					<section commented="no" display-inline="no-display-inline" id="IDa2facf2cccc94d67881d4c1a4c10ead1" section-type="subsequent-section"><enum>701.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idBDDBF739A6D14D95A97F39B3D27DFEF4"><enum>(1)</enum><text display-inline="yes-display-inline">global warming poses a significant threat
				to the national security and economy of the United States, public health and
				welfare, and the global environment;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDba946ac658b44cdebece5e035c8ded66"><enum>(2)</enum><text display-inline="yes-display-inline">due largely to an increased use of energy
				from fossil fuels, human activities are primarily responsible for the release
				of carbon dioxide and other heat-trapping global warming pollutants that are
				accumulating in the atmosphere and causing surface air and subsurface ocean
				temperatures to rise;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID751030f0c4ea45cdbd1c692c9562ca54"><enum>(3)</enum><text display-inline="yes-display-inline">as of the date of enactment of this title,
				atmospheric concentrations of carbon dioxide are 35 percent higher than those
				concentrations were 150 years ago, at 378 parts per million compared to 280
				parts per million;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5cd9a795cd064f40a12c2d1e7668ca56"><enum>(4)</enum><text display-inline="yes-display-inline">the United States emits more global warming
				pollutants than any other country, and United States carbon dioxide emissions
				have increased by an average of 1.3 percent annually since 1990;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID045e558d50b0437c96927527f806fe93"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC507C669D2034FA4AA3E61754CCD822E"><enum>(A)</enum><text display-inline="yes-display-inline">during the past 100 years, global
				temperatures have risen by 1.44 degrees Fahrenheit; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6D4C20CFA1EF4BBDB19338DB84282923" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">from 1970 to the present, those
				temperatures have risen by almost 1 degree Fahrenheit;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7CB48F72AE6F40BB83266764E8B53B3B"><enum>(6)</enum><text display-inline="yes-display-inline">8 years during the 10-year period beginning
				January 1, 1996, and ending December 31, 2005, were among the 10 warmest years
				on record;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEAE94F24F2E5402BB7B7094A05BA90D6"><enum>(7)</enum><text display-inline="yes-display-inline">average temperatures in the Arctic have
				increased by 4 to 7 degrees Fahrenheit during the past 50 years;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd8fda545351042dd996ad79481ed0f32"><enum>(8)</enum><text display-inline="yes-display-inline">global warming has caused—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDa7dccc39f7cb4b8a89d52b207bc8523d"><enum>(A)</enum><text display-inline="yes-display-inline">ocean temperatures to increase, resulting
				in rising sea levels, extensive bleaching of coral reefs worldwide, and an
				increase in the intensity of tropical storms;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc2443628aa6e4addb2c9651dd6fae211"><enum>(B)</enum><text display-inline="yes-display-inline">the retreat of Arctic sea ice by an average
				of 9 percent per decade since 1978;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID637e5a4d93494d27ae1289707d73cd47"><enum>(C)</enum><text display-inline="yes-display-inline">the widespread thawing of permafrost in
				polar, subpolar, and mountainous regions;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1ac76f2bce974c9fae7c1eb38a27a65b"><enum>(D)</enum><text display-inline="yes-display-inline">the redistribution and loss of species;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfbaa679946cd4317ad5072bd5779e1f7"><enum>(E)</enum><text display-inline="yes-display-inline">the rapid shrinking of glaciers;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID669cb5201d6a47cb8160c50304673fb1"><enum>(9)</enum><text display-inline="yes-display-inline">the United States must adopt a
				comprehensive and effective national program of mandatory limits and incentives
				to reduce global warming pollution emissions into the atmosphere;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6d301248500b4cedad828a13243ff002"><enum>(10)</enum><text display-inline="yes-display-inline">at the current rate of emission, global
				warming pollution concentrations in the atmosphere could reach more than 600
				parts per million in carbon dioxide equivalent, and global average mean
				temperature could rise an additional 2.7 to 11 degrees Fahrenheit, by the end
				of the century;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4f1330d119cc4552b3e07f45799f41f4"><enum>(11)</enum><text display-inline="yes-display-inline">although an understanding of all details of
				the Earth system is not yet complete, present knowledge indicates that
				potential future temperature increases could result in—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idE002F94D094F47D8B4B9E146AAC9F761"><enum>(A)</enum><text display-inline="yes-display-inline">the further or complete melting of the
				Antarctic and Greenland ice sheets;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8872CC55C18740D38B5DAB0B296BBFC5"><enum>(B)</enum><text display-inline="yes-display-inline">the disruption of the North-Atlantic
				Thermohaline Circulation (commonly known as the <quote>Gulf
				Stream</quote>);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FB2DB8CF97A4681B1EF7F5C4657B615"><enum>(C)</enum><text display-inline="yes-display-inline">the extinction of species; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C4B0E381FB14E85B5722908155B0194"><enum>(D)</enum><text display-inline="yes-display-inline">large-scale disruptions of the natural
				systems that support life;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7bda79a8183241ec8b9745c9f8f2def6"><enum>(12)</enum><text display-inline="yes-display-inline">there exists an array of technological
				options for use in reducing global warming pollution emissions, and significant
				reductions can be attained using a portfolio of options that will not adversely
				impact the economy;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB2B7D61E76749CDB19BFE28D69FF560"><enum>(13)</enum><text display-inline="yes-display-inline">the ingenuity of the people of the United
				States will allow the Nation to become a leader in solving global warming;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32BEF35BE08C4991B0A552B6FBFA97DA"><enum>(14)</enum><text display-inline="yes-display-inline">it should be a goal of the United States to
				achieve a reduction in global warming pollution emissions in the United
				States—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD419DFFCEFF14CC78A5C7B3C6DB8B133"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure that the average global
				temperature does not increase by more than 3.6 degrees Fahrenheit (2 degrees
				Celsius); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48DE72E22B074C22A4D16C056D69FA1B"><enum>(B)</enum><text display-inline="yes-display-inline">to facilitate the achievement of an average
				global atmospheric concentration of global warming pollutants that does not
				exceed 450 parts per million in carbon dioxide equivalent.</text>
							</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID1002b867a72b4ffa867d320dc8bb9a0e" section-type="subsequent-section"><enum>702.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID4df1e74ed237426f92f4b0299e1fe6e3"><enum>(1)</enum><text display-inline="yes-display-inline">to achieve a reduction in global warming
				pollution emissions compatible with ensuring that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id1111BB0EA86F4BA79AF920D2E9F2C665"><enum>(A)</enum><text display-inline="yes-display-inline">the average global temperature does not
				increase by more than 3.6 degrees Fahrenheit (2 degrees Celsius) above the
				preindustrial average; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id528EE93967214ED9B2914B0E708E202E"><enum>(B)</enum><text display-inline="yes-display-inline">total average global atmospheric
				concentrations of global warming pollutants do not exceed 450 parts per million
				in carbon dioxide equivalent;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf781f28727bd49d2a70ae9cdad55e49d"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce by calendar year 2050 the
				aggregate net level of global warming pollution emissions of the United States
				to a level that is 80 percent below the aggregate net level of global warming
				pollution emissions for calendar year 1990;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3101a7510eca49ecb284b94e9fed9754"><enum>(3)</enum><text display-inline="yes-display-inline">to allow for an acceleration of reductions
				in global warming pollution emissions to prevent—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idBE01BCF469C14D8DB42CEB558EBB2D56"><enum>(A)</enum><text display-inline="yes-display-inline">average global temperature from increasing
				by more than 3.6 degrees Fahrenheit (2 degrees Celsius) above the preindustrial
				average; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3E33C3D590D459BAC15A6AE5CBA0684"><enum>(B)</enum><text display-inline="yes-display-inline">global atmospheric concentrations of global
				warming pollutants from exceeding 450 parts per million;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4d98ddf361064f9f92555150fd966286"><enum>(4)</enum><text display-inline="yes-display-inline">to establish a motor vehicle global warming
				pollution emission requirement;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83de6ec768e841a18c0da149e3e59958"><enum>(5)</enum><text display-inline="yes-display-inline">to require electric generation units to
				meet a global warming pollution emission standard;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2e8dd11c0c0044d0acfc9431d187213e"><enum>(6)</enum><text display-inline="yes-display-inline">to establish rules for the safe geological
				sequestration of carbon dioxide;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9ea3dd8c477c4c069ecd48e91b0c804a"><enum>(7)</enum><text display-inline="yes-display-inline">to encourage energy efficiency and the use
				of renewable energy by establishing a renewable portfolio standard and an
				energy efficiency portfolio standard;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3bf29fa91f5f47d5bd95a3438437df0c"><enum>(8)</enum><text display-inline="yes-display-inline">to provide for research relating to, and
				development of, the technologies to control global warming pollution
				emissions;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15941b5dd9874dc3b4d06708f2993dff"><enum>(9)</enum><text display-inline="yes-display-inline">to position the United States as the world
				leader in reducing the risk of the potentially devastating, wide-ranging
				impacts associated with global warming; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D578575F99643299DFB1727371E3448"><enum>(10)</enum><text display-inline="yes-display-inline">to promote, through leadership by the
				United States, accelerated reductions in global warming pollution from other
				countries with significant global warming pollution emissions.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDee1ab6b033d14014befcfbc915b83a55" section-type="subsequent-section"><enum>703.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id44952403B20C4291A3D269A687A12AEF"><enum>(1)</enum><header display-inline="yes-display-inline">Academy</header><text display-inline="yes-display-inline">The term <term>Academy</term> means the
				National Academy of Sciences.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1c55fb1125b446908b012e15455f72d9"><enum>(2)</enum><header display-inline="yes-display-inline">Carbon dioxide equivalent</header><text display-inline="yes-display-inline">The term <term>carbon dioxide
				equivalent</term> means, for each global warming pollutant, the quantity of the
				global warming pollutant that makes the same contribution to global warming as
				1 metric ton of carbon dioxide, as determined by the Administrator, taking into
				account the study and report described in section 705(a).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2d5a5f28a91749638dcf7dd6d27f7dda"><enum>(3)</enum><header display-inline="yes-display-inline">Facility</header><text display-inline="yes-display-inline">The term <term>facility</term> means all
				buildings, structures, or installations that are—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id589C32456CA04C40BDEEE2CE26019B5A"><enum>(A)</enum><text display-inline="yes-display-inline">located on 1 or more contiguous or adjacent
				properties under common control of the same persons; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7F6EBA284D74A288C3F4B982109E2A2"><enum>(B)</enum><text display-inline="yes-display-inline">located in the United States.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa407aec3a8a401c95f7536e86a2cc9a"><enum>(4)</enum><header display-inline="yes-display-inline">Global warming pollutant</header><text display-inline="yes-display-inline">The term <term>global warming
				pollutant</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID29f8f9ccfe324fa4ad9157ffb0d2e567"><enum>(A)</enum><text display-inline="yes-display-inline">carbon dioxide;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8d7763157191468085a0706ac2394809"><enum>(B)</enum><text display-inline="yes-display-inline">methane;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID940791470be842e0a20e7053b855cb35"><enum>(C)</enum><text display-inline="yes-display-inline">nitrous oxide;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4428b399e60d43f29d197e98b9c7e488"><enum>(D)</enum><text display-inline="yes-display-inline">hydrofluorocarbons;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0738632bf0334d339250b274051189ae"><enum>(E)</enum><text display-inline="yes-display-inline">perfluorocarbons;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID319706f18a944b46aafb7a804067129a"><enum>(F)</enum><text display-inline="yes-display-inline">sulfur hexafluoride; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd28a2b086dcd43c49126ab424d63a27b"><enum>(G)</enum><text display-inline="yes-display-inline">any other anthropogenically-emitted gas
				that the Administrator, after notice and comment, determines to contribute to
				global warming.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77024F69D1F44A1F9A9E4C38AA53C27B"><enum>(5)</enum><header display-inline="yes-display-inline">Global warming pollution</header><text display-inline="yes-display-inline">The term <term>global warming
				pollution</term> means any combination of 1 or more global warming pollutants
				emitted into the ambient air or atmosphere.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BC6DC060CC847D8A24EC09B15CB25D1"><enum>(6)</enum><header display-inline="yes-display-inline">Market-based program</header><text display-inline="yes-display-inline">The term <term>market-based program</term>
				means a program that places an absolute limit on the aggregate net global
				warming pollution emissions of 1 or more sectors of the economy of the United
				States, while allowing the transfer or sale of global warming pollution
				emission allowances.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B994A8255B24D23B5D3741013CF6364"><enum>(7)</enum><header display-inline="yes-display-inline">NAS report</header><text display-inline="yes-display-inline">The term <term>NAS report</term> means a
				report completed by the Academy under subsection (a) or (b) of section
				705.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID702ac58bbbb14618bc3d55c915c8e20c" section-type="subsequent-section"><enum>704.</enum><header display-inline="yes-display-inline">Global warming pollution emission
				reductions</header>
						<subsection commented="no" display-inline="no-display-inline" id="id5F55665DAA1B4228A54811A4E0F9CA32"><enum>(a)</enum><header display-inline="yes-display-inline">Emission reduction goal</header><text display-inline="yes-display-inline">Congress declares that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id900EF90947684AC59B1E9E23266406A0"><enum>(1)</enum><text display-inline="yes-display-inline">it shall be the goal of the United States,
				acting in concert with other countries that emit global warming pollutants, to
				achieve a reduction in global warming pollution emissions—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id6C61172955754639AE2B21B927F230AF"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure that the average global
				temperature does not increase by more than 3.6 degrees Fahrenheit (2 degrees
				Celsius); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0799D6EA7B9B4FDE81A7272E65E9AD48"><enum>(B)</enum><text display-inline="yes-display-inline">to facilitate the achievement of an average
				global atmospheric concentration of global warming pollutants that does not
				exceed 450 parts per million in carbon dioxide equivalent; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E518EB90F9C49538819477D1BE8A954"><enum>(2)</enum><text display-inline="yes-display-inline">in order to achieve the goal described in
				paragraph (1), the United States shall reduce the global warming pollution
				emissions of the United States by a quantity that is proportional to the share
				of the United States of the reductions that are necessary—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idCAB3EC6AD3604929825F68AE64E65C76"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure that the average global
				temperature does not increase more than 3.6 degrees Fahrenheit (2 degrees
				Celsius); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD274DFFE0C0A480CAB85A9FCD4EBD058"><enum>(B)</enum><text display-inline="yes-display-inline">to stabilize average global warming
				pollution concentrations globally at or below 450 parts per million in carbon
				dioxide equivalent.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID99da2724d2f242ffbfeafd30c213e5d8"><enum>(b)</enum><header display-inline="yes-display-inline">Emission reduction milestones for
				2020</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id9AB45D3F8C104C34978D2BF734C2C90D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To achieve the goal described in subsection
				(a)(1), not later than 2 years after the date of enactment of this title, after
				an opportunity for public notice and comment, the Administrator shall
				promulgate any rules that are necessary to reduce, by not later than January 1,
				2020, the aggregate net levels of global warming pollution emissions of the
				United States to the aggregate net level of those global warming pollution
				emissions during calendar year 1990.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE76EE592471B42D8BE88894A825F69C7"><enum>(2)</enum><header display-inline="yes-display-inline">Achievement of milestones</header><text display-inline="yes-display-inline">To the maximum extent practicable, the
				reductions described in paragraph (1) shall be achieved through an annual
				reduction in the aggregate net level of global warming pollution emissions of
				the United States of approximately 2 percent for each of calendar years 2010
				through 2020.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2e0343a347394100957a2d9ad2a0f64c"><enum>(c)</enum><header display-inline="yes-display-inline">Emission reduction milestones for 2030,
				2040, and 2050</header><text display-inline="yes-display-inline">Except as
				described in subsection (d), not later than January 1, 2018, after an
				opportunity for public notice and comment, the Administrator shall promulgate
				any rules that are necessary to reduce the aggregate net levels of global
				warming pollution emissions of the United States—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDb59f701781fc4703ba756f0850183ae5"><enum>(1)</enum><text display-inline="yes-display-inline">by calendar year 2030, by
				<fraction>1/3</fraction> of 80 percent of the aggregate net level of global
				warming pollution emissions of the United States during calendar year
				1990;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID592b336efbaf4fee83fdf3482a7b733a"><enum>(2)</enum><text display-inline="yes-display-inline">by calendar year 2040, by
				<fraction>2/3</fraction> of 80 percent of the aggregate net level of the global
				warming pollution emissions of the United States during calendar year 1990;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID108d48bbca2c43d2ae9c690a818c5c67"><enum>(3)</enum><text display-inline="yes-display-inline">by calendar year 2050, by 80 percent of the
				aggregate net level of global warming pollution emissions of the United States
				during calendar year 1990.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID543c9af18f9c46a2a8f2158c222b42e6"><enum>(d)</enum><header display-inline="yes-display-inline">Accelerated emission reduction
				milestones</header><text display-inline="yes-display-inline">If an NAS report
				determines that any of the events described in section 705(a)(2) have occurred,
				or are more likely than not to occur in the foreseeable future, not later than
				2 years after the date of completion of the NAS report, the Administrator,
				after an opportunity for public notice and comment and taking into account the
				new information reported in the NAS report, may adjust the milestones under
				this section and promulgate any rules that are necessary—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id111D5509344A44309A15E49900933617"><enum>(1)</enum><text display-inline="yes-display-inline">to reduce the aggregate net levels of
				global warming pollution emissions from the United States on an accelerated
				schedule; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA33BE53B4CC8421F8B475AC3D1D2470F"><enum>(2)</enum><text display-inline="yes-display-inline">to minimize the effects of rapid climate
				change and achieve the goals of this title.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID57797c676a70465b8f8b94a1291c58b2"><enum>(e)</enum><header display-inline="yes-display-inline">Report on achievement of
				milestones</header><text display-inline="yes-display-inline">If an NAS report
				determines that a milestone under paragraph (1) or (2) of subsection (c) cannot
				be achieved because of technological infeasibility, the Administrator shall
				submit to Congress a notification of that determination.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb74cb857c1384532a9447d0d7fa81b26"><enum>(f)</enum><header display-inline="yes-display-inline">Emission reduction policies</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id3FC0453E6FD74D16A71AD41188F62565"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In implementing subsections (a) through
				(e), the Administrator may establish 1 or more market-based programs.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8551237EB93D4EBABA4668FC93EBDA51"><enum>(2)</enum><header display-inline="yes-display-inline">Market-based program policies</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id82D2ED5859E843F78193444F7AF78F61"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In implementing any market-based program,
				the Administrator shall allocate to households, communities, and other entities
				described in section 706(a) any global warming pollution emission allowances
				that are not allocated to entities covered under the emission
				limitation.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6130047d613247a4b58f873d831c6ef2"><enum>(B)</enum><header display-inline="yes-display-inline">Recognition of emission reductions made in
				compliance with State and local laws</header><text display-inline="yes-display-inline">A market-based program may recognize
				reductions of global warming pollution emissions made before the effective date
				of the market-based program if the Administrator determines that—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID68fb272ba5b84b478d145c2f86c9a1b7"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id3075EF4FE987441B96A747E783D508C8"><enum>(I)</enum><text display-inline="yes-display-inline">the reductions were made in accordance with
				a State or local law;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id8078FCD4E6A448ADB3B5FFFDB7FDD3E7" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the State or local law is at least as
				stringent as the rules established for the market-based program under paragraph
				(1); and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idBF00C90AB9854A858B745F0143D2A557" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">the reductions are at least as verifiable
				as reductions made in accordance with those rules; or</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idCF72DA7BB55140148C1FD0AB4B116C7B"><enum>(ii)</enum><text display-inline="yes-display-inline">for any given entity subject to the
				market-based program, the entity demonstrates that the entity has made
				entity-wide reductions of global warming pollution emissions before the
				effective date of the market-based program, but not earlier than calendar year
				1992, that are at least as verifiable as reductions made in accordance with the
				rules established for the market-based program under paragraph (1).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3F4A15DB34D84F3290AA65E09BEB07C8"><enum>(C)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">If the Administrator determines that it is
				necessary to establish a market-based program, the Administrator shall publish
				notice of the determination in the Federal Register.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0e8697e199074203b95bda3c4c32808f"><enum>(D)</enum><header display-inline="yes-display-inline">Limitations on market-based
				programs</header>
									<clause commented="no" display-inline="no-display-inline" id="id7E44ABE2968E46BCBB7931666D0E6347"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDe10fecc80cfb4daab1bbaf3a839a492b"><enum>(I)</enum><header display-inline="yes-display-inline">Annual allowance price</header><text display-inline="yes-display-inline">The term <term>annual allowance
				price</term> means the average market price of global warming pollution
				emission allowances for a calendar year.</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id87431178D2CA495E99A87EB17714A03D"><enum>(II)</enum><header display-inline="yes-display-inline">Declining emissions cap with a
				technology-indexed stop price</header><text display-inline="yes-display-inline">The term <term>declining emissions cap with
				a technology-indexed stop price</term> means a feature of a market-based
				program for an industrial sector, or on an economy-wide basis, under which the
				emissions cap declines by a fixed percentage each calendar year or, during any
				year in which the annual allowance price exceeds the technology-indexed stop
				price, the emissions cap remains the same until the occurrence of the earlier
				of—</text>
											<item commented="no" display-inline="no-display-inline" id="id551D56B3FFDB4277BFC5CCE2081B4F9F"><enum>(aa)</enum><text display-inline="yes-display-inline">the date on which the annual allowance
				price no longer exceeds the technology-indexed stop price; or</text>
											</item><item commented="no" display-inline="no-display-inline" id="IDd86bca2c1fb948d595b4bcaffc56a396"><enum>(bb)</enum><text display-inline="yes-display-inline">the date on which a period of 3 years has
				elapsed during which the emissions cap has remained unchanged.</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="IDc9bacfc191a34fa4b19b29f29eb17a28"><enum>(III)</enum><header display-inline="yes-display-inline">Emissions cap</header><text display-inline="yes-display-inline">The term <term>emissions cap</term> means
				the total number of global warming pollution emission allowances issued for a
				calendar year.</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2d64ef9f90224f61955fb2c707af74c3"><enum>(IV)</enum><header display-inline="yes-display-inline">Technology-indexed stop price</header><text display-inline="yes-display-inline">The term <term>technology-indexed stop
				price</term> means a price per ton of global warming pollution emissions
				determined annually by the Administrator that is not less than the
				technology-specific average cost of preventing the emission of 1 ton of global
				warming pollutants through commercial deployment of any available zero-carbon
				or low-carbon technologies. With respect to the electricity sector, those
				technologies shall consist of—</text>
											<item commented="no" display-inline="no-display-inline" id="ID67a9162abd744812bef8e41125f10a6d"><enum>(aa)</enum><text display-inline="yes-display-inline">wind-generated electricity;</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID73b9b000a0db4629a514430cdafc5544"><enum>(bb)</enum><text display-inline="yes-display-inline">photovoltaic-generated electricity;</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID5e0983871fed40848a1c62cda06b0159"><enum>(cc)</enum><text display-inline="yes-display-inline">geothermal energy;</text>
											</item><item commented="no" display-inline="no-display-inline" id="id790C05AB937542BF819FB20C4D67B879"><enum>(dd)</enum><text display-inline="yes-display-inline">solar thermally-generated energy;</text>
											</item><item commented="no" display-inline="no-display-inline" id="idA46389E7A30E4465B2ADE5956D29202A"><enum>(ee)</enum><text display-inline="yes-display-inline">wave-based forms of energy;</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID22a7a95c2910464c92d7d470a0678f20"><enum>(ff)</enum><text display-inline="yes-display-inline">any fossil fuel-based electric generating
				technology emitting less than 250 pounds per megawatt hour; and</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID05270b4688634c29a1e6c9865580b4a7"><enum>(gg)</enum><text display-inline="yes-display-inline">any zero-carbon-emitting electric
				generating technology that does not generate radioactive waste.</text>
											</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA5F6288898684B93B0C0CCED2DF51E38"><enum>(ii)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">In implementing any market-based program
				under this Act, for the period prior to January 1, 2020, the Administrator
				shall consider the impact on the economy of the United States of implementing
				the program with a declining emissions cap through the use of a
				technology-indexed stop price.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID117b23ccf81441859af8651f6dcebfe7"><enum>(iii)</enum><header display-inline="yes-display-inline">Other emitting sectors</header><text display-inline="yes-display-inline">The Administrator may consider the use of a
				declining emissions cap with a technology-indexed stop price, or similar
				approaches, for other emitting sectors based on low-carbon or zero-carbon
				technologies, including—</text>
										<subclause commented="no" display-inline="no-display-inline" id="idC7D4AF4C7FFC46168212EDE64619D8EA"><enum>(I)</enum><text display-inline="yes-display-inline">biofuels;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idD40DDB649BAD416A845D4C780593BFBC"><enum>(II)</enum><text display-inline="yes-display-inline">hydrogen power; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idE4D0E16018C949D3B7759F64518013F5"><enum>(III)</enum><text display-inline="yes-display-inline">other sources of energy and transportation
				fuel.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id640246AD80AC470C966A15870DE375A1"><enum>(g)</enum><header display-inline="yes-display-inline">Cost-effectiveness</header><text display-inline="yes-display-inline">In promulgating regulations under this
				section, the Administrator shall select the most cost-effective options for
				global warming pollution control and emission reduction strategies.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDb36d5ac2b15544ee86e48ab646edd60e" section-type="subsequent-section"><enum>705.</enum><header display-inline="yes-display-inline">Conditions for accelerated global warming
				pollution emission reduction</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID3058b41ee5ba4bb9b113c4d945da813a"><enum>(a)</enum><header display-inline="yes-display-inline">Report on global change events by the
				Academy</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id162BA3EDDF2A4ABD8A478ADB4665E5B4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall offer to enter into
				a contract with the Academy under which the Academy, not later than 2 years
				after the date of enactment of this title, and every 3 years thereafter, shall
				submit to Congress and the Administrator a report that describes whether any of
				the events described in paragraph (2)—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id277C9CC604F44A2A9661F5C5DEC26123"><enum>(A)</enum><text display-inline="yes-display-inline">have occurred or are more likely than not
				to occur in the foreseeable future; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2FE183142A10488C9C1D8F3503A5FF19"><enum>(B)</enum><text display-inline="yes-display-inline">in the judgment of the Academy, are the
				result of anthropogenic climate change.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96930ACBC2FE49FBA523D7FE5B8DB494"><enum>(2)</enum><header display-inline="yes-display-inline">Events</header><text display-inline="yes-display-inline">The events referred to in paragraph (1)
				are—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf630494051844162bf26410d7acbaca1"><enum>(A)</enum><text display-inline="yes-display-inline">the exceedance of an atmospheric
				concentration of global warming pollutants of 450 parts per million in carbon
				dioxide equivalent; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9c53469da7eb478ca6b8aecc6f599b17"><enum>(B)</enum><text display-inline="yes-display-inline">an increase of global average temperatures
				in excess of 3.6 degrees Fahrenheit (2 degrees Celsius) above the preindustrial
				average.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4FDFDE8B463643A399C1AFAE26E1F3C7"><enum>(b)</enum><header display-inline="yes-display-inline">Technology reports</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idCB7FAF9CDFB34FDD8297F6DBEE7CEEC9"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of technologically
				infeasible</header><text display-inline="yes-display-inline">In this
				subsection, the term <quote>technologically infeasible</quote>, with respect to
				a technology, means that the technology—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id92A94E7C836342E8A1E14CB5E4FB949E"><enum>(A)</enum><text display-inline="yes-display-inline">will not be demonstrated beyond
				laboratory-scale conditions;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id793502394AEF4447BE38835C2001A1A6"><enum>(B)</enum><text display-inline="yes-display-inline">would be unsafe;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA3978F61B1564C91A84DEC1323C8183D"><enum>(C)</enum><text display-inline="yes-display-inline">would not reliably reduce global warming
				pollution emissions; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5742C44E87CE4973BEA0F3D8C98D4CBB"><enum>(D)</enum><text display-inline="yes-display-inline">would prevent the activity to which the
				technology applies from meeting or performing its primary purpose (such as
				generating electricity or transporting goods or individuals).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID738745c50bf54680a507698221eec476"><enum>(2)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Administrator shall offer to enter into
				a contract with the Academy under which the Academy, not later than 2 years
				after the date of enactment of this title and every 3 years thereafter, shall
				submit to Congress and the Administrator a report that describes or
				analyzes—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID4acfbfd9ee8940c6976a3879aa44bea4"><enum>(A)</enum><text display-inline="yes-display-inline">the status of current global warming
				pollution emission reduction technologies, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="idA79EA9ABF580411B9A97AB3DA48497BD"><enum>(i)</enum><text display-inline="yes-display-inline">technologies for capture and disposal of
				global warming pollutants;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idA8AB8AF0FF704BC4AF039D16EAC66B85"><enum>(ii)</enum><text display-inline="yes-display-inline">efficiency improvement technologies;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id43AFDF5BC4E542C6AA01D49448399D93"><enum>(iii)</enum><text display-inline="yes-display-inline">zero-global-warming-pollution-emitting
				energy technologies; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idA482ED28631C4FC4A00CAEA788C5B981"><enum>(iv)</enum><text display-inline="yes-display-inline">above- and below-ground biological
				sequestration technologies;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6a9cd33204024d1fb1ca673d2de3f3bc"><enum>(B)</enum><text display-inline="yes-display-inline">whether any of the requirements under this
				title (including regulations promulgated under this title) mandate a level of
				emission control or reduction that, based on available or expected technology,
				will be technologically infeasible at the time at which the requirements become
				effective;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6705d4965db4031b908573fde9f3d9f"><enum>(C)</enum><text display-inline="yes-display-inline">the projected date on which any technology
				determined to be technologically infeasible will become technologically
				feasible;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID06522c73b32a4b3f905b627f265e3904"><enum>(D)</enum><text display-inline="yes-display-inline">whether any technology determined to be
				technologically infeasible cannot reasonably be expected to become
				technologically feasible prior to calendar year 2050; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3b2e12c926d4288816df66bde9cec93"><enum>(E)</enum><text display-inline="yes-display-inline">the costs of available alternative global
				warming pollution emission reduction strategies that could be used or pursued
				in lieu of any technologies that are determined to be technologically
				infeasible.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A96131E3DE844ABAE9B085B0AF3FC71"><enum>(3)</enum><header display-inline="yes-display-inline">Report evaluating 2050
				milestone</header><text display-inline="yes-display-inline">Not later than
				December 31, 2037, the Administrator shall offer to enter into a contract with
				the Academy under which, not later than December 31, 2039, the Academy shall
				prepare and submit to Congress and the Administrator a report on the
				appropriateness of the milestone described in section 704(c)(3), taking into
				consideration—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idE323B2F4792E4592A5194E1811020D85"><enum>(A)</enum><text display-inline="yes-display-inline">information that was not available as of
				the date of enactment of this title; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE13E2BDDF3142E98B3DDCEAAEA6292D"><enum>(B)</enum><text display-inline="yes-display-inline">events that have occurred since that date
				relating to—</text>
									<clause commented="no" display-inline="no-display-inline" id="id16CC9253DDEE4DA5B652E087D0F7D6C1"><enum>(i)</enum><text display-inline="yes-display-inline">climate change;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idFFAFD56EBE7F4831ABE3611087459CE5"><enum>(ii)</enum><text display-inline="yes-display-inline">climate change technologies; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id6DB666F62FBA48449EAFD6C5F541E5DA"><enum>(iii)</enum><text display-inline="yes-display-inline">national and international climate change
				commitments.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6d5bd397171e484d87a5110db11367da"><enum>(c)</enum><header display-inline="yes-display-inline">Additional items in NAS
				report</header><text display-inline="yes-display-inline">In addition to the
				information described in subsection (a)(1) that is required to be included in
				the NAS report, the Academy shall include in the NAS report—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDcca4671e00314ab6b76cf42f83e30c15"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of the trends in annual global
				warming pollution emissions by the United States and the other countries that
				collectively account for more than 90 percent of global warming pollution
				emissions (including country-specific inventories of global warming pollution
				emissions and facility-specific inventories of global warming pollution
				emissions in the United States);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04521d4bbf344d7ca7506a84d100112e"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of the trends in global warming
				pollution concentrations (including observed atmospheric concentrations of
				global warming pollutants);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd043bc56a8b84019827e04a26cdadd3a"><enum>(3)</enum><text display-inline="yes-display-inline">a description of actual and projected
				global change impacts that may be caused by anthropogenic global warming
				pollution emissions, in addition to the events described in subsection (a)(2);
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7facdbc118a643f4b0747bef3973d007"><enum>(4)</enum><text display-inline="yes-display-inline">such other information as the Academy
				determines to be appropriate.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDc8c903acbc77479faf8a3f4925d5c9bb" section-type="subsequent-section"><enum>706.</enum><header display-inline="yes-display-inline">Use of allowances for transition assistance
				and other purposes</header>
						<subsection commented="no" display-inline="no-display-inline" id="id8AB78265F65D476896F8EB511AB834B6"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations governing allocation of
				allowances for transition assistance to individuals and entities</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id7EEB3F7E687D48AD80CAD9BBC3B68803"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In implementing any market-based program,
				the Administrator may promulgate regulations providing for the allocation of
				global warming pollution emission allowances to the individuals and entities,
				or for the purposes, specified in subsection (b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9c0efa3769b9496f873ee1c2fa13a8a5"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Regulations promulgated under paragraph (1)
				may, as the Administrator determines to be necessary, provide for the
				appointment of 1 or more trustees—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID6516531e12494a82afc1607ec3578ee6"><enum>(A)</enum><text display-inline="yes-display-inline">to receive emission allowances for the
				benefit of households, communities, and other entities described in paragraph
				(1);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86ab650dfc4a44459263459422356d36"><enum>(B)</enum><text display-inline="yes-display-inline">to sell the emission allowances at fair
				market value; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDac4a21629b934d66a18646e58f53365b"><enum>(C)</enum><text display-inline="yes-display-inline">to distribute the proceeds of any sale of
				emission allowances to the appropriate beneficiaries.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0124cb55a0954d30bce378130fbe9bf9"><enum>(b)</enum><header display-inline="yes-display-inline">Allocation for Transition
				Assistance</header><text display-inline="yes-display-inline">The Administrator
				may allocate emission allowances, in accordance with regulations promulgated
				under subsection (a), to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID654785fd91fb46d589c2315f360dd197"><enum>(1)</enum><text display-inline="yes-display-inline">communities, individuals, and companies
				that have experienced disproportionate adverse impacts as a result of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idB73D7D1EF3B5433C9653C177540A6F66"><enum>(A)</enum><text display-inline="yes-display-inline">the transition to a lower carbon-emitting
				economy; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22A06139D586408F820E84B659FF09FE"><enum>(B)</enum><text display-inline="yes-display-inline">global warming;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76fcc4945fba45ab92ee774c809f3e3f"><enum>(2)</enum><text display-inline="yes-display-inline">owners and operators of highly
				energy-efficient buildings, including—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idAB72D1B54D54467482E9B74D6A7E1E4F"><enum>(A)</enum><text display-inline="yes-display-inline">residential users;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0C1D692FAB364483B144246EA40AD0B1"><enum>(B)</enum><text display-inline="yes-display-inline">producers of highly energy-efficient
				products; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id843789089994438997A0BFBE07FA3E6B"><enum>(C)</enum><text display-inline="yes-display-inline">entities that carry out energy-efficiency
				improvement projects pursuant to section 712 that result in consumer-side
				reductions in electricity use;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8f6c9b666c7c4a78a7853b7880fda497"><enum>(3)</enum><text display-inline="yes-display-inline">entities that will use the allowances for
				the purpose of carrying out geological sequestration of carbon dioxide produced
				by an anthropogenic global warming pollution emission source in accordance with
				requirements established by the Administrator;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDac33614c5e8d4ac8ac645a6e9d1a8bf3"><enum>(4)</enum><text display-inline="yes-display-inline">such individuals and entities as the
				Administrator determines to be appropriate, for use in carrying out projects to
				reduce net carbon dioxide emissions through above-ground and below-ground
				biological carbon dioxide sequestration (including sequestration in forests,
				forest soils, agricultural soils, rangeland, or grassland in the United
				States);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7CCA20B9C084D30B8C8F7FB934C301C"><enum>(5)</enum><text display-inline="yes-display-inline">such individuals and entities (including
				fish and wildlife agencies) as the Administrator determines to be appropriate,
				for use in carrying out projects to protect and restore ecosystems (including
				fish and wildlife) affected by climate change; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8924776DA4D440BD895CB143E1A9E13F"><enum>(6)</enum><text display-inline="yes-display-inline">manufacturers producing consumer products
				that result in substantially reduced global warming pollution emissions, for
				use in funding rebates for purchasers of those products.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9815ADA126FA4EC3A0517FA384C77E76" section-type="subsequent-section"><enum>707.</enum><header display-inline="yes-display-inline">Vehicle emission standards</header>
						<subsection commented="no" display-inline="no-display-inline" id="id0C56C24B5E2E4DE1B954B2B567F00271"><enum>(a)</enum><header display-inline="yes-display-inline">Vehicles under 10,000 pounds</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id206DB1E94EB24AABA1D93989D219220E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2010, the
				Administrator shall promulgate regulations requiring each fleet of automobiles
				sold by a manufacturer in the United States beginning in model year 2016 to
				meet the standards for global warming pollution emissions described in
				paragraph (2).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E547AD0217C4710AE39ABC13E8CFC75"><enum>(2)</enum><header display-inline="yes-display-inline">Emission standards</header><text display-inline="yes-display-inline">The average global warming pollution
				emissions of a vehicle fleet described in paragraph (1) shall not
				exceed—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id15759C3E49EB4006BFC7E4E01CA5E338"><enum>(A)</enum><text display-inline="yes-display-inline">205 carbon dioxide equivalent grams per
				mile for automobiles with—</text>
									<clause commented="no" display-inline="no-display-inline" id="id6FCF5CF9B488446A98ABA43A7BB26849"><enum>(i)</enum><text display-inline="yes-display-inline">a gross vehicle weight of not more than
				8,500 pounds; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id71A64C84BC364FE98D90977EF663A97E"><enum>(ii)</enum><text display-inline="yes-display-inline">a loaded vehicle weight of not more than
				3,750 pounds;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F3F9258E61740B6A09193FF5EE22B9F"><enum>(B)</enum><text display-inline="yes-display-inline">332 carbon dioxide equivalent grams per
				mile for—</text>
									<clause commented="no" display-inline="no-display-inline" id="idE05E5232C9424AB1887611FA63B15A4E"><enum>(i)</enum><text display-inline="yes-display-inline">automobiles with—</text>
										<subclause commented="no" display-inline="no-display-inline" id="idE04119B9223848FAB8A8D56F92E52884"><enum>(I)</enum><text display-inline="yes-display-inline">a gross vehicle weight of not more than
				8,500 pounds; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idED12ADCA05D14A83AE30B964D6519324"><enum>(II)</enum><text display-inline="yes-display-inline">a loaded vehicle weight of more than 3,750
				pounds; and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEA78C271F73844A498089463FE9A6104"><enum>(ii)</enum><text display-inline="yes-display-inline">medium-duty passenger vehicles; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C300703299E43C9BA829CDF523AAA74"><enum>(C)</enum><text display-inline="yes-display-inline">405 carbon dioxide equivalent grams per
				mile for vehicles—</text>
									<clause commented="no" display-inline="no-display-inline" id="id4DB0BF1C8018443D9B53B70D7C92B0FF"><enum>(i)</enum><text display-inline="yes-display-inline">with a gross vehicle weight of between
				8,501 pounds and 10,000 pounds; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idF10E760A5A32473E892E4E46C6FE8D4C"><enum>(ii)</enum><text display-inline="yes-display-inline">that are not medium-duty passenger
				vehicles.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE90E0B6E07CE416883B8D437AA9F8273"><enum>(3)</enum><header display-inline="yes-display-inline">Heightened standards</header><text display-inline="yes-display-inline">After model year 2016, the Administrator
				may promulgate regulations that increase the stringency of emission standards
				described in paragraph (2) as necessary to meet the emission reduction goal
				described in section 704(e)(3).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id18A800DAB8034AC1B97972D8DC849004"><enum>(b)</enum><header display-inline="yes-display-inline">Highway vehicles over 10,000
				pounds</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id67A547226CA94CEA901F4ADD114E9ECE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2010, the
				Administrator shall promulgate regulations requiring each fleet of highway
				vehicles over 10,000 pounds sold by a manufacturer in the United States
				beginning in model year 2020 to meet the standards for global warming pollution
				emissions described in paragraph (2).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1EA08029F02742FFAC623819DABF27D3"><enum>(2)</enum><header display-inline="yes-display-inline">Emission standards</header><text display-inline="yes-display-inline">The average global warming pollution
				emissions of a vehicle fleet described in paragraph (1) shall not
				exceed—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id2DA73E167B194B1DA63CC3FF50C1A547"><enum>(A)</enum><text display-inline="yes-display-inline">850 carbon dioxide equivalent grams per
				mile for highway vehicles with a gross vehicle weight rating between 10,001
				pounds and 26,000 pounds; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB3FB13DA658A47F79095179E5AF60127"><enum>(B)</enum><text display-inline="yes-display-inline">1,050 carbon dioxide equivalent grams per
				mile for highway vehicles with a gross vehicle weight rating of more than
				26,000 pounds.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id614B74ED4B4C4C739DF70C15EE572F56"><enum>(3)</enum><header display-inline="yes-display-inline">Heightened standards</header><text display-inline="yes-display-inline">After model year 2020, the Administrator
				may promulgate regulations that increase the stringency of emission standards
				described in paragraph (2) as necessary to meet the emission reduction goal
				described in section 704(a)(1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA9E9F61B43CD4FFC85F58CEB41D4158C"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment of requirements</header><text display-inline="yes-display-inline">Taking into account appropriate lead times
				for vehicle manufacturers, if the Academy determines, pursuant to an NAS
				report, that a vehicle emission standard under this section is or will be
				technologically infeasible as of the effective date of the standard, the
				Administrator may, by regulation, modify the requirement to take into account
				the determination of the Academy.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id167E02BB548B40B286062D775AEB50C1"><enum>(d)</enum><header display-inline="yes-display-inline">Study</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id98B90ADD85F649E7AB6A9AFE933568BD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2008, the
				Administrator shall enter into a contract with the Academy under which the
				Academy shall conduct a study of, and submit to the Administrator a report on,
				the potential contribution of the non-highway portion of the transportation
				sector toward meeting the emission reduction goal described in section
				704(a)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA999046DB317419EAE211AAD2F2D8BB8"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The study shall analyze—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id14CBB78331834722B47C328A28D6EB3C"><enum>(A)</enum><text display-inline="yes-display-inline">the technological feasibility and
				cost-effectiveness of global warming pollution reductions from the non-highway
				sector; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83F54CCEBDDF4F4F8F3EAC79C4237C83"><enum>(B)</enum><text display-inline="yes-display-inline">the overall potential contribution of that
				sector in terms of emissions, in meeting the emission reduction goal described
				in section 704(a)(1).</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDcbc3c9ae01074e4cbcba2502a922a5c9" section-type="subsequent-section"><enum>708.</enum><header display-inline="yes-display-inline">Emission standards for electric generation
				units</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID189ab93fe2b04787bee73dc5359b7b39"><enum>(a)</enum><header display-inline="yes-display-inline">Initial standard</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id7F7B6DA531084B0FA041B7548968A766"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, the Administrator shall, by regulation, require each
				unit that is designed and intended to provide electricity at a unit capacity
				factor of at least 60 percent and that begins operation after December 31,
				2011, to meet the standard described in paragraph (2).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6052179806BC472796062B3FA93DFCC3"><enum>(2)</enum><header display-inline="yes-display-inline">Standard</header><text display-inline="yes-display-inline">Beginning on December 31, 2015, a unit
				described in paragraph (1) shall meet a global warming pollution emission
				standard that is not higher than the emission rate of a new combined cycle
				natural gas generating unit.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD1B8AE4CC2CA4E32B1EA4B26CB462C86"><enum>(3)</enum><header display-inline="yes-display-inline">More stringent requirements</header><text display-inline="yes-display-inline">For the period beginning on January 1 of
				the calendar year following the effective date of the regulation described in
				paragraph (1) and ending on December 31, 2029, the Administrator may increase
				the stringency of the global warming pollution emission standard described in
				paragraph (1) with respect to electric generation units described in that
				paragraph.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0d21f62267af47a4897bdfa57f67243c"><enum>(b)</enum><header display-inline="yes-display-inline">Final
				standard</header><text display-inline="yes-display-inline">Not later than
				December 31, 2030, the Administrator shall require each electric generation
				unit, regardless of when the unit began to operate, to meet the applicable
				emission standard under subsection (a).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id4243D4623A254ABC93C47AD62FFCE2A0"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment of requirements</header><text display-inline="yes-display-inline">If the Academy determines, pursuant to
				section 705, that a requirement of this section is or will be technologically
				infeasible at the time at which the requirement becomes effective, the
				Administrator, may, by regulation, adjust or delay the effective date of the
				requirement as is necessary to take into consideration the determination of the
				Academy.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id3E2ABB89E3A744409A4C5D5AF8FC2EF3" section-type="subsequent-section"><enum>709.</enum><header display-inline="yes-display-inline">Low-carbon generation requirement</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDae655417ac034182a58ba271d9eb1868"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id47DB7C4362594144AF7E8013A95C6CD7"><enum>(1)</enum><header display-inline="yes-display-inline">Base quantity of electricity</header><text display-inline="yes-display-inline">The term <term>base quantity of
				electricity</term> means the total quantity of electricity produced for sale by
				a covered generator during the calendar year immediately preceding a compliance
				year from coal, petroleum coke, lignite, or any combination of those
				fuels.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf83ba1aebc9e4125ad3528c96b8ef1b4"><enum>(2)</enum><header display-inline="yes-display-inline">Covered generator</header><text display-inline="yes-display-inline">The term <term>covered generator</term>
				means an electric generating unit that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id4AF55E3FFBF3465D9AC93062A3F44074"><enum>(A)</enum><text display-inline="yes-display-inline">has a rated capacity of 25 megawatts or
				more; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE848DF666923435EB56CEA0873C981F1"><enum>(B)</enum><text display-inline="yes-display-inline">has an annual fuel input at least 50
				percent of which is provided by coal, petroleum coke, lignite, or any
				combination of those fuels.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdbff856d0d44d5aa44dc0511a62c8d5"><enum>(3)</enum><header display-inline="yes-display-inline">Low-carbon generation</header><text display-inline="yes-display-inline">The term <term>low-carbon generation</term>
				means electric energy generated from an electric generating unit at least 50
				percent of the annual fuel input of which, in any year—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id9DE8CB18B95D4F0E8FB16380ABE3A9DD"><enum>(A)</enum><text display-inline="yes-display-inline">is provided by coal, petroleum coke,
				lignite, biomass, or any combination of those fuels; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E30CDB0A01042FDAFA0ED40627A591B"><enum>(B)</enum><text display-inline="yes-display-inline">results in an emission rate into the
				atmosphere of not more than 250 pounds of carbon dioxide per megawatt-hour
				(after adjustment for carbon dioxide from the electric generating unit that is
				geologically sequestered in a geological repository approved by the
				Administrator pursuant to subsection (e)).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3466E69B1EC7494688B997F8E3C89788"><enum>(4)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
				low-carbon generation credit trading program established under subsection
				(d)(1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID32a6477f9f9d4d358df79d4bbc01252a"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idF8E22D4056B2403EB6B6879C94924B89"><enum>(1)</enum><header display-inline="yes-display-inline">Calendar years 2015 through
				2020</header><text display-inline="yes-display-inline">Of the base quantity of
				electricity produced for sale by a covered generator for a calendar year, the
				covered generator shall provide a minimum percentage of that base quantity of
				electricity for the calendar year from low-carbon generation, as specified in
				the following table:</text>

				2025</header><text display-inline="yes-display-inline">For each of calendar
				years 2021 through 2025, the Administrator may increase the minimum percentage
				of the base quantity of electricity from low-carbon generation described in
				paragraph (1) by up to 2 percentage points from the previous year, as the
				Administrator determines to be necessary to achieve the emission reduction goal
				described in section 704(a)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id925922615C7E41C9B2E094D5B2EED857"><enum>(3)</enum><header display-inline="yes-display-inline">Calendar years 2026 through
				2030</header><text display-inline="yes-display-inline">For each of calendar
				years 2026 through 2030, the Administrator may increase the minimum percentage
				of the base quantity of electricity from low-carbon generation described in
				paragraph (1) by up to 3 percentage points from the previous year, as the
				Administrator determines to be necessary to achieve the emission reduction goal
				described in section 704(a)(1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC306E58168054F879E65388D95F5C3C4"><enum>(c)</enum><header display-inline="yes-display-inline">Means of compliance</header><text display-inline="yes-display-inline">An owner or operator of a covered generator
				shall comply with subsection (b) by—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDe8847807937745529a5106a87e86049c"><enum>(1)</enum><text display-inline="yes-display-inline">generating electric energy using low-carbon
				generation;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14FBA952AD204BD298A2FEFBCE73E835"><enum>(2)</enum><text display-inline="yes-display-inline">purchasing electric energy generated by
				low-carbon generation;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A832B6800C24B69B85EC6BA8A9A498F"><enum>(3)</enum><text display-inline="yes-display-inline">purchasing low-carbon generation credits
				issued under the program; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79974711E15E423CA1C967E5A9CF5177"><enum>(4)</enum><text display-inline="yes-display-inline">undertaking a combination of the actions
				described in paragraphs (1) through (3).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA415FFE658BC4D0CAC6F8012FC1640CC"><enum>(d)</enum><header display-inline="yes-display-inline">Low-carbon generation credit trading
				program</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idE9752CA81C5044A2B09DB6951C25F21B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2008, the
				Administrator shall establish, by regulation after notice and opportunity for
				comment, a low-carbon generation trading program to permit an owner or operator
				of a covered generator that does not generate or purchase enough electric
				energy from low-carbon generation to comply with subsection (b) to achieve that
				compliance by purchasing sufficient low-carbon generation credits.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47f69e780811473f87e96e2d6e769eaa"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">As part of the program, the Administrator
				shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id102D3AAB38114F009CC014324447FF57"><enum>(A)</enum><text display-inline="yes-display-inline">issue to producers of low-carbon
				generation, on a quarterly basis, a single low-carbon generation credit for
				each kilowatt hour of low-carbon generation sold during the preceding quarter;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf67764f52c8b4d09ab8b85cd5c4281d7"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that a kilowatt hour, including the
				associated low-carbon generation credit, shall be used only once for purposes
				of compliance with subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDea39790621aa4328966d481a2192c70d"><enum>(e)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">An owner or operator of a covered generator
				that fails to comply with subsection (b) shall be subject to a civil penalty in
				an amount equal to the product obtained by multiplying—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id4CCEE2CC61A14DBAABA9BC8DC992A4F9"><enum>(1)</enum><text display-inline="yes-display-inline">the number of kilowatt-hours of electric
				energy sold to electric consumers in violation of subsection (b); and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id360B49A43F8A4637B423A6178DC3EB8B"><enum>(2)</enum><text display-inline="yes-display-inline">the greater of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idADC17E7BB5BA445CB2A6B7F3C427040E"><enum>(A)</enum><text display-inline="yes-display-inline">2.5 cents (as adjusted under subsection
				(g)); or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC434D0895AC04403B424545CF0BB290E"><enum>(B)</enum><text display-inline="yes-display-inline">200 percent of the average market value of
				those low-carbon generation credits during the year in which the violation
				occurred.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1fda12a74ef34783a76a003114bf1cfe"><enum>(f)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">This section shall not apply for any
				calendar year to an owner or operator of a covered generator that sold less
				than 40,000 megawatt-hours of electric energy produced from covered generators
				during the preceding calendar year.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0c59ae165ca442768de66bd785cbef87"><enum>(g)</enum><header display-inline="yes-display-inline">Inflation adjustment</header><text display-inline="yes-display-inline">Not later than December 31, 2008, and
				annually thereafter, the Administrator shall adjust the amount of the civil
				penalty for each kilowatt-hour calculated under subsection (e)(2) to reflect
				changes for the 12-month period ending on the preceding November 30 in the
				Consumer Price Index for All Urban Consumers published by the Bureau of Labor
				Statistics of the Department of Labor.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id4DDECB6691CA46F7BB0C95E082BC96C1"><enum>(h)</enum><header display-inline="yes-display-inline">Technological infeasibility</header><text display-inline="yes-display-inline">If the Academy determines, pursuant to
				section 705, that the schedule for compliance described in subsection (b) is or
				will be technologically infeasible for covered generators to meet, the
				Administrator may, by regulation, adjust the schedule as the Administrator
				determines to be necessary to take into account the consideration of the
				determination of the Academy.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID940eaac18e7a454db52d7198fa3b5fa5"><enum>(i)</enum><header display-inline="yes-display-inline">Termination of authority</header><text display-inline="yes-display-inline">This section and the authority provided by
				this section terminate on December 31, 2030.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID97e56362a79041f0aa91e7cc49510b5d" section-type="subsequent-section"><enum>710.</enum><header display-inline="yes-display-inline">Geological disposal of global warming
				pollutants</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID739ee2c7bbd94d569893f02b6789fc66"><enum>(a)</enum><header display-inline="yes-display-inline">Geological carbon dioxide disposal
				deployment projects</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDb599b20ca92f443b9d2b5e9baaf4b2d9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish a
				competitive grant program to provide grants to 5 entities for the deployment of
				projects to geologically dispose of carbon dioxide (referred to in this
				subsection as <term>geological disposal deployment projects</term>).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26bf18f3242a4ef98b154148a1fd44dd"><enum>(2)</enum><header display-inline="yes-display-inline">Location</header><text display-inline="yes-display-inline">Each geological disposal deployment project
				shall be conducted in a geologically distinct location in order to demonstrate
				the suitability of a variety of geological structures for carbon dioxide
				disposal.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e8b166da8844ceda8cdb3560ac1ac10"><enum>(3)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">Each geological disposal deployment project
				shall include an analysis of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDc9783912ccd043bca5440169f9e930f2"><enum>(A)</enum><text display-inline="yes-display-inline">mechanisms for trapping the carbon dioxide
				to be geologically disposed;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID140a8d132f404ac9b71dc93e2039dbdb"><enum>(B)</enum><text display-inline="yes-display-inline">techniques for monitoring the geologically
				disposed carbon dioxide;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1890b0f2460445fcbd66c9b6b12ea98e"><enum>(C)</enum><text display-inline="yes-display-inline">public response to the geological disposal
				deployment project; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7AACD2B75B4B4EE7A43E414CB0B4BE4F"><enum>(D)</enum><text display-inline="yes-display-inline">the permanency of carbon dioxide storage in
				geological reservoirs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID77043cd646774a8b81fbc19a5c98eb74"><enum>(4)</enum><header display-inline="yes-display-inline">Requirements</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf07fc9666c6c4d43aae97bf72438ea05"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish—</text>
									<clause commented="no" display-inline="no-display-inline" id="id5F8F35E725954C09BDCFA782F7C926E4"><enum>(i)</enum><text display-inline="yes-display-inline">appropriate conditions for environmental
				protection with respect to geological disposal deployment projects to protect
				public health and the environment; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idC02CF3DAEC5B4731889E9615BEE80B3C"><enum>(ii)</enum><text display-inline="yes-display-inline">requirements relating to applications for
				grants under this subsection.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID929c5f7a4e83446a82ce743fd6c6c37a"><enum>(B)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">The establishment of requirements under
				subparagraph (A) shall not require a rulemaking.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd786a06989fd43ae985c9ab77f874d84"><enum>(C)</enum><header display-inline="yes-display-inline">Minimum requirements</header><text display-inline="yes-display-inline">At a minimum, each application for a grant
				under this subsection shall include—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDf9162101c8fb42d7a53121060848ba41"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the geological disposal
				deployment project proposed in the application;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID79222f8a8afb4c95945c0b64b7f48a71"><enum>(ii)</enum><text display-inline="yes-display-inline">an estimate of the quantity of carbon
				dioxide to be geologically disposed over the life of the geological disposal
				deployment project; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID08dc10aa369a431a9f1b0778faf16123"><enum>(iii)</enum><text display-inline="yes-display-inline">a plan to collect and disseminate data
				relating to each geological disposal deployment project to be funded by the
				grant.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb5da53973fa24d7194de2e4d8411cb4d"><enum>(5)</enum><header display-inline="yes-display-inline">Partners</header><text display-inline="yes-display-inline">An applicant for a grant under this
				subsection may carry out a geological disposal deployment project under a pilot
				program in partnership with 1 or more public or private entities.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4d3f3372a5db42f78bfb8c0c663f16f3"><enum>(6)</enum><header display-inline="yes-display-inline">Selection criteria</header><text display-inline="yes-display-inline">In evaluating applications under this
				subsection, the Administrator shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDc09bcbe5728f45c98a9f2e73fed8035c"><enum>(A)</enum><text display-inline="yes-display-inline">consider the previous experience of each
				applicant with similar projects; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID44ae10d13cfd45459f8b7afa4576ac20"><enum>(B)</enum><text display-inline="yes-display-inline">give priority consideration to applications
				for geological disposal deployment projects that—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID50a3025b6fe14d39a9eced922ef015e0"><enum>(i)</enum><text display-inline="yes-display-inline">offer the greatest geological diversity
				from other projects that have previously been approved;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDefb7e77078374e3db62aeaa73f2c35aa"><enum>(ii)</enum><text display-inline="yes-display-inline">are located in closest proximity to a
				source of carbon dioxide;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6dc181a3fa9d4f368c65170b9da3fb81"><enum>(iii)</enum><text display-inline="yes-display-inline">make use of the most affordable source of
				carbon dioxide;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID44f1c352774b4ca5b1d746bb08027a8b"><enum>(iv)</enum><text display-inline="yes-display-inline">are expected to geologically dispose of the
				largest quantity of carbon dioxide;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID363caa149e9a4aff98ea9b984f387e60"><enum>(v)</enum><text display-inline="yes-display-inline">are combined with demonstrations of
				advanced coal electricity generation technologies;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDe8f758fa15af4c9282a37a6550610a98"><enum>(vi)</enum><text display-inline="yes-display-inline">demonstrate the greatest commitment on the
				part of the applicant to ensure funding for the proposed demonstration project
				and the greatest likelihood that the demonstration project will be maintained
				or expanded after Federal assistance under this subsection is completed;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID5f1c26a8333a44218783d8c43e677bb5"><enum>(vii)</enum><text display-inline="yes-display-inline">minimize any adverse environmental effects
				from the project.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2a44c721cd384fe6a591c7172a87fb08"><enum>(7)</enum><header display-inline="yes-display-inline">Period of grants</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID1fae4a00a3da424eb89362b7cd425857"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A geological disposal deployment project
				funded by a grant under this subsection shall begin construction not later than
				3 years after the date on which the grant is provided.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd4dc7e5ac5f948659b0693e4dd5fccfd"><enum>(B)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">The Administrator shall not provide grant
				funds to any applicant under this subsection for a period of more than 5
				years.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID84b7b3f4cbaf48219ceb1d2c86b34eca"><enum>(8)</enum><header display-inline="yes-display-inline">Transfer of information and
				knowledge</header><text display-inline="yes-display-inline">The Administrator
				shall establish mechanisms to ensure that the information and knowledge gained
				by participants in the program under this subsection are published and
				disseminated, including to other applicants that submitted applications for a
				grant under this subsection.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67c5f3f001904de7af9a3f59ef264109"><enum>(9)</enum><header display-inline="yes-display-inline">Schedule</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7474c26bf84d40389a8a3cac8b26aec7"><enum>(A)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this title, the Administrator shall publish in the Federal
				Register, and elsewhere as appropriate, a request for applications to carry out
				geological disposal deployment projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc98b7ea799544293a1885a31b1ec5657"><enum>(B)</enum><header display-inline="yes-display-inline">Date for applications</header><text display-inline="yes-display-inline">An application for a grant under this
				subsection shall be submitted not later than 180 days after the date of
				publication of the request under subparagraph (A).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb41e0b23153645e6af7bb410d817b053"><enum>(C)</enum><header display-inline="yes-display-inline">Selection</header><text display-inline="yes-display-inline">After the date by which applications for
				grants are required to be submitted under subparagraph (B), the Administrator,
				in a timely manner, shall select, after peer review and based on the criteria
				under paragraph (6), those geological disposal deployment projects to be
				provided a grant under this subsection.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID85fe8ee7cd2e4bce9f274733812b2313"><enum>(b)</enum><header display-inline="yes-display-inline">Interim standards</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, the Administrator, in consultation with the Secretary
				of Energy, shall, by regulation, establish interim geological carbon dioxide
				disposal standards that address—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID0e65fd8027f84f5da3064dd2ec330cf0"><enum>(1)</enum><text display-inline="yes-display-inline">site selection;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd527a390762b43b6a5748ec6f18a6f43"><enum>(2)</enum><text display-inline="yes-display-inline">permitting processes;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID915c64e559304998ac78c1e6ff9d7999"><enum>(3)</enum><text display-inline="yes-display-inline">monitoring requirements;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2ef89e10500f4b38a1ba2ab93628d1cb"><enum>(4)</enum><text display-inline="yes-display-inline">public participation; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb52185cc750e4ecf8cdca2450eb133f5"><enum>(5)</enum><text display-inline="yes-display-inline">such other issues as the Administrator and
				the Secretary of Energy determine to be appropriate.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB89F0DCC8B9B499C90C528ECE0B63758"><enum>(c)</enum><header display-inline="yes-display-inline">Final standards</header><text display-inline="yes-display-inline">Not later than 6 years after the date of
				enactment of this title, taking into account the results of geological disposal
				deployment projects carried out under subsection (a), the Administrator shall,
				by regulation, establish final geological carbon dioxide disposal
				standards.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4c4171abf2c64cf2a8353124ecd0d798"><enum>(d)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In developing standards under subsections
				(b) and (c), the Administrator shall consider the experience in the United
				States in regulating—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id23A4ED55E37241F9A5673E27F1A258D8"><enum>(1)</enum><text display-inline="yes-display-inline">underground injection of waste;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id234870CF8DB54FAB9011E7C9D026867D"><enum>(2)</enum><text display-inline="yes-display-inline">enhanced oil recovery;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30A81FC16377413390C1134BDDC7DEA6"><enum>(3)</enum><text display-inline="yes-display-inline">short-term storage of natural gas;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DB12CC227914B2D9F4A1E87CCD620D4"><enum>(4)</enum><text display-inline="yes-display-inline">long-term waste storage.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE9800FA0C22E41399BD545BB0BADD71E"><enum>(e)</enum><header display-inline="yes-display-inline">Termination of authority</header><text display-inline="yes-display-inline">This section and the authority provided by
				this section terminate on December 31, 2030.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id7957724D301C41AEB28E1AA67A76AE75" section-type="subsequent-section"><enum>711.</enum><header display-inline="yes-display-inline">Research and development</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID317ccda39b6a48d3809492f410bc4206"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall carry out a program
				to perform and support research on global climate change standards and
				processes, with the goals of—</text>

				704.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa4ec4b8c10b6487ba226d8442c5ee8e4"><enum>(b)</enum><header display-inline="yes-display-inline">Research program</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDf14a9224b54d41359cab462263b2391e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall carry out, directly
				or through the use of contracts or grants, a global climate change standards
				and processes research program.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa7cdbcfa30ac453e8ed71df315e36c85"><enum>(2)</enum><header display-inline="yes-display-inline">Research</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idE2E9FE85A7D6430A8E37FE985DFF294C"><enum>(A)</enum><header display-inline="yes-display-inline">Contents and priorities</header><text display-inline="yes-display-inline">The specific contents and priorities of the
				research program shall be determined in consultation with appropriate Federal
				agencies, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="idB4DFCC1A637A4580A995FB591F13D937"><enum>(i)</enum><text display-inline="yes-display-inline">the National Oceanic and Atmospheric
				Administration;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idA69DEB45AF8A489796DB23B57523A725"><enum>(ii)</enum><text display-inline="yes-display-inline">the National Aeronautics and Space
				Administration; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id392B89A32EE34A8D8E9133EF40291CC1"><enum>(iii)</enum><text display-inline="yes-display-inline">the Department of Energy.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30F5182F3BD24C0CAEE4ACCD82206A37"><enum>(B)</enum><header display-inline="yes-display-inline">Types of research</header><text display-inline="yes-display-inline">The research program shall include the
				conduct of basic and applied research—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID95a08c3a815e42c4b4904e35453ad2b0"><enum>(i)</enum><text display-inline="yes-display-inline">to develop and provide the enhanced
				measurements, calibrations, data, models, and reference material standards
				necessary to enable the monitoring of global warming pollution;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDb17d05ccd0924cd5a5a38e654808f172"><enum>(ii)</enum><text display-inline="yes-display-inline">to assist in establishing a baseline
				reference point for future trading in global warming pollutants (including the
				measurement of progress in emission reductions);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID5446f6dd01724a1384b4a1ff9735eab9"><enum>(iii)</enum><text display-inline="yes-display-inline">for international exchange as scientific or
				technical information for the stated purpose of developing mutually-recognized
				measurements, standards, and procedures for reducing global warming pollution;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID676b1e94ab5f4379aa9f0ac6d6ea8168"><enum>(iv)</enum><text display-inline="yes-display-inline">to assist in developing improved industrial
				processes designed to reduce or eliminate global warming pollution.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2e31939ff7d2445bb3c083c82bb8c91f"><enum>(3)</enum><header display-inline="yes-display-inline">Abrupt climate change research</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id3E6C1B46BF2145BAA56FEA5F344F3E15"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of abrupt climate
				change</header><text display-inline="yes-display-inline">In this paragraph, the
				term <term>abrupt climate change</term> means a change in climate that occurs
				so rapidly or unexpectedly that humans or natural systems may have difficulty
				adapting to the change.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43D5A2A8FB4041C2AB8D6BF9C67AB12B"><enum>(B)</enum><header display-inline="yes-display-inline">Research</header><text display-inline="yes-display-inline">The Administrator shall carry out a program
				of scientific research on potential abrupt climate change that is
				designed—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID01555fe899d04700aac409d3713e6057"><enum>(i)</enum><text display-inline="yes-display-inline">to develop a global array of terrestrial
				and oceanographic indicators of paleoclimate in order to identify and describe
				past instances of abrupt climate change;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6b0201ccad91443ba36bfaba41b085fd"><enum>(ii)</enum><text display-inline="yes-display-inline">to improve understanding of thresholds and
				nonlinearities in geophysical systems relating to the mechanisms of abrupt
				climate change;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDe43ea64a88e84d79a34d600ff58b6247"><enum>(iii)</enum><text display-inline="yes-display-inline">to incorporate those mechanisms into
				advanced geophysical models of climate change; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDaf4b0e52e0cd4f2c83903d789c412b29"><enum>(iv)</enum><text display-inline="yes-display-inline">to test the output of those models against
				an improved global array of records of past abrupt climate changes.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEAA53D760EEF488AB9CF28129B730ED8"><enum>(c)</enum><header display-inline="yes-display-inline">Sense of the Senate</header><text display-inline="yes-display-inline">It is the sense of the Senate that Federal
				funds for clean, low-carbon energy research, development, and deployment should
				be increased by at least 100 percent for each year during the 10-year period
				beginning on the date of enactment of this title.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id1D1CC3435F3940B9850FBFA002D32AC9" section-type="subsequent-section"><enum>712.</enum><header display-inline="yes-display-inline">Energy efficiency performance
				standard</header>
						<subsection commented="no" display-inline="no-display-inline" id="id16138240B57B4D64B69015D25928264A"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id5CBE3425A4ED48B18C00DC7D79B65DFC"><enum>(1)</enum><header display-inline="yes-display-inline">Electricity savings</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id243CAD1722D94FFCB827227AA6C06747"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>electricity savings</term>
				means reductions in end-use electricity consumption relative to consumption by
				the same customer or at the same new or existing facility in a given year, as
				defined in regulations promulgated by the Administrator under subsection
				(e).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa8ffb3e3d0e4c72b7c6c257a7f935dc"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>savings</term> includes
				savings achieved as a result of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDd9c4e9703d204560a1019dbee0e1ea8c"><enum>(i)</enum><text display-inline="yes-display-inline">installation of energy-saving technologies
				and devices; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDf9252701fdf14aa993c3736acd6652a4"><enum>(ii)</enum><text display-inline="yes-display-inline">the use of combined heat and power systems,
				fuel cells, or any other technology identified by the Administrator that
				recaptures or generates energy solely for onsite customer use.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BCF95C6B3F64869AFCD723EFB72DCDE"><enum>(C)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>savings</term> does not
				include savings from measures that would likely be adopted in the absence of
				energy-efficiency programs, as determined by the Administrator.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDafe590fee11a4804ac909290a1df36fe"><enum>(2)</enum><header display-inline="yes-display-inline">Retail electricity sales</header><text display-inline="yes-display-inline">The term <term>retail electricity
				sales</term> means the total quantity of electric energy sold by a retail
				electricity supplier to retail customers during the most recent calendar year
				for which that information is available.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfd4081506c31482794f2bb0ba10d7cd3"><enum>(3)</enum><header display-inline="yes-display-inline">Retail electricity supplier</header><text display-inline="yes-display-inline">The term <term>retail electricity
				supplier</term> means a distribution or integrated utility, or an independent
				company or entity, that sells electric energy to consumers.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdacbd1876a6042d3b0d86a3ac3e523d4"><enum>(b)</enum><header display-inline="yes-display-inline">Energy efficiency performance
				standard</header><text display-inline="yes-display-inline">Each retail
				electricity supplier shall implement programs and measures to achieve
				improvements in energy efficiency and peak load reduction, as verified by the
				Administrator.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDcaa87bc20c9242218f18b1fb7845ee99"><enum>(c)</enum><header display-inline="yes-display-inline">Targets</header><text display-inline="yes-display-inline">For calendar year 2008 and each calendar
				year thereafter, the Administrator shall ensure that retail electric suppliers
				annually achieve electricity savings and reduce peak power demand and
				electricity use by retail customers by a percentage that is not less than the
				applicable target percentage specified in the following table:</text>

				date</header><text display-inline="yes-display-inline">For the purpose of
				meeting the targets established under subsection (c), electricity savings shall
				be calculated based on the sum of—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id4B8C7B08B54B4F15AEBFA3BC54246EB4"><enum>(1)</enum><text display-inline="yes-display-inline">savings realized as a result of actions
				taken by the retail electric supplier during the specified calendar year;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id903AB6A8B9F74BCF9E9E2AA7A643A370"><enum>(2)</enum><text display-inline="yes-display-inline">cumulative savings realized as a result of
				electricity savings achieved in all previous calendar years (beginning with
				calendar year 2006).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDee4b6a60d5a345e28939a825937376fd"><enum>(e)</enum><header display-inline="yes-display-inline">Implementing regulations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idF0E8DEEB125B48AF990F6BE75299C71C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator shall promulgate regulations to
				implement the targets established under subsection (c).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07DFAC2AC1964954B8A4E385C643DFBF"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The regulations shall establish—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDa1177710b3984c74a7e408ff82f1f044"><enum>(A)</enum><text display-inline="yes-display-inline">a national credit system permitting credits
				to be awarded, bought, sold, or traded by and among retail electricity
				suppliers;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7a029c846d8d400cb1d53248b0b65cf0"><enum>(B)</enum><text display-inline="yes-display-inline">a fee equivalent to not less than 4 cents
				per kilowatt hour for retail energy suppliers that do not meet the targets
				established under subsection (c); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2758bb75730f4d0ca7d7913c1bf8fa87"><enum>(C)</enum><text display-inline="yes-display-inline">standards for monitoring and verification
				of electricity use and demand savings reported by the retail electricity
				suppliers.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id769267ABB1EB48578A83C685BB9E453A"><enum>(3)</enum><header display-inline="yes-display-inline">Consideration of transmission and
				distribution efficiency</header><text display-inline="yes-display-inline">In
				developing regulations under this subsection, the Administrator shall consider
				whether savings, in whole or part, achieved by retail electricity suppliers by
				improving the efficiency of electric distribution and use should be eligible
				for credits established under this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID92ab7fc8730749cc9beaf51e378d51b5"><enum>(f)</enum><header display-inline="yes-display-inline">Compliance with State law</header><text display-inline="yes-display-inline">Nothing in this section shall supersede or
				otherwise affect any State or local law requiring or otherwise relating to
				reductions in total annual electricity consumption, or peak power consumption,
				by electric consumers to the extent that the State or local law requires more
				stringent reductions than those required under this section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id7C9025CAC94442F687A20A0D55EAD0A3"><enum>(g)</enum><header display-inline="yes-display-inline">Voluntary participation</header><text display-inline="yes-display-inline">The Administrator may—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id6C0CC080B56F42F18872D8081D2623E4"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to the regulations promulgated
				under subsection (e)(1), issue a credit to any entity that is not a retail
				electric supplier if the entity implements electricity savings; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id856B967209EF4602868F61CA05BF1FBA"><enum>(2)</enum><text display-inline="yes-display-inline">in a case in which an entity described in
				paragraph (1) is a nonprofit or educational organization, provide to the entity
				1 or more grants in lieu of a credit.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDFCEC963B3FE34D7D8DC7AC598754C545" section-type="subsequent-section"><enum>713.</enum><header display-inline="yes-display-inline">Renewable portfolio standard</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID1697de44d0f94e85937e89f448ab67f7"><enum>(a)</enum><header display-inline="yes-display-inline">Renewable energy</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id466F8AA0485749A7977721D3F4E20B3A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
				Secretary of Energy, shall promulgate regulations defining the types and
				sources of renewable energy generation that may be carried out in accordance
				with this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe424267d1bea47c39fa5c24693379faa"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">In promulgating regulations under paragraph
				(1), the Administrator shall include of all types of renewable energy (as
				defined in section 203(b) of the Energy Policy Act of 2005 (42 U.S.C.
				15852(b))) other than energy generated from—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id602438F09612435F84B5345B0C1EC7A3"><enum>(A)</enum><text display-inline="yes-display-inline">municipal solid waste;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C06345448254FED9E59C057A5B99C4D"><enum>(B)</enum><text display-inline="yes-display-inline">wood contaminated with plastics or metals;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E31DFC9C07F4DD7BA7E5C1840792A87"><enum>(C)</enum><text display-inline="yes-display-inline">tires.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcea26cd32eee4276a9b725f37dc1748c"><enum>(b)</enum><header display-inline="yes-display-inline">Renewable energy requirement</header><text display-inline="yes-display-inline">Of the base quantity of electricity sold by
				each retail electric supplier to electric consumers during a calendar year, the
				quantity generated by renewable energy sources shall be not less than the
				following percentages:</text>

				program</header><text display-inline="yes-display-inline">Not later than 1 year
				after the date of enactment of this title, the Administrator shall
				establish—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id9002560FD3A44DD591EA85A8F757B47C"><enum>(1)</enum><text display-inline="yes-display-inline">a program to issue, establish the value of,
				monitor the sale or exchange of, and track renewable energy credits; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F6EA5747156486888AC58FE7A8CA87A"><enum>(2)</enum><text display-inline="yes-display-inline">penalties for any retail electric supplier
				that does not comply with this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID410854136267498097EB1C9AE08544D9"><enum>(d)</enum><header display-inline="yes-display-inline">Prohibition on double
				counting</header><text display-inline="yes-display-inline">A renewable energy
				credit issued under subsection (c)—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id093C65DA3C454B4682B273A359650543"><enum>(1)</enum><text display-inline="yes-display-inline">may be counted toward meeting the
				requirements of subsection (b) only once; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ECF994978B34C89BD26E773D4648DA8"><enum>(2)</enum><text display-inline="yes-display-inline">shall vest with the owner of the system or
				facility that generates the renewable energy that is covered by the renewable
				energy credit, unless the owner explicitly transfers the renewable energy
				credit.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID19E1C9C7AA364BFE9978FAB8E2A8BA27"><enum>(e)</enum><header display-inline="yes-display-inline">Sale under purpa contract</header><text display-inline="yes-display-inline">If the Administrator, after consultation
				with the Secretary of Energy, determines that a renewable energy generator is
				selling electricity to comply with this section to a retail electric supplier
				under a contract subject to section 210 of the Public Utilities Regulatory
				Policies Act of 1978 (16 U.S.C. 824a–3), the retail electric supplier shall be
				treated as the generator of the electric energy for the purposes of this title
				for the duration of the contract.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6C0C45213A73487DAD66D1D3958F7A65"><enum>(f)</enum><header display-inline="yes-display-inline">State
				programs</header><text display-inline="yes-display-inline">Nothing in this
				section precludes any State from requiring additional renewable energy
				generation under any State renewable energy program.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9BA758BCAEB3470284558D3139E5018B"><enum>(g)</enum><header display-inline="yes-display-inline">Voluntary participation</header><text display-inline="yes-display-inline">The Administrator may issue a renewable
				energy credit pursuant to subsection (c) to any entity that is not subject to
				this section only if the entity applying for the renewable energy credit meets
				the terms and conditions of this section to the same extent as retail electric
				suppliers subject to this section.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id569328AE7F37466EA0CED9D1BC2132BF" section-type="subsequent-section"><enum>714.</enum><header display-inline="yes-display-inline">Standards to account for biological
				sequestration of carbon</header>
						<subsection commented="no" display-inline="no-display-inline" id="idAF2B6EC9DB5E4D30BB3A3DF7D1FED2E6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of title, the Secretary of Agriculture, with the concurrence of the
				Administrator, shall establish standards for accrediting certified reductions
				in the emission of carbon dioxide through above-ground and below-ground
				biological sequestration activities.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idD1F06BF4FD954ECAA8293897DF9DCDE3"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The standards shall include—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID6b008a2a83d3499c933bc97ebe8a4f20"><enum>(1)</enum><text display-inline="yes-display-inline">a national biological carbon storage
				baseline or inventory; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7d2627bb979b4866a7e4efa73c4fdc28"><enum>(2)</enum><text display-inline="yes-display-inline">measurement, monitoring, and verification
				guidelines based on—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDbe8d3ff44ee74b49b135140fd1eb7f9d"><enum>(A)</enum><text display-inline="yes-display-inline">measurement of increases in carbon storage
				in excess of the carbon storage that would have occurred in the absence of a
				new management practice designed to achieve biological sequestration of
				carbon;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3707a65a6e440fa80eeced527d1bd62"><enum>(B)</enum><text display-inline="yes-display-inline">comprehensive carbon accounting
				that—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID5f78a51908e4431182d2c31cabec9818"><enum>(i)</enum><text display-inline="yes-display-inline">reflects sustained net increases in carbon
				reservoirs; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID7fb15290277d49359afcf83d92d41c7f"><enum>(ii)</enum><text display-inline="yes-display-inline">takes into account any carbon emissions
				resulting from disturbance of carbon reservoirs in existence as of the date of
				commencement of any new management practice designed to achieve biological
				sequestration of carbon;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1112d1b0c07742908277f2d7254e3c32"><enum>(C)</enum><text display-inline="yes-display-inline">adjustments to account for—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDf5afb1a2286548348f5225ba24c993ae"><enum>(i)</enum><text display-inline="yes-display-inline">emissions of carbon that may result at
				other locations as a result of the impact of the new biological sequestration
				management practice on timber supplies; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID52ccc2ed98ea49aa96f7e9e9485e6d7e"><enum>(ii)</enum><text display-inline="yes-display-inline">potential displacement of carbon emissions
				to other land owned by the entity that carries out the new biological
				sequestration management practice; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd25cf67543bd4e3d899e359f72af016c"><enum>(D)</enum><text display-inline="yes-display-inline">adjustments to reflect the expected carbon
				storage over various time periods, taking into account the likely duration of
				the storage of carbon in a biological reservoir.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE62BEA8711244061AA6DE7C024275372"><enum>(c)</enum><header display-inline="yes-display-inline">Updating of standards</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				establishment of the standards under subsection (a), and every 3 years
				thereafter, the Secretary of Agriculture shall update the standards to take
				into account the most recent scientific information.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id1750D54C13CB4A5990B7658078A199E9" section-type="subsequent-section"><enum>715.</enum><header display-inline="yes-display-inline">Global warming pollution reporting</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID4cba76281b434fb28362758377cf124a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this title, and annually thereafter, any entity considered to be a
				major stationary source (as defined in section 169A(g)) shall submit to the
				Administrator a report describing the emissions of global warming pollutants
				from the entity for the preceding calendar year.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3e68a746e7844495bdd85d35fde8b8f0"><enum>(b)</enum><header display-inline="yes-display-inline">Voluntary reporting</header><text display-inline="yes-display-inline">An entity that is not described in
				subsection (a) may voluntarily report the emissions of global warming
				pollutants from the entity to the Administrator.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDc16eb5c4c43c40f7b27e61524441a4ac"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements for reports</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id47BFE60F6AAF4E558C183F44721D4B15"><enum>(1)</enum><header display-inline="yes-display-inline">Expression of measurements</header><text display-inline="yes-display-inline">Each global warming pollution report
				submitted under this section shall express global warming pollution emissions
				in—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idCC39186943B3411DB8C4C86D036D7501"><enum>(A)</enum><text display-inline="yes-display-inline">metric tons of each global warming
				pollutant; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B57A0454137451C8B9583CC80B0BE37"><enum>(B)</enum><text display-inline="yes-display-inline">metric tons of the carbon dioxide
				equivalent of each global warming pollutant.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25159A9AB2CE471EB60BB74F3D1DFE94"><enum>(2)</enum><header display-inline="yes-display-inline">Electronic format</header><text display-inline="yes-display-inline">The information contained in a report
				submitted under this section shall be reported electronically to the
				Administrator in such form and to such extent as may be required by the
				Administrator.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE9C4ED4FFC344C88364492F485F0135"><enum>(3)</enum><header display-inline="yes-display-inline">De minimis exemption</header><text display-inline="yes-display-inline">The Administrator may specify the level of
				global warming pollution emissions from a source within a facility that shall
				be considered to be a de minimis exemption from the requirement to comply with
				this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID183c8cbc63e446eea072cf33d7583ae0"><enum>(d)</enum><header display-inline="yes-display-inline">Public availability of
				information</header><text display-inline="yes-display-inline">Not later than
				March 1 of the year after which the Administrator receives a report under this
				subsection from an entity, and annually thereafter, the Administrator shall
				make the information reported under this section available to the public
				through the Internet.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID38ecbecc6524477fad798c945d90bb41"><enum>(e)</enum><header display-inline="yes-display-inline">Protocols and methods</header><text display-inline="yes-display-inline">The Administrator shall, by regulation,
				establish protocols and methods to ensure completeness, consistency,
				transparency, and accuracy of data on global warming pollution emissions
				submitted under this section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb947514835e9477fbaff23b38efa00d0"><enum>(f)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">Regulations promulgated under this section
				may be enforced pursuant to section 113 with respect to any person that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idDBB55A00BB054DDB8DA64AFD358F2D7F"><enum>(1)</enum><text display-inline="yes-display-inline">fails to submit a report under this
				section; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA139100EFF354B2D8E33AC3D870F9D6C"><enum>(2)</enum><text display-inline="yes-display-inline">otherwise fails to comply with those
				regulations.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID005257daa0bc499f89e6161abda7a692" section-type="subsequent-section"><enum>716.</enum><header display-inline="yes-display-inline">Clean energy technology deployment in
				developing countries</header>
						<subsection commented="no" display-inline="no-display-inline" id="idD3BF1A79DC194669A9E08E92D60A3521"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID17945b3288d449f7b53e07b556d052e5"><enum>(1)</enum><header display-inline="yes-display-inline">Clean energy technology</header><text display-inline="yes-display-inline">The term <term>clean energy
				technology</term> means an energy supply or end-use technology that, over the
				lifecycle of the technology and compared to a similar technology already in
				commercial use in any developing country—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf16b8d5a84a94a118507833ff683f7a9"><enum>(A)</enum><text display-inline="yes-display-inline">is reliable; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID185cdb2cd72f4697a0e1a75677e24af2"><enum>(B)</enum><text display-inline="yes-display-inline">results in reduced emissions of global
				warming pollutants.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd864fbcd1a8843c2b6b673c823f752ef"><enum>(2)</enum><header display-inline="yes-display-inline">Developing country</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID60f5e94a67324609b396b9cb9fa598ca"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>developing country</term>
				means any country not listed in Annex I of the United Nations Framework
				Convention on Climate Change, done at New York on May 9, 1992.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe646d9de7f7d40e8869e9b596f9f127b"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>developing country</term>
				may include a country with an economy in transition, as determined by the
				Secretary.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D8463CBE4614035931CE3CF1038FF33"><enum>(3)</enum><header display-inline="yes-display-inline">Task Force</header><text display-inline="yes-display-inline">The term <term>Task Force</term> means the
				Task Force on International Clean, Low-Carbon Energy Cooperation established
				under subsection (b)(1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID57189f95d29448a5b1307e01b46ab976"><enum>(b)</enum><header display-inline="yes-display-inline">Task force</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDef05e92400794d93b98d542c491eab7d"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				enactment of this title, the President shall establish a task force to be known
				as the <quote>Task Force on International Clean, Low Carbon Energy
				Cooperation</quote>.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe938d6b533dc4bdaa13653fda60db438"><enum>(2)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Task Force shall be composed of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7fb3d17171704b26abf1e9c4592d0c41"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator and the Secretary of
				State, who shall serve jointly as Co-Chairpersons; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2c6545f077364b11b09588d613e90629"><enum>(B)</enum><text display-inline="yes-display-inline">representatives, appointed by the head of
				the respective Federal agency, of—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID7cd4561609414416acb9d6f62e6b1e2a"><enum>(i)</enum><text display-inline="yes-display-inline">the Department of Commerce;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID439f0238e6e04f2ba3a39a51f6ba497a"><enum>(ii)</enum><text display-inline="yes-display-inline">the Department of the Treasury;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDe8e2ebc9f11c4e1486aa4c2853a5a49d"><enum>(iii)</enum><text display-inline="yes-display-inline">the United States Agency for International
				Development;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDf9c62a050f4546c7b6dbd0ab7071b91c"><enum>(iv)</enum><text display-inline="yes-display-inline">the Export-Import Bank;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDee8c9a049a684d0b949e212bd650587f"><enum>(v)</enum><text display-inline="yes-display-inline">the Overseas Private Investment
				Corporation;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDc2b36600efa94a8f86786512d836e3ca"><enum>(vi)</enum><text display-inline="yes-display-inline">the Office of United States Trade
				Representative; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID0cd8f0eac9fd42a0bb23a7037881cf16"><enum>(vii)</enum><text display-inline="yes-display-inline">such other Federal agencies as are
				determined to be appropriate by the President.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDddcadc7c234a47ac92ddbe616f4e6f1f"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id75AA64B8E9AE4FA28EC1D2BA426D875E"><enum>(1)</enum><header display-inline="yes-display-inline">Initial strategy</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idCD6EA741354E4EBE8D5BA909E3E12D87"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Task Force shall develop and submit to the
				President an initial strategy—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID9e3a50e11b0e47b7a1d925e47c38f9e9"><enum>(i)</enum><text display-inline="yes-display-inline">to support the development and
				implementation of programs and policies in developing countries to promote the
				adoption of clean, low-carbon energy technologies and energy-efficiency
				technologies and strategies, with an emphasis on those developing countries
				that are expected to experience the most significant growth in global warming
				pollution emissions over the 20-year period beginning on the date of enactment
				of this title; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID31c0faa26eac4a7ea54b1f8978671f2f"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4B58E63680254F948CC592B9E40CF460"><enum>(I)</enum><text display-inline="yes-display-inline">open and expand clean, low-carbon energy
				technology markets; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id627635B490ED45E492103E910BAEF7A4" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">facilitate the export of that technology to
				developing countries.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf7ae337809b240db96ffcc71e8306b89"><enum>(B)</enum><header display-inline="yes-display-inline">Submission to congress</header><text display-inline="yes-display-inline">On receipt of the initial strategy from the
				Task Force under subparagraph (A), the President shall submit the initial
				strategy to Congress.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9e644564b1e406dbd980946f0253765"><enum>(2)</enum><header display-inline="yes-display-inline">Final
				strategy</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of submission of the initial strategy under paragraph (1),
				and every 2 years thereafter—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID13d72c9cfddf42e188f88760cae9dd21"><enum>(A)</enum><text display-inline="yes-display-inline">the Task Force shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID3f2d22c76a2d407cb0cb1e5c9986144a"><enum>(i)</enum><text display-inline="yes-display-inline">review and update the initial strategy;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDdf371eebaec949fabb0cf8e8fbe0cca5"><enum>(ii)</enum><text display-inline="yes-display-inline">report the results of the review and update
				to the President; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID333f9cf398dd4df487ec1f78ee327ccb"><enum>(B)</enum><text display-inline="yes-display-inline">the President shall submit to Congress a
				final strategy.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF81731AABAB418BAC4758C8C083A7E1"><enum>(3)</enum><header display-inline="yes-display-inline">Performance criteria</header><text display-inline="yes-display-inline">The Task Force shall develop and submit to
				the Administrator performance criteria for use in the provision of assistance
				under this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID978be904cbfa49aeb88d0f4c96e6ee50"><enum>(d)</enum><header display-inline="yes-display-inline">Provision of assistance</header><text display-inline="yes-display-inline">The Administrator may—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idB3B8DB08DDBF4D10B4923E3D33EA1A37"><enum>(1)</enum><text display-inline="yes-display-inline">provide assistance to developing countries
				for use in carrying out activities that are consistent with the priorities
				established in the final strategy; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e31c98c55e84a6eb831abc18474949f"><enum>(2)</enum><text display-inline="yes-display-inline">establish a pilot program that provides
				financial assistance for qualifying projects (as determined by the
				Administrator) in accordance with—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8A782834D7AB45D59B4EAC6ED3E5ED29"><enum>(A)</enum><text display-inline="yes-display-inline">the final strategy submitted under
				subsection (c)(2)(B); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77FFB2FD998C426ABE84DF88C81B8D6E"><enum>(B)</enum><text display-inline="yes-display-inline">any performance criteria developed by the
				Task Force under subsection (c)(3).</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3C3D0E942CD84BF1B8B017B84F3B1721" section-type="subsequent-section"><enum>717.</enum><header display-inline="yes-display-inline">Paramount interest waiver</header>
						<subsection commented="no" display-inline="no-display-inline" id="id006F8E65C7B7436DAFB651D2144AF170"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the President determines that a national
				security emergency exists and, in light of information that was not available
				as of the date of enactment of this title, that it is in the paramount interest
				of the United States to modify any requirement under this title to minimize the
				effects of the emergency, the President may, after opportunity for public
				notice and comment, temporarily adjust, suspend, or waive any regulations
				promulgated pursuant to this title to achieve that minimization.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id77092BFB2BDD41CDA13B72A3B7D4FDB7"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In making an emergency determination under
				subsection (a), the President shall, to the maximum extent practicable, consult
				with and take into account any advice received from—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id33FC6E2186004F2B9FF94DE520B19FF4"><enum>(1)</enum><text display-inline="yes-display-inline">the Academy;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA499B04A2FDD4EA9946472FB3CB9738C"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0334567B08B411AA2C64E3C0A5218FD"><enum>(3)</enum><text display-inline="yes-display-inline">the Administrator.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3A73075A6FF44ABBBD8B85219290FFC8"><enum>(c)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">An emergency determination under subsection
				(a) shall be subject to judicial review under section 307.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id438F9BAA2DDA4DFE8B04FAD68259804D" section-type="subsequent-section"><enum>718.</enum><header display-inline="yes-display-inline">Effect on other law</header><text display-inline="no-display-inline">Nothing in this title—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id655C46D682904BC3909528CD1AEFCC6C"><enum>(1)</enum><text display-inline="yes-display-inline">affects the ability of a State to take
				State actions to further limit climate change (except that section 209 shall
				apply to standards for vehicles); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB380B58180E46FC93F09254847A8B3F"><enum>(2)</enum><text display-inline="yes-display-inline">except as expressly provided in this
				title—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id0FD9F8A478844590A85A371B5669D9D0"><enum>(A)</enum><text display-inline="yes-display-inline">modifies or otherwise affects any
				requirement of this Act in effect on the day before the date of enactment of
				this title; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D26E48FD2364262A628AFA0409B09C1"><enum>(B)</enum><text display-inline="yes-display-inline">relieves any person of the responsibility
				to comply with this
				Act.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idAB226F283E58443DA913E1101AFB28C0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Renewable content of gasoline</header><text display-inline="no-display-inline">Section 211(o) of the Clean Air Act (as
			 amended by section 1501 of the Energy Policy Act of 2005 (Public Law 109–58;
			 119 Stat. 1067)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idC0386FC25EBF477CBDB2800C19508C2A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idBC586C7BA39140B59F098298C19316A7"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as
			 subparagraph (E); and</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idFAF2DDE064484DF58AC7ACBFB1368121"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)(i), by inserting

				emission standards established under subsections (a) and (b) of section

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC9581CAAAFE242488204C2A7D207D51E"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
				date</header><text display-inline="yes-display-inline">The regulations
				promulgated under paragraph (1) shall take effect with respect to motor
				vehicles sold by a manufacturer beginning in model year

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id6CF47FBD445047EE849BCEFDDC3AD657" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Federal fleet fuel economy</header><text display-inline="no-display-inline">Section 32917 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id707D8E52824C4F48AF7392FE687D2CA2" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="idDD271C9F8A86406E8953F84B06E4E2A8"><enum>(3)</enum><header display-inline="yes-display-inline">New vehicles</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE522AC08732E476F9C45BB8E056F1932"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B),
				each passenger vehicle purchased, or leased for a period of at least 60
				consecutive days, by an Executive agency after the date of enactment of this
				paragraph shall be as fuel-efficient as practicable.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id867B4B33932E42B4B61B3F5D86B654EE"><enum>(B)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">In an emergency situation, an Executive
				agency may submit to Congress a written request for a waiver of the requirement
				under paragraph
				(1).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id2F0512F1D2404E14BC96BC2F64A606F4" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">International negotiations and trade
			 restrictions</header><text display-inline="no-display-inline">It is the sense
			 of the Senate that the United States should act to reduce the health,
			 environmental, economic, and national security risks posed by global climate
			 change, and foster sustained economic growth through a new generation of
			 technologies, by—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDdc415f952bb64ae5a859bf13af169b17"><enum>(1)</enum><text display-inline="yes-display-inline">participating in negotiations under the
			 United Nations Framework Convention on Climate Change, done at New York May 9,
			 1992, and leading efforts in other international forums, with the objective of
			 securing participation of the United States in agreements that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDb543738d87ab4a8d95c62573dca41a31"><enum>(A)</enum><text display-inline="yes-display-inline">advance and protect the economic and
			 national security interests of the United States;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4ef2d1b801f44c73ad40d3d0ddc646e6"><enum>(B)</enum><text display-inline="yes-display-inline">establish mitigation commitments by all
			 countries that are major emitters of global warming pollution, in accordance
			 with the principle of <quote>common but differentiated
			 responsibilities</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0088281a0c4b4d61aa73b989bf6b0b76"><enum>(C)</enum><text display-inline="yes-display-inline">establish flexible international mechanisms
			 to minimize the cost of efforts by participating countries; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID305b778976944775a181942a25299aae"><enum>(D)</enum><text display-inline="yes-display-inline">achieve a significant long-term reduction
			 in global warming pollution emissions; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd0e905527c474f4ea9198f84169c07c6"><enum>(2)</enum><text display-inline="yes-display-inline">establishing a bipartisan Senate
			 observation group, the members of which should be designated by the Chairman
			 and Ranking Member of the Committee on Foreign Relations of the Senate, and
			 which should include the Chairman and Ranking Member of the Committee on
			 Environment and Public Works of the Senate—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idBBD928916527417EA1FF3A10F377ED58"><enum>(A)</enum><text display-inline="yes-display-inline">to monitor any international negotiations
			 on climate change; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id848FBF117A4F4AC3955B238A881FDB59"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure that the advice and consent
			 function of the Senate is exercised in a manner to facilitate timely
			 consideration of any applicable treaty submitted to the Senate.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id477E08FCCE654742A64EEF7141B4B414" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Report on trade and innovation
			 effects</header><text display-inline="no-display-inline">Not later than 2 years
			 after the date of enactment of this Act, and annually thereafter, the Secretary
			 of Commerce, in consultation with the United States Trade Representative, the
			 Secretary of the Treasury, the Secretary of Agriculture, the Secretary of
			 Energy, and the Administrator of the Environmental Protection Agency (referred
			 to in this section as the <term>Secretary</term>), shall prepare and submit to
			 Congress a report on the trade, economic, and technology innovation effects of
			 the failure of the United States to adopt measures that require or result in a
			 reduction in total global warming pollution emissions in the United States, in
			 accordance with the goals for the United States under the United Nations
			 Framework Convention on Climate Change, done at New York on May 9, 1992.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDd79b60dd035c4b95b3f05971bf3adf25" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Climate change in environmental impact
			 statements</header><text display-inline="no-display-inline">In any case in
			 which a Federal agency prepares an environmental impact statement or similar
			 analysis required under the National Environmental Policy Act of 1969 (42
			 U.S.C. 4321 et seq.), the Federal agency shall consider and evaluate—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID16232c25f7214736ae1dfe16943a3614"><enum>(1)</enum><text display-inline="yes-display-inline">the impact that the Federal action or
			 project necessitating the statement or analysis would have in terms of net
			 changes in global warming pollution emissions; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5d9bcb08d04941adb65e12db1cfaf4fb"><enum>(2)</enum><text display-inline="yes-display-inline">the ways in which climate changes may
			 affect the action or project in the short term and the long term.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDc2d46963239442f59aa76b2d8ed38d4d" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Corporate environmental disclosure of
			 climate change risks</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDcabab997c7104e00836c9cce31b16140"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Securities and Exchange Commission (referred to in
			 this section as the <term>Commission</term>) shall promulgate regulations in
			 accordance with section 13 of the Securities Exchange Act of 1934 (15 U.S.C.
			 78m) directing each issuer of securities under that Act to inform securities
			 investors of the risks relating to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd1a10da8e06a407fa0af6f1852b242ac"><enum>(1)</enum><text display-inline="yes-display-inline">the financial exposure of the issuer
			 because of the net global warming pollution emissions of the issuer; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd2af181bd43f4d5db9791922b721c5eb"><enum>(2)</enum><text display-inline="yes-display-inline">the potential economic impacts of global
			 warming on the interests of the issuer.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID556df606ac794f649280acfd707c6c45"><enum>(b)</enum><header display-inline="yes-display-inline">Uniform format for disclosure</header><text display-inline="yes-display-inline">In carrying out subsection (a), the
			 Commission shall enter into an agreement with the Financial Accounting
			 Standards Board, or another appropriate organization that establishes voluntary
			 standards, to develop a uniform format for disclosing to securities investors
			 information on the risks described in subsection (a).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa3e1abfd411b4f7aaf96aa778b04e674"><enum>(c)</enum><header display-inline="yes-display-inline">Interim interpretive release</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDca65b2569027426c9fd4ba08e776d941"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 enactment of this Act, the Commission shall issue an interpretive release
			 clarifying that under items 101 and 303 of Regulation S-K of the Commission
			 under part 229 of title 17, Code of Federal Regulations (as in effect on the
			 date of enactment of this Act)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDb8f80ea794d74c23aba8bdc4001215fe"><enum>(A)</enum><text display-inline="yes-display-inline">the commitments of the United States to
			 reduce emissions of global warming pollution under the United Nations Framework
			 Convention on Climate Change, done at New York on May 9, 1992, are considered
			 to be a material effect; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbd93ab4049e24d6fbee4a2ce782902df"><enum>(B)</enum><text display-inline="yes-display-inline">global warming constitutes a known
			 trend.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDab450c06cd2c463e8ae3412c7760ade6"><enum>(2)</enum><header display-inline="yes-display-inline">Period of effectiveness</header><text display-inline="yes-display-inline">The interpretive release issued under
			 paragraph (1) shall remain in effect until the effective date of the final
			 regulations promulgated under subsection (a).</text>
