		<official-title>To amend the Endangered Species Act of 1973 to
		  temporarily prohibit the Secretary of the Interior from considering global
		  climate change as a natural or manmade factor in determining whether a species
		  is a threatened or endangered species, and for other purposes.</official-title>

	<legis-body>
		<section id="idD6F5979628244732BD4426DCBDDE6601" section-type="section-one"><enum>1.</enum><header>Requirement relating to
			 global climate change</header>
			<subsection id="id27FE056DB8DA479887A04D127B74B6DC"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id45AC49A79E98432BA9302C61E6B03262"><enum>(1)</enum><text>without the
			 cooperation of other countries, the United States cannot reverse global climate
			 change to ensure the recovery of species that are listed as threatened or
			 endangered species on the list of threatened species or the list of endangered
			 species published under section 4(c)(1) of the Endangered Species Act of 1973
			 (16 U.S.C. 1533(c)(1)); and</text>
				</paragraph><paragraph id="idD6270815024B4693997A07DB8EA32AE0"><enum>(2)</enum><text>the ratification
			 of an international agreement by each major carbon emitting country is the
			 likely path towards—</text>
					<subparagraph id="idA41E0300181B48AEA19BD7C30FD75BD7"><enum>(A)</enum><text>reversing global
			 climate change; and</text>
					</subparagraph><subparagraph id="idF416A6C66D814758A5A6C871A26F1823"><enum>(B)</enum><text>ensuring through
			 applicable laws (including regulations) the recovery of species described in
			 paragraph (1) that are affected by global climate change.</text>
					</subparagraph></paragraph></subsection><subsection id="idCDF4406EE1874A0494B5FC6A8394F6C7"><enum>(b)</enum><header>Requirement
			 relating to global climate change</header><text>Section 4(a) of the Endangered
			 Species Act of 1973 (16 U.S.C. 1533(a)) is amended—</text>
				<paragraph id="id8342BC767F744DBAAB33362DBCDFC7CB"><enum>(1)</enum><text>in paragraph
			 (1)(E), by inserting <quote>subject to paragraph (4),</quote> before
			 <quote>other natural</quote>; and</text>
				</paragraph><paragraph id="idE8A4B56112984D7AB3D6720E7EF23E11"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

						<paragraph id="idACCF1FC0B0AC4DFEB6B76BCAE063A7AF"><enum>(4)</enum><header>Requirement
				relating to global climate change</header>
							<subparagraph id="id352A6C856CFA41E7A68A0123256EEF5E"><enum>(A)</enum><header>Definitions</header><text>In
				this paragraph:</text>
								<clause id="id8F57244851E84B1BBD1BD8018697C8A4"><enum>(i)</enum><header>Administrator</header><text>The
				term <term>Administrator</term> means the Administrator of the Environmental
				Protection Agency.</text>
								</clause><clause id="idD9C4304F289049F1B12028E74B6D43AD"><enum>(ii)</enum><header>Global climate
				change</header><text>The term <term>global climate change</term> includes any
				significant increase in—</text>
									<subclause id="id5F648C35E859455EA1A21D8ED3C9255A"><enum>(I)</enum><text>global air
				temperatures; or</text>
									</subclause><subclause id="idD58EB72C051446518921B8A702714CE0"><enum>(II)</enum><text>global sea
				levels.</text>
									</subclause></clause><clause commented="no" id="id4AE63EA284A943D580A28A0CC7AD63E1"><enum>(iii)</enum><header>Greenhouse
				gas</header><text>The term <term>greenhouse gas</term> has the meaning given
				the term in section 1610(a) of the Energy Policy Act of 1992 (42 U.S.C.
				13389(a)).</text>
								</clause><clause id="idC53D9F7524FE456AB37BBF2403F6C63B"><enum>(iv)</enum><header>Major emitter
				of greenhouse gas</header>
									<subclause id="id57265E6CE6E84656A0C14B300DECC931"><enum>(I)</enum><header>In
				general</header><text>The term <term>major emitter of greenhouse gas</term>
				means any country that the Administrator determines to be a major emitter of
				greenhouse gas.</text>
									</subclause><subclause id="id6C5B9BCBF8384B86B3671074F74BE105"><enum>(II)</enum><header>Inclusions</header><text>The
				term <term>major emitter of greenhouse gas</term> includes—</text>
										<item id="id028DD43198C04521B57D6710E2679BB8"><enum>(aa)</enum><text>China;</text>
										</item><item id="idF192955F7E3D435581377310E4603F8F"><enum>(bb)</enum><text>India;
				and</text>
										</item><item id="id0450A21ADE524B34A8BF294BA69D257D"><enum>(cc)</enum><text>the United
				States.</text>
										</item></subclause></clause></subparagraph><subparagraph id="id3B3EA7F1F35D4D749946A228B15C1D92"><enum>(B)</enum><header>Duties of
				Secretary</header>
								<clause id="id2B2682AC449045C4BC0B109F23248BC8"><enum>(i)</enum><header>Ratification of
				international agreement</header><text>In determining whether any species is a
				threatened or endangered species under paragraph (1), the Secretary shall not
				consider global climate change as a natural or manmade factor under paragraph
				(1)(E) until the date on which the Administrator notifies the Secretary that
				each major emitter of greenhouse gas has ratified an international agreement to
				reduce the quantity of greenhouse gases emitted from each major emitter of
				greenhouse gas.</text>
								</clause><clause id="idBBC9E85BEF7243A4869B8842FF7BA24F"><enum>(ii)</enum><header>Compliance
				with international agreement</header>
									<subclause id="idFE38B0F74DDE46B98A2A49748BFAABD9"><enum>(I)</enum><header>Annual
				determinations</header><text>The Secretary shall, on an annual basis, request
				the Administrator to determine whether each major emitter of greenhouse gas is
				in compliance with the international agreement described in clause (i).</text>
									</subclause><subclause id="idD45C867F8431401695C19CF40C0BCCB0"><enum>(II)</enum><header>Effects</header><text>If
				the Administrator determines that any major emitter of greenhouse gas is not in
				compliance with the international agreement described in clause (i) for the
				period covered by the determination—</text>
										<item id="id536028FBDD96410E926B5A82CC4CBD9B"><enum>(aa)</enum><text>the Secretary
				shall not consider global climate change as a natural or manmade factor under
				paragraph (1)(E) until the date on which the Administrator notifies the
				Secretary that each major emitter of greenhouse gas is in compliance with the
				international agreement; and</text>
										</item><item id="id7095219635FC4C92ADE74F0F3E2EFD98"><enum>(bb)</enum><text>each species
				that the Secretary has determined to be a threatened or endangered species
				under paragraph (1) as the result of global climate change shall not be
				considered to be a threatened or endangered species until the date described in
				item
				(aa).</text>

				</paragraph></subsection><subsection id="idC15F56453B764F4A9510BB57E4108889"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsection (b) take effect on January
			 1, 2006.</text>
