		  direct the Administrator of the Environmental Protection Agency to establish a
		  hazardous waste electronic manifest system.</official-title>

		<section id="idD8A7D36A50654390A923E37537D2E7A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hazardous Waste Electronic Manifest
			 Establishment Act</short-title></quote>.</text>
		</section><section id="id25B59EDEA0D9495F8626061399C2CC4A"><enum>2.</enum><header>Hazardous waste
			 electronic manifest system</header>
			<subsection id="idBA6E9ED4D7AD4B64BD245C321A715CDF"><enum>(a)</enum><header>In
			 general</header><text>Subtitle C of the Solid Waste Disposal Act (42 U.S.C.
			 6921 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBD4C8CC4C30E45E6B329B3DAA1D6DB98" style="OLC">
					<section id="idC49F0097EA53443DBD80BE34AD08708B"><enum>3024.</enum><header>Hazardous
				waste electronic manifest system</header>
						<subsection id="idA10B7F278DDB4E6EAB291597AF4FB3DA"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id61BEF0301D854C19B726A4D0A7E5821B"><enum>(1)</enum><header>Board</header><text>The
				term <term>Board</term> means the Hazardous Waste Electronic Manifest System
				Governing Board established under subsection (f).</text>
							</paragraph><paragraph id="id03319182BAFA44D79531F6A5CD0A1983"><enum>(2)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the Hazardous Waste Electronic Manifest System
				Fund established by subsection (d).</text>
							</paragraph><paragraph id="idCACD53ABE6C446ABB0EEE6A2A5D65EB6"><enum>(3)</enum><header>Person</header><text>The
				term <term>person</term> includes an individual, corporation (including a
				Government corporation), company, association, firm, partnership, society,
				joint stock company, trust, municipality, commission, Federal agency, State,
				political subdivision of a State, or interstate body.</text>
							</paragraph><paragraph id="idCCA30BF0C0024A21B8C4EBA289AB852E"><enum>(4)</enum><header>System</header><text>The
				term <term>system</term> means the hazardous waste electronic manifest system
				established under subsection (b).</text>
							</paragraph><paragraph id="idE20AEF429C0B4D0DB23946BBFE6F4ED6"><enum>(5)</enum><header>User</header><text>The
				term <term>user</term> means a hazardous waste generator, a hazardous waste
				transporter, an owner or operator of a hazardous waste treatment, storage,
				recycling, or disposal facility, or any other person that—</text>
								<subparagraph id="idB82F34FF66204616B73685A56E6CC1EA"><enum>(A)</enum><text>is required to
				use a manifest to comply with any Federal or State requirement to track the
				shipment, transportation, and receipt of hazardous waste or other material that
				is shipped from the site of generation to an off-site facility for treatment,
				storage, disposal, or recycling; and</text>
								</subparagraph><subparagraph id="id84E71C1FED40444A99508C9AE1E7CCC3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idB0A7B34F0F2F4A63BBBBD2286B09AC8F"><enum>(i)</enum><text>elects to use the
				system to complete and transmit an electronic manifest format; or</text>
									</clause><clause id="idC99DE243697A4953BAFFCA059DBEBA16" indent="up1"><enum>(ii)</enum><text>submits to the system for data
				processing purposes a paper copy of the manifest (or data from such a paper
				copy), in accordance with such regulations as the Administrator may promulgate
				to require such a submission.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="id1D9A19A7F292461FAFC017CBDAFF034E"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this section, the Administrator shall establish a hazardous waste
				electronic manifest system that may be used by any user.</text>
						</subsection><subsection id="idCE6AFE86E7A0462885853624F25633AA"><enum>(c)</enum><header>User
				fees</header>
							<paragraph id="id49B74466033B4DC4AF2DB4833F613DF4"><enum>(1)</enum><header>In
				general</header><text>The Administrator may impose on users such reasonable
				service fees as the Administrator determines to be necessary to pay costs
				incurred in developing, operating, maintaining, and upgrading the system,
				including any costs incurred in collecting and processing data from any paper
				manifest submitted to the system after the date on which the system enters
				operation.</text>
							</paragraph><paragraph id="idFF4E40B7C91345CB894CFAB32901B6B3"><enum>(2)</enum><header>Collection of
				fees</header><text>The Administrator shall—</text>
								<subparagraph id="id348E9FAB3A6C4BD4ADBCD8F56EA374A0"><enum>(A)</enum><text>collect the fees
				described in paragraph (1) from the users in advance of, or as reimbursement
				for, the provision by the Administrator of system-related services; and</text>
								</subparagraph><subparagraph id="idEF10880F37D14C89AF4E26CA3A9E0BF6"><enum>(B)</enum><text>deposit the fees
				in the Fund for use in accordance with this subsection.</text>
								</subparagraph></paragraph><paragraph id="idF979473F43A646BA93B723F050B81D12"><enum>(3)</enum><header>Fee
				structure</header>
								<subparagraph id="id8BF6A5423A9449E197F7251D25D13C41"><enum>(A)</enum><header>In
				general</header><text>The Administrator, in consultation with information
				technology vendors, shall determine through the contract award process
				described in subsection (e) the fee structure that is necessary to recover the
				full cost to the Administrator of providing system-related services, including
				costs relating to—</text>
									<clause id="id986E254B75864EA6916688F6F01A6C56"><enum>(i)</enum><text>materials and
				supplies;</text>
									</clause><clause id="id2BE12256970B46489EA5C92C24514B1F"><enum>(ii)</enum><text>contracting and
				consulting;</text>
									</clause><clause id="id14BA88615F1340F6A002F6539003B1BB"><enum>(iii)</enum><text>overhead;</text>
									</clause><clause id="idF17B861ADD0E407FBC8E71506920D1C8"><enum>(iv)</enum><text>information
				technology (including costs of hardware, software, and related
				services);</text>
									</clause><clause id="idC58EB8492BD04466B874322CA2CE1F80"><enum>(v)</enum><text>information
				management;</text>
									</clause><clause id="id7CC50A907B68492F9691EF6FE91E838C"><enum>(vi)</enum><text>collection of
				service fees;</text>
									</clause><clause id="id567CD66F55464B33B14B23D2132AD14E"><enum>(vii)</enum><text>investment of
				any unused service fees;</text>
									</clause><clause id="idD11F66AE1A7E4414B6901CC7593FDF4E"><enum>(viii)</enum><text>reporting and
				accounting;</text>
									</clause><clause id="idF26A5BC80DAD49DCB0B3D0DAFE9E4415"><enum>(ix)</enum><text>employment of
				direct and indirect Government personnel dedicated to establishing and
				maintaining the system; and</text>
									</clause><clause id="idA315A037E60143C6AA07A0DC39580007"><enum>(x)</enum><text>project
				management.</text>
									</clause></subparagraph><subparagraph id="id9B8C214C7B9E4515A453DC4372FFD857"><enum>(B)</enum><header>Adjustments in
				fee amount</header>
									<clause id="id42431D782B114794AD68BBEB4EBAC57D"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall increase or decrease amount of a
				service fee determined under the fee structure described in subparagraph (A) to
				a level that will—</text>
										<subclause id="idF734B20683E644339EC698325B3A6ED1"><enum>(I)</enum><text>result in the
				collection of an aggregate amount for deposit in the Fund that is sufficient to
				cover current and projected system-related costs (including any necessary
				system upgrades); and</text>
										</subclause><subclause id="id559FCADE1A0C41D380311C28AF876D87"><enum>(II)</enum><text>minimize, to the
				maximum extent practicable, the accumulation of unused amounts in the
				Fund.</text>
										</subclause></clause><clause id="id97F66C37CA16496B8711755CB864EC64"><enum>(ii)</enum><header>Exception for
				initial period of operation</header><text>The requirement described in clause
				(i)(II) shall not apply to any additional fees that accumulate in the Fund, in
				an amount that does not exceed $2,000,000, during the 3-year period beginning
				on the date on which the system enters operation.</text>
									</clause><clause id="id279C7DCEB81640588AB575542C0C9CEF"><enum>(iii)</enum><header>Timing of
				adjustments</header><text>Adjustments to service fees described in clause (i)
				shall be made—</text>
										<subclause id="IDdc76d01c0a474eec9bfa0db29c6e8847"><enum>(I)</enum><text>initially, at the
				time at which initial development costs of the system have been recovered by
				the Administrator such that the service fee may be reduced to reflect the
				elimination of the system development component of the fee; and</text>
										</subclause><subclause id="IDb96d202089bd4655bc28d035ffa66ed1"><enum>(II)</enum><text>periodically
				thereafter, upon receipt and acceptance of the findings of any annual
				accounting or auditing report under subsection (d)(6), if the report discloses
				a significant disparity for a fiscal year between the funds collected from
				service fees under this subsection for the fiscal year and expenditures made
				for the fiscal year to provide system-related services.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection id="id887756A0877344CFBF94018B8C600884"><enum>(d)</enum><header>Hazardous Waste
				Electronic Manifest System Fund</header>
							<paragraph id="id4C7F48C99C114E6DBF9E89D114D64C4A"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Treasury of the United States a revolving fund, to be
				known as the <quote>Hazardous Waste Electronic Manifest System Fund</quote>,
				consisting of—</text>
								<subparagraph id="IDD2EF1B70D5204F73B84970D1BF09ABCD"><enum>(A)</enum><text>such amounts as
				are appropriated to the Fund under paragraph (2); and</text>
								</subparagraph><subparagraph id="IDDEF1CB6C8E834F71B796E6B85E12D28F"><enum>(B)</enum><text>any interest
				earned on investment of amounts in the Fund under paragraph (4).</text>
								</subparagraph></paragraph><paragraph id="ID75847D4BD6B24B8E83CBB81F88EF90BB"><enum>(2)</enum><header>Transfers to
				Fund</header><text>There are appropriated to the Fund amounts equivalent to
				amounts collected as fees and received by the Administrator under subsection
				(c).</text>
							</paragraph><paragraph id="ID72CBA45BD1F440E4B3F4FD55F33AAC30"><enum>(3)</enum><header>Expenditures
				from Fund</header>
								<subparagraph id="ID1475BB464CDB4E84B16FFDF76CB44B9B"><enum>(A)</enum><header>In
				general</header><text>Subject to paragraph (2), on request by the
				Administrator, the Secretary of the Treasury shall transfer from the Fund to
				the Administrator such amounts as the Administrator determines to be necessary
				to pay costs incurred in developing, operating, maintaining, and upgrading the
				system under subsection (c).</text>
								</subparagraph><subparagraph id="id97E2AF70FAB84FF98FE08139E51CC5CC"><enum>(B)</enum><header>Use of
				funds</header>
									<clause id="id3803C20C6299403ABB6B2EADFFFF27AA"><enum>(i)</enum><header>In
				general</header><text>Fees collected by the Administrator and deposited in the
				Fund under this section shall be available to the Administrator for use in
				accordance with this section without fiscal year limitation and without further
				appropriation.</text>
									</clause><clause id="idB24CEE82B91E47FE9190EA45A59F63E3"><enum>(ii)</enum><header>Oversight</header><text>The
				Administrator shall carry out all necessary measures to ensure that amounts in
				the Fund are used only to carry out the goals of establishing, operating,
				maintaining, upgrading, managing, supporting, and overseeing the system.</text>
									</clause></subparagraph></paragraph><paragraph id="ID5603607AF5D94AF4BC15A9D3321A0821"><enum>(4)</enum><header>Investment of
				amounts</header>
								<subparagraph id="IDB41A9725093D45BAABBED0F22225BDF4"><enum>(A)</enum><header>In
				general</header><text>The Secretary of the Treasury shall invest such portion
				of the Fund as is not, in the judgment of the Secretary of the Treasury and the
				Administrator, required to meet current withdrawals.</text>
								</subparagraph><subparagraph id="id6511CF2C0E1C45378F26AC70920DBAAF"><enum>(B)</enum><header>Interest-bearing
				obligations</header><text>Investments may be made only in—</text>
									<clause id="id960AF765D9B44D5FAC567C6F2190B565"><enum>(i)</enum><text>interest-bearing
				obligations of the United States; or</text>
									</clause><clause id="idBAA3B91F71F74D4A9EB8492FDB78F319"><enum>(ii)</enum><text>obligations,
				participations, or other instruments that are lawful investments for
				fiduciaries, trusts, or public funds, as determined by the Secretary of the
				Treasury.</text>
									</clause></subparagraph><subparagraph id="ID64BE379517894186B89A1201FBFD944E"><enum>(C)</enum><header>Acquisition of
				obligations</header><text>For the purpose of investments under paragraph (1),
				obligations may be acquired—</text>
									<clause id="ID2FBB30C1FE744A27BAD9FAB522B3731C"><enum>(i)</enum><text>on original issue
				at the issue price; or</text>
									</clause><clause id="ID119C636409D948D786ECA703681825D8"><enum>(ii)</enum><text>by purchase of
				outstanding obligations at the market price.</text>
									</clause></subparagraph><subparagraph id="ID41DB13A27611478D8A6149DA3B5D78BE"><enum>(D)</enum><header>Sale of
				obligations</header><text>Any obligation acquired by the Fund may be sold by
				the Secretary of the Treasury at the market price.</text>
								</subparagraph><subparagraph id="ID484E65079F0D4D97AAD686B9EEE029C8"><enum>(E)</enum><header>Credits to
				Fund</header><text>The interest on, and the proceeds from the sale or
				redemption of, any obligations held in the Fund shall be credited to, and form
				a part of, the Fund.</text>
								</subparagraph></paragraph><paragraph id="ID990781DF86FA4B5A8ADACB8C3C4C49B3"><enum>(5)</enum><header>Transfers of
				amounts</header>
								<subparagraph id="IDEA15210E59234B4AB0176880E4E2B3F6"><enum>(A)</enum><header>In
				general</header><text>The amounts required to be transferred to the Fund under
				this subsection shall be transferred at least monthly from the general fund of
				the Treasury to the Fund on the basis of estimates made by the Secretary of the
				Treasury.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCF3824F211E742E7A61FAAF06623B01E"><enum>(B)</enum><header>Adjustments</header><text>Proper
				adjustment shall be made in amounts subsequently transferred to the extent
				prior estimates were in excess of or less than the amounts required to be
				transferred.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BAF5C8E14904648A869BE814A36E725"><enum>(6)</enum><header>Accounting and
				auditing</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8725E3F4A74F457E8B177824FC72DD4D"><enum>(A)</enum><header>Accounting</header><text>For
				each 2-fiscal-year period, the Administrator shall prepare and submit to
				Congress a report that includes—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD7A3795A995246529513102BAEF60369"><enum>(i)</enum><text>an accounting of
				the fees paid to the Administrator under subsection (c) and disbursed from the
				Fund for the period covered by the report, as reflected by financial statements
				provided in accordance with—</text>
										<subclause id="ID53488a739c94438995bc1048947eadc0"><enum>(I)</enum><text>the Chief
				Financial Officers Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/576">Public Law 101–576</external-xref>; 104 Stat. 2838) and
				amendments made by that Act; and</text>
										</subclause><subclause id="ID4c0b4096c6484f5884c80a513a48cd67"><enum>(II)</enum><text>the Government
				Management Reform Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/356">Public Law 103–356</external-xref>; 108 Stat. 3410) and
				amendments made by that Act; and</text>
										</subclause></clause><clause id="id09BA89A2A4344B50A32FC32EADBAF207"><enum>(ii)</enum><text>an accounting
				describing actual expenditures from the Fund for the period covered by the
				report for costs described in subsection (c)(1).</text>
									</clause></subparagraph><subparagraph id="id492037EE498D4E408BD0CC7889C38D7D"><enum>(B)</enum><header>Auditing</header>
									<clause id="idCE34364ED22F464BB6A6244B66569065"><enum>(i)</enum><header>In
				general</header><text>For the purpose of <external-xref legal-doc="usc" parsable-cite="usc/31/3515">section 3515(c)</external-xref> of title 31, United
				States Code, the Fund shall be considered a component of an Executive
				agency.</text>
									</clause><clause id="ID32018c010b6040abbb1acd9ff8e38c69"><enum>(ii)</enum><header>Components of
				audit</header><text>The annual audit required in accordance with sections
				3515(b) and 3521 of title 31, United States Code, of the financial statements
				of activities carried out using amounts from the Fund shall include an analysis
				of—</text>
										<subclause id="id1DD31B9849904AAD8EEC052370EE8AC5"><enum>(I)</enum><text>the fees
				collected and disbursed under this section;</text>
										</subclause><subclause id="ID6ca8b3aadd2f43969626c445dbcee0da"><enum>(II)</enum><text>the
				reasonableness of the fee structure in place as of the date of the audit to
				meet current and projected costs of the system;</text>
										</subclause><subclause id="IDa48c0d76ec7049dea12cb3ff39deec5e"><enum>(III)</enum><text>the level of
				use of the system by users; and</text>
										</subclause><subclause id="IDcf43d98b105f4257985bfd6333627160"><enum>(IV)</enum><text>the success to
				date of the system in operating on a self-sustaining basis and improving the
				efficiency of tracking waste shipments and transmitting waste shipment
				data.</text>
										</subclause></clause><clause id="id1CCD23FC0E864A62B10C446EAFAA8FEF"><enum>(iii)</enum><header>Federal
				responsibility</header><text>The Inspector General of the Environmental
				Protection Agency shall—</text>
										<subclause id="idD657F3419EE14A798A501E1513578A3A"><enum>(I)</enum><text>conduct the
				annual audit described in clause (ii); and</text>
										</subclause><subclause id="idCE6CAEE326B34924BE75D262C02B1B4A"><enum>(II)</enum><text>submit to the
				Administrator a report that describes the findings and recommendations of the
				Inspector General resulting from the audit.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection id="id53499A0C965D40588C89B1C2DC02E536"><enum>(e)</enum><header>Contracts</header>
							<paragraph id="IDbf03d18d9b644487967e38f833c4bb87"><enum>(1)</enum><header>Authority to
				Enter Into Contracts Funded by Service Fees</header><text>The Administrator may
				enter into 1 or more information technology contracts with entities determined
				to be appropriate by the Administrator (referred to in this subsection as
				<term>contractors</term>) under which—</text>
								<subparagraph id="id31379503291D49E791D153B1790E046E"><enum>(A)</enum><text>the Administrator
				agrees to award a contract for the provision of system-related services;
				and</text>
								</subparagraph><subparagraph id="id754B789A28CF470A91E2D770408D0ED1"><enum>(B)</enum><text>the contractor
				agrees to assume the initial risk of the information technology investment, and
				to obtain reimbursement for investment costs, operating costs, and other fees,
				by receiving as payment an agreed-upon share of the amounts collected as fees
				by the Administrator under subsection (c).</text>
								</subparagraph></paragraph><paragraph id="ID1b04157c8e4c49ebaf774b355c12468a"><enum>(2)</enum><header>Term of
				contract</header><text>A contract awarded under this subsection shall have a
				term of not more than 10 years.</text>
							</paragraph><paragraph id="ID3470a34f494b4c9594777885b6071c31"><enum>(3)</enum><header>Achievement of
				goals</header><text>The Administrator shall ensure, to the maximum extent
				practicable, that a contract awarded under this subsection—</text>
								<subparagraph id="id8141EFD28BD24C37879FD4A44871C520"><enum>(A)</enum><text>is
				performance-based;</text>
								</subparagraph><subparagraph id="idFD70AD56D98F40C48FB588562CCA2916"><enum>(B)</enum><text>identifies
				objective outcomes; and</text>
								</subparagraph><subparagraph id="id3E8F884008424F4E9D20B7A8811A606E"><enum>(C)</enum><text>contains
				performance standards that may be used to measure achievement and goals to
				evaluate the success of a contractor in performing under the contract and the
				right of the contractor to payment for services under the contract, taking into
				consideration that a primary measure of successful performance shall be the
				development of a hazardous waste electronic manifest system that—</text>
									<clause id="id985EB0BFA8634622AC5BB0AEC07D0A0B"><enum>(i)</enum><text>meets the needs
				of the user community (including States that rely on data contained in
				manifests); and</text>
									</clause><clause id="id2D296624BBBE46B78087F7ED63FD4483"><enum>(ii)</enum><text>attracts
				sufficient user participation and service fee revenues to ensure the viability
				of the system.</text>
									</clause></subparagraph></paragraph><paragraph id="IDa91b9d94ddfc40f787435b9809e91358"><enum>(4)</enum><header>Payment
				structure</header><text>Each contract awarded under this subsection shall
				include a provision that specifies—</text>
								<subparagraph id="idB1DA4C545C62405A85519599AE52AB47"><enum>(A)</enum><text>the service fee
				structure of the contractor that will form the basis for payments to the
				contractor;</text>
								</subparagraph><subparagraph id="idF6C0A838B84D4E9D9EB8A8BF7DF1A707"><enum>(B)</enum><text>the fixed-share
				ratio of monthly service fee revenues from which the Administrator shall
				reimburse the contractor for system-related development, operation, and
				maintenance costs and provide an additional profit or fee commensurate with the
				risk undertaken by the contractor in performing in accordance with the
				contract;</text>
								</subparagraph><subparagraph id="idA203E191A7C245FEB0E2A4B16460376A"><enum>(C)</enum><text>the amount of
				additional transactional costs attributed to—</text>
									<clause id="idB69FF5ED99AC42BEB0F8301827D318F8"><enum>(i)</enum><text>the ancillary
				costs of the Administrator in implementing and managing the system, including
				the costs of integrating the applications of the contractor with the central
				data exchange architecture of the Environmental Protection Agency;</text>
									</clause><clause id="id31BEC5F5F46248E1A7BDB51E342ABF24"><enum>(ii)</enum><text>the direct and
				indirect personnel costs incurred by the Administrator to employ personnel
				dedicated to the implementation and management of the system; and</text>
									</clause><clause id="id9FC4E55910504AE4AD0BB1527FA61F25"><enum>(iii)</enum><text>expenses
				incurred in procuring any independent contractor services to assist staff of
				the Administrator in the preparation of financial statements and reports and
				the conduct of regular user group and governance meetings necessary for the
				oversight of the system.</text>
									</clause></subparagraph></paragraph><paragraph id="ID7976dac8869545de9833478150a7c274"><enum>(5)</enum><header>Cancellation
				and termination</header>
								<subparagraph id="ID422604ab55ab4a00a443f5b19804937f"><enum>(A)</enum><header>In
				general</header><text>If the Administrator determines that sufficient funds are
				not made available for the continuation in a subsequent fiscal year of a
				contract entered into under this subsection, the Administrator shall cancel or
				terminate the contract.</text>
								</subparagraph><subparagraph id="id62DAEC1EB5064F739011447763659D09"><enum>(B)</enum><header>Costs</header><text>The
				costs of cancellation or termination under subparagraph (A) may be paid
				using—</text>
									<clause id="ID8261c3dc95c14f3da6896a353b251234"><enum>(i)</enum><text>appropriations
				available for performance of the contract;</text>
									</clause><clause id="id77762097B0214301A9829195BF443C4B"><enum>(ii)</enum><text>unobligated
				appropriations available for acquisition of the information technology procured
				under the contract; or</text>
									</clause><clause id="idA5B4B716F84249E4A33F3D0BEBDEF882"><enum>(iii)</enum><text>funds
				subsequently appropriated for payment of costs of the cancellation or
				termination.</text>
									</clause></subparagraph><subparagraph id="ID7c719b6818be4001a7b93b0f0a33f94f"><enum>(C)</enum><header>Negotiation of
				amounts</header><text>The amount payable in the event of cancellation or
				termination of a contract entered into under this subsection shall be
				negotiated with the contractor at the time at which the contract is
				awarded.</text>
								</subparagraph><subparagraph id="IDc2721fab91aa4d80add65004ee03e73e"><enum>(D)</enum><header>Authority to
				enter into contracts</header><text>The Administrator may enter into a contract
				under this subsection for any fiscal year, regardless of whether funds are made
				specifically available for the full costs of cancellation or termination of the
				contract, if—</text>
									<clause id="idAAD827F59A9F4D3FADB90AD8708C99BF"><enum>(i)</enum><text>funds are
				available at the time at which the contract is awarded to make payments with
				respect to a contingent liability in an amount equal to at least 100 percent of
				the estimated costs of a cancellation or termination during the first fiscal
				year of the contract, as determined by the Administrator; or</text>
									</clause><clause id="id48C9374600ED453DB46A46529915154D"><enum>(ii)</enum><text>funds described
				in clause (i) are not available as described in that clause, but the
				contractor—</text>
										<subclause id="idB476C15F555348EBA9A73158EBDDA7C1"><enum>(I)</enum><text>is informed of
				the amount of any unfunded contingent liability; and</text>
										</subclause><subclause id="idA043FED930E4498E9F2B85AFEE68BFDB"><enum>(II)</enum><text>agrees to
				perform the contract despite the unfunded contingent liability.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id08C6EA2F6E9140DE8D05CAFFE5BABD91"><enum>(6)</enum><header>No effect on
				ownership</header><text>Regardless of whether the Administrator enters into a
				contract under this subsection, the system shall be owned by the Federal
				Government.</text>
							</paragraph></subsection><subsection id="id5CD0719495A0436FA328F3AAA023E341"><enum>(f)</enum><header>Hazardous Waste
				Electronic Manifest System Governing Board</header>
							<paragraph id="id003CE746E0E84225B8BD14FB1A6BA568"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 3 years after the date of enactment of this section, the
				Administrator shall establish a board to be known as the <quote>Hazardous Waste
				Electronic Manifest System Governing Board</quote>.</text>
							</paragraph><paragraph id="idF6F0AFBEBEB84533BFA7191B8FC08593"><enum>(2)</enum><header>Composition</header><text>The
				Board shall be composed of 7 members, of which—</text>
								<subparagraph id="id5EE88AD72A044EE6A52676B790CD6335"><enum>(A)</enum><text>1 member shall be
				the Administrator (or a designee), who shall serve as Chairperson of the Board;
				and</text>
								</subparagraph><subparagraph id="idD40C0AAA336D4C3B9708F02DFEF35150"><enum>(B)</enum><text>6 members shall
				be individuals appointed by the Administrator—</text>
									<clause id="idF96B396F94E247B58840E288C69CF0FB"><enum>(i)</enum><text>at least 1 of
				whom shall have expertise in information technology;</text>
									</clause><clause id="id0C135FFF08DD42448E50622A9040384F"><enum>(ii)</enum><text>at least 1 of
				whom shall have experience in using the manifest system to track the
				transportation of hazardous waste under this subtitle (or an equivalent State
				program); and</text>
									</clause><clause id="idCA615069B25C470B99405B5E51861689"><enum>(iii)</enum><text>at least 1 of
				whom shall be a State representative responsible for processing those
				manifests.</text>
									</clause></subparagraph></paragraph><paragraph id="id38D108A03ACC4B90A17BC882A1A0BE56"><enum>(3)</enum><header>Duties</header><text>The
				Board shall meet annually to discuss, evaluate the effectiveness of, and
				provide recommendations to the Administrator relating to, the system.</text>
							</paragraph></subsection><subsection id="ID532996183fbf4dc08056a899610d7f09"><enum>(g)</enum><header>Regulations</header>
							<paragraph id="id4484E55730E44EC285F42747B2DBEEE6"><enum>(1)</enum><header>Promulgation</header>
								<subparagraph id="idE834229D3AF6446E9438DF5A1F7F4A22"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				section, the Administrator shall promulgate regulations to carry out this
				section.</text>
								</subparagraph><subparagraph id="idD3776EC8F5E14F978CB888DB49A61FE5"><enum>(B)</enum><header>Inclusions</header><text>The
				regulations promulgated pursuant to subparagraph (A) may include such
				requirements as the Administrator determines to be necessary to facilitate the
				transition from the use of paper manifests to the use of electronic manifests,
				or to accommodate the processing of data from paper manifests in the electronic
				manifest system, including a requirement that users of paper manifests submit
				to the system copies of the paper manifests for data processing
				purposes.</text>
								</subparagraph><subparagraph id="IDc3fe998c953848628215429375121f22"><enum>(C)</enum><header>Requirements</header><text>The
				regulations promulgated pursuant to subparagraph (A) shall ensure that each
				electronic manifest provides, to the same extent as paper manifests under
				applicable Federal and State law, for—</text>
									<clause id="IDf15a05e5655541bd88c476540673a1f3"><enum>(i)</enum><text>the ability to
				track and maintain legal accountability of—</text>
										<subclause id="idDD83DDE399CE433CBED42AE24BB22468"><enum>(I)</enum><text>the person that
				certifies that the information provided in the manifest is accurately
				described; and</text>
										</subclause><subclause id="ID5995202fc8e9439ebadd712e26d20d3d"><enum>(II)</enum><text>the person that
				acknowledges receipt of the manifest;</text>
										</subclause></clause><clause id="IDd84c527900b447949c7a04ec9cb70049"><enum>(ii)</enum><text>if the manifest
				is electronically submitted, State authority to access paper copies of
				manifest; and</text>
									</clause><clause id="ID0f05adf84bd24de4bda8648ce716f896"><enum>(iii)</enum><text>access to all
				publicly-available information contained in the manifest.</text>
									</clause></subparagraph></paragraph><paragraph id="idA5D4497BE04946389D5FD949C0CAF0EF"><enum>(2)</enum><header>Effective date
				of regulations</header><text>Any regulation promulgated by the Administrator
				under paragraph (1) and in accordance with section 3003 relating to electronic
				manifesting of hazardous waste shall take effect in each State as of the
				effective date specified in the regulation.</text>
							</paragraph><paragraph id="idDD03AF2939F2452F995A9486F9B1863F"><enum>(3)</enum><header>Administration</header><text>The
				Administrator shall carry out regulations promulgated under this subsection in
				each State unless the State program is fully authorized to carry out those
				regulations in lieu of the Administrator.</text>
							</paragraph></subsection><subsection id="idBC49E8EA338F4D1BA5AE696691A3D404"><enum>(h)</enum><header>Requirement of
				compliance with respect to certain States</header><text>In any case in which
				the State in which waste is generated, or the State in which waste will be
				transported to a designated facility, requires that the waste be tracked
				through a hazardous waste manifest, the designated facility that receives the
				waste shall, regardless of the State in which the facility is located—</text>
							<paragraph id="id7D826CC63F2144AD83AB853F0DF14E04"><enum>(1)</enum><text>complete the
				facility portion of the applicable manifest;</text>
							</paragraph><paragraph id="idD8D27C7C13B642CBA8AD1B79601D55CD"><enum>(2)</enum><text>sign and date the
				facility certification; and</text>
							</paragraph><paragraph id="id2C5B206262904351AF4F1A8A14AD4A52"><enum>(3)</enum><text>submit to the
				system a final copy of the manifest for data processing
				purposes.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id89CC678FF0D341A4920921ED6AC1BAC3"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Solid Waste Disposal Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref>) is amended by inserting at the end of the items relating to
			 subtitle C the following:</text>
