		<section display-inline="no-display-inline" id="H1E18BEC0E9B34C73BE19A94D21CFF079" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Eurasia Foundation
			 Act</short-title></quote>.</text>
		</section><section id="H2DC3DBE8A7EC449ABCD804E9BA9C84A1"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="HC73C294D17AD427E9B00F818FE3B6D5F"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="HF1820A6171FB40DE8746333D91314D61"><enum>(1)</enum><text>There has been
			 established in the District of Columbia a private, nonprofit corporation known
			 as the Eurasia Foundation (hereafter in this Act referred to as the
			 <quote>Foundation</quote>), which is not an agency or establishment of the
			 United States Government.</text>
				</paragraph><paragraph id="H8164270FF278444FAC74264C40FCB8C2"><enum>(2)</enum><text>In recognition of
			 the valuable contributions of the Foundation to long-range United States
			 foreign policy interests, the United States Government has, through the United
			 States Agency for International Development and the Department of State,
			 provided financial support for the Foundation.</text>
				</paragraph><paragraph id="H5C98841617FE479D937FA9CF90A1CB52"><enum>(3)</enum><text>It is in the
			 interest of the United States, and the further strengthening of cooperation
			 with the countries of Eurasia, to establish a more permanent mechanism for
			 United States Government financial support for the ongoing activities of the
			 Foundation, while preserving the independent character of the
			 Foundation.</text>
				</paragraph></subsection><subsection id="HE85292A63AF64C8781A8F19371B87E1D"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the Foundation are to—</text>
				<paragraph id="H8641E939E9BB4B6886825C6DD2872C54"><enum>(1)</enum><text>promote civil
			 society, private enterprise, and sound public administration and policy only in
			 the countries of Eurasia and in lending encouragement and assistance to
			 citizens of such countries in their own efforts to develop more open, just, and
			 democratic societies;</text>
				</paragraph><paragraph id="H4FEACB3692E948ABA0FD34FE6B00E25C"><enum>(2)</enum><text>strengthen
			 indigenous institutions only in the countries of Eurasia in order to foster
			 national development, constructive social change, equitable economic growth,
			 and cooperative international relationships that are fully consistent with and
			 supportive of long-term United States interests with respect to the countries
			 of Eurasia; and</text>
				</paragraph><paragraph id="H12EA39859AB64F75ADC18C1B100EAE4"><enum>(3)</enum><text>conduct programs in
			 response to initiatives in the countries of Eurasia that would be difficult or
			 impossible for an official United States entity, and, as a result of its
			 position in the countries of Eurasia, to respond quickly and flexibly to meet
			 new opportunities.</text>
				</paragraph></subsection></section><section id="H86F048C7DDC04003835DCDB2F286C31E"><enum>3.</enum><header>Grants to the
			 Foundation</header>
			<subsection id="HE71553ECD60645D29E32C5CFAFD9BDE"><enum>(a)</enum><header>Grants
			 required</header>
				<paragraph id="H6F9220DA436C4E61BFE44D3E62831D78"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of State shall award an annual grant to the
			 Foundation to enable the Foundation to carry out the purposes described in
			 section 2(b).</text>
				</paragraph><paragraph id="HC5D91A122F554459AEA985A4DF3773F4"><enum>(2)</enum><header>Additional
			 requirements</header><text>Each grant awarded under paragraph (1) shall—</text>
					<subparagraph id="HCEB8134F0D484144BF497B68CF1BB465"><enum>(A)</enum><text>consist of funds
			 specifically appropriated for grants to the Foundation; and</text>
					</subparagraph><subparagraph id="H73A0255397664B6094B6464C5181F5A6"><enum>(B)</enum><text>be contingent upon
			 a grant agreement between the Secretary and the Foundation that requires the
			 Foundation to—</text>
						<clause id="HCC4DE1A0BBCB486FBE188DECBD1EF93"><enum>(i)</enum><text>only
			 use grant funds for activities that the Board of Directors of the Foundation
			 determines are consistent with the purposes described in section 2(b);
			 and</text>
						</clause><clause id="idBB7E1E0C02CA4F43B28209BBCD16E6E6"><enum>(ii)</enum><text>otherwise comply
			 with the requirements of this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H6D022BDEB816417DAB10006B0776CAC3"><enum>(b)</enum><header>Rule of
			 construction</header><text>Nothing in this Act may be construed to—</text>
				<paragraph id="id5B7BAFFC1924458981D48DA6F362262A"><enum>(1)</enum><text>make the
			 Foundation an agency or establishment of the United States Government;
			 or</text>
				</paragraph><paragraph id="id309EDAE3E85042BA84A6DE5642767F77"><enum>(2)</enum><text>make the members
			 of the Board of Directors of the Foundation, or the officers or employees of
			 the Foundation, officers or employees of the United States.</text>
				</paragraph></subsection><subsection id="H55920D74B40F46129F5D16C605145500"><enum>(c)</enum><header>Oversight</header><text>The
			 Foundation and its grantees shall be subject to the appropriate oversight
			 procedures of Congress.</text>
			</subsection><subsection id="H0878490CEB56414A890290FADF1D3053"><enum>(d)</enum><header>Other
			 funding</header><text>The Foundation may accept funding from non-United States
			 Government sources to complement United States Government funding.</text>
			</subsection><subsection id="H6C476D9D95ED4A8D00E8AD4C0041A723"><enum>(e)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="H97DDFD9A806C403F859BEFD3C78B8D76"><enum>(1)</enum><text>a
			 Foundation, funded for fiscal year 2009 at the levels authorized under section
			 7, and at appropriate levels in subsequent fiscal years, can contribute
			 significantly to the political, economic, and social development of democracy
			 and human rights in the countries of Eurasia;</text>
				</paragraph><paragraph id="H2519B943D505469FBDE44135C322121E"><enum>(2)</enum><text>notwithstanding
			 the Foundation’s distinguished record of performance, organizations that seek
			 competitive grants typically perform in a more transparent and effective
			 manner; and</text>
				</paragraph><paragraph id="HF8A7F863505C4714BEA50335003D1700"><enum>(3)</enum><text>to the maximum
			 extent possible, the Foundation should seek competitive grants to supplement
			 appropriations from the United States Government, and at least 20 percent of
			 the funding received in each fiscal year by the Foundation should be from
			 non-United States Government sources to ensure continued strong performance of
			 the Foundation.</text>
				</paragraph></subsection></section><section id="H4B02657B7F1E4CFA8503484F4024B013"><enum>4.</enum><header>Eligibility of
			 the Foundation for grants</header>
			<subsection id="H7C217C6C0C51408C8DEBBEA3C003D86"><enum>(a)</enum><header>Funding for
			 covered programs only</header><text>The Foundation may provide funding only for
			 programs that are consistent with the purposes set forth in section
			 2(b).</text>
			</subsection><subsection id="H6333EF6ADB9D4DD5BDF3A925F43EB59"><enum>(b)</enum><header>Compensation for
			 officers and employees of the foundation</header><text>If an individual who is
			 an officer or employee of the United States Government serves as a member of
			 the Board of Directors or as an officer or employee of the Foundation, that
			 individual may not receive any compensation or travel expenses in connection
			 with service performed for the Foundation.</text>
			</subsection><subsection id="H5EF871048C42477083FC98F713F4D07"><enum>(c)</enum><header>Prohibition
			 respecting financial matters</header><text>The Foundation shall not issue any
			 shares of stock or declare or pay any dividends. No part of the assets of the
			 Foundation shall inure to the benefit of any member of the Board of Directors
			 of the Foundation, any officer or employee of the Foundation, or any other
			 individual, except as salary or reasonable compensation for expenses incurred
			 in the performance of duties to the Foundation.</text>
			</subsection><subsection id="H5FE220A132874648A44B91D8250097B6"><enum>(d)</enum><header>Audit of
			 accounts; reporting requirements</header>
				<paragraph id="HB25EFE0BDADC410EACE3E19CDFAE78FA"><enum>(1)</enum><header>Audit of
			 accounts</header><text>The accounts of the Foundation shall be audited annually
			 in accordance with chapter 75 of title 31, United States Code.</text>
				</paragraph><paragraph id="HAAB5CEDD11C64E3E00A0002CB1C54F24"><enum>(2)</enum><header>Reporting
			 requirements</header><text>The report of each such independent audit shall be
			 included in the annual report required under subsection (g). The audit report
			 shall set forth the scope of the audit and include such statements as are
			 necessary to present fairly the Foundation’s assets and liabilities, surplus or
			 deficit, with an analysis of the changes therein during the year, supplemented
			 in reasonable detail by a statement of the Foundation’s income and expenses
			 during the year, and a statement of the application of funds, together with the
			 independent auditor’s opinion of those statements.</text>
				</paragraph></subsection><subsection id="H94FF4C4AB2A2400F886B2CCBDAD33B9"><enum>(e)</enum><header>Audit of
			 financial transactions</header>
				<paragraph id="HD2C31D4453B94037A0003F2C0000CD45"><enum>(1)</enum><header>Audit of
			 financial transactions</header><text>The Government Accountability Office may
			 audit the financial transactions of the Foundation for each fiscal year in
			 accordance with such principles, procedures, rules, and regulations as may be
			 prescribed by the Comptroller General of the United States.</text>
				</paragraph><paragraph id="H31AB417EF06E47A8957D53B71222D5B"><enum>(2)</enum><header>Reporting
			 requirements</header><text>The Comptroller General of the United States shall
			 simultaneously submit, to the President, the Foundation, and the appropriate
			 congressional committees, a report regarding each audit described in paragraph
			 (1) that contains—</text>
					<subparagraph id="id134FC6138F4B46B3AC7748BDC5EC754D"><enum>(A)</enum><text>any comments and
			 information as the Comptroller General determines to be necessary to inform the
			 appropriate congressional committees of the financial operations and condition
			 of the Foundation; and</text>
					</subparagraph><subparagraph id="idF02339077D124E948D8D10A31FA841F4"><enum>(B)</enum><text>any
			 recommendations that the Comptroller General considers advisable.</text>
					</subparagraph></paragraph></subsection><subsection id="H6466069D16DC4BF4936934A4978BD9A4"><enum>(f)</enum><header>Recordkeeping
			 requirements; audit and examination of books</header>
				<paragraph id="H6A41A4411308428CACD3FFC5EEF4E0FF"><enum>(1)</enum><header>Recordkeeping
			 requirements</header><text>The Foundation shall ensure that each recipient of
			 financial assistance provided through the Foundation under this Act maintains
			 such records as may be reasonably necessary to—</text>
					<subparagraph id="idAB91520AD7DF4213860E1CE4DD1FA7F0"><enum>(A)</enum><text>fully
			 disclose—</text>
						<clause id="id4DC1B7243BAC4D3C9F089609136E9A4E"><enum>(i)</enum><text>the
			 amount and the disposition by such recipient of the proceeds of such
			 assistance;</text>
						</clause><clause id="id9CECB8C825134FCBBD5A53C58377472C"><enum>(ii)</enum><text>the total cost
			 of the project or undertaking in connection with which such assistance is given
			 or used; and</text>
						</clause><clause id="idAD044FAFE89846F0B4CD9179EAF005E7"><enum>(iii)</enum><text>the amount and
			 nature of that portion of the cost of the project or undertaking supplied by
			 other sources; and</text>
						</clause></subparagraph><subparagraph id="idE7AB54B66A5F4368BFBDA992328DE31B"><enum>(B)</enum><text>facilitate an
			 effective audit.</text>
					</subparagraph></paragraph><paragraph id="HB351354192414B0484AA63473FCD5539"><enum>(2)</enum><header>Audit and
			 examination of books</header><text>The Foundation shall ensure that the
			 Foundation, any of its duly authorized representatives, the Comptroller General
			 of the United States, and any duly authorized representative of the Comptroller
			 General has access to any books, documents, papers, and records of the
			 recipient that are pertinent to assistance provided through the Foundation
			 under this Act for the purpose of audit and examination.</text>
				</paragraph></subsection><subsection id="HF63FFC07911841718B5E4C8DB8708288"><enum>(g)</enum><header>Annual report;
			 testimony relating to report</header>
				<paragraph id="HF61D0F0299484D25BD3F1273E9DD0161"><enum>(1)</enum><header>Annual
			 report</header>
					<subparagraph id="H54C2D087DDF64AF9889541E61B3E7B2E"><enum>(A)</enum><header>In
			 general</header><text>Not later than June 30 of each year, the Foundation shall
			 submit an annual report for the preceding fiscal year to the President and to
			 the appropriate congressional committees.</text>
					</subparagraph><subparagraph id="H48FB681DD76F4F96BA253D8F6346D0C5"><enum>(B)</enum><header>Contents</header><text>The
			 report submitted under subparagraph (A)—</text>
						<clause id="idC8E36809D5594161A28A0F279EA71B6F"><enum>(i)</enum><text>shall include a
			 comprehensive, detailed report of the Foundation’s operations, activities,
			 financial condition, and accomplishments under this Act;</text>
						</clause><clause id="id53C2CF63064A44DF8AB0563EA4EF4144"><enum>(ii)</enum><text>should include
			 any information regarding allegations or reports on the misuse of funds and how
			 such allegations or reports were addressed by the Foundation; and</text>
						</clause><clause id="id45FE5645F686424897D797908C46029E"><enum>(iii)</enum><text>may include
			 such recommendations as the Foundation determines to be appropriate.</text>
						</clause></subparagraph></paragraph><paragraph id="HBBCA4F72D54640A1B726EDE6DC8D1F6C"><enum>(2)</enum><header>Testimony
			 relating to report</header><text>The Board members and officers of the
			 Foundation shall be available to testify before appropriate committees of the
			 Congress with respect to—</text>
					<subparagraph id="idA3AFF97F1C5E44BEB9CFBC9012CC415F"><enum>(A)</enum><text>the report
			 required under paragraph (1);</text>
					</subparagraph><subparagraph id="id2947DAA21EFD4CFC80068406268B66E4"><enum>(B)</enum><text>the report of any
			 audit made by the Comptroller General of the United States pursuant to
			 subsection (e); or</text>
					</subparagraph><subparagraph id="id889DC204FB2545438A53AAF7B6F061AB"><enum>(C)</enum><text>any other matter
			 requested by any such committee.</text>
					</subparagraph></paragraph></subsection><subsection id="HF68F8A2ABA184819828F99623DF3CE22"><enum>(h)</enum><header>Grantee;
			 conflict of interest</header><text>A member of the Board of Directors of the
			 Foundation who serves as a member of the board of directors or an officer of a
			 grantee of the Foundation—</text>
				<paragraph id="id9A1DD004DD18405A98C9C31A78AF7799"><enum>(1)</enum><text>may not receive
			 compensation for services provided to the grantee; and</text>
				</paragraph><paragraph id="idD387984826CE4183986DF0DC29BFA8EB"><enum>(2)</enum><text>shall be entitled
			 to reimbursement for travel and other expenses incurred by the member in
			 connection with the member’s other duties on behalf of such grantee.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H18586A6E47604BFFA4FBA743D3A072CE"><enum>5.</enum><header>Agreement between
			 Foundation and successor or related entity to the U.S. Russia Investment
			 Fund</header>
			<subsection id="H9F06F40FD7EA484FBAC8BA61180C4E3"><enum>(a)</enum><header>Agreement
			 required</header><text display-inline="yes-display-inline">The Foundation and
			 any successor or related entity to the U.S. Russia Investment Fund shall enter
			 into a memorandum of understanding for the purpose of—</text>
				<paragraph id="idDDC8D4C0CEFE4D6FA0BB9AB5F5FC2C8C"><enum>(1)</enum><text display-inline="yes-display-inline">coordinating activities carried out by the
			 Foundation and the successor or related entity; and</text>
				</paragraph><paragraph id="id3DCD455AF7EB457E8361F42D8BCDD107"><enum>(2)</enum><text display-inline="yes-display-inline">ensuring that the activities of 1 entity do
			 not duplicate the activities of the other entity.</text>
				</paragraph></subsection><subsection id="H1991F3CB22B046B48B886E69004F0038"><enum>(b)</enum><header>Deadline</header><text>The
			 Foundation and the successor or related entity described in subsection (a)
			 shall enter into the memorandum of understanding described in subsection (a) by
			 not later than the later of—</text>
				<paragraph id="HE81033975D3D45019100CE1E6F6759B4"><enum>(1)</enum><text>90 days after the
			 date of the enactment of this Act, if the successor or related entity is
			 established on or before the date of the enactment of this Act; or</text>
				</paragraph><paragraph id="HBD6F5ADCC29C4B6DAC89A773E0CE7EE3"><enum>(2)</enum><text>90 days after the
			 date on which the successor or related entity is established, if such entity is
			 established after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="H13483D0AF7074AD5A110886254761CFB"><enum>(c)</enum><header>Submission to
			 Secretary of State and Congress</header><text display-inline="yes-display-inline">Not later than 30 days after the date on
			 which the parties enter into the memorandum of understanding described in
			 subsection (a), the Foundation and the successor or related entity described in
			 subsection (a) shall submit a copy of the memorandum of understanding described
			 in subsection (a) to the Secretary of State and to the appropriate
			 congressional committees.</text>
			</subsection><subsection id="H3B90CFD2C07F4F70A299C8689B6F2FFA"><enum>(d)</enum><header>Successor or
			 related entity to the U.S. Russia Investment Fund defined</header><text>In this
			 section, the terms <term>successor or related entity to the U.S. Russia
			 Investment Fund</term> and <term>successor or related entity</term> mean any
			 organization, corporation, limited-liability partnership, foundation, or other
			 corporate structure that receives any or all of the remaining funds of the U.S.
			 Russia Investment Fund after the liquidation of assets upon closure of the U.S.
			 Russia Investment Fund. </text>
			</subsection></section><section id="H85D5B46188AC4271945D033BD99E75A1"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id0C2C524708AA45DEA8F77E0C8D0DB334"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
				<subparagraph id="id96EDCBBD29174878AD9C3FC1283DB1C4"><enum>(A)</enum><text>the
			 <committee-name committee-id="SSFR00">Committee on Foreign Relations of the
			 Senate</committee-name>; and</text>
				</subparagraph><subparagraph id="idE033232462E44C6EB6071A0163CC2BA3"><enum>(B)</enum><text>the
			 <committee-name committee-id="">Committee on Foreign Affairs of the House of
			 Representatives</committee-name>.</text>
				</subparagraph></paragraph><paragraph id="idCA7F2763D8934E088BFBE6858B1FD1DE"><enum>(2)</enum><header>Countries of
			 eurasia</header><text display-inline="yes-display-inline">The term
			 <term>countries of Eurasia</term> means Armenia, Azerbaijan, Be­la­rus,
			 Georgia, Kazakhstan, the Kyrgyz Republic, Mol­do­va, the Russian Federation,
			 Tajikistan, Turk­men­i­stan, Ukraine, and Uzbekistan.</text>
			</paragraph></section><section id="H375B15A9A56844E8006ED868B3E500D6"><enum>7.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H1CD9326B42464004A1CE587E31B1199"><enum>(a)</enum><header>In
			 general</header><text>There are authorized to be appropriated to carry out this
			 Act—</text>
				<paragraph id="idAFB95E68156647CE85C72674C5C384B1"><enum>(1)</enum><text>$15,000,000 for
			 fiscal year 2009; and</text>
				</paragraph><paragraph id="id9CECD58B53F34BE9825B2495C86E58D9"><enum>(2)</enum><text>such sums as may
			 be necessary for fiscal year 2010.</text>
				</paragraph></subsection><subsection id="HF07C0245520E4C3A80861943784F17C1"><enum>(b)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts appropriated pursuant to the
			 authorization of appropriation under subsection (a) are authorized to remain
			 available until the date that is 2 years after the last day of the fiscal year
			 for which the amount was appropriated.</text>
