		<official-title>To amend title 38, United States Code, to include
		  federally recognized tribal organizations in certain grant programs of the
		  Department of Veterans Affairs for the several States and territories, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Native American Veterans Access
			 Act of 2008</short-title></quote>.</text>
		</section><section id="id47CFF3769B3F48E6B783A30C353876E4"><enum>2.</enum><header>Inclusion of
			 Federally recognized tribal organizations in certain grant programs of the
			 Department of Veterans Affairs for the States and territories</header>
			<subsection id="id003FDFE164C54F2DA0A1CEF73CEDECD5"><enum>(a)</enum><header>Treatment of
			 tribal organization health facilities as State homes</header><text>Section 8138
			 of title 38, United States Code, is amended—</text>
				<paragraph id="id29C1C7C0C4594BD28F58F3A54AA06B15"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
				</paragraph><paragraph id="idAB887F95A5F74524AB84597C1A96253B"><enum>(2)</enum><text>by inserting
			 after subsection (d) the following new subsection (e):</text>
					<quoted-block display-inline="no-display-inline" id="id94D73CAD9D404058994A9F3234C7354D" style="OLC">
						<subsection id="idFF80D3DA80C64F809B3433AE302F520C"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id6722CB29F6A14CA590D7DEDC56728570"><enum>(1)</enum><text>A health facility (or
				certain beds in a health facility) of a tribal organization is treatable as a
				State home under subsection (a) in accordance with the provisions of that
				subsection.</text>
							</paragraph><paragraph id="id897F5A1A8A724E68AB46416F63477212" indent="up1"><enum>(2)</enum><text>Except as provided in paragraph (3),
				the provisions of this section shall apply to a health facility (or certain
				beds in such facility) treated as a State home under subsection (a) by reason
				of this subsection to the same extent as health facilities (or beds) treated as
				a State home under subsection (a).</text>
							</paragraph><paragraph id="id9CAE966EF35F44599723ED30C50A5437" indent="up1"><enum>(3)</enum><text>Subsection (f) shall not apply to the
				treatment of health facilities (or certain beds in such facilities) of tribal
				organizations as a State home under subsection (a).</text>
							</paragraph><paragraph id="idB9457FFC333840238BF93E3F1C363A26" indent="up1"><enum>(4)</enum><text>In this subsection, the term
				<term>tribal organization</term> has the meaning given such term in section
				3764(4) of this
				title.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idF48AAC95461146BFA3AC0BEB8303B6AA"><enum>(b)</enum><header>State home
			 facilities for domiciliary, nursing, and other care</header>
				<paragraph id="id6B0C66A9E97E40A2A13146EEEE6E9D8A"><enum>(1)</enum><header>In
			 general</header><text>Chapter 81 of such title is further amended—</text>
					<subparagraph id="idE8F51CC4CC4B43BE9B4850B149B2EBF8"><enum>(A)</enum><text>in section 8131,
			 by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="idDE0C12D57C9E42C49C8F4ABA9BAA27CB" style="OLC">
							<paragraph id="id0CA051D7B7F34119958665F0C1E16201"><enum>(5)</enum><text>The term
				<term>tribal organization</term> has the meaning given such term in section
				3764(4) of this
				title.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id22E03C45181B458FB4BF1EF8A45A558B"><enum>(B)</enum><text>in section 8132,
			 by inserting <quote>and tribal organizations</quote> after <quote>the several
			 States</quote>; and</text>
					</subparagraph><subparagraph id="idE05C9FFF814F42419A666E0D4E969F97"><enum>(C)</enum><text>by inserting
			 after section 8133 the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="idC9F40989917B48758D9A2A9B76A5CFF4" style="USC">
							<section id="idD58FA2111A0045C39AADE79B47604F72"><enum>8133A.</enum><header>Tribal
				organizations</header>
								<subsection id="id22BCD3165BA642C7A6FB82DB15BC9649"><enum>(a)</enum><text>The Secretary may
				make grants to tribal organizations under this subchapter in order to carry out
				the purposes of this subchapter.</text>
								</subsection><subsection id="idBD85C5F869C0422CACB4571A158ECBDF"><enum>(b)</enum><text>Grants to tribal
				organizations under this section shall be made in the same manner, and under
				the same conditions, as grants made to the several States under the provisions
				of this subchapter, subject to such exceptions as the Secretary shall prescribe
				for purposes of this subchapter to take into account the unique circumstances
				of tribal
				organizations.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idC77EABD29A9249F8911CB29DDCC28804"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 81 of
			 such title is amended by inserting after the item relating to section 8133 the
			 following new item:</text>

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idEBD25669486D459C8302E7C830094A49"><enum>(c)</enum><header>Job counseling,
			 training, and placement services for veterans</header><text>Section 4101 of
			 such title is amended—</text>
				<paragraph id="idAFF1E65656D14F3B9E93787DA89D092F"><enum>(1)</enum><text>in paragraph (6),
			 by inserting <quote>tribal organizations,</quote> after <quote>to the extent
			 determined necessary and feasible,</quote>; and</text>
				</paragraph><paragraph id="id7E3EB1BC10F642B388E412F379B111AA"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
