					<paragraph commented="no" display-inline="no-display-inline" id="H7275D2853B7E4108A0586FB02CBD2726"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of
			 2002 (42 U.S.C. 15481 et seq.) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id0B4925FAFD654287884D8F37EB376600"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating sections 304 and 305 as
			 sections 305 and 306, respectively, and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id745978DBA8B7460B97245FCDFD23AD43"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after section 303 the
			 following new section:</text>

									<subsection commented="no" display-inline="no-display-inline" id="H1ADADEC8B30C4E35B8D14C66346600D9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the 15-day period (or, at the option
				of the State, a longer period) which ends on the date of an election for
				Federal office, each State shall allow individuals to vote in the election in a
				similar manner to the manner in which voting is allowed in person at the
				polling place on the date of such election.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="H0D64C56C9A7146108000166F3BF9D558"><enum>(b)</enum><header display-inline="yes-display-inline">Minimum Early Voting
				Requirements</header><text display-inline="yes-display-inline">Each polling
				place which allows voting prior to the day of a Federal election pursuant to
				subsection (a) shall—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="HD13C4B876D074BFB9B8F36266125751C"><enum>(1)</enum><text display-inline="yes-display-inline">allow such voting for no less than 4 hours
				on each day (other than Sunday); and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE096AC9F71E9430FA65CEB68BF8BF59C"><enum>(2)</enum><text display-inline="yes-display-inline">have minimum uniform hours each day for
				which such voting occurs.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCEF48E5F6D06448B90E5C885582641EA"><enum>(c)</enum><header>Effective
				date</header><text display-inline="yes-display-inline">Each State and
				jurisdiction shall be required to comply with the requirements of this section
				on and after January 1,
				2010.</text>

			 seq.) is amended by adding at the end the following new subtitle:</text>

								<subsection commented="no" display-inline="no-display-inline" id="H94A7D9FED9CC4114B34E2B002EF99046"><enum>(a)</enum><header display-inline="yes-display-inline">Standards</header>
									<paragraph commented="no" display-inline="no-display-inline" id="HAAB59CF2EE824ABEBC99088B2861A52"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall issue standards for
				the administration of voting prior to the day scheduled for a Federal
				election.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4400D9483E247D282E79E8080852059"><enum>(2)</enum><header display-inline="yes-display-inline">Standards for polling places</header><text display-inline="yes-display-inline">Such standards shall include the
				nondiscriminatory geographic placement of polling places at which such voting
				occurs and the public listing of the date, time, and location of polling places
				no earlier than 10 days before the date on which such voting begins.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0893114A888A40C191864058927E8CA9"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">Such standards shall be developed in
				consultation with civil rights, voting rights, and voting protection
				organizations, State and local election officials, and other interested members
				of the community.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2710A59A02364249BEAA5D0034DA2E87"><enum>(b)</enum><header display-inline="yes-display-inline">Deviation</header><text display-inline="yes-display-inline">The standards described in subsection (a)
				shall permit States, upon giving reasonable public notice, to deviate from any
				requirement in the case of unforeseen circumstances such as a natural disaster
				or a terrorist
				attack.</text>
								</subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HEFDEFBD510FF44A9A7E8698BB95F9C3E"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 202 of such Act (42 U.S.C. 15322)
			 is amended—</text>

				voting</header><text>Each State shall permit any person who is otherwise
				qualified to vote in an election for Federal office to vote in such election in
				a manner other than in person, and shall not impose any additional conditions
				or restrictions on absentee voting other than a reasonable deadline for
				requesting and returning the ballot.</text>
								</subsection><subsection commented="no" id="id4A7CDB4294F54956A98E96DDA06DF2C5"><enum>(b)</enum><header>Submission and
				processing</header><text>Any ballot cast under subsection (a) shall be
				submitted and processed in the manner provided for absentee ballots under State
				law.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id84DE6A84F0F9460AA7998BCA6ECC7BC2"><enum>(c)</enum><header>Effective
				date</header><text>Each State and jurisdiction shall be required to comply with
				the requirements of this section on and after January 1,

			 mail</header>
			<section commented="no" display-inline="no-display-inline" id="id5B8E1E66F65648FFB910DEB5761F0ADD" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1A7CEC9681124F54B340A2B121E1ED41"><enum>(1)</enum><header display-inline="yes-display-inline">Election</header><text display-inline="yes-display-inline">The term <term>election</term> means any
			 general, special, primary, or runoff election.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C5065EEFB9E46CAA91860C017B1E504"><enum>(2)</enum><header display-inline="yes-display-inline">Participating State</header><text display-inline="yes-display-inline">The term <term>participating State</term>
			 means a State receiving a grant under the Vote by Mail grant program under
			 section 402.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCDA49DE19E941E38DAEF25A47D06C51"><enum>(3)</enum><header display-inline="yes-display-inline">Residual vote rate</header><text display-inline="yes-display-inline">The term <term>residual vote rate</term>
			 means the sum of all votes that cannot be counted in an election (overvotes,
			 undervotes, and otherwise spoiled ballots) divided by the total number of votes
			 cast.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01AFFBEB95B145119BF8CE9A2CCCD243"><enum>(4)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State
			 of the United States, the District of Columbia, the Commonwealth of Puerto
			 Rico, or a territory or possession of the United States.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CBAF8D3BB674816B3C27ACEE6B899ED"><enum>(5)</enum><header display-inline="yes-display-inline">Voting system</header><text display-inline="yes-display-inline">The term <term>voting system</term> has the
			 meaning given such term under section 301(b) of the Help America Vote Act of
			 2002 (42 U.S.C. 15481(b)).</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idC72FDBED5D63472FA88165D5B2F5CCA9" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Vote by mail grant program</header>
				<subsection commented="no" display-inline="no-display-inline" id="id0F846DAB61804DCFB99CCE0C711F59B2"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
			 enactment of this Act, the Election Assistance Commission shall establish a
			 Vote by Mail grant program (in this section referred to as the
			 <quote>program</quote>).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id9592E60110AE4187A90EC5E2AF4D820F"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the program is to make
			 implementation grants to participating States solely for the implementation of
			 procedures for the conduct of all elections by mail at the State or local
			 government level.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idED83431A56B84A61A43CC5756F848AA3"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">In no case may grants made under this
			 section be used to reimburse a State for costs incurred in implementing mail-in
			 voting for elections at the State or local government level if such costs were
			 incurred prior to the date of enactment of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idDDDC7B034E694C5AB292755AF68309B8"><enum>(d)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A State seeking to participate in the
			 program under this section shall submit an application to the Election
			 Assistance Commission containing such information, and at such time, as the
			 Election Assistance Commission may specify.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID17d00300c99143b1bde174fb6de10b8a"><enum>(e)</enum><header display-inline="yes-display-inline">Amount and awarding of implementation
			 grants; duration of program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idCCD32E5A709940C4985ACF37744F57AA"><enum>(1)</enum><header display-inline="yes-display-inline">Amount of implementation grants</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1FFF22C837F1417884D127D2CF108AE4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the amount of
			 an implementation grant made to a participating State shall be, in the case of
			 a State that certifies that it will implement all elections by mail in
			 accordance with the requirements of subsection (f), with respect to—</text>
							<clause commented="no" display-inline="no-display-inline" id="idEAB389602D23468AACBD8B66FC16CE70"><enum>(i)</enum><text display-inline="yes-display-inline">the entire State, $2,000,000; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id66BE1BBAF053402FAEB157F71441B965"><enum>(ii)</enum><text display-inline="yes-display-inline">any single unit or multiple units of local
			 government within the State, $1,000,000.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2b518124692544d3b9377927ceca09ae"><enum>(B)</enum><header display-inline="yes-display-inline">Excess funds</header>
							<clause commented="no" display-inline="no-display-inline" id="id32DA21BF9B2C4C0881A74A7DD54754C7"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the extent that there are excess funds
			 in either of the first 2 years of the program, such funds may be used to award
			 implementation grants to participating States in subsequent years.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id7F3D5C3836F0491586C7ACC478D28271"><enum>(ii)</enum><header display-inline="yes-display-inline">Excess funds defined</header><text display-inline="yes-display-inline">For purposes of clause (i), the term
			 <term>excess funds</term> means any amounts appropriated pursuant to the
			 authorization under subsection (h)(1) with respect to a fiscal year that are
			 not awarded to a participating State under an implementation grant during such
			 fiscal year.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95F6A398F8C54E968FEE146C578E4A63"><enum>(C)</enum><header display-inline="yes-display-inline">Continuing availability of funds after
			 appropriation</header><text display-inline="yes-display-inline">An
			 implementation grant made to a participating State under this section shall be
			 available to the State without fiscal year limitation.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4BD884877F6643B19CD8EE182054BCB7"><enum>(2)</enum><header display-inline="yes-display-inline">Awarding of implementation grants</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1B682324F6F6444AB9C45631248ED802"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Election Assistance Commission shall
			 award implementation grants during each year in which the program is
			 conducted.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2CDA83F1F756490C9757BC288AE9C0AA"><enum>(B)</enum><header display-inline="yes-display-inline">One grant per State</header><text display-inline="yes-display-inline">The Election Assistance Commission shall
			 not award more than 1 implementation grant to any participating State under
			 this section over the duration of the program.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46EDF04DDB6B495A883B4DEACF8FB1E4"><enum>(3)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">The program shall be conducted for a period
			 of 3 years.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3FA368F03B5C4FE8B16B96611CEF4966"><enum>(f)</enum><header display-inline="yes-display-inline">Requirements</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idC28AAAFC5ED148EDB29A70E36038BC07"><enum>(1)</enum><header display-inline="yes-display-inline">Required procedures</header><text display-inline="yes-display-inline">A participating State shall establish and
			 implement procedures for conducting all elections by mail in the area with
			 respect to which it receives an implementation grant to conduct such elections,
			 including the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id7EAD4B19EAD14F7B92497EF3CDE77940"><enum>(A)</enum><text display-inline="yes-display-inline">A process for recording electronically each
			 voter’s registration information and signature.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDAAEF81BBCA4000A1C108195139E4B0"><enum>(B)</enum><text display-inline="yes-display-inline">A process for mailing ballots to all
			 eligible voters.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id645B8BED055B4D08859E467262C3A3D8"><enum>(C)</enum><text display-inline="yes-display-inline">The designation of places for the deposit
			 of ballots cast in an election.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id582FC8863CEF40E6AF78504CA4B3C50C"><enum>(D)</enum><text display-inline="yes-display-inline">A process for ensuring the secrecy and
			 integrity of ballots cast in the election.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6B743B4F7999450D89E4B311A1BF5666"><enum>(E)</enum><text display-inline="yes-display-inline">Procedures and penalties for preventing
			 election fraud and ballot tampering, including procedures for the verification
			 of the signature of the voter accompanying the ballot through comparison of
			 such signature with the signature of the voter maintained by the State in
			 accordance with subparagraph (A).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB684B7CE1B1A4838B5D05E02D4127F2F"><enum>(F)</enum><text display-inline="yes-display-inline">Procedures for verifying that a ballot has
			 been received by the appropriate authority.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96E2161A5AF449C3B5C9B22EE6666A3A"><enum>(G)</enum><text display-inline="yes-display-inline">Procedures for obtaining a replacement
			 ballot in the case of a ballot which is destroyed, spoiled, lost, or not
			 received by the voter.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD1487B00EDC14A47A7D645835725EFF1"><enum>(H)</enum><text display-inline="yes-display-inline">A plan for training election workers in
			 signature verification techniques.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3AF11C80DC5842849F9320A91F27568B"><enum>(I)</enum><text display-inline="yes-display-inline">Plans and procedures to ensure that voters
			 who are blind, visually-impaired, or otherwise disabled have the opportunity to
			 participate in elections conducted by mail and to ensure compliance with the
			 Help America Vote Act of 2002. Such plans and procedures shall be developed in
			 consultation with disabled and other civil rights organizations, voting rights
			 groups, State election officials, voter protection groups, and other interested
			 community organizations.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdacbe7ddec40460a9283a91e882aae25"><enum>(J)</enum><text display-inline="yes-display-inline">Plans and procedures to ensure the
			 translation of ballots and voting materials in accordance with section 203 of
			 the Voting Rights Act of 1965 (42 U.S.C. 1973aa–1a)).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9790C0AC487449AB0400DB2E86E767A"><enum>(K)</enum><text>Plans and
			 procedures to allow for voting in person at designated polling places.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6B6806C310084A7C8710E71315691319"><enum>(g)</enum><header display-inline="yes-display-inline">Best practices, technical assistance, and
			 reports</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id7070085D0C024D7F9DEF53CB6495E6F0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Election Assistance Commission
			 shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF591030792C041E59B880A04A9A701E9"><enum>(A)</enum><text display-inline="yes-display-inline">develop, periodically issue, and, as
			 appropriate, update best practices for conducting elections by mail;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7897EC344EC4434A84D1A5A7E894B5A"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to
			 participating States for the purpose of implementing procedures for conducting
			 elections by mail; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA096130F94254F2C9D17D583A058BDFD"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of
			 Congress—</text>
							<clause commented="no" display-inline="no-display-inline" id="idCBE592C235074BAF96EBF7488A8C4796"><enum>(i)</enum><text display-inline="yes-display-inline">annual reports on the implementation of
			 such procedures by participating States during each year in which the program
			 is conducted; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF466323EAE58494397AF6BFBAD041AFE"><enum>(ii)</enum><text display-inline="yes-display-inline">upon completion of the program conducted
			 under this section, a final report on the program, together with
			 recommendations for such legislation or administrative action as the Election
			 Assistance Commission determines to be appropriate.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC44BBFDDED294B26BF6F91B42DC49D64"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In developing, issuing, and updating best
			 practices, developing materials to provide technical assistance to
			 participating States, and developing the annual and final reports under
			 paragraph (1), the Election Assistance Commission shall consult with interested
			 parties, including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id6FDF9841E7DE4B0EB1278B20C9362056"><enum>(A)</enum><text display-inline="yes-display-inline">State and local election officials;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1C50FE7E8E144B895A8A2D7070FA575"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Postal Service;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE4B4A5283EB4AE59A6D72D4CF3D216C"><enum>(C)</enum><text display-inline="yes-display-inline">the Postal Regulatory Commission
			 established under section 501 of title 39, United States Code; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1B4949DFFBB444AABB73627A1FEBEB61"><enum>(D)</enum><text display-inline="yes-display-inline">voting rights groups, voter protection
			 groups, groups representing the disabled, and other civil rights or community
			 organizations.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8783C4181CF247748094A05A1600D452"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id878099969BE744B2B613BA58480F81C3"><enum>(1)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 award grants under this section, for each of fiscal years 2009 through 2011,
			 $6,000,000, to remain available without fiscal year limitation until
			 expended.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BFEC785346D44B5B17C10E85C2D3C41"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 administer the program under this section, $200,000 for the period of fiscal
			 years 2009 through 2011, to remain available without fiscal year limitation
			 until expended.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2A05B16023544D778C3B61FFF9C1C54C"><enum>(i)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this title may be construed to
			 authorize or require conduct prohibited under any of the following laws, or to
			 supersede, restrict, or limit the application of such laws:</text>

			 for elections</header>
				<subsection commented="no" display-inline="no-display-inline" id="idF83DA20DFDA84CEBAE629C3377F5BC91"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idAEF38C990BEA47A89C8BD8ECC056C55E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States (in this section referred to as the <term>Comptroller General</term>)
			 shall conduct a study evaluating the benefits of broader implementation of
			 mail-in voting in elections, taking into consideration the annual reports
			 submitted by the Election Assistance Commission under section 402(g)(1)(C)(i)
			 before November 1, 2009.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id495E6DCE3FA9423283D31ACD0DC6C4D1"><enum>(2)</enum><header display-inline="yes-display-inline">Specific issues studied</header><text display-inline="yes-display-inline">The study conducted under paragraph (1)
			 shall include a comparison of traditional voting methods and mail-in voting
			 with respect to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id165754407D9340409517090B087571FE"><enum>(A)</enum><text display-inline="yes-display-inline">the likelihood of voter fraud and
			 misconduct;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa56e41f928f24f4395cbbdfb707a9071"><enum>(B)</enum><text display-inline="yes-display-inline">the accuracy of voter rolls;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFBC83D4878EB4B22BA21A2BD4A737A7B"><enum>(C)</enum><text display-inline="yes-display-inline">the accuracy of election results;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID65c892a9109a428ebd594f7bd60df9c5"><enum>(D)</enum><text display-inline="yes-display-inline">voter participation in urban and rural
			 communities and by minorities, language minorities (as defined in section 203
			 of the Voting Rights Act of 1965 (42 U.S.C. 1973aa–1a)), and individuals with
			 disabilities and by individuals who are homeless or who frequently change their
			 official residences;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0089B79419F348AEB5321CE5DDE7652E"><enum>(E)</enum><text display-inline="yes-display-inline">public confidence in the election
			 system;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6f17ec87178b49c2887287af93777bfd"><enum>(F)</enum><text display-inline="yes-display-inline">the residual vote rate, including such rate
			 based on voter age, education, income, race, or ethnicity or whether a voter
			 lives in an urban or rural community, is disabled, or is a language minority
			 (as so defined); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A98F0FEA2B7459ABCFA2614D8397DCF"><enum>(G)</enum><text display-inline="yes-display-inline">cost savings.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB91CAB5E8FE24F16B850B96D984DA013"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In conducting the study under paragraph
			 (1), the Comptroller General shall consult with interested parties,
			 including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id3D541F23E35A43C6B96DEF4A8B69E3BE"><enum>(A)</enum><text display-inline="yes-display-inline">State and local election officials;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFDD4B16A089541948FDF367C46CEF9F2"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Postal Service;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE805560BCF3D4BCFBF930BEDEFD233CD"><enum>(C)</enum><text display-inline="yes-display-inline">the Postal Regulatory Commission
			 established under section 501 of title 39, United States Code; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A7BBEB1309A4674B33C588B43FCE8D7"><enum>(D)</enum><text display-inline="yes-display-inline">voting rights groups, voter protection
			 groups, groups representing the disabled, and other civil rights or community
			 organizations.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDE9792594979442CB6F577CD3BB59454"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than November 1, 2009, the
			 Comptroller General shall prepare and submit to the appropriate committees of
			 Congress a report on the study conducted under subsection (a), together with
			 such recommendations for legislation or administrative action as the
			 Comptroller General determines to be appropriate.</text>
				</subsection></section></title><title id="idDDCE39967B674799935016EE10761945"><enum>IV</enum><header>Vote
			 verification</header>
			<section id="H20623C95922B4C15A4A80CA195600E7"><enum>401.</enum><header>Promoting
			 accuracy, integrity, and security through voter-verified permanent paper
			 ballot</header>
				<subsection id="HA930BA01691647999E5257BD15CCB87"><enum>(a)</enum><header>Ballot
			 Verification and Audit Capacity</header>
					<paragraph id="HA321F70A12914567A31F717F00591713"><enum>(1)</enum><header>In
			 general</header><text>Section 301(a)(2) of the Help America Vote Act of 2002
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C.
			 15481(a)(2)</external-xref>) is amended to read as follows:</text>

				paper ballots</header>
									<clause id="H4530F81B0EA547ABA0170210CC3F45B1"><enum>(i)</enum><header>Verification</header><subclause commented="no" display-inline="yes-display-inline" id="HA7C9F1B062864312909333F184BE0976"><enum>(I)</enum><text display-inline="yes-display-inline">The voting system shall require the use of
				or produce an individual, durable, voter-verified, paper ballot of the voter’s
				vote that shall be created by or made available for inspection and verification
				by the voter before the voter’s vote is cast and counted. For purposes of this
				subclause, the term <term>individual, durable, voter-verified, paper
				ballot</term> includes (but is not limited to) a paper ballot marked by the
				voter for the purpose of being counted by hand or read by an optical scanner or
				other similar device, a paper ballot prepared by the voter to be mailed to an
				election official (whether from a domestic or overseas location), a paper
				ballot created through the use of a nontabulating ballot marking device or
				system, or, in the case of an election held before 2012, a paper ballot
				produced by a direct recording electronic voting machine, so long as in each
				case the voter is permitted to verify the ballot in a paper form in accordance
				with this subparagraph.</text>
										</subclause><subclause id="H8E41C3E051A44E7F9434B33650CDA35F" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">The
				voting system shall provide the voter with an opportunity to correct any error
				made by the system in the voter-verified paper ballot before the permanent
				voter-verified paper ballot is preserved in accordance with clause (ii).</text>
										</subclause><subclause id="HE14CF749C688410A9CE9EB868323DFB8" indent="up1"><enum>(III)</enum><text>The voting system shall not preserve
				the voter-verified paper ballots in any manner that makes it possible, at any
				time after the ballot has been cast, to associate a voter with the record of
				the voter’s vote.</text>
										</subclause></clause><clause id="HDC1F7D2E61644D319EABC03313001839"><enum>(ii)</enum><header>Preservation</header><text display-inline="yes-display-inline">The individual, durable, voter-verified,
				paper ballot produced in accordance with clause (i) shall be used as the
				official ballot for purposes of any recount or audit conducted with respect to
				any election for Federal office in which the voting system is used, and shall
				be preserved—</text>
										<subclause id="H610B5CB9946447DB8D2FE3CBAA4E4BB2"><enum>(I)</enum><text>in the case of
				votes cast at the polling place on the date of the election, within the polling
				place in a secure manner; or</text>
										</subclause><subclause id="H51E3D653D30F4C648787E2AF6B92C5CA"><enum>(II)</enum><text>in any other
				case, in a secure manner which is consistent with the manner employed by the
				jurisdiction for preserving paper ballots in general.</text>
										</subclause></clause><clause id="H01317FDA86A4445F9BE76D3398B293A4"><enum>(iii)</enum><header>Manual audit
				capacity</header><subclause commented="no" display-inline="yes-display-inline" id="H6264C2724DF84C2381ED92AB2F444D87"><enum>(I)</enum><text>Each paper ballot
				produced pursuant to clause (i) shall be suitable for a manual audit equivalent
				to that of a paper ballot voting system, and shall be counted by hand in any
				recount or audit conducted with respect to any election for Federal
				office.</text>
										</subclause><subclause id="H6171BA95764E41D1920000173030B9C5" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">In
				the event of any inconsistencies or irregularities between any electronic vote
				tallies and the vote tallies determined by counting by hand the individual,
				durable, voter-verified, paper ballots produced pursuant to clause (i), and
				subject to subparagraph (B), the individual, durable, voter-verified, paper
				ballots shall be the true and correct record of the votes cast.</text>
										</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H39F9653E32B046169C5D77BDA1CB6C8F"><enum>(B)</enum><header>Special rule for
				treatment of disputes when paper ballots have been shown to be
				compromised</header>
									<clause id="HC08E219D5EBC430988FBAF3D3F8BAC16"><enum>(i)</enum><header>In
				general</header><text>In the event that—</text>
										<subclause id="H1032768EBCA24B45963960D05346DEB3"><enum>(I)</enum><text display-inline="yes-display-inline">there is any inconsistency between any
				electronic vote tallies and the vote tallies determined by counting by hand the
				individual, durable, voter-verified, paper ballots produced pursuant to
				subparagraph (A)(i) with respect to any election for Federal office; and</text>
										</subclause><subclause id="H254400A1D69745C49DF8C21248EF0006"><enum>(II)</enum><text display-inline="yes-display-inline">it is demonstrated by clear and convincing
				evidence (as determined in accordance with the applicable standards in the
				jurisdiction involved) in any recount, audit, or contest of the result of the
				election that the paper ballots have been compromised (by damage or mischief or
				otherwise) and that a sufficient number of the ballots have been so compromised
				that the result of the election could be changed,</text>
										</subclause><continuation-text continuation-text-level="clause">the
				determination of the appropriate remedy with respect to the election shall be
				made in accordance with applicable State law, except that the electronic tally
				shall not be used as the exclusive basis for determining the official certified
				vote tally.</continuation-text></clause><clause id="H0A3879B6662548AFB23C91CC9948CDC0"><enum>(ii)</enum><header>Rule for
				consideration of ballots associated with each voting machine</header><text display-inline="yes-display-inline">For purposes of clause (i), only the paper
				ballots deemed compromised, if any, shall be considered in the calculation of
				whether or not the result of the election could be changed due to the
				compromised paper
				ballots.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H4D86D91DCB2443DB991E2D945B8B2879"><enum>(2)</enum><header>Conforming
			 amendment clarifying applicability of alternative language

			 paper ballots required to be produced under paragraph (2) and the notices

					<paragraph id="HF6FDB862BE6D44A4B33C007BAE6FD3FC"><enum>(1)</enum><header>In
			 general</header><text>Section 301(a)(3)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C.
			 15481(a)(3)(B)</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H28D783C3D3C04CC3A35DB3585D8C001B" style="traditional">
							<subparagraph id="H73A3962E19D3411FBC15829EEFC675E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8A21210FD8C249AABF70E3493E8CDA90"><enum>(i)</enum><text display-inline="yes-display-inline">satisfy the requirement of subparagraph (A)
				through the use of at least one voting system equipped for individuals with
				disabilities, including nonvisual and enhanced visual accessibility for the
				blind and visually impaired, at each polling place; and</text>
								</clause><clause id="id562AED7F83B446B3AF595B2665809A89" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">meet the requirements of subparagraph (A)
				and paragraph (2)(A) by using a system that—</text>
									<subclause id="id1157D95FF84B46188FEFF1A470A8395A"><enum>(I)</enum><text display-inline="yes-display-inline">allows the voter to privately and
				independently verify the permanent paper ballot through the presentation, in
				accessible form, of the printed or marked vote selections from the same printed
				or marked information that would be used for any vote counting or
				auditing;</text>
									</subclause><subclause id="idB156FAD9863A45E1B74E03BEAFA76F06"><enum>(II)</enum><text>ensures that the entire process of
				ballot verification and vote casting is equipped for individuals with
				disabilities, including nonvisual and enhanced visual accessibility for the
				blind and visually impaired; and</text>
									</subclause><subclause id="id8137D6DEF75A461B92611AEFDC059FB5"><enum>(III)</enum><text>does not preclude the supplementary use
				of Braille or tactile ballots;
				and</text>
									</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H4872A1B13A784F759183344B9CB5CEA7"><enum>(2)</enum><header>Specific
			 requirement of study, testing, and development of accessible ballot
			 verification mechanisms</header>
						<subparagraph id="H3C0668B30726467DB4A8C1DAB520D791"><enum>(A)</enum><header>Study and
			 reporting</header><text>Subtitle C of title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15381">42 U.S.C. 15381 et
			 seq.</external-xref>) is amended—</text>
							<clause id="H4DBAD2B9A844440B90B66FB1E3D7B89E"><enum>(i)</enum><text>by
			 redesignating section 247 as section 248; and</text>
							</clause><clause id="HD3C3FDF357F640B68D6CF66E97BECE83"><enum>(ii)</enum><text>by
			 inserting after section 246 the following new section:</text>
								<quoted-block display-inline="no-display-inline" id="HD15EDE212DED40EEACEA6B88DC251799" style="OLC">
									<section id="H28FA9DBDBBF74316851DA8D415EF4510"><enum>247.</enum><header>Study and
				report on accessible ballot verification mechanisms</header>
										<subsection id="HDDBF39A5E74F4D9186B84925E1110088"><enum>(a)</enum><header>Study and
				Report</header><text display-inline="yes-display-inline">The Director of the
				National Institute of Standards and Technology shall study, test, and develop
				best practices to enhance the accessibility of ballot verification mechanisms
				for individuals with disabilities, for voters whose primary language is not
				English, and for voters with difficulties in literacy, including best practices
				for the mechanisms themselves and the processes through which the mechanisms
				are used. In carrying out this section, the Director shall specifically
				investigate existing and potential methods or devices, including non-electronic
				devices, that will assist such individuals and voters in creating
				voter-verified paper ballots and presenting or transmitting the information
				printed or marked on such ballots back to such individuals and voters.</text>
										</subsection><subsection id="H8FFB9A5F98E64A68882E02225E616813"><enum>(b)</enum><header>Coordination
				With Grants for Technology Improvements</header><text>The Director shall
				coordinate the activities carried out under subsection (a) with the research
				conducted under the grant program carried out by the Commission under section
				271, to the extent that the Director and Commission determine necessary to
				provide for the advancement of accessible voting technology.</text>
										</subsection><subsection id="HA57896D4803D4CCEAF81BE33D2BA6D3C"><enum>(c)</enum><header>Deadline</header><text>The
				Director shall complete the requirements of subsection (a) not later than
				December 31, 2010.</text>
										</subsection><subsection id="H550FB216BF46421B956F4DBDC248E8FA"><enum>(d)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated to carry
				out subsection (a) $3,000,000, to remain available until
				expended.</text>
										</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph id="H17AF03F9E0D841CC86ABA7DA63A409F"><enum>(B)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended—</text>
							<clause id="H500D443CDFE44A6CA372F1F6DC070097"><enum>(i)</enum><text>by
			 redesignating the item relating to section 247 as relating to section 248;
			 and</text>

							</clause></subparagraph></paragraph><paragraph id="H5AD95B87CC0B4DBE9CA19B3FE0E5002E"><enum>(3)</enum><header>Clarification of
			 accessibility standards under voluntary voting system guidance</header><text>In
			 adopting any voluntary guidance under subtitle B of title III of the Help
			 America Vote Act with respect to the accessibility of the paper ballot
			 verification requirements for individuals with disabilities, the Election
			 Assistance Commission shall include and apply the same accessibility standards
			 applicable under the voluntary guidance adopted for accessible voting systems
			 under such subtitle.</text>
					</paragraph></subsection><subsection id="H1CEDAEB064CA45B8A603FE94C6DC9525"><enum>(c)</enum><header>Additional
			 Voting System Requirements</header>
					<paragraph id="HF2164C314A0C4612B059F717E43FD026"><enum>(1)</enum><header>Requirements
			 described</header><text>Section 301(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C.
			 15481(a)</external-xref>) is amended by adding at the end the following new
			 paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H89993368025F49B6B9777701BE449756" style="OLC">
							<paragraph id="HB4927158596B491396561B7FF6D28B53"><enum>(7)</enum><header>Instruction
				reminding voters of importance of verifying paper ballot</header>
								<subparagraph id="H278DAECAC0784BFB985DD5C13813A62"><enum>(A)</enum><header>In
				general</header><text>The appropriate election official at each polling place
				shall cause to be placed in a prominent location in the polling place which is
				clearly visible from the voting booths a notice, in large font print accessible
				to the visually impaired, advising voters that the paper ballots representing
				their votes shall serve as the vote of record in all audits and recounts in
				elections for Federal office, and that they should not leave the voting booth
				until confirming that such paper ballots accurately record their vote.</text>
								</subparagraph><subparagraph id="H05FFE60B80084B63A0C7F294B3DD107C"><enum>(B)</enum><header>Systems for
				individuals with disabilities</header><text display-inline="yes-display-inline">All voting systems equipped for individuals
				with disabilities shall present or transmit in accessible form the statement
				referred to in subparagraph (A), as well as an explanation of the verification
				process described in paragraph (3)(B)(ii).</text>
								</subparagraph></paragraph><paragraph id="HE12766DB4FC04C90B315667F42A41F18"><enum>(8)</enum><header>Prohibiting use
				of uncertified election-dedicated voting system technologies; disclosure
				requirements</header>
								<subparagraph id="H482ADA8A35A5419C9F8D1FBD74477775"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">A voting system used
				in an election for Federal office in a State may not at any time during the
				election contain or use any election-dedicated voting system technology—</text>
									<clause id="idD7AEC94EA50D42D4971AF99EA8B4C374"><enum>(i)</enum><text display-inline="yes-display-inline">which has not been certified by the State
				for use in the election; and</text>
									</clause><clause id="id05BBF3AA242D44319B606C60977E336C"><enum>(ii)</enum><text display-inline="yes-display-inline">which has not been deposited with an
				accredited laboratory described in section 231 to be held in escrow and
				disclosed in accordance with this section.</text>
									</clause></subparagraph><subparagraph id="H302928A20EB2457BA20002A80062D3BE"><enum>(B)</enum><header>Requirement for
				and restrictions on disclosure</header><text display-inline="yes-display-inline">An accredited laboratory under section 231
				with whom an election-dedicated voting system technology has been deposited
				shall—</text>
									<clause id="H1F376906CCCF42C5A96700A6A35722D2"><enum>(i)</enum><text>hold the
				technology in escrow; and</text>
									</clause><clause id="H80DC9BFC775944E997D7A483614CB845"><enum>(ii)</enum><text>disclose
				technology and information regarding the technology to another person
				if—</text>
										<subclause id="H782100AF98274E2185DFE33C1F008710"><enum>(I)</enum><text>the person is a
				qualified person described in subparagraph (C) who has entered into a
				nondisclosure agreement with respect to the technology which meets the
				requirements of subparagraph (D); or</text>
										</subclause><subclause id="HEC3F4141BC96459FA7578C394B2BC2A5"><enum>(II)</enum><text>the laboratory is
				required to disclose the technology to the person under State law, in
				accordance with the terms and conditions applicable under such law.</text>
										</subclause></clause></subparagraph><subparagraph id="HD556CC6AEDCE4E66AC55AE91D1D8BE68"><enum>(C)</enum><header>Qualified
				persons described</header><text>With respect to the disclosure of
				election-dedicated voting system technology by a laboratory under subparagraph
				(B)(ii)(I), a <term>qualified person</term> is any of the following:</text>
									<clause id="HCBC80C7BC58E48CEA943C3CE6EE2760"><enum>(i)</enum><text>A
				governmental entity with responsibility for the administration of voting and
				election-related matters for purposes of reviewing, analyzing, or reporting on
				the technology.</text>
									</clause><clause id="H2C57402A73E44A7E83DC688EABE7F357"><enum>(ii)</enum><text>A
				party to pre- or post-election litigation challenging the result of an election
				or the administration or use of the technology used in an election, including
				but not limited to election contests or challenges to the certification of the
				technology, or an expert for a party to such litigation, for purposes of
				reviewing or analyzing the technology to support or oppose the litigation, and
				all parties to the litigation shall have access to the technology for such
				purposes.</text>
									</clause><clause id="H9DB80436E0304550B712E38F24B7471B"><enum>(iii)</enum><text>A person not
				described in clause (i) or (ii) who reviews, analyzes, or reports on the
				technology solely for an academic, scientific, technological, or other
				investigation or inquiry concerning the accuracy or integrity of the
				technology.</text>
									</clause></subparagraph><subparagraph id="HBFC1D0BBB6F34585B5E10064DF4297D7"><enum>(D)</enum><header>Requirements for
				nondisclosure agreements</header><text>A nondisclosure agreement entered into
				with respect to an election-dedicated voting system technology meets the
				requirements of this subparagraph if the agreement—</text>
									<clause id="H9FC9DA8CAB024974A76DDF5128D80125"><enum>(i)</enum><text>is
				limited in scope to coverage of the technology disclosed under subparagraph (B)
				and any trade secrets and intellectual property rights related thereto;</text>
									</clause><clause id="H39A5889F1D4242F69251995D08AA05D9"><enum>(ii)</enum><text>does not prohibit
				a signatory from entering into other nondisclosure agreements to review other
				technologies under this paragraph;</text>
									</clause><clause id="H6299039C9F7845A3A29CE16FA41FFFBD"><enum>(iii)</enum><text>exempts from
				coverage any information the signatory lawfully obtained from another source or
				any information in the public domain;</text>
									</clause><clause id="HFDE4EF80F0AB4DC4AD75B9A6528552E4"><enum>(iv)</enum><text>remains in effect
				for not longer than the life of any trade secret or other intellectual property
				right related thereto;</text>
									</clause><clause id="HA9722937B1DC41698EB22EEABBA9C1A9"><enum>(v)</enum><text>prohibits the use
				of injunctions barring a signatory from carrying out any activity authorized
				under subparagraph (C), including injunctions limited to the period prior to a
				trial involving the technology;</text>
									</clause><clause id="H8C28B0546E7B4AF500D9A0B6EF9E1285"><enum>(vi)</enum><text>is silent as to
				damages awarded for breach of the agreement, other than a reference to damages
				available under applicable law;</text>
									</clause><clause id="H73A8D0FCF843406CB48CFA24446DC200"><enum>(vii)</enum><text>allows
				disclosure of evidence of crime, including in response to a subpoena or
				warrant;</text>
									</clause><clause id="H1D07E4C650EA4E07920072DA00F12595"><enum>(viii)</enum><text>allows the
				signatory to perform analyses on the technology (including by executing the
				technology), disclose reports and analyses that describe operational issues
				pertaining to the technology (including vulnerabilities to tampering, errors,
				risks associated with use, failures as a result of use, and other problems),
				and describe or explain why or how a voting system failed or otherwise did not
				perform as intended; and</text>
									</clause><clause id="H8E842F81B25042A5B5CD9D7FCCEFF759"><enum>(ix)</enum><text>provides that the
				agreement shall be governed by the trade secret laws of the applicable
				State.</text>
									</clause></subparagraph><subparagraph id="H8417112AD9754585AED691F35500D334"><enum>(E)</enum><header>Election-dedicated
				voting system technology defined</header><text display-inline="yes-display-inline">For purposes of this paragraph:</text>
									<clause id="id5677897F9BC5402B8C995E9369098179"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>election-dedicated voting system technology</term> means the
				following:</text>
										<subclause id="id71FD7D31117344449E071398A49F7AB5"><enum>(I)</enum><text>The source code
				used for the trusted build and its file signatures.</text>
										</subclause><subclause id="id0146EDC917D242B5AF8280C986661ACB"><enum>(II)</enum><text>A complete disk
				image of the pre-build, build environment, and any file signatures to validate
				that it is unmodified.</text>
										</subclause><subclause id="id5C66FD11D0684A89B72486E0CA658499"><enum>(III)</enum><text>A complete disk
				image of the post-build, build environment, and any file signatures to validate
				that it is unmodified.</text>
										</subclause><subclause id="idA29AD0A192294E18A376F6C3AC1B908D"><enum>(IV)</enum><text>All executable
				code produced by the trusted build and any file signatures to validate that it
				is unmodified.</text>
										</subclause><subclause id="idDA0DFC93CC6C4BF6AF7A4EDB740E6CCE"><enum>(V)</enum><text>Installation
				devices and software file signatures.</text>
										</subclause></clause><clause id="id8846AE78FE0747C8B359685B3D69E9B4"><enum>(ii)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Such term does not include
				<term>commercial-off-the-shelf</term> software and hardware defined under under
				the 2005 voluntary voting system guidelines adopted by the Commission under
				section 222.</text>
									</clause></subparagraph></paragraph><paragraph id="H31B60147E05B480781CCCCCCE94C5073"><enum>(9)</enum><header>Prohibition of
				use of wireless communications devices in voting systems</header><text display-inline="yes-display-inline">No voting device upon which ballots are
				programmed or votes are cast or tabulated shall contain, use, or be accessible
				by any wireless, power-line, or concealed communication device, except that
				enclosed infrared communications devices which are certified for use in such
				device by the State and which cannot be used for any remote or wide area
				communications or used without the knowledge of poll workers shall be
				permitted.</text>
							</paragraph><paragraph id="HE189CAEFB6314FCE00447E99A2DC25F1"><enum>(10)</enum><header>Prohibiting
				connection of system or transmission of system information over the
				internet</header>
								<subparagraph id="idB9C52E09FD2D4BE580AEBF42DA507672"><enum>(A)</enum><header>In
				general</header><text>No voting device upon which ballots are programmed or
				votes are cast or tabulated shall be connected to the Internet at any
				time.</text>
								</subparagraph><subparagraph id="idCC19664EE52B496BBA8559F10EA0E706"><enum>(B)</enum><header>Rule of
				construction</header><text>Nothing contained in this paragraph shall be deemed
				to prohibit the Commission from conducting the studies under section 242 or to
				conduct other similar studies under any other provision of law in a manner
				consistent with this paragraph.</text>
								</subparagraph></paragraph><paragraph id="H7CFDDFDD6CDB4CD282B4367F8E54C4EF"><enum>(11)</enum><header>Security
				standards for voting systems used in Federal elections</header>
								<subparagraph id="H3F3D90077A3A440AADB04BACE73C0081"><enum>(A)</enum><header>In
				general</header><text>No voting system may be used in an election for Federal
				office unless the manufacturer of such system and the election officials using
				such system meet the applicable requirements described in subparagraph
				(B).</text>
								</subparagraph><subparagraph id="H0FEDCFA0E687444092139BDB1E4F69DA"><enum>(B)</enum><header>Requirements
				described</header><text>The requirements described in this subparagraph are as
				follows:</text>
									<clause id="H7AFBCE3A899F4B208EE5B19C3C8A9F3"><enum>(i)</enum><text>The
				manufacturer and the election officials shall document the secure chain of
				custody for the handling of all software, hardware, vote storage media,
				ballots, and voter-verified ballots used in connection with voting systems, and
				shall make the information available upon request to the Commission.</text>
									</clause><clause id="HA6FC68F6DEC44DA3A2C87DCFF7DD633"><enum>(ii)</enum><text display-inline="yes-display-inline">The manufacturer shall disclose to an
				accredited laboratory under section 231 and to the appropriate election
				official any information required to be disclosed under paragraph (8).</text>
									</clause><clause id="H1B30CD46B99D4EF88D008F9D7F5E3F37"><enum>(iii)</enum><text display-inline="yes-display-inline">After the appropriate election official has
				certified the election-dedicated and other voting system software for use in an
				election, the manufacturer may not—</text>
										<subclause id="H946479E9F1504D108FB204EB6EC4681F"><enum>(I)</enum><text>alter such
				software; or</text>
										</subclause><subclause id="H38BF5C90A9484774A339FA58EBEB12AB"><enum>(II)</enum><text>insert or use in
				the voting system any software not certified by the State for use in the
				election.</text>
										</subclause></clause><clause id="H1B27377BACFF4964B6F7191C6216BCD9"><enum>(iv)</enum><text>At the request of
				the Commission—</text>
										<subclause id="HE7E4A1874B84455A856508C55633C6D1"><enum>(I)</enum><text>the appropriate
				election official shall submit information to the Commission regarding the
				State’s compliance with this subparagraph; and</text>
										</subclause><subclause id="H3839EFC414404B15B07CE225DA29AE71"><enum>(II)</enum><text display-inline="yes-display-inline">the manufacturer shall submit information
				to the Commission regarding the manufacturer’s compliance with this
				subparagraph.</text>
										</subclause></clause></subparagraph><subparagraph id="H40ABF39E21254C389EB20006264032A5"><enum>(C)</enum><header>Development and
				publication of best practices on documentation of secure chain of
				custody</header><text>Not later than August 1, 2010, the Commission shall
				develop and make publicly available best practices regarding the requirement of
				subparagraph (B)(i).</text>
								</subparagraph><subparagraph id="H0B7F7A1AD2304600AF10BC4D60A264B1"><enum>(D)</enum><header>Disclosure of
				secure chain of custody</header><text>The Commission shall make information
				provided to the Commission under subparagraph (B)(i) available to any person
				upon request.</text>
								</subparagraph></paragraph><paragraph id="H05E1EDA40CCC4AE287252455A9C76D38"><enum>(12)</enum><header>Durability and
				readability requirements for ballots</header>
								<subparagraph id="H0EBDCF4CB784430DB3186DEFA7488B3"><enum>(A)</enum><header>Durability
				requirements for paper ballots</header>
									<clause id="HB41139DE7C5E4058B302F25783CE6F00"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">All voter-verified
				paper ballots required to be used under this Act (including the paper ballots
				provided to voters under paragraph (13)) shall be marked, printed, or recorded
				on durable paper.</text>
									</clause><clause id="HF0344168BE824F4100C7FF8374005312"><enum>(ii)</enum><header>Definition</header><text>For
				purposes of this Act, paper is <term>durable</term> if it is capable of
				withstanding multiple counts and recounts by hand without compromising the
				fundamental integrity of the ballots, and capable of retaining the information
				marked, printed, or recorded on them for the full duration of a retention and
				preservation period of 22 months.</text>
									</clause></subparagraph><subparagraph id="H85166F09B81E4CF8B978F17EB29DF1D0"><enum>(B)</enum><header>Readability
				requirements for machine-marked or printed paper ballots</header><text display-inline="yes-display-inline">All voter-verified paper ballots completed
				by the voter through the use of a marking or printing device shall be clearly
				readable by the voter without assistance (other than eyeglasses or other
				personal vision enhancing devices) and by a scanner or other device equipped
				for individuals with disabilities.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="idC9CB226BEB8F470E833DADF978F353E4"><enum>(13)</enum><header>Mandatory
				availability of paper ballots at polling places</header>
								<subparagraph id="id6A6F046350314AF280B5E1653629A32C"><enum>(A)</enum><header>Requiring
				ballots to be offered and provided</header>
									<clause id="id2212870998F44A6C84262E72FD550CD4"><enum>(i)</enum><header>In
				general</header><text>The appropriate election official at each polling place
				in any election for Federal office shall offer each individual who is eligible
				to cast a vote in the election at the polling place the opportunity to cast the
				vote using a pre-printed paper ballot which the individual may mark by hand and
				which is not produced by the direct recording electronic voting machine. The
				official shall provide the individual with the ballot and the supplies
				necessary to mark the ballot.</text>
									</clause><clause id="idFB98970CAA744628870FF32B57E89FB0"><enum>(ii)</enum><header>Special rule
				for locations using DRE voting systems</header><text>In the case of a polling
				place that uses a direct recording electronic voting device, if the individual
				accepts the offer to cast the vote using a paper ballot, the official shall
				ensure (to the greatest extent practicable) that the waiting period for the
				individual to cast a vote is not greater than the waiting period for an
				individual who does not agree to cast the vote using such a paper ballot under
				this paragraph.</text>
									</clause></subparagraph><subparagraph id="id838E7C374C404BFE9B89B55AF85F7504"><enum>(B)</enum><header>Treatment of
				ballot</header><text display-inline="yes-display-inline">Any paper ballot which
				is cast by an individual under this paragraph shall be counted and otherwise
				treated as a regular ballot for all purposes (including by incorporating it
				into the final unofficial vote count (as defined by the State) for the
				precinct) and not as a provisional ballot, unless the individual casting the
				ballot would have otherwise been required to cast a provisional ballot.</text>
								</subparagraph><subparagraph id="idE33F4736CBB54F18B863251F38256E06"><enum>(C)</enum><header>Posting of
				notice</header><text>The appropriate election official shall ensure there is
				prominently displayed at each polling place a notice that describes the
				obligation of the official to offer individuals the opportunity to cast votes
				using a pre-printed paper ballot.</text>
								</subparagraph><subparagraph id="id0CEFF66B726A41309602569122921805"><enum>(D)</enum><header>Training of
				election officials</header><text>The chief State election official shall ensure
				that election officials at polling places in the State are aware of the
				requirements of this paragraph, including the requirement to display a notice
				under subparagraph (C), and are aware that it is a violation of the
				requirements of this title for an election official to fail to offer an
				individual the opportunity to cast a vote using a pre-printed paper
				ballot.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HB16A57EB76DA40E8BE937528F846C218"><enum>(2)</enum><header>Requiring
			 laboratories to meet standards prohibiting conflicts of interest as condition
			 of accreditation for testing of voting system hardware and software</header>
						<subparagraph id="H23E21C654DEA4391AAA03098BBAABAED"><enum>(A)</enum><header>In
			 general</header><text>Section 231(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15371">42 U.S.C.
			 15371(b)</external-xref>) is amended by adding at the end the following new
			 paragraphs:</text>
							<quoted-block display-inline="no-display-inline" id="HDC2A01E66938450000B6A3EE5CB9178" style="OLC">
								<paragraph id="H5703B0AA138D4BA787DE105CADC15726"><enum>(3)</enum><header>Prohibiting
				conflicts of interest; ensuring availability of results</header>
									<subparagraph id="H3FE73DE5504442F8A78E013D3309E300"><enum>(A)</enum><header>In
				general</header><text>A laboratory may not be accredited by the Commission for
				purposes of this section unless—</text>
										<clause id="H9080FA396D53471289D8E3BDF8555287"><enum>(i)</enum><text>the laboratory
				certifies that the only compensation it receives for the testing carried out in
				connection with the certification, decertification, and recertification of the
				manufacturer’s voting system hardware and software is the payment made from the
				Testing Escrow Account under paragraph (4);</text>
										</clause><clause id="HF078F419DE804DD08DE6D627DB102BFA"><enum>(ii)</enum><text>the laboratory
				meets such standards as the Commission shall establish (after notice and
				opportunity for public comment) to prevent the existence or appearance of any
				conflict of interest in the testing carried out by the laboratory under this
				section, including standards to ensure that the laboratory does not have a
				financial interest in the manufacture, sale, and distribution of voting system
				hardware and software, and is sufficiently independent from other persons with
				such an interest;</text>
										</clause><clause id="H79A52D9393E54FC49753CD74D2E7B7E5"><enum>(iii)</enum><text display-inline="yes-display-inline">the laboratory certifies that it will
				permit an expert designated by the Commission to observe any testing the
				laboratory carries out under this section; and</text>
										</clause><clause id="H82E3DCD9FFC1481500D9F619176355F8"><enum>(iv)</enum><text>the laboratory,
				upon completion of any testing carried out under this section, discloses the
				test protocols, results, and all communication between the laboratory and the
				manufacturer to the Commission.</text>
										</clause></subparagraph><subparagraph id="H0462D251E4D94BF7BF3800094500D572"><enum>(B)</enum><header>Availability of
				results</header><text>Upon receipt of information under subparagraph (A), the
				Commission shall make the information available promptly to election officials
				and the public.</text>
									</subparagraph></paragraph><paragraph id="H2069641136D04E5E9760D07C6400E3BA"><enum>(4)</enum><header>Procedures for
				conducting testing; payment of user fees for compensation of accredited
				laboratories</header>
									<subparagraph id="H49B12CC5FCB54378BB7D992C2C1D2C81"><enum>(A)</enum><header>Establishment of
				escrow account</header><text display-inline="yes-display-inline">The Commission
				shall establish an escrow account (to be known as the <term>Testing Escrow
				Account</term>) for making payments to accredited laboratories for the costs of
				the testing carried out in connection with the certification, decertification,
				and recertification of voting system hardware and software.</text>
									</subparagraph><subparagraph id="H9FBFA86A3C904322AA82797F5B73FD64"><enum>(B)</enum><header>Schedule of
				fees</header><text display-inline="yes-display-inline">In consultation with the
				accredited laboratories, the Commission shall establish and regularly update a
				schedule of fees for the testing carried out in connection with the
				certification, decertification, and recertification of voting system hardware
				and software, based on the reasonable costs expected to be incurred by the
				accredited laboratories in carrying out the testing for various types of
				hardware and software.</text>
									</subparagraph><subparagraph id="H71B5AB4794BA473EBBB56FBAB43775E6"><enum>(C)</enum><header>Requests and
				payments by manufacturers</header><text display-inline="yes-display-inline">A
				manufacturer of voting system hardware and software may not have the hardware
				or software tested by an accredited laboratory under this section
				unless—</text>
										<clause id="H0170A0EA27594056B303D4F39E9434D9"><enum>(i)</enum><text>the manufacturer
				submits a detailed request for the testing to the Commission; and</text>
										</clause><clause id="H43CBF2AB9FA84D79BDA1BF0365009EB8"><enum>(ii)</enum><text>the manufacturer
				pays to the Commission, for deposit into the Testing Escrow Account established
				under subparagraph (A), the applicable fee under the schedule established and
				in effect under subparagraph (B).</text>
										</clause></subparagraph><subparagraph id="HC36B2EBC186D4CF1B8AFD402A046EB25"><enum>(D)</enum><header>Selection of
				laboratory</header><text>Upon receiving a request for testing and the payment
				from a manufacturer required under subparagraph (C), the Commission shall
				select at random (to the greatest extent practicable), from all laboratories
				which are accredited under this section to carry out the specific testing
				requested by the manufacturer, an accredited laboratory to carry out the
				testing.</text>
									</subparagraph><subparagraph id="HE49E284D4FBE44C9906594F8F2FF0423"><enum>(E)</enum><header>Payments to
				laboratories</header><text display-inline="yes-display-inline">Upon receiving a
				certification from a laboratory selected to carry out testing pursuant to
				subparagraph (D) that the testing is completed, along with a copy of the
				results of the test as required under paragraph (3)(A)(iv), the Commission
				shall make a payment to the laboratory from the Testing Escrow Account
				established under subparagraph (A) in an amount equal to the applicable fee
				paid by the manufacturer under subparagraph (C)(ii).</text>
									</subparagraph></paragraph><paragraph id="HC85DBDB4023B4B629FCBB951D84090C0"><enum>(5)</enum><header>Dissemination of
				additional information on accredited laboratories</header>
									<subparagraph id="H5A1AFBEA661346EEB61D7C6DAB332F28"><enum>(A)</enum><header>Information on
				testing</header><text display-inline="yes-display-inline">Upon completion of
				the testing of a voting system under this section, the Commission shall
				promptly disseminate to the public the identification of the laboratory which
				carried out the testing.</text>
									</subparagraph><subparagraph id="H86F51BD3BA5144D08FB8BCCF2DB41D8"><enum>(B)</enum><header>Information on
				status of laboratories</header><text display-inline="yes-display-inline">The
				Commission shall promptly notify Congress, the chief State election official of
				each State, and the public whenever—</text>
										<clause id="H39528A105C37484CAF5DE5009DA29F31"><enum>(i)</enum><text>the Commission
				revokes, terminates, or suspends the accreditation of a laboratory under this
				section;</text>
										</clause><clause id="HA2207B41C36E4B32BCB09FF3E6F7DE70"><enum>(ii)</enum><text>the Commission
				restores the accreditation of a laboratory under this section which has been
				revoked, terminated, or suspended; or</text>
										</clause><clause id="HCDE07709A8074CA280A32EFC0055CAA9"><enum>(iii)</enum><text>the Commission
				has credible evidence of significant security failure at an accredited
				laboratory.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="HCE43676821244C47A692F4002D886CFF"><enum>(B)</enum><header>Conforming
			 amendments</header><text>Section 231 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15371">42 U.S.C. 15371</external-xref>)
			 is further amended—</text>
							<clause id="H6ED91AD9AF404A3C920000763101F16E"><enum>(i)</enum><text>in
			 subsection (a)(1), by striking <quote>testing, certification,</quote> and all
			 that follows and inserting the following: <quote>testing of voting system
			 hardware and software by accredited laboratories in connection with the
			 certification, decertification, and recertification of the hardware and
			 software for purposes of this Act.</quote>;</text>
							</clause><clause id="H6F344053D0EF4322B233FF5900257E00"><enum>(ii)</enum><text>in
			 subsection (a)(2), by striking <quote>testing, certification,</quote> and all
			 that follows and inserting the following: <quote>testing of its voting system
			 hardware and software by the laboratories accredited by the Commission under
			 this section in connection with certifying, decertifying, and recertifying the
			 hardware and software.</quote>;</text>
							</clause><clause id="HBCBFB991B9BC4CD7A5A436F3BC29879"><enum>(iii)</enum><text>in
			 subsection (b)(1), by striking <quote>testing, certification, decertification,
			 and recertification</quote> and inserting <quote>testing</quote>; and</text>
							</clause><clause id="HA8FF6DC8AEC9408F83A5004B3294F622"><enum>(iv)</enum><text>in
			 subsection (d), by striking <quote>testing, certification, decertification, and
			 recertification</quote> each place it appears and inserting
			 <quote>testing</quote>.</text>
							</clause></subparagraph><subparagraph id="H0CFE1A40E26748F09CA9D7E64722425"><enum>(C)</enum><header>Deadline for
			 establishment of standards, escrow account, and schedule of
			 fees</header><text>The Election Assistance Commission shall establish the
			 standards described in section 231(b)(3) of the Help America Vote Act of 2002
			 and the Testing Escrow Account and schedule of fees described in section
			 231(b)(4) of such Act (as added by subparagraph (A)) not later than January 1,
			 2010.</text>
						</subparagraph><subparagraph id="HD4D8002D87E8474DAB71639F10AC065B"><enum>(D)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Election Assistance Commission such sums
			 as may be necessary to carry out the Commission’s duties under paragraphs (3)
			 and (4) of section 231 of the Help America Vote Act of 2002 (as added by
			 subparagraph (A)).</text>
						</subparagraph></paragraph><paragraph id="H6AC9B3D855D746CF9B78A374DAA8CC1E"><enum>(3)</enum><header>Special
			 certification of ballot durability and readability requirements for States not
			 currently using durable paper ballots</header>
						<subparagraph id="HAC23349E0CC74D508639A741CE963100"><enum>(A)</enum><header>In
			 general</header><text>If any of the voting systems used in a State for the
			 regularly scheduled 2008 general elections for Federal office did not require
			 the use of or produce durable paper ballots, the State shall certify to the
			 Election Assistance Commission not later than 90 days after the date of the
			 enactment of this Act that the State will be in compliance with the
			 requirements of sections 301(a)(2) and 301(a)(12) of the Help America Vote of
			 2002, as added or amended by this subsection, in accordance with the deadlines
			 established under this Act, and shall include in the certification the methods
			 by which the State will meet the requirements.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HBE6EEE5B75CD42808052E85BC886C9E"><enum>(B)</enum><header>Certifications by
			 States that require changes to State law</header><text>In the case of a State
			 that requires State legislation to carry out an activity covered by any
			 certification submitted under this paragraph, the State shall be permitted to
			 make the certification notwithstanding that the legislation has not been
			 enacted at the time the certification is submitted and such State shall submit
			 an additional certification once such legislation is enacted.</text>
						</subparagraph></paragraph><paragraph id="H811CA2B242554D42A88D6E4252561468"><enum>(4)</enum><header>Grants for
			 research on development of election-dedicated voting system software</header>
						<subparagraph id="HDF93092D47274A92001FD1E879E720CF"><enum>(A)</enum><header>In
			 general</header><text>Subtitle D of title II of the Help America Vote Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15401">42 U.S.C.
			 15401 et seq.</external-xref>) is amended by adding at the end the following
			 new part:</text>
							<quoted-block display-inline="no-display-inline" id="HA6C34B4C2A2E4691B05419DC35E2D4BB" style="OLC">
								<part id="H0C102AD8A9604EE3833044F6981B7FB"><enum>7<?LEXA-Enum 7?></enum><header>Grants for research on development of
				election-dedicated voting system software</header>
									<section id="H6CD208E3933D4421A634F5003F6CC55"><enum>297.</enum><header>Grants for
				research on development of election-dedicated voting system software</header>
										<subsection id="H75093CCAD20A4591B4E2F8BFBBC94FA6"><enum>(a)</enum><header>In
				General</header><text>The Director of the National Science Foundation
				(hereafter in this part referred to as the <term>Director</term>) shall make
				grants to not fewer than 3 eligible entities to conduct research on the
				development of election-dedicated voting system software.</text>
										</subsection><subsection id="HFF5D1E3F9F7D44B7AF13158704941878"><enum>(b)</enum><header>Eligibility</header><text>An
				entity is eligible to receive a grant under this part if it submits to the
				Director (at such time and in such form as the Director may require) an
				application containing—</text>
											<paragraph id="HB905564B6F89487EAB74C3AE1FB9D9C6"><enum>(1)</enum><text display-inline="yes-display-inline">certifications regarding the benefits of
				operating voting systems on election-dedicated software which is easily
				understandable and which is written exclusively for the purpose of conducting
				elections;</text>
											</paragraph><paragraph id="H03FF95F692324D67A11EEC79EBB4B500"><enum>(2)</enum><text>certifications
				that the entity will use the funds provided under the grant to carry out
				research on how to develop voting systems that run on election-dedicated
				software and that will meet the applicable requirements for voting systems
				under title III; and</text>
											</paragraph><paragraph id="H16EBEB8E4C61457DB8D66B8EA700E2DF"><enum>(3)</enum><text>such other
				information and certifications as the Director may require.</text>
											</paragraph></subsection><subsection id="HEDC3BF03E3E348FE9E1291B400C8BC5"><enum>(c)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated for grants
				under this section $1,500,000 for each of fiscal years 2010 and 2011, to remain
				available until
				expended.</text>
										</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>

				payments for fiscal year 2010</header>
									<subparagraph id="HF16E227C1B6840829F51DBFA4BB1D76"><enum>(A)</enum><header>In
				general</header><text>In the case of the requirements payment made to a State
				for fiscal year 2010, the <term>State allocation percentage</term> for a State
				is the amount (expressed as a percentage) equal to the quotient of—</text>

				number of noncompliant precincts in the State and 50 percent of the number of
				partially noncompliant precincts in the State; and</text>

				number of noncompliant precincts in all States and 50 percent of the number of

				paragraph, a <term>noncompliant precinct</term> means any precinct (or

				administer the regularly scheduled general election for Federal office held in
				November 2008 did not meet either of the requirements described in subparagraph
				(D).</text>
									</subparagraph><subparagraph id="H350BC21822D749C89EC857E685E786E"><enum>(C)</enum><header>Partially
				noncompliant precinct defined</header><text display-inline="yes-display-inline">In this paragraph, a <term>partially
				noncompliant precinct</term> means any precinct (or equivalent location) within
				a State for which the voting system used to administer the regularly scheduled
				general election for Federal office held in November 2008 met only one of the
				requirements described in subparagraph (D).</text>
									</subparagraph><subparagraph id="HF16834E65A4E4576A41D41B3E4A032E"><enum>(D)</enum><header>Requirements
				described</header><text display-inline="yes-display-inline">The requirements
				described in this subparagraph with respect to a voting system are as
				follows:</text>
										<clause id="H91695CD24B47496C97C9A37828539C7B"><enum>(i)</enum><text display-inline="yes-display-inline">The primary voting system required the use
				of or produced durable paper ballots (as described in section 301(a)(12)(A))
				for every vote cast.</text>
										</clause><clause id="H0654DFCF1E04436384C48545853B1326"><enum>(ii)</enum><text display-inline="yes-display-inline">The voting system provided that the entire
				process of paper ballot verification was equipped for individuals with
				disabilities.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H83475E280CB04F68B9A1914D2F3303B0"><enum>(3)</enum><header>Revised
			 conditions for receipt of funds</header><text>Section 253 of such Act

							<quoted-block display-inline="no-display-inline" id="H5F603DDAB5974DA5A621252554C290B5" style="OLC">
								<subsection id="HDB1C16877EAB43639D35EC3302E84343"><enum>(f)</enum><header>Special Rule for
				Fiscal Year 2010</header>
									<paragraph id="H3B843D5E65654AB2B5BF0600F5C03514"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this part, a State is eligible to receive a requirements
				payment for fiscal year 2010 if, not later than 90 days after the date of the
				enactment of the <short-title>Voting Opportunities and
				Integrity in the Conduct of Elections Act of 2008</short-title>, the chief
				executive officer of the State, or designee, in consultation and coordination
				with the chief State election official—</text>
										<subparagraph id="HCF8234E577B4419681EFC9D63623E341"><enum>(A)</enum><text>certifies to the
				Commission the number of noncompliant and partially noncompliant precincts in
				the State (as defined in section 252(b)(2)); and</text>
										</subparagraph><subparagraph id="H42EF70FA9F874790B74E45A63935883E"><enum>(B)</enum><text>files a statement
				with the Commission describing the State’s need for the payment and how the
				State will use the payment to meet the requirements of title III (in accordance
				with the limitations applicable to the use of the payment under section
				257(a)(4)).</text>
										</subparagraph></paragraph><paragraph id="H9B9FBE3FE6A54B3AA3207845F8593403"><enum>(2)</enum><header>Certifications
				by States that require changes to State law</header><text>In the case of a
				State that requires State legislation to carry out any activity covered by any
				certification submitted under this subsection, the State shall be permitted to
				make the certification notwithstanding that the legislation has not been
				enacted at the time the certification is submitted and such State shall submit
				an additional certification once such legislation is
				enacted.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H7C982873445D443B951DC497F12D947E"><enum>(4)</enum><header>Permitting use
			 of funds for reimbursement for costs previously incurred</header><text>Section
			 251(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15401">42 U.S.C. 15401(c)(1)</external-xref>) is amended
			 by striking the period at the end and inserting the following: <quote>, or as a
			 reimbursement for any costs incurred after November 2006 in meeting the
			 requirements of title III which are imposed pursuant to the amendments made by
			 section 401 of the <short-title>Voting Opportunities and
			 Integrity in the Conduct of Elections Act of 2008</short-title> or in otherwise
			 upgrading or replacing voting systems in a manner consistent with such
			 amendments (so long as the voting systems meet any of the requirements that
			 apply with respect to elections for Federal office held in 2012 and each
			 succeeding year).</quote>.</text>
					</paragraph><paragraph id="H30AB107D20AD4004894137C5661BC19B"><enum>(5)</enum><header>Rule of
			 construction regarding States receiving other funds for replacing punch card,
			 lever, or other voting machines</header><text>Nothing in the amendments made by
			 this subsection or in any other provision of the Help America Vote Act of 2002
			 may be construed to prohibit a State which received or was authorized to
			 receive a payment under title I or II of such Act for replacing punch card,
			 lever, or other voting machines from receiving or using any funds which are
			 made available under the amendments made by this subsection.</text>
					</paragraph><paragraph id="id39391370E2EC4C4A8E1E615D32986F8C"><enum>(6)</enum><header>Rule of
			 construction regarding use of funds received in prior years</header>
						<subparagraph id="idA17A1EBBEDF84948BDA7205E3E96022A"><enum>(A)</enum><header>In
			 general</header><text>Nothing contained in this Act or the Help America Vote
			 Act of 2002 may be construed to prohibit a State from using funds received
			 under title I or II of the Help America Vote Act of 2002—</text>
							<clause id="id054BAF1F9E6649A583B999382B5AF5EA"><enum>(i)</enum><text>to
			 purchase or acquire by other means a voting system that meets the requirements
			 of paragraphs (2) and (3) of section 301 of the Help America Vote Act of 2002
			 (as amended by this Act); or</text>
							</clause><clause id="id633FA3E562794E47AA98409E48504BBF"><enum>(ii)</enum><text>to
			 retrofit a voting system so that it will meet such requirements,</text>
							</clause><continuation-text continuation-text-level="subparagraph">in order
			 to replace or upgrade (as the case may be) voting systems purchased with funds
			 received under the Help America Vote Act of 2002 that do not require the use of
			 or produce paper ballots.</continuation-text></subparagraph><subparagraph id="idC5B4B43C7D874AAC883B7F7A915F99B2"><enum>(B)</enum><header>Waiver of
			 notice and comment requirements</header><text>The requirements of subparagraphs
			 (A), (B), and (C) of section 254(a)(11) of the Help America Vote Act of 2002
			 shall not apply to any State using funds received under such Act for the
			 purposes described in clause (i) or (ii) of subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="H5C5BC66C6A8147E5B5A1CA5CC0D78500"><enum>(7)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply with
			 respect to fiscal years beginning with fiscal year 2010.</text>
					</paragraph></subsection><subsection id="H01BAF24B88A64242A715B96932ADD200"><enum>(e)</enum><header>Effective Date
			 for New Requirements</header><text>Section 301(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C.
			 15481(d)</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HCACBF36FD4CD497183C323D93BAA1778" style="OLC">
						<subsection id="H67ED6E0AA65E4A4499A8F4DD71349949"><enum>(d)</enum><header>Effective
				Date</header>
							<paragraph id="H61CFB51F593C468F8003D9A72B2D96EF"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), each State and
				jurisdiction shall be required to comply with the requirements of this section
				on and after January 1, 2006.</text>
							</paragraph><paragraph id="H7615AF1ED87248269E40A774001BBAF0"><enum>(2)</enum><header>Special rule for
				certain requirements</header>
								<subparagraph id="H483202A27F7448B4AB27175F9F5BA381"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (B), the requirements of this section which are first imposed on a
				State and jurisdiction pursuant to the amendments made by section 401 of the
				<short-title>Voting Opportunities and Integrity in the
				Conduct of Elections Act of 2008</short-title> shall apply with respect to the
				regularly scheduled general election for Federal office held in November 2010
				and each succeeding election for Federal office.</text>
								</subparagraph><subparagraph id="HCB40BFF65DE447B686A6AE31107782E0"><enum>(B)</enum><header>Delay for
				jurisdictions using certain paper ballot printers or certain paper
				ballot-equipped accessible machines in 2006</header>
									<clause id="HD1F6D40BF5E54A488323DE024D446545"><enum>(i)</enum><header>Delay</header><text>In
				the case of a jurisdiction described in clause (ii), subparagraph (A) shall
				apply to the jurisdiction as if the reference in such subparagraph to
				<quote>the regularly scheduled general election for Federal office held in
				November 2010 and each succeeding election for Federal office</quote> were a
				reference to <quote>elections for Federal office occurring during 2012 and each
				succeeding year</quote>, but only with respect to the following requirements of
				this section:</text>
										<subclause id="H3F10634D186443D8AFF61704764CE8E3"><enum>(I)</enum><text>Paragraph
				(3)(B)(ii)(I) and (II) of subsection (a) (relating to access to verification
				from the durable paper ballot).</text>
										</subclause><subclause id="H2A82BFE22E8D4DF393E8C2F2028420D2"><enum>(II)</enum><text>Paragraph (12) of
				subsection (a) (relating to durability and readability requirements for
				ballots).</text>
										</subclause></clause><clause id="HBFB221D6EAB14A24A227503E0132F080"><enum>(ii)</enum><header>Jurisdictions
				described</header><text display-inline="yes-display-inline">A jurisdiction
				described in this clause is—</text>
										<subclause id="H75BFA26791594B039CBA37A584DE968C"><enum>(I)</enum><text>a jurisdiction
				which used thermal reel-to-reel voter verified paper ballot printers attached
				to direct recording electronic voting machines for the administration of the
				regularly scheduled general election for Federal office held in November 2008
				and which will continue to use such printers (or other printers which meet the
				requirements of paragraph (3)(B)(ii)(I) and (II) of subsection (a)) attached to
				such voting machines for the administration of elections for Federal office
				held in years before 2012; or</text>
										</subclause><subclause id="H7C16CBE8B0E64965BA29AB333FE14158"><enum>(II)</enum><text display-inline="yes-display-inline">a jurisdiction which used voting machines
				which met the accessibility requirements of paragraph (3) of subsection (a) (as
				in effect with respect to such election) for the administration of the
				regularly scheduled general election for Federal office held in November 2008
				and which used or produced a paper ballot, and which will continue to use such
				voting machines (or other voting machines which meet the requirements of this
				section) for the administration of elections for Federal office held in years
				before
				2012.</text>
										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HE1BB870913A848BBA16C5D40E89FC929"><enum>402.</enum><header>Enhancement of
			 enforcement of Help America Vote Act of 2002</header><text display-inline="no-display-inline">Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>)
			 is amended—</text>
				<paragraph id="H3683E3A6137240329E141FC518389FDB"><enum>(1)</enum><text>by striking
			 <quote>The Attorney General</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In General.—</header-in-text>The
			 Attorney General</quote>; and</text>
				</paragraph><paragraph id="H0AFED14C9470448D81BDC1C06173D718"><enum>(2)</enum><text>by adding at the
			 end the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="H65A7DC1980784FA1AB82D784AFA43DA8" style="OLC">
						<subsection id="HA80FC3A653F5446CBC6787C1FC2AD91"><enum>(b)</enum><header>Filing of
				Complaints by Aggrieved Persons</header>
							<paragraph id="HA88CEC589F4E48369599EA9B8E952440"><enum>(1)</enum><header>In
				general</header><text>A person who is aggrieved by a violation of section 301,
				302, 303, 304, or 305 which has occurred, is occurring, or is about to occur
				may file a written, signed, notarized complaint with the Attorney General
				describing the violation and requesting the Attorney General to take
				appropriate action under this section. The Attorney General shall immediately
				provide a copy of a complaint filed under the previous sentence to the entity
				responsible for administering the State-based administrative complaint
				procedures described in section 402(a) for the State involved.</text>
							</paragraph><paragraph id="HC2AD252612EF44A585456BE9057BF644"><enum>(2)</enum><header>Response by
				Attorney General</header><text>The Attorney General shall respond to each
				complaint filed under paragraph (1), in accordance with procedures established
				by the Attorney General that require responses and determinations to be made
				within the same (or shorter) deadlines which apply to a State under the
				State-based administrative complaint procedures described in section 402(a)(2).
				The Attorney General shall immediately provide a copy of the response made
				under the previous sentence to the entity responsible for administering the
				State-based administrative complaint procedures described in section 402(a) for
				the State involved.</text>
							</paragraph></subsection><subsection id="HF4AC991245374C6893FC922E041BB8B6"><enum>(c)</enum><header>Clarification of
				availability of private right of action</header><text>Nothing in this section
				may be construed to prohibit any person from bringing an action under section
				1979 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>)
				(including any individual who seeks to enforce the individual’s right to a
				voter-verified paper ballot, the right to have the voter-verified paper ballot
				counted in accordance with this Act, or any other right under subtitle A of
				title III) to enforce the uniform and nondiscriminatory election technology and
				administration requirements under sections 301, 302, 303, 304, and 305.</text>
						</subsection><subsection id="HCB6A5124D97C40D20040285870EAD6C"><enum>(d)</enum><header>No effect on
				State procedures</header><text>Nothing in this section may be construed to
				affect the availability of the State-based administrative complaint procedures
				required under section 402 to any person filing a complaint under this
				subsection.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H3E13F4CA3D264731810958C603DB24CB"><enum>403.</enum><header>Requirement for
			 mandatory manual audits by hand count</header>
				<subsection id="HD1EB1F35FD8A458B891FAE4418550699"><enum>(a)</enum><header>Mandatory Manual
			 Audits</header><text>Title III of the Help America Vote Act of 2002
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et
			 seq.</external-xref>) is amended by adding at the end the following new
			 subtitle:</text>
					<quoted-block display-inline="no-display-inline" id="HBFEA476B8EBC4233B50324CB48F61EB5" style="OLC">
						<subtitle id="H3B5E7914A3CF416EAA14DFA8A2D47A8"><enum>C</enum><header>Mandatory manual
				audits</header>
							<section id="H6D2CAA62EBAF414AB0F313CD849EA13B"><enum>321.</enum><header>Requiring
				audits of results of elections</header>
								<subsection id="H9434442B5F104678A8DD00E3F3E85892"><enum>(a)</enum><header>Requiring
				Audits</header>
									<paragraph id="H9E504F64B9F14335AFC380932DDD17BD"><enum>(1)</enum><header>In
				general</header><text>In accordance with this subtitle, each State shall
				administer, without advance notice to the precincts selected, audits of the
				results of elections for Federal office held in the State (and, at the option
				of the State or jurisdiction involved, of elections for State and local office
				held at the same time as such election) consisting of random hand counts of the
				voter-verified paper ballots required to be produced and preserved pursuant to
				section 301(a)(2).</text>
									</paragraph><paragraph id="H659C3D9800464CEA94C12EFABA26295F"><enum>(2)</enum><header>Exception for
				certain elections</header><text>A State shall not be required to administer an
				audit of the results of an election for Federal office under this subtitle if
				the winning candidate in the election—</text>
										<subparagraph id="H4FE6C74F68794537B450C7340777192"><enum>(A)</enum><text>had no opposition
				on the ballot; or</text>
										</subparagraph><subparagraph id="H2AC4DB0C536E49C98CAA21124365EBD9"><enum>(B)</enum><text>received 80
				percent or more of the total number of votes cast in the election, as
				determined on the basis of the final unofficial vote count.</text>
										</subparagraph></paragraph></subsection><subsection id="H7BD10F89E0FD4726BDB5B7C411DABC90"><enum>(b)</enum><header>Determination of
				Entity Conducting Audits; Application of GAO Independence
				Standards</header><text>The State shall administer audits under this subtitle
				through an entity selected for such purpose by the State in accordance with
				such criteria as the State considers appropriate consistent with the
				requirements of this subtitle, except that the entity must meet the general
				standards established by the Comptroller General and as set forth in the
				Comptroller General’s Government Auditing Standards to ensure the independence
				(including the organizational independence) of entities performing financial
				audits, attestation engagements, and performance audits.</text>
								</subsection><subsection id="H750C67CE7CCD43B5A38CE335CA2248DC"><enum>(c)</enum><header>References to
				Election Auditor</header><text>In this subtitle, the term <term>Election
				Auditor</term> means, with respect to a State, the entity selected by the State
				under subsection (b).</text>
								</subsection></section><section display-inline="no-display-inline" id="HB1F849284E7A4EEC882C013CBFABE4" section-type="subsequent-section"><enum>322.</enum><header>Number of ballots
				counted under audit</header>
								<subsection id="HE32D2B00496E48FCAFB1ABEE2DF3C803"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">Except as provided in
				subsection (b), the number of voter-verified paper ballots which will be
				subject to a hand count administered by the Election Auditor of a State under
				this subtitle with respect to an election shall be determined as
				follows:</text>
									<paragraph id="HE2E7F69CEC7B499B8E60E4AD4949F5D0"><enum>(1)</enum><text display-inline="yes-display-inline">In the event that the unofficial count as
				described in section 323(a)(1) reveals that the margin of victory between the
				two candidates receiving the largest number of votes in the election is less
				than 1 percent of the total votes cast in that election, the hand counts of the
				voter-verified paper ballots shall occur in at least 10 percent of all
				precincts or equivalent locations (or alternative audit units used in
				accordance with the method provided for under subsection (b)) in the
				Congressional district involved (in the case of an election for the House of
				Representatives) or the State (in the case of any other election for Federal
				office).</text>
									</paragraph><paragraph id="HBD97872CED35432A88435D08CC2232FA"><enum>(2)</enum><text display-inline="yes-display-inline">In the event that the unofficial count as
				described in section 323(a)(1) reveals that the margin of victory between the
				two candidates receiving the largest number of votes in the election is greater
				than or equal to 1 percent but less than 2 percent of the total votes cast in
				that election, the hand counts of the voter-verified paper ballots shall occur
				in at least 5 percent of all precincts or equivalent locations (or alternative
				audit units used in accordance with the method provided for under subsection
				(b)) in the Congressional district involved (in the case of an election for the
				House of Representatives) or the State (in the case of any other election for
				Federal office).</text>
									</paragraph><paragraph id="HA88D20A0CA60497E00A4EB906DF3968C"><enum>(3)</enum><text display-inline="yes-display-inline">In the event that the unofficial count as
				described in section 323(a)(1) reveals that the margin of victory between the
				two candidates receiving the largest number of votes in the election is equal
				to or greater than 2 percent of the total votes cast in that election, the hand
				counts of the voter-verified paper ballots shall occur in at least 3 percent of
				all precincts or equivalent locations (or alternative audit units used in
				accordance with the method provided for under subsection (b)) in the
				Congressional district involved (in the case of an election for the House of
				Representatives) or the State (in the case of any other election for Federal
				office).</text>
									</paragraph></subsection><subsection id="H6F2892980C3F4045BAE09DFA0E600E2"><enum>(b)</enum><header>Use of
				Alternative Mechanism</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), a State may
				adopt and apply an alternative mechanism to determine the number of
				voter-verified paper ballots which will be subject to the hand counts required
				under this subtitle with respect to an election, so long as the alternative
				mechanism uses the voter-verified paper ballots to conduct the audit and the
				National Institute of Standards and Technology determines that the alternative
				mechanism will be at least as statistically effective in ensuring the accuracy
				of the election results as the procedure under this subtitle.</text>
								</subsection></section><section display-inline="no-display-inline" id="HEE6F1EBAF960446EB75646E88DB45BF" section-type="subsequent-section"><enum>323.</enum><header>Process for
				administering audits</header>
								<subsection id="HF572F03E61A04286811EF2FF0021E3E2"><enum>(a)</enum><header>In
				General</header><text>The Election Auditor of a State shall administer an audit
				under this section of the results of an election in accordance with the
				following procedures:</text>
									<paragraph id="H034F1D0A0887448F9E961887885F00CA"><enum>(1)</enum><text>Within 24 hours
				after the State announces the final unofficial vote count (as defined by the
				State) in each precinct in the State, the Election Auditor shall determine and
				then announce the precincts or equivalent locations (or alternative audit units
				used in accordance with the method provided under section 322(b)) in the State
				in which it will administer the audits.</text>
									</paragraph><paragraph id="HE5F35AF46DFA4AF08DFA00BB515735B3"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to votes cast at the precinct
				or equivalent location on or before the date of the election (other than
				provisional ballots described in paragraph (3)), the Election Auditor shall
				administer the hand count of the votes on the voter-verified paper ballots
				required to be produced and preserved under section 301(a)(2)(A) and the
				comparison of the count of the votes on those ballots with the final unofficial
				count of such votes as announced by the State.</text>
									</paragraph><paragraph id="H720674AA66684FE181BB8B8FCF9283E7"><enum>(3)</enum><text display-inline="yes-display-inline">With respect to votes cast other than at
				the precinct on the date of the election (other than votes cast before the date
				of the election described in paragraph (2)) or votes cast by provisional ballot
				on the date of the election which are certified and counted by the State on or
				after the date of the election, including votes cast by absent uniformed
				services voters and overseas voters under the Uniformed and Overseas Citizens
				Absentee Voting Act, the Election Auditor shall administer the hand count of
				the votes on the applicable voter-verified paper ballots required to be
				produced and preserved under section 301(a)(2)(A) and the comparison of the
				count of the votes on those ballots with the final unofficial count of such
				votes as announced by the State.</text>
									</paragraph></subsection><subsection id="H079C0F8092FF44D483176C003C4D82C6"><enum>(b)</enum><header>Use of
				personnel</header><text>In administering the audits, the Election Auditor may
				utilize the services of the personnel of the State or jurisdiction, including
				election administration personnel and poll workers, without regard to whether
				or not the personnel have professional auditing experience.</text>
								</subsection><subsection id="H97821A0CA937418EB2E0C6B9D1B41B3F"><enum>(c)</enum><header>Location</header><text>The
				Election Auditor shall administer an audit of an election—</text>
									<paragraph id="idB22B042840BA4D89B4FB1FEF476019F6"><enum>(1)</enum><text>at the location
				where the ballots cast in the election are stored and counted after the date of
				the election or such other appropriate and secure location agreed upon by the
				Election Auditor and the individual that is responsible under State law for the
				custody of the ballots; and</text>
									</paragraph><paragraph id="idA57430EF0CCE4B1EB1442EE70E9C8D8D"><enum>(2)</enum><text>in the presence
				of the personnel who under State law are responsible for the custody of the
				ballots.</text>
									</paragraph></subsection><subsection id="H83FBAFF9B5A8429D955FA2F146F6FFF"><enum>(d)</enum><header>Special rule in
				case of delay in reporting absentee vote count</header><text>In the case of a
				State in which the final count of absentee and provisional votes is not
				announced until after the expiration of the 7-day period which begins on the
				date of the election, the Election Auditor shall initiate the process described
				in subsection (a) for administering the audit not later than 24 hours after the
				State announces the final unofficial vote count for the votes cast at the
				precinct or equivalent location on or before the date of the election, and
				shall initiate the administration of the audit of the absentee and provisional
				votes pursuant to subsection (a)(3) not later than 24 hours after the State
				announces the final unofficial count of such votes.</text>
								</subsection><subsection id="HB6A43BC20A594CAEBFCC88C5DF92E69"><enum>(e)</enum><header>Additional Audits
				if Cause Shown</header>
									<paragraph id="HD4E13413657D40909BA21BE1E23BB030"><enum>(1)</enum><header>In
				general</header><text>If the Election Auditor finds that any of the hand counts
				administered under this section do not match the final unofficial tally of the
				results of an election, the Election Auditor shall administer hand counts under
				this section of such additional precincts (or equivalent jurisdictions) as the
				Election Auditor considers appropriate to resolve any concerns resulting from
				the audit and ensure the accuracy of the results.</text>
									</paragraph><paragraph id="H761905611D354C3F99E71334FF49C523"><enum>(2)</enum><header>Establishment
				and publication of procedures governing additional audits</header><text display-inline="yes-display-inline">Not later than August 1, 2010, each State
				shall establish and publish procedures for carrying out the additional audits
				under this subsection, including the means by which the State shall resolve any
				concerns resulting from the audit with finality and ensure the accuracy of the
				results.</text>
									</paragraph></subsection><subsection id="H603A5F9DCE9441AEA1DEC2884F43DA31"><enum>(f)</enum><header>Public
				Observation of Audits</header><text display-inline="yes-display-inline">Each
				audit conducted under this section shall be conducted in a manner that allows
				public observation of the entire process.</text>
								</subsection></section><section display-inline="no-display-inline" id="H0B37A8EE009346678DC077C17490A851" section-type="subsequent-section"><enum>324.</enum><header>Selection of
				precincts</header>
								<subsection id="H5535C431B2224FB9A70041F600299527"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">Except as provided in
				subsection (c), the selection of the precincts in the State in which the
				Election Auditor of the State shall administer the hand counts under this
				subtitle shall be made by the Election Auditor on an entirely random basis
				using a uniform distribution in which all precincts in a Congressional district
				have an equal chance of being selected, in accordance with procedures adopted
				by the National Institute of Standards and Technology, except that at least one
				precinct shall be selected at random in each county.</text>
								</subsection><subsection id="H8EFF5C9072EA4C549E02BC00F221F566"><enum>(b)</enum><header>Public
				Selection</header><text>The random selection of precincts under subsection (a)
				shall be conducted in public, at a time and place announced in advance.</text>
								</subsection><subsection id="H7B69C9CDCB324915B0C1E1009B8BC1AE"><enum>(c)</enum><header>Mandatory
				Selection of Precincts Established Specifically for Absentee
				Ballots</header><text display-inline="yes-display-inline">If a State
				establishes a separate precinct for purposes of counting the absentee ballots
				cast in an election and treats all absentee ballots as having been cast in that
				precinct, and if the State does not make absentee ballots sortable by precinct
				and include those ballots in the hand count administered with respect to that
				precinct, the State shall include that precinct among the precincts in the
				State in which the Election Auditor shall administer the hand counts under this
				subtitle.</text>
								</subsection><subsection id="H07CA3655A882437E914BEFC79E1E382C"><enum>(d)</enum><header>Deadline for
				Adoption of Procedures by Commission</header><text>The National Institute of
				Standards and Technology shall adopt the procedures described in subsection (a)
				not later than March 31, 2010, and shall publish them in the Federal Register
				upon adoption.</text>
								</subsection></section><section display-inline="no-display-inline" id="H91B9C55DB34F46B4A6E851888BB68634" section-type="subsequent-section"><enum>325.</enum><header>Publication of
				results</header>
								<subsection id="HA451A2A080284C428874093561962DF9"><enum>(a)</enum><header>Submission to
				Commission</header><text display-inline="yes-display-inline">As soon as
				practicable after the completion of an audit under this subtitle, the Election
				Auditor of a State shall—submit to the Commission the results of the audit, and
				shall include in the submission a comparison of the results of the election in
				the precinct as determined by the Election Auditor under the audit and the
				final unofficial vote count in the precinct as announced by the State and all
				undervotes, overvotes, blank ballots, and spoiled, voided, or cancelled
				ballots, as well as a list of any discrepancies discovered between the initial,
				subsequent, and final hand counts administered by the Election Auditor and such
				final unofficial vote count and any explanation for such discrepancies, broken
				down by the categories of votes described in paragraphs (2) and (3) of section
				323(a).</text>
								</subsection><subsection id="H46EE85F296C4481D8D1717A1D885B6D"><enum>(b)</enum><header>Publication by
				Commission</header><text>Immediately after receiving the submission of the
				results of an audit from the Election Auditor of a State under subsection (a),
				the Commission shall publicly announce and publish the information contained in
				the submission.</text>
								</subsection><subsection id="H8E2D8008074D4B3780A46E28C6B7F70"><enum>(c)</enum><header>Delay in
				certification of results by State</header>
									<paragraph display-inline="no-display-inline" id="HD11EC253FF4047798F7363B52298C393"><enum>(1)</enum><header>Prohibiting
				certification until completion of audits</header><text display-inline="yes-display-inline">No State may certify the results of any
				election which is subject to an audit under this subtitle prior to—</text>
										<subparagraph id="H7E1FC6DCE2D14719ADC264ACB8C6B33B"><enum>(A)</enum><text display-inline="yes-display-inline">to the completion of the audit (and, if
				required, any additional audit conducted under section 323(e)(1)) and the
				announcement and submission of the results of each such audit to the Commission
				for publication of the information required under this section; and</text>
										</subparagraph><subparagraph id="H1D7404B20636405FA34F2202F200AB4F"><enum>(B)</enum><text>the completion of
				any procedure established by the State pursuant to section 323(e)(2) to resolve
				discrepancies and ensure the accuracy of results.</text>
										</subparagraph></paragraph><paragraph id="H149BE8DFC2FB49F8B825E74042B6A6C4"><enum>(2)</enum><header>Deadline for
				completion of audits of Presidential elections</header><text>In the case of an
				election for electors for President and Vice President which is subject to an
				audit under this subtitle, the State shall complete the audits and announce and
				submit the results to the Commission for publication of the information
				required under this section in time for the State to certify the results of the
				election and provide for the final determination of any controversy or contest
				concerning the appointment of such electors prior to the deadline described in
				<external-xref legal-doc="usc" parsable-cite="usc/3/6">section
				6</external-xref> of title 3, United States Code.</text>
									</paragraph></subsection></section><section display-inline="no-display-inline" id="HECC2B75859C84862849000F00468BCAE" section-type="subsequent-section"><enum>326.</enum><header>Payments to
				States</header>
								<subsection id="HAA6EEE9083394CCFA4E0F97100BF93CD"><enum>(a)</enum><header>Payments for
				Costs of Conducting Audits</header><text>In accordance with the requirements
				and procedures of this section, the Commission shall make a payment to a State
				to cover the costs incurred by the State in carrying out this subtitle with
				respect to the elections that are the subject of the audits conducted under
				this subtitle.</text>
								</subsection><subsection id="H3C475D8B56C445EF9F001FAA001FE215"><enum>(b)</enum><header>Certification of
				Compliance and Anticipated Costs</header>
									<paragraph id="H215045A6E3854E2080892D31A37D50A4"><enum>(1)</enum><header>Certification
				required</header><text>In order to receive a payment under this section, a
				State shall submit to the Commission, in such form as the Commission may
				require, a statement containing—</text>
										<subparagraph id="H8FFE51627173412BAAEF57167587D1F2"><enum>(A)</enum><text>a certification
				that the State will conduct the audits required under this subtitle in
				accordance with all of the requirements of this subtitle;</text>
										</subparagraph><subparagraph id="H81A5524D23B64112AD22EF4739993B29"><enum>(B)</enum><text display-inline="yes-display-inline">a notice of the reasonable costs incurred
				or the reasonable costs anticipated to be incurred by the State in carrying out
				this subtitle with respect to the elections involved; and</text>
										</subparagraph><subparagraph id="H52375D671ADF4142AF702E54BE0057A4"><enum>(C)</enum><text>such other
				information and assurances as the Commission may require.</text>
										</subparagraph></paragraph><paragraph id="HFF0AAA255BBD4A218149A6BF40F389C1"><enum>(2)</enum><header>Amount of
				payment</header><text display-inline="yes-display-inline">The amount of a
				payment made to a State under this section shall be equal to the reasonable
				costs incurred or the reasonable costs anticipated to be incurred by the State
				in carrying out this subtitle with respect to the elections involved, as set
				forth in the statement submitted under paragraph (1).</text>
									</paragraph><paragraph id="H33E17F6C63F648359DA600A19EB3BDA"><enum>(3)</enum><header>Timing of
				notice</header><text>The State may not submit a notice under paragraph (1)
				until candidates have been selected to appear on the ballot for all of the
				elections for Federal office which will be the subject of the audits
				involved.</text>
									</paragraph></subsection><subsection id="HB59D4D9FCAF949A100DA40EBDAFE00CE"><enum>(c)</enum><header>Timing of
				Payments</header><text>The Commission shall make the payment required under
				this section to a State not later than 30 days after receiving the notice
				submitted by the State under subsection (b).</text>
								</subsection><subsection id="H17BCA0387B9B46E0A6ACEE82DC55898"><enum>(d)</enum><header>Recoupment of
				Overpayments</header><text>No payment may be made to a State under this section
				unless the State agrees to repay to the Commission the excess (if any)
				of—</text>
									<paragraph id="HF95AB01CBF664D64B852337E4D46DCB4"><enum>(1)</enum><text>the amount of the
				payment received by the State under this section with respect to the elections
				involved; over</text>
									</paragraph><paragraph id="HB49BD69F15F646DAA54DE2BA246CD859"><enum>(2)</enum><text>the actual costs
				incurred by the State in carrying out this subtitle with respect to the
				elections involved.</text>
									</paragraph></subsection><subsection id="H38AF3CF787754F9D943739E5722E3CF3"><enum>(e)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated to the
				Commission for fiscal year 2010 and each succeeding fiscal year $100,000,000
				for payments under this section.</text>
								</subsection></section><section display-inline="no-display-inline" id="H1D0620EC7E4A412EB1289C1500255D79" section-type="subsequent-section"><enum>327.</enum><header>Exception for
				elections subject to recount under State law prior to certification</header>
								<subsection id="H2AE80C8D97EB4430911627462C822363"><enum>(a)</enum><header>Exception</header><text display-inline="yes-display-inline">This subtitle does not apply to any
				election for which a recount under State law will commence prior to the
				certification of the results of the election, including but not limited to a
				recount required automatically because of the margin of victory between the 2
				candidates receiving the largest number of votes in the election, but only if
				each of the following applies to the recount:</text>
									<paragraph id="HE1D219067064420000C34CF14B39F00"><enum>(1)</enum><text>The recount
				commences prior to the determination and announcement by the Election Auditor
				under section 323(a)(1) of the precincts in the State in which it will
				administer the audits under this subtitle.</text>
									</paragraph><paragraph id="HDF85D3B5ACDF46E900A9BCDC1CBAD081"><enum>(2)</enum><text>If the recount
				would apply to fewer than 100 percent of the ballots cast in the
				election—</text>
										<subparagraph id="H24721ECDD21D43D191AD04A331313C99"><enum>(A)</enum><text>the number of
				ballots counted will be at least as many as would be counted if an audit were
				conducted with respect to the election in accordance with this subtitle;
				and</text>
										</subparagraph><subparagraph id="H5016BE4452F94A5188260031CF5211AA"><enum>(B)</enum><text>the selection of
				the precincts in which the recount will be conducted will be made in accordance
				with the random selection procedures applicable under section 324.</text>
										</subparagraph></paragraph><paragraph id="H4E1A20731EA8422BBC82C18C2B97C9C"><enum>(3)</enum><text>The recount for the
				election meets the requirements of section 323(f) (relating to public
				observation).</text>
									</paragraph><paragraph id="H262F93791F3C4DB3BD639905DD87F8F1"><enum>(4)</enum><text>The State meets
				the requirements of section 325 (relating to the publication of results and the
				delay in the certification of results) with respect to the recount.</text>
									</paragraph></subsection><subsection id="H2FE498490B11490799C95DA52D36F9F"><enum>(b)</enum><header>Clarification of
				Effect on Other Requirements</header><text>Nothing in this section may be
				construed to waive the application of any other provision of this Act to any
				election (including the requirement set forth in section 301(a)(2) that the
				voter verified paper ballots serve as the vote of record and shall be counted
				by hand in all audits and recounts, including audits and recounts described in
				this subtitle).</text>
								</subsection></section><section display-inline="no-display-inline" id="H0982EF034D21421185DD0075D1577B24" section-type="subsequent-section"><enum>328.</enum><header>Effective
				date</header><text display-inline="no-display-inline">This subtitle shall apply
				with respect to elections for Federal office beginning with the regularly
				scheduled general elections held in November
				2010.</text>
							</section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD47454B400A641438C72009BF4008551"><enum>(b)</enum><header>Availability of
			 Enforcement Under Help America Vote Act of 2002</header><text display-inline="yes-display-inline">Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>),
			 as amended by this Act, is amended—</text>
					<paragraph id="H67C5334A87FA4A5B9100399ED7C49050"><enum>(1)</enum><text>in subsection (a),

			 Practices for Alternative Audit Mechanisms</header>
					<paragraph id="H3044623ED2B54758811509B4090665C9"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than May 1,
			 2010, the Director of the National Institute for Standards and Technology shall
			 establish guidance for States that wish to establish alternative audit
			 mechanisms under section 322(b) of the Help America Vote Act of 2002 (as added
			 by subsection (a)). Such guidance shall be based upon scientifically and
			 statistically reasonable assumptions for the purpose of creating an alternative
			 audit mechanism that will be at least as effective in ensuring the accuracy of
			 election results and as transparent as the procedure under subtitle C of title
			 III of such Act (as so added).</text>
					</paragraph><paragraph id="H0031D314D6B7420AB7E5EEEC07F53452"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out paragraph (1) $100,000, to remain available until expended.</text>

			 general</header><text>A State receiving a grant under this section shall use
			 the grant only for costs associated with establishing a pre-registration
			 program.</text>

			 grant under this section may not be used for any costs incurred prior to the
			 date of the enactment of this Act.</text>
					</paragraph></subsection><subsection id="id799AEBA99D6F4EEA88C9DCA62781796F"><enum>(d)</enum><header>Eligible
			 State</header><text>For purposes of this section, the term <term>eligible
			 State</term> means any State that—</text>
					<paragraph id="id0CB1AF6354B948C9BA6233537E6A5534"><enum>(1)</enum><text>submits an
			 application to the Election Assistance Commission at such time and containing
			 such information as the Commission may specify, and</text>
					</paragraph><paragraph id="idB0EDF69E42E040C98E0088EAF561F3EF"><enum>(2)</enum><text>agrees to
			 implement a pre-registration program.</text>
					</paragraph></subsection><subsection id="idC5E846801CFB4ACC894277829C493F27"><enum>(e)</enum><header>Pre-registration
			 program</header><text>For purposes of this section:</text>
					<paragraph id="id2CB8075FE7474926B34580A4E67CB011"><enum>(1)</enum><header>In
			 general</header><text>The term <term>pre-registration program</term> means a
			 program under which the State pre-registers for voting purposes individuals
			 who—</text>
						<subparagraph id="idC13DC98C29C743CA83794DACA9F8BCEE"><enum>(A)</enum><text>have—</text>
							<clause id="id4C95066AC1E44831911A6BA37F7B73AB"><enum>(i)</enum><text>not
			 attained the age of 18, but</text>
							</clause><clause id="id21F79FCF889940AA98E99B7F4B3D0673"><enum>(ii)</enum><text>either—</text>
								<subclause id="id0876A111D3394575B93B9421165ED84F"><enum>(I)</enum><text>attained the age
			 of 16, or</text>
								</subclause><subclause id="id51548033C6AF455CAC323D8E975ACEF9"><enum>(II)</enum><text>received a valid
			 driver's license under the laws of the State, and</text>
								</subclause></clause></subparagraph><subparagraph id="id0C220F94B3CD42B6B1B6E29DB43CDEE5"><enum>(B)</enum><text>are otherwise
			 eligible to vote in such State.</text>
						</subparagraph></paragraph><paragraph id="idAD5258F1DAE849BEA0995A530535515B"><enum>(2)</enum><header>Effect of
			 pre-registration on right to vote</header><text>A voter pre-registration
			 program shall permit any individual who is pre-registered under such program to
			 vote in any election for which such individual is otherwise eligible to vote
			 which occurs on or after such individual's 18th birthday.</text>
					</paragraph></subsection><subsection id="idFD4DF549902645AE8A3FA17E70A4C3E2"><enum>(f)</enum><header>Authorization
			 of appropriations</header>
					<paragraph id="idF9F3CE248595464A9992C54DDA9A8300"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated for grants under
			 this section such sums as may be necessary for fiscal years 2009 through
			 2011.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id876AA3421FBD4065AD8BC2357FAF245F"><enum>(2)</enum><header>Availability</header><text>Any
			 amount appropriated pursuant to the authority under subsection (a) shall remain
			 available without fiscal year limitation until expended.</text>
					</paragraph></subsection></section><section id="idD5AB0428D8E140E3BB5ED75C7CB9060F"><enum>502.</enum><header>Grants for
			 automatic re-registration of voters changing residence</header>
				<subsection id="idDB8C03FBE08747B796F8F6553C729DE0"><enum>(a)</enum><header>In
			 general</header><text>Not later than 270 days after the date of the enactment
			 of this Act, the Election Assistance Commission shall establish an automatic
			 re-registration grant program under which the Commission shall make grants to
			 eligible States.</text>
				</subsection><subsection id="idD037E0E860B54592AE4B62B0D170EDBF"><enum>(b)</enum><header>Amount of
			 grant</header>
					<paragraph id="id21D502E9D409458CA0905A800E761FE4"><enum>(1)</enum><header>In
			 general</header><text>The amount of a grant under this section to any eligible
			 State shall be $500,000.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBA0D23AB9CDD4D4EB717222929E21C2B"><enum>(2)</enum><header display-inline="yes-display-inline">Awarding of implementation grants</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1F8FBBE90F604E43A74809926A503D1B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Election Assistance Commission shall
			 award automatic re-registration implementation grants during each year in which
			 the program is conducted.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9D0EF028A6A4135B5524F997D48A35C"><enum>(B)</enum><header display-inline="yes-display-inline">One grant per State</header><text display-inline="yes-display-inline">The Election Assistance Commission shall
			 not award more than 1 implementation grant to any eligible State under this
			 section over the duration of the program.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4FFD38FB32E47F0911A06E9D73E22F6"><enum>(3)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">The program shall be conducted for a period
			 of 3 years.</text>
					</paragraph></subsection><subsection id="idE0F5E8F23B124F2395A288F4C00D7028"><enum>(c)</enum><header>Use of
			 funds</header>
					<paragraph id="id3FBB1FE6000941619747A37CDFA6FA51"><enum>(1)</enum><header>In
			 general</header><text>A State receiving a grant under this section shall use
			 the grant only for costs associated with establishing an automatic
			 re-registration program.</text>
					</paragraph><paragraph id="id864599E569F140C082CC1E9F0D7766D0"><enum>(2)</enum><header>Limitation</header><text>A
			 grant under this section may not be used for any costs incurred prior to the
			 date of the enactment of this Act.</text>
					</paragraph></subsection><subsection id="idBC745A8D8E6D458EB2CEE74D378A5659"><enum>(d)</enum><header>Eligible
			 State</header><text>For purposes of this section, the term <term>eligible
			 State</term> means any State that—</text>
					<paragraph id="idE815EA27F01C4DCBA9A14878A06F64CA"><enum>(1)</enum><text>submits an
			 application to the Election Assistance Commission at such time and containing
			 such information as the Commission may specify,</text>
					</paragraph><paragraph id="id1ACAB0BEB6574B5AB0C1BF99B5025C89"><enum>(2)</enum><text>agrees to
			 implement an automatic re-registration program, and</text>
					</paragraph><paragraph id="idB93DE26C807D4A72A30665DC0629BBF8"><enum>(3)</enum><text>certifies that
			 any automatic re-registration program has been tested and shown to accurately
			 update voters' registration status.</text>
					</paragraph></subsection><subsection id="idA5847401712F4FA1A1613BD74386A7CB"><enum>(e)</enum><header>Automatic
			 re-registration program</header><text>For purposes of this section:</text>
					<paragraph id="idD9AC4505CC384D2DB05C7F4C814D86CE"><enum>(1)</enum><header>In
			 general</header><text>The term <term>automatic re-registration program</term>
			 means a program under which, on a monthly basis, the State—</text>
						<subparagraph id="id36AB140B92DD491D88A23E4EEB13F4D4"><enum>(A)</enum><text>obtains permanent
			 change of address information from the Postal Service through its licensees
			 with respect to individuals moving to, from, or within such State, and</text>
						</subparagraph><subparagraph id="id2CD8C49FCC5A4C5BA0EB941698D98429"><enum>(B)</enum><text>automatically
			 registers for voting purposes specified individuals residing in such State at
			 the specified individual's current permanent address.</text>
						</subparagraph></paragraph><paragraph id="idCBB1B8EAE35042B683452DDD911D07CC"><enum>(2)</enum><header>Specified
			 individual</header><text>The term <term>specified individual</term> means, with
			 respect to any State, any individual—</text>
						<subparagraph id="id47C2C859588847EE837A091714976BBD"><enum>(A)</enum><text>with respect to
			 whom the State has obtained permanent change of address information from the
			 Postal service through its licensees, and</text>
						</subparagraph><subparagraph id="idF99D0B21494141768FF1C2C647F302C3"><enum>(B)</enum><text>who is registered
			 to vote in such State before the change of permanent address.</text>
						</subparagraph></paragraph><paragraph commented="no" id="idBD07678836594166840CEC208BE14514"><enum>(3)</enum><header>Exception to
			 National Voter Registration Act of 1993 to enable automatic
			 registration</header><text>Paragraph (1) of section 8(d) of the National Voter
			 Registration Act of 1993 (42 U.S.C. 1973gg–6(d)) is amended by adding at the
			 end the following flush sentence:</text>
						<quoted-block display-inline="no-display-inline" id="idA792D4AD0BCE4983A639AC1C041CE2E8" style="OLC">
							<quoted-block-continuation-text commented="no" quoted-block-continuation-text-level="paragraph">Subparagraph (B)(ii) shall not apply
				with respect to any removal carried out under an automatic re-registration
				program described in section 501(e) of the <short-title>Voting Opportunities and Integrity in the Conduct of
				Elections Act of
				2008</short-title>.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id62A64CA954A8480EABCC741F3A019E57"><enum>(4)</enum><header>Compliance with
			 voter removal standards</header><text>Except as otherwise provided by law, any
			 automatic re-registration program shall meet the requirements for removing
			 registrants from the official list of eligible voters under section 8 of the
			 National Voter Registration Act of 1993 (42 U.S.C. 1973gg–6).</text>
					</paragraph></subsection><subsection id="idDBFC24C8D85B40D7B3D59B9F999E0C1E"><enum>(f)</enum><header>Authorization
			 of appropriations</header>
					<paragraph id="id6F215031C1FC4959A1428D9C53E99B54"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated for grants under
			 this section such sums as may be necessary for fiscal years 2009 through
			 2011.</text>
					</paragraph><paragraph id="idAF3076AFC3AC4A2696AC3DBB77D95643"><enum>(2)</enum><header>Availability</header><text>Any
			 amount appropriated pursuant to the authority under subsection (a) shall remain
			 available without fiscal year limitation until expended.</text>
					</paragraph></subsection></section><section id="ID5054D454E1E141868C39A2AABDE99C61"><enum>503.</enum><header>Interoperability
			 of voter registration databases</header>
				<subsection id="id352431E55241472FA35941A1360D90D4"><enum>(a)</enum><header>Interoperability</header>
					<paragraph id="id8281F57DA5144D30B410D8240DA2E2CB"><enum>(1)</enum><header>Uniform
			 template and data transfer technology</header><text>Subtitle C of title II of
			 the Help America Vote Act of 2002 (42 U.S.C. 15381 et seq.), as amended by this
			 Act, is amended by redesignating section 248 as section 249 and by inserting
			 after section 248 the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="idECEE82BA28BD4E0CAC9E1DDFA4AC8952" style="OLC">
							<section id="idE9312CD6EC934E83A6EC621C517507BB"><enum>249.</enum><header>Development of
				uniform template and provision of technology to ensure interoperability of
				voter registration databases</header>
								<subsection id="id01E7C9DAD75D48A8BEEAB2F90844B4F4"><enum>(a)</enum><header>Uniform
				template</header>
									<paragraph id="id9C33EF3495AE4BC79F941385112B4B41"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall
				develop a uniform template for the maintenance and exchange of voter
				registration information contained in the computerized statewide voter
				registration list of participating States.</text>
									</paragraph><paragraph id="id74763A6B6DC34229981A41FAA989BCFA"><enum>(2)</enum><header>Data
				fields</header><text display-inline="yes-display-inline">Such template shall
				include data fields for the following information:</text>
										<subparagraph id="id8653B24926334C1486CDD8320BEA61DE"><enum>(A)</enum><text display-inline="yes-display-inline">Full legal name.</text>
										</subparagraph><subparagraph id="idC4D17507CFBC47EBA5F4EDF0F78D5D3B"><enum>(B)</enum><text display-inline="yes-display-inline">Date of birth.</text>
										</subparagraph><subparagraph id="id65B99196658949B3852E6FD07D05EDBC"><enum>(C)</enum><text display-inline="yes-display-inline">Digital signature image.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id101FB0B20E9843F28EA3AD5D485059DD"><enum>(D)</enum><text display-inline="yes-display-inline">Social Security number.</text>
										</subparagraph></paragraph></subsection><subsection id="id21C4E8020F2848A5A41F4195E6C12356"><enum>(b)</enum><header>Interoperable
				voter registration databases</header>
									<paragraph id="idD04EACB3A0C247A399F3097171273D7C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall
				establish a computerized system that is capable of communicating and exchanging
				data among participating States in an accurate, effective, and consistent
				manner.</text>
									</paragraph><paragraph id="id29EB81B97F6440D58AEF5F192337FDEF"><enum>(2)</enum><header>Provision to
				States</header><text display-inline="yes-display-inline">The Commission shall
				provide access to the system to participating States for the purpose of
				transferring and exchanging voter registration data.</text>
									</paragraph><paragraph id="id9FFA90EE7340498BA6A88A0A9C3E2B7A"><enum>(3)</enum><header>Participating
				State defined</header><text display-inline="yes-display-inline">In this
				subsection, the term <term>participating State</term> means a State that meets
				the interoperability requirements of section 298A(b).</text>
									</paragraph></subsection><subsection id="idA7311965B2C84C978644CE55DF4EEDFD"><enum>(c)</enum><header>Consultation
				with the Commissioner of Social Security on safeguards</header><text>The
				Commission shall consult with the Commissioner of Social Security for the
				purpose of providing procedures for safeguarding Social Security numbers under
				the computerized system established under subsection
				(b).</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id851A4F95632E43C886C8C949FF12685C"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act, as amended by this
			 Act, is amended by inserting after the item relating to section 248 the

									<subsection id="idF3212A92776F4040AF79FDDE3ADDAF3E"><enum>(a)</enum><header>In
				general</header>
										<paragraph id="id4B3B56B121EA4F4099D46D718F6DBFD3"><enum>(1)</enum><header>Interoperability
				requirements payments</header><text display-inline="yes-display-inline">The
				Commission shall make an interoperability requirements payment each year to
				participating States.</text>
										</paragraph><paragraph id="id8F100059BDCD40AFA48538D3AD9F9473"><enum>(2)</enum><header>Participating
				State defined</header><text display-inline="yes-display-inline">In this part,
				the term <term>participating State</term> means a State that meets the
				interoperability requirements of section 298A(b).</text>
										</paragraph></subsection><subsection id="ID8ec6771fa61846ed8e61d841b1476f75"><enum>(b)</enum><header>Use of
				funds</header><text>A State receiving an interoperability requirements payment
				shall use the payment only to meet the requirements of section 298A(b).</text>
									</subsection><subsection id="ID1bef72ffbac34649945273e2d55d8962"><enum>(c)</enum><header>Schedule of
				payments</header><text>As soon as practicable after the date of enactment of
				this subtitle, and not less frequently than once each calendar year thereafter,
				the Commission shall make interoperability requirements payments to States
				under this part.</text>
									</subsection></section><section id="ID2dbdd6f8f9224193ad36a25688f0d7b5"><enum>298A.</enum><header>Condition for
				receipt of funds</header>
									<subsection id="IDbda7abff99d342b19f6cda7d0bb777f6"><enum>(a)</enum><header>In
				general</header><text>A State is eligible to receive an interoperability
				requirements payment for a fiscal year if the chief executive officer of the
				State, or designee, in consultation and coordination with the chief State
				election official, has filed with the Commission a statement certifying that
				the State is in compliance with the requirements of subsection (b).</text>
									</subsection><subsection id="idE9C16CB632084284A50D520DEA46F357"><enum>(b)</enum><header>Interoperability
				requirements</header><text display-inline="yes-display-inline">The
				interoperability requirements of this subsection are as follows:</text>
										<paragraph id="id2D9548EB82654D67BC816EA2B911E831"><enum>(1)</enum><header>Unique
				identifier</header><text display-inline="yes-display-inline">The State shall
				use the Social Security number of each legally registered voter in the State as
				the unique identifier required under section 303(a)(1)(A).</text>
										</paragraph><paragraph id="id26D82910F4DA40DDA3E4E6AE1D99C293"><enum>(2)</enum><header>Uniform
				template</header><text display-inline="yes-display-inline">The State shall use
				the uniform template developed under section 249(a) for voter information
				maintained in the computerized statewide voter registration list of the State
				under section 303(a).</text>
										</paragraph><paragraph id="id1FB00290EA5B47E68C43C08507732B8E"><enum>(3)</enum><header>Interoperable
				voter registration databases</header><text display-inline="yes-display-inline">The State shall—</text>
											<subparagraph id="idAB41101488F245E8909EB254FDD24E4A"><enum>(A)</enum><text display-inline="yes-display-inline">maintain the computerized statewide voter
				registration list under section 303(a) in a format that is compatible with the
				computerized system established by the Commission under section 249(b);
				and</text>
											</subparagraph><subparagraph id="id6165D889E9194DACB1EAC7D8E503FF8C"><enum>(B)</enum><text>provide voter
				registration information, upon request, to other participating States through
				the computerized system established under section 249(b).</text>
											</subparagraph></paragraph><paragraph id="idA6DC0559C2924EA791F9E5D35A5082F5"><enum>(4)</enum><header>Electronic poll
				books</header><text>The State shall establish an electronic system through
				which local election officials can identify the appropriate location for
				registered voters to vote on the day of an election.</text>
										</paragraph></subsection></section><section id="idF44686823C8E4F3E9B13F123B67E3689"><enum>298B.</enum><header>Authorization
				of appropriations</header>
									<subsection id="id0D0BAA11FF0841B9A36C8995A93B2F77"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">There are authorized
				to be appropriated for interoperability requirements payments under this part
				such sums as may be necessary.</text>
									</subsection><subsection id="id3FB485285DB142CF97DC0E49722A1C49"><enum>(b)</enum><header>Availability</header><text display-inline="yes-display-inline">Any amounts appropriated pursuant to the
				authority of subsection (a) shall remain available without fiscal year

						<subparagraph id="idD7B382674B48486F9B23136C9F6EB671" indent="up2"><enum>(I)</enum><clause commented="no" display-inline="yes-display-inline" id="idBFAC7188C3324FFFB0D6F3E20359AF62"><enum>(i)</enum><text>It is the policy of the
				United States that any State (or any political subdivision of a State) may
				utilize the Social Security account numbers issued by the Commissioner of
				Social Security for the administration of any voter registration law.</text>
							</clause><clause id="id7FF26BAFF6E84340B6ADA0189801DA96" indent="up1"><enum>(ii)</enum><text>An agency of a State (or political
				subdivision thereof) charged with the administration of any voter registration
				law which did not use Social Security account numbers for identification under
				a law or regulation adopted before the date of the enactment of this
				subparagraph may require an individual to disclose his or her Social Security
				number to such agency solely for the purpose of administering such law.</text>
							</clause><clause id="id1B9793723959411EBDE0FD239D40794E" indent="up1"><enum>(iii)</enum><text>Any agency of a State (or any
				political subdivision thereof) which utilizes Social Security account numbers
				in the administration of voter registration laws in accordance with clause (i)
				shall provide such safeguards as the Commissioner of Social Security determines
				to be necessary or appropriate to protect the confidentiality of such Social
				Security account numbers.</text>
							</clause><clause id="idB61C77E103FF468693AD87F0A77D4D19" indent="up1"><enum>(iv)</enum><text>To the extent that any provision of
				Federal law enacted before the date of the enactment of this subparagraph is
				inconsistent with the policy set forth in clause (i), such provision shall, on
				and after that date, be null, void, and of no
				effect.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HD318107EE05F40068800FDE0E900F1BF"><enum>504.</enum><header>Clarification
			 of standards for determining matching of information provided with
			 applications</header>
				<subsection id="H599F3710979644569C25C2C3B7D1BA9E"><enum>(a)</enum><header>State
			 requirements for determination of validity of numbers
			 provided</header><text>Section 303(a)(5)(A)(iii) of the Help America Vote Act
			 of 2002 (42 U.S.C. 15483(a)(5)(A)(iii)) is amended by striking the period at
			 the end and inserting the following: <quote>, except that the information
			 provided by an individual shall be sufficient to meet the requirements of this
			 subparagraph if, based on the information provided, the State is able to
			 determine the individual’s motor vehicle driver’s number or other personal
			 identification document number or the last four digits of the individual’s
			 Social Security number, or is able to locate one of those numbers in another
			 State record.</quote>.</text>
				</subsection><subsection id="H9C49BA9D847940FB8FEBA953EE1FAC"><enum>(b)</enum><header>Standards for
			 determination of match of Social Security numbers</header>
					<paragraph id="H2801DAAF7C6E47B8BF8F6649B3E653D1"><enum>(1)</enum><header>Requirements for
			 States</header><text>Section 303(a)(5)(B) of such Act (42 U.S.C.
			 15483(a)(5)(B)) is amended by adding at the end the following new
			 clause:</text>
						<quoted-block display-inline="no-display-inline" id="HA53B284E3A6E4E4BAA61E9269E9553DD" style="OLC">
							<clause id="H0E0DBDFE2D064EA4B7B5EADF25CAAA42"><enum>(iii)</enum><header>Matching
				standards</header><text display-inline="yes-display-inline">Information
				provided by an applicant for voter registration shall be deemed to be validly
				matched with information maintained by the Commissioner of Social Security or
				with information in the database of the State motor vehicle authority for
				purposes of this subparagraph if it may be reasonably concluded that the
				applicant is substantially likely to be the same individual as an individual
				reflected in the database of the Social Security
				Administration.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H3CD2DCFF8AB14F8693E3ED802B669374"><enum>(2)</enum><header>Procedures of
			 Commissioner of Social Security</header><text>Section 205(r)(8) of the Social
			 Security Act (42 U.S.C. 405(r)(8)), as added by section 303(a)(5)(C) of the
			 Help America Vote Act of 2002, is amended by adding at the end the following
			 new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HF620466F94DE46AFB84D75BB05E44CA5" style="OLC">
							<subparagraph id="H25288B3F8A04452AAC9C9C027EC56C24"><enum>(G)</enum><text display-inline="yes-display-inline">The Commissioner shall develop procedures
				consistent with the matching standard established under section
				303(a)(5)(B)(iii) of the Help America Vote Act of 2002 to improve the accuracy
				of the matching process under the agreements under this paragraph, including
				procedures to account for typographical errors and common variations in
				recording data. Such procedures shall be uniform, nondiscriminatory, and open
				to public
				scrutiny.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id3E354A348B94470E908E0E317B7C0443"><enum>(c)</enum><header>State</header><text>For
			 purposes of this section, the term <term>State</term> includes the District of
			 Columbia and any possession of the United States.</text>
				</subsection></section></title><title id="id9C203A83F3DD412380F8B89D3AE8CE27"><enum>VI</enum><header>Voter
			 caging</header>
			<section id="id82C27997924A4DA29402E812C056CB66"><enum>601.</enum><header>Prohibition on
			 voter caging</header>
				<subsection id="id2BBC769901084EE1A65B9C0725C541CD"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="IDa5380764e9284b1f90f2b821c104283d"><enum>(1)</enum><header>Voter caging
			 document</header><text>The term <term>voter caging document</term>
			 means—</text>
						<subparagraph id="ID29d05d9d355a496ea6ac943f9b04cc68"><enum>(A)</enum><text>any
			 nonforwardable document that is sent to an individual at the address at which
			 such individual is registered or seeking to become registered as a voter in a
			 Federal election and that is returned to the sender or to a third party as
			 undelivered or undeliverable; and</text>
						</subparagraph><subparagraph id="ID310240e1328e48679faa59790b95feb1"><enum>(B)</enum><text>any document
			 (other than a notice described in section 8(d) of the National Voter
			 Registration Act of 1993) that is sent to an individual at the address at which
			 such individual is registered as a voter in a Federal election and that
			 contains instructions to return the document to the sender or a third party but
			 is not so returned.</text>
						</subparagraph></paragraph><paragraph id="ID5a7971861c9c46aeacf2a46e8ea7dc57"><enum>(2)</enum><header>Voter caging
			 list</header><text>The term <term>voter caging list</term> means any list of
			 individuals compiled from voter caging documents.</text>
					</paragraph><paragraph id="ID127cabb0163f4c409433a1301b9041cf"><enum>(3)</enum><header>Unverified list
			 match</header><text>The term <term>unverified list match</term> means a list
			 produced by matching—</text>
						<subparagraph id="id2E7AED78D3AC4699A6459F29B07B6E23"><enum>(A)</enum><text>the identity of
			 registered voters or applicants for voter registration, with</text>
						</subparagraph><subparagraph id="idE978AD36E26545E38A44343D65C9B846"><enum>(B)</enum><text>the identity of
			 individuals who are ineligible to vote in the registrar’s jurisdiction, by
			 virtue of death, conviction, change of address, mental impairment, or
			 otherwise;</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">unless the
			 information establishing the identity of the individual under both
			 subparagraphs (A) and (B) contains a signature, photograph, or unique
			 identifying number verifying the identity of the individual.</continuation-text></paragraph></subsection><subsection id="ID89e62752657340f09c68e9869301cde5"><enum>(b)</enum><header>Conduct by
			 election officials prohibited</header><text>No State or local election official
			 shall prevent an individual from registering or voting in any election for
			 Federal office, or permit in connection with any election for Federal office a
			 formal challenge under State law to an individual’s registration status or
			 eligibility to vote, if the sole basis for such decision or challenge is
			 evidence consisting of—</text>
					<paragraph id="IDa62ff206d90840c3bd12266b8d3b6aaf"><enum>(1)</enum><text>a voter caging
			 document or voter caging list;</text>
					</paragraph><paragraph id="ID4e70d7f373124d87b3425b41023a7dfb"><enum>(2)</enum><text>an unverified
			 match list; or</text>
					</paragraph><paragraph id="IDcedfd21f2c0d4175b9550a9f0b745e20"><enum>(3)</enum><text>notwithstanding
			 section 209 of the Help America Vote Act of 2002 (42 U.S.C. 15329), any other
			 evidence so designated for the purposes of this section by the Election
			 Assistance Commission.</text>
					</paragraph></subsection><subsection id="ID6a3791354e3e4bab8d8af2a2bdbf0262"><enum>(c)</enum><header>Requirements
			 for challenges by persons other than election officials</header>
					<paragraph id="id09DA665D80A34BB690C37C3A2439B15D"><enum>(1)</enum><header>Attestation of
			 first-hand knowledge of ineligibility</header><text>No person, other than a
			 State or local election official, shall submit a formal challenge to an
			 individual’s eligibility to register to vote in an election for Federal office
			 or to vote in an election for Federal office unless the challenge—</text>
						<subparagraph id="id2F44AF08B3C149BAB3F934DA4627969D"><enum>(A)</enum><text>sets forth in
			 writing the specific grounds for the ineligibility of the individual who is the
			 subject of the challenge; and</text>
						</subparagraph><subparagraph id="IDfcd300f58ef0406c8ad0cf085060e892"><enum>(B)</enum><text>is subject to an
			 oath or attestation under penalty of perjury that such individual is ineligible
			 to register to vote or to vote in that election.</text>
						</subparagraph></paragraph><paragraph id="ID5916e967a3664173be5075f24f8ed7cc"><enum>(2)</enum><header>Prohibiting
			 challenges based on certain evidence</header><text>No person shall submit a
			 formal challenge to an individual’s eligibility to register to vote in an
			 election for Federal office or to vote in an election for Federal office if the
			 sole basis for such challenge is evidence consisting of—</text>
						<subparagraph id="ID3db4440cc3834ed78f2e3406b5df83d7"><enum>(A)</enum><text>a voter caging
			 document or voter caging list;</text>
						</subparagraph><subparagraph id="ID3926e0b5e39d4a1eb285b16a538f0f2b"><enum>(B)</enum><text>an unverified
			 match list; or</text>
						</subparagraph><subparagraph id="ID4e74a1f10bd048c8ac121fbaef85b0bc"><enum>(C)</enum><text>notwithstanding
			 section 209 of the Help America Vote Act of 2002 (42 U.S.C. 15329), any other
			 evidence so designated for the purposes of this section by the Election
			 Assistance Commission.</text>
						</subparagraph></paragraph><paragraph id="IDeeac1365796549e199ded7bd02b6db44"><enum>(3)</enum><header>Penalties for
			 knowing misconduct</header><text>Whoever knowingly challenges the eligibility
			 of any individual to register or vote or knowingly causes the eligibility of
			 such individuals to be challenged in violation of paragraph (1) or (2) with the
			 intent that one or more such individuals be disqualified from voting, shall be
			 fined not more than $50,000 for each such violation.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID954388a2f8a649fe8330234bd951678a"><enum>(d)</enum><header>No effect on
			 National Voter Registration Act of 1993</header><text>Nothing in this section
			 shall be construed to override the protections of the National Voter
			 Registration Act of 1993 (42 U.S.C. 1973gg et seq.).</text>
