		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Spring Basin Wilderness Act of
			 2008</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="IDdb55e9b041914490a108432f3dea21bc" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID44b0ec932e9e4cf5a5ca696d47ad3250"><enum>(1)</enum><header>Family
			 trust</header><text>The term <term>family trust</term> means the Bowerman
			 Family Trust, which is the owner of the land described in section
			 4(d)(2)(A).</text>
			</paragraph><paragraph id="ID5fa008e4b52f4eed9dd97adc26af4f04"><enum>(2)</enum><header>Keys</header><text>The
			 term <term>Keys</term> means Bob Keys, a resident of Portland, Oregon.</text>
			</paragraph><paragraph id="IDd08a46d05d5d48c4a2d1c0e4a4faa2e6"><enum>(3)</enum><header>McGreer</header><text>The
			 term <term>McGreer</term> means H. Kelly McGreer, a resident of Antelope,
			 Oregon.</text>
			</paragraph><paragraph id="ID09f1e7a0874b43e39030cf9b460a99b7"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="idD5E04DFAE01B4ADBA5BE352AE51D16B1"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text>
			</paragraph><paragraph id="ID67727f2dc33c49ca9c37d75c77bfbcbf"><enum>(6)</enum><header>Tribes</header><text>The
			 term <term>Tribes</term> means the Confederated Tribes of the Warm Springs
			 Indian Reservation, with offices in Warm Springs, Oregon.</text>
			</paragraph><paragraph id="id26AF9B4DEB344FDE9A0401EA876FE705"><enum>(7)</enum><header>Wilderness
			 map</header><text>The term <term>wilderness map</term> means the map entitled
			 <quote>Spring Basin Study Area with Exchange Proposals</quote> and dated May
			 22, 2008.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="ID667cd955a772495e88ce84029dee825f" reported-display-style="strikethrough"><enum>3.</enum><header>Spring basin
			 wilderness</header>
			<subsection id="IDcc9d83491ad049ac846d15d6afb4b6e6"><enum>(a)</enum><header>Designation</header><text>In
			 accordance with the Wilderness Act (16 U.S.C. 1131 et seq.), the approximately
			 8,661 acres of Bureau of Land Management land in the State, as depicted on the
			 wilderness map, is designated as wilderness and as a component of the National
			 Wilderness Preservation System, to be known as the <quote>Spring Basin
			 Wilderness</quote>.</text>
			</subsection><subsection id="IDb79adeaf3b4248f1a4aa7fa254791bab"><enum>(b)</enum><header>Administration
			 of wilderness</header>
				<paragraph id="ID8aaa8dd92f8640acb6bbfe1ed241c008"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, the Wilderness shall be
			 administered by the Secretary in accordance with the Wilderness Act (16 U.S.C.
			 1131 et seq.), except that—</text>
					<subparagraph id="id420AFE13265545BA9B2185B3DC8D2AEB"><enum>(A)</enum><text>any reference in
			 the Wilderness Act to the effective date of the Wilderness Act shall be
			 considered to be a reference to the date of enactment of this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84EBB4DDEBC84AA0A535F0D5A9D95738"><enum>(B)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary of the Interior.</text>
					</subparagraph></paragraph><paragraph id="IDb0e0617e3ebb4d81a86da4619714b39d"><enum>(2)</enum><header>Incorporation of
			 acquired land and interests</header><text>Any land or interest in land within
			 the boundary of the Wilderness that is acquired by the United States
			 shall—</text>
					<subparagraph id="ID62114f6aa4c647fd8bf80f4ec3213f3f"><enum>(A)</enum><text>become part of the
			 Wilderness; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8564c9b5b5b148929f76ec59e6e89b7c"><enum>(B)</enum><text>be managed in
			 accordance with this Act, the Wilderness Act (16 U.S.C. 1131 et seq.), and any
			 other applicable law.</text>
					</subparagraph></paragraph><paragraph id="ID170f362c0b124fa0890f3f1421364a30"><enum>(3)</enum><header>Grazing</header><text>The
			 grazing of domestic livestock in the Wilderness shall be administered in
			 accordance with—</text>
					<subparagraph id="ID60c536ad7d054710873b1f0c43a688e2"><enum>(A)</enum><text>section 4(d)(4) of
			 the Wilderness Act (16 U.S.C. 1133(d)(4));</text>
					</subparagraph><subparagraph id="id7405071A7AD74B8C9354AB5F9C6E4896"><enum>(B)</enum><text>the guidelines set
			 forth in the report of the Committee on Interior and Insular Affairs of the
			 House of Representatives accompanying H.R. 5487 of the 96th Congress (H. Rept.
			 96–617); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdb4ac657721445a2aed95c5d2167fa04"><enum>(C)</enum><text>the guidelines set
			 forth in Appendix A of the report of the Committee on Interior and Insular
			 Affairs of the House of Representatives accompanying H.R. 2570 of the 101st
			 Congress (H. Rept. 101–405).</text>
					</subparagraph></paragraph><paragraph id="ID692a727873ee4963a71bad347de32ebb"><enum>(4)</enum><header>Access to
			 non-Federal land</header><text>In accordance with the Wilderness Act (16 U.S.C.
			 1131 et seq.), the Secretary shall provide reasonable access to non-Federal
			 land within the boundaries of the Wilderness.</text>
				</paragraph><paragraph id="ID5ce7a03569c34babb9e41516f32903db"><enum>(5)</enum><header>State water
			 laws</header><text>Nothing in this section constitutes an exemption from State
			 water laws (including regulations).</text>
				</paragraph><paragraph commented="no" id="ID8f6de02fa42c44d985031a7717fb9a5a"><enum>(6)</enum><header>Tribal
			 rights</header><text>Nothing in this section—</text>
					<subparagraph commented="no" id="ID797c4059ee0a45809a0d7eea5beb624b"><enum>(A)</enum><text>affects, alters,
			 amends, repeals, interprets, extinguishes, modifies, or is in conflict
			 with—</text>
						<clause commented="no" id="idD11E28A4D52B48D09F7CA45B7F056804"><enum>(i)</enum><text>the treaty rights
			 of an Indian tribe, including the rights secured by the Treaty of June 25,
			 1855, between the United States and the Tribes and Bands of Middle Oregon (12
			 Stat. 963); or</text>
						</clause><clause commented="no" id="idDF9F3244AB8D4856AE9DB56C674EA8D0"><enum>(ii)</enum><text>any other rights
			 of an Indian tribe; or</text>
						</clause></subparagraph><subparagraph commented="no" id="IDe53fcf9ccb5e402c81e59ca7dda18ce2"><enum>(B)</enum><text>prevents,
			 prohibits, terminates, or abridges the exercise of treaty-reserved rights,
			 including the rights secured by the Treaty of June 25, 1855, between the United
			 States and the Tribes and Bands of Middle Oregon (12 Stat. 963)—</text>
						<clause commented="no" id="idA0BB9259EA9841F68872A84BD7F1D97A"><enum>(i)</enum><text>within the
			 boundaries of the Wilderness; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF93B5120425C43AAB750790E60B987C8"><enum>(ii)</enum><text>on land acquired
			 by the United States under this Act.</text>
						</clause></subparagraph></paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id9800BA4886AE446B88CD8CC81E60F4EB" reported-display-style="strikethrough"><enum>4.</enum><header>Land
			 exchanges</header>
			<subsection id="IDcd1a25527e5e4188b9bb0104710b7b9f"><enum>(a)</enum><header>Confederated
			 Tribes of the Warm Springs Indian Reservation land exchange</header>
				<paragraph id="ID3e18b085c13643c58ed9a8c21407b2c3"><enum>(1)</enum><header>Conveyance of
			 land</header><text>If the Tribes offer to convey to the United States all
			 right, title, and interest of the Tribes in and to the non-Federal land
			 described in paragraph (2)(A), the Secretary shall—</text>
					<subparagraph id="idB1985026B034452DBFDEC6C20E0AC37F"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id21E61F6FD56149D4A1B4C29A7C091BCC"><enum>(B)</enum><text>on receipt of
			 acceptable title to the non-Federal land and subject to valid existing rights,
			 convey to the Tribes all right, title, and interest of the United States in and
			 to the Federal land described in paragraph (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id6188678E81434E2DA4591A016BBBFF46"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id26D37341145B44D8A8E0FEFCA32E0F9A"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 3,635 acres of non-Federal land identified on the wilderness map
			 as <quote>Lands proposed for transfer from the CTWSIR to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id518598C2CD1B4CEB8BD5E060111AAF76"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 3,653 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 CTWSIR</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID5e4e9eeb81974109964641f3aa333415"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="ID977f70f7fb5c431d80888b1cc81c50a8"><enum>(b)</enum><header>McGreer land
			 exchange</header>
				<paragraph id="idD47248841613495EB7A43AC7D8BC8360"><enum>(1)</enum><header>Conveyance of
			 land</header><text>If McGreer offers to convey to the United States all right,
			 title, and interest of McGreer in and to the non-Federal land described in
			 paragraph (2)(A), the Secretary shall—</text>
					<subparagraph id="id7875E166519947D4A3528DDC75FD471D"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id88FBBBCA9DF648E783513B0CDBD27230"><enum>(B)</enum><text>on receipt of
			 acceptable title to the non-Federal land and subject to valid existing rights,
			 convey to McGreer all right, title, and interest of the United States in and to
			 the Federal land described in paragraph (2)(B).</text>
					</subparagraph></paragraph><paragraph id="idAFF03ACBF8A74292A77DA3D1415B470A"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id65B0B2B1B12640E89098402A6AB842C7"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 18 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from McGreer to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="idFE502F86C622462A83F429D283F2D87D"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 325 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 McGreer</quote>.</text>
					</subparagraph></paragraph><paragraph id="idB4DE8172415B46C5AA45D3BAB55EC872"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="ID02114818b26c4c798e20d0f91a1670e5"><enum>(c)</enum><header>Keys land
			 exchange</header>
				<paragraph id="idADF0BE94B5A84100969B5B2662D745EA"><enum>(1)</enum><header>Conveyance of
			 land</header><text>If Keys offers to convey to the United States all right,
			 title, and interest of Keys in and to the non-Federal land described in
			 paragraph (2)(A), the Secretary shall—</text>
					<subparagraph id="id2CC4868C951C40689A467C46ABE70D26"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id01FAB88F008044A7892F81ECFDB3E05F"><enum>(B)</enum><text>on receipt of
			 acceptable title to the non-Federal land and subject to valid existing rights,
			 convey to Keys all right, title, and interest of the United States in and to
			 the Federal land described in paragraph (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id2B1CAA85C5AA40278DD07367B98D223C"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id40B1B3BC711B4479B421A63A32413EE5"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 181 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from Keys to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id173D0BB13DF345F29D2390FAFCDD228C"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 183 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 Keys</quote>.</text>
					</subparagraph></paragraph><paragraph id="id224EB30885684F7DBF362DD569C0F1BE"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="ID1650760a362e42b4a3929a3eab02c339"><enum>(d)</enum><header>Bowerman land
			 exchange</header>
				<paragraph id="idA0C16303023B4DFE9D9B62817997AF3C"><enum>(1)</enum><header>Conveyance of
			 land</header><text>If the family trust offers to convey to the United States
			 all right, title, and interest of the family trust in and to the non-Federal
			 land described in paragraph (2)(A), the Secretary shall—</text>
					<subparagraph id="idECA7F0AF3BAF4D51956A16553B1FA027"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="idA0624F40635E483AA14F7BD4345FEE4A"><enum>(B)</enum><text>on receipt of
			 acceptable title to the non-Federal land and subject to valid existing rights,
			 convey to the family trust all right, title, and interest of the United States
			 in and to the Federal land described in paragraph (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id95CC3210B9894C2698F83BBDA7D1FDD6"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="idB54A7607D8FB4175B76AAADD4599B97A"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 34 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from Bowerman to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id867D948AC868460C9FE59EACBBBDB276"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 24 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 Bowerman</quote>.</text>
					</subparagraph></paragraph><paragraph id="id2D6042A01784470CBDEB9DEC02D1E5A9"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="IDd486bc685b234e8b9f5b402cbcd071d9"><enum>(e)</enum><header>Applicable
			 law</header><text>Except as otherwise provided in this section, the Secretary
			 shall carry out the land exchanges under this section in accordance with
			 section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1716).</text>
			</subsection><subsection id="IDf43fa480b59a423fa06108811c33274f"><enum>(f)</enum><header>Valuation,
			 Appraisals, and Equalization</header>
				<paragraph id="ID02e3ded5958a45318c50664552856966"><enum>(1)</enum><header>In
			 general</header><text>The value of the Federal land and the non-Federal land to
			 be conveyed in a land exchange under this section—</text>
					<subparagraph id="IDba31fb83e0ca482391b0a2319c3ce4f9"><enum>(A)</enum><text>shall be equal, as
			 determined by appraisals conducted in accordance with paragraph (2); or</text>
					</subparagraph><subparagraph id="IDcfa2d0d182ff43199907423cb7da8dbf"><enum>(B)</enum><text>if not equal,
			 shall be equalized in accordance with paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="IDa0df4176658e40ad886d192915dfd2a7"><enum>(2)</enum><header>Appraisals</header>
					<subparagraph id="IDf7c17f558d9646369a0772c1869c0623"><enum>(A)</enum><header>In
			 general</header><text>The Federal land and the non-Federal land to be exchanged
			 under this section shall be appraised by an independent, qualified appraiser
			 that is agreed to by the Secretary and the owner of the non-Federal land to be
			 exchanged.</text>
					</subparagraph><subparagraph id="ID66c30bff3e3042ca8382427a11462923"><enum>(B)</enum><header>Requirements</header><text>An
			 appraisal under subparagraph (A) shall be conducted in accordance with—</text>
						<clause id="ID21f1fc3585664126a07639107586ca17"><enum>(i)</enum><text>the Uniform
			 Appraisal Standards for Federal Land Acquisition; and</text>
						</clause><clause id="IDc81c1b23ffdb4f44839337104490e5ff"><enum>(ii)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice.</text>
						</clause></subparagraph></paragraph><paragraph id="ID0e99db03e19c496aa9fd6860c664d4e4"><enum>(3)</enum><header>Equalization</header>
					<subparagraph id="ID9c0622912b4241aea8b74f4679b279df"><enum>(A)</enum><header>In
			 general</header><text>If the value of the Federal land and the non-Federal land
			 to be conveyed in a land exchange under this section is not equal, the value
			 may be equalized by—</text>
						<clause id="IDa31acf04016246eba8c3e32e6e4b3ca5"><enum>(i)</enum><text>the Secretary
			 making a cash equalization payment to the owner of the non-Federal land;</text>
						</clause><clause id="IDdffffe6dc06046e7aaa419fa5d8f1922"><enum>(ii)</enum><text>the owner of the
			 non-Federal land making a cash equalization payment to the Secretary; or</text>
						</clause><clause id="IDa29fe5b23c0647728a7511bbc1e64b9d"><enum>(iii)</enum><text>reducing the
			 acreage of the Federal land or the non-Federal land to be exchanged, as
			 appropriate.</text>
						</clause></subparagraph><subparagraph id="ID5b1cc099a959434fa21de4ca48ba42f8"><enum>(B)</enum><header>Cash
			 equalization payments</header><text>Any cash equalization payments received by
			 the Secretary under subparagraph (A)(ii) shall be—</text>
						<clause id="idBEF075247F484BFEADDB0422E70ABBBF"><enum>(i)</enum><text>deposited in the
			 Federal Land Disposal Account established by section 206(a) of the Federal Land
			 Transaction Facilitation Act (43 U.S.C. 2305(a)); and</text>
						</clause><clause id="id64AC8866986B49FB9B8C9BD2206536D8"><enum>(ii)</enum><text>used in
			 accordance with that Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID546650dbec4b4464adb6f3497f3c48b3"><enum>(g)</enum><header>Conditions of
			 Exchange</header>
				<paragraph id="idBE5BE9296C8744F9A49EF17462AA1DD5"><enum>(1)</enum><header>In
			 general</header><text>As a condition of the conveyance of Federal land and
			 non-Federal land under this section, the Federal Government and the owner of
			 the non-Federal land shall equally share all costs relating to the land
			 exchange, including the costs of appraisals, surveys, and any necessary
			 environmental clearances.</text>
				</paragraph><paragraph id="ID2d24b84ff3414cbaba6e048fac23452d"><enum>(2)</enum><header>Valid existing
			 rights</header><text>The exchange of Federal land and non-Federal land under
			 this section shall be subject to any easements, rights-of-way, or other valid
			 encumbrances in existence on the date of enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe076f8eae3bc4d36a96b0af9363618a3"><enum>(h)</enum><header>Deadline for
			 completion of land exchange</header><text>It is the intent of Congress that the
			 land exchanges under this section shall be completed not later than 16 months
			 after the date of enactment of this Act.</text>
			</subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id0995870c-c000-4d0b-b202-0dd91cfea351" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Spring Basin Wilderness Act of
			 2008</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="id0e8d46b6-f74e-41a7-b458-47983d951e2b" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id55794c19-2be7-4c14-83a7-f7fe36095448"><enum>(1)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id1df723e5-45cc-4f79-8cbd-bdffd8e26554"><enum>(2)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text>
			</paragraph><paragraph id="id293ef303-b92d-4ca5-a30a-65a55c24e58a"><enum>(3)</enum><header>Tribes</header><text>The
			 term <term>Tribes</term> means the Confederated Tribes of the Warm Springs
			 Reservation of Oregon.</text>
			</paragraph><paragraph id="id5f6ffff4-bb81-41e3-83ea-a234f1edfee9"><enum>(4)</enum><header>Wilderness
			 map</header><text>The term <term>wilderness map</term> means the map entitled
			 <quote>Spring Basin Wilderness with Land Exchange Proposals</quote> and dated
			 September 3, 2008.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="id56818f1c-b377-4ea7-95e2-6c9f0e5f4ed0" reported-display-style="italic"><enum>3.</enum><header>Spring Basin
			 Wilderness</header>
			<subsection id="id14714753-fcc9-4e3b-8309-66ecf0df7adf"><enum>(a)</enum><header>Designation</header><text>In
			 accordance with the Wilderness Act (16 U.S.C. 1131 et seq.), the approximately
			 6,382 acres of Bureau of Land Management land in the State, as generally
			 depicted on the wilderness map, is designated as wilderness and as a component
			 of the National Wilderness Preservation System, to be known as the
			 <quote>Spring Basin Wilderness</quote>.</text>
			</subsection><subsection id="idb6d4d8b2-c924-4a35-a892-51787a234661"><enum>(b)</enum><header>Administration of
			 wilderness</header>
				<paragraph id="id2347bf40-bfcf-4db0-b4b9-cd9356f25f9c"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, the Spring Basin
			 Wilderness shall be administered by the Secretary in accordance with the
			 Wilderness Act (16 U.S.C. 1131 et seq.), except that—</text>
					<subparagraph id="id06cf9289-19cf-4817-b4be-b62df7faec44"><enum>(A)</enum><text>any reference in the
			 Wilderness Act to the effective date of that Act shall be considered to be a
			 reference to the date of enactment of this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffd0a34c-b1da-4a9e-a509-90e515a96d6d"><enum>(B)</enum><text>any reference in the
			 Wilderness Act to the Secretary of Agriculture shall be considered to be a
			 reference to the Secretary of the Interior.</text>
					</subparagraph></paragraph><paragraph id="id877a123e-2ace-4054-af1b-44894e0fd73b"><enum>(2)</enum><header>Incorporation of
			 acquired land and interests</header><text>Any land or interest in land within
			 the boundary of the Spring Basin Wilderness that is acquired by the United
			 States shall—</text>
					<subparagraph id="idb220affb-9a40-4bbe-b7dd-7c07501a8cbe"><enum>(A)</enum><text>become part of the Spring
			 Basin Wilderness; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8e89bb8-496e-41d3-9649-ca57160d290a"><enum>(B)</enum><text>be managed in accordance
			 with this Act, the Wilderness Act (16 U.S.C. 1131 et seq.), and any other
			 applicable law.</text>
					</subparagraph></paragraph><paragraph id="id839909e8-933c-4bcd-ba91-c1d2596f1d59"><enum>(3)</enum><header>Grazing</header><text>The
			 grazing of livestock in the Spring Basin Wilderness, if established before the
			 date of enactment of this Act, shall be permitted to continue subject to such
			 reasonable regulations as are considered necessary by the Secretary, in
			 accordance with—</text>
					<subparagraph id="id4af3fc1e-7b8b-471f-9d59-a1edaaabf2c8"><enum>(A)</enum><text>section 4(d)(4) of the
			 Wilderness Act (16 U.S.C. 1133(d)(4)); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5d5543f-bde1-4b4b-b608-52dcba6837ed"><enum>(B)</enum><text>the guidelines set forth
			 in Appendix A of the report of the Committee on Interior and Insular Affairs of
			 the House of Representatives accompanying H.R. 2570 of the 101st Congress (H.
			 Rept. 101–405).</text>
					</subparagraph></paragraph></subsection><subsection id="ID16dedb4c512f42699e35badb5de4f38b"><enum>(c)</enum><header>Map and legal
			 description</header>
				<paragraph id="ID8ca15f8e0ee64dddbfd4b4188a924416"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file a map and a legal description of the Spring
			 Basin Wilderness with—</text>
					<subparagraph id="ID1edbb42d6f4c4ba98da24a4075961b53"><enum>(A)</enum><text>the Committee on Energy
			 and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="IDe3f483bc22da407fa824be6765161594"><enum>(B)</enum><text>the Committee on Natural
			 Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="ID8c05fa8ea31b484dab1b97440ec100d0"><enum>(2)</enum><header>Force of
			 law</header><text>The map and legal description filed under paragraph (1) shall
			 have the same force and effect as if included in this Act, except that the
			 Secretary may correct any typographical errors in the map and legal
			 description.</text>
				</paragraph><paragraph id="IDfcba0c475d8444f08e298341500792e0"><enum>(3)</enum><header>Public
			 availability</header><text>The map and legal description filed under paragraph
			 (1) shall be on file and available for public inspection in the appropriate
			 offices of the Bureau of Land Management.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID15688587ab3b4071aae4e0baa3445156" reported-display-style="italic"><enum>4.</enum><header>Release</header>
			<subsection id="ID1004920148c84625b6c046dd08aea170"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that, for the purposes of section 603(c) of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1782(c)), the portions of the Spring Basin
			 wilderness study area that are not designated by section 3(a) as the Spring
			 Basin Wilderness in the following areas have been adequately studied for
			 wilderness designation:</text>
				<paragraph id="IDaff7395f68c74695b428d49f0ee051e4"><enum>(1)</enum><text>T. 8 S., R. 19 E., sec.
			 10, NE ¼, W ½.</text>
				</paragraph><paragraph id="IDde1e3015bcb740ddad11b3744d40479f"><enum>(2)</enum><text>T. 8 S., R.19 E., sec.
			 25, SE ¼, SE ¼.</text>
				</paragraph><paragraph id="ID40b23d5d59f34473a2695ce801af2aa7"><enum>(3)</enum><text>T. 8 S., R. 20 E., sec.
			 19, SE ¼, S ½ of the S ½.</text>
				</paragraph></subsection><subsection id="ID35a1daf02dac4d5e959206232dd9460d"><enum>(b)</enum><header>Release</header><text>Any
			 public land described in subsection (a) that is not designated as wilderness by
			 this Act—</text>
				<paragraph id="ID649d815de7524cfdbadc38d74dcd53e0"><enum>(1)</enum><text>is no longer subject to
			 section 603(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1782(c)); and</text>
				</paragraph><paragraph id="ID84e3e4b12c8a482ab609ce0851bba838"><enum>(2)</enum><text>shall be managed in
			 accordance with the applicable land use plan adopted under section 202 of that
			 Act (43 U.S.C. 1712).</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id705fa6d4-b98a-4b87-884f-c727e92bc332" reported-display-style="italic"><enum>5.</enum><header>Land exchanges</header>
			<subsection id="ide5b5f7ca-1681-481a-89d2-90119256dc60"><enum>(a)</enum><header>Confederated Tribes of
			 the Warm Springs Reservation land exchange</header>
				<paragraph id="id19cc49a2-485b-4cdd-8264-1f3d0b187f70"><enum>(1)</enum><header>Conveyance of
			 land</header><text>Subject to subsections (e) through (g), if the Tribes offer
			 to convey to the United States all right, title, and interest of the Tribes in
			 and to the non-Federal land described in paragraph (2)(A), the Secretary
			 shall—</text>
					<subparagraph id="id1764d989-954e-40fa-968e-cf067e56371e"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id132aa847-9d9d-409c-aa9d-3ceb2a4dc4c3"><enum>(B)</enum><text>on receipt of acceptable
			 title to the non-Federal land, convey to the Tribes all right, title, and
			 interest of the United States in and to the Federal land described in paragraph
			 (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id3f953fed-d6eb-4e88-b590-e0a262c943de"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id965d549d-0313-4d6b-a06a-1aa71941ae88"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 4,480 acres of non-Federal land identified on the wilderness map
			 as <quote>Lands proposed for transfer from the CTWSIR to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id6c072639-e335-4026-986d-95286d0a7e17"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 4,578 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 CTWSIR</quote>.</text>
					</subparagraph></paragraph><paragraph id="idde4d0941-ec4d-4d23-b359-921598a20630"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph><paragraph id="ID2ff9658abdf248e29e4fa070222b0002"><enum>(4)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the land acquired by the Secretary under this
			 subsection is withdrawn from all forms of—</text>
					<subparagraph id="ID300a11b89294497fb33918e603a723b7"><enum>(A)</enum><text>entry, appropriation, or
			 disposal under the public land laws;</text>
					</subparagraph><subparagraph id="ID8a02dbab9db84ad4bcdc96a7de0057b3"><enum>(B)</enum><text>location, entry, and
			 patent under the mining laws; and</text>
					</subparagraph><subparagraph id="ID647aa4e72de24eca89a1b59a27aea3e9"><enum>(C)</enum><text>disposition under any law
			 relating to mineral and geothermal leasing or mineral materials.</text>
					</subparagraph></paragraph></subsection><subsection id="id8ce4333d-e062-4894-9bf1-6a9f4230bcda"><enum>(b)</enum><header>McGreer land
			 exchange</header>
				<paragraph id="id24864a3b-0601-4919-af4c-8d86a17ec02b"><enum>(1)</enum><header>Conveyance of
			 land</header><text>Subject to subsections (e) through (g), if the landowner
			 offers to convey to the United States all right, title, and interest of the
			 landowner in and to the non-Federal land described in paragraph (2)(A), the
			 Secretary shall—</text>
					<subparagraph id="ide965536a-3120-4b9c-96ea-260f1469d1e5"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id77947c0c-b97c-4f07-9021-78903e21044d"><enum>(B)</enum><text>on receipt of acceptable
			 title to the non-Federal land, convey to the landowner all right, title, and
			 interest of the United States in and to the Federal land described in paragraph
			 (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id42b3fd27-af82-4803-b2a4-dbf751589978"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id2b84d35c-7f26-4652-ba8c-07658d53cf64"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 18 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from McGreer to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="idaa20dc65-1fb3-4101-852c-8dd7dbcb92ac"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 327 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 McGreer</quote>.</text>
					</subparagraph></paragraph><paragraph id="id29c8c1dc-eb8d-4904-ba00-cc14c32909b3"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="idce6f0351-e407-4487-8fd6-93d9fdf87882"><enum>(c)</enum><header>Keys land
			 exchange</header>
				<paragraph id="idf02ab958-92c8-472b-8b4a-c51db053dd7b"><enum>(1)</enum><header>Conveyance of
			 land</header><text>Subject to subsections (e) through (g), if the landowner
			 offers to convey to the United States all right, title, and interest of the
			 landowner in and to the non-Federal land described in paragraph (2)(A), the
			 Secretary shall—</text>
					<subparagraph id="id48f1ca6f-eeb7-4f16-a544-8b4661831bb3"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id360f1216-41e8-49f4-b452-8e31cc69f6b2"><enum>(B)</enum><text>on receipt of acceptable
			 title to the non-Federal land, convey to the landowner all right, title, and
			 interest of the United States in and to the Federal land described in paragraph
			 (2)(B).</text>
					</subparagraph></paragraph><paragraph id="id61fb45f0-102d-4b62-8d0f-73e6f35f873d"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="id12d78f97-9587-4b72-8582-bebc1ecb145a"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 180 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from Keys to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id2148e22a-ac4c-4fc7-9e39-080508f9af5e"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 187 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 Keys</quote>.</text>
					</subparagraph></paragraph><paragraph id="id623917d1-7beb-4cce-83c7-119706c8b389"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="id3a0e5f1a-06a6-4f4c-9632-76f12c29d4e2"><enum>(d)</enum><header>Bowerman land
			 exchange</header>
				<paragraph id="id39861b5b-d98a-4f68-802b-5d300a07eee3"><enum>(1)</enum><header>Conveyance of
			 land</header><text>Subject to subsections (e) through (g), if the landowner
			 offers to convey to the United States all right, title, and interest of the
			 landowner in and to the non-Federal land described in paragraph (2)(A), the
			 Secretary shall—</text>
					<subparagraph id="id52146093-549d-425f-91b8-05f163b6ade1"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id3544a1f3-e8ec-41c4-a702-f374d2bc041c"><enum>(B)</enum><text>on receipt of acceptable
			 title to the non-Federal land, convey to the landowner all right, title, and
			 interest of the United States in and to the Federal land described in paragraph
			 (2)(B).</text>
					</subparagraph></paragraph><paragraph id="idcbecef3a-152c-4a8f-bac3-40865fb8b9d2"><enum>(2)</enum><header>Description of
			 land</header>
					<subparagraph id="idd0cc8acf-aaa9-4c95-89cb-beb7cc780733"><enum>(A)</enum><header>Non-Federal
			 land</header><text>The non-Federal land referred to in paragraph (1) is the
			 approximately 32 acres of non-Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from Bowerman to the Federal
			 Government</quote>.</text>
					</subparagraph><subparagraph id="id7882ce58-20ec-4aac-a47f-ac0281d896af"><enum>(B)</enum><header>Federal
			 land</header><text>The Federal land referred to in paragraph (1)(B) is the
			 approximately 24 acres of Federal land identified on the wilderness map as
			 <quote>Lands proposed for transfer from the Federal Government to
			 Bowerman</quote>.</text>
					</subparagraph></paragraph><paragraph id="id1787bca8-e2ab-442f-a0cd-2a0607a56eae"><enum>(3)</enum><header>Surveys</header><text>The
			 exact acreage and legal description of the Federal land and non-Federal land
			 described in paragraph (2) shall be determined by surveys approved by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="idfea97a58-92ac-4e71-bdd4-ae2091fb39d0"><enum>(e)</enum><header>Applicable
			 law</header><text>Except as otherwise provided in this section, the Secretary
			 shall carry out the land exchanges under this section in accordance with
			 section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1716).</text>
			</subsection><subsection id="id6b5a8b43-6088-4b4c-9bdd-5627d695ee89"><enum>(f)</enum><header>Valuation, Appraisals,
			 and Equalization</header>
				<paragraph id="ideae29da8-9fde-4592-a9e6-cf48ec4f7dc8"><enum>(1)</enum><header>In
			 general</header><text>The value of the Federal land and the non-Federal land to
			 be conveyed in a land exchange under this section—</text>
					<subparagraph id="idac3809b8-5d6c-4cb3-a0e7-0595840df83a"><enum>(A)</enum><text>shall be equal, as
			 determined by appraisals conducted in accordance with paragraph (2); or</text>
					</subparagraph><subparagraph id="id29c1195a-01bd-44c6-87a3-e22c435bc064"><enum>(B)</enum><text>if not equal, shall be
			 equalized in accordance with paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="idb226ef16-4082-431d-a64c-2d0718aebdc4"><enum>(2)</enum><header>Appraisals</header>
					<subparagraph id="ida99dd910-61db-4f67-bbc9-53616f37dfc4"><enum>(A)</enum><header>In
			 general</header><text>The Federal land and the non-Federal land to be exchanged
			 under this section shall be appraised by an independent, qualified appraiser
			 that is agreed to by the Secretary and the owner of the non-Federal land to be
			 exchanged.</text>
					</subparagraph><subparagraph id="id702f91b7-0161-4396-84b9-e96c3c33d94a"><enum>(B)</enum><header>Requirements</header><text>An
			 appraisal under subparagraph (A) shall be conducted in accordance with—</text>
						<clause id="iddbfca01c-483a-46a3-a9a6-59330ef2b894"><enum>(i)</enum><text>the Uniform Appraisal
			 Standards for Federal Land Acquisitions; and</text>
						</clause><clause id="id026870db-ac11-4d4f-b470-49a31271dfa3"><enum>(ii)</enum><text>the Uniform Standards of
			 Professional Appraisal Practice.</text>
						</clause></subparagraph></paragraph><paragraph id="id0e1402b3-a282-4485-b224-12e43de38d44"><enum>(3)</enum><header>Equalization</header>
					<subparagraph id="id2e091b79-e32b-4d9e-8897-42173db46ad6"><enum>(A)</enum><header>In
			 general</header><text>If the value of the Federal land and the non-Federal land
			 to be conveyed in a land exchange under this section is not equal, the value
			 may be equalized by—</text>
						<clause id="id6f24e2df-2b9c-4a7c-81df-cf5832362bc9"><enum>(i)</enum><text>making a cash
			 equalization payment to the Secretary or to the owner of the non-Federal land,
			 as appropriate, in accordance with section 206(b) of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1716(b)); or</text>
						</clause><clause id="id3a107b51-e768-4022-904c-e0391a916719"><enum>(ii)</enum><text>reducing the acreage of
			 the Federal land or the non-Federal land to be exchanged, as
			 appropriate.</text>
						</clause></subparagraph><subparagraph id="idda00e7c8-0707-4559-bd33-3ed916a4a517"><enum>(B)</enum><header>Cash equalization
			 payments</header><text>Any cash equalization payments received by the Secretary
			 under subparagraph (A)(i) shall be—</text>
						<clause id="id2160b5b4-c7f7-47dc-a3c7-465a54d2e5bf"><enum>(i)</enum><text>deposited in the Federal
			 Land Disposal Account established by section 206(a) of the Federal Land
			 Transaction Facilitation Act (43 U.S.C. 2305(a)); and</text>
						</clause><clause id="id177b993f-40a0-4fe3-a741-6d1c5f7c1f37"><enum>(ii)</enum><text>used in accordance with
			 that Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ida1018ebe-5462-45d7-970e-26e72e1bce70"><enum>(g)</enum><header>Conditions of
			 Exchange</header>
				<paragraph id="id48C3371BE4EB4879B0E321A093E1E14C"><enum>(1)</enum><header>In
			 general</header><text>The land exchanges under this section shall be subject to
			 such terms and conditions as the Secretary may require.</text>
				</paragraph><paragraph id="id806a0fae-bed9-4360-8e34-97b74e9bcbea"><enum>(2)</enum><header>Costs</header><text>As
			 a condition of a conveyance of Federal land and non-Federal land under this
			 section, the Federal Government and the owner of the non-Federal land shall
			 equally share all costs relating to the land exchange, including the costs of
			 appraisals, surveys, and any necessary environmental clearances.</text>
				</paragraph><paragraph id="id4356bcdb-4265-4da2-8ba2-abed981beabb"><enum>(3)</enum><header>Valid existing
			 rights</header><text>The exchange of Federal land and non-Federal land under
			 this section shall be subject to any easements, rights-of-way, and other valid
			 rights in existence on the date of enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9add0d0a-1c1b-4c89-9c96-3b4e3f94b40f"><enum>(h)</enum><header>Completion of land
			 exchange</header><text>It is the intent of Congress that the land exchanges
			 under this section shall be completed not later than 2 years after the date of
			 enactment of this Act.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="IDd008d50c67624806b8f6c1bf02ac6f0e" reported-display-style="italic"><enum>6.</enum><header>Protection of tribal
			 treaty rights</header><text display-inline="no-display-inline">Nothing in this
			 Act alters, modifies, enlarges, diminishes, or abrogates the treaty rights of
			 any Indian tribe, including the off-reservation reserved rights secured by the
			 Treaty with the Tribes and Bands of Middle Oregon of June 25, 1855 (12 Stat.
			 963).</text>
