		<official-title>To provide for a Federal employees program to authorize
		  the use of leave by caregivers for family members of certain individuals
		  performing military service, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Military Family Support
			 Act</short-title></quote>.</text>
		</section><section id="idD35BB932EFD84E42A1212A3372DB744B"><enum>2.</enum><header>Federal
			 employees program for use of leave by caregivers for family members of
			 individuals performing certain military service</header>
			<subsection id="id43AA0AE2BE084E50B9030004C057231C"><enum>(a)</enum><header>Federal
			 employees program</header>
				<paragraph id="idDFD9495B2E3849BD93E858D721B4ED0F"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="idD6EAE6B6EB754DC28F9E841A247A1A7C"><enum>(A)</enum><header>Caregiver</header><text>The
			 term <term>caregiver</term> means an individual who—</text>
						<clause id="id7F2BC3B3727D4B99985AF1E453EDC0E7"><enum>(i)</enum><text>is
			 an employee;</text>
						</clause><clause id="idF5B9EDB92F44417CB73BDCB9D0C2BA87"><enum>(ii)</enum><text>is
			 at least 18 years of age; and</text>
						</clause><clause id="id215CE9B806384892A802026AC14521C2"><enum>(iii)</enum><text>is capable of
			 self care and care of children or other dependent family members of a qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph id="idF591016A5F1847178F53B80A37117674"><enum>(B)</enum><header>Covered period
			 of service</header><text>The term <term>covered period of service</term> means
			 any period of service performed by an employee as a caregiver—</text>
						<clause id="idBCB9B82FB90A4CC39622B9C754298CC8"><enum>(i)</enum><text>while the
			 individual who designated the caregiver under paragraph (3)(A) remains a
			 qualified member of the Armed Forces; or</text>
						</clause><clause id="id2D267BA0F1E7448CB7C8A773D36A612A"><enum>(ii)</enum><text>after being
			 designated as the caregiver under paragraph (3)(B) and while the applicable
			 qualified member of the Armed Forces remains a qualified member of the Armed
			 Forces.</text>
						</clause></subparagraph><subparagraph id="idEBA8225E125E4653A362C1CCD1231772"><enum>(C)</enum><header>Employee</header><text>Except
			 as provided under paragraph (5), the term <term>employee</term> has the meaning
			 given under section 6331 of title 5, United States Code.</text>
					</subparagraph><subparagraph id="id1CBD349A82B84E0A8064DAF1D8E70E02"><enum>(D)</enum><header>Family
			 member</header><text>The term <term>family member</term> includes—</text>
						<clause id="id158C8AF53C544ABEBABA88705B3FCE3B"><enum>(i)</enum><text>individuals for
			 whom the qualified member of the Armed Forces provides medical, financial, and
			 logistical support (such as housing, food, clothing, or transportation);
			 and</text>
						</clause><clause id="idCE9D08E849ED49FFB984EA00AF81611F"><enum>(ii)</enum><text>children under
			 the age of 19 years, elderly adults, persons with disabilities, and other
			 persons who are unable to care for themselves in the absence of the qualified
			 member of the Armed Forces.</text>
						</clause></subparagraph><subparagraph id="id0CF10C595BD441F7989A36D076148594"><enum>(E)</enum><header>Qualified
			 member of the armed forces</header><text>The term <term>qualified member of the
			 Armed Forces</term>—</text>
						<clause id="id4B1C8ABB08BE416382FBD10338A70240"><enum>(i)</enum><text>means—</text>
							<subclause id="id28ACCE1DBF714731BD51C72CA19612BA"><enum>(I)</enum><text>a member of a
			 reserve component of the Armed Forces as described under section 10101 of title
			 10, United States Code, who has received notice to report to, or is serving on,
			 active duty in the Armed Forces in support of a contingency operation as
			 defined under section 101(a)(13) of title 10, United States Code; or</text>
							</subclause><subclause id="id49F92A54B5C4481F9E2C266896DD4898"><enum>(II)</enum><text>a member of the
			 Armed Forces on active duty who is eligible for hostile fire or imminent danger
			 special pay under section 310 of title 37, United States Code; and</text>
							</subclause></clause><clause id="id7981BB1C1ED0448BB4E1C55E784B9972"><enum>(ii)</enum><text>includes a
			 member described under clause (i) who is medically discharged or retires from
			 the Armed Forces, but only for the 36 month period beginning on the date of
			 that medical discharge or retirement.</text>
						</clause></subparagraph></paragraph><paragraph id="idFD60AC332C36400084CFDEE2FD901C4D"><enum>(2)</enum><header>Establishment
			 of program</header><text>The Office of Personnel Management shall establish a
			 program that—</text>
					<subparagraph id="idF26D71D3E5FC4D2D9988AEE57D0CA39D"><enum>(A)</enum><text>authorizes a
			 caregiver to—</text>
						<clause id="id2E517A34575243DFB5F676824CEB4B29"><enum>(i)</enum><text>use
			 any sick leave of that caregiver during a covered period of service; and</text>
						</clause><clause id="id4404D7E595D7450190241D0FB4F18B71"><enum>(ii)</enum><text>use any leave
			 available to that caregiver under subchapter III or IV of chapter 63 of title
			 5, United States Code, during a covered period of service as though that
			 covered period of service is a medical emergency;</text>
						</clause></subparagraph><subparagraph id="id0213F706DA49409E9DBC033B6367D4DE"><enum>(B)</enum><text>provides a
			 process under which a caregiver provides the employing agency reasonable notice
			 of the need for leave under this section, similar to the process under which
			 notice is provided to the employing agency under subchapter V of chapter 63 of
			 title 5, United States Code; and</text>
					</subparagraph><subparagraph id="id6727DBB545D14F77A5B426313B5B4F4E"><enum>(C)</enum><text>protects
			 employees from discrimination or retaliation for the use of the leave under
			 this section and provides employees with the opportunity to appeal a denial of
			 the use of leave under this section.</text>
					</subparagraph></paragraph><paragraph id="idFCCFDFC700E04B278F2DE9F6D82DF5A8"><enum>(3)</enum><header>Designation of
			 caregiver</header>
					<subparagraph id="id759F7BC7FBBA4BBCAC6AFDD73B503214"><enum>(A)</enum><header>In
			 general</header><text>A qualified member of the Armed Forces shall submit a
			 written designation of the individual who is the caregiver for any family
			 member of that member of the Armed Forces during a covered period of service to
			 the employing agency and the Office of Personnel Management.</text>
					</subparagraph><subparagraph id="idDBA8DA4E480D48B1A5497FA52B4EF749"><enum>(B)</enum><header>Incapacitated
			 members</header><text>If a qualified member of the Armed Forces who did not
			 submit a designation under subparagraph (A) becomes incapacitated and is unable
			 to submit that designation, a designation under subparagraph (A) may be
			 submitted on behalf of that member by another individual in accordance with
			 regulations prescribed by the Office of Personnel Management after consultation
			 with the Department of Defense.</text>
					</subparagraph></paragraph><paragraph id="id9079AF187080435EB05DBF85474F6231"><enum>(4)</enum><header>Use of
			 caregiver leave</header><text>Leave may only be used under this subsection for
			 purposes directly relating to, or resulting from, the designation of an
			 employee as a caregiver.</text>
				</paragraph><paragraph id="id0CB49B481F88498EBA3DB5FFD1EBB3EE"><enum>(5)</enum><header>Prohibition of
			 coercion</header>
					<subparagraph id="idA7E64BAF91B446578D8DB584EDD608D6"><enum>(A)</enum><header>Definition</header><text>In
			 this section:</text>
						<clause id="id0774428C62704885BF5C862009EAA9DC"><enum>(i)</enum><header>Employee</header><text>The
			 term <term>employee</term> has the meaning given under section 2105 of title 5,
			 United States Code.</text>
						</clause><clause id="idB9797393C66448B9B39A512D015D1265"><enum>(ii)</enum><header>Intimidate,
			 threaten, or coerce</header><text>The term <term>intimidate, threaten, or
			 coerce</term> includes promising to confer or conferring any benefit (such as
			 appointment, promotion, or compensation), or taking or threatening to take any
			 reprisal (such as deprivation of appointment, promotion, or
			 compensation).</text>
						</clause></subparagraph><subparagraph id="idD441C922638F4855971C90511EDEF6A5"><enum>(B)</enum><header>Prohibition</header><text>An
			 employee shall not directly or indirectly intimidate, threaten, or coerce, or
			 attempt to intimidate, threaten, or coerce, any other employee for the purpose
			 of interfering with the exercise of any rights which such other employee may
			 have under this Act.</text>
					</subparagraph></paragraph><paragraph id="id8E19CAD0485D48F89C8B29CEC2B966DE"><enum>(6)</enum><header>Regulations</header><text>Not
			 later than 120 days after the date of enactment of this Act, the Office of
			 Personnel Management shall prescribe regulations to carry out this
			 subsection.</text>
				</paragraph><paragraph id="id2951C9F73A5A46D795ED2FE0729D0C2E"><enum>(7)</enum><header>Termination</header><text>The
			 program under this subsection shall terminate on December 31, 2012.</text>
				</paragraph></subsection><subsection id="id79B0D9FFAFCB430AA104A0A5AF7A6933"><enum>(b)</enum><header>GAO
			 report</header><text display-inline="yes-display-inline">Not later than June
			 30, 2010, the Government Accountability Office shall submit a report to
			 Congress on the program under subsections (a) that includes—</text>
				<paragraph id="idC307EFDB58D24A4BAF79B5EEE6D2D1E3"><enum>(1)</enum><text>an evaluation of
			 the success of the program;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE37CA6AF57404D25AC77EDBF765E7409"><enum>(2)</enum><text>recommendations
			 for the continuance or termination of the program; and</text>
				</paragraph><paragraph id="ID0e67c1a153024672800a5bc2f6ff3368"><enum>(3)</enum><text>a recommendation
			 for the program or an expansion of the Family Medical Leave Act of 1993.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA42E52D6BBAB41E09262ED74654AD721"><enum>(c)</enum><header>Offset</header><text>The
			 aggregate amount authorized to be appropriated for fiscal year 2008 for the use
			 of the Department of Defense for research, development, test and evaluation
			 shall be reduced by $2,000,000.</text>
