		<official-title>To amend the Federal Water Pollution Control Act to
		  provide for the remediation of sediment contamination in areas of

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Great Lakes Legacy Act of
			 2008</short-title></quote>.</text>
		</section><section id="idB5ED5CED98E749AD9B4512B850837A28"><enum>2.</enum><header>Remediation of
			 sediment contamination in areas of concern</header><text display-inline="no-display-inline">Section 118(c)(12) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1268(c)(12)) is amended—</text>
			<paragraph id="id5B0ECAAE3D474EE1AA28FA5904E7531F"><enum>(1)</enum><text>in subparagraph
			 (B)—</text>
				<subparagraph id="idE3CFCE697BC848AA8B935C5C82909107"><enum>(A)</enum><text>by redesignating
			 clauses (i), (ii), and (iii) as clauses (v), (i), and (ii), respectively, and
			 moving the clauses so as to appear in numerical order;</text>
				</subparagraph><subparagraph id="id23208A0487C0424AB858D59DCA78357A"><enum>(B)</enum><text>in clause (i) (as
			 redesignated by subparagraph (A)), by striking <quote>or</quote> at the end;
			 and</text>
				</subparagraph><subparagraph id="id0D50856A8A3F43BD9D02F3E8AF11FFA8"><enum>(C)</enum><text>by inserting
			 after clause (ii) (as redesignated by subparagraph (A)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id750D318C9E974158934ECA943FB22CD6" style="OLC">
						<clause id="id4E143A0611AD471A9E6A439709BBC156"><enum>(iii)</enum><text>is a
				demonstration or pilot project that uses innovative approaches, technologies,
				or techniques for the remediation of sediment contamination;</text>
						</clause><clause id="id7FD46CA6519744E0A2909F681051C5DC"><enum>(iv)</enum><text>restores aquatic
				habitat after remediation;
				or</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id4ED1FD2B4B10402A982F515EECB0A4E9"><enum>(2)</enum><text>by striking
			 subparagraph (C) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFDAFBBB9D7C24D6CB81358DBB81D07FD" style="OLC">
					<subparagraph id="idBC33547DE61E487A96AB557A56FEEB78"><enum>(C)</enum><header>Priority</header>
						<clause id="id8AE56D02CE6045F7A68E5B094925C38F"><enum>(i)</enum><header>In
				general</header><text>In selecting projects to carry out under this paragraph,
				the Administrator shall give priority to a project that—</text>
							<subclause id="id2F6A5F29C0E7484CB94FB469D9B2DBFE"><enum>(I)</enum><text>constitutes
				remedial action for contaminated sediment;</text>
							</subclause><subclause id="id2A3535D8799E44778FE0EFBCA39594FC"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id39FFAFCEAAB14FEE81A2273D3F831442"><enum>(aa)</enum><text>has been identified in
				a remedial action plan submitted under paragraph (3); and</text>
								</item><item id="idB5EA2C95A6984FFEBEDA3734559973DC" indent="up1"><enum>(bb)</enum><text>is ready to be implemented;</text>
								</item></subclause><subclause id="idDF4BBF8316624EE09BD44A1D2117F9ED"><enum>(III)</enum><text>will use an
				innovative approach, technology, or technique that may provide greater
				environmental benefits, or equivalent environmental benefits at a reduced cost;
				or</text>
							</subclause><subclause id="id6C1BF5A0A2DD4578B72DB3FA710A17F7"><enum>(IV)</enum><text>includes
				remediation to be commenced not later than 1 year after the date of receipt of
				funds for the project.</text>
							</subclause></clause><clause id="idDC3E4CC8707C418ABA3F52489CCB41DF"><enum>(ii)</enum><header>Environmental
				significance</header><text>Notwithstanding any regulation promulgated or
				guidance issued to implement this section, the Administrator may provide
				additional consideration to a project that is—</text>
							<subclause id="idA6A476259EAD4E218DE91C9A431441C9"><enum>(I)</enum><text>funded by a
				potentially responsible party; and</text>
							</subclause><subclause id="idA66F6C21AFEE498BAF7E0255C4DE7ED0"><enum>(II)</enum><text>determined to be
				of greater environmental significance than a competing
				proposal.</text>
							</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idE47E2F3D43BA402AA57C49EDE1401B05"><enum>(3)</enum><text>in subparagraph
			 (E)—</text>
				<subparagraph id="id818B8C0C5FAA49A6A5C6604BD6EF86EB"><enum>(A)</enum><text>in clause
			 (iii)—</text>
					<clause id="idD6D93B5F887147F098C30CE6942393C5"><enum>(i)</enum><text>in
			 subclause (I)—</text>
						<subclause id="idD4F4ADAA85444AE29F5BA86BB9734F1B"><enum>(I)</enum><text>by inserting
			 <quote>(including any in-kind services or funds provided in implementing the
			 administrative order on consent or judicial consent decree)</quote> after
			 <quote>judicial consent decree</quote>; and</text>
						</subclause><subclause id="idDC31EB2818D64705BC1A1A346E23E1B4"><enum>(II)</enum><text>by striking
			 <quote>but</quote> at the end;</text>
						</subclause></clause><clause id="id33D42EF712AE4B34BFECFD12477304E0"><enum>(ii)</enum><text>by
			 redesignating subclause (II) as subclause (III); and</text>
					</clause><clause id="idDB239D7B35884B4583272A01D3F34E2D"><enum>(iii)</enum><text>by inserting
			 after subclause (I) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id19E6160CAA9F4EAA96705011CF32D9C2" style="OLC">
							<subclause id="ID3de2da574d18495aa77586b240c5e400"><enum>(II)</enum><text>may include
				funds paid, or the value of any in-kind service performed, by a potentially
				responsible party, subject to the condition that the eligibility of the
				potentially responsible party to contribute to the non-Federal share is
				evaluated on the merits on a site-specific basis, in the context of added
				value, such as at sites at which an orphan share exists or the remedy will be
				enhanced (such as where the qualitative or quantitative scope of the
				remediation is improved, innovative methods are employed, or the remediation
				will be accelerated); but</text>
							</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="id4EA83519194649F0A2C1B9254A704611"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA587D0F029BA49E4ABC55E5C4D1A205A" style="OLC">
						<clause id="idB0A0F8F2489147659CD6550D72DEDC26"><enum>(v)</enum><header>Payment and
				retention of non-Federal share</header><text>The non-Federal sponsor for a
				project under this paragraph may pay to the Administrator, for retention and
				use by the Administrator in carrying out the project, the non-Federal share of
				the cost of the
				project.</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idBCA8DE80CAE54FECA21C4E5EE536CFE9"><enum>(4)</enum><text>by striking
			 subparagraph (F);</text>
			</paragraph><paragraph id="idBEAC7B7AA71E4877A852F6CDAA1FF864"><enum>(5)</enum><text>by redesignating
			 subparagraph (G) as subparagraph (F);</text>
			</paragraph><paragraph id="id0E32E99C7AA84A72BE3648BFEC3476A0"><enum>(6)</enum><text>by redesignating
			 subparagraph (H) as subparagraph (I);</text>
			</paragraph><paragraph id="id3FBF318FAE114D8EA9D90713BF297CD0"><enum>(7)</enum><text>by inserting
			 after subparagraph (F) (as redesignated by paragraph (5)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDA240DA409424826986CC8EF63F14636" style="OLC">
					<subparagraph id="idB69E5DA093D946468D382DC2EDE5D608"><enum>(G)</enum><header>Advance payment
				and reimbursement costs</header><text>The Administrator, acting through the
				Program Office, may enter into an agreement with a non-Federal sponsor to carry
				out a project under this paragraph under which the non-Federal sponsor may, as
				appropriate—</text>
						<clause id="idEAE352969CBB4276A9A2B092AE4CB0C3"><enum>(i)</enum><text>pay in advance
				the non-Federal share of the cost of the project; and</text>
						</clause><clause id="idF5461298D9AE4BFC97405403E5B4F054"><enum>(ii)</enum><text>receive from the
				Administrator reimbursement for amounts (other than the non-Federal share)
				expended by the non-Federal sponsor for the project.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB670B16DCA25476991D4ACF7443EC436"><enum>(H)</enum><header display-inline="yes-display-inline">Definition of potentially responsible
				party</header><text display-inline="yes-display-inline">In this paragraph, the
				term <term>potentially responsible party</term> means an individual or entity
				that may be liable under any Federal or State environmental remediation law
				(including regulations) with respect to a project carried out under this
				paragraph.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id9340834D0F8E4CD7A85F2FA5D240C6E5"><enum>(8)</enum><text>in subparagraph
			 (I) (as redesignated by paragraph (6)), by striking <quote>$50,000,000 for each
			 of fiscal years 2004 through 2008</quote> and inserting <quote>$150,000,000 for
			 each of fiscal years 2009 through 2013</quote>.</text>
			</paragraph></section><section id="id5521ECAFA05845759E7D09D75A23A847"><enum>3.</enum><header>Public
			 information program</header><text display-inline="no-display-inline">Section
			 118(c)(13) of the Federal Water Pollution Control Act (33 U.S.C. 1268(c)(13))
			 is amended—</text>
			<paragraph id="idA4A9309B9A4A4D60A413DB617CB2E504"><enum>(1)</enum><text>in the paragraph
			 heading, by inserting <quote><header-in-text level="paragraph" style="OLC">and
			 participation</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">information</header-in-text></quote>;</text>
			</paragraph><paragraph id="idA568070F4FD845DDA5ED6F4FE38AAD0E"><enum>(2)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3A65B5D47AF3440395D24F3E374D8644" style="OLC">
					<subparagraph id="id9F65DFA112D34507B484C52BCDECEA8C"><enum>(A)</enum><header>In
				general</header><text>The Administrator, acting through the Program Office and
				in coordination with States, Indian tribes, local governments, and other
				entities, shall carry out a public information and participation program,
				including by providing grants to States, Indian tribes, corporations,
				nongovernmental organizations, and other appropriate entities, for the
				provision to the public of information and outreach activities relating to the
				remediation of contaminated sediment in areas of concern that are located
				wholly or partially in the United
				States.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id84A7338AF6ED426AA79C53FA7FE1CFE1"><enum>(3)</enum><text>in subparagraph
			 (B), by striking <quote>2004 through 2008</quote> and inserting <quote>2009
			 through 2013</quote>.</text>
			</paragraph></section><section id="id61C6533D921A47CF8B1DC7AE3877C803"><enum>4.</enum><header>Research and
			 development program</header><text display-inline="no-display-inline">Section
			 106(b)(1) of the Great Lakes Legacy Act of 2002 (33 U.S.C. 1271a(b)(1)) is
			 amended by striking <quote>2004 through 2008</quote> and inserting <quote>2009
			 through 2013</quote>.</text>
