			 international trafficking in persons</header>
			<section id="HF5CCD9640EC646528B006092B28D89D"><enum>101.</enum><header>Interagency Task
			 Force to Monitor and Combat Trafficking</header><text display-inline="no-display-inline">Section 105(b) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7103(b)) is amended by inserting <quote>the
			 Secretary of Education,</quote> after <quote>the Secretary of Homeland
			 Security,</quote>.</text>
			</section><section id="H6776F939FD8841619E6F4B233E228EF1"><enum>102.</enum><header>Office to
			 Monitor and Combat Trafficking</header><text display-inline="no-display-inline">Section 105(e) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7103(e)) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H56ABDC7BB2CA4E818B005035B044D4C" style="OLC">
					<subsection id="H201A6A6CC59E4D3DB46FE2053D1F4270"><enum>(e)</enum><header>Office To
				monitor and combat trafficking</header>
						<paragraph id="H22F2A54C33674837B57C81C8585C4B9E"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of State shall establish
				within the Department of State an Office to Monitor and Combat Trafficking. The
				Office shall be headed by a Director, with the rank of Ambassador at Large, who
				shall be appointed by the President, by and with the advice and consent of the
				Senate.</text>
						</paragraph><paragraph id="H158DBFE0EECC47C98EB9A4601F80193"><enum>(2)</enum><header>Responsibilities</header><text>The
				Director shall have the following responsibilities:</text>
							<subparagraph id="HEEF28BA8AA0B420093919E860024507D"><enum>(A)</enum><text display-inline="yes-display-inline">The Director shall have primary
				responsibility for assisting the Secretary of State in carrying out the
				purposes of this division, shall provide assistance to the Task Force, and may
				have additional responsibilities as determined by the Secretary of
				State.</text>
							</subparagraph><subparagraph id="H320D24D1F72B47B6B99590AC68E447CF"><enum>(B)</enum><text>The Director shall
				consult with nongovernmental organizations and multilateral organizations, and
				with trafficking victims or other affected persons. The Director may collect
				evidence in public hearings or by other means if such collection does not
				disrupt an ongoing criminal investigation.</text>
							</subparagraph><subparagraph id="H6622497EE5D741ECBF001888F1B30FF"><enum>(C)</enum><text display-inline="yes-display-inline">The Director, in coordination and
				cooperation with other officials at the Department of State involved in
				corporate responsibility, the Deputy Under Secretary for International Affairs
				of the Department of Labor, and other relevant officials of the United States
				Government, shall promote, build, and sustain partnerships between the United
				States Government and private entities (including foundations, universities,
				corporations, community-based organizations, and other nongovernmental
				organizations) to ensure that—</text>
								<clause id="id9B3486B316EC4F1091204F161D729641"><enum>(i)</enum><text display-inline="yes-display-inline">United States citizens do not use any item,
				product, or material produced or extracted with the use of labor from victims
				of severe forms of trafficking; and</text>
								</clause><clause id="idCD2ED67F4B9141429674A29866E21D83"><enum>(ii)</enum><text display-inline="yes-display-inline">such entities do not contribute to
				trafficking in persons involving sexual exploitation.</text>
								</clause></subparagraph></paragraph><paragraph id="HB58A2D01E197497F8BADD677D8214D69"><enum>(3)</enum><header>Coordination</header><text>Any
				trafficking in persons programs of the Department of State or the United States
				Agency for International Development that are not centrally controlled by the
				Director of the Office to Monitor and Combat Trafficking shall be carried out
				with concurrence of the
				Director.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HC6AFCFD63F5E48C3A88DA0E3991F41A7"><enum>103.</enum><header>Assistance for
			 victims of trafficking in other countries</header><text display-inline="no-display-inline">Section 107(a) of Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7105(a)) is amended—</text>
				<paragraph id="H78FF78699E684499982F64FB98685911"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HF78E0FF52A1945BC8D7E5DF6BF823FC3"><enum>(A)</enum><text>in the second
			 sentence, by inserting at the end before the period the following: <quote>, and
			 shall be carried out in a manner which takes into account the cross-border,
			 regional, and transnational aspects of trafficking in persons</quote>;
			 and</text>
					</subparagraph><subparagraph id="H8786CBC8023F4D84BDCC4DE44F842CDF"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HE9C43A59172545B091BB3545B2B4E4D" style="OLC">
							<subparagraph id="HE09A9C1775004D909F0088D6571F7674"><enum>(F)</enum><text display-inline="yes-display-inline">In cooperation and coordination with
				relevant organizations, such as the United Nations High Commissioner for
				Refugees, the International Organization for Migration, and private
				nongovernmental organizations that contract with, and receive grants from, the
				United States Government to assist refugees and internally displaced persons,
				support for—</text>
								<clause id="idD08A707D0D2B428383C50A2FA74D16DD"><enum>(i)</enum><text display-inline="yes-display-inline">increased protections for refugees and
				internally displaced persons, including outreach and education efforts to
				prevent such refugees and internally displaced persons from being exploited by
				traffickers; and</text>
								</clause><clause id="id8B0339F1BFD7456D8C30B79F0B18969B"><enum>(ii)</enum><text display-inline="yes-display-inline">performance of best interest determinations
				for unaccompanied and separated children who come to the attention of the
				United Nations High Commissioner for Refugees, its partner organizations, or
				any organization that contracts with the Department of State in order to
				identify child trafficking victims and to assist their safe integration,
				reintegration, and resettlement.</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HBC8E007B474F4E7683FAD6DC30C48CD7"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the
			 following: <quote>In carrying out this paragraph, the Secretary and the
			 Administrator shall take all appropriate steps to ensure that cooperative
			 efforts among foreign countries are undertaken on a regional
			 basis.</quote>.</text>
				</paragraph></section><section id="H86FD336A4F204C5183ABC58B9EA33B91"><enum>104.</enum><header>Increasing
			 effectiveness of anti-trafficking programs</header><text display-inline="no-display-inline">The Trafficking Victims Protection Act of
			 2000 (22 U.S.C. 7101 et seq.) is amended by inserting after section 107 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id8F8DD9BE17C64113BBA14A5AE7D88B2E" style="OLC">
					<section id="H0E544D1D00AA4756B38498A5804984E"><enum>107A.</enum><header>Increasing
				effectiveness of anti-trafficking programs</header>
						<subsection id="IDa0064da6142c4b5b89f437a14310fa27"><enum>(a)</enum><header>Awarding of
				Grants, Cooperative Agreements, and Contracts</header><text>In administering
				funds made available to carry out this Act in the United States and
				abroad—</text>
							<paragraph id="ID296bf9c58c0449d0bcf5092ac34ebb4f"><enum>(1)</enum><text>solicitations of
				grants, cooperative agreements, and contracts for such programs shall be made
				publicly available;</text>
							</paragraph><paragraph id="ID76eeaacccda24a248be6d7b7d6623b23"><enum>(2)</enum><text>grants,
				cooperative agreements, and contracts shall be subject to full and open
				competition, in accordance with applicable laws;</text>
							</paragraph><paragraph id="ID41ab20aee6e440829e107a635f8443e8"><enum>(3)</enum><text>grants shall be
				evaluated by a review panel that is composed of Federal experts and
				nongovernmental experts, as appropriate; and</text>
							</paragraph><paragraph id="IDffc2f0deed1a420485108cc186fd6a59"><enum>(4)</enum><text>the internal
				department or agency review process for such grants, cooperative agreements,
				and contracts shall not be subject to ad hoc or intermittent review or
				influence by individuals or organizations outside the United States Government
				except as provided under paragraphs (1) through (3).</text>
							</paragraph></subsection><subsection id="IDaa893f91305c418a8ca49326e56e503d"><enum>(b)</enum><header>Eligibility</header>
							<paragraph id="IDa278b74f38e641308d216d4b9405b9f6"><enum>(1)</enum><header>In
				general</header><text>An applicant desiring a grant, contract, or cooperative
				agreement under this Act shall certify that persons or entities providing legal
				services, social services, health services, or other assistance have completed,
				or will complete, training in connection with severe forms of trafficking in
				persons.</text>
							</paragraph><paragraph id="ID5ac05c556ec74f038f46134e34411f7d"><enum>(2)</enum><header>Disclosure</header><text>If
				appropriate, applicants should indicate collaboration with nongovernmental
				organizations, including organizations with expertise in severe forms of
				trafficking and forced labor.</text>
							</paragraph></subsection><subsection id="IDd75bb1f48c4c48f6a4e61a8c17bad6a7"><enum>(c)</enum><header>Evaluation of
				Anti-Trafficking Programs</header>
							<paragraph id="ID07ad1960c12d4720b5de75bf64005480"><enum>(1)</enum><header>In
				general</header><text>The President shall establish a system to evaluate the
				effectiveness and efficiency of the assistance provided under anti-trafficking
				programs established under this Act on a program-by-program basis in order to
				maximize the long-term sustainable development impact of such
				assistance.</text>
							</paragraph><paragraph id="IDa2830ff5cea64a4aa768fc8d15a9524f"><enum>(2)</enum><header>Requirements</header><text>In
				carrying out paragraph (1), the President shall—</text>
								<subparagraph id="IDf587f53ef3594137b3a96c614b2b1819"><enum>(A)</enum><text>establish
				performance goals for the assistance described in paragraph (1), expressed in
				an objective and quantifiable form, to the extent practicable;</text>
								</subparagraph><subparagraph id="IDe7e8c34fb7a346889f933da78af67f8a"><enum>(B)</enum><text>ensure that
				performance indicators are used for programs authorized under this Act to
				measure and assess the achievement of the performance goals described in
				subparagraph (A);</text>
								</subparagraph><subparagraph id="ID0f481b8a9c744ae29d51645b974b78c4"><enum>(C)</enum><text>provide a basis
				for recommendations for adjustments to the assistance described in paragraph
				(1) to enhance the impact of such assistance; and</text>
								</subparagraph><subparagraph id="IDc58a1fb70db240bcaa2c272e0cb40d45"><enum>(D)</enum><text>ensure that
				evaluations, to the extent practicable, are conducted by subject matter experts
				in and outside the United States Government.</text>
								</subparagraph></paragraph></subsection><subsection id="ID52c8d0fb97c14431bd148af351072384"><enum>(d)</enum><header>Targeted Use of
				Anti-Trafficking Programs</header><text>The Director of the Office to Monitor
				and Combat Trafficking shall provide assistance to foreign countries and
				nongovernmental organizations receiving assistance under this division based on
				the priorities and country assessments contained in the most recent report
				submitted by the Secretary of State to Congress pursuant to section 110(b) of
				the <short-title>William Wilberforce Trafficking Victims
				Protection Reauthorization Act of 2008</short-title>.</text>
						</subsection><subsection id="ID9f72733bf00c4eb69c2cafe2d125fa3c"><enum>(e)</enum><header>Consistency
				With Other Programs</header><text>The President shall ensure that the design,
				monitoring, and evaluation of United States assistance programs for emergency
				relief, development, and poverty alleviation under part I and chapter 4 of part
				II of the Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq. and 2346 et
				seq.) and other similar United States assistance programs are consistent with
				United States policies and other United States programs relating to combating
				trafficking in persons.</text>
						</subsection><subsection id="ID654137dd90bd4349b69654775ca0128a"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>For each of the fiscal years 2008 through 2011,
				not more than 5 percent of the amounts made available to carry out this
				division may be used to carry out this section, including—</text>
							<paragraph id="ID71e5581952e94a78acaae3de811adab6"><enum>(1)</enum><text>evaluations of
				promising anti-trafficking programs and projects funded by the disbursing
				agency pursuant to this Act; and</text>
							</paragraph><paragraph id="ID411efd0dd5a740a29f2ef49ea085f072"><enum>(2)</enum><text>evaluations of
				emerging problems or global
				trends.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0D3C567C846F4F4194B548D07C49EC23"><enum>105.</enum><header>Minimum
			 standards for the elimination of trafficking</header>
				<subsection id="H0023CFA3A92646EEAB6DF05F241FD82E"><enum>(a)</enum><header>Criteria</header><text>Section
			 108(b) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7106(b)) is
			 amended—</text>
					<paragraph id="HBB3699AF80054FAA849F006F72C540A4"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="H9887B112CFF5433F8FF3353C7E01ADB3"><enum>(A)</enum><text>in the first
			 sentence, by inserting at the end before the period the following: <quote>,
			 including in all appropriate cases requiring incarceration of individuals
			 convicted of such acts</quote>; and</text>
						</subparagraph><subparagraph id="HDD1148576C6E4F6080B1A58590D6E158"><enum>(B)</enum><text>by inserting after
			 the first sentence the following new sentence: <quote>For purposes of the
			 preceding sentence, suspended or significantly-reduced sentences for
			 convictions of principal actors in cases of severe forms of trafficking in
			 persons shall be considered, on a case-by-case basis, whether to be considered
			 an indicator of serious and sustained efforts to eliminate severe forms of
			 trafficking in persons.</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H9C69E86A4BCD4DE4ACDAFB325F48EFA9"><enum>(2)</enum><text>in paragraph (2),
			 by inserting at the end before the period the following: <quote>, including by
			 providing training to law enforcement and immigration officials in the
			 identification and treatment of trafficking victims using approaches that focus
			 on the needs of the victims</quote>.</text>
					</paragraph></subsection></section><section id="H4D105C71945F447AB5902FF3F2FF80"><enum>106.</enum><header>Actions against
			 governments failing to meet minimum standards</header>
				<subsection id="H14B9A17A595E4C84AA7485A6855EF213"><enum>(a)</enum><header>Countries on
			 special watch list relating to trafficking in persons for 3 consecutive
			 years</header><text>Section 110(b)(3) of the Trafficking Victims Protection Act
			 of 2000 (22 U.S.C. 7107(b)(3)) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HC15D14AE126E4A8292A8F7BE752C00AF" style="OLC">
						<subparagraph id="H575DAE988DB94581AEAE00FA12F638F3"><enum>(D)</enum><header>Countries on
				special watch list for 3 consecutive years</header>
							<clause id="id00E94F80253840E19D1709A7DD81F1AB"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided
				under clause (ii), a country that is included on the special watch list
				described in subparagraph (A) for 3 consecutive years after the date of the
				enactment of this subparagraph, shall be included on the list of countries
				described in paragraph (1)(C).</text>
							</clause><clause id="IDdc1bf31a94434e648062b186aca84395"><enum>(ii)</enum><header>Exercise of
				waiver authority</header><text>The President may waive the application of
				clause (i) for up to 1 year if the President determines and certifies to the
				Committee on Foreign Relations of the Senate and the Committee on Foreign
				Affairs of the House of Representatives that such a waiver would promote the
				purposes of this Act or is otherwise in the national interest of the United
				States.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HEB75259FBE0643F2A01743D0EF609B80"><enum>(b)</enum><header>Clarification of
			 measures against certain foreign countries</header><text display-inline="yes-display-inline">Section 110(d)(1)(A)(ii) of such Act is
			 amended by inserting <quote>such assistance to the government of the country
			 for the subsequent fiscal year and will not provide</quote> after <quote>will
			 not provide</quote>.</text>
				</subsection><subsection id="H51BBA5C1A0FE4A249C7E9C75C55B9401"><enum>(c)</enum><header>Translation of
			 Trafficking in Persons Report</header><text display-inline="yes-display-inline">The Secretary of State shall—</text>
					<paragraph id="id958981A69A1A4755BF0EF6B5817972F8"><enum>(1)</enum><text display-inline="yes-display-inline">timely translate the annual report
			 submitted under section 110(b) of the Trafficking Victims Protection Act of
			 2000 (22 U.S.C. 7107(b)) into the principal languages of as many countries as
			 possible, with particular emphasis on the languages of the countries on the
			 lists described in subparagraphs (B) and (C) of section 110(b)(1) of such Act;
			 and</text>
					</paragraph><paragraph id="idDDC68B0626B44726900F2818BC7C69D5"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that such translations are made
			 available to the public, including through postings on the Internet website of
			 the Department of State and other appropriate websites.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HB414A6220CA842FE96D415C67DB2BBF1"><enum>107.</enum><header>Research on
			 domestic and international trafficking in persons</header>
				<subsection display-inline="no-display-inline" id="idD7A17E045C5848A18116ECFBBFAF347A"><enum>(a)</enum><header>Integrated
			 database</header><text display-inline="yes-display-inline">Section 112A of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7109a) is amended—</text>
					<paragraph commented="no" id="id0873319698214F4FA834A41F82FADB14"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by amending paragraph
			 (5) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idB6CC25C8170D4E8B94931CE80C8DAF1A" style="OLC">
							<paragraph commented="no" id="id69FB4AEC6D41417A9B54B9AB5E40612D"><enum>(5)</enum><text display-inline="yes-display-inline">An effective mechanism for quantifying the
				number of victims of trafficking on a national, regional, and international
				basis, which shall include, not later than 2 years after the date of the
				enactment of the <short-title>William Wilberforce
				Trafficking Victims Protection Reauthorization Act of 2008</short-title>, the
				establishment and maintenance of an integrated database within the Human
				Smuggling and Trafficking Center.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="idF07DF4B52D0C437EB2132F5DCE1F1F23"><enum>(2)</enum><text>by amending
			 subsection (b) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idDB8F42A4A6554547BE011EC331B1C808" style="OLC">
							<subsection commented="no" id="id9DB403864AE4401493289DEE37EB3197"><enum>(b)</enum><header>Role of Human
				Smuggling and Trafficking Center</header>
								<paragraph commented="no" id="idA00DC79A062741F8AA9BADA5FA761E59"><enum>(1)</enum><header>In
				general</header><text>The research initiatives described in paragraphs (4) and
				(5) of subsection (a) shall be carried out by the Human Trafficking and
				Smuggling Center, established under section 7202 of the 9/11 Commission
				Implementation Act of 2004 (8 U.S.C. 1777).</text>
								</paragraph><paragraph commented="no" id="id5E2743EDFECE4B6E8297EE804F39819D"><enum>(2)</enum><header>Database</header><text>The
				database described in subsection (a)(5) shall be established by combining all
				applicable data collected by each Federal department and agency represented on
				the Interagency Task Force to Monitor and Combat Trafficking, consistent with
				the protection of sources and methods, and, to the maximum extent practicable,
				applicable data from relevant international organizations, to—</text>
									<subparagraph id="ID6875b575ccbc4a28a4c3b1daf28d5092"><enum>(A)</enum><text>improve the
				coordination of the collection of data related to trafficking in persons by
				each agency of the United States Government that collects such data;</text>
									</subparagraph><subparagraph id="IDd996017906194e62b264b423748a7f25"><enum>(B)</enum><text>promote
				uniformity of such data collection and standards and systems related to such
				collection;</text>
									</subparagraph><subparagraph id="ID45beec4c97304d87b68a597c746ec404"><enum>(C)</enum><text>undertake a
				meta-analysis of patterns of trafficking in persons, slavery, and slave-like
				conditions to develop and analyze global trends in human trafficking;</text>
									</subparagraph><subparagraph id="IDcdefcbc7a09a468e9b516661821b8bad"><enum>(D)</enum><text>identify emerging
				issues in human trafficking and establishing integrated methods to combat them;
				and</text>
									</subparagraph><subparagraph id="IDa7febfc7a801434bb7da6ac57a069e5a"><enum>(E)</enum><text>identify research
				priorities to respond to global patterns and emerging issues.</text>
									</subparagraph></paragraph><paragraph id="ID7bdbc3ed570a44b69eb6b603807a7c2c"><enum>(3)</enum><header>Consultation</header><text>The
				database established in accordance with paragraph (2) shall be maintained in
				consultation with the Director of the Office to Monitor and Combat Trafficking
				in Persons of the Department of State.</text>
								</paragraph><paragraph id="id180F16F2F6564FA69524E2C69EB7DF8C"><enum>(4)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated
				$3,000,000 to the Human Trafficking and Smuggling Center for each of the fiscal
				years 2008 through 2011 to carry out the activities described in this
				subsection.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="id7493356D19A34F10AD0F167933D6E17E"><enum>(b)</enum><header>Report</header><text>Section
			 110(b)(1) of such Act (22 U.S.C. 7107(b)(1)) is amended—</text>
					<paragraph commented="no" id="id6BBB211027B249EBBA65D1A9E5267AC5"><enum>(1)</enum><text>in subparagraph
			 (C), by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph commented="no" id="id0CF67F53D867403C8A8123F60F356220"><enum>(2)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting a semicolon; and</text>

							</subparagraph><subparagraph commented="no" id="id023D28ADDA8D4F58BA925BC37095B4FE"><enum>(F)</enum><text>emerging issues
				in human
				trafficking.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H89D47A8EE7CF47EDAE88F703009FC279"><enum>108.</enum><header>Presidential
			 Award for Extraordinary Efforts to Combat Trafficking in Persons</header><text display-inline="no-display-inline">The Trafficking Victims Protection Act of
			 2000 (22 U.S.C. 7101 et seq.) is amended by inserting after section 112A the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HF751DE6C8DE54EBBB87417E8290395F1" style="OLC">
					<section id="HC55E68EE7C3344E4B0116D4E3429BC43"><enum>112B.</enum><header>Presidential
				Award for Extraordinary Efforts to Combat Trafficking in Persons</header>
						<subsection id="H92F0F573156D407F91AE2FA544F159A4"><enum>(a)</enum><header>Establishment of
				award</header><text display-inline="yes-display-inline">The President is
				authorized to establish an award, to be known as the <quote>Paul D. Wellstone
				Presidential Award for Extraordinary Efforts To Combat Trafficking in
				Persons</quote>, for extraordinary efforts to combat trafficking in persons. To
				the maximum extent practicable, the Secretary of State shall present the award
				annually to not more than 5 individuals or organizations, including—</text>
							<paragraph id="idD7691391D4374C97A51A4782B2342F77"><enum>(1)</enum><text display-inline="yes-display-inline">individuals who are United States citizens
				or foreign nationals; and</text>
							</paragraph><paragraph id="id3BE2B2EA03D44BA4A8FB91574CB2E75A"><enum>(2)</enum><text display-inline="yes-display-inline">United States or foreign nongovernmental
				organizations.</text>
							</paragraph></subsection><subsection id="H71F6343633A94B51A25C038B9FB863FC"><enum>(b)</enum><header>Selection</header><text>The
				President shall establish procedures for selecting recipients of the award
				authorized under subsection (a).</text>
						</subsection><subsection id="HB0E582350C8B4AAC8700E6034D694B4F"><enum>(c)</enum><header>Ceremony</header><text>The
				Secretary of State shall host an annual ceremony for recipients of the award
				authorized under subsection (a) as soon as practicable after the date on which
				the Secretary submits to Congress the report required under section 110(b)(1).
				The Secretary of State may pay the travel costs of each recipient and a guest
				of each recipient who attends the ceremony.</text>
						</subsection><subsection id="H0A272C66F6AC455B8DE76121F1BB9EC2"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated, for each
				of the fiscal years 2008 through 2011, such sums as may be necessary to carry
				out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HCD64810F9BBB40FAA8A3004837EEBA89"><enum>109.</enum><header>Report on
			 activities of the Department of Labor to monitor and combat forced labor and
			 child labor</header>
				<subsection id="HA62030CE09E6450BAFE1669E275F0181"><enum>(a)</enum><header>Final report;
			 public availability of list</header><text display-inline="yes-display-inline">Not later than January 15, 2009, the
			 Secretary of Labor shall—</text>
					<paragraph id="H67C6C84612BB49D29792F9A61FBE073"><enum>(1)</enum><text>submit to the
			 appropriate congressional committees a final report that—</text>
						<subparagraph id="id770718EF5323437A9E26C322D5E912B3"><enum>(A)</enum><text>describes the
			 implementation of section 105(b) of the Trafficking Victims Protection
			 Reauthorization Act of 2005 (22 U.S.C. 7103(b)); and</text>
						</subparagraph><subparagraph id="id237F92584E0E49C090F392E10C38761D"><enum>(B)</enum><text>includes an
			 initial list of goods described in paragraph (2)(C) of such section; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="H78129F16A2A94D358C7B21CFDFA9D5B"><enum>(2)</enum><text>make the list of
			 goods described in paragraph (1)(B) available to the public.</text>
					</paragraph></subsection><subsection id="H8294DC9D96804A99A4ECECD019057CFE"><enum>(b)</enum><header>Appropriate
			 congressional committees defined</header><text>In this section, the term
			 <term>appropriate congressional committees</term> has the meaning given the
			 term in section 103 of the Trafficking Victims Protection Act of 2000 (22

				hardship under section 101(a)(15)(T)(i)(IV), the Secretary of Homeland
				Security, in consultation with the Attorney General and other relevant
				individuals responsible for working with victims and witnesses, may

									<subparagraph id="id772828C20B194A8EAF294BBBA9CAC5BF"><enum>(A)</enum><text display-inline="yes-display-inline">whether the country to which the alien is
				likely to be removed could adequately address security concerns; and</text>
									</subparagraph><subparagraph id="id8ACC4227E8F045599B43418E2720E5AF"><enum>(B)</enum><text display-inline="yes-display-inline">the mental and physical health needs of the
				alien and of the family members of the alien (as described in section
				101(a)(15)(T)(ii)).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="HCA0D2EEE50EA40C09B851200DD3275FC"><enum>(c)</enum><header>Conditions on
			 nonimmigrant status for certain crime victims</header><text>Section 214(p)(6)
			 of the Immigration and Nationality Act (8 U.S.C. 1184(p)(6)) is amended by
			 adding at the end the following: <quote>The Secretary of Homeland Security may
			 extend the authorized period of status of an alien as a nonimmigrant under
			 section 101(a)(15)(U) for a period in excess of 4 years if the Secretary
			 determines that an extension of such period is warranted due to exceptional
			 circumstances. Such alien’s nonimmigrant status shall be extended if the alien
			 is eligible for relief under section 245(m) and is unable to obtain such relief
			 because regulations have not been issued to implement such
			 section.</quote>.</text>
					</subsection><subsection commented="no" id="H0FF1378209C64093882D8D7451C5BDDE"><enum>(d)</enum><header>Adjustment of
			 Status for trafficking victims</header><text>Section 245(l) of the Immigration
			 and Nationality Act (8 U.S.C. 1255(l)) is amended—</text>
						<paragraph commented="no" id="HD5F6A0CAEE4F4E17B9B7F0296D48DFB1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
							<subparagraph commented="no" id="idA2293331B4B74C6FA24191E6716FCE7E"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by striking <quote>the Attorney General,,</quote> and inserting <quote>in the

					<subsection id="HF8640CE755C94D2E919D5657F1E00017"><enum>(a)</enum><header>Information
			 pamphlet</header>
						<paragraph id="id59D5545A8EE445FCA4E8E067763ABEB7"><enum>(1)</enum><header>Development and
			 distribution</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security, in consultation with the Secretary of State, the Attorney
			 General, and the Secretary of Labor, shall develop an information pamphlet on
			 legal rights and resources for aliens applying for employment-based
			 nonimmigrant visas.</text>
						</paragraph><paragraph id="id23A05134939E4D4398A6B2B1B7611D8E"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the information pamphlet
			 under paragraph (1), the Secretary of Homeland Security shall consult with
			 nongovernmental organizations with expertise on the legal rights of workers and
			 victims of severe forms of trafficking in persons.</text>
						</paragraph></subsection><subsection id="H8D560329A45741DFADD7E28D1DA38483"><enum>(b)</enum><header>Contents</header><text>The
			 information pamphlet developed under subsection (a) shall include information
			 concerning—</text>
						<paragraph commented="no" id="HD5194614DB684A8FA58B4600FDEA0163"><enum>(1)</enum><text>the nonimmigrant
			 visa application processes, including information about the portability of
			 employment;</text>
						</paragraph><paragraph commented="no" id="id1283C1B993FC4D17A1D8C99204B6C792"><enum>(2)</enum><text>the legal rights
			 of employment-based nonimmigrant visa holders under Federal immigration, labor,
			 and employment law;</text>
						</paragraph><paragraph id="HC3075AB0D4CE49F1AC9BDFC0B88C3BE4"><enum>(3)</enum><text>the illegality of
			 slavery, peonage, trafficking in persons, sexual assault, extortion, blackmail,
			 and worker exploitation in the United States;</text>
						</paragraph><paragraph id="H481486CE231A42B686097926A7F60021"><enum>(4)</enum><text>the legal rights
			 of immigrant victims of worker exploitation, including—</text>
							<subparagraph id="id6058CDC5D56744DAB016FFFE3C94A2DE"><enum>(A)</enum><text>the right of
			 access to immigrant and labor rights groups;</text>
							</subparagraph><subparagraph id="id43AB4106E0994392BA7BDD7EA0CA67A6"><enum>(B)</enum><text>the right to seek
			 redress in United States courts; and</text>
							</subparagraph><subparagraph id="id250EADD2CF7C4A7D833A36597E5F97B9"><enum>(C)</enum><text>the right to
			 report abuse without retaliation; and</text>
							</subparagraph></paragraph><paragraph id="HAFBA0C1C2F5743A1A7C1D8CF92F5ECD5"><enum>(5)</enum><text display-inline="yes-display-inline">services for victims of severe forms of
			 trafficking in persons and worker exploitation in the United States, including
			 Federal law enforcement and victim services complaint lines.</text>
						</paragraph></subsection><subsection id="HA7B568A25C004D2DB17470A8CC27BC9F"><enum>(c)</enum><header>Translation</header>
						<paragraph id="HF3907F6627C14BDD927E00008E05FE49"><enum>(1)</enum><header>In
			 general</header><text>To best serve the language groups having the greatest
			 concentration of employment-based nonimmigrant visas, the Secretary of Homeland
			 Security shall translate the information pamphlet developed under subsection
			 (a) into not fewer than 14 foreign languages, to be determined by the Secretary
			 based on the languages spoken by the greatest concentrations of
			 employment-based nonimmigrant visa applicants.</text>
						</paragraph><paragraph id="HFD20A6C90DE24BCBB6DEA2A397DF22A1"><enum>(2)</enum><header>Revision</header><text>Every
			 2 years, the Secretary of Homeland Security, in consultation with the Attorney
			 General and the Secretary of State, shall determine the 14 specific languages
			 into which the information pamphlet will be translated based on the languages
			 spoken by the greatest concentrations of employment-based nonimmigrant visa
			 applicants.</text>
						</paragraph></subsection><subsection id="H51047094FC764AB59C64C1B83EF90008"><enum>(d)</enum><header>Availability and
			 distribution</header>
						<paragraph id="HCEA2140F572D4A86BEF46EF364720036"><enum>(1)</enum><header>Posting on
			 federal websites</header><text>The information pamphlet developed under
			 subsection (a) shall be posted on the websites of the Department of State, the
			 Department of Homeland Security, the Department of Justice, the Department of
			 Labor, and all United States consular posts processing applications for
			 nonimmigrant visas.</text>
						</paragraph><paragraph id="H9AF6C9F922BF472DAE4549FD629BE42"><enum>(2)</enum><header>Other
			 distribution</header><text>The information pamphlet developed under subsection
			 (a) shall be made available to any—</text>
							<subparagraph id="id6923E43CFE4D4147B1127BD051A6B117"><enum>(A)</enum><text>government
			 agency;</text>
							</subparagraph><subparagraph id="idDF097015D7C94BE8A01D72A1056F11C0"><enum>(B)</enum><text>nongovernmental
			 advocacy organization; or</text>
							</subparagraph><subparagraph id="id326D7D4266A64DA3AB30066E5070E57C"><enum>(C)</enum><text>foreign labor
			 broker doing business in the United States.</text>
							</subparagraph></paragraph><paragraph id="HCC2E289E45534A0F87BC122242011D70"><enum>(3)</enum><header>Deadline for
			 pamphlet development and distribution</header><text>Not later than 180 days
			 after the date of the enactment of this Act, the Secretary of Homeland Security
			 shall distribute and make available the information pamphlet developed under
			 subsection (a) in all the languages referred to in subsection (c).</text>
						</paragraph></subsection><subsection id="ID1726e505ac7e40089fcbd9b5472e1d18"><enum>(e)</enum><header>Responsibilities
			 of consular officers of the Department of State</header>
						<paragraph id="IDf58d22ed00a14289bdfeb73c8b854e40"><enum>(1)</enum><header>Interviews</header><text>A
			 consular officer conducting an interview of an alien for an employment-based
			 nonimmigrant visa shall—</text>
							<subparagraph id="idB8E4EB0111C149A087940F28646E19B0"><enum>(A)</enum><text>orally disclose
			 to the alien the information described in paragraphs (2) and (3) in a language
			 that the alien understands; and</text>
							</subparagraph><subparagraph id="idC17C31EEA72C44D088DBEEA63B1B4BE6"><enum>(B)</enum><text>distribute the
			 pamphlet required under subsection (a).</text>
							</subparagraph></paragraph><paragraph id="ID504b41e3fe1c4345875e7828b6ce6eaf"><enum>(2)</enum><header>Legal
			 rights</header><text>The consular officer shall disclose to the alien—</text>
							<subparagraph id="id7EF5E43CF7D6476B82E2022A37835D95"><enum>(A)</enum><text>the legal rights
			 of employment-based nonimmigrant visa holders under Federal immigration, labor,
			 and employment laws;</text>
							</subparagraph><subparagraph id="id27875614BBC1468AB3999249E9B062AA"><enum>(B)</enum><text>the illegality of
			 slavery, peonage, trafficking in persons, sexual assault, extortion, blackmail,
			 and worker exploitation in the United States; and</text>
							</subparagraph><subparagraph id="id2C93C222C288423D8EF2208A2D2B1CBA"><enum>(C)</enum><text>the legal rights
			 of immigrant victims of trafficking in persons, worker exploitation, and other
			 related crimes, including—</text>
								<clause id="id05404BFB76734C9FBEFDE69467FDAC2B"><enum>(i)</enum><text>the
			 right of access to immigrant and labor rights groups;</text>
								</clause><clause id="idB89D5AF6120F453F98D8BE7999DBFCE8"><enum>(ii)</enum><text>the right to
			 seek redress in United States courts; and</text>
								</clause><clause id="idDF9A057E9BE94244BCA75AC75D0BB89B"><enum>(iii)</enum><text>the right to
			 report abuse without retaliation.</text>
								</clause></subparagraph></paragraph><paragraph id="ID07d26138223242e0ac4568de1ffe219a"><enum>(3)</enum><header>Victim
			 services</header><text>In carrying out the disclosure requirement under this
			 subsection, the consular officer shall disclose to the alien the availability
			 of services for victims of human trafficking and worker exploitation in the
			 United States, including victim services complaint hotlines.</text>
						</paragraph></subsection><subsection commented="no" id="HB4018D8478A645DCA4EB4FB74C46B90"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph commented="no" id="H78FD130E40264BF18D7FD977CED13412"><enum>(1)</enum><header>Employment-based
			 nonimmigrant visa</header><text display-inline="yes-display-inline">The term
			 <term>employment-based nonimmigrant visa</term> means a nonimmigrant visa
			 issued for the purpose of employment, education, or training in the United
			 States, including visas issued under subparagraph (A)(iii), (B)(i) (but only
			 for domestic servants described in clause (i) or (ii) of section 274a.12(c)(17)
			 of title 8, Code of Federal Regulations (as in effect on December 4, 2007)),
			 (G)(v), (H), (J), (L), (Q), or (R) of section 101(a)(15) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(15)).</text>
						</paragraph><paragraph id="H0C72B0962376428D8E6BA1B2F1E5A67F"><enum>(2)</enum><header>Severe forms of
			 trafficking in persons</header><text>The term <term>severe forms of trafficking
			 in persons</term> has the meaning given the term in section 103 of the
			 Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102).</text>
						</paragraph></subsection></section><section id="IDe8a2a6cd2b754edaa561a0113a8a97c4"><enum>203.</enum><header>Domestic
			 worker protections</header>
					<subsection id="ID5a582e0a7cd342e69d80eff73e72e285"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="IDe868586a601a4b4790f259b652cdc627"><enum>(1)</enum><header>A–3
			 visa</header><text>The term <term>A–3 visa</term> means a nonimmigrant visa
			 issued pursuant to section 101(a)(15)(A)(iii) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(15)(A)(iii)).</text>
						</paragraph><paragraph id="ID6de2e06468644276a4763c0a8a346355"><enum>(2)</enum><header>G–5
			 visa</header><text>The term <term>G–5 visa</term> means a nonimmigrant visa
			 issued pursuant to section 101(a)(15)(G)(v) of the Immigration and Nationality
			 Act (8 U.S.C. 1101(a)(15)(G)(v)).</text>
						</paragraph><paragraph id="IDf901675b99fe40cf9314becd9e39be8b"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of State.</text>
						</paragraph></subsection><subsection id="ID8b7d844c11ba4f4aaa316cd5a581849a"><enum>(b)</enum><header>Distribution of
			 anti-trafficking information to applicants for A–3 and G–5 visas</header>
						<paragraph id="ID17be01097596432f99dbb22a2cc9e85c"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall ensure the content, consistency, and
			 accuracy of information disseminated to—</text>
							<subparagraph id="ID8f351a2fe66d49ca878626daed2b3a71"><enum>(A)</enum><text>recipients of A–3
			 and G–5 visas; and</text>
							</subparagraph><subparagraph id="ID50117067eed843018c3decff058223d3"><enum>(B)</enum><text>sponsors or
			 employers of such visa applicants or visa holders.</text>
							</subparagraph></paragraph><paragraph id="ID1a93726ac2ff4277b0ae8084bb40214c"><enum>(2)</enum><header>Information
			 pamphlet</header>
							<subparagraph id="id6E5466A822944FBFAA7C5F8A8752D47E"><enum>(A)</enum><header>Development</header><text>Pursuant
			 to paragraph (1), the Secretary, in consultation with the Secretary of the
			 Department of Homeland Security, the Attorney General, the Secretary of Labor,
			 and nongovernmental organizations with expertise in the legal rights of, and
			 services for, human trafficking victims and immigrant workers, shall develop an
			 information pamphlet for applicants seeking A–3 and G–5 visas.</text>
							</subparagraph><subparagraph id="ID09a08760522940428f98d2c3cf49ff6b"><enum>(B)</enum><header>Content</header><text>The
			 pamphlet required under this paragraph shall include information on—</text>
								<clause id="IDc5dbd82800fb4946a1e89ec20f62eacc"><enum>(i)</enum><text>the
			 visa application process;</text>
								</clause><clause id="IDe26242853e2443ad8f0acb803c3bdce0"><enum>(ii)</enum><text>the terms and
			 conditions of the immigration status granted such visa holders in the United
			 States, if admitted;</text>
								</clause><clause id="IDece6af07eee841fb81eafc1027584470"><enum>(iii)</enum><text>the rights of
			 A–3 and G–5 visa holders under Federal immigration, labor, and employment laws,
			 including—</text>
									<subclause id="id62A84647B5F747C9A3685113CBD703B1"><enum>(I)</enum><text>the right to
			 report abuse without retaliation;</text>
									</subclause><subclause id="id6B9B53C88F584F23BD86ABE6869B80B0"><enum>(II)</enum><text>the right of
			 access to immigrant and labor rights groups; and</text>
									</subclause><subclause id="id90F9AC2D217D4B66947EE6F6BE81E758"><enum>(III)</enum><text>the right to
			 seek redress in United States courts;</text>
									</subclause></clause><clause id="IDc91611638c6544a3b53017ea900374ed"><enum>(iv)</enum><text>the laws of the
			 United States prohibiting slavery, peonage, trafficking in persons, sexual
			 assault, extortion, blackmail, and worker exploitation;</text>
								</clause><clause id="IDa8a4ed61ba474ec98cb7a972352559ac"><enum>(v)</enum><text>the
			 right of the visa holder to retain possession of their passport;</text>
								</clause><clause id="ID8f00108e3072443e8da17d8e9e95f961"><enum>(vi)</enum><text>the requirement
			 of an employment contract between the employer and the visa holder and an
			 explanation of the rights and protections included in the contract; and</text>
								</clause><clause id="IDba342592a50349eab49c0231115f264a"><enum>(vii)</enum><text>information
			 about nongovernmental organizations that provide services to trafficking
			 victims, including—</text>
									<subclause id="id0A558E0BE02444C4A7DCB78B79722961"><enum>(I)</enum><text>the National
			 Trafficking in Persons and Worker Exploitation Task Force complaint
			 line;</text>
									</subclause><subclause id="idC41FCFAE412446079175F6166E1CBBE1"><enum>(II)</enum><text>the Operation
			 Rescue and Restore hotline; and</text>
									</subclause><subclause id="id4CDC4C00A75C4C83A7ABB8D8FC49CCDB"><enum>(III)</enum><text>a general
			 description of the types of victims services available if an individual is
			 subject to trafficking in persons.</text>
									</subclause></clause></subparagraph><subparagraph id="ID0e2446c09cf94e029a25cf0148f887d9"><enum>(C)</enum><header>Translation</header><text>The
			 Secretary, in consultation with the Secretary of Homeland Security, shall
			 translate the information pamphlet required under this paragraph into at least
			 10 languages based upon the languages spoken by the greatest concentration of
			 A–3 and G–5 visa holders.</text>
							</subparagraph><subparagraph id="ID1f32aad6759242ffaa1c67739ef67418"><enum>(D)</enum><header>Availability</header>
								<clause id="IDb42e871bef9c41f2bf0811a5e244a910"><enum>(i)</enum><header>By
			 mail</header><text>The Secretary shall mail the information pamphlet developed
			 under this paragraph to each applicant for an A–3 or G–5 visa. The pamphlet
			 shall be in the primary language of the applicant, or in English if no
			 translation into the applicant’s primary language is available.</text>
								</clause><clause id="IDc754c8f0bf9744b6ae7503d7e2792c39"><enum>(ii)</enum><header>Consular
			 interviews</header><text>The consular officer conducting the personal interview
			 with the visa applicant shall provide the information pamphlet developed under
			 this paragraph to the applicant. If a version of the pamphlet is not available
			 in the primary language of the applicant, the officer shall—</text>
									<subclause id="IDf2403fb20e6d45fca8b85df64b60b17b"><enum>(I)</enum><text>provide the
			 applicant with a copy of the pamphlet in English; and</text>
									</subclause><subclause id="ID1e77251fccb64b6084d62a214f7f2398"><enum>(II)</enum><text>if the officer
			 determines that the applicant is illiterate, review the pamphlet with the
			 applicant orally in the primary language of the applicant.</text>
									</subclause></clause><clause id="IDe3f062ca9da64c44ad56e6b9681b639c"><enum>(iii)</enum><header>Website</header><text>The
			 Secretary shall ensure that the information pamphlet developed under this
			 paragraph is posted on—</text>
									<subclause id="id147578ED1F6E4D3788EAE6640794E0D3"><enum>(I)</enum><text>the Internet
			 website of the Department of State; and</text>
									</subclause><subclause id="id49022774A5544334B3BEB2D00220DA5C"><enum>(II)</enum><text>on the Internet
			 websites of all consular posts processing A–3 and G–5 visa applications.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="IDedb0d6b446564229bc1754cc69cba54e"><enum>(c)</enum><header>Limitations on
			 issuance of A–3 and G–5 visas</header>
						<paragraph id="id5114DC89FD83432BBE29BD18125DCE2F"><enum>(1)</enum><header>Contract
			 requirement</header><text>Notwithstanding any other provision of law, the
			 Secretary may not issue a visa—</text>
							<subparagraph id="IDf109920b9f1648e29a849831893f9c97"><enum>(A)</enum><text>under section
			 101(a)(15)(A)(iii) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(15)(A)(iii)) unless the applicant is employed, or has signed a contract
			 to be employed, by the Ambassador, Deputy Chief of Mission, or principal
			 officer or deputy principal officer of a diplomatic mission or consular post;
			 or</text>
							</subparagraph><subparagraph id="id9EBCB19CAA0945168B3C90B94BB186ED"><enum>(B)</enum><text>under section
			 101(a)(15)(G)(v) of such Act unless the applicant is employed, or has signed a
			 contract to be employed by an employee in a senior management position in an
			 international organization.</text>
							</subparagraph></paragraph><paragraph id="idBBA945E49B3C4D199076F351BEABF828"><enum>(2)</enum><header>Suspension
			 requirement</header><text>Notwithstanding any other provision of law, the
			 Secretary shall suspend, for such period as the Secretary determines necessary,
			 the issuance of visas under subparagraphs (A)(iii) and (G)(v) of section
			 101(a)(15) of the Immigration and Nationality Act to applicants seeking to work
			 for officials of a diplomatic mission, if the Secretary finds that such
			 mission, or the employees of such mission, have a record of abusing or
			 exploiting A–3 or G–5 visa holders, or of tolerating such actions.</text>
						</paragraph></subsection><subsection id="ID5c08f222a7bc44678ce6fbe60ac12c7a"><enum>(d)</enum><header>Protections and
			 remedies for A–3 and G–5 visa holders employed by diplomats and staff of
			 international organizations</header>
						<paragraph id="IDa6ff1c9071c94bec8074378da00594a7"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may not issue or renew an A–3 or G–5 visa
			 unless—</text>
							<subparagraph id="ID6efb3d484e68487796129f43add658aa"><enum>(A)</enum><text>the visa
			 applicant has executed a contract with the employer or prospective employer
			 containing provisions described in paragraph (2); and</text>
							</subparagraph><subparagraph id="ID5526682e4d474eef80ee476b7e7ee858"><enum>(B)</enum><text>a consular
			 officer has conducted a personal interview with the applicant outside the
			 presence of the employer or any recruitment agent in which the officer reviewed
			 the terms of the contract and the provisions of the pamphlet required under
			 subsection (b)(2).</text>
							</subparagraph></paragraph><paragraph id="ID305ece7efea442b9b9cac26fc5420cfd"><enum>(2)</enum><header>Mandatory
			 contract</header><text>The contract between the employer and domestic worker
			 required under paragraph (1) shall include—</text>
							<subparagraph id="ID2d0a5c7b80744dbc99aa541952ee57a1"><enum>(A)</enum><text>an agreement by
			 the employer to abide by all Federal, State, and local laws in the United
			 States;</text>
							</subparagraph><subparagraph id="ID7f8ec2a6cc454e588f731ba881506108"><enum>(B)</enum><text>information on
			 the frequency and form of payment, work duties, weekly work hours, holidays,
			 sick days, and vacation days; and</text>
							</subparagraph><subparagraph id="ID68db610f894b4ae19be7c1671e647890"><enum>(C)</enum><text>an agreement by
			 the employer not to withhold the passport, employment contract, or other
			 personal property of the employee.</text>
							</subparagraph></paragraph><paragraph id="ID7da789db13df41a9b5dc12f292ec6040"><enum>(3)</enum><header>Training of
			 consular officers</header><text>The Secretary shall provide appropriate
			 training to consular officers on fair labor standards in the United States,
			 trafficking in persons, and the provisions of this section.</text>
						</paragraph><paragraph id="ID4b94b2d97b7d4873ac3f53ef8d55740a"><enum>(4)</enum><header>Recordkeeping</header>
							<subparagraph id="idC09B21232A794972B0D2F7CCCC4ECB7D"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall maintain records on the presence of
			 A–3 and G–5 visa holders in the United States, including—</text>
								<clause id="id873061A0059D4C5791561AFA40B34E79"><enum>(i)</enum><text>a
			 copy of the employment contract of applicants for such visas;</text>
								</clause><clause id="idE30AFE13186F4884A974DEBA3EDE992A"><enum>(ii)</enum><text>information
			 about when the visa holder entered and permanently exited the country place of
			 residence;</text>
								</clause><clause id="id9E4BFB2F97944F25A81A9375C7901BB3"><enum>(iii)</enum><text>the official
			 title, contact information, and immunity level of the employer; and</text>
								</clause><clause id="idB9681E3D953441A0873101B310F9B36B"><enum>(iv)</enum><text>information
			 regarding any allegations of abuse received by the Department of State.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDcc981a628f56445db04cc44236e086fd"><enum>(e)</enum><header>Protection from
			 removal during legal actions against former employers</header>
						<paragraph id="ID29028fc496994b139e00c3b5e0e32e53"><enum>(1)</enum><header>Remaining in
			 the United States to seek legal redress</header>
							<subparagraph id="ID95a7b469357f43378194931926501577"><enum>(A)</enum><header>In
			 general</header>
								<clause id="id840C29EB85C642DBA2624641426926A3"><enum>(i)</enum><header>Effect of
			 complaint filing</header><text>If an A–3 or G–5 visa holder working in the
			 United States files a complaint regarding a violation of any of the terms
			 contained in the contract or violation of any other Federal, State, or local
			 law in the United States governing the terms and conditions of employment of
			 the visa holder, the Attorney General and the Secretary of Homeland Security
			 shall permit the visa holder to remain legally in the United States for time
			 sufficient to participate fully and effectively in all administrative and legal
			 proceedings related to the complaint.</text>
								</clause><clause id="id57F233510FD24AD19F5B8329B9BFAB4F"><enum>(ii)</enum><header>Failure to
			 exercise due diligence</header><text>If the Secretary of Homeland Security,
			 after consultation with the Attorney General, determines that the A–3 or G–5
			 visa holder has failed to exercise due diligence in pursuing such action, the
			 Secretary may revoke the order permitting the A–3 or G–5 visa holder to remain
			 in the United States.</text>
								</clause></subparagraph><subparagraph id="ID3db8d16fa9764aa0a8ce8dc88d230aed"><enum>(B)</enum><header>Authorization
			 to work</header><text>The Attorney General and the Secretary of Homeland
			 Security shall authorize visa holders described in subparagraph (A) to engage
			 in employment in the United States during the period the visa holder is in the
			 United States pursuant to subparagraph (A).</text>
							</subparagraph></paragraph></subsection><subsection id="ID6adb35b3b44b4429a1fe37da3023e8c0"><enum>(f)</enum><header>Study and
			 report</header>
						<paragraph id="IDd379861aabfc482ca12fe1113f4702cf"><enum>(1)</enum><header>Investigation
			 report</header>
							<subparagraph id="idB92F75463B9849119275950BE1C7103A"><enum>(A)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, and every 2 years thereafter for the following 10 years, the
			 Secretary shall submit a report to the appropriate congressional committees on
			 the implementation of this section.</text>
							</subparagraph><subparagraph id="id64EAB299911844C99A10B121DD4E5F83"><enum>(B)</enum><header>Contents</header><text>The
			 report submitted under subparagraph (A) shall include—</text>
								<clause id="idF9F6EE74288840FABC9A7C63699E2475"><enum>(i)</enum><text>an
			 assessment of the actions taken by the Department of State and the Department
			 of Justice to investigate allegations of trafficking or abuse of A–3 and G–5
			 visa holders; and</text>
								</clause><clause id="idE1603B98F4B44B23967458D99C4858B5"><enum>(ii)</enum><text>the results of
			 such investigations.</text>
								</clause></subparagraph></paragraph><paragraph id="ID34ced07b63544709a32721fc2fe895aa"><enum>(2)</enum><header>Feasibility of
			 oversight of employees of diplomats and representatives of other institutions
			 report</header><text>Not later than 180 days after the date of the enactment of
			 this Act, the Secretary shall submit a report to the appropriate congressional
			 committees on the feasibility of—</text>
							<subparagraph id="IDe6743528a007462b9dbffd31607b5fca"><enum>(A)</enum><text>establishing a
			 system to monitor the treatment of A–3 and G–5 visa holders who have been
			 admitted to the United States;</text>
							</subparagraph><subparagraph id="ID02d8865487144e839c82dd3f262eeaf4"><enum>(B)</enum><text>a range of
			 compensation approaches, such as a bond program, compensation fund, or
			 insurance scheme, to ensure that such visa holders receive appropriate
			 compensation if their employers violate the terms of their employment
			 contracts; and</text>
							</subparagraph><subparagraph id="id2DB35FF98F714C1A8A32DE3A73088357"><enum>(C)</enum><text>with respect to
			 each proposed compensation approach described in subparagraph (B), an
			 evaluation and proposal describing the proposed processes for—</text>
								<clause id="id6B704737B7694691ACF4822CC08D02B3"><enum>(i)</enum><text>adjudicating
			 claims of rights violations;</text>
								</clause><clause id="id72D8401C5B0540609F6A339AC2150335"><enum>(ii)</enum><text>determining the
			 level of compensation; and</text>
								</clause><clause id="id9FFAE020F911496E918CFA10188173E3"><enum>(iii)</enum><text>administering
			 the program, fund, or scheme.</text>
								</clause></subparagraph></paragraph></subsection></section><section commented="no" id="HBF4B2D264B904345BCD5A02FD8D43949"><enum>204.</enum><header>Relief for
			 certain victims pending actions on petitions and applications for
			 relief</header><text display-inline="no-display-inline">Section 237 of the
			 Immigration and Nationality Act (8 U.S.C. 1227) is amended by adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H96F214D5ED59456DAD9F6088529727F7" style="traditional">
						<subsection commented="no" id="H11AFE90D5DB54356B8EECFEB1CE90378"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8DC9CC324C4B49FDA0AEB5588B408751"><enum>(1)</enum><text>If an application for
				nonimmigrant status under section 101(a)(15)(T) filed for an alien in the
				United States sets forth a prima facie case for approval, the Secretary of
				Homeland Security may grant the alien a stay of removal or deportation
				until—</text>
								<subparagraph commented="no" id="idD6F52100204C44DE8C7108DA1920B903" indent="up1"><enum>(A)</enum><text>the application is approved; or</text>
								</subparagraph><subparagraph commented="no" id="id0CC362678B6740BCA7F3BD6412DBC703" indent="up1"><enum>(B)</enum><text>the application is denied, after the
				exhaustion of administrative appeals.</text>
								</subparagraph></paragraph><paragraph commented="no" id="id51533165E3EC4C609D99EF9AB39471F3" indent="up1"><enum>(2)</enum><text>Any appeal of the denial of a stay of
				removal or deportation under this subsection shall accompany any appeal of the
				underlying substantive petition or application for benefits.</text>
							</paragraph><paragraph commented="no" id="HFA7B6851E08E4CBB00B11918006BDDDE" indent="up1"><enum>(3)</enum><text>During any period in which an alien
				is provided a stay of removal under this subsection, the alien may not be
				removed or deported.</text>
							</paragraph><paragraph commented="no" id="HCBB3AAA552B042C5BB19DC797DF6603" indent="up1"><enum>(4)</enum><text>Nothing in this subsection may be
				construed to limit the authority of the Secretary of Homeland Security to grant
				a stay of removal or deportation in any case not described in this
				subsection.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" id="H5C55E672482948FE966F22186826B5D2"><enum>205.</enum><header>Expansion of
			 authority to permit continued presence in the United States</header>
					<subsection commented="no" id="H8290EE9B80EB483A86B53BA2835E72F9"><enum>(a)</enum><header>Expansion of
			 authority</header>
						<paragraph id="H8D6440AD961840358D00D0BDC548B41F"><enum>(1)</enum><header>In
			 general</header><text>Section 107(c)(3) of the Trafficking Victims Protection
			 Act of 2000 (22 U.S.C. 7105(c)(3)) is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="HEF07BAE5FB484C35B5F8013740FD79" style="OLC">
								<paragraph id="H19A1BC637CAE41B183EC3E40225E87B0"><enum>(3)</enum><header>Authority to
				permit continued presence in the United States</header>
									<subparagraph id="H31AF540EC7EE4624BA8EA4543300AEA0"><enum>(A)</enum><header>Trafficking
				victims</header>
										<clause id="H7CBB09651CA64E488200C1E8ACD1A409"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">If a Federal law
				enforcement official files an application that makes a prima facie showing that
				an alien may be a victim of a severe form of trafficking and may be a potential
				witness to such trafficking, the Secretary of Homeland Security may permit the
				alien to remain in the United States to facilitate the investigation and
				prosecution of those responsible for such crime.</text>
										</clause><clause id="H56B26EF45DA34E558823F6403DEEC284"><enum>(ii)</enum><header>Safety</header><text display-inline="yes-display-inline">While investigating and prosecuting
				suspected traffickers, Federal law enforcement officials described in clause
				(i) shall make reasonable efforts to protect the safety of trafficking victims,
				including taking measures to protect trafficked persons and their family
				members from intimidation, threats of reprisals, and reprisals from traffickers
				and their associates.</text>
										</clause><clause id="H9C79EA46C7CD42FEA7D0369B400FF75"><enum>(iii)</enum><header>Continuation of
				presence</header><text display-inline="yes-display-inline">The Secretary shall
				permit an alien described in clause (i) who has filed a civil action under
				section 1595 of title 18, United States Code, to remain in the United States
				until such action is concluded. If the Secretary, in consultation with the
				Attorney General, determines that the alien has failed to exercise due
				diligence in pursuing such action, the Secretary may revoke the order
				permitting the alien to remain in the United States.</text>
										</clause></subparagraph><subparagraph id="HEFBC4CA09C8246F695B9A341001ED9FB"><enum>(B)</enum><header>Parole for
				relatives</header><text display-inline="yes-display-inline">Law enforcement
				officials may submit written requests to the Secretary of Homeland Security, in
				accordance with section 240A(b)(6) of the Immigration and Nationality Act (8
				U.S.C. 1229b(b)(b)), to permit the parole into the United States of certain
				relatives of an alien described in subparagraph (A)(i).</text>
									</subparagraph><subparagraph id="H05F3AF287BAB4677924F44992D31D711"><enum>(C)</enum><header>State and local
				law enforcement</header><text>The Secretary of Homeland Security, in
				consultation with the Attorney General, shall—</text>
										<clause id="id9ABF3D25C3D445BDA055790CC2FC3011"><enum>(i)</enum><text>develop materials
				to assist State and local law enforcement officials in working with Federal law
				enforcement to obtain continued presence for victims of a severe form of
				trafficking in cases investigated or prosecuted at the State or local level;
				and</text>
										</clause><clause id="id4DF9426CF3664CCD81181607519BFB91"><enum>(ii)</enum><text>distribute the
				materials developed under clause (i) to State and local law enforcement
				officials.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph commented="no" id="H79C68F3FDD72461100346645659DF459"><enum>(2)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1)—</text>
							<subparagraph commented="no" id="idED4170BE9A474460AB3DB1AFF04C7D19"><enum>(A)</enum><text display-inline="yes-display-inline">shall take effect on the date of the
			 enactment of this Act;</text>
							</subparagraph><subparagraph commented="no" id="id5EB84FF88A2C46FE861604B965672E70"><enum>(B)</enum><text display-inline="yes-display-inline">shall apply to requests for continued
			 presence filed pursuant to section 107(c)(3) of the Trafficking Victims
			 Protection Act (22 U.S.C. 7105(c)(3)) before, on, or after such date;
			 and</text>
							</subparagraph><subparagraph commented="no" id="idA41BDE3734114CEF8A75EAE3149EA535"><enum>(C)</enum><text display-inline="yes-display-inline">may not be applied to an alien who is not
			 present in the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="HAF9200650AEC49F5B982532B8DA18BA2"><enum>(b)</enum><header>Parole for
			 derivatives of trafficking victims</header><text display-inline="yes-display-inline">Section 240A(b) of the Immigration and
			 Nationality Act (8 U.S.C. 1229b(b)) is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H680AAC1B49BE41968FDF00DEAC368FD2" style="OLC">
							<paragraph id="HAABA16EACBC7432EB4525107A1156A8"><enum>(6)</enum><header>Relatives of
				trafficking victims</header>
								<subparagraph id="H5A41E126EC3347DAAA99000063115F6F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Upon written request
				by a law enforcement official, the Secretary of Homeland Security may parole
				under section 212(d)(5) any alien who is a relative of an alien granted
				continued presence under section 107(c)(3)(A) of the Trafficking Victims
				Protection Act (22 U.S.C. 7105(c)(3)(A)), if the relative—</text>
									<clause id="HFD278824C8D1485D9892B4C1911D6EF5"><enum>(i)</enum><text display-inline="yes-display-inline">was, on the date on which law enforcement
				applied for such continued presence—</text>
										<subclause id="H89FBC397839C40E29B1D9B997765E62D"><enum>(I)</enum><text>in the case of an
				alien granted continued presence who is under 21 years of age, the spouse,
				child, parent, or unmarried sibling under 18 years of age, of the alien;
				or</text>
										</subclause><subclause id="H89565082CD454BBBA6F2E360ECD26E18"><enum>(II)</enum><text>in the case of an
				alien granted continued presence who is 21 years of age or older, the spouse or
				child of the alien; or</text>
										</subclause></clause><clause id="H221DFF66A9A14B2EBA0010709FA36595"><enum>(ii)</enum><text display-inline="yes-display-inline">is a parent or sibling of the alien who the
				requesting law enforcement official determines to be in present danger of
				retaliation as a result of the alien’s escape from the severe form of
				trafficking or cooperation with law enforcement, irrespective of age.</text>
									</clause></subparagraph><subparagraph id="H92898DEDD5A9474C95A50817F100F52E"><enum>(B)</enum><header>Duration of
				parole</header>
									<clause commented="no" id="H15098C5E9E6A4317978655E2F23203F0"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall extend the parole granted under
				subparagraph (A) until the final adjudication of the application filed by the
				principal alien under section 101(a)(15)(T)(ii).</text>
									</clause><clause commented="no" id="H51B2FDDD02FA45F2B0FFE878988C521F"><enum>(ii)</enum><header>Other limits on
				duration</header><text>If an application described in clause (i) is not filed,
				the parole granted under subparagraph (A) shall extend until the later
				of—</text>
										<subclause commented="no" id="H55A39DE3C8064820999C236890995976"><enum>(I)</enum><text>the date on which
				the principal alien’s authority to remain in the United States under section
				107(c)(3)(A) of the Trafficking Victims Protection Act (22 U.S.C.
				7105(c)(3)(A)) is terminated; or</text>
										</subclause><subclause commented="no" id="H88C95E3E976D4F31B3143C1708120002"><enum>(II)</enum><text>the date on which
				a civil action filed by the principal alien under section 1595 of title 18,
				United States Code, is concluded.</text>
										</subclause></clause><clause commented="no" id="H84E305BA536F434797F901FACAA089F5"><enum>(iii)</enum><header>Due
				diligence</header><text display-inline="yes-display-inline">Failure by the
				principal alien to exercise due diligence in filing a visa petition on behalf
				of an alien described in clause (i) or (ii) of subparagraph (A), or in pursuing
				the civil action described in clause (ii)(II) (as determined by the Secretary
				of Homeland Security in consultation with the Attorney General), may result in
				revocation of parole.</text>
									</clause></subparagraph><subparagraph id="IDa9449626305a44ab8243e89110a58e9a"><enum>(C)</enum><header>Other
				limitations</header><text>A relative may not be granted parole under this
				paragraph if—</text>
									<clause id="idEDF7F69D483043BDB86AFF0D534BE827"><enum>(i)</enum><text>the Secretary of
				Homeland Security or the Attorney General has reason to believe that the
				relative was knowingly complicit in the trafficking of an alien permitted to
				remain in the United States under section 107(c)(3)(A) of the Trafficking
				Victims Protection Act (22 U.S.C. 7105(c)(3)(A)); or</text>
									</clause><clause id="id396CA3C705704C82A33DED12C0252866"><enum>(ii)</enum><text>the relative is
				an alien described in paragraph (2) or (3) of section 212(a) or paragraph (2)
				or (4) of section
				237(a).</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section commented="no" id="H19DA00ACA28C484F9558E723CEB97178"><enum>206.</enum><header>Implementation
			 of Trafficking Victims Protection Reauthorization Act of 2005</header>
					<subsection commented="no" id="id466356FCAC5C4DD288FBCF36D8DCDD13"><enum>(a)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 the enactment of this Act, the Secretary of Homeland Security shall issue
			 interim regulations regarding the adjustment of status to permanent residence
			 for nonimmigrants admitted into the United States under section 101(a)(15)(T)
			 or (U) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(T) and
			 (U)).</text>
					</subsection><subsection commented="no" id="idD93A7721F13640D5A857521F96A53643"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">If the interim regulations required under
			 subsection (a) are not issued by the deadline set forth in subsection (a), the
			 Secretary shall submit a report providing a detailed explanation of the reasons
			 such regulations have not been issued to—</text>
						<paragraph commented="no" id="idB1985D71101D4C4886B992F860C2DE65"><enum>(1)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the
			 Senate</committee-name>;</text>
						</paragraph><paragraph commented="no" id="idF089A1DFE99843DFA06D765F44297CF1"><enum>(2)</enum><text display-inline="yes-display-inline">the
			 <committee-name added-display-style="italic" committee-id="SSJU00" deleted-display-style="strikethrough">Committee on the Judiciary of the
			 Senate</committee-name>;</text>
						</paragraph><paragraph commented="no" id="idD21514216526465BBBF286AAF7EF02E1"><enum>(3)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Foreign Affairs of the House of
			 Representatives</committee-name>; and</text>

			 certain nonimmigrant status applicants</header>
					<subsection commented="no" id="H8BD754481FFA479CBBBBEF49CFAA95A3"><enum>(a)</enum><header>In
			 general</header><text>Section 431(c) of the Personal Responsibility and Work
			 Opportunity Reconciliation Act of 1996 (8 U.S.C. 1641(c)) is amended—</text>

			 date</header><text>The amendments made by subsection (a) shall apply to
			 applications for public benefits and public benefits provided on or after the
			 date of the enactment of this Act without regard to whether regulations have
			 been implemented to carry out such amendments.</text>
					</subsection></section><section id="HBDCFE065E01A4D49ADC5CACFFBA9058"><enum>212.</enum><header>Interim
			 assistance for child victims of trafficking</header>
					<subsection id="H08CE5F9EB5CB49D8B7AAAACFB1C503ED"><enum>(a)</enum><header>In
			 general</header><text>Section 107(b)(1) of the Trafficking Victims Protection
			 Act of 2000 (22 U.S.C. 7105(b)(1)) is amended—</text>

								<subparagraph id="HF61C543D13754033BA7BC6ABD3D16B72"><enum>(F)</enum><header>Eligibility of
				interim assistance for child victims</header>
									<clause id="HC8BB633EAEB54917B58E89B206CCB2B"><enum>(i)</enum><header>Determination</header><text>Upon
				receiving credible information that a person described in subparagraph
				(C)(ii)(I) who is seeking assistance under this paragraph has been subjected to
				a severe form of trafficking in persons, the Secretary of Health and Human
				Services shall promptly determine if the person is eligible for interim
				assistance under this paragraph. The Secretary shall have exclusive authority
				to make interim eligibility determinations under this clause.</text>
									</clause><clause id="IDd2c6cea65b4145c58e6271cab233b2ec"><enum>(ii)</enum><header>Notification</header><text>The
				Secretary of Health and Human Services shall notify the Attorney General and
				the Secretary of Homeland Security not later than 48 hours after all interim
				eligibility determinations have been made under clause (i) if there is evidence
				of an ongoing violation.</text>
									</clause><clause id="H9D746F864E4449B5B9B3869EF3DD3E9C"><enum>(iii)</enum><header>Duration</header><text>Assistance
				under this paragraph may be provided to individuals determined to be eligible
				under clause (i) for a period of up to 90 days and may be extended for an
				additional 30 days.</text>
									</clause><clause id="IDf59bb234846641d18868e9d8cbb0811f"><enum>(iv)</enum><header>Long-term
				assistance for child victims</header>
										<subclause id="idDE6D00FAB7ED4C0C94B1C81EC3DE3749"><enum>(I)</enum><header>Eligibility
				determination</header><text>Before the expiration of the period for interim
				assistance under clause (iii), the Secretary of Health and Human Services shall
				determine if the person referred to in clause (i) is eligible for assistance
				under this paragraph.</text>
										</subclause><subclause id="idE7D1BED41BCB4E8D829A884921A26E2B"><enum>(II)</enum><header>Consultation</header><text>In
				making a determination, the Secretary must consult with the Attorney General,
				the Secretary of Homeland Security, and nongovernmental organizations with
				expertise on victims of severe form of trafficking.</text>
										</subclause><subclause id="id5801813F4EC843AE9785F9F3C84BFF13"><enum>(III)</enum><header>Letter of
				eligibility</header><text>If the Secretary, after receiving information the
				Secretary believes, taken as a whole, indicates that the person referred to in
				clause (i) was a victim of a severe form of human trafficking, the Secretary
				shall issue a letter confirming that the person is eligible for assistance
				under this paragraph. The Secretary may not require that the person meet with
				law enforcement as a condition for receiving such letter of eligibility.</text>
										</subclause></clause></subparagraph><subparagraph id="H23E513E782B54450A7004CE074FC94C6"><enum>(G)</enum><header> Notification of
				child victims for interim assistance</header>
									<clause id="HD6A343555D3D4A06BABEC0EBF2006400"><enum>(i)</enum><header>Federal
				officials</header><text>Not later than 24 hours after a Federal official
				discovers that a person who is under 18 years of age may be a victim of a
				severe form of trafficking in persons, the official shall notify the Secretary
				of Health and Human Services to facilitate the provision of interim assistance
				under subparagraph (F).</text>
									</clause><clause id="H99E40977E5E6458FB7BB009D68C71BA6"><enum>(ii)</enum><header>State and local
				officials</header><text display-inline="yes-display-inline">Not later than 48
				hours after a State or local official discovers that a person who is under 18
				years of age may be a victim of trafficking in persons, the official shall
				notify the Secretary of Health and Human Services to facilitate the provision
				of interim assistance under subparagraph
				(F).</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HBF86F11516C646A5AD7BC3B7ABEDFDBF"><enum>(b)</enum><header>Training of
			 government personnel</header><text>Section 107(c)(4) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7105(c)(4)) is amended to read as
			 follows:</text>
						<quoted-block display-inline="no-display-inline" id="id45A26DF7A3BF476E9221F44EF60EEB82" style="OLC">
							<paragraph id="HBB223B051FB64D1ABBB97BA6E6F61325"><enum>(4)</enum><header>Training of
				government personnel</header>
								<subparagraph id="idD23685E369EF4888B2D5BAAB3A2A9611"><enum>(A)</enum><header>Federal
				personnel</header><text>Appropriate personnel of the Department of State, the
				Department of Justice, the Department of Homeland Security, and the Department
				of Health and Human Services shall be trained to—</text>
									<clause id="id1002B2ABA28342DAB12620CD0097DCFC"><enum>(i)</enum><text>identify victims
				of severe forms of trafficking, including juvenile victims; and</text>
									</clause><clause id="idA1DA41D557534724AA418D9847452C59"><enum>(ii)</enum><text>provide for the
				protection of such victims.</text>
									</clause></subparagraph><subparagraph id="idD6460B62E5034CC4AA92340F821A6341"><enum>(B)</enum><header>State and local
				officials</header><text>The Attorney General and the Secretary of Heath and
				Human Services shall provide education and guidance to State and local
				officials regarding—</text>
									<clause id="id19F5CF56C7C5482EA29FD86C79986C74"><enum>(i)</enum><text>the
				identification of aliens who are the victims of severe forms of trafficking,
				particularly child victims of trafficking; and</text>
									</clause><clause id="id878ABD44D5AB46DDBCF7ED4FA2771545"><enum>(ii)</enum><text>the requirements
				of subsection
				(b)(1)(G)(ii).</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H0A6BBF55C0714759AA05BA4F046B7F31" section-type="subsequent-section"><enum>213.</enum><header>Ensuring assistance
			 for all victims of trafficking in persons</header>
					<subsection id="H7AF8D8E4E2F94D16A5A8DCD931007ED9"><enum>(a)</enum><header>Amendments to
			 the Trafficking Victims Protection Act of 2000</header>
						<paragraph id="H7F6B42BFEF9A4286B9D54B6E6DF9A682"><enum>(1)</enum><header>Assistance for
			 United States citizens and lawful permanent residents</header><text display-inline="yes-display-inline">Section 107 of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7105) is amended by inserting after
			 subsection (e) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H551C54BD446F4A1AAA52979C983D6180" style="OLC">
								<subsection id="H5FA59CAA2CE8488F8B01004328787D45"><enum>(f)</enum><header>Assistance for
				United States citizens and lawful permanent residents</header>
									<paragraph id="H18A20ED339DC462F889E00B600DC935E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				Health and Human Services and the Attorney General, in consultation with the
				Secretary of Labor, shall establish a program to assist United States citizens
				and aliens lawfully admitted for permanent residence (as defined in section
				101(a)(20) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(20))) who
				are victims of severe forms of trafficking. In determining the assistance that
				would be most beneficial for such victims, the Secretary and the Attorney
				General shall consult with nongovernmental organizations that provide services
				to victims of severe forms of trafficking in the United States.</text>
									</paragraph><paragraph commented="no" id="H09D6B81D5C034160889B200169253900"><enum>(2)</enum><header>Use of existing
				programs</header><text display-inline="yes-display-inline">In addition to
				specialized services required for victims described in paragraph (1), the
				program established pursuant to paragraph (1) shall—</text>
										<subparagraph commented="no" id="id35EC87F16599497CA0FED396D26078BD"><enum>(A)</enum><text display-inline="yes-display-inline">facilitate communication and coordination
				between the providers of assistance to such victims;</text>
										</subparagraph><subparagraph commented="no" id="idDCECEE7D0F9449FA819BC69B3F9F8A9E"><enum>(B)</enum><text display-inline="yes-display-inline">provide a means to identify such providers;
				and</text>
										</subparagraph><subparagraph commented="no" id="id6B84F412B21141FCA2F581B25006D2B6"><enum>(C)</enum><text display-inline="yes-display-inline">provide a means to make referrals to
				programs for which such victims are already eligible, including programs
				administered by the Department of Justice and the Department of Health and
				Human Services.</text>
										</subparagraph></paragraph><paragraph commented="no" id="HB6D6F21061F24A5C92FB3FBAA0CEAB49"><enum>(3)</enum><header>Grants</header>
										<subparagraph commented="no" id="id687099AC1AEE491FA37977CA2ADAABD0"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				Health and Human Services and the Attorney General may award grants to States,
				Indian tribes, units of local government, and nonprofit, nongovernmental victim
				service organizations to develop, expand, and strengthen victim service
				programs authorized under this subsection.</text>
										</subparagraph><subparagraph commented="no" id="id0CDCF92D0231461CA7C3FBA2DBF7B82B"><enum>(B)</enum><header>Maximum federal
				share</header><text display-inline="yes-display-inline">The Federal share of a
				grant awarded under this paragraph may not exceed 75 percent of the total costs
				of the projects described in the application submitted by the
				grantee.</text>
										</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="HC55947C2928A4F2E8876001FDAB9FA0"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>Section 113 of the Trafficking Victims Protection
			 Act of 2000 (22 U.S.C. 7110) is amended—</text>

											</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</clause></subparagraph></paragraph><paragraph id="H737D1A905FA84DFA93EF00CDF6305776"><enum>(3)</enum><header>Technical
			 assistance</header><text>Section 107(b)(2)(B)(ii) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7105(b)(2)(B)(ii)) is amended to read as
			 follows:</text>

						</paragraph></subsection><subsection id="H2424AF2EF4B140E5880779002824122D"><enum>(b)</enum><header>Study</header>
						<paragraph id="H7C4415C2E7DB406D9591C1DAD6F8BB9F"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Attorney General and the Secretary of Health and
			 Human Services shall submit a report to the appropriate congressional
			 committees that identifies the existence or extent of any service gap between
			 foreign and United States citizen victims of severe forms of trafficking and
			 victims of sex trafficking (as defined in section 103 of the Trafficking
			 Victims Protection Act of 2000 (22 U.S.C. 7102)).</text>
						</paragraph><paragraph id="H0C67C64A3AC34B5692F6D75FE21C4947"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">In carrying out the study under
			 subparagraph (1), the Attorney General and the Secretary of Health and Human
			 Services shall—</text>
							<subparagraph id="H770B249E8E564C96BB5BEA2356EFF6E"><enum>(A)</enum><text>investigate factors
			 relating to the legal ability of foreign and United States citizen victims of
			 trafficking to access government-funded social services in general, including
			 the application of the Personal Responsibility and Work Opportunity
			 Reconciliation Act of 1996 (8 U.S.C. 1641(c)(5)) and the Illegal Immigration
			 and Immigrant Responsibility Act of 1996 (division C of Public Law 104–208; 110
			 Stat. 3009 et seq.);</text>
							</subparagraph><subparagraph id="H29F609639DFE46FE86BA6882CBF4C739"><enum>(B)</enum><text>investigate any
			 other impediments to the access of foreign and United States citizen victims of
			 trafficking to government-funded social services;</text>
							</subparagraph><subparagraph id="HB20F9F1D577F4EA6B349800015942D7B"><enum>(C)</enum><text>investigate any
			 impediments to the access of foreign and United States citizen victims of
			 trafficking to government-funded services targeted to victims of severe forms
			 of trafficking and victims of sex trafficking;</text>
							</subparagraph><subparagraph id="HD51FF78FFC65463C921B4DFCE68B658"><enum>(D)</enum><text>investigate the
			 effect of trafficking service-provider infrastructure development, continuity
			 of care, and availability of caseworkers on the eventual restoration and
			 rehabilitation of foreign and United States citizen victims of trafficking;
			 and</text>
							</subparagraph><subparagraph id="H6A059F1510DC43368B765FC94EA27156"><enum>(E)</enum><text>include findings,
			 best practices, and recommendations, if any, based on the study of the elements
			 described in subparagraphs (A) through (D) and any other related
			 information.</text>
							</subparagraph></paragraph></subsection></section></subtitle><subtitle id="HF5DF5B05771840D9A54C6BC46CC58BD7"><enum>C</enum><header>Penalties against
			 traffickers and other crimes</header>
				<section id="HEDB1AAED51734F628B02B216C5787132"><enum>221.</enum><header>Restitution of
			 forfeited assets; enhancement of civil action</header><text display-inline="no-display-inline">Chapter 77 of title 18, United States Code,
			 is amended—</text>
					<paragraph id="id154931A01D274B32BE6E2142F1C4FB84"><enum>(1)</enum><text>in section
			 1593(b), by adding at the end the following:</text>
						<quoted-block id="H8A7AC986B69242B79F376EB373BCBD6E" style="OLC">
							<paragraph id="H48551E796C8D4CECB8B4130015AD2225" indent="up1"><enum>(4)</enum><text>The distribution of proceeds among
				multiple victims in an order of restitution under this section shall govern the
				distribution of forfeited funds through the processes of remission or
				restoration under this section or any other statute that explicitly authorizes
				restoration or remission of forfeited
				property.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id47F5CA3FB1EE45EBB8BC21C4A86FA944"><enum>(2)</enum><text>in section
			 1594—</text>

				that explicitly authorizes restoration or remission of forfeited
				property.</text>
									</subparagraph></paragraph><paragraph id="H0FF9E22A97974CB79817B89D00A00315" indent="up1"><enum>(4)</enum><text>In a prosecution brought under
				Federal law, the Attorney General may grant restoration or remission of
				property to victims of severe forms of trafficking (as defined in section 103
				of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102)), in
				accordance with section 1593(b)(4).</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id7D7E4C03BD934A7D81473C16F1C2FFBE"><enum>(3)</enum><text>in section
			 1595—</text>
						<subparagraph id="HD1FE05E1977144C6AAB964CD1F33337F"><enum>(A)</enum><text>in subsection
			 (a)—</text>
							<clause id="HD5EE84FE3A1A4544002DB58C36322DA5"><enum>(i)</enum><text>by
			 striking <quote>of section 1589, 1590, or 1591</quote>; and</text>

						</subparagraph></paragraph></section><section id="idE215B4F918184D2DA73CC39E99CFB30C"><enum>222.</enum><header>Enhancing
			 trafficking offenses</header>
					<subsection id="idD70EDD5E0644429D810FFA0ACD9E1ACC"><enum>(a)</enum><header>Detention</header><text>Section
			 3142(e) of title 18, United States Code, is amended—</text>
						<paragraph id="id48A7C5B59CE64C98A7B2E1F8A1B20125"><enum>(1)</enum><text>by redesignating
			 paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C),
			 respectively;</text>
						</paragraph><paragraph id="id8E222F82C1C54E60B3BE3E747E5DFDDA"><enum>(2)</enum><text>by inserting
			 <quote><header-in-text level="paragraph" style="USC">(1)</header-in-text></quote> before <quote>If, after a
			 hearing</quote>;</text>

										<paragraph id="idE20B2C0F221043E8887A42877D031FE1"><enum>(1)</enum><text>kidnaps or
				carries away any other person, with the intent that such other person be sold
				into involuntary servitude, or held as a slave;</text>
										</paragraph><paragraph id="idCF468F09DDE4442787AFD8D6C6C7E3CB"><enum>(2)</enum><text>entices,
				persuades, or induces any other person to go on board any vessel or to any
				other place with the intent that he may be made or held as a slave, or sent out
				of the country to be so made or held; or</text>
										</paragraph><paragraph id="id29090D00D90A444081526D456E853C0F"><enum>(3)</enum><text>obstructs, or
				attempts to obstruct, or in any way interferes with or prevents the enforcement
				of this section,</text>
										</paragraph><continuation-text continuation-text-level="subsection">shall be
				fined under this title, imprisoned not more than 20 years, or both.</continuation-text></subsection><subsection id="IDef161e83a6ee4c94bac2827269c0d960"><enum>(b)</enum><text>Any person who
				violates this section shall be fined under this title, imprisoned for any term
				of years or for life, or both if—</text>

			 amended—</text>

			 that means of force, threats of force, fraud, coercion described in subsection
			 (c)(2), or any combination of such means</quote>;</text>
							</subparagraph><subparagraph id="idD4C135ECF3834E3ABC14817164652010"><enum>(B)</enum><text>in subsection

				take some action or refrain from taking some
				action.</text>
										</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
								</clause><clause id="id1084D7E5FF864B2CBAF6D158F77E8659"><enum>(iv)</enum><text>by
			 inserting after paragraph (3), as redesignated, the following:</text>

			 conduct</header><text>Section 1592 of such title is amended by adding at the

			 conspirators accountable</header><text>Section 1594 of title 18, United States
			 Code, is amended—</text>

			 subsections (b), (c), and (d) as subsections (c), (d), and (e) respectively;
			 and</text>
						</paragraph><paragraph id="idCD5FB14F8BF643BD8DA592C8A16278B5"><enum>(2)</enum><text>by inserting
			 after subsection (a) the following:</text>

						</paragraph></subsection><subsection id="idE1AD43298F8846568956476CE70008BC"><enum>(d)</enum><header>Punishing
			 financial gain from trafficked labor</header><text>Section 1589 of title 18,
			 United States Code, is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idCF4B00125E924584B5ED83FC6F303E60" style="OLC">
							<section id="id825D42498A2D4F0E920E7FDD65F14284"><enum>1589.</enum><header>Forced
				labor</header>
								<subsection id="id26F9D4F9DFBC42808E738641533DFCB4"><enum>(a)</enum><text>Whoever knowingly
				provides or obtains the labor or services of a person by any one of, or by any
				combination of, the following means—</text>
									<paragraph id="idEDC5B04B19D34B35A156B80CD4FD952A"><enum>(1)</enum><text>by means of
				force, threats of force, physical restraint, or threats of physical restraint
				to that person or another person;</text>
									</paragraph><paragraph id="ID043ca91b57dd4aae907574cbebf5511d"><enum>(2)</enum><text>by means of
				serious harm or threats of serious harm to that person or another
				person;</text>
									</paragraph><paragraph id="IDb6334fe5487d40bfa954f52b9fbfde06"><enum>(3)</enum><text>by means of the
				abuse or threatened abuse of law or legal process; or</text>
									</paragraph><paragraph id="IDc11ed6c3e43b4cb9a18f446b9b861f34"><enum>(4)</enum><text>by means of any
				scheme, plan, or pattern intended to cause the person to believe that, if that
				person did not perform such labor or services, that person or another person
				would suffer serious harm or physical restraint,</text>
									</paragraph><continuation-text continuation-text-level="subsection">shall be
				punished as provided under subsection (d).</continuation-text></subsection><subsection id="idE5C4986A3F5746FF93294D530381E0F5"><enum>(b)</enum><text>Whoever knowingly
				benefits, financially or by receiving anything of value, from participation in
				a venture, which has engaged in the providing or obtaining of labor or services
				by any of the means described in subsection (a), knowing or in reckless
				disregard of the fact that the venture has engaged in the providing or
				obtaining of labor or services by any of such means, shall be punished as
				provided in subsection (d).</text>
								</subsection><subsection id="ID266ea5e639834b7e8d4bda5d1737996b"><enum>(c)</enum><text>In this
				section:</text>
									<paragraph id="IDb4a75d1c22314388bf8699d98fa7d62a"><enum>(1)</enum><text>The term
				<term>abuse or threatened abuse of law or legal process</term> means the use or
				threatened use of a law or legal process, whether civil or criminal, against
				another person primarily to accomplish a purpose for which the law was not

					</subsection><subsection id="ID2bb4254ece714486a0dbe3010d1f3d52"><enum>(e)</enum><header>Benefitting
			 from financial gain in peonage, slavery, and trafficking in persons</header>

			 general</header><text>Chapter 77 of title 18, United States Code, is
			 amended—</text>

				general</header><text display-inline="yes-display-inline">In addition to any
				domestic or extra-territorial jurisdiction otherwise provided by law, the
				courts of the United States have extra-territorial jurisdiction over any
				offense (or any attempt or conspiracy to commit an offense) under section 1581,
				1583, 1584, 1589, 1590, or 2429 if—</text>
									<paragraph id="H46E73AF217AC4FE2BCC0EE10C3197D69"><enum>(1)</enum><text display-inline="yes-display-inline">an alleged offender is a national of the
				United States or an alien lawfully admitted for permanent residence (as those
				terms are defined in section 101 of the Immigration and Nationality Act (8
				U.S.C. 1101)); or</text>
									</paragraph><paragraph id="H338678CF78734D1A87EFEFFAF3AB73CF"><enum>(2)</enum><text>an alleged
				offender is present in the United States, irrespective of the nationality of
				the alleged offender.</text>
									</paragraph></subsection><subsection id="H3A120235E7694ABD8EEFFC35315DB1C5"><enum>(b)</enum><header>Limitation on
				prosecutions of offenses prosecuted in other countries</header><text display-inline="yes-display-inline">No prosecution may be commenced against a
				person under this section if a foreign government, in accordance with
				jurisdiction recognized by the United States, has prosecuted or is prosecuting
				such person for the conduct constituting such offense, except upon the approval
				of the Attorney General or the Deputy Attorney General (or a person acting in
				either such capacity), which function of approval may not be
				delegated.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 removal of sex offenders</header>
					<subsection id="IDb6f95bd49db14664bc94035339246d1c"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall notify—</text>
						<paragraph id="id7388ED08B01842D1AFB993B35B791819"><enum>(1)</enum><text>the Secretary of State in
			 a timely manner regarding any conviction of an individual of a violation of
			 section 2423 of title 18, United States Code, for appropriate action under
			 subsection (b); and</text>
						</paragraph><paragraph id="ID46954e122b08409b87952ee335a9aba7"><enum>(2)</enum><text>the Secretary of Homeland
			 Security in a timely manner regarding any conviction of an alien of a sex
			 offense for appropriate action under subsection (c).</text>
						</paragraph></subsection><subsection id="ID39c13117c4b94cb58277d1aa9667e4c2"><enum>(b)</enum><header>Authority To restrict
			 passport</header>
						<paragraph id="ID88f096a9856c43c589351f926dd08b0e"><enum>(1)</enum><header>Ineligibility for
			 passport</header>
							<subparagraph id="ID45fd10752b1c4483a885c65440b073b5"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of State shall not issue a passport to an
			 individual who is convicted of a Federal sex offense during the covered period
			 if the individual used a passport or otherwise crossed an international border
			 in committing the Federal sex offense.</text>
							</subparagraph><subparagraph id="ID15331bd7e3434cbd8bc25bb0ba75ce8c"><enum>(B)</enum><header>Passport
			 revocation</header><text>The Secretary of State shall revoke a passport issued
			 to an individual described in subparagraph (A) before the date on which the
			 individual was convicted of the applicable Federal sex offense.</text>
							</subparagraph></paragraph><paragraph id="IDaa79ab106aa743e9a7af0689ab7c4ee7"><enum>(2)</enum><header>Emergency and
			 humanitarian exceptions</header><text>Notwithstanding paragraph (1), the
			 Secretary of State may issue a passport, in emergency circumstances or for
			 humanitarian reasons, to an individual described in paragraph (1)(A).</text>
						</paragraph><paragraph id="ID174005ce9315476fbea0e5297ee666e6"><enum>(3)</enum><header>Definitions</header><text>In
			 this subsection—</text>
							<subparagraph id="idAC83331D62DB4899BC10211471E0C797"><enum>(A)</enum><text>the term <term>covered
			 period</term> means the period beginning on the date on which an individual is
			 convicted of a Federal sex offense and ending on the latter of—</text>
								<clause id="id298ABF8994354F15AF2D87A1C7D33D5D"><enum>(i)</enum><text>the date on which the
			 individual is released from a sentence of imprisonment relating to the Federal
			 sex offense; and</text>
								</clause><clause id="ID158c7a426d574884a90e92c653c07bb5"><enum>(ii)</enum><text>the end of a period of
			 parole or other supervised release of the covered individual relating to the
			 Federal sex offense;</text>
								</clause></subparagraph><subparagraph id="IDc65b4687eabe41398acf231fc587e6c0"><enum>(B)</enum><text>the term <term>Federal
			 sex offense</term> means a felony violation of section 2423 of title 18, United
			 States Code; and</text>
							</subparagraph><subparagraph id="ID15798c2862734484a3ab2ebf17ab1470"><enum>(C)</enum><text>the term
			 <term>imprisoned</term> means being confined in or otherwise restricted to a
			 jail, prison, half-way house, treatment facility, or another institution, on a
			 full or part-time basis, pursuant to the sentence imposed as the result of a
			 criminal conviction.</text>
							</subparagraph></paragraph></subsection><subsection id="ID4cc8e0a1841c4a7a985a1de0866d9b90"><enum>(c)</enum><header>Removal of
			 aliens</header><text>The Secretary of Homeland Security shall place an alien
			 convicted of a sex offense in removal proceedings under section 240 of the
			 Immigration and Nationality Act (8 U.S.C. 1229a).</text>
					</subsection><subsection id="ID0e96cd1ee41148b79bb956c6d1e3b093"><enum>(d)</enum><header>Grounds of
			 inadmissibility and removability</header>
						<paragraph id="id418C4E91A9144824A08750AA7CC55366"><enum>(1)</enum><header>In
			 general</header><text>Section 212(a)(2) of the Immigration and Nationality Act
			 (8 U.S.C. 1182(a)(2)) is amended by adding at the end the following:</text>

								<subparagraph id="IDb2579290734c4e239f72a67d62180353"><enum>(J)</enum><header>Sexual abuse of a
				minor</header>
									<clause id="id8F9B49A09C4A4DF7A0FA95C0BEC6E271"><enum>(i)</enum><header>In
				general</header><text>An alien who is convicted of sexual abuse of a minor is
				inadmissible.</text>
									</clause><clause id="idCC6CC9EDAD31423BA4EF23540F26F56D"><enum>(ii)</enum><header>Sex
				offenses</header><text>For purposes of this subparagraph, an alien who has been
				convicted of a sex offense (as that term is defined in section 111 of the Adam
				Walsh Child Protection and Safety Act of 2006 (42 U.S.C. 16911)) shall be
				considered to have been convicted of sexual abuse of a minor. An alien
				convicted of a sex offense shall be ineligible for any discretionary relief
				under this
				Act.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="idB8DC0E7E089A4EF398F240F5A07F13A5"><enum>(2)</enum><header>Deportable
			 aliens</header><text>Section 237(a)(2)(A)(iii) of the Immigration and
			 Nationality Act (8 U.S.C. 1227(a)(2)(A)(iii)) is amended by adding at the end
			 the following <quote>For purposes of this clause, an alien who has been
			 convicted of a sex offense (as that term is defined in section 111 of the Adam
			 Walsh Child Protection and Safety Act of 2006 (42 U.S.C. 16911)) shall be
			 considered to have been convicted of sexual abuse of a minor.</quote>.</text>
						</paragraph></subsection><subsection id="idC5E25AC78BB548BA8F424F23A7D5C90C"><enum>(e)</enum><header>Definition of sex
			 offense</header><text>In this section, the term <term>sex offense</term> has
			 the meaning given that term in section 111 of the Adam Walsh Child Protection
			 and Safety Act of 2006 (42 U.S.C. 16911).</text>
					</subsection></section></subtitle><subtitle id="HB5204C1A508040B6AEECD8383EF6B3E6"><enum>D</enum><header>Activities of the
			 United States Government</header>
				<section id="HD8A31A177A2541198B78AFBB217E3BC1"><enum>231.</enum><header>Annual report
			 by the Attorney General</header><text display-inline="no-display-inline">Section 105(d)(7) of the Trafficking Victims
			 Protection Act of 2000 (22 U.S.C. 7103(d)(7)) is amended—</text>
					<paragraph id="HE5D84222B5304A768F8160AC22B94138"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>

				the armed forces of foreign countries; and</text>
								</clause><clause id="idD991625DE5DF4BB389AC24E9297D77D6"><enum>(iii)</enum><text display-inline="yes-display-inline">efforts to ensure that United States
				Government contractors and their employees or United States Government
				subcontractors and their employees do not engage in trafficking in
				persons;</text>
								</clause></subparagraph><subparagraph id="HE4087265D3DA415BB9E160FD82987B9"><enum>(I)</enum><text display-inline="yes-display-inline">activities or actions by Federal
				departments and agencies to enforce—</text>
								<clause id="H0D4444A78530474EADA242C01E66FDA5"><enum>(i)</enum><text display-inline="yes-display-inline">section 106(g) and any similar law,
				regulation, or policy relating to United States Government contractors and
				their employees or United States Government subcontractors and their employees
				that engage in severe forms of trafficking in persons, the procurement of
				commercial sex acts, or the use of forced labor, including debt bondage;</text>
								</clause><clause id="HC7B40BB705854654BC9D6715411F65CA"><enum>(ii)</enum><text display-inline="yes-display-inline">section 307 of the Tariff Act of 1930 (19
				U.S.C. 1307; relating to prohibition on importation of convict-made goods),
				including any determinations by the Secretary of Homeland Security to waive the
				restrictions of such section; and</text>
								</clause><clause id="H6F03C265F0AA4D718324CAAC3B9B3137"><enum>(iii)</enum><text display-inline="yes-display-inline">prohibitions on the procurement by the
				United States Government of items or services produced by slave labor,
				consistent with Executive Order 13107 (December 10, 1998);
				and</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="idC0C2E7854D7D410CA4AC619AE3296213"><enum>232.</enum><header>Defense
			 contract audit agency audit</header>
					<subsection id="id9C5D573F6A6B4606A346CAC492824600"><enum>(a)</enum><header>Audit</header><text display-inline="yes-display-inline">The Defense Contract Audit Agency shall
			 conduct an audit of all contractors and subcontractors of the Department of
			 Defense implementing contracts abroad where there is substantial evidence to
			 suggest trafficking in persons, including—</text>
						<paragraph id="id619727DC37F344D9B728E997528BDF03"><enum>(1)</enum><text>confiscation of
			 passports;</text>
						</paragraph><paragraph id="id85F107948D934BD4B59955843A6D0737"><enum>(2)</enum><text>restriction on
			 mobility;</text>
						</paragraph><paragraph id="id65287A328047433BBA5F03FD145E1227"><enum>(3)</enum><text>abrupt or evasive
			 repatriation,</text>
						</paragraph><paragraph id="idF8F15B89ACC0415180D8AE2214E3621F"><enum>(4)</enum><text>deception of work
			 destination; or</text>
						</paragraph><paragraph id="id3C38FD1BF0C24EFD829A82EA71BDAA06"><enum>(5)</enum><text>forced
			 labor.</text>
						</paragraph></subsection><subsection id="id7CE2D57FD8DE470DAFBEC7E649302541"><enum>(b)</enum><header>Congressional
			 notification</header>
						<paragraph id="id218F0D1C96374E89B131F6206544E169"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the completion of each audit under subsection (a), the Secretary of
			 Defense shall—</text>
							<subparagraph id="idE0A10971890F4EC688871047E7044CB3"><enum>(A)</enum><text display-inline="yes-display-inline">notify the congressional committees listed
			 in paragraph (2) of the findings of the audit; and</text>
							</subparagraph><subparagraph id="idEB316FF9CFA04A17A5447AD801410F11"><enum>(B)</enum><text display-inline="yes-display-inline">certify that the contractor or
			 subcontractor has not engaged in, or is no longer engaged in, the activities
			 described in subsection (a).</text>
							</subparagraph></paragraph><paragraph id="id60C6B84493E542BDB8EBA1CE9FA140B8"><enum>(2)</enum><header>Congressional

				</section><section commented="no" id="HAE08F79C60554DF7935B73DB29EE815D"><enum>234.</enum><header>Preventing
			 United States travel by traffickers</header><text display-inline="no-display-inline">Section 212(a)(2)(H)(i) of the Immigration
			 and Nationality Act (8 U.S.C. 1182(a)(2)(H)(i)) is amended by striking
			 <quote>consular officer</quote> and inserting <quote>consular officer, the
			 Secretary of Homeland Security, the Secretary of State,</quote>.</text>
				</section><section id="id7B4F393F8C644B149EA18C6572EFF3F2"><enum>235.</enum><header>Enhancing
			 efforts to combat the trafficking of children</header>
					<subsection id="ID7ab14d72ef7049f78374daa71bcba4c2"><enum>(a)</enum><header>Combating child
			 trafficking at the border and ports of entry of the United States</header>
						<paragraph id="IDde7f77ef6ae14be6a14b2ce530d4d9e1"><enum>(1)</enum><header>Policies and
			 procedures</header><text>In order to enhance the efforts of the United States
			 to prevent trafficking in persons, the Secretary of Homeland Security, in
			 conjunction with the Secretary of State, the Attorney General, and the
			 Secretary of Health and Human Services, shall develop policies and procedures
			 to ensure that unaccompanied alien children in the United States are safely
			 repatriated to their country of nationality or of last habitual
			 residence.</text>
						</paragraph><paragraph id="ID12c4430b32e74e03affbc56e1662befe"><enum>(2)</enum><header>Special rules
			 for children from contiguous countries</header>
							<subparagraph id="IDb68fceafc3d84f3182ca46132a01d3ac"><enum>(A)</enum><header>Determinations</header><text>Any
			 unaccompanied alien child who is a national or habitual resident of a country
			 that is contiguous with the United States shall be treated in accordance with
			 subparagraph (B), if the Secretary of Homeland Security determines, on a
			 case-by-case basis, that—</text>
								<clause id="IDf2a9afc2cadb4f81857da72a6050ba3c"><enum>(i)</enum><text>such child has
			 not been a victim of a severe form of trafficking in persons, and there is no
			 credible evidence that such child is at risk of being trafficked upon return to
			 the child’s country of nationality or of last habitual residence;</text>
								</clause><clause id="IDf2959e9b93844846aae50538a4b73bd5"><enum>(ii)</enum><text>such child does
			 not have a fear of returning to the child’s country of nationality or of last
			 habitual residence owing to a credible fear of persecution;</text>
								</clause><clause id="ID6104f61026f04db58e327bf28c92ddc0"><enum>(iii)</enum><text>there is no
			 credible evidence that the return of such child to the child’s country of
			 nationality or of last habitual residence would endanger the life or safety of
			 such child; and</text>
								</clause><clause id="ID74bf491ca7a64722a6426ff74bf51718"><enum>(iv)</enum><text>the child is
			 able to make an independent decision to withdraw the child’s application for
			 admission to the United States.</text>
								</clause></subparagraph><subparagraph id="IDbef92a6b7cec42f3963572066a2102a7"><enum>(B)</enum><header>Return</header><text>An
			 immigration officer who finds an unaccompanied alien child described in
			 subparagraph (A) at a land border or port of entry of the United States and
			 determines that such child is inadmissible under the Immigration and
			 Nationality Act (8 U.S.C. 1101 et seq.) shall—</text>
								<clause id="IDe0e4170e9c1b4229baa3b83f0fa02335"><enum>(i)</enum><text>permit such child
			 to withdraw the child’s application for admission pursuant to section 235(a)(4)
			 of the Immigration and Nationality Act (8 U.S.C. 1225(a)(4)); and</text>
								</clause><clause id="ID2d0fb40fff8d4a6dbcdd990b6c5148d3"><enum>(ii)</enum><text>return such
			 child to the child’s country of nationality or country of last habitual
			 residence.</text>
								</clause></subparagraph><subparagraph id="IDcafd5ff4e2484a2da1125811846d4b2a"><enum>(C)</enum><header>Contiguous
			 country agreements</header><text>The Secretary of State shall negotiate
			 agreements between the United States and countries contiguous to the United
			 States with respect to the repatriation of children. Such agreements shall be
			 designed to protect children from severe forms of trafficking in persons, and
			 shall, at a minimum, provide that—</text>
								<clause id="ID9b1cd3b55a364b93ad61eddbac2750bb"><enum>(i)</enum><text>no
			 child shall be returned to the child’s country of nationality or of last
			 habitual residence unless returned to appropriate officials or employees of the
			 accepting country’s government;</text>
								</clause><clause id="ID0268f8a77d124a4fbdadb17fe333c284"><enum>(ii)</enum><text>no
			 child shall be returned to the child’s country of nationality or of last
			 habitual residence outside of reasonable business hours; and</text>
								</clause><clause id="IDb838d5d128704574a80e2790e21ad817"><enum>(iii)</enum><text>border
			 personnel of the countries that are parties to such agreements are trained in
			 the terms of such agreements.</text>
								</clause></subparagraph></paragraph><paragraph id="ID0470edcc26da46e59e160f087f08d929"><enum>(3)</enum><header>Rule for other
			 children</header><text>The custody of unaccompanied alien children not
			 described in paragraph (2)(A) who are apprehended at the border of the United
			 States or at a United States port of entry shall be treated in accordance with
			 subsection (c).</text>
						</paragraph><paragraph id="ID5f7db1d3fc3c42f384005db8eeb3d142"><enum>(4)</enum><header>Screening</header><text>Within
			 48 hours of the apprehension of a child who is believed to be described in
			 paragraph (2)(A), but in any event prior to returning such child to the child’s
			 country of nationality or of last habitual residence, the child shall be
			 screened to determine whether the child meets the criteria listed in paragraph
			 (2)(A). If the child does not meet such criteria, or if no determination can be
			 made within 48 hours of apprehension, the child shall immediately be
			 transferred to the Secretary of Health and Human Services and treated in
			 accordance with subsection (c).</text>
						</paragraph><paragraph id="ID3b9e10fb220c40c087a57db68e12a280"><enum>(5)</enum><header>Ensuring the
			 safe repatriation of children</header>
							<subparagraph id="IDbb907c9486bf46e6bc25f1db8840acd2"><enum>(A)</enum><header>Repatriation
			 pilot program</header><text>To protect children from trafficking and
			 exploitation, the Secretary of State shall create a pilot program, in
			 conjunction with non-governmental organizations and other national and
			 international agencies and experts, to develop and implement best practices to
			 ensure the safe and secure repatriation and reintegration of unaccompanied
			 alien children into their country of nationality or of last habitual residence,
			 including placement with their families or other sponsoring agencies.</text>
							</subparagraph><subparagraph id="ID28d11df706c249b4887027804d3a4364"><enum>(B)</enum><header>Assessment of
			 country conditions</header><text>The Secretary of Homeland Security shall
			 consult the State Department’s Country Reports on Human Rights Practices and
			 the Trafficking in Persons Report in assessing whether to repatriate an
			 unaccompanied alien child to a particular country. Such assessment shall
			 consider whether there is reasonable risk that repatriation of an unaccompanied
			 alien child would threaten the life or safety of the child.</text>
							</subparagraph><subparagraph id="IDe45007046a804bc780b0afe662575381"><enum>(C)</enum><header>Report on
			 repatriation of unaccompanied alien children</header><text>Not later than 18
			 months after the date of the enactment of this Act, and annually thereafter,
			 the Secretary of Homeland Security, in conjunction with the Secretary of State
			 and Secretary of Health and Human Services, shall submit a report to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives on efforts to repatriate unaccompanied alien
			 children. Such report shall include—</text>
								<clause id="IDcfe0354003114addbfd51a4c3a8fb1c5"><enum>(i)</enum><text>the
			 number of unaccompanied alien children ordered removed and the number of such
			 children actually removed from the United States;</text>
								</clause><clause id="ID040edf6a66d342e9ab9b1ae2348aa380"><enum>(ii)</enum><text>a
			 statement of the nationalities, ages, and gender of such children;</text>
								</clause><clause id="ID6fe744e83a7c4ae0a1c9e51923ca9ed2"><enum>(iii)</enum><text>a
			 description of the policies and procedures used to effect the removal of such
			 children from the United States and the steps taken to ensure that such
			 children were safely and humanely repatriated to their country of nationality
			 or of last habitual residence, including a description of the repatriation
			 pilot program created pursuant to subparagraph (A);</text>
								</clause><clause id="ID03232cbf3c0c4becbdc61e7e692601af"><enum>(iv)</enum><text>a
			 description of the type of immigration relief sought and denied to such
			 children;</text>
								</clause><clause id="IDe65fcfa6c49946f78a601c620b043331"><enum>(v)</enum><text>any
			 information gathered in assessments of country and local conditions pursuant to
			 paragraph (2); and</text>
								</clause><clause id="ID7d5cb0188560436f8a1e55e30264a67f"><enum>(vi)</enum><text>statistical
			 information and other data on unaccompanied alien children as provided for in
			 section 462(b)(1)(J) of the Homeland Security Act of 2002 (6 U.S.C.
			 279(b)(1)(J)).</text>
								</clause></subparagraph><subparagraph id="IDc7d3161e56024527b599d77ea460ef35"><enum>(D)</enum><header>Placement in
			 removal proceedings</header><text>Any unaccompanied alien child sought to be
			 removed by the Department of Homeland Security, except for an unaccompanied
			 alien child from a contiguous country subject to exceptions under subsection
			 (a)(2), shall be placed in removal proceedings under section 240 of the
			 Immigration and Nationality Act (8 U.S.C. 1229a) and shall be safely
			 repatriated pursuant to 240B of such Act (8 U.S.C. 1229c).</text>
							</subparagraph></paragraph></subsection><subsection id="IDd29d1d3f478b4e67a38b39e1a91a2c00"><enum>(b)</enum><header>Combating child
			 trafficking and exploitation in the United States</header>
						<paragraph id="ID4517d11e4a47410e986a4f4f9701d726"><enum>(1)</enum><header>Care and
			 custody of unaccompanied alien children</header><text>Consistent with section
			 462 of the Homeland Security Act of 2002 (6 U.S.C. 279), and except as
			 otherwise provided under subsection (a), the care and custody of all
			 unaccompanied alien children, including responsibility for their detention,
			 where appropriate, shall be the responsibility of the Secretary of Health and
			 Human Services.</text>
						</paragraph><paragraph id="IDe1f4cce5b3224e74bc082c66197ae1d1"><enum>(2)</enum><header>Notification</header><text>Each
			 department or agency of the Federal Government shall notify the Department of
			 Health and Human services within 48 hours upon—</text>
							<subparagraph id="ID85f5eb04beeb4f7ab9ddeba34992f043"><enum>(A)</enum><text>the apprehension
			 or discovery of an unaccompanied alien child; or</text>
							</subparagraph><subparagraph id="IDc6a668f74afd4e76b74ade795f3e89f8"><enum>(B)</enum><text>any claim or
			 suspicion that an alien in the custody of such department or agency is under 18
			 years of age.</text>
							</subparagraph></paragraph><paragraph id="IDdfd0120f12604ea5b92ded89247e4542"><enum>(3)</enum><header>Transfers of
			 unaccompanied alien children</header><text>Except in the case of exceptional
			 circumstances, any department or agency of the Federal Government that has an
			 unaccompanied alien child in custody shall transfer the custody of such child
			 to the Secretary of Health and Human Services not later than 72 hours after
			 determining that such child is an unaccompanied alien child.</text>
						</paragraph><paragraph id="ID0be886abb84844ac962475195cad45d2"><enum>(4)</enum><header>Age
			 determinations</header>
							<subparagraph id="IDb14c43f8363b4d5da754188123419e52"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall make an
			 age determination for an alien described in paragraph (2)(B) and take whatever
			 other steps are necessary to determine whether such alien is eligible for
			 treatment under this section or section 462 of the Homeland Security Act of
			 2002 (6 U.S.C. 279).</text>
							</subparagraph><subparagraph id="ID69f5318d6b0b4475bbf8f1ccdbf8de82"><enum>(B)</enum><header>Procedures</header><text>The
			 Secretary of Health and Human Services, in consultation with the Secretary of
			 Homeland Security, shall develop procedures to make a prompt determination of
			 the age of an alien, which shall be used by the Secretary of Homeland Security
			 and the Secretary of Health and Human Services for children in their respective
			 custody. At a minimum, these procedures shall permit the presentation of
			 multiple forms of evidence, including the non-exclusive use of radiographs, to
			 determine the age of the unaccompanied alien.</text>
							</subparagraph></paragraph></subsection><subsection id="ID80891839a3a842d5afc6edb409b30925"><enum>(c)</enum><header>Providing safe
			 and secure placements for children</header>
						<paragraph id="ID515275e1d6184de5960d62aba71c16eb"><enum>(1)</enum><header>Policies and
			 programs</header><text>The Secretary of Health and Human Services, Secretary of
			 Homeland Security, Attorney General, and Secretary of State shall establish
			 policies and programs to ensure that unaccompanied alien children in the United
			 States are protected from traffickers and other persons seeking to victimize or
			 otherwise engage such children in criminal, harmful, or exploitative activity,
			 including policies and programs reflecting best practices in witness security
			 programs.</text>
						</paragraph><paragraph id="ID54ee38ebedeb4eaea3d081655826f28c"><enum>(2)</enum><header>Safe and secure
			 placements</header><text>Subject to section 462(b)(2) of the Homeland Security
			 Act of 2002 (6 U.S.C. 279(b)(2)), an unaccompanied alien child in the custody
			 of the Secretary of Health and Human Services shall be promptly placed in the
			 least restrictive setting that is in the best interest of the child. Placement
			 of child trafficking victims may include placement in an Unaccompanied Refugee
			 Minor program, pursuant to section 501(a) of the Refugee Education Assistance
			 Act of 1980 (8 U.S.C. 1522 note), if a suitable family member is not available
			 to provide care. A child shall not be placed in a secure facility absent an
			 independent finding that the child poses a danger to self or others.</text>
						</paragraph><paragraph id="ID007c2710f6de4d258c4b0227e4200ced"><enum>(3)</enum><header>Safety and
			 suitability assessments</header>
							<subparagraph id="IDf73346515d6447559b0f555fa99fe08a"><enum>(A)</enum><header>In
			 general</header><text>Subject to the requirements of subparagraph (B), an
			 unaccompanied alien child may not be placed with a person or entity unless the
			 Secretary of Health and Human Services makes a determination that the proposed
			 custodian is capable of providing for the child’s physical and mental
			 well-being. Such determination shall, at a minimum, include verification of the
			 custodian’s identity and relationship to the child, if any, as well as an
			 independent finding that the individual has not engaged in any activity that
			 would indicate a potential risk to the child.</text>
							</subparagraph><subparagraph id="IDf94f4820456743bdbeb15b8bc6b19bdf"><enum>(B)</enum><header>Home
			 studies</header><text>Before placing the child with an individual, the
			 Secretary of Health and Human Services shall determine whether a home study is
			 first necessary. A home study shall be conducted for a child who is a victim of
			 a severe form of trafficking in persons, a special needs child with a
			 disability (as defined in section 3 of the Americans with Disabilities Act of
			 1990 (42 U.S.C. 12102(2))), or a child who has been a victim of physical or
			 sexual abuse under circumstances that indicate that the child’s health or
			 welfare has been significantly harmed or threatened or a child whose proposed
			 sponsor clearly presents a risk of abuse, maltreatment, exploitation, or
			 trafficking to the child based on all available objective evidence. The
			 Secretary of Health and Human Services shall conduct follow-up services, during
			 the pendency of removal proceedings, on children and custodians for whom a home
			 study was conducted and is authorized to conduct follow-up services in cases
			 involving children with mental health or other needs who could benefit from
			 ongoing assistance from a social welfare agency.</text>
							</subparagraph><subparagraph id="ID0061943af9154e9ba23e58799ef0993f"><enum>(C)</enum><header>Access to
			 information</header><text>Not later than 2 weeks after receiving a request from
			 the Secretary of Health and Human Services, the Secretary of Homeland Security
			 shall provide information necessary to conduct suitability assessments from
			 appropriate Federal, State, and local law enforcement and immigration
			 databases.</text>
							</subparagraph></paragraph><paragraph id="ID48afb732fd314232952d1bee59d72c71"><enum>(4)</enum><header>Legal
			 orientation presentations</header><text>The Secretary of Health and Human
			 Services shall cooperate with the Executive Office for Immigration Review to
			 ensure that custodians receive legal orientation presentations provided through
			 the Legal Orientation Program administered by the Executive Office for
			 Immigration Review. Such presentations shall address the custodian’s
			 responsibility to ensure the child’s appearance at all immigration proceedings
			 and to protect the child from mistreatment, exploitation, and
			 trafficking.</text>
						</paragraph><paragraph id="ID9d2ba21337264bee8482c6db4a91e186"><enum>(5)</enum><header>Access to
			 counsel</header><text>The Secretary of Health and Human Services shall ensure,
			 to the greatest extent practicable, that all unaccompanied alien children who
			 are or have been in the custody of the Secretary or the Secretary of Homeland
			 Security, and who are not described in subsection (a)(2)(A), have competent
			 counsel to represent them in legal proceedings or matters and protect them from
			 mistreatment, exploitation, and trafficking. To the greatest extent
			 practicable, the Secretary of Health and Human Services shall make every effort
			 to utilize the services of competent pro bono counsel who agree to provide
			 representation to such children without charge. Consistent with section 292 of
			 the Immigration and Nationality Act (8 U.S.C. 1362), nothing in this Act may be
			 construed to require the Government of the United States to pay for counsel to
			 any unaccompanied alien child.</text>
						</paragraph><paragraph id="ID1d2bce609111422591902e37ebe7ffd8"><enum>(6)</enum><header>Child
			 advocates</header><text>The Secretary of Health and Human Services is
			 authorized to appoint independent child advocates for child trafficking victims
			 and other vulnerable unaccompanied alien children. A child advocate shall be
			 provided access to materials necessary to effectively advocate for the best
			 interest of the child. The child advocate shall not be compelled to testify or
			 provide evidence in any proceeding concerning any information or opinion
			 received from the child in the course of serving as a child advocate. The child
			 advocate shall be presumed to be acting in good faith and be immune from civil
			 and criminal liability for lawful conduct of duties as described in this
			 provision.</text>
						</paragraph><paragraph id="IDce3fa9d814e545d68eefa926536ee58f"><enum>(7)</enum><header>Confidentiality</header><text>The
			 Secretary of Health and Human Services shall maintain the privacy and
			 confidentiality of all information gathered in the course of the care, custody,
			 and placement of unaccompanied alien children, consistent with its role and
			 responsibilities under the Homeland Security Act of 2002 to act as guardian in
			 loco parentis in the best interest of the unaccompanied alien child, by not
			 disclosing such information to other government agencies or nonparental third
			 parties. The Secretary shall provide information to a duly recognized law
			 enforcement entity in connection with a prosecution or investigation of an
			 offense described in paragraph (2) or (3) of section 212(a) of the Immigration
			 and Nationality Act (8 U.S.C. 1182(a)), when such information is requested in
			 writing by such entity.</text>
						</paragraph></subsection><subsection id="IDfc9427933b714f4bbbcebcabb7edf6a6"><enum>(d)</enum><header>Permanent
			 protection for certain at-risk children</header>
						<paragraph id="ID791ce889fd8b4550828cfdc42a03c8c7"><enum>(1)</enum><header>In
			 general</header><text>Section 101(a)(27)(J) of the Immigration and Nationality
			 Act (8 U.S.C. 1101(a)(27)(J)) is amended—</text>
							<subparagraph id="ID142abffaba2e4c47a8ab4c90e2f9726a"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>State and who has been deemed eligible by that court for
			 long-term foster care due to abuse, neglect, or abandonment;</quote> and
			 inserting <quote>State, or an individual or entity appointed by a State or
			 juvenile court located in the United States, and whose reunification with 1 or
			 both of the immigrant’s parents is not viable due to abuse, neglect,
			 abandonment, or a similar basis found under State law;</quote>; and</text>
							</subparagraph><subparagraph id="IDbf3a48ea1f1f48cea0b4ce2d9d65787b"><enum>(B)</enum><text>in clause
			 (iii)—</text>
								<clause id="id7F08320B0618485186E8BF25C5EA2AA9"><enum>(i)</enum><text>in
			 the matter preceding subclause (I), by striking <quote>the Attorney General
			 expressly consents to the dependency order serving as a precondition to the
			 grant of special immigrant juvenile status;</quote> and inserting <quote>the
			 Secretary of Homeland Security consents to the grant of special immigrant
			 juvenile status,</quote>; and</text>
								</clause><clause id="IDc55768f4f4b44777898478bc0066287d"><enum>(ii)</enum><text>in
			 subclause (I), by striking <quote>in the actual or constructive custody of the
			 Attorney General unless the Attorney General specifically consents to such
			 jurisdiction;</quote> and inserting <quote>in the custody of the Secretary of
			 Health and Human Services unless the Secretary of Health and Human Services
			 specifically consents to such jurisdiction;</quote>.</text>
								</clause></subparagraph></paragraph><paragraph id="IDdb92b103de2743278caa8baa6e21f22b"><enum>(2)</enum><header>Expeditious
			 adjudication</header><text>All applications for special immigrant status under
			 section 101(a)(27)(J) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(27)(J)) shall be adjudicated by the Secretary of Homeland Security not
			 later than 180 days after the date on which the application is filed.</text>
						</paragraph><paragraph id="ID0d8f12dec5b7483486bde8ff08a0e719"><enum>(3)</enum><header>Adjustment of
			 status</header><text>Section 245(h)(2)(A) of the Immigration and Nationality
			 Act (8 U.S.C. 1255(h)(2)(A)) is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="id9874154130C8415AA82961267367EB3E" style="OLC">
								<subparagraph id="ID93eeb8aac14f44f8aade6df199476500"><enum>(A)</enum><text>paragraphs (4),
				(5)(A), (6)(A), (6)(C), (6)(D), (7)(A), 9(B), and 9(C)(i)(I) of section 212(a)
				shall not apply;
				and</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="ID66a79a9f4af242b3ba1c5f3e7af7aebb"><enum>(4)</enum><header>Eligibility for
			 assistance</header>
							<subparagraph id="ID7708346123904ca59867817f71a15c4e"><enum>(A)</enum><header>In
			 general</header><text>A child who has been granted special immigrant status
			 under section 101(a)(27)(J) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(27)(J)) and who was either in the custody of the Secretary of Health
			 and Human Services at the time a dependency order was granted for such child or
			 who was receiving services pursuant to section 501(a) of the Refugee Education
			 Assistance Act of 1980 (8 U.S.C. 1522 note) at the time such dependency order
			 was granted, shall be eligible for placement and services under section 412(d)
			 of the Immigration and Nationality Act (8 U.S.C. 1522(d)) until the earlier
			 of—</text>
								<clause id="IDd2a299b68da84529a5170239a41a4d5c"><enum>(i)</enum><text>the
			 date on which the child reaches the age designated in section 412(d)(2)(B) of
			 the Immigration and Nationality Act (8 U.S.C. 1522(d)(2)(B)); or</text>
								</clause><clause id="IDb95b3812a8ba4caaa6b1af3da619959d"><enum>(ii)</enum><text>the date on
			 which the child is placed in a permanent adoptive home.</text>
								</clause></subparagraph><subparagraph id="ID434e6f0d273841a59877179052337736"><enum>(B)</enum><header>State
			 reimbursement</header><text>If State foster care funds are expended on behalf
			 of a child who is not described in subparagraph (A) and has been granted
			 special immigrant status under section 101(a)(27)(J) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(27)(J)), the Federal Government shall
			 reimburse the State in which the child resides for such expenditures by the
			 State.</text>
							</subparagraph></paragraph><paragraph id="IDd10634f22e59437da349552316fb4bf1"><enum>(5)</enum><header>State courts
			 acting in loco parentis</header><text>A department or agency of a State, or an
			 individual or entity appointed by a State court or juvenile court located in
			 the United States, acting in loco parentis, shall not be considered a legal
			 guardian for purposes of this section or section 462 of the Homeland Security
			 Act of 2002 (6 U.S.C. 279).</text>
						</paragraph><paragraph id="ID70c866c42f344d12a382e6a7f7077169"><enum>(6)</enum><header>Transition
			 rule</header><text>Notwithstanding any other provision of law, an alien
			 described in section 101(a)(27)(J) of the Immigration and Nationality Act (8
			 U.S.C. 1101(a)(27)(J)), as amended by paragraph (1), may not be denied special
			 immigrant status under such section after the date of the enactment of this Act
			 based on age if the alien was a child on the date on which the alien applied
			 for such status.</text>
						</paragraph><paragraph id="IDa0d7bbae743544aaab5c94b378bf070c"><enum>(7)</enum><header>Access to
			 asylum protections</header><text>Section 208 of the Immigration and Nationality
			 Act (8 U.S.C. 1158) is amended—</text>
							<subparagraph id="ID9d672983e7be471fb48865047ca24926"><enum>(A)</enum><text>in subsection
			 (a)(2), by adding at the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="id75709D3A223F4D6280B1041D41DE6343" style="OLC">
									<subparagraph id="ID474a5f1eb31e4d0386d7b594ce151d25"><enum>(E)</enum><header>Applicability</header><text>Subparagraphs
				(A) and (B) shall not apply to an unaccompanied alien child (as defined in
				section 462(g) of the Homeland Security Act of 2002 (6 U.S.C.
				279(g))).</text>
									</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="ID07f71d188f90426984106cb916260345"><enum>(B)</enum><text>in subsection
			 (b)(3), by adding at the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="id5C6A741CE435469B92DCDF34D77E6878" style="OLC">
									<subparagraph id="ID30931d385ae84c58a11dc58984637017"><enum>(C)</enum><header>Initial
				jurisdiction</header><text>An asylum officer (as defined in section
				235(b)(1)(E)) shall have initial jurisdiction over any asylum application filed
				by an unaccompanied alien child (as defined in section 462(g) of the Homeland
				Security Act of 2002 (6 U.S.C. 279(g))), regardless of whether filed in
				accordance with this section or section
				235(b).</text>
									</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="ID2fd7eefad46e4a7aa7a7efe7e4d2a65c"><enum>(8)</enum><header>Specialized
			 needs of children</header><text>Applications for asylum and other forms of
			 relief from removal in which a child is the principal applicant shall be
			 governed by regulations which take into account the specialized needs of
			 children and which address both procedural and substantive aspects of handling
			 children’s cases.</text>
						</paragraph></subsection><subsection id="ID7216aa4d22284e7a84e36c2e3efa16c7"><enum>(e)</enum><header>Training</header><text>The
			 Secretary of State, the Secretary of Homeland Security, the Secretary of Health
			 and Human Services, and the Attorney General shall provide specialized training
			 to all Federal personnel, and upon request, state and local personnel, who come
			 into contact with unaccompanied alien children. Such personnel shall be trained
			 to work with unaccompanied alien children, including identifying children who
			 are a victim of a severe form of trafficking in persons, and children for whom
			 asylum or special immigrant relief may be appropriate, including children
			 described in subsection (a)(2).</text>
					</subsection><subsection id="IDd9c047a9b3274bedbc9ce015a8ed0ab9"><enum>(f)</enum><header>Amendments to
			 the Homeland Security Act of 2002</header>
						<paragraph id="IDc53797a0b19e4546a66f1e4aab35dbc5"><enum>(1)</enum><header>Additional
			 responsibilities</header><text>Section 462(b)(1)(L) of the Homeland Security
			 Act of 2002 (6 U.S.C. 279(b)(1)(L)) is amended by striking the period at the
			 end and inserting <quote>, including regular follow-up visits to such
			 facilities, placements, and other entities, to assess the continued suitability
			 of such placements.</quote>.</text>
						</paragraph><paragraph id="ID2d1e8240a2934f98b5292a0b258667e3"><enum>(2)</enum><header>Technical
			 corrections</header><text>Section 462(b) of such Act (6 U.S.C. 279(b)) is
			 further amended—</text>
							<subparagraph id="IDefe36bee09e140fbbb2728870cc3126e"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>paragraph (1)(G),</quote> and inserting <quote>paragraph
			 (1),</quote>; and</text>
							</subparagraph><subparagraph id="ID4abcaeb81e564f05bc349f3d0aa21a6b"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
								<quoted-block display-inline="no-display-inline" id="idD02D1C9F49A54B7B8901FA23F1980214" style="OLC">
									<paragraph id="IDc533720cdf2840e7b166e0015d1213d7"><enum>(4)</enum><header>Rule of
				construction</header><text>Nothing in paragraph (2)(B) may be construed to
				require that a bond be posted for an unaccompanied alien child who is released
				to a qualified
				sponsor.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="IDfc043f1e6bfc45538d11805700fca7ab"><enum>(g)</enum><header>Definition of
			 unaccompanied alien child</header><text>For purposes of this section, the term
			 <term>unaccompanied alien child</term> has the meaning given such term in
			 section 462(g) of the Homeland Security Act of 2002 (6 U.S.C. 279(g)).</text>
					</subsection><subsection id="ID043eec1bfa3e4ea59d32992b2f616fc1"><enum>(h)</enum><header>Effective
			 date</header><text>This section shall—</text>
						<paragraph id="idB9A0B7E0182F40A5B1FE8B569F8CCE44"><enum>(1)</enum><text>take effect on
			 the date that is 90 days after the date of the enactment of this Act;
			 and</text>
						</paragraph><paragraph id="idDB45ECF55B094A75AB9C84EDE886A4B2"><enum>(2)</enum><text>apply to all
			 aliens in the United States, pending proceedings before the Executive Office
			 for Immigration Review or related administrative or Federal appeals on or after
			 the date of the enactment of this Act.</text>
						</paragraph></subsection><subsection id="ID0d6f251b01134d6880686d680affd5b6"><enum>(i)</enum><header>Grants and
			 contracts</header><text>The Secretary of Health and Human Services may award
			 grants to, and enter into contracts with, voluntary agencies to carry out this
			 section and section 462 of the Homeland Security Act of 2002 (6 U.S.C.
			 279).</text>
					</subsection></section><section id="H71C0E1F44B404579A14F351CF38B534F"><enum>236.</enum><header>Temporary
			 increase in fee for certain consular services</header>
					<subsection id="H73068069AE5745109F7F3E3C74476400"><enum>(a)</enum><header>Increase in
			 Fee</header><text>Notwithstanding any other provision of law, not later than
			 October 1, 2008, the Secretary of State shall increase by $2 the fee or
			 surcharge assessed under section 140(a) of the Foreign Relations Authorization
			 Act, Fiscal Years 1994 and 1995 (Public Law 103–236; 8 U.S.C. 1351 note) for
			 processing machine-readable nonimmigrant visas and machine-readable combined
			 border crossing identification cards and nonimmigrant visas.</text>
					</subsection><subsection id="H09CB1D3604254D7590003F0948B9BE6E"><enum>(b)</enum><header>Deposit of
			 Amounts</header><text display-inline="yes-display-inline">Notwithstanding
			 section 140(a)(2) of the Foreign Relations Authorization Act, Fiscal Years 1994
			 and 1995 (Public Law 103–236; 8 U.S.C. 1351 note), the additional amount
			 collected pursuant the fee increase under subsection (a) shall be deposited in
			 the Treasury.</text>
					</subsection><subsection id="H3AFC91E7E647417DB700CA0626BDAED1"><enum>(c)</enum><header>Duration of
			 Increase</header><text>The fee increase authorized under subsection (a) shall
			 terminate on the date that is 2 years after the first date on which such
			 increased fee is collected.</text>
					</subsection></section></subtitle></title><title id="H352C93A5E63E4D999E6925AC7BD4E49F"><enum>III</enum><header>Authorizations
			 of appropriations</header>
			<section id="H61F54EB4F4B244C0AF057F5D6447A141"><enum>301.</enum><header>Trafficking
			 Victims Protection Act of 2000</header><text display-inline="no-display-inline">Section 113 of the Trafficking Victims
			 Protection Act of 2000, as amended by section 213(a)(2), is amended—</text>
				<paragraph id="HFCD6CD76079F4C91B332BF7A2D7083"><enum>(1)</enum><text>in
			 subsection (a)—</text>
					<subparagraph id="H5EA0EF7676194438975FB500389EA048"><enum>(A)</enum><text>in the first
			 sentence—</text>
						<clause id="H96ACB4D8C71541B1AF8D2BD705A98DB5"><enum>(i)</enum><text>by
			 striking <quote>section 104, and</quote>; and</text>
						</clause><clause id="HFC0E61B2F8A44781B55FD8000728B1B0"><enum>(ii)</enum><text>by
			 striking <quote>$1,500,000</quote> and all that follows through
			 <quote>$5,500,000 for each of the fiscal years 2006 and 2007</quote> and
			 inserting <quote>$5,500,000 for each of the fiscal years 2008 through
			 2011</quote>; and</text>
						</clause></subparagraph><subparagraph id="H63BFB780834445809D1175AC645B5E5B"><enum>(B)</enum><text>in the second
			 sentence—</text>

			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Child Soldiers Prevention and
			 Accountability Act of 2008</short-title></quote>.</text>
			</section><section id="IDd59fd71e989542af9e2346b339738f0d"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="idAEDAAB22FC3F4C7294F14048C43C99BE"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
					<subparagraph id="idD66E88759F9648B4BEB78BC5221C8F83"><enum>(A)</enum><text>the
			 <committee-name committee-id="SSFR00">Committee on Foreign Relations of the
			 Senate</committee-name>;</text>
					</subparagraph><subparagraph id="id1748F85831C74ACDAB92C192AC1E716D"><enum>(B)</enum><text>the
			 <committee-name committee-id="SSAP00">Committee on Appropriations of the
			 Senate</committee-name>;</text>
					</subparagraph><subparagraph id="id16FB0813E5244B829012A84ADC8028C2"><enum>(C)</enum><text>the
			 <committee-name committee-id="">Committee on Foreign Affairs of the House of
			 Representatives</committee-name>; and</text>

					</subparagraph></paragraph><paragraph id="id67F5CCE796F5478888356EEEF3136E3E"><enum>(2)</enum><header>Child
			 soldier</header><text display-inline="yes-display-inline">Consistent with the
			 provisions of the Optional Protocol to the Convention of the Rights of the
			 Child, the term <term>child soldier</term>—</text>
					<subparagraph id="ID788a3ac265914602bafc148a8c4793e0"><enum>(A)</enum><text>means—</text>
						<clause id="ID3c3e7b897f3c401e83f6d85e100e1372"><enum>(i)</enum><text>any
			 person under 18 years of age who takes a direct part in hostilities as a member
			 of governmental armed forces;</text>
						</clause><clause id="IDcf092cd17389460e99f14df4a3f43ebd"><enum>(ii)</enum><text>any person under
			 18 years of age who has been compulsorily recruited into governmental armed
			 forces;</text>
						</clause><clause id="ID887685ba8cf24db9bab4ed8d78c01eac"><enum>(iii)</enum><text>any person
			 under 16 years of age who has been voluntarily recruited into governmental
			 armed forces; or</text>
						</clause><clause id="IDf9c729fd9a9443f983387dac2a6e1b60"><enum>(iv)</enum><text>any person under
			 18 years of age who has been recruited or used in hostilities by armed forces
			 distinct from the armed forces of a state; and</text>
						</clause></subparagraph><subparagraph id="IDb3849db73cee4b1c9a646ec3e6455603"><enum>(B)</enum><text>includes any
			 person described in clauses (ii), (iii), or (iv) of subparagraph (A) who is
			 serving in any capacity, including in a support role such as a cook, porter,
			 messenger, medic, guard, or sex slave.</text>
					</subparagraph></paragraph></section><section id="IDb93aaa741a97492caa9bbf4d6866ffec"><enum>403.</enum><header>Prohibition</header>
				<subsection id="IDbf9dfd4645cc454c863d8b8fae7e9fdc"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsections (c), (d), and (e), none of the
			 funds appropriated or otherwise made available for international military
			 education and training, foreign military financing, or the transfer of excess
			 defense articles under section 116 or 502B of the Foreign Assistance Act of
			 1961 (22 U.S.C. 2151n(f) and 2304(h)), the Arms Export Control Act (22 U.S.C.
			 2751), the Department of State, Foreign Operations, and Related Programs
			 Appropriations Act, 2008 (division J of Public Law 110–161) or under any other
			 Act making appropriations for foreign operations, export financing, and related
			 programs may be obligated or otherwise made available, and no licenses for
			 direct commercial sales of military equipment may be issued to the government
			 of a country that is clearly identified, in the Department of State’s Country
			 Report on Human Rights Practices for the most recent year preceding the fiscal
			 year in which the appropriated funds, transfer, or license, would have been
			 used or issued in the absence of a violation of this title, as having
			 governmental armed forces or government-supported armed groups, including
			 paramilitaries, militias, or civil defense forces, that recruit and use child
			 soldiers.</text>
				</subsection><subsection id="IDcf751e4c7b294b9498d8eabdbe8a7948"><enum>(b)</enum><header>Notification to
			 Countries in Violation of Standards</header><text>The Secretary of State shall
			 formally notify any government identified pursuant to subsection (a).</text>
				</subsection><subsection id="ID5bf08377dba54ddaacc7c58e83313ca1"><enum>(c)</enum><header>National
			 Interest Waiver</header>
					<paragraph id="ID85a75adcdf1443469b7121fd3ff4613e"><enum>(1)</enum><header>Waiver</header><text>The
			 President may waive the application to a country of the prohibition in
			 subsection (a) if the President determines that such waiver is in the national
			 interest of the United States.</text>
					</paragraph><paragraph id="ID112a3c2a836040e1be31301a69940d06"><enum>(2)</enum><header>Publication and
			 notification</header><text>Not later than 45 days after each waiver is granted
			 under paragraph (1), the President shall publish such waiver in the Federal
			 Register with the justification for granting such waiver.</text>
					</paragraph></subsection><subsection id="IDc53c00c3c7ee466d9376351dfa80b1e8"><enum>(d)</enum><header>Reinstatement
			 of Assistance</header><text>The President may provide to a country assistance
			 otherwise prohibited under subsection (a) upon certifying to the appropriate
			 congressional committees that the government of such country—</text>
					<paragraph id="ID63f781297273462eb18dd8e81eb875eb"><enum>(1)</enum><text>has implemented
			 measures that include an action plan and actual steps to come into compliance
			 with the standards outlined in section 404(b); and</text>
					</paragraph><paragraph id="ID9cc82debbc7a459ebc94e5faa4aba217"><enum>(2)</enum><text>has implemented
			 policies and mechanisms to prohibit and prevent future government or
			 government-supported use of child soldiers and to ensure that no children are
			 recruited, conscripted, or otherwise compelled to serve as child
			 soldiers.</text>
					</paragraph></subsection><subsection id="ID0b9c4119b69f499da440a861a9973cab"><enum>(e)</enum><header>Exception for
			 Programs Directly Related To Addressing the Problem of Child Soldiers or
			 Professionalization of the Military</header>
					<paragraph id="IDdcfb9c8a0e89476cafd747d3d8d8fc02"><enum>(1)</enum><header>In
			 general</header><text>The President may provide assistance to a country for
			 international military education, training, and nonlethal supplies (as defined
			 in section 2557(d)(1)(B) of title 10, United States Code) otherwise prohibited
			 under subsection (a) upon certifying to the appropriate congressional
			 committees that—</text>
						<subparagraph id="ID2b1bde882b35445d9cd1a98910db6280"><enum>(A)</enum><text>the government of
			 such country is taking reasonable steps to implement effective measures to
			 demobilize child soldiers in its forces or in government-supported
			 pa­ra­mil­i­tar­ies and is taking reasonable steps within the context of its
			 national resources to provide demobilization, rehabilitation, and reintegration
			 assistance to those former child soldiers; and</text>
						</subparagraph><subparagraph id="IDfd0739dd213240f6a43be83018419139"><enum>(B)</enum><text>the assistance
			 provided by the United States Government to the government of such country will
			 go to programs that will directly support professionalization of the
			 military.</text>
						</subparagraph></paragraph><paragraph id="IDf469a87c1d3d4576905cd94c14ddfcf5"><enum>(2)</enum><header>Limitation</header><text>The
			 exception under paragraph (1) may not remain in effect for a country for more
			 than 2 years.</text>
					</paragraph></subsection></section><section id="IDa9cd317bd1bf49a0a6404328ceaec8e2"><enum>404.</enum><header>Reports</header>
				<subsection id="ID4af5485142264b98849b6d2a62f72584"><enum>(a)</enum><header>Investigation
			 of Allegations Regarding Child Soldiers</header><text>United States missions
			 abroad shall thoroughly investigate reports of the use of child
			 soldiers.</text>
				</subsection><subsection id="ID026b433cd17144819b5c305c43576838"><enum>(b)</enum><header>Information for
			 Annual Human Rights Reports</header><text>In preparing those portions of the
			 annual Human Rights Report that relate to child soldiers under sections 116 and
			 502B of the Foreign Assistance Act of 1961 (22 U.S.C. 2151n(f) and 2304(h)),
			 the Secretary of State shall ensure that such reports include—</text>
					<paragraph id="id328C1A2120C242E19660203DA0B278DD"><enum>(1)</enum><text>any determination
			 that a government has violated the standards under this title; and</text>
					</paragraph><paragraph id="id3E6680C199F34947AD63038987DEEF94"><enum>(2)</enum><text>a description of
			 the use of child soldiers in each foreign country, whether or not such use
			 constitutes a violation of such standards, including—</text>
						<subparagraph id="ID8adfe65bdabf4040a7efc854fef044cf"><enum>(A)</enum><text>trends toward
			 improvement in such country of the status of child soldiers or the continued or
			 increased tolerance of such practices; and</text>
						</subparagraph><subparagraph id="IDc465014ad4fe4a83b84b577b3512d391"><enum>(B)</enum><text>the role of the
			 government of such country in engaging in or tolerating the use of child
			 soldiers.</text>
						</subparagraph></paragraph></subsection><subsection id="IDe4807fd3118849f2acb8d41859caa529"><enum>(c)</enum><header>Annual report
			 to Congress</header><text>Not later than June 15 of each of the 10 years
			 following the date of the enactment of this Act, the President shall submit a
			 report to the appropriate congressional committees that contains—</text>
					<paragraph id="ID54ae561ee1164ae88edb9ecf50e2ee18"><enum>(1)</enum><text>a list of the
			 countries receiving notification that they are in violation of the standards
			 under this title;</text>
					</paragraph><paragraph id="IDbf1bafefab8947408e6500c10f4c0379"><enum>(2)</enum><text>a list of any
			 waivers or exceptions exercised under this title;</text>
					</paragraph><paragraph id="ID6323d79fae0d4a0fa0dce537ec6cf32c"><enum>(3)</enum><text>justification for
			 any such waivers and exceptions; and</text>
					</paragraph><paragraph id="ID1504f19beaeb42bcbac10c5e6106c0b1"><enum>(4)</enum><text>a description of
			 any assistance provided under this title pursuant to the issuance of such
			 waiver.</text>
					</paragraph></subsection><subsection id="IDa12f83136d4249d79e7ba09b542f9b4d"><enum>(d)</enum><header>Implementation
			 report</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Secretary of State and
			 the Secretary of Defense shall jointly submit a report to the appropriate
			 congressional committees that—</text>
					<paragraph id="id47410FB9F8EB48039A3286BA105C6031"><enum>(1)</enum><text display-inline="yes-display-inline">sets forth a strategy and a program to
			 assist governments that have expressed the political will to achieve the policy
			 objectives described in this title; and</text>
					</paragraph><paragraph id="id04F30CDA526C401A969EE71A8C1CE274"><enum>(2)</enum><text display-inline="yes-display-inline">includes a description of an effective
			 mechanism for coordination of United States Government efforts to implement
			 this strategy.</text>
					</paragraph></subsection></section><section id="IDf91fe3a045aa4154bbbc002eb2885bdc"><enum>405.</enum><header>Training for
			 foreign service officers</header><text display-inline="no-display-inline">Section 708 of the Foreign Service Act of
			 1980 (22 U.S.C. 4028) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id78042A0C770A48519BE9CD9BBFB5521D" style="OLC">
					<subsection id="ID325e22abac5a415694eebe6a770cf83a"><enum>(c)</enum><text>The Secretary of
				State, with the assistance of other relevant officials, shall establish as part
				of the standard training provided for chiefs of mission, deputy chiefs of
				mission, and other officers of the Service who are or will be involved in the
				assessment of child soldier use or the drafting of the annual Human Rights
				Report, instruction on matters related to child soldiers, and the substance of
				the <short-title>Child Soldiers Prevention and
				Accountability Act of
				2008</short-title>.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDfada2f645f0e43a4860255f6840cc734"><enum>406.</enum><header>Accountability
			 for the recruitment and use of child soldiers</header>
				<subsection id="IDab91543d10cb4f8c9d674a109c3ec9ae"><enum>(a)</enum><header>Crime for
			 Recruiting or Using Child Soldiers</header>
					<paragraph id="ID204df899076649d3a9f1d8257c625c78"><enum>(1)</enum><header>In
			 general</header><text>Chapter 118 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id36D5D705FE234856865BE7F93847CD45" style="USC">
							<section id="ID567873eed3064a01bf60b01245090ccb"><enum>2442.</enum><header>Recruitment
				or use of child soldiers</header>
								<subsection id="ID8d580ee2d57d4ed9867200ab8c984778"><enum>(a)</enum><header>Offense</header><text>Any
				person who knowingly recruits, enlists, or conscripts a person under 15 years
				of age into an armed force or group, or knowingly uses a person under 15 years
				of age to participate actively in hostilities—</text>
									<paragraph id="ID550a275db94f4397855b6a3db609f0e4"><enum>(1)</enum><text>shall be fined
				under this title, imprisoned not more than 20 years, or both; and</text>
									</paragraph><paragraph id="IDce1f8cbf702749c69406a40d72af286f"><enum>(2)</enum><text>if the death of
				any person results, shall be fined under this title and imprisoned for any term
				of years or for life.</text>
									</paragraph></subsection><subsection id="ID999c62d61f1d4162ade13ef08a72c75d"><enum>(b)</enum><header>Attempt and
				conspiracy</header><text>Any person who attempts or conspires to commit an
				offense under this section shall be punished in the same manner as a person who
				completes the offense.</text>
								</subsection><subsection id="IDdff4f51a90cb460698e03e597a0667e2"><enum>(c)</enum><header>Jurisdiction</header><text>There
				is jurisdiction over an offense described in subsection (a), and any attempt or
				conspiracy to commit such offense, if—</text>
									<paragraph id="IDb67d3f92e8f4417fa731bfa076496d7f"><enum>(1)</enum><text>the alleged
				offender is a national of the United States (as defined in section 101(a)(22)
				of the Immigration and Nationality Act (8 U.S.C. 1101(a)(22))) or an alien
				lawfully admitted for permanent residence in the United States (as defined in
				section 101(a)(20) of such Act (8 U.S.C. 1101(a)(20));</text>
									</paragraph><paragraph id="ID097b0922dd7548e4904966dc5a254eb5"><enum>(2)</enum><text>the alleged
				offender is a stateless person whose habitual residence is in the United
				States;</text>
									</paragraph><paragraph id="ID585403f237b143ff91cb7ce7f4140580"><enum>(3)</enum><text>the alleged
				offender is present in the United States, irrespective of the nationality of
				the alleged offender; or</text>
									</paragraph><paragraph id="ID5c02ad39e8a746dabc2dcf612796510a"><enum>(4)</enum><text>the offense
				occurs in whole or in part within the United States.</text>
									</paragraph></subsection><subsection id="ID81e464fb53c0463782b7eb3ea416f978"><enum>(d)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph id="ID10b951ccba4c4cacb5043e059205263e"><enum>(1)</enum><header>Participate
				actively in hostilities</header><text>The term <term>participate actively in
				hostilities</term> means taking part in—</text>
										<subparagraph id="IDed956f18280940168665229e99c2e3bd"><enum>(A)</enum><text>combat or
				military activities related to combat, including scouting, spying, sabotage,
				and serving as a decoy, a courier, or at a military checkpoint; or</text>
										</subparagraph><subparagraph id="IDe8fbbc56c9f745a9a27fbf3abe20571e"><enum>(B)</enum><text>direct support
				functions related to combat, including taking supplies to the front line and
				other services at the front line.</text>
										</subparagraph></paragraph><paragraph id="ID5b97a89e04d640f89e02b8f55c3447ed"><enum>(2)</enum><header>Armed force or
				group</header><text>The term <term>armed force or group</term> means any army,
				militia, or other military organization, whether or not it is state-sponsored,
				excluding any group assembled solely for nonviolent political
				association.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="ID8b6ebe8488d04a84939b84744a3ba61a"><enum>(2)</enum><header>Statute of
			 limitations</header><text>Chapter 213 of title 18, United States Code, is
			 amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id4F314169412B4457A22C0D2C7D94B943" style="USC">
							<section id="ID55c002df621e42ff95cb3d7af9654faa"><enum>3300.</enum><header>Recruitment
				or use of child soldiers</header><text display-inline="no-display-inline">No
				person may be prosecuted, tried, or punished for a violation of section 2442
				unless the indictment or the information is filed not later than 10 years after
				the commission of the
				offense.</text>
							</section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="ID95997ba56bbb4a2abdf1dcdb654925fc"><enum>(3)</enum><header>Clerical
			 amendments</header><text>Title 18, United States Code, is amended—</text>
						<subparagraph id="IDdc06c28ede364ff3998a68502ab93610"><enum>(A)</enum><text>in the table of
			 sections for chapter 118, by adding at the end the following:</text>

			 212(a)(3) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(3)) is
			 amended by adding at the end the following:</text>

						<subparagraph id="ID678e542380ba425b9f3627c46493534a"><enum>(G)</enum><header>Recruitment or
				use of child soldiers</header><text>Any alien who has engaged in the
				recruitment or use of child soldiers in violation of section 2442 of title 18,
				United States Code, is
				inadmissible.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID76ef0dc98c6d45fe9e64bb3864ef0972"><enum>(c)</enum><header>Ground of
			 Removability for Recruiting or Using Child Soldiers</header><text>Section
			 237(a)(4) of the Immigration and Nationality Act (8 U.S.C. 1227(a)(4)) is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id45E724201CCF48878A5EC6994B38FE0F" style="OLC">
						<subparagraph id="IDf2a4b9499ad746dd9f3f5ba995edbd11"><enum>(F)</enum><header>Recruitment or
				use of child soldiers</header><text>Any alien who has engaged in the
				recruitment or use of child soldiers in violation of section 2442 of title 18,
				United States Code, is
				deportable.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDe686ba35775e480890dc0e38ef592c01"><enum>(d)</enum><header>Asylum and
			 withholding of removal</header><text>Not later than 60 days after the date of
			 the enactment of this Act, the Attorney General shall promulgate final
			 regulations establishing that, for purposes of sections 208(b)(2)(A)(iii) and
			 241(b)(3)(B)(iii) of the Immigration and Nationality Act (8 U.S.C.
			 1158(b)(2)(A)(iii) and 1231(b)(3)(B)(iii)), an alien who is inadmissible under
			 section 212(a)(3)(G) of such Act or removable under section 237(a)(4)(F) of
			 such Act shall be considered an alien with respect to whom there are serious
			 reasons to believe that the alien committed a serious nonpolitical
			 crime.</text>
				</subsection></section><section id="ID0d355ea9e7474c99b07a4e5ba3246a56"><enum>407.</enum><header>Effective
			 date; applicability</header><text display-inline="no-display-inline">This
			 title, and the amendments made by this title, shall take effect 180 days after
			 the date of the enactment of this Act and shall apply to funds obligated after
			 such effective date.</text>
