		<official-title>To provide energy price relief by authorizing greater
		  resources and authority for the Commodity Futures Trading Commission, and for
		  other purposes. </official-title>

		<section id="id206FEA4A0F6846E3A14D23B287CDC6D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Increasing Transparency and
			 Accountability in Oil Prices Act of 2008 </short-title></quote>.</text>
		</section><section id="idA9AA391DD189430882BAD8D79DE45E0E"><enum>2.</enum><header>Sense of Senate
			 on additional emergency funding for Commission</header>
			<subsection id="id30052A3E133A4D4F8C3D5790B40C36CF"><enum>(a)</enum><header>Findings</header><text>The
			 Senate finds that—</text>
				<paragraph id="idA9CBE9FEFCF5457E9DC262D93D102580"><enum>(1)</enum><text>excessive
			 speculation may be adding significantly to the price of oil and other energy
			 commodities;</text>
				</paragraph><paragraph id="idC9783CD7549B4EE1A5B76E10D8CA666D"><enum>(2)</enum><text>the public and
			 Congress are concerned that private, unregulated transactions and overseas
			 exchange transactions are not being adequately reviewed by any regulatory
			 body;</text>
				</paragraph><paragraph id="id9AD1872193DE48ED85CE9E691A47A93B"><enum>(3)</enum><text>an important
			 Federal overseer of commodity speculation, the Commodity Futures Trading
			 Commission, has staffing levels that have dropped to the lowest levels in the
			 33-year history of the Commission; and</text>
				</paragraph><paragraph id="id3235DB3C3E9F47DC99BA552867D86C1A"><enum>(4)</enum><text>the acting
			 Chairman of the Commission has said publicly that an additional 100 employees
			 are needed in light of the inflow of trading volume.</text>
				</paragraph></subsection><subsection id="id3E186732AF5E4D71990E811D3B23BA7D"><enum>(b)</enum><header>Sense of
			 Senate</header><text>It is the sense of the Senate that the President should
			 immediately send to Congress a request for emergency appropriations for fiscal
			 year 2008 for the Commodity Futures Trading Commission in an amount that is
			 sufficient—</text>
				<paragraph id="id4F1151797D894D9B8C7D865D033FA99F"><enum>(1)</enum><text>to help restore
			 public confidence in energy commodities markets and Federal oversight of those
			 markets;</text>
				</paragraph><paragraph id="id71D7692C1A2F4DFA83CE291B69FC5E47"><enum>(2)</enum><text>to potentially
			 impose limits on excessive speculation that is increasing the price of oil,
			 gasoline, diesel, and other energy commodities;</text>
				</paragraph><paragraph id="id8F2FA1A08BFE430E81CE1C666458163F"><enum>(3)</enum><text>to significantly
			 improve the information technology capabilities of the Commission to help the
			 Commission effectively regulate the energy futures markets; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id802724C3A5504810A3EF73A2C97B6594"><enum>(4)</enum><text>to fund at least
			 100 new full-time positions at the Commission to oversee energy commodity
			 market speculation and to enforce the Commodity Exchange Act (7 U.S.C. 1 et
			 seq.).</text>
				</paragraph></subsection></section><section id="idDE9EE53E3D374C3CA69784F61777A70D"><enum>3.</enum><header>Additional
			 Commission employees for improved enforcement</header><text display-inline="no-display-inline">Section 2(a)(7) of the Commodity Exchange
			 Act (7 U.S.C. 2(a)(7)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id6E16C81096734823BEDC86F4306FCF6A" style="OLC">
				<subparagraph id="ID794726de886c476fba08ba46d5a3b9f5"><enum>(D)</enum><header>Additional
				employees</header><text>As soon as practicable after the date of enactment of
				this subparagraph, the Commission shall appoint at least 100 full-time
				employees (in addition to the employees employed by the Commission as of the
				date of enactment of this subparagraph)—</text>
					<clause id="id56427626307D4E4285A874CAA2E5AF4B"><enum>(i)</enum><text>to increase the
				public transparency of operations in energy futures markets;</text>
					</clause><clause id="idC815C50DC9EC478FA6DD0FD7B3FE5394"><enum>(ii)</enum><text>to improve the
				enforcement of this Act in those markets; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idA4170178A2464A2C8F7C36B596C229BC"><enum>(iii)</enum><text>to carry out
				such other duties as are prescribed by the
				Commission.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id4B17516CE9274ACD9BB38D472325C858"><enum>4.</enum><header>Inspector
			 General</header><text display-inline="no-display-inline">Section 2(a) of the
			 Commodity Exchange Act (7 U.S.C. 2(a)) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idBFA9573A801D493CB4722972FC1E7CBE" style="OLC">
				<paragraph id="IDe5dfaec2bf2943c0b23492af25a63fef"><enum>(13)</enum><header>Inspector
				General</header>
					<subparagraph id="ID5b7564cbe007435ba1ee09c4ae6c1d18"><enum>(A)</enum><header>Office</header><text>There
				shall be in the Commission, as an independent office, an Office of the
				Inspector General.</text>
					</subparagraph><subparagraph id="ID068c5f9dea3a45899d9e5dcabcf38567"><enum>(B)</enum><header>Appointment</header><text>The
				Office shall be headed by an Inspector General, appointed in accordance with
				the Inspector General Act of 1978 (5 U.S.C. App.).</text>
					</subparagraph><subparagraph id="ID26f6e5f1db314aa19c680dc8e9e8aaaf"><enum>(C)</enum><header>Compensation</header><text>The
				Inspector General shall be compensated at the rate provided for level IV of the
				Executive Schedule under section 5315 of title 5, United States Code.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F918ECC37474C06A5141648590D6F37"><enum>(D)</enum><header>Administration</header><text>The
				Inspector General shall exert independent control of the budget allocations,
				expenditures, and staffing levels, personnel decisions and processes,
				procurement, and other administrative and management functions of the
				Office.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDda970fe0fc1547308bdcfb24122f3d41"><enum>5.</enum><header>Study of
			 international regulation of energy commodity markets</header>
			<subsection id="IDebae98c8ffb54f16a054ce60b9cca10e"><enum>(a)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct a study of the international regime for regulating the trading of
			 energy commodity futures and derivatives.</text>
			</subsection><subsection id="idE3E91672B1664FFBB3D8913B140D1FD7"><enum>(b)</enum><header>Analysis</header><text>The
			 study shall include an analysis of, at a minimum—</text>
				<paragraph id="ID3e8499f6f51a46e6914d92455e79308a"><enum>(1)</enum><text>key common
			 features and differences among countries in the regulation of energy commodity
			 trading, including with respect to market oversight and enforcement;</text>
				</paragraph><paragraph id="IDf2fde3798b0d4022b000f84525f462c0"><enum>(2)</enum><text>agreements and
			 practices for sharing market and trading data;</text>
				</paragraph><paragraph id="ID9448775771c34639b9c44f639363afa2"><enum>(3)</enum><text>the use of
			 position limits or thresholds to detect and prevent price manipulation,
			 excessive speculation, or other unfair trading practices;</text>
				</paragraph><paragraph id="ID865e013b86ad413ebae38f9cde030310"><enum>(4)</enum><text>practices
			 regarding the identification of commercial and noncommercial trading and the
			 extent of market speculation; and</text>
				</paragraph><paragraph id="ID801f01c1fd394e6d94bf841d8c0e9b3f"><enum>(5)</enum><text>agreements and
			 practices for facilitating international cooperation on market oversight,
			 compliance, and enforcement.</text>
				</paragraph></subsection><subsection id="ID594d406a53374a509e87b6615605cd91"><enum>(c)</enum><header>Report</header><text>Not
			 later than 120 days after the date of enactment of this Act, the Comptroller
			 General shall submit to the appropriate committees of Congress a report
			 that—</text>
				<paragraph id="IDa7e83515ccb34ca99c569afd9bbe0be7"><enum>(1)</enum><text>describes the
			 results of the study; and</text>
				</paragraph><paragraph id="ID6b09db60bf344bae85f693611854d810"><enum>(2)</enum><text>provides
			 recommendations to improve openness, transparency, and other necessary elements
			 of a properly functioning market in a manner that protects consumers in the
			 United States from the effects of excessive speculation and energy price
			 volatility.</text>
				</paragraph></subsection></section><section id="idCD347AF7F4DD44F28745486DDA68639C"><enum>6.</enum><header>Speculative
			 limits and transparency for off-shore oil trading</header><text display-inline="no-display-inline">Section 4 of the Commodity Exchange Act (7
			 U.S.C. 6) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id7370DE6C3402422488062D047D231B63" style="OLC">
				<subsection id="id07CD5208AF134260BAAFD83BBB5C5282"><enum>(e)</enum><header>Foreign boards
				of trade</header>
					<paragraph id="IDa0b4eac7a77f489cb94b78e9c3f601ec"><enum>(1)</enum><header>In
				general</header><text>In the case of any foreign board of trade for which the
				Commission has granted or is considering an application to grant a board of
				trade located outside of the United States relief from the requirement of
				subsection (a) to become a designated contract market, derivatives transaction
				execution facility, or other registered entity, with respect to an energy
				commodity that is physically delivered in the United States, prior to
				continuing to or initially granting the relief, the Commission shall determine
				that the foreign board of trade—</text>
						<subparagraph id="id78B609627E0A4E369FB5727CAC0DCF8E"><enum>(A)</enum><text>applies
				comparable principles or requirements regarding the daily publication of
				trading information and position limits or accountability levels for
				speculators as apply to a designated contract market, derivatives transaction
				execution facility, or other registered entity trading energy commodities
				physically delivered in the United States; and</text>
						</subparagraph><subparagraph id="IDf8323920e8e14228a5d1255d0cbf722a"><enum>(B)</enum><text>provides such
				information to the Commission regarding the extent of speculative and
				nonspeculative trading in the energy commodity that is comparable to the
				information the Commission determines necessary to publish a Commitment of
				Traders report for a designated contract market, derivatives transaction
				execution facility, or other registered entity trading energy commodities
				physically delivered in the United States.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID878d8e9800234e9e9946b4353c6d7093"><enum>(2)</enum><header>Existing
				foreign boards of trade</header><text>During the period beginning 1 year after
				the date of enactment of this subsection and ending 18 months after the date of
				enactment of this subsection, the Commission shall determine whether to
				continue to grant relief in accordance with paragraph (1) to any foreign board
				of trade for which the Commission granted relief prior to the date of enactment
				of this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idABBADA8B29604BFCB73D28A167EB96FE" section-type="subsequent-section"><enum>7.</enum><header>Commission authority
			 over traders</header><text display-inline="no-display-inline">Section 4 of the
			 Commodity Exchange Act (7 U.S.C. 6) (as amended by section 6) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id720065080F024B2683C39928C3A52C9D" style="OLC">
				<subsection id="id90B41520C41E4CD1BFDA01FA0556C18B"><enum>(f)</enum><header>Commission
				authority over traders</header>
					<paragraph id="ID6ce0c4c6ea0548759d9b379b23ac34eb"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this section or
				any determination made by the Commission to grant relief from the requirements
				of subsection (a) to become a designated contract market, derivatives
				transaction execution facility, or other registered entity, in the case of a
				person located within the United States, or otherwise subject to the
				jurisdiction of the Commission, trading on a foreign board of trade, exchange,
				or market located outside the United States (including the territories and or
				possessions of the United States), the Commission shall have authority under
				this Act—</text>
						<subparagraph id="ID9822e6c118b04ba9b40cd985d696c9f2"><enum>(A)</enum><text>to apply and
				enforce section 9, including provisions relating to manipulation or attempted
				manipulation, the making of false statements, and willful violations of this
				Act;</text>
						</subparagraph><subparagraph id="IDfb231352a3dd4051a4c21230fe7c5807"><enum>(B)</enum><text>to require or
				direct the person to limit, reduce, or liquidate any position to prevent or
				reduce the threat of price manipulation, excessive speculation, price
				distortion, or disruption of delivery or the cash settlement process;
				and</text>
						</subparagraph><subparagraph id="IDb994d34464a749259b2c42dbbef59e1a"><enum>(C)</enum><text>to apply such
				recordkeeping requirements as the Commission determines are necessary.</text>
						</subparagraph></paragraph><paragraph id="ID586ee55a8cd24f11bf12b7f05fb28c12"><enum>(2)</enum><header>Consultation</header><text>Prior
				to the issuance of any order under paragraph (1) to reduce a position on a
				foreign board of trade, exchange, or market located outside the United States
				(including the territories and possessions of the United States), the
				Commission shall consult with the foreign board of trade, exchange, or market
				and the appropriate regulatory authority.</text>
					</paragraph><paragraph id="ID1140451b01594fe8a29f929f2d2ad827"><enum>(3)</enum><header>Administration</header><text>Nothing
				in this subsection limits any of the otherwise applicable authorities of the
				Commission.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idBC7EA98EC4EC418DBCA818E72705A20A"><enum>8.</enum><header>Index traders
			 and swap dealers</header><text display-inline="no-display-inline">Section 4 of
			 the Commodity Exchange Act (7 U.S.C. 6) (as amended by section 7) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idFF53CC7FD7E14E42964682F56D3C9943" style="OLC">
				<subsection id="ID6193c0eff0bf4facac82dccbbc9a8439"><enum>(g)</enum><header>Index traders
				and swap dealers</header><text>Not later than 60 days after the date of
				enactment of this subsection, the Commission shall—</text>
					<paragraph id="ID84a72fcef3494c7cad54abcc3bbbc858"><enum>(1)</enum><text>routinely require
				detailed reporting from index traders and swap dealers in markets under the
				jurisdiction of the Commission;</text>
					</paragraph><paragraph id="ID754c044b05894e67b08ae3a193268f71"><enum>(2)</enum><text>reclassify the
				types of traders for regulatory and reporting purposes to distinguish between
				index traders and swaps dealers; and</text>
					</paragraph><paragraph id="ID5aea99d7fa32485a8f1a734f8b9046da"><enum>(3)</enum><text>review the
				trading practices for index traders in markets under the jurisdiction of the
				Commission—</text>
						<subparagraph id="idFCAE9082B11840AB99D8A281D6CCF849"><enum>(A)</enum><text>to ensure that
				index trading is not adversely impacting the price discovery process;
				and</text>
						</subparagraph><subparagraph id="id00EE6F99D0EB4162B66D483DF05AF36D"><enum>(B)</enum><text>to determine
				whether different practices or regulations should be
				implemented.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idB1DBDCA166C1471F92AF2500E12252BA"><enum>9.</enum><header>Disaggregation
			 of index funds and other data in energy markets</header><text display-inline="no-display-inline">Section 4 of the Commodity Exchange Act (7
			 U.S.C. 6) (as amended by section 8) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id2FEE430858F242E9B11198C09058C7BA" style="OLC">
				<subsection id="ID5a41ec1de295409595b6304c2d7e7eff"><enum>(h)</enum><header>Disaggregation
				of index funds and data in energy markets</header><text>The Commission shall
				disaggregate and make public monthly—</text>
					<paragraph id="id0FE40AED63D347D584E484D9E90933E6"><enum>(1)</enum><text>the number of
				positions and total value of index funds and other passive, long-only positions
				in energy markets; and</text>
					</paragraph><paragraph id="id0816BAD6771446B8A225AA192896E04A"><enum>(2)</enum><text>data on
				speculative positions relative to bona fide physical hedgers in those
				markets.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
