		<official-title>To amend the Commodity Exchange Act to provide for the
		  regulation of oil commodities markets, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Policing United States Oil
			 Commodities Markets Act of 2008</short-title></quote>.</text>
		</section><section id="id1E4775F2D15B4623AA545199C45CF5F5"><enum>2.</enum><header>Energy
			 commodities and related swaps traded on foreign boards of trade</header><text display-inline="no-display-inline">Section 5 of the Commodity Exchange Act (7
			 U.S.C. 7) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idC81459C18A3E474BA94A8AEB52150497" style="OLC">
				<subsection id="idF7C575C0D6184F4D8D29CA54B245E922"><enum>(f)</enum><header>Designation of
				certain contract markets and electronic trading facilities</header>
					<paragraph id="id89031B7FFE9C459D9C0F0784D1807B43"><enum>(1)</enum><header>Definition of
				covered market or facility</header><text>In this subsection, the term
				<term>covered market or facility</term> means a contract market or electronic
				trading facility—</text>
						<subparagraph id="idE9CA0B70E34945BE876D202A9A445DE6"><enum>(A)</enum><text>that operates 1
				or more trading terminals within the United States (including any territory or
				possession of the United States);</text>
						</subparagraph><subparagraph id="id2E8410C039BD4213AC5E857CEC92A8F0"><enum>(B)</enum><text>on which there is
				transacted or facilitated any agreement, contract, or transaction that serves a
				price discovery function for any energy commodity that is delivered in the
				United States; and</text>
						</subparagraph><subparagraph id="id50E9E033697946D08D52E7582550E17B"><enum>(C)</enum><text>that is regulated
				by a foreign regulatory agency.</text>
						</subparagraph></paragraph><paragraph id="idF27F43B58645436396EEA3113F5D1CB5"><enum>(2)</enum><header>Designation
				requirement</header>
						<subparagraph id="idB12A5EC57B404B179E95D56624AA18C7"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, not
				later than 180 days after the date of enactment of this subsection, a covered
				market or facility shall—</text>
							<clause id="idDB89BDC894EE418C9F730490FBA771B8"><enum>(i)</enum><text>register with the
				Commission as a designated contract market under this section; and</text>
							</clause><clause id="idB8881DBECD4B410FA35353DACB054900"><enum>(ii)</enum><text>be subject to
				each rule established and regulation promulgated by the Commission (including
				each disclosure requirement that applies to a designated contract
				market).</text>
							</clause></subparagraph><subparagraph id="idF61FE9FE8EC8485FB27D831B0C3555AB"><enum>(B)</enum><header>Effect on
				exemptions</header><text>Effective beginning on the earlier of the date of
				registration of a covered market or facility under subparagraph (A) or the date
				that is 180 days after the date of enactment of this subsection, the authority
				of each exemption provided to a covered market or facility relating to the
				registration of the covered market or facility as a designated contract market
				(including any no action letter issued by the Commission) shall
				terminate.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
