the annual tonnage limitation for the aggregate quantity of
				emissions of greenhouse gases from affected units in the United States shall be
				equal to—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID702107fbd3b9427c90c20e1803d051eb"><enum>(1)</enum><text display-inline="yes-display-inline">for each of calendar years 2011 through
				2014, the aggregate quantity of emissions emitted from affected units in
				calendar year 2006, as determined by the Administrator based on certified and
				quality-assured continuous emissions monitoring data for greenhouse gases, or
				data that the Administrator determines to be of similar reliability for
				affected units without continuous monitoring systems, reported to the
				Administrator by affected units in accordance with this subtitle;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0e369efc864a4eba987e5f99f11de650"><enum>(2)</enum><text display-inline="yes-display-inline">for calendar year 2015, the aggregate
				quantity of emissions emitted from affected units in calendar year 2001, as
				determined by the Administrator based on certified and quality-assured
				continuous emissions monitoring data for greenhouse gases, or data that the
				Administrator determines to be of similar reliability for affected units
				without continuous monitoring systems, reported to the Administrator by
				affected units in accordance with this subtitle;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf12d78bc3b8145f6bd6f51c0ce937919"><enum>(3)</enum><text display-inline="yes-display-inline">for each of calendar years 2016 through
				2019, the aggregate quantity of emissions emitted from affected units during
				the calendar year that is 1 percent less than the aggregate quantity of
				emissions from affected units allowed pursuant to this section during the
				preceding calendar year; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0bfeec312c9b402190657ad8e7b060d2"><enum>(4)</enum><text display-inline="yes-display-inline">for calendar year 2020 and each calendar
				year thereafter, the aggregate quantity of emissions emitted during the
				calendar year that is 1.5 percent less than the aggregate quantity of emissions
				from affected units allowed pursuant to this section during the preceding
				calendar year, except as modified by the Administrator pursuant to section
				713.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID4a38f73938ed42c68f6421b7ec4d74b4" section-type="subsequent-section"><enum>712.</enum><header display-inline="yes-display-inline">Scientific review of the safe climate
				level</header>
									<subsection commented="no" display-inline="no-display-inline" id="id5235DD2881BF40BE90788F14E4D87D92"><enum>(a)</enum><header display-inline="yes-display-inline">Definition and objective of maintaining the
				safe climate level</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id414D6ED4205E4E09B4635EDF19294BF0"><enum>(1)</enum><header display-inline="yes-display-inline">Finding</header><text display-inline="yes-display-inline">Congress finds that ratification by the
				Senate in 1992 of the UNFCCC, commitments which were affirmed by the President
				in 2002, established for the United States an objective of <quote>stabilization
				of greenhouse gas concentrations in the atmosphere at a level that would
				prevent dangerous anthropogenic interference with the climate
				system</quote>.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC729FE05424F477AAC6533F157A79DAC"><enum>(2)</enum><header display-inline="yes-display-inline">Definition of safe climate
				level</header><text display-inline="yes-display-inline">In this section, the
				term <term>safe climate level</term> means the climate level referred to in
				paragraph (1).</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE019797F2C1642C790B6674F3DB6C798"><enum>(b)</enum><header display-inline="yes-display-inline">Climate Science Advisory Panel</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id1E92412729ED42A9B397F6ED26348EA3"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
				enactment of this title, the Administrator shall establish an advisory panel,
				to be known as the <quote>Climate Science Advisory Panel</quote>.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF3AF5755D2FF45FFA422625FE3ACC512"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Panel shall—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id6D90B30D875E4980AD79943649C72E55"><enum>(A)</enum><text display-inline="yes-display-inline">inform Congress and the Administrator of
				the state of climate science;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA99BAD4D8EB441D297F911BF81932225"><enum>(B)</enum><text display-inline="yes-display-inline">not later than December 31, 2011, and not
				less frequently than every 4 years thereafter, issue a report that is endorsed
				by at least 7 members of the Panel that describes recommendations for the
				Administrator, based on the best available information in the fields of climate
				science, including reports from the Intergovernmental Panel on Climate Change,
				relating to—</text>
												<clause commented="no" display-inline="no-display-inline" id="idFEA946A90B8B4FF9B22EB30E0579DE4D"><enum>(i)</enum><text display-inline="yes-display-inline">the specific concentration, in parts per
				million, of all greenhouse gases in carbon dioxide equivalents at or below
				which constitutes the safe climate level; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="idAA867CED68D64266AB18FE9E9025B8E2"><enum>(ii)</enum><text display-inline="yes-display-inline">the projected timeframe for achieving the
				safe climate level.</text>
												</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA042A3670E5F47BEB40E10E5150BFE36"><enum>(3)</enum><header display-inline="yes-display-inline">Composition</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id748DD83BA3694CB8BC14082CF9F822FA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Panel shall be composed of 8 climate
				scientists and 3 former Federal officials, as described in subparagraphs (B)
				through (D).</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1B6E1A5E14EC47B4866097F2FD6168DA"><enum>(B)</enum><header display-inline="yes-display-inline">Climate scientists</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
				enactment of this title, the President of the National Academy of Sciences
				shall appoint to serve on the Panel 8 climate scientists from among individuals
				who—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID73392aa16bf149288a43df5d8ce28ac7"><enum>(i)</enum><text display-inline="yes-display-inline">have earned doctorate degrees;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="idC9EFB964E77B400A83D4185F380B7111"><enum>(ii)</enum><text display-inline="yes-display-inline">have performed research in physical,
				biological, or social sciences, mathematics, economics, or related fields, with
				a particular focus on or link to 1 or more aspects of climate science;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDf4162ae9505648c79fd94eb70515df45"><enum>(iii)</enum><text display-inline="yes-display-inline">have records of peer-reviewed publications
				that include—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID0cd938715ed34fbc871631e0278c0973"><enum>(I)</enum><text display-inline="yes-display-inline">publications in main-stream, high-quality
				scientific journals (such as journals associated with respected scientific
				societies or those with a high impact factor, as determined by the Institute
				for Scientific Information);</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID98fe1d953fd7497587a3a6d1626fe80c"><enum>(II)</enum><text display-inline="yes-display-inline">recent publications relating to earth
				systems, and particularly relating to the climate system; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0f5604db54214f3aa1de625b0ad6ff21"><enum>(III)</enum><text display-inline="yes-display-inline">a high publication rate, typically at least
				2 or 3 papers per year; and</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDb9d24f2da25a4fb9816e78e5a0baefd4"><enum>(iv)</enum><text display-inline="yes-display-inline">have participated in high-level committees,
				such as those formed by the National Academy of Sciences or by leading
				scientific societies.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3cf79701e3504b9b9a51eeb6a4778b0f"><enum>(C)</enum><header display-inline="yes-display-inline">Restriction</header><text display-inline="yes-display-inline">A majority of climate scientists appointed
				to the Panel under subparagraph (B) shall be participating, as of the date of
				appointment to the Panel, in active research in the physical or biological
				sciences, with a particular focus on or link to 1 or more aspects of climate
				science.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa78d50cc8be74abd9960dcada0a9d604"><enum>(D)</enum><header display-inline="yes-display-inline">Federal officials</header>
												<clause commented="no" display-inline="no-display-inline" id="idE771E42FF071429A90C0F81E0E03378D"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to clause (ii), the Administrator
				shall appoint as members of the Panel, the longest-serving former
				Administrators of the Environmental Protection Agency for each of the 3 most
				recent former Presidents.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id0D2622283AAF403796174C30DA75BD90"><enum>(ii)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">The 3 most recent former Presidents
				described in clause (i) shall be identified as of the deadline for appointments
				to the Panel under subparagraph (B) or (E)(ii), whichever is applicable.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID0eb2b97f6c4740e19bf256769c84c1bb"><enum>(iii)</enum><header display-inline="yes-display-inline">Substitutes</header><text display-inline="yes-display-inline">If a former Administrator described in
				clause (i) declines appointment, or is unable to serve, as a member of the
				Panel, the Administrator shall appoint in place of the former
				Administrator—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID55bd15d8109d4ad8b24667fb537109bf"><enum>(I)</enum><text display-inline="yes-display-inline">the longest-serving former Administrator
				for the applicable President who agrees to serve; or</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9755b1a36ba04a6f9228c4c9b44f9357"><enum>(II)</enum><text display-inline="yes-display-inline">if no individual described in subclause (I)
				accepts appointment as a member of the Panel, the longest-serving Assistant
				Administrator for Air and Radiation for the applicable President who agrees to
				serve.</text>
													</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe5dd418d088f4862851a3a8f9b866d32"><enum>(E)</enum><header display-inline="yes-display-inline">Terms of service and vacancies</header>
												<clause commented="no" display-inline="no-display-inline" id="ID0bfad14429cb49d1a9db5898df3312d7"><enum>(i)</enum><header display-inline="yes-display-inline">Terms</header><text display-inline="yes-display-inline">The initial term of a member of the Panel
				shall be—</text>
													<subclause commented="no" display-inline="no-display-inline" id="id7AE5212B672C4A5090797EF6E953BD63"><enum>(I)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, the
				period covered by, and extending through the date of issuance of, each report
				under paragraph (2)(B); but</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="id31308A53018B41D89476909FA2F4E08F"><enum>(II)</enum><text display-inline="yes-display-inline">not longer than 4 years.</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDfca4ea98edaa42f4a0821dbb5c7371ce"><enum>(ii)</enum><header display-inline="yes-display-inline">Subsequent panels and reports</header><text display-inline="yes-display-inline">On the issuance of each report under
				paragraph (2)(B)—</text>
													<subclause commented="no" display-inline="no-display-inline" id="idEA82D1975DF34BFAA5EE0B045E82DDDD"><enum>(I)</enum><text display-inline="yes-display-inline">the Panel that submitted the report shall
				terminate; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9283fcce464343d897addc6da2070fce"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idF26711C195004482865985947C5E7ECC"><enum>(aa)</enum><text display-inline="yes-display-inline">pursuant to subparagraphs (B) and (C), the
				President of the National Academy of Sciences shall appoint climate scientists
				(including at least 3 climate scientists who served as members of the preceding
				Panel) to serve as members of a new Panel by not later than 15 months after the
				deadline for issuance of the report under paragraph (2)(B); and</text>
														</item><item commented="no" display-inline="no-display-inline" id="id5434BAD8C0BD41B78A952BADD1B26207" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">pursuant to subparagraph (D), the
				Administrator shall appoint 3 Federal officials as members of the new Panel by
				the deadline described in item (aa).</text>
														</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID61f44a71a3e84535ad475f76ff8aeee8"><enum>(iii)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Vacancies in the membership of the
				Panel—</text>
													<subclause commented="no" display-inline="no-display-inline" id="id576E73FD241A422D9298A192EBC49FAE"><enum>(I)</enum><text display-inline="yes-display-inline">shall not affect the power of the remaining
				members to execute the functions of the Panel; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="id3CE780C9AC844E7C9770BFB3C1606898"><enum>(II)</enum><text display-inline="yes-display-inline">shall be filled in the same manner in which
				the original appointment was made.</text>
													</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1100585C2F1C4E12A5E135B43F45A1B5"><enum>(F)</enum><header display-inline="yes-display-inline">Chairperson and vice
				chairperson</header><text display-inline="yes-display-inline">The Panel shall
				elect a Chairperson and Vice Chairperson as soon as practicable.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03C45AFB854F46A5B74053723292B0B4"><enum>(G)</enum><header display-inline="yes-display-inline">Compensation of members</header><text display-inline="yes-display-inline">A member of the Panel shall be compensated
				at a rate equal to the daily equivalent of the annual rate of basic pay
				prescribed for level IV of the Executive Schedule under section 5315 of title
				5, United States Code, for each day (including travel time) during which the
				member is engaged in the performance of the duties of the Panel.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id497E861E6F544B86BAFDF28355B9E30E"><enum>(H)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">A member of the Panel shall be allowed
				travel expenses, including per diem in lieu of subsistence, at rates authorized
				for an employee of an agency under subchapter I of chapter 57 of title 5,
				United States Code, while away from the home or regular place of business of
				the member in the performance of the duties of the Panel.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4DE6D96EE164BFB938A526B49C74E16"><enum>(4)</enum><header display-inline="yes-display-inline">Staff</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="idCFC0FCD3C4C64BD5B20711CA82E8289B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Chairperson of the Panel may, without
				regard to the civil service laws (including regulations), appoint and terminate
				an executive director and such other additional personnel as are necessary to
				enable the Panel to perform the duties of the Panel.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFABD6089463148E095689C27874F7212"><enum>(B)</enum><header display-inline="yes-display-inline">Confirmation of executive
				director</header><text display-inline="yes-display-inline">The employment of an
				executive director shall be subject to confirmation by the Panel.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60C9ACA64E404AC5B89BEA02E142FF28"><enum>(C)</enum><header display-inline="yes-display-inline">Compensation</header>
												<clause commented="no" display-inline="no-display-inline" id="idDFAECF2DACA54F64801C4D208204CDF1"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the
				Chairperson of the Panel may fix the compensation of the executive director and
				other personnel without regard to the provisions of chapter 51 and subchapter
				III of chapter 53 of title 5, United States Code, relating to classification of
				positions and General Schedule pay rates.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="idDE6A3B8398A94F6A904E19C67C45E135"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The rate of pay for the executive director
				and other personnel shall not exceed the rate payable for level V of the
				Executive Schedule under section 5316 of title 5, United States Code.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89231FA2E1464DDEAF10C6EBA9473AD0"><enum>(D)</enum><header display-inline="yes-display-inline">Detail of Federal Government
				employees</header>
												<clause commented="no" display-inline="no-display-inline" id="id41204E06A96C4EC3AB24A9E5BED68AC8"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An employee of the Federal Government may
				be detailed to the staff of the Panel without reimbursement.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id478782E91BDC43C491C6A282F491D9A9"><enum>(ii)</enum><header display-inline="yes-display-inline">Treatment of detailees</header><text display-inline="yes-display-inline">The detail of the employee shall be without
				interruption or loss of civil service status or privilege.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56ACD4CE2ABD4356BF0943B5E68EE657"><enum>(E)</enum><header display-inline="yes-display-inline">Procurement of temporary and intermittent
				services</header><text display-inline="yes-display-inline">The Chairperson or
				executive director of the Panel may procure temporary and intermittent services
				in accordance with section 3109(b) of title 5, United States Code, at rates for
				individuals that do not exceed the daily equivalent of the annual rate of basic
				pay prescribed for level V of the Executive Schedule under section 5316 of that
				title.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE672A4EE4DF492B9E8685D5708E4E92"><enum>(5)</enum><header display-inline="yes-display-inline">Hearings</header><text display-inline="yes-display-inline">The Panel may hold such hearings, meet and
				act at such times and places, take such testimony, and receive such evidence as
				the Panel considers advisable to carry out this section.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60EFBC267F3B44A48BDFF1C0ED1A3E01"><enum>(6)</enum><header display-inline="yes-display-inline">Information from Federal agencies</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id8FD1B1E046254B8EBC800F841E1F62FD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Panel may secure directly from a
				Federal agency such information as the Panel considers necessary to carry out
				this section.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE264FD71A0A74EC6B3DDDDC74AB78832"><enum>(B)</enum><header display-inline="yes-display-inline">Provision of information</header><text display-inline="yes-display-inline">On request of the Chairperson of the Panel,
				the head of the agency shall provide the information to the Panel.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id863340B3F42F406A8EAD55C6B5CF76CA"><enum>(7)</enum><header display-inline="yes-display-inline">Postal services</header><text display-inline="yes-display-inline">The Panel may use the United States mail in
				the same manner and under the same conditions as other agencies of the Federal
				Government.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID81c0b28c09d84eef88c4515ee2ec1bdb" section-type="subsequent-section"><enum>713.</enum><header display-inline="yes-display-inline">Required review of emission reductions
				needed to maintain the safe climate level</header>
									<subsection commented="no" display-inline="no-display-inline" id="id67A4BA708F4F4A97B9F648DBC30D4167"><enum>(a)</enum><header display-inline="yes-display-inline">Review and determination regarding
				reduction rate</header><text display-inline="yes-display-inline">Not later than
				December 31, 2015, the Administrator, after providing public notice and
				opportunity to comment, shall promulgate a final rule pursuant to which the
				Administrator shall review the reduction rate for greenhouse gas emissions
				required under section 711(b)(4) and determine—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="id6CC7F39DF1F4435BA2A95A6402DEFF45"><enum>(1)</enum><text display-inline="yes-display-inline">whether to—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="idEF014F301B0E48CBA49B75B4D675CFB3"><enum>(A)</enum><text display-inline="yes-display-inline">accept the recommendations of the Panel
				under section 712(b)(2)(B) regarding the safe climate level and the timeframe
				for achieving the safe climate level; or</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9409E0BC88C542AC83122BA4C481AF30"><enum>(B)</enum><text display-inline="yes-display-inline">establish a different safe climate level or
				timeframe, together with a detailed explanation of the justification of the
				Administrator for rejection of the recommendations of the Panel; and</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2727D6C6EBE54EDCBA94F839FA5C37B5"><enum>(2)</enum><text display-inline="yes-display-inline">whether, in order to achieve the safe
				climate level within the timeframe described in paragraph (1), the reduction
				rate under section 711(b)(4) is most accurately characterized as
				requiring—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="idEEE364CC03CA481389352EAEB22E34BF"><enum>(A)</enum><text display-inline="yes-display-inline">the appropriate level of emission
				reductions;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A2047FC0A124ACD829166218022691D"><enum>(B)</enum><text display-inline="yes-display-inline">lesser emission reductions than are
				necessary; or</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2006A08C4DCF45EC9714DF332FAAE373"><enum>(C)</enum><text display-inline="yes-display-inline">greater emission reductions than are
				necessary.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA7E2995BF666475DA9B39620639BCD46"><enum>(b)</enum><header display-inline="yes-display-inline">Modification of reduction rate</header>
										<paragraph commented="no" display-inline="no-display-inline" id="idE3AA83E4BD8D4B3B840F60DA5113DEB0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Administrator makes a determination
				described in subparagraph (B) or (C) of subsection (a)(2), the final rule
				promulgated pursuant to subsection (a) shall establish a required level of
				emissions reductions for each calendar year, beginning with calendar year 2020,
				based on the considerations described in paragraph (2).</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9E74932410A84834B4A1AA103E2A46FA"><enum>(2)</enum><header display-inline="yes-display-inline">Considerations</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="idAE9CB966B70E4B068CED1B6EF0F17FE6"><enum>(A)</enum><header display-inline="yes-display-inline">Primary consideration</header><text display-inline="yes-display-inline">In establishing the required level of
				emission reductions pursuant to paragraph (1), the Administrator shall take
				into consideration primarily the emission reductions necessary to stabilize
				atmospheric greenhouse gas concentrations at the safe climate level within the
				timeframe specified under section 712(b)(2)(B).</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd3aa47c3153b41059e05526d7f40c245"><enum>(B)</enum><header display-inline="yes-display-inline">Secondary considerations</header><text display-inline="yes-display-inline">In establishing the required level of
				emission reductions pursuant to paragraph (1), in addition to the primary
				consideration described in paragraph (1), the Administrator shall take into
				consideration—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDac31da7036304d578e6ed4c89c3f72eb"><enum>(i)</enum><text display-inline="yes-display-inline">technological capability to reduce
				greenhouse gas emissions;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID89b4189ec2b441eda5295cb85136d916"><enum>(ii)</enum><text display-inline="yes-display-inline">the progress that foreign countries have
				made toward reducing their greenhouse gas emissions;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID89e0ebba66ae40719c21fbb414f2c06d"><enum>(iii)</enum><text display-inline="yes-display-inline">the economic impacts within the United
				States of implementing this subtitle, including impacts on the major emitting
				sectors; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID084c4f1acc694c3697dbc59505c0c736"><enum>(iv)</enum><text display-inline="yes-display-inline">the economic impacts within the United
				States of inadequate action.</text>
												</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDef967e5d00f54e3c8745c5406e7821fe"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement provision</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDe72d5b25f9994107b4a6b70dcf5c3579"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Administrator fails to meet a
				deadline for promulgation of any regulation under subsection (a), the
				Administrator shall withhold from allocation to covered units that would
				otherwise be entitled to an allocation of allowances under this subtitle a
				total of 10 percent of the allowances for each covered unit for each year after
				the deadline until the Administrator promulgates the applicable
				regulation.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd50b7a5d279248ecae4811552909d684"><enum>(2)</enum><header display-inline="yes-display-inline">Return of allowances</header><text display-inline="yes-display-inline">On promulgation of a delayed regulation
				described in paragraph (1), the Administrator shall distribute any allowances
				withheld under that paragraph—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id9CA9EB9411974D4EB7C9AE1C28BAB4B3"><enum>(A)</enum><text display-inline="yes-display-inline">among the covered units from which the
				allowances were withheld; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4853D3BAA4FE48EAAD89F3438F1B7054"><enum>(B)</enum><text display-inline="yes-display-inline">in accordance with the applicable formula
				under section 716.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4118D9220E0C4D7A8A9315F67C2B71E1"><enum>(d)</enum><header display-inline="yes-display-inline">Subsequent rulemakings</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id12F3AE18A0D9469DADA2D8D40269BDC2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than December 31, 2019, and every
				4 years thereafter, the Administrator shall promulgate a new final rule
				described in subsection (a) in accordance with this section.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCF9DAABB9DD4452AF470AF18A574090"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
				date</header><text display-inline="yes-display-inline">If a new final rule
				promulgated pursuant to paragraph (1) changes a level of emission reductions
				required under the preceding final rule, the effective date of the new final
				rule shall be January 1 of the calendar year that is 5 years after the deadline
				for promulgation of the new final rule under paragraph (1).</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID1aa1022958624b1f8305e606543c8482" section-type="subsequent-section"><enum>714.</enum><header display-inline="yes-display-inline">Distribution of allowances between auctions
				and allocations; nature of allowances</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID4e0762dceac44444945c789a4910f4cf"><enum>(a)</enum><header display-inline="yes-display-inline">Distribution of allowances between auctions
				and allocations</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDf57df0e982c64f57be49b26844e7426a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, the total quantity
				of allowances to be auctioned and allocated under this subtitle shall be equal
				to the annual tonnage limitation for emissions of greenhouse gases from
				affected units specified in section 711 for the calendar year.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID25944dfb808a401ea4451ec358ce1a8f"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution</header><text display-inline="yes-display-inline">The proportion of allowances to be
				auctioned pursuant to section 715 and allocated pursuant to section 716 for
				each calendar year beginning in calendar year 2011 shall be as follows:</text>

										<paragraph commented="no" display-inline="no-display-inline" id="idF2FA877456AA43029BBF350C042EFAFE"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be considered to be a property
				right; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7304884A796D420BBA13335CCA3B42B2"><enum>(2)</enum><text display-inline="yes-display-inline">may be terminated or limited by the
				Administrator.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe2d9b09b013a4218be69d738fab7c8c9"><enum>(c)</enum><header display-inline="yes-display-inline">No judicial review</header><text display-inline="yes-display-inline">An auction or allocation of an allowance by
				the Administrator shall not be subject to judicial review.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="IDc5461d8bf2a24fadafa3be0762ecab22" section-type="subsequent-section"><enum>715.</enum><header display-inline="yes-display-inline">Auction of allowances</header>
									<subsection commented="no" display-inline="no-display-inline" id="id92FA955B4BEF4BE39832651CE6AD8CAA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall promulgate regulations
				establishing a procedure for the auction of the quantity of allowances
				specified in section 714(a) for each calendar year.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="idDF3917010CAA4B2D8350CCACF7BBA9FA"><enum>(b)</enum><header display-inline="yes-display-inline">Deposit of proceeds</header><text display-inline="yes-display-inline">The Administrator shall deposit all
				proceeds from auctions conducted under this section in the Fund for use in
				accordance with section 717.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="ID0631661ceff54594a08255209154ed92" section-type="subsequent-section"><enum>716.</enum><header display-inline="yes-display-inline">Allocation of allowances</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID7b29e77397384b7a9c5b5a8deb0c743b"><enum>(a)</enum><header display-inline="yes-display-inline">Allocation to new covered units</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDb101d5f904cd4cecae4ad2ec1af7ca3c"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">For each calendar year, the Administrator,
				in consultation with the Secretary of Energy, shall, based on projections of
				electricity output for new covered units, promulgate regulations
				establishing—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id21A3A338F66548FDBA93DD3FCB5ABEE3"><enum>(A)</enum><text display-inline="yes-display-inline">a reserve of allowances to be allocated
				among new covered units for the calendar year; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41CF32F6AE01454090FD5AAFE52EC149"><enum>(B)</enum><text display-inline="yes-display-inline">the methodology for allocating those
				allowances among new covered units.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb865c00f90fd4ea285df04430bace7e8"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The number of allowances allocated under
				paragraph (1) during a calendar year shall be not more than 3 percent of the
				total number of allowances allocated among covered units for the calendar
				year.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ed57b95b6f747a3a9386bee1a36720a"><enum>(3)</enum><header display-inline="yes-display-inline">Unused allowances</header><text display-inline="yes-display-inline">For each calendar year, the Administrator
				shall reallocate to each covered unit any unused allowances from the new unit
				reserve established under paragraph (1) in the proportion that—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID9302667918e74eeb95714af04c6a6dc7"><enum>(A)</enum><text display-inline="yes-display-inline">the number of allowances allocated to each
				covered unit for the calendar year; bears to</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7a204881efd44d94a407d2376e4793e5"><enum>(B)</enum><text display-inline="yes-display-inline">the number of allowances allocated to all
				covered units for the calendar year.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID20bdf30681dc485290142972a9e65fb4"><enum>(b)</enum><header display-inline="yes-display-inline">Allocation to covered units that are not
				new covered units</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID852902b163674a80a58315436b76ffa5"><enum>(1)</enum><header display-inline="yes-display-inline">Timing of allocations</header><text display-inline="yes-display-inline">Subject to subsection (c), the
				Administrator shall allocate allowances among covered units that are not new
				covered units—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID917349dda37c4b84b7979b6b77d75bc9"><enum>(A)</enum><text display-inline="yes-display-inline">not later than December 31, 2007, for
				calendar year 2011; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1a8fbcdada4f471cb2c735b58d084228"><enum>(B)</enum><text display-inline="yes-display-inline">not later than December 31 of calendar year
				2008 and of each calendar year thereafter, for each fourth calendar year that
				begins after that December 31.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDef25714db1cf48398da78234b14734fd"><enum>(2)</enum><header display-inline="yes-display-inline">Allocations</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID0ef0a8cafd7d4bd2ab546c7d85567ea8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (c), the
				Administrator shall allocate to each covered unit that is not a new covered
				unit a quantity of allowances that is equal to the product obtained by
				multiplying—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDf5c0b753de8a4b7c84fe9a0ad9e82f46"><enum>(i)</enum><text display-inline="yes-display-inline">the quantity of allowances available for
				allocation under this subsection; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID0931ac2e7fd0427cbd3c460fc0e2fc9d"><enum>(ii)</enum><text display-inline="yes-display-inline">the quotient obtained by dividing—</text>
													<subclause commented="no" display-inline="no-display-inline" id="IDb9de8740cd614efd8b8dde76f2626530"><enum>(I)</enum><text display-inline="yes-display-inline">the annual average quantity of electricity
				generated by the unit (including only incremental nuclear generation for
				nuclear generating units) during the most recent 3-calendar year period for
				which data is available, updated each calendar year and measured in megawatt
				hours; by</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9e7b0694a3634e10a57a1f4a96f95271"><enum>(II)</enum><text display-inline="yes-display-inline">the difference between—</text>
														<item commented="no" display-inline="no-display-inline" id="id405812562CB44C5D81A3C16447D26175"><enum>(aa)</enum><text display-inline="yes-display-inline">the total of the average quantities
				calculated under subclause (I) for all covered units; and</text>
														</item><item commented="no" display-inline="no-display-inline" id="idC67EFB9313114F4BAE0B0CFE9831725E"><enum>(bb)</enum><text display-inline="yes-display-inline">the quantity of electricity generated by
				all affected units and new affected units that, pursuant to subsection (c), do
				not receive any allowances.</text>
														</item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe59259db2c2b43f8a32cfe3cfcf6f88e"><enum>(B)</enum><header display-inline="yes-display-inline">Quantity to be allocated</header><text display-inline="yes-display-inline">For each calendar year, the quantity of
				allowances allocated under subparagraph (A) to covered units that are not new
				covered units shall be equal to the difference between—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID9b900f920c064cb7a6b992ae4e2e5c60"><enum>(i)</enum><text display-inline="yes-display-inline">the annual tonnage limitation for emissions
				of greenhouse gases from affected units specified in section 711 for the
				calendar year, as modified, if applicable, under section 713; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID973533971bde477b863c3259fef6b43c"><enum>(ii)</enum><text display-inline="yes-display-inline">the quantity of allowances reserved under
				subsection (a) for the calendar year.</text>
												</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB73C76DB5F1E4F5FA11A1A83157C93C6"><enum>(c)</enum><header display-inline="yes-display-inline">Coal-fired affected units and new affected
				units</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id5694E46D893D45B49DFF74C3486389F9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subtitle, no allowance shall be allocated under this subtitle to a coal-fired
				affected unit or a coal-fired new affected unit unless the affected unit or new
				affected unit—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id2C342B72A6E34CE98D90EC29F67D0537"><enum>(A)</enum><text display-inline="yes-display-inline">is powered by qualifying advanced clean
				coal technology, as defined pursuant to paragraph (2); or</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D6B5720F6E14056B322F309B32FEC20"><enum>(B)</enum><text display-inline="yes-display-inline">entered operation before January 1,
				2007.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73364544503B4093BE5E52D4B13BA14B"><enum>(2)</enum><header display-inline="yes-display-inline">Definition of qualifying advanced clean
				coal technology</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id4FAF4F6A168D42ECA79331E84BCB3649"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this title, the Administrator, by regulation, shall define the
				term <term>qualifying advanced clean coal technology</term> with respect to
				electric power generation.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB24026DA4B2B494DBBA0B4A04C0E98E5"><enum>(B)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">In promulgating a definition pursuant to
				subparagraph (A), the Administrator shall ensure that the term <term>qualifying
				advanced clean coal technology</term> reflects advances in available
				technology, taking into consideration—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDda1bfb386cab4d2bb1f70d2cbe5b3a6a"><enum>(i)</enum><text display-inline="yes-display-inline">net thermal efficiency;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDa61123f383074f71be5ebf0d9d93d761"><enum>(ii)</enum><text display-inline="yes-display-inline">measures to capture and sequester carbon
				dioxide; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID89b65864f8a049e1b24d835702798545"><enum>(iii)</enum><text display-inline="yes-display-inline">output-based emission rates for—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID163692592b47486ab4a76674b2ba5633"><enum>(I)</enum><text display-inline="yes-display-inline">carbon dioxide;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9ee925f1b94e4182b526b48b7f201123"><enum>(II)</enum><text display-inline="yes-display-inline">sulfur dioxide;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID97ec14898f624d63ae0f2a732cf2ab0c"><enum>(III)</enum><text display-inline="yes-display-inline">oxides of nitrogen;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd6fb5aa40b7b44a494972bc8e87b62bf"><enum>(IV)</enum><text display-inline="yes-display-inline">filterable and condensable particulate
				matter; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4bdc6fa5b87a4d2389db1381f62e0534"><enum>(V)</enum><text display-inline="yes-display-inline">mercury.</text>
													</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18BFF360C5F94EFC9EA5CAAF51B052F6"><enum>(C)</enum><header display-inline="yes-display-inline">Review and revision</header>
												<clause commented="no" display-inline="no-display-inline" id="idA117731B8A514D2C8C2A4428F468540A"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than July 1, 2009, and each July
				1 of every second year thereafter, the Administrator shall review and, if
				appropriate, revise the definition under subparagraph (A) based on
				technological advances during the preceding 2 calendar years.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id52020AAE4ACC4112BC014A4F41DA02CF"><enum>(ii)</enum><header display-inline="yes-display-inline">Notice and comment required</header><text display-inline="yes-display-inline">Subject to clause (iii), after the initial
				definition is established under subparagraph (A), no subsequent review or
				revision under this subparagraph shall be subject to the notice and comment
				provisions of section 307 of this Act or of section 553 of title 5, United
				States Code.</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id24B0F15ED5EC4D59AFF5FD192E9D6F4B"><enum>(iii)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Nothing in clause (ii) precludes the
				application of the notice and comment provisions of section 307 of this Act or
				of section 553 of title 5, United States Code, as the Administrator determines
				to be practicable.</text>
												</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDda44463e0a13409f835f1e9d2eb660ca" section-type="subsequent-section"><enum>717.</enum><header display-inline="yes-display-inline">Climate Action Trust Fund</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDB87E6EB3E15A423C9459B522069F2D1F"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment and Administration</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id3EED2D6CA67A43CF9A82F76F1F735408"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established in the general fund of
				the Treasury a fund, to be known as the <term>Climate Action Trust Fund</term>,
				consisting of—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDD2EF1B70D5204F73B84970D1BF09ABCD"><enum>(A)</enum><text display-inline="yes-display-inline">such amounts as are deposited in the Fund
				under paragraph (2); and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDEF1CB6C8E834F71B796E6B85E12D28F"><enum>(B)</enum><text display-inline="yes-display-inline">any interest earned on investment of
				amounts in the Fund under paragraph (4).</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75847D4BD6B24B8E83CBB81F88EF90BB"><enum>(2)</enum><header display-inline="yes-display-inline">Transfers to Fund</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall deposit
				in the Fund amounts equivalent to the proceeds received by the Administrator as
				a result of the conduct of auctions of allowances under section 715.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72CBA45BD1F440E4B3F4FD55F33AAC30"><enum>(3)</enum><header display-inline="yes-display-inline">Expenditures from Fund</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID1475BB464CDB4E84B16FFDF76CB44B9B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C), the
				Administrator shall use amounts in the Fund to carry out the programs described
				in this section.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9724CABDFFA844AE9AEFD47A75CBECA6"><enum>(B)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Of amounts in the Fund, there shall be made
				available to pay the administrative expenses necessary to carry out this title,
				as adjusted for changes beginning on January 1, 2007, in accordance with the
				Consumer Price Index for All-Urban Consumers published by the Department of
				Labor—</text>
												<clause commented="no" display-inline="no-display-inline" id="idBFECA2CBA7DD4477A328C8730F8839BC"><enum>(i)</enum><text display-inline="yes-display-inline">$90,000,000 for each fiscal year, to the
				Administrator; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="idD0CB9B59B8934839BA8AF7B2FDE0CD22"><enum>(ii)</enum><text display-inline="yes-display-inline">$30,000,000 for each fiscal year, to the
				Secretary of Agriculture.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID18650edc3bf443ea83b7a68d08e3cf38"><enum>(C)</enum><header display-inline="yes-display-inline">Panel</header><text display-inline="yes-display-inline">Of amounts in the Fund, there shall be made
				available to pay the expenses of the Panel under section 712 $7,000,000 for
				each fiscal year, as adjusted for changes beginning on January 1, 2007, in
				accordance with the Consumer Price Index for All-Urban Consumers published by
				the Department of Labor.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5603607AF5D94AF4BC15A9D3321A0821"><enum>(4)</enum><header display-inline="yes-display-inline">Investment of amounts</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDB41A9725093D45BAABBED0F22225BDF4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Treasury shall invest such
				portion of the Fund as is not, in the judgment of the Administrator, required
				to meet current withdrawals.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6511CF2C0E1C45378F26AC70920DBAAF"><enum>(B)</enum><header display-inline="yes-display-inline">Interest-bearing obligations</header><text display-inline="yes-display-inline">Investments may be made only in
				interest-bearing obligations of the United States.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID64BE379517894186B89A1201FBFD944E"><enum>(C)</enum><header display-inline="yes-display-inline">Acquisition of obligations</header><text display-inline="yes-display-inline">For the purpose of investments under
				paragraph (1), obligations may be acquired—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID2FBB30C1FE744A27BAD9FAB522B3731C"><enum>(i)</enum><text display-inline="yes-display-inline">on original issue at the issue price;
				or</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID119C636409D948D786ECA703681825D8"><enum>(ii)</enum><text display-inline="yes-display-inline">by purchase of outstanding obligations at
				the market price.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41DB13A27611478D8A6149DA3B5D78BE"><enum>(D)</enum><header display-inline="yes-display-inline">Sale of obligations</header><text display-inline="yes-display-inline">Any obligation acquired by the Fund may be
				sold by the Administrator at the market price.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID484E65079F0D4D97AAD686B9EEE029C8"><enum>(E)</enum><header display-inline="yes-display-inline">Return of proceeds to Fund</header><text display-inline="yes-display-inline">The interest on, and the proceeds from the
				sale or redemption of, any obligations held in the Fund shall be credited to,
				and form a part of, the Fund.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDedf30b596b7048aa8632f9aab5342cc3"><enum>(5)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator, in consultation with the Secretary
				of Energy, shall promulgate such regulations as are necessary to administer the
				Fund in accordance with this section.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdbfecf4c02104ea894b7c549c1c13060"><enum>(b)</enum><header display-inline="yes-display-inline">Uses of Fund</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDc47009fca2b64a73b3ce6d0a11df7014"><enum>(1)</enum><header display-inline="yes-display-inline">No further appropriation</header><text display-inline="yes-display-inline">The Administrator shall distribute amounts
				in the Fund for use in accordance with this section, without further
				appropriation.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID39edb8a00a334ac18735842dcc0d3fa1"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id265480A472BF43A6A6B3C2EE66A3DAE9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in consultation with the Secretary
				of Energy, shall promulgate regulations establishing an innovative low- and
				zero-emitting carbon technologies program, a clean coal technologies program,
				and an energy efficiency technology program that include—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID2b2ca738b2b04bd2b090bc5cfd08a0e3"><enum>(i)</enum><text display-inline="yes-display-inline">the funding mechanisms that will be
				available to support the development and deployment of the technologies
				addressed by each program, including low-interest loans, loan guarantees,
				grants, and financial awards; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDdc45f52943e748f48c17eb664e9b802a"><enum>(ii)</enum><text display-inline="yes-display-inline">the criteria for the methods by which
				proposals will be funded to develop and deploy the technologies.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcb71a44f26974656b1f06eb64c4db597"><enum>(B)</enum><header display-inline="yes-display-inline">Revision of criteria</header><text display-inline="yes-display-inline">Not later than January 1, 2014, and every 3
				years thereafter, the Administrator shall review and, if appropriate, revise,
				based on technological advances, the criteria referred to in subparagraph
				(A)(ii).</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD32C8CB330A419E9D130F67C253A51E"><enum>(C)</enum><header display-inline="yes-display-inline">Adaptation assistance for workers and
				communities</header><text display-inline="yes-display-inline">Not later than 3
				years after the date of enactment of this title, the Administrator, in
				consultation with the Secretary of Energy, shall promulgate regulations
				governing the distribution of funds pursuant to subsection (g).</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8ed2011263cb4323b6a838ef957eaaad"><enum>(c)</enum><header display-inline="yes-display-inline">Innovative low- and zero-emitting carbon
				electricity generation technologies program</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID4656b31125f4402aa13650474862a177"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, of amounts
				remaining in the Fund after making the expenditures described in subparagraphs
				(B) and (C) of subsection (a)(3), the Administrator shall use not more than 35
				percent to support the development and deployment of low- and zero-emitting
				carbon electricity generation technologies.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8d6aa5d0451a4b1ea9405a40a1d6d583"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The regulations establishing the innovative
				low- and zero-emitting carbon electricity generation technologies program
				referred to in subsection (b)(2)(A) shall establish the areas of technology
				development that will qualify for funding under that program, including
				technologies for the generation of electricity from renewable energy
				sources.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1bb9b6f19b004cec9a328d47cf271446"><enum>(d)</enum><header display-inline="yes-display-inline">Clean coal technologies program</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID02da4e0a3ad64dc68e27d5ec6857a247"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, of amounts
				remaining in the Fund after making the expenditures described in subparagraphs
				(B) and (C) of subsection (a)(3), the Administrator shall use not more than 20
				percent to support the development and deployment of clean coal
				technologies.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98fa22f8fbe14ba6ab39da3a6bf9ad45"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The regulations establishing the clean coal
				technologies program referred to in subsection (b)(2)(A) shall establish the
				criteria for use in defining qualifying clean coal technologies for electric
				power generation, while ensuring that those technologies represent an advance
				in available technology, taking into consideration net thermal efficiency and
				measures to capture and sequester carbon dioxide.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5c6b76a6654248718fdd959215f5eba9"><enum>(e)</enum><header display-inline="yes-display-inline">Energy efficiency technology
				program</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDeb323096b55e46ac9f39473360c02b39"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, of amounts
				remaining in the Fund after making the expenditures described in subparagraphs
				(B) and (C) of subsection (a)(3), the Administrator shall use not more than 15
				percent to support the development and deployment of technologies for
				increasing the efficiency of energy end use in buildings and industry.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54ac6f0da3a94061b08bd8d97abfe530"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The regulations establishing the energy
				efficiency program referred to in subsection (b)(2)(A) shall establish the
				areas of technology development that will qualify for funding under the energy
				efficiency program.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID862ed966dad24a939a5f9a6940d8b9f5"><enum>(f)</enum><header display-inline="yes-display-inline">Federal funding of research into and
				development of energy and efficiency technologies</header><text display-inline="yes-display-inline">For each calendar year, the Administrator
				shall use not more than 10 percent of the amounts in the Fund to support
				research into and development of energy and efficiency technologies.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3652bac1ac364d479f93ddd69c2fd5bd"><enum>(g)</enum><header display-inline="yes-display-inline">Adaptation assistance for workers and
				communities negatively affected by climate change and greenhouse gas
				regulation</header><text display-inline="yes-display-inline">For each calendar
				year, of amounts remaining in the Fund after making the expenditures described
				in subparagraphs (B) and (C) of subsection (a)(3), the Administrator shall use
				at least 10 percent to provide adaptation assistance for workers and
				communities—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID75baaf30712b463b8485ed9e635d002d"><enum>(1)</enum><text display-inline="yes-display-inline">to address local or regional impacts of
				climate change and the impacts, if any, from greenhouse gas regulation,
				including by providing assistance to displaced workers and disproportionately
				affected communities; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9910612589a44750a1b5497ecd3d7b00"><enum>(2)</enum><text display-inline="yes-display-inline">to mitigate impacts of climate change and
				the impacts, in any, from greenhouse gas regulation on low-income energy
				consumers.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3b959e72caf64925b1cd7e80fcd5eb5b"><enum>(h)</enum><header display-inline="yes-display-inline">Fish and wildlife habitat</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDad782f1ca6f54f6a855e950368ad74f7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, of amounts
				remaining in the Fund after making the expenditures described in subparagraphs
				(B) and (C) of subsection (a)(3), the Administrator shall use at least 10
				percent to mitigate the impacts of climate change on fish and wildlife habitat
				in accordance with this subsection.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd3a68ce83a0e43548ebdb1fad1465c3e"><enum>(2)</enum><header display-inline="yes-display-inline">Wildlife restoration fund</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDd70e5f48c593400383a164a9c6ed5686"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, the Administrator
				shall transfer not less than 70 percent of the amounts made available under
				paragraph (1) to the Federal aid to wildlife restoration fund established under
				section 3(a)(1) of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C.
				669b(a)(1))—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDcaee0115355d4e47ad4fed156ac46d21"><enum>(i)</enum><text display-inline="yes-display-inline">to carry out climate change impact
				mitigation actions pursuant to comprehensive wildlife conservation strategies;
				and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDea61d88f74974719a604f0147d2ff3c7"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide relevant information, training,
				monitoring, and other assistance to develop climate change impact mitigation
				and adaptation plans and integrate the plans into State comprehensive wildlife
				conservation strategies.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID92e9b56870da4be38fa4c2ae762403e8"><enum>(B)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Amounts transferred to the Federal aid to
				wildlife restoration fund under this paragraph shall—</text>
												<clause commented="no" display-inline="no-display-inline" id="id8A1D7A499EDC4EACBAC2F446E78D3F8F"><enum>(i)</enum><text display-inline="yes-display-inline">be available, without further
				appropriation, for obligation and expenditure; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id782117644CC64769874681C9F875CCC0"><enum>(ii)</enum><text display-inline="yes-display-inline">remain available until expended.</text>
												</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c506a24495d43829879212221eeeb06"><enum>(3)</enum><header display-inline="yes-display-inline">Protection of natural resources</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDf1190e80d6dd429b991088455840f9d8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, the Administrator,
				in consultation with the Secretary of Agriculture, the Secretary of Commerce,
				the Chief of Engineers, and State and national wildlife conservation
				organizations, shall transfer not more than 30 percent of the funds made
				available under paragraph (1) to the Secretary of the Interior for use in
				carrying out Federal and State programs and projects—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID9d4224a439244429aefa9106562ff8e3"><enum>(i)</enum><text display-inline="yes-display-inline">to protect natural communities that are
				most vulnerable to climate change;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID8917f6a9002e4224b9dc87617ede5108"><enum>(ii)</enum><text display-inline="yes-display-inline">to restore and protect natural resources
				that directly guard against damages from climate change events; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDce0b831d7f7c48e8b630e581ede420fb"><enum>(iii)</enum><text display-inline="yes-display-inline">to restore and protect ecosystem services
				that are most vulnerable to climate change.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe8f71412cc9543f49bd87fa86181febd"><enum>(B)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Amounts transferred to the Secretary of the
				Interior under this paragraph shall—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID057d80d119e44fee976f1f7521693ecf"><enum>(i)</enum><text display-inline="yes-display-inline">be available, without further
				appropriation, for obligation and expenditure;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id52C2C3A0201046108EF207F6D36C0447"><enum>(ii)</enum><text display-inline="yes-display-inline">remain available until expended;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDb438987ebf474679b67eb3c9c620b885"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idBDC0189B1FE440198827701D40B52F6B"><enum>(I)</enum><text display-inline="yes-display-inline">be obligated not later than 2 years after
				the date of transfer; or</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID91821e68575e4980bdbb960865866b59" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">if the amounts are not obligated in
				accordance with subclause (I), be transferred to the Federal aid to wildlife
				restoration fund for use in accordance with paragraph (2); and</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID83778dcfdc97455aa0abc67044fc1bfe"><enum>(iv)</enum><text display-inline="yes-display-inline">supplement, and not supplant, the amount of
				Federal, State, and local funds otherwise expended to carry out programs and
				projects described in subparagraph (A).</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf186a07e6b4c4248a6a69206f64b753a"><enum>(C)</enum><header display-inline="yes-display-inline">Programs and projects</header><text display-inline="yes-display-inline">Programs and projects for which funds may
				be used under this paragraph include—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID27e635cfe2b74d8f9017d6359a66ef9c"><enum>(i)</enum><text display-inline="yes-display-inline">Federal programs and projects—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID8c8dec5efbb940b1b7e9cbecc5d6d7f9"><enum>(I)</enum><text display-inline="yes-display-inline">to identify Federal land and water at
				greatest risk of being damaged or depleted by climate change;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0126bb58cd19452a9f752459513dfbc5"><enum>(II)</enum><text display-inline="yes-display-inline">to monitor Federal land and water to allow
				for early detection of impacts;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDfcdc6b78efc742c59bcffe6456b03e5c"><enum>(III)</enum><text display-inline="yes-display-inline">to develop adaptation strategies to
				minimize the damage; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDaf4e8ff5e5d64ed9b7f89e919a357ba7"><enum>(IV)</enum><text display-inline="yes-display-inline">to restore and protect Federal land and
				water at the greatest risk of being damaged or depleted by climate
				change;</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID2ffc92dcf1df4cfc8b270a7c47931634"><enum>(ii)</enum><text display-inline="yes-display-inline">Federal programs and projects to identify
				climate change risks and develop adaptation strategies for natural grassland,
				wetlands, migratory corridors, and other habitats vulnerable to climate change
				on private land enrolled in—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID6747a247d3f14b12bb48582a6099edd3"><enum>(I)</enum><text display-inline="yes-display-inline">the wetlands reserve program established
				under subchapter C of chapter 1 of subtitle D of title XII of the Food Security
				Act of 1985 (16 U.S.C. 3837 et seq.);</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID64491d9b3fb648b0a5bfc4aac0fba3b6"><enum>(II)</enum><text display-inline="yes-display-inline">the grassland reserve program established
				under subchapter C of chapter 2 of subtitle D of title XII of that Act (16
				U.S.C. 3838n et seq.); and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID326a9413a052473db99ee023570cad30"><enum>(III)</enum><text display-inline="yes-display-inline">the wildlife habitat incentive program
				established under section 1240N of that Act (16 U.S.C. 3839bb–1);</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDee6e7b969ab5485fae372aa1d7bfdb30"><enum>(iii)</enum><text display-inline="yes-display-inline">programs and projects under the North
				American Wetlands Conservation Act (16 U.S.C. 4401 et seq.), the North American
				Bird Conservation Initiative, and the Neotropical Migratory Bird Conservation
				Act (16 U.S.C. 6101 et seq.) to protect habitat for migratory birds that are
				vulnerable to climate change impacts;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID11f8a8a3561640c6a482e571656abf8d"><enum>(iv)</enum><text display-inline="yes-display-inline">programs and projects—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID8afb4461e51548ea9e389eedf5e4eae2"><enum>(I)</enum><text display-inline="yes-display-inline">to identify coastal and marine resources
				(such as coastal wetlands, coral reefs, submerged aquatic vegetation, shellfish
				beds, and other coastal or marine ecosystems) at the greatest risk of being
				damaged by climate change;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf6eceea133694ded8cc9a0cca0947d7c"><enum>(II)</enum><text display-inline="yes-display-inline">to monitor those resources to allow for
				early detection of impacts;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID33d4fbfb682949eb813d9cb35ec5ad6d"><enum>(III)</enum><text display-inline="yes-display-inline">to develop adaptation strategies;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID25c76a4501bf4502a5cc231883b44e43"><enum>(IV)</enum><text display-inline="yes-display-inline">to protect and restore those resources;
				and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5f20c435df6349f7ae1c78982101f571"><enum>(V)</enum><text display-inline="yes-display-inline">to integrate climate change adaptation
				requirements into State plans developed under the coastal zone management
				program established under the Coastal Zone Management Act of 1972 (16 U.S.C.
				1451 et seq.), the national estuary program established under section 320 of
				the Federal Water Pollution Control Act (33 U.S.C. 1330), the Coastal and
				Estuarine Land Conservation Program established under the fourth proviso of the
				matter under the heading <quote><header-in-text level="paragraph" style="OLC">procurement, acquisition, and construction (including transfers of
				funds)</header-in-text></quote> of title II of the Departments of Commerce,
				Justice, and State, the Judiciary, and Related Agencies Appropriations Act,
				2002 (16 U.S.C. 1456d), or other comparable State programs;</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID3693a5a3dda4409b9c041abdf29e5f8b"><enum>(v)</enum><text display-inline="yes-display-inline">programs and projects to conserve habitat
				for endangered species and species of conservation concern that are vulnerable
				to the impact of climate change;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID48dfe7b5b7b44c4495b2683d5374842c"><enum>(vi)</enum><text display-inline="yes-display-inline">programs and projects under the Forest
				Legacy Program established under section 7 of the Cooperative Forestry
				Assistance Act (16 U.S.C. 2103c), to support State efforts to protect
				environmentally sensitive forest land through conservation easements to provide
				refuges for wildlife;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDceeb6f9c1fad4b7085aee833c8b8fc91"><enum>(vii)</enum><text display-inline="yes-display-inline">other Federal or State programs and
				projects identified by the heads of agencies described in subparagraph (A) as
				high priorities—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID7d6872d26357493997b53d25f2c4ea2d"><enum>(I)</enum><text display-inline="yes-display-inline">to protect natural communities that are
				most vulnerable to climate change;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4e4b7cb47b914ada87693245eac9771c"><enum>(II)</enum><text display-inline="yes-display-inline">to restore and protect natural resources
				that directly guard against damages from climate change events; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6e2d8f6ab373486ba0f53137c20465de"><enum>(III)</enum><text display-inline="yes-display-inline">to restore and protect ecosystem services
				that are most vulnerable to climate change;</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDae036bcae93145c8b1e3b8481a391cb4"><enum>(viii)</enum><text display-inline="yes-display-inline">to address climate change in Federal land
				use planning and plan implementation and to integrate climate change adaptation
				strategies into—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID010bb2c76abb40e8a60405c04430f9fd"><enum>(I)</enum><text display-inline="yes-display-inline">comprehensive conservation plans prepared
				under section 4(e) of the National Wildlife Refuge System Administration Act of
				1966 (16 U.S.C. 668dd(e));</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID14ed93e748514096973e6d7b1558e52d"><enum>(II)</enum><text display-inline="yes-display-inline">general management plans for units of the
				National Park System;</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID786c03c716114de599bc127499bd192b"><enum>(III)</enum><text display-inline="yes-display-inline">resource management plans of the Bureau of
				Land Management; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4ab7c74b94134102be2cbab285893185"><enum>(IV)</enum><text display-inline="yes-display-inline">land and resource management plans under
				the Forest and Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C.
				1600 et seq.) and the National Forest Management Act of 1976 (16 U.S.C. 1600 et
				seq.); and</text>
													</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID0e8d841a68cb4a469272326889250e13"><enum>(ix)</enum><text display-inline="yes-display-inline">projects to promote sharing of information
				on climate change wildlife impacts and mitigation strategies across agencies,
				including funding efforts to strengthen and restore habitat that improves the
				ability of fish and wildlife to adapt successfully to climate change through
				the Wildlife Conservation and Restoration Account established by section
				3(a)(2) of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C.
				669b(a)(2)).</text>
												</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID3e227082d3b94d778dede3ae7c25c195" section-type="subsequent-section"><enum>718.</enum><header display-inline="yes-display-inline">Early reduction credits</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID421791b4af24411ca9f3efff301e840d"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall promulgate regulations that
				provide for the issuance on a 1-time basis, certification, and use of early
				reduction credits for greenhouse gas reduction or sequestration projects
				carried out during any of calendar years 2000 through 2010.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb1402bb2124646c09a9ad1707ea4ffb5"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible projects</header><text display-inline="yes-display-inline">A greenhouse gas reduction or sequestration
				project shall be eligible for early reduction credits if the project—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="IDf9c99814dd0a4ab9b81aa596952d33a1"><enum>(1)</enum><text display-inline="yes-display-inline">is carried out in the United States;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd945cb80d9e64adba4a0c4e6d5dee32f"><enum>(2)</enum><text display-inline="yes-display-inline">meets the standards contained in
				regulations promulgated by the Administrator under subsection (a) that the
				Administrator determines to be applicable to the project, including consistency
				with the requirements of—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id37856334BE9B43DA90C857C50470B520"><enum>(A)</enum><text display-inline="yes-display-inline">paragraphs (2) through (5) of section
				736(a), with respect to greenhouse gas reduction projects; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B838AF8A5E348AAB2B52C09222149E7"><enum>(B)</enum><text display-inline="yes-display-inline">section 732(a), with respect to
				sequestration projects; and</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9a6b60049d0049a196f637c57c92f6b2"><enum>(3)</enum><text display-inline="yes-display-inline">was reported—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDaf59461503f04f56be880e2385dccfdd"><enum>(A)</enum><text display-inline="yes-display-inline">under section 1605(b) of the Energy Policy
				Act of 1992 (42 U.S.C. 13385(b)); or</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe2d6dff3199f4f7c9958d5b27db24e0f"><enum>(B)</enum><text display-inline="yes-display-inline">to a State or regional greenhouse gas
				registry.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc2fb2609f08a4435a24168c24856f699"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID2065b6881c414be9b5b4133ee23db123"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The aggregate quantity of early reduction
				credits available for greenhouse gas reduction or sequestration projects for
				the period of calendar years 2000 through 2010 shall not exceed 10 percent of
				the tonnage limitation for calendar year 2011 for emissions of greenhouse gases
				from affected units under section 711.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID878e23a4af844bba8feeb56f7a6e4bdc"><enum>(2)</enum><header display-inline="yes-display-inline">No other exceedance of tonnage
				limitation</header><text display-inline="yes-display-inline">No provision of
				this subtitle (other than paragraph (1)) or any regulation promulgated under
				this subtitle authorizes the issuance or use of a quantity of credits greater
				than the annual tonnage limitation for emissions of greenhouse gases from
				affected units for a calendar year.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID161810e688134f958b0c1fb0e3aba584" section-type="subsequent-section"><enum>719.</enum><header display-inline="yes-display-inline">Recognition and use of international
				credits</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDa86881b65ae14bd4be812056164823f6"><enum>(a)</enum><header display-inline="yes-display-inline">Use of international credits</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID3183bcff69a741f585b7e2047718db5b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in this section and
				section 720, the owner of each affected unit may satisfy the obligation of the
				affected unit under section 722 to surrender a quantity of credits associated
				with the greenhouse gas emissions of the affected unit by submitting
				international credits representing up to 25 percent of the total annual
				submission requirements of the affected unit.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID357d3af2a8304b1b90f49582c228d333"><enum>(2)</enum><header display-inline="yes-display-inline">New affected units</header><text display-inline="yes-display-inline">The owner of a new affected unit may
				satisfy up to 50 percent of the obligation of the new affected unit under
				section 722 to surrender a quantity of credits associated with the greenhouse
				gas emissions of the new affected unit by submitting international
				credits.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa6aeca81bf514dcc8975b1e168231dd0"><enum>(b)</enum><header display-inline="yes-display-inline">Facility certification</header><text display-inline="yes-display-inline">The owner of an affected unit who submits
				an international credit under this section shall certify that the international
				credit—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID24359d4e7f6d4ed9805f4d5edcfc02fc"><enum>(1)</enum><text display-inline="yes-display-inline">has not been retired from use in the
				registry of the applicable foreign country; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc80145826d0144d0a59cc24c25c868ad"><enum>(2)</enum><text display-inline="yes-display-inline">satisfies the requirements of subsection
				(c) or (d).</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1e44dbfe2b344f62933e36d583ea44a5"><enum>(c)</enum><header display-inline="yes-display-inline">International credits from countries with
				mandatory greenhouse gas limits</header><text display-inline="yes-display-inline">The owner of an affected unit may submit an
				international credit under this subsection if—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID4df5ddee892f49b3b39a12e04e40e111"><enum>(1)</enum><text display-inline="yes-display-inline">the international credit is issued by a
				foreign country pursuant to a governmental program that imposes mandatory
				absolute tonnage limits on greenhouse gas emissions from the country or 1 or
				more industry sectors pursuant to protocols adopted through the UNFCCC process;
				and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9efac2b822e24f99a78a1826e29c16f8"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator has promulgated
				regulations, taking into consideration applicable UNFCCC protocols, approving
				for use under this subsection international credits from such categories of
				countries as the regulations establish, and the regulations permit the use of
				international credits from the foreign country that issued the credit.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5f8ae93fc235468a82a9fa0de4d30b4d"><enum>(d)</enum><header display-inline="yes-display-inline">International credits from countries
				without mandatory greenhouse gas limits</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID6308e8ebdbe3419b852120f23dbb66f6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the owner of an
				affected unit may submit an international credit under this subsection
				if—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID5705c1a407ab48e69341a028da17a7c1"><enum>(A)</enum><text display-inline="yes-display-inline">the international credit is issued by a
				foreign country that has not imposed mandatory absolute tonnage limits on
				greenhouse gas emissions from the country or 1 or more industry sectors
				pursuant to protocols adopted through the UNFCCC process;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9fd3ce5c007747a18cc8a560fa5cbe8c"><enum>(B)</enum><text display-inline="yes-display-inline">the international credit is issued pursuant
				to protocols adopted through the UNFCCC process; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf0e6274a6eb04b5d9ffdb053c3dc1557"><enum>(C)</enum><text display-inline="yes-display-inline">the Administrator has promulgated
				regulations, taking into consideration applicable UNFCCC protocols, approving
				for use under this subsection international credits from such categories of
				countries as the regulations establish, and the regulations permit the use of
				international credits from the foreign country that issued the credit.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88D4AC3C528143BCB668E2DA9F02C20D"><enum>(2)</enum><header display-inline="yes-display-inline">Decision on continued
				approval</header><text display-inline="yes-display-inline">Not later than
				December 31, 2015, the Administrator shall determine, pursuant to the
				regulations promulgated under paragraph (1)(C), whether to continue to approve
				for use under this subsection international credits from any country
				that—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDddd08cc2050d4d53913d9430c37409db"><enum>(A)</enum><text display-inline="yes-display-inline">has not imposed mandatory absolute tonnage
				limits on greenhouse gas emissions from the country or 1 or more industry
				sectors pursuant to protocols adopted through the UNFCCC process; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID488aaf747faa4c7d9b84e12dd0e4ee04"><enum>(B)</enum><text display-inline="yes-display-inline">generates more than 0.5 percent of global
				greenhouse gas emissions as of 2010 or as of the most recent year for which
				data are available.</text>
											</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID674631e5f0b64aaa965806495d330360" section-type="subsequent-section"><enum>720.</enum><header display-inline="yes-display-inline">Avoiding significant economic harm</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDf3994e9e495c45f781b9c9119273116b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to the regulations promulgated
				under this section, the Administrator may permit affected units—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID5a965140a9104744a8babc09abb452cf"><enum>(1)</enum><text display-inline="yes-display-inline">to use allowances in a calendar year before
				the calendar year for which the allowances were allocated; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1d0e0590f0044b3e93f464e4821cff48"><enum>(2)</enum><text display-inline="yes-display-inline">to increase the use by the affected units
				of international credits up to 50 percent of the total annual submission
				requirements of the affected units under section 722.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5c0229635d29489d845d594be04f6bd6"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id98F3DAAB22B042B684A0BE2DD40C3892"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in coordination with the Secretary
				of the Treasury, shall promulgate regulations requiring the continuous
				monitoring of the operation of the carbon market and the effect of that market
				on the economy of the United States.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID63608b9d98f74f88a398429b06dde32e"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The regulations shall—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID5afab5af4e1c4698af18e1c2bf914015"><enum>(A)</enum><text display-inline="yes-display-inline">establish the criteria for determining
				whether allowance prices have reached and sustained a level that is causing or
				will cause significant harm to the economy of the United States; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDecc6f195bb6c425ea4f58b235511fa6d"><enum>(B)</enum><text display-inline="yes-display-inline">take into consideration—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDc0b84dea0fd240a8b4ff21a08dfc6855"><enum>(i)</enum><text display-inline="yes-display-inline">the obligation of the United States under
				this subtitle to stabilize greenhouse gas concentrations in the atmosphere at
				the safe climate level; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDeb17571d5a2c40b98906c63b9ee13cfc"><enum>(ii)</enum><text display-inline="yes-display-inline">the costs of the anticipated impacts of
				climate change in the United States.</text>
												</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd880041468244de0847690230aebd91c"><enum>(3)</enum><header display-inline="yes-display-inline">Prevention of economic harm</header><text display-inline="yes-display-inline">If the Administrator determines that
				allowance prices have reached and sustained a level that is causing or will
				cause significant harm to the economy of the United States, the regulations
				shall establish—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID40de78c45fac49aba7b42ba110f6689e"><enum>(A)</enum><text display-inline="yes-display-inline">a program under which an affected unit may
				use allowances in a calendar year before the calendar year for which the
				allowances were allocated, including—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID9f789a1287384542806a59dfc6bce8df"><enum>(i)</enum><text display-inline="yes-display-inline">a requirement that allowances borrowed from
				the allocation of a future year reduce the allocation of allowances to the
				affected unit for the future year on a 1-to-1 basis;</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDaa1f606386274a4696155085347ff5cd"><enum>(ii)</enum><text display-inline="yes-display-inline">a requirement for payment of interest on
				borrowed allowances requiring the submission of additional credits upon
				repayment of the allowances equal to the product obtained by
				multiplying—</text>
													<subclause commented="no" display-inline="no-display-inline" id="ID411e9c79e8da41d1a6023d495d9e98be"><enum>(I)</enum><text display-inline="yes-display-inline">the number of years between the advance use
				of allowances by an affected unit under clause (i) and the submission of
				additional credits under this clause; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDe938123932d74c55b948baa069f9261c"><enum>(II)</enum><text display-inline="yes-display-inline">the sum obtained by adding—</text>
														<item commented="no" display-inline="no-display-inline" id="ID7280a4b7a43e45778d11e502c1a4c14c"><enum>(aa)</enum><text display-inline="yes-display-inline">the Federal short-term rate, as defined
				pursuant to section 1274(d)(1)(C)(i) of the Internal Revenue Code of 1986;
				and</text>
														</item><item commented="no" display-inline="no-display-inline" id="ID3ba2ebf77d2747e8af04a057053aa134"><enum>(bb)</enum><text display-inline="yes-display-inline">2 percent; and</text>
														</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDdb98a0998ca34e29b82cc6515545ed3e"><enum>(iii)</enum><text display-inline="yes-display-inline">a limitation that in no event may an
				affected unit—</text>
													<subclause commented="no" display-inline="no-display-inline" id="IDda6c58488120485e9ce237aebfcbe6fc"><enum>(I)</enum><text display-inline="yes-display-inline">satisfy more than 10 percent of the
				obligation of the affected unit under section 722 to surrender allowances by
				submitting allowances in a calendar year before the calendar year for which the
				allowances were allocated; and</text>
													</subclause><subclause commented="no" display-inline="no-display-inline" id="IDb814dce6dcd549e1afde508ca314f01f"><enum>(II)</enum><text display-inline="yes-display-inline">use allowances in a calendar year that is
				more than 5 years before the calendar year for which the allowances were
				allocated; and</text>
													</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID611fa68498044588993bb2b309843999"><enum>(B)</enum><text display-inline="yes-display-inline">a program under which the owner of an
				affected unit may satisfy the obligation of the affected unit under section 722
				to surrender allowances for the calendar year in which the determination is
				made by submitting international credits representing up to 50 percent of the
				total annual submission requirements of the affected unit.</text>
											</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID2d43d2eeb14f4448934a17b9a437ca73" section-type="subsequent-section"><enum>721.</enum><header display-inline="yes-display-inline">Use and transfer of credits</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID42b1515ed1f74c4c9279b7f8aad09c44"><enum>(a)</enum><header display-inline="yes-display-inline">Use in other greenhouse gas allowance
				trading programs</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id12C30B8263954FD480BDD51C0E38079B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A credit obtained under this subtitle may
				be used in any other greenhouse gas allowance trading program, including a
				program of 1 or more States or subdivisions of States, that is approved by the
				Administrator and an authorized official for the other program for use of the
				allowance.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC30B13314444CDA8D4045D330F4C9B0"><enum>(2)</enum><header display-inline="yes-display-inline">Reciprocity</header><text display-inline="yes-display-inline">A credit obtained from another greenhouse
				gas trading program, including a program of 1 or more States or subdivisions of
				States, that is approved by the Administrator and an authorized official for
				the other program may be used in the trading program under this title.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdcf05b28ef4e442bbdbea7c7397b9348"><enum>(b)</enum><header display-inline="yes-display-inline">Allowance Use before applicable calendar
				year</header><text display-inline="yes-display-inline">Except as provided in
				section 720, an allowance auctioned or allocated under this subtitle may not be
				used before the calendar year for which the allowance was auctioned or
				allocated.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID64cb5e6504214ddb8d25e230f3edc343"><enum>(c)</enum><header display-inline="yes-display-inline">Transfer</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID4dd9ac62b48e4d7c90d9559fd14945f3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
				transfer of a credit shall not take effect until receipt and recording by the
				Administrator of a written certification of the transfer that is executed by an
				authorized official of the person making the transfer.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54bdcc79ea0443be866f0a4617e50463"><enum>(2)</enum><header display-inline="yes-display-inline">Special rule for allowances</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the transfer
				of an allowance auctioned or allocated under this subtitle may take effect
				before the calendar year for which the allowance was auctioned or
				allocated.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9e30c4c27df94512abf50f539cb9b2c8"><enum>(d)</enum><header display-inline="yes-display-inline">Banking of credits</header><text display-inline="yes-display-inline">Any affected unit may use a credit obtained
				under this subtitle in the calendar year for which the credit was auctioned or
				allocated, or in a subsequent calendar year, to demonstrate compliance with
				section 722.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="IDf8d5925935534b7ba65ecf16c9f7eb9c" section-type="subsequent-section"><enum>722.</enum><header display-inline="yes-display-inline">Compliance and enforcement</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDd42b6c8270e04a749bfb19b4b9493a44"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For calendar year 2011 and each calendar
				year thereafter, the owner of each affected unit shall surrender to the
				Administrator a quantity of credits that is equal to the total tons of carbon
				dioxide or, with respect to other greenhouse gases, tons in carbon dioxide
				equivalent, associated with the combustion by the affected unit of greenhouse
				gas-emitting fuels during the calendar year.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa414f08ec0fb4057829b3f7e72a2f15a"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall promulgate regulations
				establishing the procedures for the surrender of credits.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="IDdd55e6b8228549019bb4876e444f478c"><enum>(c)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">The owner of an affected unit that emits
				greenhouse gases associated with the combustion by the affected unit of a
				greenhouse gas-emitting fuel in excess of the number of credits that the owner
				of the affected unit holds for use of the affected unit for the calendar year
				shall—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID34f37938c85849468f5c62cb67b9a5a2"><enum>(1)</enum><text display-inline="yes-display-inline">submit to the Administrator 1.3 credits for
				each metric ton of excess greenhouse gas emissions of the affected unit;
				and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID33e93c62600241bcbb47fcbc375d645a"><enum>(2)</enum><text display-inline="yes-display-inline">pay an excess emissions penalty equal to
				the product obtained by multiplying—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID4e51f11279cb4f6fbebadfb6178d3cde"><enum>(A)</enum><text display-inline="yes-display-inline">the number of tons of carbon dioxide, or
				the carbon dioxide equivalent of other greenhouse gases, emitted in excess of
				the total quantity of credits held by the affected unit; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84a7b959d24f4846af985f9456ffc5ee"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idEAACBDEE358545A6A584299A27D055B5"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), $100, as
				adjusted for changes beginning on January 1, 2007, in accordance with the
				Consumer Price Index for All-Urban Consumers published by the Department of
				Labor; or</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id1CB89FD1198D4B02A54E48630C40A6BC" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">if the average market price for a metric
				ton of carbon dioxide equivalent during a calendar year exceeds $60, $200, as
				adjusted for changes beginning on January 1, 2007, in accordance with the
				Consumer Price Index for All-Urban Consumers published by the Department of
				Labor.</text>
												</clause></subparagraph></paragraph></subsection></section></subtitle><subtitle commented="no" id="idD60935F9CB9B43AC85619F1914C03AAA" level-type="subsequent" style="OLC"><enum>B</enum><header display-inline="yes-display-inline">Offset credits</header>
								<section commented="no" display-inline="no-display-inline" id="id17A3966F151742C4AAE0DF6F2EF6ABA4" section-type="subsequent-section"><enum>731.</enum><header display-inline="yes-display-inline">Outreach initiative on revenue enhancement
				for agricultural producers</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDa228c4433a824959958de498c04ae13b"><enum>(a)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this subtitle are to
				achieve climate benefits, reduce overall costs to the United States economy,
				and enhance revenue for domestic agricultural producers, foresters, and other
				landowners by—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID7ae3cf0713524ad2be586554a0c3094c"><enum>(1)</enum><text display-inline="yes-display-inline">establishing procedures by which domestic
				agricultural producers, foresters, and other landowners can measure and report
				reductions in greenhouse gas emissions and increases in sequestration;
				and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6f60af1aadc04401be3ebb7d894e14b5"><enum>(2)</enum><text display-inline="yes-display-inline">publishing a handbook of guidance for
				domestic agricultural producers, foresters, and other landowners to market
				emission reductions to companies.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdecd5ee3c7f44209852836288610c988"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary of Agriculture, acting
				through the Chief of the Natural Resources Conservation Service, the Chief of
				the Forest Service, the Administrator of the Cooperative State Research,
				Education, and Extension Service, and land-grant colleges and universities, in
				consultation with the Administrator and the heads of other appropriate
				departments and agencies, shall establish an outreach initiative to provide
				information to agricultural producers, agricultural organizations, foresters,
				and other landowners about opportunities under this subtitle to earn new
				revenue.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9a496cc28e934dd590a27a88ff5afcdc"><enum>(c)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">The initiative under this section—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID8c0e35f3949940a6882adbb14875f0b1"><enum>(1)</enum><text display-inline="yes-display-inline">shall be designed to ensure that, to the
				maximum extent practicable, agricultural organizations and individual
				agricultural producers, foresters, and other landowners receive detailed
				practical information about—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID36aff327d84c48a5a20cb0716abedb5f"><enum>(A)</enum><text display-inline="yes-display-inline">opportunities to earn new revenue under
				this subtitle;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6c56a19c34d7437b8d8602988baf1cc0"><enum>(B)</enum><text display-inline="yes-display-inline">measurement protocols, monitoring,
				verifying, inventorying, registering, insuring, and marketing offsets under
				this title;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID237b3a3af90a4c37ad886d080d81bf01"><enum>(C)</enum><text display-inline="yes-display-inline">emerging domestic and international markets
				for energy crops, allowances, and offsets; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID366b7632c9f54c218461eed8af321a7a"><enum>(D)</enum><text display-inline="yes-display-inline">local, regional, and national databases and
				aggregation networks to facilitate achievement, measurement, registration, and
				sales of offsets;</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe506a4daaa5e4644b2682c569f2c7017"><enum>(2)</enum><text display-inline="yes-display-inline">shall provide—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID55834fefdcec4d0db69292edd1a800d6"><enum>(A)</enum><text display-inline="yes-display-inline">outreach materials, including the handbook
				published under subsection (d)(1), to interested parties;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1db44a48aa884660afd2847e71c3c9f1"><enum>(B)</enum><text display-inline="yes-display-inline">workshops; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd207de355f944ac0a371ac2a7d9feda3"><enum>(C)</enum><text display-inline="yes-display-inline">technical assistance; and</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDab5228c0680044e9872ca00d17d47177"><enum>(3)</enum><text display-inline="yes-display-inline">may include the creation and development of
				regional marketing centers or coordination with existing centers (including
				centers within the Natural Resources Conservation Service or the Cooperative
				State Research, Education, and Extension Service or at land-grant colleges and
				universities).</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9058510c0d5c4284885cc5b63d575a0e"><enum>(d)</enum><header display-inline="yes-display-inline">Handbook</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID06e11d62f2514c459c68a76f03800610"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Secretary of Agriculture, in consultation with the
				Administrator and after public input, shall publish a handbook for use by
				agricultural producers, agricultural cooperatives, foresters, other landowners,
				offset buyers, and other stakeholders that provides easy-to-use guidance on
				achieving, reporting, registering, and marketing offsets.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd28c96999f47402b97c153b60e0529b4"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall ensure,
				to the maximum extent practicable, that the handbook is distributed widely
				through land-grant colleges and universities and other appropriate
				institutions.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idECB9755DBAF14EFF9EE5CEA380EE9CE4" section-type="subsequent-section"><enum>732.</enum><header display-inline="yes-display-inline">Offset measurement for agricultural,
				forestry, wetlands, and other land use-related sequestration projects</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID126fc586947c4e01b876de3534b4f18a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Secretary of Agriculture, in consultation with the
				Administrator, shall promulgate regulations establishing the requirements
				regarding the issuance, certification, and use of offset credits for greenhouse
				gas reductions from agricultural, forestry, wetlands, and other land
				use-related sequestration projects, including requirements—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID40ac572cd2d1451bb1ebfe52a66802a3"><enum>(1)</enum><text display-inline="yes-display-inline">for a region-specific discount factor for
				business-as-usual practices for specific types of sequestration projects, in
				accordance with subsection (c);</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID84ae057fb7274c32827e6152465effaa"><enum>(2)</enum><text display-inline="yes-display-inline">that ensure that the reductions are real,
				additional, verifiable, and enforceable;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb881c787e54d41f2964775a8f19cc1a1"><enum>(3)</enum><text display-inline="yes-display-inline">that address leakage;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID07dc50c1b5234a4fad4dc85dfaa4b595"><enum>(4)</enum><text display-inline="yes-display-inline">that the reductions are not otherwise
				required by any law (including a regulation) or other legally binding
				requirement;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf24e5b297d22464682cea6e14a7fd608"><enum>(5)</enum><text display-inline="yes-display-inline">for the quantification, monitoring,
				reporting, and verification of the reductions;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID194393214a15444d85ed3df0d8a2950e"><enum>(6)</enum><text display-inline="yes-display-inline">that ensure that offset credits are limited
				in duration to the period of sequestration of greenhouse gases, and rectify any
				loss of sequestration other than a loss caused by an error in calculation
				identified under this subtitle, by requiring the submission of additional
				credits of an equivalent quantity to the lost sequestration; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID354bacab98cc4d69bfae45a964ab13dd"><enum>(7)</enum><text display-inline="yes-display-inline">that quantify sequestration flow.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8fe806a627bd40abb109ef39ace9d5eb"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility To create offset
				credits</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID16e44cea5cc848f894e823a4fceb9063"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A sequestration project that commences
				operation on or after January 1, 2011, is eligible to create offset credits
				under this subtitle if the sequestration project satisfies the other applicable
				requirements of this subtitle.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID452bffdc955741b1b372ca9b16d6e397"><enum>(2)</enum><header display-inline="yes-display-inline">Exception for agricultural
				projects</header><text display-inline="yes-display-inline">Notwithstanding
				paragraph (1), sequestration flow from an agricultural project that occurs on
				or after January 1, 2011, may provide the basis for offset credits under this
				subtitle regardless of the date on which the agricultural sequestration project
				to which the sequestration flow is attributable commenced, if the project
				satisfies the other applicable requirements of this subtitle.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2bab633763224f908fe16d2288cacb27"><enum>(c)</enum><header display-inline="yes-display-inline">Discounting for business-as-usual
				practices</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDf066f0b10ba14396ae906c142d7e8329"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In order to streamline the availability of
				offset credits for agricultural and other land use-related sequestration
				projects, the regulations promulgated under subsection (a) shall provide for
				the calculation and reporting of region-specific discount factors by the
				Secretary of Agriculture—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="idDCFC5F0CC1C94ACBA911CAA44EF0B3AA"><enum>(A)</enum><text display-inline="yes-display-inline">to be used by developers of agricultural
				projects and other land use-related sequestration projects; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6EFAE29E854C4D57A3F87B688FBDE6C4"><enum>(B)</enum><text display-inline="yes-display-inline">to account for business-as-usual practices
				for specific types of sequestration projects.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9831c3a9f1b84479914c6b31b823ddb0"><enum>(2)</enum><header display-inline="yes-display-inline">Calculation</header><text display-inline="yes-display-inline">Unless otherwise provided in this subtitle,
				the region-specific discount factor for business-as-usual practices for
				sequestration projects shall be calculated by dividing—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDed338ca5f2b34ee18d5e817104f57748"><enum>(A)</enum><text display-inline="yes-display-inline">the difference between—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID46302378bfb648fbbf0c75feb5eae346"><enum>(i)</enum><text display-inline="yes-display-inline">the quantity of greenhouse gases
				sequestered in the region as a result of the offset practice under this
				subtitle; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDeec4dabfb0144e60a04d0c267bbee053"><enum>(ii)</enum><text display-inline="yes-display-inline">the quantity of greenhouse gases
				sequestered in the region as a result of the projected business-as-usual
				implementation of the applicable offset practice; by</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID62e551dd6035417bb2195a17fe058d61"><enum>(B)</enum><text display-inline="yes-display-inline">the quantity of greenhouse gases
				sequestered in the region as a result of the offset practice under this
				subtitle.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6980fec9725e4800b2de92a5c6d28a86"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id415D363626E94051989D31A9E67414E3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The regulations promulgated under this
				section shall, to the maximum extent practicable—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID719e1655f33043e1a65215b005631ddd"><enum>(i)</enum><text display-inline="yes-display-inline">define geographic regions with reference to
				land that has similar agricultural characteristics; and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID49dd0285f37a40288baeea48f0c82fc7"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), define
				baseline historical reference periods for each category of sequestration
				practice, using the most recent period of sufficient length for which there are
				reasonably comprehensive data available.</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id895E9EAEC1354E20A6B5D7F267D33165"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Secretary of Agriculture determines
				that entities have increased implementation of the relevant offset practice
				during the most recent period in anticipation of legislation granting credit
				for the offsets, the regulations described in subparagraph (A)(ii) may define
				baseline historical reference periods for each category of sequestration
				practice using an earlier period.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1ff5cdb70a6e43fbad82a02381c64ffc"><enum>(d)</enum><header display-inline="yes-display-inline">Quantifying sequestration
				flow</header><text display-inline="yes-display-inline">The regulations that
				quantify sequestration flow shall include—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID0f05c6cdad054259874821ac150f0eae"><enum>(1)</enum><text display-inline="yes-display-inline">a default rate of sequestration flow,
				regionally specific to the maximum extent practicable, for each offset practice
				or combination of offset practices, that is estimated conservatively to allow
				for site-specific variations and data uncertainties;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5fd479b3d99143bb880847a50d3affcf"><enum>(2)</enum><text display-inline="yes-display-inline">a downward adjustment factor for any offset
				practice or combination of practices for which, in the judgment of the
				Secretary of Agriculture, there are substantial uncertainties in the
				sequestration flows estimated in paragraph (1), but still reasonably sufficient
				data to calculate a default rate of flow; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb27b1d1f52dd4ef1a2e5ca66179c8d6a"><enum>(3)</enum><text display-inline="yes-display-inline">offset practice- or project-specific
				measurement, monitoring, and verification requirements for—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="idE3D02E1719114A95815E873BE6C38CF7"><enum>(A)</enum><text display-inline="yes-display-inline">offset practices or projects for which
				there are insufficiently reliable data to calculate a default rate of
				sequestration flow; or</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6F8CE1CC12842A29C048DB288413175"><enum>(B)</enum><text display-inline="yes-display-inline">projects for which the project proponent
				chooses to use project-specific requirements.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa5603f0f95844a96a63c2e7bcc701c14"><enum>(e)</enum><header display-inline="yes-display-inline">Use of native plant species in offset
				projects</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID26d3f58c40444fb8ba8a340dc1b708ae"><enum>(1)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this title, the Administrator, in consultation with the Secretary
				of Agriculture, shall promulgate regulations for selection, use, and storage of
				native and nonnative plant materials in the offset projects described in
				paragraph (2)—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID8594a8a5d5f941ee84dbe0cb6175d256"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure native plant materials are given
				primary consideration, in accordance with applicable Department of Agriculture
				guidance for use of native plant materials;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58fbf2c01cf14fdf972a15f76ddee749"><enum>(B)</enum><text display-inline="yes-display-inline">to prohibit the use of Federal- or
				State-designated noxious weeds; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8f63893315c845bd90a53e574658cf90"><enum>(C)</enum><text display-inline="yes-display-inline">to prohibit the use of a species listed by
				a regional or State invasive plant council within the applicable region or
				State.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf3fddb82544b41c1982db797f26c2b01"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The regulations under paragraph (1) shall
				apply to qualifying offset projects described in sections 733(b)(2), 734(a)(2),
				and 734(b)(1).</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE915BDD0BEE143B89203026C22DDDED6" section-type="subsequent-section"><enum>733.</enum><header display-inline="yes-display-inline">Categories of agricultural offset
				practices</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDcbbb4bec4adf42d689d8dc7b5a188fbd"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Secretary of Agriculture, in consultation with the
				Administrator, shall promulgate regulations establishing the categories of
				offset practices that—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="id407B00233AB148FFA9D49330F033E8D1"><enum>(1)</enum><text display-inline="yes-display-inline">reduce greenhouse gases as a result of
				agricultural sequestration projects; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8CBB628003640ED80916C6F18C06AE0"><enum>(2)</enum><text display-inline="yes-display-inline">are eligible to receive offset credits
				under this subtitle.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd7e68d052eb14cf49a1555885f7bf3a0"><enum>(b)</enum><header display-inline="yes-display-inline">Offset practices</header><text display-inline="yes-display-inline">Offset practices described in subsection
				(a) shall include—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID89e50d71cb9343638251e1a1f6767fec"><enum>(1)</enum><text display-inline="yes-display-inline">agricultural sequestration practices,
				including—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID7c7be59ded2e4fafacfadd01c69e1fa5"><enum>(A)</enum><text display-inline="yes-display-inline">no-till agriculture;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID23b543353edb43f3bdbb240416a01100"><enum>(B)</enum><text display-inline="yes-display-inline">conservation tillage (ridge till or minimum
				till);</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID466c1623dd7e44caabf7211c899898c6"><enum>(C)</enum><text display-inline="yes-display-inline">winter cover cropping;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0b4a5672266b42e0a698f311cd093ccd"><enum>(D)</enum><text display-inline="yes-display-inline">switching from a cycle of—</text>
												<clause commented="no" display-inline="no-display-inline" id="IDd61843cd45f740f8ae8797e156edcfa4"><enum>(i)</enum><text display-inline="yes-display-inline">planting wheat or other crops and then
				fallowing land; to</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="ID0a53ef3763eb425198efa54fb1e2d701"><enum>(ii)</enum><text display-inline="yes-display-inline">continuous cropping;</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0a76425529014464a052cbbef1b3df83"><enum>(E)</enum><text display-inline="yes-display-inline">any other offset practices identified by
				the Administrator, in consultation with the Secretary of Agriculture;
				and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf8d11ef815af434394bb8c36f2096a38"><enum>(F)</enum><text display-inline="yes-display-inline">combinations of any of the offset practices
				described in subparagraphs (A) through (E); and</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2e4394b6eed04f56a3259dfefb6244f2"><enum>(2)</enum><text display-inline="yes-display-inline">conversion of cropland to rangeland or
				grassland.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id149965C800E04CF6A9730F7F18725552" section-type="subsequent-section"><enum>734.</enum><header display-inline="yes-display-inline">Offset credits from forest management,
				grazing management, and wetlands management</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID943d1ad46f4d48199f9841f6caed63e0"><enum>(a)</enum><header display-inline="yes-display-inline">Forest management offsets</header>
										<paragraph commented="no" display-inline="no-display-inline" id="idA87DB1AB7D6C40DBA62402C166A41CDD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Secretary of Agriculture, in consultation with the
				Administrator, shall promulgate regulations providing for the issuance of
				offset credits for forest management projects that provide durable, long-term
				reductions in greenhouse gases as a result of sequestration.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7a28003801f541b48775d384d45d564e"><enum>(2)</enum><header display-inline="yes-display-inline">Forest management offsets</header><text display-inline="yes-display-inline">Forest management offset projects under
				this section may include activities that reduce greenhouse gases as a result of
				forest management sequestration projects (including afforestation), other than
				avoided forest land conversion as described in section 735.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6f4c6f87fa554d4ea7b68ef51a6d6cdf"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibitions</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="idD082B268782045D6BB6068F880A2EAD8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with section 732(e), no
				afforestation project may involve the planting of invasive species or noxious
				weeds.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0936A88DBF134122B6617DE77B3FED42"><enum>(B)</enum><header display-inline="yes-display-inline">Existing native grassland and
				ecosystems</header><text display-inline="yes-display-inline">No afforestation
				project may involve planting trees on existing native grassland or other
				existing native non-forested ecosystems that the Secretary of Agriculture
				determines should be protected in their existing native condition.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID98e31d4e78e0494ba26604d494b24101"><enum>(b)</enum><header display-inline="yes-display-inline">Wetlands management offsets</header>
										<paragraph commented="no" display-inline="no-display-inline" id="idFEF8DE5646D349B3ABF3A04DF3458BE5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in consultation with the Chief of
				Engineers, shall promulgate regulations providing for the issuance of offset
				credits for wetlands management projects that provide durable, long-term
				reductions in greenhouse gases as a result of sequestration.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0bc69705ae344cde84883a42f140b1b7"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibitions</header>
											<subparagraph commented="no" display-inline="no-display-inline" id="id0BA59E9B68A74D29A638BDA4EED69F10"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with section 732(e), no
				wetlands restoration project may involve the planting of invasive species or
				noxious weeds.</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2FEE49EB8D84BCD98C3C9E2FBBF1CE5"><enum>(B)</enum><header display-inline="yes-display-inline">No new wetlands</header><text display-inline="yes-display-inline">No wetlands offset project may be carried
				out in an area in which underlying local hydrologic processes will not support
				a wetland.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6dc71e9f93a7450085993cea5d2cc3ff"><enum>(c)</enum><header display-inline="yes-display-inline">Grazing management offsets</header>
										<paragraph commented="no" display-inline="no-display-inline" id="idAF84A1522DE74C8F87807646EDEBA4A7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Secretary of Agriculture, in consultation with the
				Administrator, shall promulgate regulations providing for the issuance of
				offset credits for grazing management projects that provide durable, long-term
				reductions in greenhouse gases as a result of sequestration.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc12840ff5a70443ab69ce68923cb200e"><enum>(2)</enum><header display-inline="yes-display-inline">Grazing management offsets</header><text display-inline="yes-display-inline">Grazing management offset projects under
				this section may include activities that reduce greenhouse gases as a result of
				grazing management sequestration projects other than conversion of cropland to
				grassland or rangeland under section 733.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID450ac43b0e754b0bbf16ded0ede80122"><enum>(d)</enum><header display-inline="yes-display-inline">Use of offsets</header>
										<paragraph commented="no" display-inline="no-display-inline" id="id4C4BCD18E4BA43CEA7A6AD3A86A48D08"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each calendar year, an affected unit
				may satisfy not more than 5 percent of the total allowance submission
				requirements of the affected unit under section 722 by using forest management
				offset credits under this section.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30c7d4003cbb4d9da7b9082d501d1db6"><enum>(2)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The limitation in paragraph (1) does not
				apply to grazing management, afforestation, or wetland offset projects.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF768AF2218BB47DBBF990F4A583BBBDB" section-type="subsequent-section"><enum>735.</enum><header display-inline="yes-display-inline">Offset credits from the avoided conversion
				of forested land or wetland</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID8427716b7ce04a8190838f532ed468d1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Offset credits for avoided conversion of
				forested land or wetland shall be awarded to any State that reduces the
				conversion below expected levels for all or a significant portion of the
				State.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9982a1daeb23439a8e8e49546261d6ef"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in conjunction with the Secretary
				of Agriculture, shall promulgate regulations that address the eligibility of
				offset practices that avoid the conversion of forested land or wetland to
				nonforested land uses or drained or converted wetland to receive offset credits
				under this subtitle, including requirements that address—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="IDa4ea4ac00ef14ced85904fa5499e50c1"><enum>(1)</enum><text display-inline="yes-display-inline">the methodology for measuring the avoided
				conversion of forest land or wetland, including—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="IDc014f7f952154ff5a5447d349c7b68e6"><enum>(A)</enum><text display-inline="yes-display-inline">measurement of presently on-going rates of
				forest land conversion or wetland conversion;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd8366041bcc84ca6b12610d18058824b"><enum>(B)</enum><text display-inline="yes-display-inline">calculation of business-as-usual rates of
				forest land conversion or wetland conversion by reference to the historical
				rate of conversion of forested land or wetland; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf643521e339c4a0abb4be6a1532c4f99"><enum>(C)</enum><text display-inline="yes-display-inline">comparison of the rates in subparagraph (A)
				and subparagraph (B); and</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4a78cca84cfa41d58f47231a5ab497ae"><enum>(2)</enum><text display-inline="yes-display-inline">leakage, including—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID3e70cbba43214887a0fe23f1bed23377"><enum>(A)</enum><text display-inline="yes-display-inline">adjustments for leakage using standardized
				regional leakage factors for afforestation and wetland restoration; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID903a471f1fdc40e4a963874ca0042512"><enum>(B)</enum><text display-inline="yes-display-inline">the magnitude of the forested region or
				wetlands region in a State in which the rate of conversion of forest land or
				wetland must be reduced to ensure that leakage of forest land or wetlands
				conversion is minimized.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0031f6bd3a6746a78dac64b7eb804927"><enum>(c)</enum><header display-inline="yes-display-inline">Precondition</header><text display-inline="yes-display-inline">For an offset to be creditable under this
				section, the State must certify that the State has reduced its rate of
				conversion of forest land or wetland over a period of 5 or more consecutive
				years for the entire State or a significant forested or wetland region in the
				State.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID07d20d8f36604eacabbb84f99b09950b"><enum>(d)</enum><header display-inline="yes-display-inline">Award by States of offset
				credits</header><text display-inline="yes-display-inline">States that
				participate in the program under this section shall establish transparent and
				equitable rules by which offset credits will be awarded to owners of forested
				land or wetland.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8c0f8b7f934d4321868dc734456acb19"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Administrator, in consultation with the
				Secretary of Agriculture, for use in awarding grants to States to carry out
				this section $5,000,000 for each fiscal year.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="id19E67B890F5843ADA252DAB0AADA6AD5" section-type="subsequent-section"><enum>736.</enum><header display-inline="yes-display-inline">Offset credits from greenhouse gas
				emissions reduction projects</header>
									<subsection commented="no" display-inline="no-display-inline" id="IDe34f13885e524b1aa49827a534fd3693"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall promulgate regulations
				establishing the requirements regarding the issuance, certification, and use of
				offset credits for greenhouse gas emissions reduction offset projects,
				including requirements—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="IDb06038af7cd24cf29394d0933081ba00"><enum>(1)</enum><text display-inline="yes-display-inline">for performance standards for specific
				types of offset projects, which represent significant improvements compared to
				recent practices in the geographic area, to be reviewed, and updated if the
				Administrator determines updating is appropriate, every 5 years;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf0ca8a2e4d1249c69da2b21d12b60a93"><enum>(2)</enum><text display-inline="yes-display-inline">that ensure that the reductions are real,
				additional, verifiable, enforceable, and permanent;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3dcd8e5f2f5b4981925d5b07b557402b"><enum>(3)</enum><text display-inline="yes-display-inline">that address leakage;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf015ee3c8dc84240afdbb4edd2663cac"><enum>(4)</enum><text display-inline="yes-display-inline">that the reductions are not otherwise
				required by any law (including a regulation) or other legally binding
				requirement;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa8534efb702b410794347d449e08a541"><enum>(5)</enum><text display-inline="yes-display-inline">for the quantification, monitoring,
				reporting, and verification of the reductions; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd3e0a2cd82674f45a39218f43fd366be"><enum>(6)</enum><text display-inline="yes-display-inline">that specify the duration of offset credits
				for greenhouse gas emissions reduction projects under this section.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa11414dec05041baa9461e3c6d17d8c8"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility To create offset
				credits</header><text display-inline="yes-display-inline">Greenhouse gas
				emissions reduction offset projects that commence operation on or after January
				1, 2007, are eligible to create offset credits under this subtitle if the
				projects satisfy the other applicable requirements of this subtitle.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3cbac619e80a40de8798faf490b9434c"><enum>(c)</enum><header display-inline="yes-display-inline">Approved categories of greenhouse gas
				emissions reduction offset projects</header><text display-inline="yes-display-inline">Greenhouse gas emission reductions from the
				following types of operations shall be eligible to create offsets for use under
				this section:</text>
										<paragraph commented="no" display-inline="no-display-inline" id="IDc823b25b385b47778381607a04e5b5f8"><enum>(1)</enum><text display-inline="yes-display-inline">Landfill operations.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDff622d6924f1412c8ea5bf8000b36292"><enum>(2)</enum><text display-inline="yes-display-inline">Agricultural manure management
				projects.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf85d1836b2ac4b00a45c23a748f3d206"><enum>(3)</enum><text display-inline="yes-display-inline">Wastewater treatment facilities.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0e70be23628c469eafad5fc2a9533be8"><enum>(4)</enum><text display-inline="yes-display-inline">Coal mining operations.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID043845568cf849bb9f8ddebb29311cd9"><enum>(5)</enum><text display-inline="yes-display-inline">Natural gas transmission and distribution
				systems.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID953a6b0fcdf240a6a5bf73440d4eed50"><enum>(6)</enum><text display-inline="yes-display-inline">Electrical transmission and distribution
				systems.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0f5c6cb82da1468983b73fa923a57981"><enum>(7)</enum><text display-inline="yes-display-inline">Elimination or reduction in use of
				chemicals that substitute for ozone-depleting substances.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID138be2b3c0d2481693cf914729d4eda7"><enum>(8)</enum><text display-inline="yes-display-inline">Cement manufacturing.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDadd4f5490d4241f5b438473eab042d3c"><enum>(9)</enum><text display-inline="yes-display-inline">Lime manufacturing.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2691cf907253464d9da04061f77c0949"><enum>(10)</enum><text display-inline="yes-display-inline">Iron and steel production.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID78385f7ab42448a6a8fc289dd775e1f5"><enum>(11)</enum><text display-inline="yes-display-inline">Aluminum production.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7f4a2df4aa424905bd1db04dd26cbf52"><enum>(12)</enum><text display-inline="yes-display-inline">Adipic acid production.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa82cd27b88be4b8cb4cdd0f939783166"><enum>(13)</enum><text display-inline="yes-display-inline">Nitric acid production.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDecb4c2ee1da943b0bf273cfc3cbef325"><enum>(14)</enum><text display-inline="yes-display-inline">Semiconductor manufacturing.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd8d6aa426aaf44f8aa5d140cc5c9c4fe"><enum>(15)</enum><text display-inline="yes-display-inline">Magnesium production and processing.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe1f91273544e4f8d88a902129f8b4778"><enum>(16)</enum><text display-inline="yes-display-inline">Fossil fuel combustion at commercial and
				residential buildings.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID424722fd1b204450b1a2018962908ef4"><enum>(d)</enum><header display-inline="yes-display-inline">Creation of additional categories of
				greenhouse gas emissions reduction offset projects</header><text display-inline="yes-display-inline">The
				Administrator may, by regulation, create additional categories of greenhouse
				gas emissions reduction offset projects for types of projects for which the
				Administrator determines that compliance with the regulations promulgated under
				subsection (a) is feasible.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe067d0cc90e749b2bb2a7d89f8673dc1"><enum>(e)</enum><header display-inline="yes-display-inline">Prohibition on use</header><text display-inline="yes-display-inline">Notwithstanding the eligibility of
				greenhouse gas emission reduction projects to create offset credits in
				accordance with subsection (c) or (d), greenhouse gas emissions reduction
				offset projects shall not be eligible to create offset credits for use under
				this section beginning on the date on which the reductions are required by law
				(including regulations) or other legally binding requirement.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="id01B54F4E7FDD443799E45C067124D0D9" section-type="subsequent-section"><enum>737.</enum><header display-inline="yes-display-inline">Borrowing at program start-up based on
				contracts to purchase offset credits</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID075148c1b1a743fe8cbaacd6eefb9a2c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During calendar years 2011, 2012, and 2013,
				an affected unit may satisfy not more than 5 percent of the allowance
				submission requirements of section 722 by submitting to the Administrator
				contractual commitments to purchase offset credits that will implement an
				equivalent quantity of emission reductions or sequestration not later than
				December 31, 2015.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7fbe8d99b2b6482abf0a8c96ab8066d3"><enum>(b)</enum><header display-inline="yes-display-inline">Approval of qualifying offset
				projects</header><text display-inline="yes-display-inline">Offset projects that
				may be appropriately carried out under this section shall be approved by the
				Administrator in accordance with this subtitle.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ID54643cab65964da88425fe66fa5fe4e5"><enum>(c)</enum><header display-inline="yes-display-inline">Repayment by 2015</header>
										<paragraph commented="no" display-inline="no-display-inline" id="ID7990beb99c7f4cae8248e1ddcc4cb3a7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If an affected unit uses subsection (a) to
				comply with section 722, not later than the deadline in that section for
				allowance submissions for calendar year 2015, the affected unit shall submit
				additional credits of a quantity equivalent to the sum obtained by
				adding—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID8cfc5f3ad6154f6e8c4af1cdffc9cb49"><enum>(A)</enum><text display-inline="yes-display-inline">the value of credits submitted to comply
				with credit submission requirements described in subsection (a); and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9d883deae87b46c68a4f7c8106959f4f"><enum>(B)</enum><text display-inline="yes-display-inline">interest calculated in accordance with
				paragraph (2).</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04f9c9faa3324ea88abc15419a2decbc"><enum>(2)</enum><header display-inline="yes-display-inline">Interest</header><text display-inline="yes-display-inline">Interest referred to in paragraph (1)(B)
				shall be equal to the product obtained by multiplying—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="ID3d96cb69217942a8afc1ce887a9d7452"><enum>(A)</enum><text display-inline="yes-display-inline">the number of years between—</text>
												<clause commented="no" display-inline="no-display-inline" id="id4EF41F87A1DD48CD92D5444464C98709"><enum>(i)</enum><text display-inline="yes-display-inline">the use by an affected unit of the method
				of compliance described in subsection (a); and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="id8633CFE85E82498BB011853B37A557BB"><enum>(ii)</enum><text display-inline="yes-display-inline">the submission by the affected unit of
				additional credits under this subsection; and</text>
												</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5c2583c32a3243e3bc12086dd75ae700"><enum>(B)</enum><text display-inline="yes-display-inline">the sum obtained by adding—</text>
												<clause commented="no" display-inline="no-display-inline" id="ID5c89992b8d514c2ea40f282a688ebf9a"><enum>(i)</enum><text display-inline="yes-display-inline">the Federal short-term rate, as defined
				pursuant to section 1274(d)(1)(C)(i) of the Internal Revenue Code of 1986;
				and</text>
												</clause><clause commented="no" display-inline="no-display-inline" id="IDf424d9a0fd7c470d81fbc16fe57e9aa1"><enum>(ii)</enum><text display-inline="yes-display-inline">2 percent.</text>
												</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id70291249096D42DC8278BCBCF41FA28A" section-type="subsequent-section"><enum>738.</enum><header display-inline="yes-display-inline">Review and correction of accounting for
				offset credits</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID77466a0bce914d6794f2f8a11497bf5e"><enum>(a)</enum><header display-inline="yes-display-inline">Duty To monitor</header><text display-inline="yes-display-inline">The Secretary of Agriculture and the
				Administrator shall monitor regularly whether offset credits under the
				respective jurisdiction of each agency head under this subtitle are being
				awarded only for real and additional sequestration of greenhouse gases and
				reductions in greenhouse gas emissions, including—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID5fcac5dad66c41889d766b85c1ca176b"><enum>(1)</enum><text display-inline="yes-display-inline">the accuracy of default calculations of
				sequestration flow and greenhouse gas emission reductions achieved by the use
				of offset practices;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDba5c74ecc39441eaa368bf60b5c9e2ba"><enum>(2)</enum><text display-inline="yes-display-inline">the calculation of region-specific discount
				factors; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8eb507f52bb04bb28f922da71ad63c6b"><enum>(3)</enum><text display-inline="yes-display-inline">the accuracy of leakage
				calculations.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4b8a9149a7fc4929950dbcf7d278b9b9"><enum>(b)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">Not later than December 31, 2013, and every
				5 years thereafter, the Secretary of Agriculture and the Administrator shall
				review the issuance of offset credits under the respective jurisdiction of each
				agency head under this subtitle to determine—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID86995fb2311340ff82633e26cdde9c05"><enum>(1)</enum><text display-inline="yes-display-inline">whether offset credits are being awarded
				only for real and additional sequestration of greenhouse gases or reductions in
				greenhouse gas emissions, as described in subsection (a);</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4fa77461e7e843d4a62ac51dc9d6104c"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of excessive award of any offset
				credits;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0e82b3d4ad474642ae5bc992adada45d"><enum>(3)</enum><text display-inline="yes-display-inline">the volume of offset credits that have been
				or are expected to be approved;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7a29a28b2b234c49ae3d7ed92ee88f2f"><enum>(4)</enum><text display-inline="yes-display-inline">the impact of the offset credits on market
				prices; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8778cd48ecbf4c7191dd22b51c038fa5"><enum>(5)</enum><text display-inline="yes-display-inline">the impact of the offset credits on the
				trajectory of emissions from affected units.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7dc68e25235c40758c3b433be8f8da72"><enum>(c)</enum><header display-inline="yes-display-inline">Duty To correct</header><text display-inline="yes-display-inline">If the Secretary of Agriculture or the
				Administrator determines that offset credits under the respective jurisdictions
				of the agency head have been awarded under this subtitle in excess of real and
				additional sequestration of greenhouse gases or reductions in emissions of
				greenhouse gases, the Secretary of Agriculture or the Administrator
				shall—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="ID34f9622b5d85423cb5add9910fa15ded"><enum>(1)</enum><text display-inline="yes-display-inline">promptly correct on a prospective basis the
				sources of the errors, including correcting leakage factors, region-specific
				discount factors, default rates of sequestration flow, and other relevant
				information for the offset practices involved; and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb682ad4e2a14affba667a3b5aba93ee"><enum>(2)</enum><text display-inline="yes-display-inline">quantify and publicly disclose the quantity
				of offset credits that have been awarded in excess of real and additional
				sequestration or emissions reductions.</text>
										</paragraph></subsection></section></subtitle><subtitle commented="no" id="idAF57607B60E54093A8A2D127E5350786" level-type="subsequent" style="OLC"><enum>C</enum><header display-inline="yes-display-inline">National Registry for Credits</header>
								<section commented="no" display-inline="no-display-inline" id="IDf83b20bd034d41eab09e2c4e8b634038" section-type="subsequent-section"><enum>741.</enum><header display-inline="yes-display-inline">Establishment and operation of national
				registry</header>
									<subsection commented="no" display-inline="no-display-inline" id="ID03b9e0a7fde54f159719a6e702fffe6c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), not
				later than July 1 of the year immediately prior to the first calendar year in
				which an annual tonnage limitation on the emission of greenhouse gases applies
				under section 711(b), the Administrator shall promulgate regulations to
				establish, operate, and maintain a national registry through which the
				Administrator shall—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="IDa2adc0dc4da0446ab553e51c1d1a16a6"><enum>(1)</enum><text display-inline="yes-display-inline">record allocations of allowances, the
				issuance of offset credits or early reduction credits, and the recognition of
				international credits;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42065e7d97ea4970b577c99eeb5de723"><enum>(2)</enum><text display-inline="yes-display-inline">track transfers of credits;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID255157280b9e40a3881229c381531c88"><enum>(3)</enum><text display-inline="yes-display-inline">retire all credits used for
				compliance;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7474a50b35c74abfa5e68bb384aa8f36"><enum>(4)</enum><text display-inline="yes-display-inline">subject to subsection (b), maintain
				transparent availability of registry information to the public, including the
				quarterly reports submitted under section 742(a);</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcb770e2c9c114db7b80077e574308cee"><enum>(5)</enum><text display-inline="yes-display-inline">prepare an annual assessment of the
				emission data in the quarterly reports submitted under section 742(a);
				and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID941898a59eb8423eace02ee0cfa608a0"><enum>(6)</enum><text display-inline="yes-display-inline">take such action as is necessary to
				maintain the integrity of the registry, including adjustments to correct
				for—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id2115B5FA051248C6966EABB9004E3A03"><enum>(A)</enum><text display-inline="yes-display-inline">errors or omissions in the reporting of
				data; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47D8CF3F433A4AE2A61AA683FCB0DBDE"><enum>(B)</enum><text display-inline="yes-display-inline">the prevention of counterfeiting,
				double-counting, multiple registrations, multiple sales, and multiple
				retirements of credits.</text>
											</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID81d16a5e4daa4025bde37c695d07f5ae"><enum>(b)</enum><header display-inline="yes-display-inline">Exception to public availability of
				data</header>
										<paragraph commented="no" display-inline="no-display-inline" id="IDc02341b44ad0484fb10d700f3e974861"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (a)(4) shall not apply in any
				case in which the Administrator, in consultation with the Secretary of Defense,
				determines that publishing or otherwise making available information in
				accordance with that paragraph poses a risk to national security.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb7ae856f92d46d493dab33e159b00e2"><enum>(2)</enum><header display-inline="yes-display-inline">Statement of reasons</header><text display-inline="yes-display-inline">In a case described in paragraph (1), the
				Administrator shall publish a description of the determination and the reasons
				for the determination.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9DAC8DA7956E4E75B5C994C6212D608C" section-type="subsequent-section"><enum>742.</enum><header display-inline="yes-display-inline">Monitoring and reporting</header>
									<subsection commented="no" display-inline="no-display-inline" id="id59E09F763D874390BCB06E09EBFB9514"><enum>(a)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Each owner or operator of an affected unit,
				or to the extent applicable, the greenhouse gas authorized account
				representative for the affected unit, shall—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="idF5C36BEBABC4458BB39F79C74E97D1D0"><enum>(1)</enum><text display-inline="yes-display-inline">comply with the monitoring, recordkeeping,
				and reporting requirements of part 75 of title 40, Code of Federal Regulations
				(or successor regulations); and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD29B40F5EFF416192B927AECFB7CCAA"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Administrator electronic
				quarterly reports that describe the greenhouse gas mass emission data, fuel
				input data, and electricity output data for the affected unit.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE61F9C4E01E24604B945F0764D2096A7"><enum>(b)</enum><header display-inline="yes-display-inline">Biomass Cofiring</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this title, the Administrator shall promulgate regulations that
				provide monitoring, recordkeeping, and reporting requirements for biomass
				cofiring at affected
				units.</text>
									</subsection></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id67C767F28C7342159C057E295FAE3874"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header>

			 Foundation</header><text display-inline="no-display-inline">Section 105 of the
			 Global Change Research Act of 1990 (15 U.S.C. 2935) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7f927af1c4dd411d96cc0021b1b5c606"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as
			 subsection (d); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2de83446ad5c4bde92bc5c4192a6dc8e"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>

						<subsection commented="no" display-inline="no-display-inline" id="ID7af70d94cffa474cbe8bc40ccb5206a4"><enum>(c)</enum><header display-inline="yes-display-inline">Research grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID1184da8e84e946c090e081fadcbca56e"><enum>(1)</enum><header display-inline="yes-display-inline">List of priority research
				areas</header><text display-inline="yes-display-inline">The Committee shall
				develop a list of priority areas for research and development on climate change
				that are not being adequately addressed by Federal agencies.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe86a6da59d5e4515ad685d147e68fd21"><enum>(2)</enum><header display-inline="yes-display-inline">Transmission of list</header><text display-inline="yes-display-inline">The Director of the Office of Science and
				Technology Policy shall submit the list developed under paragraph (1) to the
				National Science Foundation.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd34d8272e3d146f5abc87f3f017594ba"><enum>(3)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the National Science Foundation such sums as
				are necessary to carry out this subsection, to be made available through the
				Science and Technology Policy Institute, for research in the priority
				areas.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id9C79711E5F694D85B8565BDBB1384AF3" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Abrupt climate change research</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID1bedd65fd40049cb8cf0dddb58489967"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Commerce, acting through
			 the National Oceanic and Atmospheric Administration, shall carry out a program
			 of scientific research on abrupt climate change designed to provide timely
			 warnings of the potential likelihood, magnitude, and consequences of, and
			 measures to avoid, abrupt human-induced climate change.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2d4c55bb70db4eabbbcc0baae54e8ef0"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary of Commerce such sums as are
			 necessary to carry out this section.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idF81C54B55FCD4FE3B7B8E9C4ADC91E94" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Development of new measurement
			 technologies</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID11c59d239a9d47ae9f69ac5b633dafbf"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall carry out a program to develop, with technical
			 assistance from appropriate Federal agencies, innovative standards and
			 measurement technologies to calculate greenhouse gas emissions or reductions
			 for which no accurate, reliable, low-cost measurement technology exists.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID32710c3ff1e04da68cb0850cc94bd44f"><enum>(b)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The program shall include technologies
			 (including remote sensing technologies) to measure carbon changes and other
			 greenhouse gas emissions and reductions from agriculture, forestry, wetlands,
			 and other land use practices.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idEF43F2FEFBF14813934387F20DFC0504"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Administrator such sums as are necessary
			 to carry out this section.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id4C794A802A5C4F64B60C28C168F83E92" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Technology development and
			 diffusion</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC5DACAD93ADE44A4B496854DA000747A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of the National Institute of
			 Standards and Technology, acting through the Manufacturing Extension
			 Partnership program, may develop a program to promote the use, by small
			 manufacturers, of technologies and techniques that result in reduced emissions
			 of greenhouse gases or increased sequestration of greenhouse gases.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id040DD0B69B4F47C3A8AD506A87C2F9F4"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Director of the National Institute of
			 Standards and Technology such sums as are necessary to carry out this
			 section.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idF5794CA0083B45F697A47F94B513CF75" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Public land</header>
				<subsection commented="no" display-inline="no-display-inline" id="id7A97E4AD30C24858BC7F3F80CA73C29C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
			 enactment of this Act, the Secretary of Agriculture and the Secretary of the
			 Interior shall prepare a joint assessment or separate assessments setting forth
			 recommendations for increased sequestration of greenhouse gases and reduction
			 of greenhouse gas emissions on public land that is—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID789bd55984444dac8bec98dabec4a77e"><enum>(1)</enum><text display-inline="yes-display-inline">managed forestland;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc714379b134b438d9d203c749691e454"><enum>(2)</enum><text display-inline="yes-display-inline">managed rangeland or grassland; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7e59c682b544496da2b5b5df55a5e893"><enum>(3)</enum><text display-inline="yes-display-inline">protected land, including national parks
			 and designated wilderness areas.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc39fa1d5053b45fea88c782ad8b62f75"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary of Agriculture and the Secretary
			 of the Interior such sums as are necessary to carry out this section.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID581ce362532d419a9d942688ca4cfa2b" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Sea level rise from polar ice sheet
			 melting</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID4ba7a479bedc46d7ac1d88876ee7937d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Commerce, acting through
			 the National Oceanic and Atmospheric Administration and in cooperation with the
			 Administrator of the National Aeronautics and Space Administration, shall carry
			 out a program of scientific research to support modeling and observations into
			 the potential role of the Greenland, west Antarctic, and east Antarctic ice
			 sheets in any future increase in sea levels.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2856047b915245abbc7746b91ed40519"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary of Commerce and the
			 Administrator of the National Aeronautics and Space Administration such sums as
			 are necessary to carry out this section.</text>
				</subsection></section></title></legis-body>
