		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Oregon Caves National Monument
			 Boundary Adjustment Act of 2008</short-title></quote>.</text>
		</section><section id="id05F5DB47E18A477CA3FAF0D6939D3FF1"><enum>2.</enum><header>Findings;
			 purpose</header>
			<subsection id="idDA6265FD32CD436B95439F4E2C3EFCD5"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id54A97C2B7A574C8C80F0BFC885E5EE26"><enum>(1)</enum><text>the Oregon Caves
			 National Monument—</text>
					<subparagraph id="id932E0112BBB0475197E69A73DB908BC1"><enum>(A)</enum><text>is comprised of a
			 rectangular area of approximately 480 acres located in the Siskiyou Mountains
			 of southern Oregon; and</text>
					</subparagraph><subparagraph id="id2DA86E6D5F714D2A8F12CEA0BB10219E"><enum>(B)</enum><text>was established
			 by Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12, 1909,
			 to protect the caves, which were determined to have unusual scientific interest
			 and importance;</text>
					</subparagraph></paragraph><paragraph id="id349220AB1E634516A143C3E35BDC6ABA"><enum>(2)</enum><text>on June 10, 1933,
			 in accordance with Executive Order 6166 (5 U.S.C. 901 note), the administration
			 of the Monument was transferred from the Secretary of Agriculture to the
			 Secretary of the Interior; and</text>
				</paragraph><paragraph id="id68A5A9973B784BE4B9A09CF8D6246900"><enum>(3)</enum><text>the 1999 general
			 management plan for the Monument contains a recommendation for adding
			 surrounding land to the Monument—</text>
					<subparagraph id="id79816407894248BEB8B71F07B262AADD"><enum>(A)</enum><text>to provide better
			 protection for—</text>
						<clause id="id4DB3A8ECF3BB4CFAB8381B923DEEFB16"><enum>(i)</enum><text>cave
			 ecology;</text>
						</clause><clause id="id365011EB57B6495690C25B282474F073"><enum>(ii)</enum><text>surface and
			 subsurface hydrology;</text>
						</clause><clause id="id9EB27AFBF721449085F9C6A3FC1AD86B"><enum>(iii)</enum><text>public water
			 supplies; and</text>
						</clause><clause id="idB63F0D13168A439284A51BB397704006"><enum>(iv)</enum><text>trails and
			 views;</text>
						</clause></subparagraph><subparagraph id="idC74A0466A2534822BF1D8189D115F0E9"><enum>(B)</enum><text>to establish a
			 logical topographical boundary; and</text>
					</subparagraph><subparagraph id="idF58CB576B0764D17AC56721165D79B2A"><enum>(C)</enum><text>to enhance public
			 outdoor recreation opportunities.</text>
					</subparagraph></paragraph></subsection><subsection id="idAFC81B0A10864323B4C300FB1A6B8CDF"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to add surrounding land to the Monument—</text>
				<paragraph id="idCE6CFBDAC14E4044B9E9987D1AC5EF7C"><enum>(1)</enum><text>to enhance the
			 protection of the resources associated with the Monument; and</text>
				</paragraph><paragraph id="id26A626F14D134197ACF8B8903936D748"><enum>(2)</enum><text>to increase
			 public recreation opportunities.</text>
				</paragraph></subsection></section><section id="id298F3C9EE2A74947810316C0C34CEC70"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID601c83e74d5548b98b01440b1969f0aa"><enum>(1)</enum><header>Grazing
			 allotment</header><text>The term <term>grazing allotment</term> means—</text>
				<subparagraph id="id79796EAA442346AFB118EEB753EC7DC1"><enum>(A)</enum><text>the Big Grayback
			 Grazing Allotment located in the Rogue River-Siskiyou National Forest;
			 and</text>
				</subparagraph><subparagraph id="idF1444FFA2EE6447DAAC3AED6FA65C567"><enum>(B)</enum><text>the Billy
			 Mountain Grazing Allotment located in a parcel of land that is—</text>
					<clause id="idACC742D298634D2B809C67071DDA8CDC"><enum>(i)</enum><text>managed by the
			 Secretary (acting through the Director of the Bureau of Land Management);
			 and</text>
					</clause><clause id="idB46392B915A141B7A58D8CB8F24E0FD5"><enum>(ii)</enum><text>located in close
			 proximity to the land described in subparagraph (A).</text>
					</clause></subparagraph></paragraph><paragraph id="id712C71033CFD464DA89C65DED5EA7E8A"><enum>(2)</enum><header>Grazing lease;
			 grazing permit</header><text>The terms <term>grazing lease</term> and
			 <term>grazing permit</term> mean any document authorizing the use of a grazing
			 allotment for the purpose of grazing livestock for commercial purposes.</text>
			</paragraph><paragraph id="ID28352a7c499240deb832de19a8451fa2"><enum>(3)</enum><header>Lessee;
			 permittee</header><text>The terms <term>lessee</term> and
			 <term>permittee</term> mean a livestock operator that holds a valid existing
			 grazing lease or permit for a grazing allotment.</text>
			</paragraph><paragraph id="id93859EB7C3AB43F4A2E7ED57158C5787"><enum>(4)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Oregon Caves National
			 Monument, Proposed Boundary</quote> numbered 150/80,023, and dated June
			 2008.</text>
			</paragraph><paragraph id="id8F30792A3711468A871ED31D1189ACA7"><enum>(5)</enum><header>Monument</header><text>The
			 term <term>Monument</term> means the Oregon Caves National Monument established
			 by Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12,
			 1909.</text>
			</paragraph><paragraph id="id8446761F2F2440F68160984378C5BCDF"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id28E09BE51B264EEEB1AF747181D642C3"><enum>(7)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
				<subparagraph id="idA230DA7D1AE64ED5A8965B11429FD3C2"><enum>(A)</enum><text>the Secretary of
			 Agriculture (acting through the Chief of the Forest Service), with respect to
			 National Forest System land; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F5D46B4D2C44FA1BE152FE16CD9D388"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to land managed by the Bureau of Land Management
			 (including land held for the benefit of an Indian tribe).</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id07037FA1D31840EE8591B7A3FC1D908C"><enum>4.</enum><header>Boundary
			 adjustment; land transfer</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD08D558A70EE4F41908DDCBE7360FA3D"><enum>(a)</enum><header>Boundary
			 adjustment</header><text>The boundary of the Monument is modified—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id2BA2C155FF854F61850C01776B85E796"><enum>(1)</enum><text>to include
			 approximately 4,070 acres of land identified on the map as the <quote>Proposed
			 Addition Lands</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id906BF67A2389444BB19309081920F6D8"><enum>(2)</enum><text>to exclude
			 approximately 4 acres of land—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9F96D07BDD6B462A85F6AE6BA34410B1"><enum>(A)</enum><text>located in the
			 City of Cave Junction; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82DA3ADE0F4D4A85ACD97886E9E4B9C3"><enum>(B)</enum><text>identified on the
			 map as the <quote>Cave Junction Unit</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF81644EF4874459F882D9EF35ECA841E"><enum>(b)</enum><header>Land
			 transfer</header><text>The Secretary of Agriculture shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idAFD32A239DDC45E19D55BAF3B5DADC06"><enum>(1)</enum><text>transfer the land
			 described in subsection (a)(1) to the Secretary; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB5D78B61956245B4B94604CBE4F038CE"><enum>(2)</enum><text>adjust the
			 boundary of the Rogue River-Siskiyou National Forest to exclude the land
			 transferred under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF09813D1559248EEA4665B2858B5A8E0"><enum>(c)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the National Park Service.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id4C684D120233408FA7B4C65A0174B723"><enum>5.</enum><header>Wild and scenic
			 river designations</header><text display-inline="no-display-inline">Section
			 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id73439B9FB7704A84B0C53AAE28181455" style="OLC">
				<paragraph id="idB390FE37782E4ACF872AB33EBDF55019"><enum>(171)</enum><header>Oregon Caves
				National Monument, Oregon</header><text>The following segments in the State of
				Oregon, to be administered by the Secretary of the Interior:</text>
					<subparagraph id="id38886238B79E4C638B9911F33C1889EF"><enum>(A)</enum><header>Cave
				Creek</header><text>The 2.6-mile segment of Cave Creek from the headwaters at
				the River Styx to the boundary of the Rogue River-Siskiyou National Forest as a
				recreational river.</text>
					</subparagraph><subparagraph id="idB6DB5F24D5D445BEA864119FA7923E95"><enum>(B)</enum><header>Lake
				Creek</header><text>The 3.6-mile segment of Lake Creek from the headwaters at
				Bigelow Lakes to the confluence with Cave Creek as a scenic river.</text>
					</subparagraph><subparagraph id="id78915417615B4A718BEDCF32CABEBB39"><enum>(C)</enum><header>No Name
				Creek</header><text>The 0.6-mile segment of No Name Creek from the headwaters
				to the confluence with Cave Creek as a wild river.</text>
					</subparagraph><subparagraph id="id8C3CB3D434944BB2BD047A8B29AAD0B2"><enum>(D)</enum><header>Panther
				Creek</header><text>The 0.8-mile segment of Panther Creek from the headwaters
				to the confluence with Lake Creek as a scenic river.</text>
					</subparagraph><subparagraph id="idD98C93F7E52B437986C213D348E807B6"><enum>(E)</enum><header>River
				Styx</header><text>The segment of River Styx from the source to the confluence
				with Cave Creek as a recreational river.</text>
					</subparagraph><subparagraph id="id4C757F2D84ED407BBA7589E6A1D6845B"><enum>(F)</enum><header>Upper Cave
				Creek</header><text>The segment of Upper Cave Creek from the headwaters to the
				confluence with River Styx as a recreational
				river.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id8821B41F6EF24E21BF496D7E8CC526E8"><enum>6.</enum><header>Administration</header>
			<subsection commented="no" display-inline="no-display-inline" id="id7C185CE6E0F3486682324A6275ABAEE0"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Director of the
			 National Park Service, shall administer the Monument in accordance with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idA2616C78A7EB48C3806110FD1068603A"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2115393C3EB54EAD90AB4100CF162C0C"><enum>(2)</enum><text>Presidential
			 Proclamation Number 876 (36 Stat. 2497), dated July 12, 1909; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92FE6026BB9B4660BAFA8DF8734D9BD1"><enum>(3)</enum><text>any law
			 (including regulations) generally applicable to units of the National Park
			 System, including the National Park Service Organic Act (16 U.S.C. 1 et
			 seq.).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4030050AA6CB4267A6316E2FFDDB3FAD"><enum>(b)</enum><header>Ecological
			 forest restoration activities</header><text>As soon as practicable after the
			 date of enactment of this Act, the Secretary shall carry out forest restoration
			 activities within the boundaries of the Monument—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1828AED41BBD4153B16D7DB8C3BDB70A"><enum>(1)</enum><text>to reduce the
			 risk of losing key ecosystem components;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52F31DD218BF42919EC008E2FBC8DFEF"><enum>(2)</enum><text>to restore the
			 proper role of fire in the ecosystem; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE2F9F59576D4EBA95CF0FFAAFC303F2"><enum>(3)</enum><text>to ensure that
			 forest attributes (including species composition and structure) remain intact
			 and functioning within a historical range.</text>
				</paragraph></subsection></section><section id="idB8EFABD9D4FC404D8C14AA3BA37B4DAC"><enum>7.</enum><header>Voluntary
			 grazing lease or permit donation program</header>
			<subsection id="id9D03BBE9150A4E20A68D131BC1A4492A"><enum>(a)</enum><header>Donation of
			 lease or permit</header>
				<paragraph id="id9BDC300379C146E8A09D998FE64441DD"><enum>(1)</enum><header>Acceptance by
			 Secretary concerned</header><text>The Secretary concerned shall accept any
			 grazing lease or grazing permit that is donated by a lessee or
			 permittee.</text>
				</paragraph><paragraph id="ID8f9a38a773e24642ac0268ce37222f33"><enum>(2)</enum><header>Termination</header><text>The
			 Secretary concerned shall terminate any grazing lease or grazing permit
			 acquired under paragraph (1).</text>
				</paragraph><paragraph id="ID8b963a00b5c349a3aada9273ee5fa86e"><enum>(3)</enum><header>No new grazing
			 lease or permit</header><text>With respect to each grazing lease or grazing
			 permit donated under paragraph (1), the Secretary concerned shall—</text>
					<subparagraph id="ID16acdf0f88ba44d9bf2bf04e529b5ca7"><enum>(A)</enum><text>not issue any new
			 grazing lease or grazing permit within the grazing allotment covered by the
			 grazing lease or grazing permit; and</text>
					</subparagraph><subparagraph id="ID2e8dccf03a21487d9d5cfca6266fa560"><enum>(B)</enum><text>ensure a
			 permanent end to livestock grazing on the grazing allotment covered by the
			 grazing lease or grazing permit.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id89D295D86FE74CE7ABFF2AE7B7F3143B"><enum>(b)</enum><header>Effect of
			 donation</header><text>A lessee or permittee that donates a grazing lease or
			 grazing permit (or a portion of a grazing lease or grazing permit) under this
			 section shall be considered to have waived any claim to any range improvement
			 on the associated grazing allotment or portion of the associated grazing
			 allotment, as applicable.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id5D1EE3BD4CA945549F411BC39DA75594"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
