		<official-title>To require that all individuals convicted of a felony
		  under State law provide a DNA sample. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>DNA Felony Collection Act of
			 2008</short-title></quote>.</text>
		</section><section id="id7CC2E9B066DC468B97FF00AC902E26B4"><enum>2.</enum><header>DNA
			 collection</header>
			<subsection id="id48E7C912B061453D8BDE11A5B2B94371"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General
			 of the United States shall enter into an agreement with each State under which
			 the State shall—</text>
				<paragraph id="id96D3C38F0E5C41C198BAC2860A4CDBB7"><enum>(1)</enum><text display-inline="yes-display-inline">collect a DNA sample from each individual
			 convicted of a felony under the laws of the State; and</text>
				</paragraph><paragraph id="idAFE60632B6DB4DF0AECADDDC0CDC9CFB"><enum>(2)</enum><text>include the
			 results of a DNA analysis of each DNA sample collected under paragraph (1) in
			 an index of DNA analysis records maintained by the State or by the Federal
			 Government.</text>
				</paragraph></subsection><subsection id="id63DAFAC6B4B3471F9444ED3AF6B1C751"><enum>(b)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="id98B67CEEC52E4B83A84C1CEB6E503B9B"><enum>(1)</enum><text>the terms
			 <term>DNA analysis</term> and <term>DNA sample</term> have the meanings given
			 those term in section 3(c) of the DNA Analysis Backlog Elimination Act of 2000
			 (42 U.S.C. 14135a(c)); and</text>
				</paragraph><paragraph id="ID5d960adeae364d4cbbdd613bb05b94b9"><enum>(2)</enum><text>the term
			 <term>State</term> means any State of the United States, the District of
			 Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American
			 Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of
			 the United States.</text>
