			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Oil Shale and Tar Sands Leasing
			 Act of 2008</short-title></quote>.</text>
		</section><section id="H84070696669142FEBD5000ABCBE6BC2E"><enum>2.</enum><header>Oil shale and tar
			 sands leasing</header><text display-inline="no-display-inline">Section 369 of
			 the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15927">42 U.S.C. 15927</external-xref>) is
			 amended—</text>
			<paragraph id="HE89CBE6FE9D24CB7A1225E50A1701800"><enum>(1)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="id7BC1BBE64F7B4B669C9C3674BE8B98DE"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="idC080C775C04D49CCBB75D9080935C79B"><enum>(i)</enum><text>by
			 striking <quote>Not later than 18 months after the date of enactment of this
			 Act, in</quote> and inserting the following:</text>

				Secretary.</text>

				commercial leasing program</header>
						<paragraph id="IDe57d3c78cc5842b09e6c3940fd670b58"><enum>(1)</enum><header>In
				general</header><text>Not later than 18 months after the date of enactment of
				the <short-title>Oil Shale and Tar Sands Leasing Act of
				2008</short-title>, and concurrent with the development of the proposed
				regulations as required by this section, the Secretary shall, in cooperation
				with the Secretary of Energy and the Administrator of the Environmental
				Protection Agency, prepare and submit to Congress a report (including
				recommendations) that analyzes the elements of a commercial leasing program for
				oil shale and tar sands, taking into account any findings from the research and
				development program conducted under subsection (c).</text>
						</paragraph><paragraph id="ID95aaab5511c34bf58839050c55ff987d"><enum>(2)</enum><header>Inclusions</header><text>The
				report under paragraph (1) shall include—</text>
							<subparagraph id="IDde4b377f4c6b42629db22d3355fdd7bb"><enum>(A)</enum><text>an analysis
				of—</text>
								<clause id="idF6107B15761C40C28827B19D0DA0C150"><enum>(i)</enum><text>technologies and
				research and development programs for the production of oil and other materials
				from oil shale and tar sands in existence on the date on which the report is
				prepared;</text>
								</clause><clause id="ID57ad7b6800ab4795b2b930591b12b7fc"><enum>(ii)</enum><text>whether leases
				under the program should be issued on a competitive basis;</text>
								</clause><clause id="ID0ec72523af12499bbf5843891f93bb1e"><enum>(iii)</enum><text>the term of the
				leases;</text>
								</clause><clause id="IDab66e53798b345e2932ad34b0ef3cf74"><enum>(iv)</enum><text>the maximum size
				of the leases;</text>
								</clause><clause id="idB2FE8F367A1C48438D9C2F1F169C78B1"><enum>(v)</enum><text>the minimum size
				of the leases;</text>
								</clause><clause id="ID50655141929f40cebe0df2a6138acb8c"><enum>(vi)</enum><text>the use and
				distribution of bonus bid payments;</text>
								</clause><clause id="ID7569d31553074495afa4d22c9dafe736"><enum>(vii)</enum><text>the royalty
				rate to be applied, including whether a sliding scale royalty rate should be
				used;</text>
								</clause><clause id="ID4fb9264d19d848eaa87f665151a650dd"><enum>(viii)</enum><text>the maximum
				number of leases and maximum acreage to be leased under the leasing program to
				a single lessee or an individual;</text>
								</clause><clause id="ID78afd5f571a14ca7b8356f4ec4e01630"><enum>(ix)</enum><text>any
				infrastructure required to support oil shale and tar sands development in
				industry and communities;</text>
								</clause><clause id="ID12bbf1ff03694d98a91697a4e46edfa8"><enum>(x)</enum><text>any conditions
				that should be imposed in leases to minimize the impacts on—</text>
									<subclause id="id1FC969BA41644B5A94537F134FB5BD78"><enum>(I)</enum><text>air quality and
				conditions, including greenhouse gas emissions;</text>
									</subclause><subclause id="idC7D5C21EFD33490F897588A6F2076B99"><enum>(II)</enum><text>water quality
				and quantity;</text>
									</subclause><subclause id="idCD5F8A756AFD46299A03CA00152DBCEE"><enum>(III)</enum><text>human
				health;</text>
									</subclause><subclause id="id167F20AB7708480B9F6751B8ABDC2839"><enum>(IV)</enum><text>local
				communities; and</text>
									</subclause><subclause id="idD5ECEC7AE8994CF4A4DF1F162BF7ED43"><enum>(V)</enum><text>wildlife
				habitat;</text>
									</subclause></clause><clause id="ID5b0980a2f714473292a1c85508de25cc"><enum>(xi)</enum><text>policies that
				are necessary to mitigate the adverse impacts of commercial oil shale and tar
				sands exploration, development, and production activities on wildlife and other
				environmental resources that may be affected by a commercial oil shale and tar
				sands leasing and development program;</text>
								</clause><clause id="ID99362de5cf564a8da4fa797337c87728"><enum>(xii)</enum><text>reclamation
				bonding requirements that should be imposed to guarantee the reclamation of
				areas disturbed by oil shale and tar sands exploration, development, and
				production activities; and</text>
								</clause><clause id="IDeb7b727a14824e098cba952116a7e6e1"><enum>(xiii)</enum><text>appropriate
				diligent development and minimum production requirements;</text>
								</clause></subparagraph><subparagraph id="ID7d2aa17c7b1842a89cd904944d67d374"><enum>(B)</enum><text>an identification
				of events that should serve as a precursor to commercial leasing,
				including—</text>
								<clause id="idB082947D0EE445F392BAFB5BE59C7FEA"><enum>(i)</enum><text>the development
				of environmentally and commercially viable technologies; and</text>
								</clause><clause id="id4B2D3B7C6C6D4D7A840115775C14C9EC"><enum>(ii)</enum><text>the completion
				of land use planning and environmental reviews; and</text>
								</clause></subparagraph><subparagraph id="ID16fd3abdaa504c30ad146b8ea1ecc22c"><enum>(C)</enum><text>an analysis,
				developed in conjunction with the appropriate State water resources agencies,
				of the demand for, and availability of, water with respect to the development
				of oil shale and tar sands, including the best available estimates of the
				impacts of population growth and climate change on availability and timing of
				freshwater throughout the Colorado River Basin.</text>
							</subparagraph></paragraph><paragraph id="ID81078d1ec28548c6826359c99058a423"><enum>(3)</enum><header>Public
				participation</header><text>In preparing the report under this subsection, the
				Secretary shall provide notice to, and solicit comment from—</text>
							<subparagraph id="ID8763d3e806494b6abcc400f7a1dcebd4"><enum>(A)</enum><text>the
				public;</text>
							</subparagraph><subparagraph id="ID5ef1a28b2bb3477ebe9ac27fdd93eaac"><enum>(B)</enum><text>representatives
				of local government;</text>
							</subparagraph><subparagraph id="ID8c15316c49ea47f1bd9a380f56c4ff81"><enum>(C)</enum><text>representatives
				of industry; and</text>
							</subparagraph><subparagraph id="ID0470b45e14a34aed814ba0f48aa4daf2"><enum>(D)</enum><text>other interested
				parties.</text>
							</subparagraph></paragraph><paragraph id="ID5a0c4c557bdb450798495c7515235dc7"><enum>(4)</enum><header>Participation
				by certain States</header><text>In preparing the report under this subsection,
				the Secretary shall—</text>
							<subparagraph id="ID7e74f9d34e4345a882a9982f33975e98"><enum>(A)</enum><text>provide timely
				notice to, and solicit comment from, the Governors of each of the States of
				Colorado, Utah, and Wyoming;</text>
							</subparagraph><subparagraph id="ID157a0cbb04604d40abd126c66f565327"><enum>(B)</enum><text>allow each of the
				Governors of Colorado, Utah, and Wyoming a period of not less than 90 days to
				provide comments on the report; and</text>
							</subparagraph><subparagraph id="ID4ae09b17945247c997492495bff0155e"><enum>(C)</enum><text>incorporate into
				the report submitted to Congress under paragraph (1) any response of the
				Secretary to those comments.</text>
							</subparagraph></paragraph><paragraph id="ID36d7cfc7412d4f51b72f15015e98dbd5"><enum>(5)</enum><header>Incorporation
				of findings by NAS</header><text>In preparing the report required by paragraph
				(1), the Secretary shall refer to and use information and recommendations made
				by the National Academy of Sciences in the report described in subsection
				(f).</text>
						</paragraph></subsection><subsection id="HCEFCA608D80C4396009BAAF65FEC07E6"><enum>(f)</enum><header>National Academy
				of Sciences report and recommendations</header>
						<paragraph id="H5573623C192F44008DB5A57B74009174"><enum>(1)</enum><header>In
				general</header><text>Not later than 90 days after the date of enactment of the
				<short-title>Oil Shale and Tar Sands Leasing Act of
				2008</short-title>, the Secretary of the Interior, in consultation with the
				Secretary of Energy and the Administrator of the Environmental Protection
				Agency, shall enter into an arrangement with the National Academy of Sciences
				under which the Academy shall conduct a study to assess the environmental and
				commercial framework for oil shale and tar sands development in the United
				States.</text>
						</paragraph><paragraph id="H552E820164EC4B5D97EE36AF61B3E32D"><enum>(2)</enum><header>Matters to be
				addressed</header><text>The study shall address—</text>
							<subparagraph id="id478C0613B908490E9875E275967869E8"><enum>(A)</enum><text>the importance of
				oil shale and tar sands production to meet the energy needs of the United
				States;</text>
							</subparagraph><subparagraph id="idC11EAB832D6F402ABD2C199CB93E0B1B"><enum>(B)</enum><text>the status of oil
				shale and tar sands research and development efforts;</text>
							</subparagraph><subparagraph id="ID5724fb1e11984232a7422da4fe4eb1ad"><enum>(C)</enum><text>the likely
				positive and negative implications of the various technologies for the
				commercial production of oil from oil shale and tar sands resources, including
				the cumulative effects of other energy infrastructure necessary for such
				production, on—</text>
								<clause id="IDd43f821b6f934d6d8e39c3a827398b89"><enum>(i)</enum><text>water resources
				(including surface water and groundwater), including the quantity and quality
				of water;</text>
								</clause><clause id="IDd03c280d7bec4ea3a29cc6328e7e83cd"><enum>(ii)</enum><text>air quality,
				including greenhouse gas emissions;</text>
								</clause><clause id="IDb85afc2e952e4e54998677164d3df427"><enum>(iii)</enum><text>human
				health;</text>
								</clause><clause id="ID5d199a068a6644e7b4eab562c975f785"><enum>(iv)</enum><text>local
				communities;</text>
								</clause><clause id="ID0e093c8f3baa4b3092fd977882ab9572"><enum>(v)</enum><text>wildlife habitat;
				and</text>
								</clause><clause id="ID39e27027060f4e43a9701e4fed49777f"><enum>(vi)</enum><text>regional energy
				needs;</text>
								</clause></subparagraph><subparagraph id="IDd812e57869b54066ad095fa916bd6117"><enum>(D)</enum><text>the timeframe for
				viable large-scale commercial oil shale and tar sands production and events
				that should serve as a precursor to commercial leasing, such as development of
				commercially viable and environmentally safe technologies;</text>
							</subparagraph><subparagraph id="ID48d45ebbd2af423984d00f8ca0d01a93"><enum>(E)</enum><text>the feasibility
				and advisability of initiating a pilot program for commercial leasing;</text>
							</subparagraph><subparagraph id="IDf8aaeb98031d4275aef714aceb0d33e8"><enum>(F)</enum><text>energy sources
				needed for extraction technologies and the resulting energy balance and
				associated costs;</text>
							</subparagraph><subparagraph id="IDdc095c30d9444983997ee0b82fecb7f0"><enum>(G)</enum><text>potential
				greenhouse gas emissions for each technology and sequestration
				opportunities;</text>
							</subparagraph><subparagraph id="IDa10657f0a6274eaa96468d3644002371"><enum>(H)</enum><text>potential social
				and environmental impacts of commercial oil shale and tar sands production,
				including groundwater and surface water usage;</text>
							</subparagraph><subparagraph id="ID9fe000201caa465e94759a4fff2ae62f"><enum>(I)</enum><text>workforce
				capacity requirements associated with large-scale commercial development;
				and</text>
							</subparagraph><subparagraph id="IDd8faee339971441abb2092c07101592a"><enum>(J)</enum><text>appropriate terms
				and conditions for commercial oil shale leases on public land, including
				royalty rates, diligent development requirements, environmental conditions, and
				length of the lease term.</text>
							</subparagraph></paragraph><paragraph id="H575AF13065744C7695AB5128EF9062B6"><enum>(3)</enum><header>Recommendations</header><text>The
				study shall—</text>
							<subparagraph id="idB4662ED019AF42DEB2F7DA167FBF757A"><enum>(A)</enum><text>analyze the
				viability of, and timeframe for, environmentally safe commercial oil shale and
				tar sands development; and</text>
							</subparagraph><subparagraph id="idCA72A19828EA48CAA6BC863337949BF4"><enum>(B)</enum><text>make
				recommendations as to changes, if any, to Federal law (including regulations)
				needed to facilitate the commercial production of oil shale and tar sands
				resources in a manner that minimizes adverse social and environmental impacts
				and ensures a fair return to the public.</text>
							</subparagraph></paragraph><paragraph id="IDe98ae91f7c8641c692b30a1e999320d0"><enum>(4)</enum><header>Completion of
				study</header><text>The National Academy of Sciences shall—</text>
							<subparagraph id="ID62ffd9fbd16e4ac99d34ab2603dd5728"><enum>(A)</enum><text>not later than 18
				months after the date of enactment of the <short-title>Oil
				Shale and Tar Sands Leasing Act of 2008</short-title>, submit the findings and
				recommendations of the study to the Secretary of the Interior, the Secretary of
				Energy, and the Administrator of the Environmental Protection Agency;
				and</text>
							</subparagraph><subparagraph id="IDc2ed5a65027842fea0f4a3b7e276ace3"><enum>(B)</enum><text>on completion of
				the study, make the results of the study available to the public.</text>
							</subparagraph></paragraph><paragraph id="ID0044b6a700fb4b418d8073382ed582ca"><enum>(5)</enum><header>Report to
				Congress</header><text>Not later than 180 days after receiving the results of
				the study, the Secretary of the Interior, in consultation with the Secretary of
				Energy and the Administrator of the Environmental Protection Agency, shall
				report to Congress on—</text>
							<subparagraph id="IDc786b1c1d0b94e64a7c2a2f8175cea1b"><enum>(A)</enum><text>the findings and
				recommendations of the study;</text>
							</subparagraph><subparagraph id="IDd3963b57f9cf47fc9b46024e1d953ed0"><enum>(B)</enum><text>the agreement or
				disagreement of the Secretary with each of the findings and recommendations of
				the study; and</text>
							</subparagraph><subparagraph id="IDda808d77b628470f99c619b2ca94bd31"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idB5085429E06B4DB4A9B3AD2E540B61BF"><enum>(i)</enum><text>a plan and timeframe
				for implementing the recommendations of the study through regulations or
				otherwise; or</text>
								</clause><clause id="idCDAF9613551B47F5AF629950E8764860" indent="up1"><enum>(ii)</enum><text>if the Secretary declines to
				implement a recommendation, the justification for declining to implement the
				recommendation.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H9B5BCCABAD924DD0A41114696860C152"><enum>(4)</enum><text>in subsection (g)
			 (as redesignated by paragraph (2))—</text>
				<subparagraph id="idCC6E59E4FDE24416B39ABD1437E216DE"><enum>(A)</enum><text>by striking

			 sentence, by striking <quote>If the Secretary finds sufficient support and
			 interest exists in a State,</quote> and inserting the following:</text>

				sands and oil shale resources is commercially and technically

				</subparagraph><subparagraph id="id58EDDE5DF3DD4F6DB1CC6F3633EE9446"><enum>(D)</enum><text>in the third
			 sentence, by striking <quote>Evidence of</quote> and inserting the
			 following:</text>

						<paragraph id="IDc913aec64a684eef93e78a526397d30d"><enum>(4)</enum><header>Recommendations
				of States on proposed lease sales and development and production plans</header>
							<subparagraph id="idB0D6713942EC41B08886DCD6EF21482B"><enum>(A)</enum><header>In
				general</header><text>Any Governor of an affected State or the executive of any
				affected local government in the State may submit recommendations to the
				Secretary regarding the size, timing, or location of a proposed lease sale or
				with respect to a proposed development and production plan.</text>
							</subparagraph><subparagraph id="id2C3090D4BCB34BFA929257752D549DF9"><enum>(B)</enum><header>Forwarding
				local recommendations to Governor</header><text>Prior to submitting
				recommendations to the Secretary, the executive of any affected local
				government in any affected State shall forward the recommendations of the
				executive to the Governor of the State.</text>
							</subparagraph><subparagraph id="id62778E5FFE694435843DDCA9F1C9D9BD"><enum>(C)</enum><header>Deadline</header><text>The
				recommendations shall be submitted not later than 60 days after the date of
				notice of the proposed lease sale or the date of receipt of the development and
				production plan.</text>
							</subparagraph><subparagraph id="id7440D9C67D304070BC69122533B90049"><enum>(D)</enum><header>Approval</header><text>The
				Secretary shall accept the recommendations of the Governor, and may accept the
				recommendations of the executive of any affected local government, if the
				Secretary determines, after having provided an opportunity for consultation,
				that the recommendations provide for a reasonable balance between the national
				interest and the well-being of the citizens of the affected State.</text>
							</subparagraph><subparagraph id="id82F0E04349324FACB143355C91AC4B10"><enum>(E)</enum><header>Rationale</header><text>The
				Secretary shall communicate to the Governor, in writing, the reasons for the
				determination of the Governor—</text>
								<clause id="idA7F64BA12EF841FDBE6E60E71B13A1AB"><enum>(i)</enum><text>to accept or
				reject the recommendations of the Governor; or</text>
								</clause><clause id="idD75CD74D8F5C4A38AC32330FAF55870F"><enum>(ii)</enum><text>to implement any
				alternative means, identified in consultation with the Governor, to provide for
				a reasonable balance between the national interest and the well-being of the
				citizens of the affected State.</text>
								</clause></subparagraph></paragraph><paragraph id="id80BAB72D4A8A4B5FB4B4C9F6233C275A"><enum>(5)</enum><header>Environmental
				compliance</header><text>An environmental impact statement or similar analysis
				required under the <act-name parsable-cite="NEPA69">National Environmental
				Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.) shall be
				required—</text>
							<subparagraph id="id5954ED043F9D4C548FF232D1CE1BBC10"><enum>(A)</enum><text>prior to any
				lease sale with respect to the land proposed to be leased under the commercial
				leasing program established under this subsection; and</text>
							</subparagraph><subparagraph id="id9F6CA874A99C46859A4E637305F5A225"><enum>(B)</enum><text>on a
				site-specific basis prior to the authorization of any development activity on
				any leased land.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H72AEFBE4A99C4C728D445BA618429D56"><enum>(5)</enum><text>in subsection
