			 <quote><short-title>Cooperative Watershed Management Act
			 of 2008</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="ID8df2591b17e84b9687f54ef27b4c8efd" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idD0E0B62D1C9942CCA4C3C0C02D59969D"><enum>(1)</enum><header>Affected
			 stakeholder</header><text>The term <term>affected stakeholder</term> means an
			 entity that significantly affects, or is significantly affected by, the quality
			 or quantity of water in a watershed, as determined by the Secretary.</text>
			</paragraph><paragraph id="id734E211AB2C64E2CA82A8F8D02D06710"><enum>(2)</enum><header>Grant
			 recipient</header><text>The term <term>grant recipient</term> means an eligible
			 management entity that the Secretary has selected to receive a grant under
			 section 3(c)(2).</text>
			</paragraph><paragraph id="id852182A09D53415D946507FB96D9DD4E"><enum>(3)</enum><header>Management
			 group</header><text>The term <term>management group</term> means a
			 self-sustaining, cooperative watershed-wide management group that—</text>
				<subparagraph id="idB3EA1BFC89CD4ED5BC3C84B7245C13F0"><enum>(A)</enum><text>is comprised of
			 each affected stakeholder of the watershed that is the subject of the
			 management group;</text>
				</subparagraph><subparagraph id="id25EF54555287470EA14B2220F0DE4CDC"><enum>(B)</enum><text>incorporates the
			 perspectives of a diverse array of stakeholders;</text>
				</subparagraph><subparagraph id="idCEA5BF0AC18242CABF4471458EEF73B1"><enum>(C)</enum><text>is designed to be
			 carried out as a grassroots, nonregulatory entity to address local water
			 availability and quality issues within the watershed that is the subject of the
			 management group; and</text>
				</subparagraph><subparagraph id="id911E6DE2AA02433291059819E840B16A"><enum>(D)</enum><text>is capable of
			 managing in a sustainable manner the water resources of the watershed that is
			 the subject of the management group and improving the functioning condition of
			 rivers and streams through—</text>
					<clause id="idDFFEED019C99468FB4F22CBB55586412"><enum>(i)</enum><text>water
			 conservation;</text>
					</clause><clause id="id197A15F0CF9643A89DCEB61076007E58"><enum>(ii)</enum><text>improved water
			 quality;</text>
					</clause><clause id="idB2CA53F327714C3F8335A9B42989E0E9"><enum>(iii)</enum><text>ecological
			 resiliency; and</text>
					</clause><clause id="id47FD405E519B46EF8099288C6D600B2B"><enum>(iv)</enum><text>the reduction of
			 water conflicts.</text>
					</clause></subparagraph></paragraph><paragraph id="id52EEEA83214946A3B213DDB5E1CCF5D6"><enum>(4)</enum><header>Program</header><text>The
			 term <term>program</term> means the cooperative watershed management program
			 established by the Secretary under section 3(a).</text>
			</paragraph><paragraph id="id02EA212089BE45688F6E182F49441FBD"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="ID81b5b53464da45b6b7df7a3c60092b26" reported-display-style="strikethrough"><enum>3.</enum><header>Program</header>
			<subsection id="idA7D54B4849E04C588AF2312B0BDDF20F"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall establish a program, which shall be known as the <quote>cooperative
			 watershed management program</quote>, under which the Secretary shall provide
			 grants to eligible management entities—</text>
				<paragraph id="id944007103FC441A9A2B55563BFA223AB"><enum>(1)</enum><text>to form a
			 management group;</text>
				</paragraph><paragraph id="id6D67FAB9F3304FE3A7042396FB7B2F08"><enum>(2)</enum><text>to enlarge a
			 management group, of which the eligible management entity is a member;
			 or</text>
				</paragraph><paragraph id="idC36577AA4F4845C8B567712D19F03586"><enum>(3)</enum><text>to conduct 1 or
			 more projects in accordance with the goals of a management group, of which the
			 eligible management entity is a member.</text>
				</paragraph></subsection><subsection id="ID616691cdad9f42b2a4674baca677c85f"><enum>(b)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section, an eligible management
			 entity shall be comprised of each affected stakeholder of the watershed that is
			 the subject of the eligible management entity, including to the maximum extent
			 practicable—</text>
				<paragraph id="idA8F5D5B06D854449A31D5F51BA5552ED"><enum>(1)</enum><text>representatives of
			 private interests, including representatives of—</text>
					<subparagraph id="idF533DAB4216E4072AFBFF8D3B65DD8A0"><enum>(A)</enum><text>hydroelectric
			 production;</text>
					</subparagraph><subparagraph id="id8E01B0D0F02F4124B84F51492FD2C0D5"><enum>(B)</enum><text>livestock
			 grazing;</text>
					</subparagraph><subparagraph id="id1B41F1F8EFFD4972BC729FC87D8EB7C2"><enum>(C)</enum><text>timber
			 production;</text>
					</subparagraph><subparagraph id="id1CC744225EB64BC392D9D38A2CE4C120"><enum>(D)</enum><text>land
			 development;</text>
					</subparagraph><subparagraph id="id7DDD87D1B26346C58051F90DC4632A82"><enum>(E)</enum><text>recreation or
			 tourism;</text>
					</subparagraph><subparagraph id="id1C8EBA1339EE4053B6F4AD357D8B9073"><enum>(F)</enum><text>irrigated
			 agricultural production; and</text>
					</subparagraph><subparagraph id="idFCC846BF685B4C0EA97336B5046B1631"><enum>(G)</enum><text>the
			 environment;</text>
					</subparagraph></paragraph><paragraph id="id36C30CA51A414D17AF562FC82E68539D"><enum>(2)</enum><text>any Federal agency
			 that has authority with respect to the watershed, including not less than 1
			 representative of—</text>
					<subparagraph id="idB7DDFE829291464E8722D389CDF3C626"><enum>(A)</enum><text>the Department of
			 Agriculture;</text>
					</subparagraph><subparagraph id="id3C38EE8B3AC5463E8DEA2E728EFD4218"><enum>(B)</enum><text>the Department of
			 the Interior; and</text>
					</subparagraph><subparagraph id="id545DC52DCCDB475D9B043E21E0E4FE59"><enum>(C)</enum><text>the National
			 Oceanic and Atmospheric Administration;</text>
					</subparagraph></paragraph><paragraph id="id815AB4E463D74A1489687A91C0F84DA1"><enum>(3)</enum><text>any State or local
			 agency that has authority with respect to the watershed; and</text>
				</paragraph><paragraph id="idBE5CDF3F94864A03A771FA43B3454C1C"><enum>(4)</enum><text>any member of an
			 Indian tribe that owns land within the watershed or has land in the watershed
			 held in trust.</text>
				</paragraph></subsection><subsection id="idCEC9C081991F4F2E99120EC28BF4F317"><enum>(c)</enum><header>Application</header>
				<paragraph id="id28BD41203EEE4E5C871C344E544E781A"><enum>(1)</enum><header>Establishment of
			 application process; criteria</header><text>Not later than 1 year after the
			 date of enactment of this Act, the Secretary shall establish—</text>
					<subparagraph id="id589FDA85FD75420CBF931C8DAF82A312"><enum>(A)</enum><text>an application
			 process under which each eligible management entity may apply for a grant under
			 this section; and</text>
					</subparagraph><subparagraph id="id0E2F84A612574D4796E4751F37EC0C4E"><enum>(B)</enum><text>criteria for
			 consideration of the application of each eligible management entity.</text>
					</subparagraph></paragraph><paragraph id="ID2ab78ca7d2544d1db13e53240b870d68"><enum>(2)</enum><header>Application
			 process</header><text>To be eligible to receive a grant under this section, an
			 eligible management entity shall submit to the Secretary an application in
			 accordance with the application process and criteria established by the
			 Secretary under paragraph (1).</text>
				</paragraph></subsection><subsection id="ID7f9bef9aef9c4c64892a89aefd0921ed"><enum>(d)</enum><header>Distribution of
			 grant funds</header>
				<paragraph id="ID7b7db3cdbf0e45b881e63689b8f9c999"><enum>(1)</enum><header>In
			 general</header><text>In distributing grant funds under this section, the
			 Secretary shall comply with paragraph (2).</text>
				</paragraph><paragraph id="idAD1993F7A1464A5DA9A1F52131067CB8"><enum>(2)</enum><header>Funding
			 procedure</header>
					<subparagraph id="id8727FCF6FDDB4E5AA194E8D3599DCB7E"><enum>(A)</enum><header>First
			 phase</header>
						<clause id="idB2AEEFB8C41A477C8A7ACFFE73C241DD"><enum>(i)</enum><header>In
			 general</header><text>During the first phase of a grant established under this
			 subparagraph, the Secretary may provide to a grant recipient a grant in an
			 amount of not greater than $100,000 each year for a period of not more than 3
			 years.</text>
						</clause><clause id="id58EBBF5E8B98485A9FAFBA9ABF87D9FB"><enum>(ii)</enum><header>Mandatory use
			 of funds</header><text>A grant recipient that receives funds through a grant
			 during the first phase shall use the funds—</text>
							<subclause id="id2DB208A253D34041BC30E14EA42CBB2F"><enum>(I)</enum><text>to establish or
			 enlarge a management group;</text>
							</subclause><subclause id="id83090519BB8D42AEAB1A02208C77AAEB"><enum>(II)</enum><text>to develop a
			 mission statement for the management group; and</text>
							</subclause><subclause id="id596DDCA7834C400EB8848F20BE7A6F1C"><enum>(III)</enum><text>to develop
			 project concepts.</text>
							</subclause></clause><clause id="id75FCA4FA681B4A79B187BD41B88BE277"><enum>(iii)</enum><header>Annual
			 determination of eligibility</header>
							<subclause id="id0E1B3808390C4B71972267BC22451727"><enum>(I)</enum><header>Determination</header><text>For
			 each year of the first phase, not later than 270 days after the date on which a
			 grant recipient first receives grant funds for the year, the Secretary shall
			 determine whether the grant recipient has made sufficient progress during the
			 year to justify additional funding.</text>
							</subclause><subclause id="id501A9EB8C2E34B13887D67FE2812EB21"><enum>(II)</enum><header>Effect of
			 determination</header><text>If the Secretary determines under subclause (I)
			 that the progress of a grant recipient during the year covered by the
			 determination justifies additional funding, the Secretary shall provide to the
			 grant recipient grant funds for the year following the year during which the
			 determination was made.</text>
							</subclause></clause><clause id="id7B7291CB16434149980D2664F5C70DDE"><enum>(iv)</enum><header>Advancement
			 conditions</header><text>A grant recipient shall not be eligible to receive
			 grant funds during the second phase described in subparagraph (B) until the
			 date on which the Secretary determines that the management group established by
			 the grant recipient is—</text>
							<subclause id="ID1f1e0eca2f754ec7993f67c392f1ab2b"><enum>(I)</enum><text>fully formed,
			 including the drafting and approval of articles of incorporation and bylaws
			 governing the organization; and</text>
							</subclause><subclause id="ID71b823c7edc44a0d9aae5607cd4e3e26"><enum>(II)</enum><text>fully functional,
			 including holding regular meetings, having reached a consensus on the mission
			 of the group, and having developed project concepts.</text>
							</subclause></clause></subparagraph><subparagraph id="id0D2A36D684F34DDC9CC2B6DB93245D5F"><enum>(B)</enum><header>Second
			 phase</header>
						<clause id="id756054BD07CD4CB7AC074541E1C3CAF5"><enum>(i)</enum><header>In
			 general</header><text>During the second phase of a grant established under this
			 subparagraph, the Secretary may provide to a grant recipient a grant in an
			 amount of not greater than $1,000,000 each year for a period of not more than 4
			 years.</text>
						</clause><clause id="id20BECAA2A216448FA6921EC9E1C9F8C1"><enum>(ii)</enum><header>Mandatory use
			 of funds</header><text>A grant recipient that receives funds through a grant
			 under the second phase shall use the funds to carry out watershed management
			 projects.</text>
						</clause><clause id="id09AC5A3447A14EE9AA09CB952FA03D63"><enum>(iii)</enum><header>Annual
			 determination of eligibility</header>
							<subclause id="id14B36175A02C4F35A798F2DC9CAAC9BD"><enum>(I)</enum><header>Determination</header><text>For
			 each year of the second phase, not later than 270 days after the date on which
			 a grant recipient first receives grant funds for the year, the Secretary shall
			 determine whether the grant recipient has made sufficient progress during the
			 year to justify additional funding.</text>
							</subclause><subclause id="idCFBA3D643FD04B7BA07BFE22E78706AB"><enum>(II)</enum><header>Effect of
			 determination</header><text>If the Secretary determines under subclause (I)
			 that the progress of a grant recipient during the year covered by the
			 determination justifies additional funding, the Secretary shall provide to the
			 grant recipient grant funds for the year following the year during which the
			 determination was made.</text>
							</subclause></clause><clause id="id10F8F5700F9C4126AB88C469E6DE0005"><enum>(iv)</enum><header>Advancement
			 condition</header><text>A grant recipient shall not be eligible to receive
			 grant funds during the third phase described in subparagraph (C) until the date
			 on which the Secretary determines that the grant recipient has—</text>
							<subclause id="id0C191AAE13A444B69453A9B242DD6DC0"><enum>(I)</enum><text>completed each
			 requirement with respect to each year of the second phase; and</text>
							</subclause><subclause id="idCE798871F5E849209FCDC182BFEE0F83"><enum>(II)</enum><text>demonstrated that
			 1 or more pilot projects of the grant recipient have resulted in demonstrable
			 improvements in the functioning condition of at least 1 river or stream in the
			 watershed.</text>
							</subclause></clause></subparagraph><subparagraph id="id4CF4091FF0604A65B1513E3D11B693F0"><enum>(C)</enum><header>Third
			 phase</header>
						<clause id="id8BA6CBED1A084D2DBA87284E8F77FE06"><enum>(i)</enum><header>Funding
			 limitation</header>
							<subclause id="id7268EDF4060B4CBAB1BC2A26B4138665"><enum>(I)</enum><header>In
			 general</header><text>Except as provided in subclause (II), during the third
			 phase of a grant established under this subparagraph, the Secretary may provide
			 to a grant recipient a grant in an amount of not greater than $5,000,000 for a
			 period of not more than 5 years.</text>
							</subclause><subclause id="id77D170F333CA4793980CAAD7C4951C81"><enum>(II)</enum><header>Exception</header><text>The
			 Secretary may provide to a grant recipient a grant in an amount that is greater
			 than the amount described in subclause (I) if the Secretary determines that the
			 grant recipient is capable of using the additional amount to achieve an
			 appropriate increase in an economic, social, or environmental benefit that
			 could not otherwise be achieved by the grant recipient through the amount
			 described in subclause (I).</text>
							</subclause></clause><clause id="id4E897B445ED94B3D8E5FEE6D8ACC1A0E"><enum>(ii)</enum><header>Mandatory use
			 of funds</header><text>A grant recipient that receives funds through a grant
			 under the third phase shall use the funds to carry out not less than 1
			 watershed management project of the grant recipient.</text>
						</clause></subparagraph></paragraph><paragraph id="ID59873d18b02a4291932796c1fefdee8e"><enum>(3)</enum><header>Permissive use
			 of funds</header><text>A grant recipient that receives funds through a grant
			 under this section may use the funds—</text>
					<subparagraph id="idA41FD211A458443E9BB9452D7FC729BC"><enum>(A)</enum><text>to pay for—</text>
						<clause id="id0C8F48117D564CB8B3EACC0D64F76536"><enum>(i)</enum><text>the administrative
			 costs of the management group of the grant recipient;</text>
						</clause><clause id="id0D0B4E7219804EA288AB2C3D2B457D6E"><enum>(ii)</enum><text>the salary of not
			 more than 1 full-time employee of the management group of the grant recipient;
			 and</text>
						</clause><clause id="idB0A1C90651C84621B5BBDF2DCF322005"><enum>(iii)</enum><text>any legal fees
			 of the grant recipient arising from the establishment of the management group
			 of the grant recipient;</text>
						</clause></subparagraph><subparagraph id="idB025EA3176EE4680A7353AFAE76B3362"><enum>(B)</enum><text>to fund—</text>
						<clause id="id2C8B065EA76D46569A4FC6DC17647BB9"><enum>(i)</enum><text>studies of the
			 watershed that is managed by the management group of the grant recipient;
			 and</text>
						</clause><clause id="idC83AC5A602BF495C904ECFD5EF2B0FC6"><enum>(ii)</enum><text>any
			 project—</text>
							<subclause id="idCAF5883359FB4A56B30C0C3D1D8FC381"><enum>(I)</enum><text>described in the
			 mission statement of the management group of the grant recipient; and</text>
							</subclause><subclause id="id150E8A70FD404294BA45BF143F965A90"><enum>(II)</enum><text>to be carried out
			 by the management group of the grant recipient to achieve any goal of the
			 management group;</text>
							</subclause></clause></subparagraph><subparagraph id="idCFDD40D8212C44DE93DCB74D4698DA48"><enum>(C)</enum><text>to carry out
			 demonstration projects relating to water conservation or alternative water
			 uses; and</text>
					</subparagraph><subparagraph id="id771EE7696D2445E7B209A091ECAFC251"><enum>(D)</enum><text>to expand a
			 management group that is established by the grant recipient.</text>
					</subparagraph></paragraph><paragraph id="id629702F886E74BD596F628272F3AB5C1"><enum>(4)</enum><header>Requirement of
			 consensus of members of management group</header><text>A management group of a
			 grant recipient may not use grant funds for any initiative of the management
			 group unless the group reaches a consensus decision.</text>
				</paragraph></subsection><subsection id="ID5e8a4ccf11604680a7087ee1748a6a92"><enum>(e)</enum><header>Cost
			 share</header>
				<paragraph id="ID4210d6076b04419a8aaef7327f53b1e9"><enum>(1)</enum><header>Planning</header><text>The
			 Federal share of the cost of any activity of a management group of a grant
			 recipient relating to any use required under subsection (d)(2)(A)(ii) shall be
			 100 percent.</text>
				</paragraph><paragraph id="IDb3ad60b0cd124dd5a1f3abe3f148ae8e"><enum>(2)</enum><header>Projects carried
			 out under second phase</header>
					<subparagraph id="id405FE2EC05E447C1A2A381006C6BFF9E"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Federal share of the
			 costs of any activity of a management group of a grant recipient relating to a
			 watershed management project described in subsection (d)(2)(B)(ii) shall not
			 exceed 60 percent of the total costs of the watershed management
			 project.</text>
					</subparagraph><subparagraph id="id763690B7F47F46BAA7D6C079F9BA8A5D"><enum>(B)</enum><header>Limitation</header><text>To
			 pay for any costs relating to administrative expenses incurred for a watershed
			 management project described in subsection (d)(2)(B)(ii), a management group of
			 a grant recipient may use grant funds in an amount not greater than the lesser
			 of—</text>
						<clause id="id90438E1E85FF4F6AB5C7400E46784D3F"><enum>(i)</enum><text>$100,000;
			 or</text>
						</clause><clause id="id6A4433DAE326493AB06590B5868B1576"><enum>(ii)</enum><text>20 percent of the
			 total amount of the Federal share provided to the management group to carry out
			 the watershed management project.</text>
						</clause></subparagraph><subparagraph id="idA76066D5781045AA84BA5AC3E2CE1F3F"><enum>(C)</enum><header>Form of
			 non-Federal share</header><text>The non-Federal share under subparagraph (A)
			 may be in the form of any in-kind contributions.</text>
					</subparagraph></paragraph><paragraph id="IDe217302cb2c7471c8f322bf6263da6c7"><enum>(3)</enum><header>Projects carried
			 out under third phase</header>
					<subparagraph id="id1D00889460A84FB5981C5430FE49638E"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Federal share of the
			 costs of any activity of a management group of a grant recipient relating to a
			 watershed management project described in subsection (d)(2)(C)(ii) shall not
			 exceed 50 percent of the total costs of the watershed management
			 project.</text>
					</subparagraph><subparagraph id="id5AAD1E7EC26E49409C4B85CAB6E43B37"><enum>(B)</enum><header>Limitation</header><text>To
			 pay for any costs relating to administrative expenses with respect to a
			 watershed management project described in subsection (d)(2)(C)(ii), a
			 management group of a grant recipient may use grant funds in an amount not
			 greater than the lesser of—</text>
						<clause id="id893170AD1E8E4818826C8E756BB4DBB5"><enum>(i)</enum><text>$100,000;
			 or</text>
						</clause><clause id="idAB5E190929F541139D83609B9B2B860B"><enum>(ii)</enum><text>20 percent of the
			 total amount of the Federal share provided to the management group to carry out
			 the watershed management project.</text>
						</clause></subparagraph><subparagraph id="id7789CCE3F2434FE59D7BE40B4018862F"><enum>(C)</enum><header>Form of
			 non-Federal share</header><text>The non-Federal share under subparagraph (A)
			 may be in the form of any in-kind contributions.</text>
					</subparagraph></paragraph></subsection><subsection id="IDaba044d02ff542c1af58563b2cf032e3"><enum>(f)</enum><header>Annual
			 reports</header>
				<paragraph id="id2FD94D2DEAB14FCCBA89EF80E7AEB962"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date on which a
			 management group of a grant recipient first receives funds through a grant
			 under this section, and annually thereafter, in accordance with paragraph (2),
			 the management group shall submit to the Secretary a report that describes, for
			 the period covered by the report, the progress of the management group with
			 respect to the duties of the management group.</text>
				</paragraph><paragraph id="idF39691130AC64F6E8490CE4366EC949A"><enum>(2)</enum><header>Required degree
			 of detail</header><text>The contents of an annual report required under
			 paragraph (1) shall contain a degree of detail that is sufficient to enable the
			 Secretary to complete each report required under subsection (g), as determined
			 by the Secretary.</text>
				</paragraph></subsection><subsection id="ID1cdcb6208c8c487a8368b2ec507575a4"><enum>(g)</enum><header>Report</header><text>Not
			 later than 5 years after the date of enactment of this Act, and every 5 years
			 thereafter, the Secretary shall submit to the appropriate committees of
			 Congress a report that describes—</text>
				<paragraph id="id27350BCC22454F0F95A36D0CA4F7EB7D"><enum>(1)</enum><text>the manner by
			 which the program enables the Secretary—</text>
					<subparagraph id="id01257D84D6DF4D95A92428A133674D0B"><enum>(A)</enum><text>to address water
			 conflicts;</text>
					</subparagraph><subparagraph id="idFE78933C273E483282F69D886055EAF3"><enum>(B)</enum><text>to conserve water;
			 and</text>
					</subparagraph><subparagraph id="id65AC84DFF9B8448DA5FF7060604119B4"><enum>(C)</enum><text>to improve water
			 quality; and</text>
					</subparagraph></paragraph><paragraph id="id92B58AB6DB7B4E54BDEA96EF0714EA06"><enum>(2)</enum><text>each benefit that
			 is achieved through the administration of the program, including, to the
			 maximum extent practicable, a quantitative analysis of each economic, social,
			 and environmental benefit.</text>
				</paragraph></subsection><subsection id="ID655c97ff2a7d49c7a5de13fa7f176f19"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section—</text>
				<paragraph id="id04362B457ECE4B0ABB48F42936C9430D"><enum>(1)</enum><text>$2,000,000 for
			 each of fiscal years 2008 and 2009;</text>
				</paragraph><paragraph id="id23F9F6EBEF584CD9B92202C07032ED1F"><enum>(2)</enum><text>$5,000,000 for
			 fiscal year 2010;</text>
				</paragraph><paragraph id="idF70EDC5FD3EB4834B724403692C8F448"><enum>(3)</enum><text>$10,000,000 for
			 fiscal year 2011; and</text>
				</paragraph><paragraph id="id72D1F456D45047E0A9E34D07FFC4BA3D"><enum>(4)</enum><text>$20,000,000 for
			 each of fiscal years 2012 through 2020.</text>
				</paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id76148624-a941-4ab9-97da-860b905b8f15" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cooperative Watershed Management Act
			 of 2008</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="id875c8fb8-1f2f-4688-9a1d-f520727d9ebb" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idffb4362c-6143-4f46-b8b2-2a6f75c755c3"><enum>(1)</enum><header>Affected
			 stakeholder</header><text>The term <term>affected stakeholder</term> means an
			 entity that significantly affects, or is significantly affected by, the quality
			 or quantity of water in a watershed, as determined by the Secretary.</text>
			</paragraph><paragraph id="id7717634d-a2b3-4a5a-a5de-e1c47146e577"><enum>(2)</enum><header>Grant
			 recipient</header><text>The term <term>grant recipient</term> means a watershed
			 group that the Secretary has selected to receive a grant under section
			 3(c)(2).</text>
			</paragraph><paragraph id="id8221bc73-54c1-47c8-a090-e27c448a8900"><enum>(3)</enum><header>Program</header><text>The
			 term <term>program</term> means the Cooperative Watershed Management Program
			 established by the Secretary under section 3(a).</text>
			</paragraph><paragraph id="id76c6be40-4455-4c9d-bb6d-7b23ee5ff069"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id42e02ae9-df7b-4086-bc0f-d6971bf5b1c7"><enum>(5)</enum><header>Watershed
			 group</header><text>The term <term>watershed group</term> means a
			 self-sustaining, cooperative watershed-wide group that—</text>
				<subparagraph id="IDdb394843bd304afdba70aea737ddb5fd"><enum>(A)</enum><text>is comprised of
			 representatives of the affected stakeholders of the relevant watershed;</text>
				</subparagraph><subparagraph id="id0e4f8b89-5ba2-4d8f-bc44-35ba698e9c84"><enum>(B)</enum><text>incorporates the
			 perspectives of a diverse array of stakeholders, including, to the maximum
			 extent practicable—</text>
					<clause id="ID8e3b402ce3de4cf49fe91b6a113076f4"><enum>(i)</enum><text>representatives
			 of—</text>
						<subclause id="IDdc91afedf19c4988aed8db2409cbc436"><enum>(I)</enum><text>hydroelectric
			 production;</text>
						</subclause><subclause id="ID37808be37efa4aa893ee1613e61f4e09"><enum>(II)</enum><text>livestock
			 grazing;</text>
						</subclause><subclause id="ID0c07f1fd975542b7ad1554897e661af6"><enum>(III)</enum><text>timber
			 production;</text>
						</subclause><subclause id="IDcc989f221411482a8bedb6f6b9ffe602"><enum>(IV)</enum><text>land development;</text>
						</subclause><subclause id="ID3a9ac51cce23482f8ae14018cf44f7d3"><enum>(V)</enum><text>recreation or
			 tourism;</text>
						</subclause><subclause id="ID0f9ec14e3de14065aad096bf2aefdcd3"><enum>(VI)</enum><text>irrigated agricultural
			 production;</text>
						</subclause><subclause id="IDd9ffec6bf5734c60b6e28939bb3175c3"><enum>(VII)</enum><text>the environment;</text>
						</subclause><subclause id="ID7f4510327a354aa5b449a51cbdb8b3c8"><enum>(VIII)</enum><text>potable water
			 purveyors and industrial water users; and</text>
						</subclause><subclause id="IDf0168108e6b64ff5b22a0b695884ee19"><enum>(IX)</enum><text>private property owners
			 within the watershed;</text>
						</subclause></clause><clause id="IDbc925d5a46d04ba88195e683484641bc"><enum>(ii)</enum><text>any Federal agency that
			 has authority with respect to the watershed;</text>
					</clause><clause id="ID02fa6e5b2153430d83399cbbc6e89c92"><enum>(iii)</enum><text>any State agency that
			 has authority with respect to the watershed;</text>
					</clause><clause id="idE7F295B3E6264DA2B1FCFD5D147FA565"><enum>(iv)</enum><text>any local agency that
			 has authority with respect to the watershed; and</text>
					</clause><clause id="IDfdf214c9a9d5468681e686156bca6a2e"><enum>(v)</enum><text>any Indian tribe
			 that—</text>
						<subclause id="id738EF499D05E4210B9A57D6349A453A7"><enum>(I)</enum><text>owns land within the
			 watershed; or</text>
						</subclause><subclause id="id46BCAC5E935E468CB7E226346377051A"><enum>(II)</enum><text>has land in the
			 watershed that is held in trust;</text>
						</subclause></clause></subparagraph><subparagraph id="id0d2a29be-95aa-4ade-bbae-1c0c67e34be3"><enum>(C)</enum><text>is a grassroots,
			 nonregulatory entity that addresses water availability and quality issues
			 within the relevant watershed;</text>
				</subparagraph><subparagraph id="IDbd00e802d95a474495a1618eda7fcd67"><enum>(D)</enum><text>is capable of promoting
			 the sustainable use of the water resources of the relevant watershed and
			 improving the functioning condition of rivers and streams through—</text>
					<clause id="id1fcbec43-0ef3-4669-afb9-8c9d308d0643"><enum>(i)</enum><text>water
			 conservation;</text>
					</clause><clause id="id9b6e9af5-e3f0-4bd5-98c0-f98d6f8f47fe"><enum>(ii)</enum><text>improved water
			 quality;</text>
					</clause><clause id="id10a453e4-84a4-4a78-9bc5-7e0cdedf2f1e"><enum>(iii)</enum><text>ecological resiliency;
			 and</text>
					</clause><clause id="id2731b8a6-6278-4c04-8a8b-20f28c046cb9"><enum>(iv)</enum><text>the reduction of water
			 conflicts; and</text>
					</clause></subparagraph><subparagraph id="ID5b81fa05a23746a4b7009f02ac7c5e6f"><enum>(E)</enum><text>makes decisions on a
			 consensus basis, as defined in the bylaws of the watershed group.</text>
				</subparagraph></paragraph><paragraph id="id4B6A634F5BBB4D7098A91F9720CE4905"><enum>(6)</enum><header>Watershed management
			 project</header><text>The term <term>watershed management project</term> means
			 any project (including a demonstration project) that—</text>
				<subparagraph id="id7C8F5CD25E904F16A450D2E2995EA66C"><enum>(A)</enum><text>enhances water
			 conservation, including alternative water uses;</text>
				</subparagraph><subparagraph id="idD014CA6D39494706990E1CF9CF4481D9"><enum>(B)</enum><text>improves water
			 quality;</text>
				</subparagraph><subparagraph id="id6EEE3E8CB6DE4DFDA708365A51D162C5"><enum>(C)</enum><text>improves ecological
			 resiliency of a river or stream;</text>
				</subparagraph><subparagraph id="idB828FF74D483430E90A01AAA51DA0D27"><enum>(D)</enum><text>reduces the potential for
			 water conflicts; or</text>
				</subparagraph><subparagraph id="id301CECC5154649C5B8FC62434206F219"><enum>(E)</enum><text>advances any other goals
			 associated with water quality or quantity that the Secretary determines to be
			 appropriate.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SSEG00" id="idc0ba83e0-2913-41cd-a452-881671094785" reported-display-style="italic"><enum>3.</enum><header>Program</header>
			<subsection id="id3bcb181b-3bad-45a7-90cd-0c361bbbfa01"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall establish a program, to be known as the <quote>Cooperative Watershed
			 Management Program</quote>, under which the Secretary shall provide
			 grants—</text>
				<paragraph id="id77afff72-a525-4b3d-8b58-ed160d4d65ba"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id55023A3F40CF416CBDF67A7DBB5687B9"><enum>(A)</enum><text>to form a watershed
			 group; or</text>
					</subparagraph><subparagraph changed="added" committee-id="SSEG00" id="id2A7CD8E61E9D4052A86A92EFE60285EF" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>to enlarge a watershed
			 group; and</text>
					</subparagraph></paragraph><paragraph id="id6a670d99-546c-46d5-88e9-85968c1c82e1"><enum>(2)</enum><text>to conduct 1 or more
			 projects in accordance with the goals of a watershed group.</text>
				</paragraph></subsection><subsection id="ide06e124d-111e-4a50-97b8-77f8ab77e09a"><enum>(b)</enum><header>Application</header>
				<paragraph id="id6c1b9ece-3150-4800-b839-83c95ac886f7"><enum>(1)</enum><header>Establishment of
			 application process; criteria</header><text>Not later than 1 year after the
			 date of enactment of this Act, the Secretary shall establish—</text>
					<subparagraph id="id0ecb190a-843d-4e9d-b6e5-1fbaf2045492"><enum>(A)</enum><text>an application process
			 for the program; and</text>
					</subparagraph><subparagraph id="ida43974ee-2f74-4995-867b-49c1bbfb451f"><enum>(B)</enum><text>in consultation with the
			 States, prioritization and eligibility criteria for considering applications
			 submitted in accordance with the application process.</text>
					</subparagraph></paragraph></subsection><subsection id="id3908cf36-6df9-48f0-b54a-c9769f6584e6"><enum>(c)</enum><header>Distribution of grant
			 funds</header>
				<paragraph id="id50040d12-9ccf-42d1-8a9f-edd0e73a9701"><enum>(1)</enum><header>In
			 general</header><text>In distributing grant funds under this section, the
			 Secretary—</text>
					<subparagraph id="idAF1A76B64F904335A154FF856F35C2F3"><enum>(A)</enum><text>shall comply with
			 paragraph (2); and</text>
					</subparagraph><subparagraph id="ID9a15b18fadb344c59b370bc7bee16733"><enum>(B)</enum><text>may give priority to
			 watershed groups that—</text>
						<clause id="id43EE6EB8556145C080E59E5B25BF86C8"><enum>(i)</enum><text>represent maximum
			 diversity of interests; or</text>
						</clause><clause id="id7B049BF9B0834921835D200BB8B19FB8"><enum>(ii)</enum><text>serve subbasin-sized
			 watersheds with an 8-digit hydrologic unit code, as defined by the United
			 States Geological Survey.</text>
						</clause></subparagraph></paragraph><paragraph id="idd90156f9-d9eb-46de-9f7a-ddb76a7cf8db"><enum>(2)</enum><header>Funding
			 procedure</header>
					<subparagraph id="id61891998-0e36-47c2-b0ea-f4c83fd5e39c"><enum>(A)</enum><header>First phase</header>
						<clause id="idfaa1358e-1000-40bc-a4d7-6978cbe899d1"><enum>(i)</enum><header>In
			 general</header><text>The Secretary may provide to a grant recipient a
			 first-phase grant in an amount not greater than $100,000 each year for a period
			 of not more than 3 years.</text>
						</clause><clause id="id69547da4-27f3-4bf1-aa10-cf5680e18a72"><enum>(ii)</enum><header>Mandatory use of
			 funds</header><text>A grant recipient that receives a first-phase grant shall
			 use the funds—</text>
							<subclause id="id7c7de0b0-bc36-4a76-8e18-d5738de76e5a"><enum>(I)</enum><text>to establish or enlarge a
			 watershed group;</text>
							</subclause><subclause id="id70c95cfa-6f0c-4c35-8098-d62839996eec"><enum>(II)</enum><text>to develop a mission
			 statement for the watershed group;</text>
							</subclause><subclause id="ide9d4f970-a27c-40e4-a02e-3bee4eb4b5f6"><enum>(III)</enum><text>to develop project
			 concepts; and</text>
							</subclause><subclause id="id905670AED81E48528E24E9A54CAEC178"><enum>(IV)</enum><text>to develop a restoration
			 plan.</text>
							</subclause></clause><clause id="id5c42be54-12bd-4e81-9434-ab681a5d48ad"><enum>(iii)</enum><header>Annual determination
			 of eligibility</header>
							<subclause id="id70772ae7-8793-4560-b1a3-d4396510cf2d"><enum>(I)</enum><header>Determination</header><text>For
			 each year of a first-phase grant, not later than 270 days after the date on
			 which a grant recipient first receives grant funds for the year, the Secretary
			 shall determine whether the grant recipient has made sufficient progress during
			 the year to justify additional funding.</text>
							</subclause><subclause id="idd7092071-fb01-4e51-b6c4-a3605d19460d"><enum>(II)</enum><header>Effect of
			 determination</header><text>If the Secretary determines under subclause (I)
			 that the progress of a grant recipient during the year covered by the
			 determination justifies additional funding, the Secretary shall provide to the
			 grant recipient grant funds for the following year.</text>
							</subclause></clause><clause id="id0172a1b7-2e33-444b-ade9-b557c0bc3ef8"><enum>(iv)</enum><header>Advancement
			 conditions</header><text>A grant recipient shall not be eligible to receive a
			 second-phase grant under subparagraph (B) until the date on which the Secretary
			 determines that the watershed group—</text>
							<subclause id="id589543e7-329c-4c4c-9868-2f9bf640f262"><enum>(I)</enum><text>has approved articles of
			 incorporation and bylaws governing the organization; and</text>
							</subclause><subclause id="ID675ff05d4c2446019a3a98a2bd95b837"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id0AABE4987EA640378DC49B3678599E7C"><enum>(aa)</enum><text>holds regular
			 meetings;</text>
								</item><item changed="added" committee-id="SSEG00" id="id70742E3D3DCC46D1A59E8D28551E426C" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text>has completed a mission
			 statement; and</text>
								</item><item changed="added" committee-id="SSEG00" id="id70AC5D8454DE48539AA1BA922B935997" indent="up1" reported-display-style="italic"><enum>(cc)</enum><text>has developed a
			 restoration plan and project concepts for the watershed.</text>
								</item></subclause></clause><clause id="IDed7b0e12937d4a5aacee579953df0f19"><enum>(v)</enum><header>Exception</header><text>A
			 watershed group that has not applied for or received first-phase grants may
			 apply for and receive second-phase grants under subparagraph (B) if the
			 Secretary determines that the group has satisfied the requirements of
			 first-phase grants.</text>
						</clause></subparagraph><subparagraph id="idb33c66b8-46d3-4801-9fa7-57b73428a96c"><enum>(B)</enum><header>Second phase</header>
						<clause id="id4dbd24f7-8b95-44a7-b29d-25e97994966f"><enum>(i)</enum><header>In
			 general</header><text>A watershed group may apply for and receive second-phase
			 grants of $1,000,000 each year for a period of not more than 4 years if—</text>
							<subclause id="idE232717CF5764196976F9C61D3EC0DEA"><enum>(I)</enum><text>the watershed group has
			 applied for and received watershed grants under subparagraph (A); or</text>
							</subclause><subclause id="id95D9AC7835BA49FB9B795F9E2AE0C59F"><enum>(II)</enum><text>the Secretary determines
			 that the watershed group has satisfied the requirements of first-phase
			 grants.</text>
							</subclause></clause><clause id="id53deb9ff-7d22-4480-a292-49d7c9c1af9e"><enum>(ii)</enum><header>Mandatory use of
			 funds</header><text>A grant recipient that receives a second-phase grant shall
			 use the funds to plan and carry out watershed management projects.</text>
						</clause><clause id="id05afb8c2-fcc4-42cd-b6e3-36f0edcc1d4d"><enum>(iii)</enum><header>Annual determination
			 of eligibility</header>
							<subclause id="id0da736d0-8a2c-4970-8a57-b8b6fba08102"><enum>(I)</enum><header>Determination</header><text>For
			 each year of the second-phase grant, not later than 270 days after the date on
			 which a grant recipient first receives grant funds for the year, the Secretary
			 shall determine whether the grant recipient has made sufficient progress during
			 the year to justify additional funding.</text>
							</subclause><subclause id="id042ddc37-660c-45cd-98ce-6d17e4e4da87"><enum>(II)</enum><header>Effect of
			 determination</header><text>If the Secretary determines under subclause (I)
			 that the progress of a grant recipient during the year justifies additional
			 funding, the Secretary shall provide to the grant recipient grant funds for the
			 following year.</text>
							</subclause></clause><clause id="id3b799866-49f8-4fee-8bc5-d4ddaec0f982"><enum>(iv)</enum><header>Advancement
			 condition</header><text>A grant recipient shall not be eligible to receive a
			 third-phase grant under subparagraph (C) until the date on which the Secretary
			 determines that the grant recipient has—</text>
							<subclause id="ida895d28f-d248-470a-b1e9-bc3e3758c766"><enum>(I)</enum><text>completed each
			 requirement of the second-phase grant; and</text>
							</subclause><subclause id="idbb4f4561-4f36-4dfe-b932-620d594a2f5d"><enum>(II)</enum><text>demonstrated that 1 or
			 more pilot projects of the grant recipient have resulted in demonstrable
			 improvements, as determined by the Secretary, in the functioning condition of
			 at least 1 river or stream in the watershed.</text>
							</subclause></clause></subparagraph><subparagraph id="id06b46c31-6e02-46cf-a1fe-a41cf9256e45"><enum>(C)</enum><header>Third phase</header>
						<clause id="id313cbf51-a944-4d26-b289-754bdaa5176c"><enum>(i)</enum><header>Funding
			 limitation</header>
							<subclause id="id5d0bc7da-a4fc-4735-afc3-db59f2639558"><enum>(I)</enum><header>In
			 general</header><text>Except as provided in subclause (II), the Secretary may
			 provide to a grant recipient a third-phase grant in an amount not greater than
			 $5,000,000 for a period of not more than 5 years.</text>
							</subclause><subclause id="id53ce463e-ed19-41ee-a51c-39e90034516b"><enum>(II)</enum><header>Exception</header><text>The
			 Secretary may provide to a grant recipient a third-phase grant in an amount
			 that is greater than the amount described in subclause (I) if the Secretary
			 determines that the grant recipient is capable of using the additional amount
			 to further the purposes of the program in a way that could not otherwise be
			 achieved by the grant recipient using the amount described in subclause
			 (I).</text>
							</subclause></clause><clause id="id27b4b458-d506-4455-acb9-9e83ba9bc445"><enum>(ii)</enum><header>Mandatory use of
			 funds</header><text>A grant recipient that receives a third-phase grant shall
			 use the funds to plan and carry out at least 1 watershed management
			 project.</text>
						</clause></subparagraph></paragraph><paragraph id="idd34f50bf-0e0f-4b38-90e7-f46ef8f9351b"><enum>(3)</enum><header>Authorizing use of
			 funds for administrative and other costs</header><text>A grant recipient that
			 receives a grant under this section may use the funds—</text>
					<subparagraph id="id62393146-0315-4640-9738-681f584b86ef"><enum>(A)</enum><text>to pay for—</text>
						<clause id="id63f77866-b3f4-40ee-b9cf-bd2c066590ca"><enum>(i)</enum><text>administrative and
			 coordination costs, if the costs are not greater than the lesser of—</text>
							<subclause id="id1B857C8B33394F989150602F06802085"><enum>(I)</enum><text>20 percent of the total
			 amount of the grant; or</text>
							</subclause><subclause id="id03E48A8A47DA4E87993FF19AB387B174"><enum>(II)</enum><text>$100,000;</text>
							</subclause></clause><clause id="id37b5b752-17e3-469f-a19d-d90e643dca77"><enum>(ii)</enum><text>the salary of not more
			 than 1 full-time employee of the watershed group; and</text>
						</clause><clause id="ida0668426-66ab-4044-8099-4c26ecab9dcf"><enum>(iii)</enum><text>any legal fees arising
			 from the establishment of the relevant watershed group; and</text>
						</clause></subparagraph><subparagraph id="id9db8d604-3f29-4d65-830b-0865a3e6407c"><enum>(B)</enum><text>to fund—</text>
						<clause id="id5db6562e-bd5d-4f13-830e-3f57b6bcbcf6"><enum>(i)</enum><text>water quality and
			 quantity studies of the relevant watershed; and</text>
						</clause><clause id="idc1db828e-dc70-4731-9955-66e31d239448"><enum>(ii)</enum><text>the planning, design,
			 and implementation of any projects relating to water quality or
			 quantity.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idec7623b8-ba38-46b8-bfd0-8545336b7d16"><enum>(d)</enum><header>Cost share</header>
				<paragraph id="id8c4c91ce-902a-461a-a9c3-87f2a912c263"><enum>(1)</enum><header>Planning</header><text>The
			 Federal share of the cost of an activity provided assistance through a
			 first-phase grant shall be 100 percent.</text>
				</paragraph><paragraph id="id830b0ce4-78bb-4c6b-a4e1-46488d74896c"><enum>(2)</enum><header>Projects carried out
			 under second phase</header>
					<subparagraph id="id97fee29c-91c5-47fd-b609-01c856dee583"><enum>(A)</enum><header>In
			 general</header><text>The Federal share of the cost of any activity of a
			 watershed management project provided assistance through a second-phase grant
			 shall not exceed 50 percent of the total cost of the activity.</text>
					</subparagraph><subparagraph id="id44c494f3-6a39-4831-a9cf-df23d34dfafb"><enum>(B)</enum><header>Form of non-Federal
			 share</header><text>The non-Federal share under subparagraph (A) may be in the
			 form of in-kind contributions.</text>
					</subparagraph></paragraph><paragraph id="id37c6efe1-9337-4db9-a4d3-40d8f3a55b4c"><enum>(3)</enum><header>Projects carried out
			 under third phase</header>
					<subparagraph id="id356fa7a6-5078-4c3e-9a9d-212b3be1ce0d"><enum>(A)</enum><header>In
			 general</header><text>The Federal share of the costs of any activity of a
			 watershed group of a grant recipient relating to a watershed management project
			 provided assistance through a third-phase grant shall not exceed 50 percent of
			 the total costs of the watershed management project.</text>
					</subparagraph><subparagraph id="iddf199f94-a39d-4436-ac0f-8d96a4b28c4f"><enum>(B)</enum><header>Form of non-Federal
			 share</header><text>The non-Federal share under subparagraph (A) may be in the
			 form of in-kind contributions.</text>
					</subparagraph></paragraph></subsection><subsection id="idbb1c5e94-4e1c-46f8-abba-dffad68f06af"><enum>(e)</enum><header>Annual reports</header>
				<paragraph id="ide977b3bf-a640-4dab-bffd-219251924cf1"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date on which a grant
			 recipient first receives funds under this section, and annually thereafter, in
			 accordance with paragraph (2), the watershed group shall submit to the
			 Secretary a report that describes the progress of the watershed group.</text>
				</paragraph><paragraph id="id32dae9a1-45a7-4575-b42e-db487d029f87"><enum>(2)</enum><header>Required degree of
			 detail</header><text>The contents of an annual report required under paragraph
			 (1) shall contain sufficient information to enable the Secretary to complete
			 each report required under subsection (f), as determined by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="id1524dbe3-04aa-43f5-9c27-11ef872f4df9"><enum>(f)</enum><header>Report</header><text>Not
			 later than 5 years after the date of enactment of this Act, and every 5 years
			 thereafter, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives a report that describes—</text>
				<paragraph id="id0ec659a3-9182-4061-a67b-b1413fb31ec8"><enum>(1)</enum><text>the ways in which the
			 program assists the Secretary—</text>
					<subparagraph id="id9b828871-a44b-4515-908f-731901a919c9"><enum>(A)</enum><text>in addressing water
			 conflicts;</text>
					</subparagraph><subparagraph id="id7c91b385-5caa-4867-b17a-1b7f74fd921b"><enum>(B)</enum><text>in conserving
			 water;</text>
					</subparagraph><subparagraph id="id81fdb739-69db-4cf3-9d3d-4a0692c3e2dc"><enum>(C)</enum><text>in improving water
			 quality; and</text>
					</subparagraph><subparagraph id="id42B39A32E33246F39395E9C3A586AF22"><enum>(D)</enum><text>in improving the
			 ecological resiliency of a river or stream; and</text>
					</subparagraph></paragraph><paragraph id="idbc76c83a-7cbf-451f-8c27-42266a6da652"><enum>(2)</enum><text>benefits that the program
			 provides, including, to the maximum extent practicable, a quantitative analysis
			 of economic, social, and environmental benefits.</text>
				</paragraph></subsection><subsection id="id77672b00-cdc7-44de-831b-e871eb7f093d"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section—</text>
				<paragraph id="id12360ee9-5691-4dc8-8947-cae0bf3e6cc8"><enum>(1)</enum><text>$2,000,000 for each of
			 fiscal years 2008 and 2009;</text>
				</paragraph><paragraph id="id96e1f8f6-a210-4f34-9d95-70a55b4f5148"><enum>(2)</enum><text>$5,000,000 for fiscal
			 year 2010;</text>
				</paragraph><paragraph id="id7a33fb90-2d03-4de5-a276-250e88ad2049"><enum>(3)</enum><text>$10,000,000 for fiscal
			 year 2011; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida3241818-b602-4134-b1ef-3d94b87ab8dc"><enum>(4)</enum><text>$20,000,000 for each of
			 fiscal years 2012 through 2020.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID683c6ce654c840299fae4156f60f4743" reported-display-style="italic"><enum>4.</enum><header>Effect of
			 Act</header><text display-inline="no-display-inline">Nothing in this Act
			 affects the applicability of any Federal, State, or local law with respect to
			 any watershed group.</text>
