		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Do-Not-Text Act of
			 2008</short-title></quote>.</text>
		</section><section id="idF3EB9476AA8445B585362EB4D0847953"><enum>2.</enum><header>Exemption of
			 certain qualifying messages from the definition of mobile service commercial
			 message</header>
			<subsection id="idD1CCA5056096460BAF6CE6B35CF680FB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 14(d) of the
			 CAN–SPAM Act of 2003 (15 U.S.C. 7712(d)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id8EA546853AE747CE97FE7F5C03FEEEDA" style="OLC">
					<subsection id="id641EC8A3AA2B4FFFAEE4B77E5927830A"><enum>(d)</enum><header>Mobile service
				commercial message defined</header><text>In this section, the term
				<quote>mobile service commercial message</quote>—</text>
						<paragraph id="idF0A0FBEE0C954FBFA04FA84C495096D2"><enum>(1)</enum><text>means a
				commercial electronic mail message that is transmitted directly to a wireless
				device that is utilized by a subscriber of commercial mobile service (as such
				term is defined in section 332(d) of the Communications Act of 1934 (47 U.S.C.
				332(d))) in connection with such service; and</text>
						</paragraph><paragraph id="idA05583ECEE164CAD9350A3874FB9E40D"><enum>(2)</enum><text>does not include
				any such commercial electronic mail message, if the primary purpose of such
				message is to—</text>
							<subparagraph id="IDb339d3faa723426bb5e92c5c7e40b322"><enum>(A)</enum><text>facilitate,
				complete, or confirm a commercial transaction that the recipient of such
				message has previously agreed to enter into with the sender of such
				message;</text>
							</subparagraph><subparagraph id="ID9bb27334aff54426ac7647c62bfaf0e2"><enum>(B)</enum><text>provide warranty
				information, product recall information, or safety or security information with
				respect to a commercial product or service used or purchased by the recipient
				of such message;</text>
							</subparagraph><subparagraph id="ID72f3ab72c5e6457a9086950720f651e5"><enum>(C)</enum><text>provide, with
				respect to a subscription, membership, account, loan, or comparable ongoing
				commercial relationship involving the ongoing purchase or use by the recipient
				of such message of products or services offered by the sender of such
				message—</text>
								<clause id="id62279B855CBD414188F78B7B5755D6CB"><enum>(i)</enum><text>notice concerning
				a change in the terms or features of such subscription, membership, account,
				loan, or comparable ongoing commercial relationship;</text>
								</clause><clause id="IDaec5b000b9e24d309acad130d8a76d9a"><enum>(ii)</enum><text>notice of a
				change in the standing or status of the recipient with respect to such
				subscription, membership, account, loan, or comparable ongoing commercial
				relationship; or</text>
								</clause><clause id="ID4f259e2ca1d44bc8a3d121891e5a8113"><enum>(iii)</enum><text>at regular
				periodic intervals, account balance information or other types of account
				statements with respect to such subscription, membership, account, loan, or
				comparable ongoing commercial relationship;</text>
								</clause></subparagraph><subparagraph id="IDa493718163024378beb8c52d75fc7c0b"><enum>(D)</enum><text>provide
				information directly related to an employment relationship or related benefit
				plan in which the recipient of such message is currently involved,
				participating, or enrolled; or</text>
							</subparagraph><subparagraph id="IDbb2c637d3a2b4e068ccb73883b25c179"><enum>(E)</enum><text>deliver goods or
				services, including product updates or upgrades, that the recipient of such
				message is entitled to receive under the terms of a transaction that the
				recipient has previously agreed to enter into with the sender of such
				message.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id8209699D59644D2EA64F0B6F0BED784F"><enum>(b)</enum><header>Rule of
			 construction</header><text>Section 14 of the CAN–SPAM Act of 2003 (15 U.S.C.
			 7712) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id983998F399CC4845B60024156E526F71" style="OLC">
					<subsection id="idD92B7449851843CAAF5922664193B484"><enum>(e)</enum><header>Rule of
				construction regarding short messaging services and mobile service commercial
				messages</header><text>This provisions of this section shall not
				prohibit—</text>
						<paragraph id="idD5E8F13B579344F3960244C495BE9370"><enum>(1)</enum><text>the sending of
				phone-to-phone short messages; and</text>
						</paragraph><paragraph id="id38F1C9C7B46D40658415E7E39CD312FA"><enum>(2)</enum><text>the sending of
				mobile service commercial messages by a provider of commercial mobile service
				(as such term is defined in section 332(d) of the Communications Act of 1934)
				to its subscribers at no cost to its subscribers unless a subscriber has
				expressed his or her desire not to receive such messages from the
				provider.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id0E38A95F6867412B9CB44CA68DA40694"><enum>3.</enum><header>Prohibition on
			 unauthorized mobile service commercial messages containing unsolicited
			 advertisements</header>
			<subsection id="idCC7852822082470197CC74CF443E95F5"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 227(b)(1) of the Communications Act
			 of 1934 (47 U.S.C. 227(b)(1)) is amended—</text>
				<paragraph id="id96157E4A5C77448F9D7AA9761EC01476"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C)(iii), by striking
			 <quote>; or</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="idD275897E21C74432B88D986A74B962FA"><enum>(2)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="id7F453F973CBB42659F5A1168CA4D8394"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6F6579D443984A6AB926BAB40CAAF74F" style="OLC">
						<subparagraph id="idEB8BD75F154F4561B7D074F0F821F722"><enum>(E)</enum><text>to send a mobile
				service commercial message to any person who has not provided express prior
				authorization for the receipt of such message to the sender of such
				message.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idC79E7DBAA13A4301BF3605B1D769B76D"><enum>(b)</enum><header>Definitions</header><text>Section
			 227(a) of the Communications Act of 1934 (47 U.S.C. 227(a)) is amended—</text>
				<paragraph id="id08DB18E7B9A04BB6B70D31C4BE927166"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) through (5) as paragraphs (4) through (6), respectively;
			 and</text>
				</paragraph><paragraph id="ID4a3cb15f90a44f4783d3326fa9165e64"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id429543D2CEF04331A6966FD60465431A" style="OLC">
						<paragraph id="id76B50BAFC91E4CB9A760613DBF2048EB"><enum>(3)</enum><text>The term
				<quote>mobile service commercial message</quote> has the same meaning given
				such term in section 14(d) of the CAN–SPAM Act of 2003 (15 U.S.C.
				7712(d)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idF30DF190B13E479080D90B0A70227C2D"><enum>(c)</enum><header>Rule of
			 construction</header><text>Section 227(d) of the Communications Act of 1934 (47
			 U.S.C. 227(d)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7BEFEE741659479FADD33EBF83D91369" style="OLC">
					<paragraph id="id27EC16CED8F940F2AF485272CFBD30B2"><enum>(4)</enum><header>Rule of
				construction regarding short messaging services and mobile service commercial
				messages</header><text>The prohibition prescribed under subsection (b)(1)(E)
				shall not prohibit—</text>
						<subparagraph id="id7A37A320A4D44954A4329271C7073063"><enum>(A)</enum><text>the sending of
				phone-to-phone short messages; and</text>
						</subparagraph><subparagraph id="id23948B59B301454BAFCA712DF6F66B41"><enum>(B)</enum><text>the sending of
				mobile service commercial messages by a provider of commercial mobile service
				(as such term is defined in section 332(d)) to its subscribers at no cost to
				its subscribers unless a subscriber has expressed his or her desire not to
				receive such messages from the
				provider.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID8b96ec82db3d42ba9e1415e73c4f2438"><enum>4.</enum><header>Mobile service
			 commercial messages containing unsolicited advertisements sent to cellular
			 telephones explicitly prohibited</header>
			<subsection id="id8CDFB9D62C79462580688243DDDD6F54"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Federal Trade Commission
			 shall revise the do-not-call registry provisions of the Telemarketing Sales
			 Rule (16 C.F.R. 310.4(b)(1)(iii))—</text>
				<paragraph id="id678E6B95979B42699E29634549C82F41"><enum>(1)</enum><text>to consider
			 commercial mobile service messaging practices that are costly or a nuisance to
			 consumers; and</text>
				</paragraph><paragraph id="idDA8364A27A124264AE8A35121CB22050"><enum>(2)</enum><text display-inline="yes-display-inline">to explicitly prohibit, as an abusive
			 telemarketing act or practice, the sending of any mobile service commercial
			 message to a telephone number that is—</text>
					<subparagraph id="idBF40A4BAE3064C868A4FC00F92C02EBA"><enum>(A)</enum><text>assigned to a
			 commercial mobile service; and</text>
					</subparagraph><subparagraph id="id7F6C2EDEA7D1483789CE3DBC74D084EA"><enum>(B)</enum><text>listed on the
			 do-not-call registry.</text>
					</subparagraph></paragraph></subsection><subsection id="id0E0ABD2F711A45C1B18FA01D8D41EA13"><enum>(b)</enum><header>Definitions</header><text>As
			 used in this section—</text>
				<paragraph id="idD80487BE1AA1453FA55DE1FAF7A05838"><enum>(1)</enum><text>the term
			 <quote>mobile service commercial message</quote> has the same meaning given
			 such term in section 14(d) of the CAN–SPAM Act of 2003 (15 U.S.C. 7712(d));
			 and</text>
				</paragraph><paragraph id="id5ED9F67E4FEF41DF8C6F5C405CBA365D"><enum>(2)</enum><text>the term
			 <quote>commercial mobile service</quote> has the same meaning given such term
			 in section 332(d) of the Communications Act of 1934 (47 U.S.C. 332(d)).</text>
