		<legis-type display="yes">AN ACT</legis-type>
		<official-title display="yes">To provide for certain Federal employee
		  benefits to be continued for certain employees of the Senate Restaurants after
		  operations of the Senate Restaurants are contracted to be performed by a
		  private business concern, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Continued Benefits for Certain Senate
			 Restaurants Employees</header>
			<subsection commented="no" display-inline="no-display-inline" id="id90A1E02188E84B1FB4BB66D3E7136474"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id9E84863963784853A805598E93C21809"><enum>(1)</enum><header display-inline="yes-display-inline">Contractor</header><text display-inline="yes-display-inline">The term <term>contractor</term> means the
			 private business concern that enters into a food services contract with the
			 Architect of the Capitol.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5C397568B50412194CCE281443EBB53"><enum>(2)</enum><header display-inline="yes-display-inline">Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term>
			 means any individual who—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id46613E81473A4CB0A034CEDBA5A9861E"><enum>(A)</enum><text display-inline="yes-display-inline">is a Senate Restaurants employee who is an
			 employee of the Architect of the Capitol on the date of enactment of this Act,
			 including—</text>
						<clause commented="no" display-inline="no-display-inline" id="id85D8E980EF9348A09264C9DB08A89765"><enum>(i)</enum><text display-inline="yes-display-inline">a permanent, full-time or part-time
			 employee;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF8AA7DA1512B4155B4B9A43A01C19083"><enum>(ii)</enum><text display-inline="yes-display-inline">a temporary, full-time or part-time
			 employee; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id7EC21F4684A440819F9E1FF5F2FE2304"><enum>(iii)</enum><text display-inline="yes-display-inline">an employee in a position described under
			 the second or third provisos under the subheading <quote><header-in-text level="paragraph" style="OLC">senate office buildings</header-in-text></quote>
			 under the heading <quote><header-in-text level="subsection" style="OLC">Capitol
			 Buildings and Grounds</header-in-text></quote> under the heading
			 <quote><header-in-text level="subsection" style="OLC">ARCHITECT OF THE
			 CAPITOL</header-in-text></quote> in the Legislative Branch Appropriations Act,
			 1972 (<external-xref legal-doc="usc" parsable-cite="usc/2/2048">2 U.S.C. 2048</external-xref>);</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17A8691B50B24B36891DC05AF2A6FF2F"><enum>(B)</enum><text display-inline="yes-display-inline">becomes an employee of the contractor under
			 a food services contract on the transfer date; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE9FEDE3C749F47CA9C149C0C583FF105"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to benefits under subsection
			 (c)(2) or (3), files an election before the transfer date with the Office of
			 Human Resources of the Architect of the Capitol to have 1 or more benefits
			 continued in accordance with this section.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4D738DCD57ED47959E20C991005227E9"><enum>(3)</enum><header display-inline="yes-display-inline">Food services contract</header><text display-inline="yes-display-inline">The term <term>food services
			 contract</term> means a contract under which food services operations of the
			 Senate Restaurants are transferred to, and performed by, a private business
			 concern.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4BB260D028B3459B9C5AE244285B2718"><enum>(4)</enum><header display-inline="yes-display-inline">Transfer date</header><text display-inline="yes-display-inline">The term <term>transfer date</term> means
			 the date on which a contractor begins the performance of food services
			 operations under a food services contract.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD2470F823A474C07AE0D3211F4FCA23D"><enum>(b)</enum><header display-inline="yes-display-inline">Election of coverage</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id1A169C07FA8D4B30BE1D5FB03DCAE8B8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id59EB0E5A2BBC4F6C91D0AB915E280FF7"><enum>(A)</enum><header display-inline="yes-display-inline">Retirement coverage</header><text display-inline="yes-display-inline">Not later than the day before the transfer
			 date, an individual described under subsection (a)(2)(A) and (B) may file an
			 election with the Office of Human Resources of the Architect of the Capitol to
			 continue coverage under the retirement system under which that individual is
			 covered on that day.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id586EE9AF6DCA439FA5FD366023B6C1D4"><enum>(B)</enum><header display-inline="yes-display-inline">Life and health insurance
			 coverage</header><text display-inline="yes-display-inline">If the individual
			 files an election under subparagraph (A) to continue retirement coverage, the
			 individual may also file an election with the Office of Human Resources of the
			 Architect of the Capitol to continue coverage of any other benefit under
			 subsection (c)(2) or (3) for which that individual is covered on that day. Any
			 election under this subparagraph shall be filed not later than the day before
			 the transfer date.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE00B6F1C2180489FB09BD0C6A9A47272"><enum>(2)</enum><header display-inline="yes-display-inline">Notification to the Office of Personnel
			 Management</header><text display-inline="yes-display-inline">The Office of
			 Human Resources of the Architect of the Capitol shall provide timely
			 notification to the Office of Personnel Management of any election filed under
			 paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1C59D35A02E647C398C8A6A2A79C4BF1"><enum>(c)</enum><header display-inline="yes-display-inline">Continuity of benefits</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idD0FB37C25C00453A8623DD22759D2D3E"><enum>(1)</enum><header display-inline="yes-display-inline">Pay</header><text display-inline="yes-display-inline">The rate of basic pay of a covered
			 individual as an employee of a contractor, or successor contractor, during a
			 period of continuous service may not be reduced to a rate less than the rate of
			 basic pay paid to that individual as an employee of the Architect of the
			 Capitol on the day before the transfer date, except for cause.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63734904A596463C8D754F762D156D36"><enum>(2)</enum><header display-inline="yes-display-inline">Retirement and life insurance
			 benefits</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id0DDF1A4CB312465E8192D6F264C5FAA4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of chapters 83, 84, and 87 of
			 title 5, United States Code—</text>
						<clause commented="no" display-inline="no-display-inline" id="id4183506D18E342F1BA6B3283897339D1"><enum>(i)</enum><text display-inline="yes-display-inline">any period of continuous service performed
			 by a covered individual as an employee of a contractor, or successor
			 contractor, shall be deemed to be a period of service as an employee of the
			 Architect of the Capitol; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idD67F64B9C5014110870AD5FCE30C1A00"><enum>(ii)</enum><text display-inline="yes-display-inline">the rate of basic pay of the covered
			 individual during the period described under clause (i) shall be deemed to be
			 the rate of basic pay of that individual as an employee of the Architect of the
			 Capitol on the date on which the Architect of the Capitol enters into the food
			 services contract.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D07FA4B81644EB4B74208F32F06FCDC"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment as Civil Service Retirement
			 Offset employees</header><text display-inline="yes-display-inline">In the case
			 of a covered individual who on the day before the transfer date is subject to
			 subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, but whose
			 employment with the Architect of the Capitol is not employment for purposes of
			 title II of the Social Security Act and chapter 21 of the Internal Revenue Code
			 of 1986—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB0726E7ADBCE42659EBFB4D734A0AB20"><enum>(i)</enum><text display-inline="yes-display-inline">the employment described under subparagraph
			 (A)(i) shall, for purposes of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United
			 States Code, be deemed to be—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id62736E0657FE4CAD9DCD53AF19162E62"><enum>(I)</enum><text display-inline="yes-display-inline">employment of an individual described under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/8402">section 8402(b)(2)</external-xref> of title 5, United States Code; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idA4F4AFA6D7944D6E8F7CAAC375F5119B"><enum>(II)</enum><text display-inline="yes-display-inline">Federal service as defined under section
			 8349(c) of title 5, United States Code; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id937FBE9234D94EE0AFF39058540EE5C4"><enum>(ii)</enum><text display-inline="yes-display-inline">the basic pay described under subparagraph
			 (A)(ii) for employment described under subparagraph (A)(i) shall be deemed to
			 be Federal wages as defined under <external-xref legal-doc="usc" parsable-cite="usc/5/8334">section 8334(k)(2)(C)(i)</external-xref> of title 5, United
			 States Code.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5908211A0584D388EEF25316A735143"><enum>(3)</enum><header display-inline="yes-display-inline">Health insurance benefits</header><text display-inline="yes-display-inline">For purposes of chapters 89, 89A, and 89B
			 of title 5, United States Code, any period of continuous service performed by a
			 covered individual as an employee of a contractor, or successor contractor,
			 shall be deemed to be a period of service as an employee of the Architect of
			 the Capitol.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD34AFD02FEFE487B99D776446E8A7B77"><enum>(4)</enum><header display-inline="yes-display-inline">Leave</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id268355C29CD940F1951C3310ACA9CD44"><enum>(A)</enum><header display-inline="yes-display-inline">Credit of leave</header><text display-inline="yes-display-inline">Subject to <external-xref legal-doc="usc" parsable-cite="usc/5/6304">section 6304</external-xref> of title 5, United
			 States Code, annual and sick leave balances of any covered individual shall be
			 credited to the leave accounts of that individual as an employee of the
			 contractor, or any successor contractor. A food services contract may include
			 provisions similar to regulations prescribed under <external-xref legal-doc="usc" parsable-cite="usc/5/6308">section 6308</external-xref> of title 5,
			 United States Code, to implement this subparagraph.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD39319C0D9B84712A673E1CB3D5CA4DA"><enum>(B)</enum><header display-inline="yes-display-inline">Accrual rate</header><text display-inline="yes-display-inline">During any period of continuous service
			 performed by a covered individual as an employee of a contractor, or successor
			 contractor, that individual shall continue to accrue annual and sick leave at
			 rates not less than the rates applicable to that individual on the day before
			 the transfer date.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62F5994138FF40159F3E180E77395BA9"><enum>(C)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendment</header><text display-inline="yes-display-inline">The second and
			 third provisos under the subheading <quote><header-in-text level="paragraph" style="OLC">senate office buildings</header-in-text></quote> under the heading
			 <quote><header-in-text level="subsection" style="OLC">Capitol Buildings and
			 Grounds</header-in-text></quote> under the heading <quote><header-in-text level="subsection" style="OLC">ARCHITECT OF THE CAPITOL</header-in-text></quote> in the
			 Legislative Branch Appropriations Act, 1972 (<external-xref legal-doc="usc" parsable-cite="usc/2/2048">2 U.S.C. 2048</external-xref>) are
			 repealed.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE10583A8797F4C479D2DDD2A88B90A51"><enum>(5)</enum><header display-inline="yes-display-inline">Transit subsidy</header><text display-inline="yes-display-inline">For purposes of any benefit under section
			 7905 of title 5, United States Code, any period of continuous service performed
			 by a covered individual as an employee of a contractor, or successor
			 contractor, shall be deemed to be a period of service as an employee of the
			 Architect of the Capitol.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF846FA7FFD694994978B25EC331505F2"><enum>(6)</enum><header display-inline="yes-display-inline">Employee pay; Government contributions;
			 transit subsidy payments; and other benefits</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id649FDF7B33D94C1489736FB280F51ADB"><enum>(A)</enum><header display-inline="yes-display-inline">Payment by contractor</header><text display-inline="yes-display-inline">A contractor, or any successor to the
			 contractor, shall pay—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB59BBC0657EF40088CD4CA6CE0819EB4"><enum>(i)</enum><text display-inline="yes-display-inline">the pay of a covered individual as an
			 employee of a contractor, or successor contractor, during a period of
			 continuous service;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id0BAB4F9A18904FFA89467C00C0F409D1"><enum>(ii)</enum><text display-inline="yes-display-inline">Government contributions for the benefits
			 of a covered individual under paragraph (2) or (3);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id51DDC755AF814E079650DC903AE7800D"><enum>(iii)</enum><text display-inline="yes-display-inline">any transit subsidy for a covered
			 individual under paragraph (5); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id63A944D834074AA6BE129305CDE447C6"><enum>(iv)</enum><text display-inline="yes-display-inline">any payment for any other benefit for a
			 covered individual in accordance with a food services contract.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id312C2663ECBA4C42B61FB34F21DE42EB"><enum>(B)</enum><header display-inline="yes-display-inline">Reimbursements and payments by Architect of
			 the Capitol</header><text display-inline="yes-display-inline">From
			 appropriations made available to the Architect of the Capitol under the heading
			 <quote><header-in-text level="subsection" style="OLC">Senate Office
			 Buildings</header-in-text></quote> under the heading <quote><header-in-text level="subsection" style="OLC">ARCHITECT OF THE
			 CAPITOL</header-in-text></quote>, the Architect of the Capitol shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="id55DAD288A1A14B9A9E1103981BAC8732"><enum>(i)</enum><text display-inline="yes-display-inline">reimburse a contractor, or any successor
			 contractor, for that portion of any payment under subparagraph (A) which the
			 Architect of the Capitol agreed to pay under a food services contract;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idD602D23219794AC3A6C193FAFE8C8E3B"><enum>(ii)</enum><text display-inline="yes-display-inline">pay a contractor, or any successor
			 contractor, for any administrative fee (or portion of an administrative fee)
			 which the Architect of the Capitol agreed to pay under a food services
			 contract.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEEF3B13D6FFE4B92AC54B0FF2056A6FD"><enum>(7)</enum><header display-inline="yes-display-inline">Regulations</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id036ED4F132474731A1626D4667DD488C"><enum>(A)</enum><header display-inline="yes-display-inline">Office of Personnel Management</header>
						<clause commented="no" display-inline="no-display-inline" id="id5458B68DA69B48209B7AC2EAA4978E50"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After consultation with the Architect of
			 the Capitol, the Director of the Office of Personnel Management shall prescribe
			 regulations to provide for the continuity of benefits under paragraphs (2) and
			 (3).</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA3EE89DD3D6F4D168B5E012462C05D88"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Regulations under this subparagraph
			 shall—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id74D1FF834C1A43F181C6B89247CB4750"><enum>(I)</enum><text display-inline="yes-display-inline">include regulations relating to employee
			 deductions and employee and employer contributions and deposits in the Civil
			 Service Retirement and Disability Fund, the Employees' Life Insurance Fund, and
			 the Employees Health Benefits Fund; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id436B5A35F1B54BF59D725A9D356F6B7C"><enum>(II)</enum><text display-inline="yes-display-inline">provide for the Architect of the Capitol to
			 perform employer administrative functions necessary to ensure administration of
			 continued coverage of benefits under paragraphs (2) and (3), including receipt
			 and transmission of the deductions, contributions, and deposits described under
			 subclause (I), the collection and transmission of such information as
			 necessary, and the performance of other administrative functions as may be
			 required.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD6ADC666E1804578801A79740AC74288"><enum>(B)</enum><header display-inline="yes-display-inline">Thrift Savings Plan benefits</header><text display-inline="yes-display-inline">After consultation with the Architect of
			 the Capitol, the Executive Director appointed by the Federal Retirement Thrift
			 Investment Board under <external-xref legal-doc="usc" parsable-cite="usc/5/8474">section 8474(a)</external-xref> of title 5, United States Code, shall
			 prescribe regulations to provide for the continuity of benefits under paragraph
			 (2) of this subsection relating to subchapter III of chapter 84 of that title.
			 Regulations under this subparagraph shall include regulations relating to
			 employee deductions and employee and employer contributions and deposits in the
			 Thrift Savings Fund.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34B5814856A743E79DAC8F75951B40E2"><enum>(d)</enum><header display-inline="yes-display-inline">Covered individuals not entitled to
			 severance pay</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id8A2C9085C56A4190BB731FB95F79C76B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided under paragraph (2), a
			 covered individual shall not be entitled to severance pay under section 5595 of
			 title 5, United States Code, by reason of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC73820E6C71647CDB7E72B7E0425E139"><enum>(A)</enum><text display-inline="yes-display-inline">separation from service with the Architect
			 of the Capitol and becoming an employee of a contractor under a food services
			 contract; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2FCF1DE82BB94D47B9FDE4F3E985DEFB"><enum>(B)</enum><text display-inline="yes-display-inline">termination of employment with a
			 contractor, or successor to a contractor.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF471AE2AD97A48F6A76FBCDE303CD65D"><enum>(2)</enum><header display-inline="yes-display-inline">Separation during 90-day period</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id03DB15070A1F4DD59D3BCE0B9E7AA53F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header>
						<clause commented="no" display-inline="no-display-inline" id="idDD02FDC0728A4B649E7B5297BA2E6AAA"><enum>(i)</enum><header display-inline="yes-display-inline">Covered individuals</header><text display-inline="yes-display-inline">Except as provided under clause (ii), a
			 covered individual shall be entitled to severance pay under section 5595 of
			 title 5, United States Code, if during the 90-day period following the transfer
			 date the employment of that individual with a contractor is terminated as
			 provided under a food services contract.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8F4DF6B579F849138376CC45DD21FBDA"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Clause (i) shall not apply to a covered
			 individual who is terminated for cause.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91239A10B2EA4850A0FD7E8C025DCFFE"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment</header><text display-inline="yes-display-inline">For purposes of <external-xref legal-doc="usc" parsable-cite="usc/5/5595">section 5595</external-xref> of title 5,
			 United States Code—</text>
						<clause commented="no" display-inline="no-display-inline" id="idDE0F2C9470D3441C86F7B4A0F2F0F56F"><enum>(i)</enum><text display-inline="yes-display-inline">any period of continuous service performed
			 by a covered individual described under subparagraph (A) as an employee of a
			 contractor shall be deemed to be a period of service as an employee of the
			 Architect of the Capitol; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9E1E2FFC9CAF41CA878FA9DC2D17F705"><enum>(ii)</enum><text display-inline="yes-display-inline">any termination of employment of a covered
			 individual described under subparagraph (A) with a contractor shall be treated
			 as a separation from service with the Architect of the Capitol.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF473614EF5FF4A4C91A135B54D8DABB9"><enum>(e)</enum><header display-inline="yes-display-inline">Voluntary separation incentive
			 payments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id6D4E4DDBBF544D53BA84E8F5D2F6ED26"><enum>(1)</enum><header display-inline="yes-display-inline">Submission of plan</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Architect of the Capitol shall submit a plan under
			 section 210 of the Legislative Branch Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/2/60q">2 U.S.C. 60q</external-xref>)
			 to the applicable committees as provided under that section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7FB6D232B804F5A92317EEBD9B1E567"><enum>(2)</enum><header display-inline="yes-display-inline">Plan</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id242D1FD7BA6B48BD92DD439320FEEAD2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 210(e) of the
			 Legislative Branch Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/2/60q">2 U.S.C. 60q(e)</external-xref>), the plan
			 submitted under this subsection shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB307D44DD4DE4A788DCEF54C692E711D"><enum>(i)</enum><text display-inline="yes-display-inline">offer a voluntary separation incentive
			 payment to any employee described under subsection (a)(2)(A) of this section in
			 accordance with section 210 of that Act; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id91676DBCA19545F3B5F07DE78EF80A56"><enum>(ii)</enum><text display-inline="yes-display-inline">offer such a payment to any such employee
			 who becomes a covered individual, if that individual accepts the offer during
			 the 90-day period following the transfer date.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81305F7B92774B538BC806C7EC411DE4"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of covered
			 individuals</header><text display-inline="yes-display-inline">For purposes of
			 the plan under this subsection—</text>
						<clause commented="no" display-inline="no-display-inline" id="idDC59386A5CEE4E67A0066E7E6B0CEC5B"><enum>(i)</enum><text display-inline="yes-display-inline">any period of continuous service performed
			 by a covered individual as an employee of a contractor shall be deemed to be a
			 period of service as an employee of the Architect of the Capitol; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idB54FEEB107F84CD99874BBEE53F91C1F"><enum>(ii)</enum><text display-inline="yes-display-inline">any termination of employment of a covered
			 individual with a contractor shall be treated as a separation from service with
			 the Architect of the Capitol.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id84BD9AAE21B44742A85AA62589F84235"><enum>(f)</enum><header display-inline="yes-display-inline">Early retirement treatment for certain
			 separated employees</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id3AFAD7592FD24E488CFEDD293BEE4784"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This subsection applies to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id612E3339FAF5471EAB8C6D22FA51B6F2"><enum>(A)</enum><text display-inline="yes-display-inline">an employee of the Senate Restaurants of
			 the Office of the Architect of the Capitol who—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID7030de1091ed4bc1bc28cc7672ca37af"><enum>(i)</enum><text display-inline="yes-display-inline">voluntarily separates from service on or
			 after the date of enactment of this Act, but prior to the day before the
			 transfer date; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDd1872ac6981b488c8ad1a92de842547c"><enum>(ii)</enum><text display-inline="yes-display-inline">on such date of separation—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID347ba01f32814da9b29e8aa3f6101664"><enum>(I)</enum><text display-inline="yes-display-inline">has completed 25 years of service as
			 defined under section <external-xref legal-doc="usc" parsable-cite="usc/5/8331">8331(12)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8401">8401(26)</external-xref> of title 5, United States Code;
			 or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2e6e97f6d5ea4354bbef9a6dd09643c7"><enum>(II)</enum><text display-inline="yes-display-inline">has completed 20 years of such service and
			 is at least 50 years of age; and</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0B278AAFD5E740DD85E3C145BCEC836E"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided under paragraph (2), a
			 covered individual—</text>
						<clause commented="no" display-inline="no-display-inline" id="idA6A91932CB2F4C4BA9FFDBAE8D59A514"><enum>(i)</enum><text display-inline="yes-display-inline">whose employment with a contractor is
			 terminated as provided under a food services contract during the 90-day period
			 following the transfer date; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idD0168A4A09FA475EB837DD04DF48476C"><enum>(ii)</enum><text display-inline="yes-display-inline">on the date of such termination—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id7E48EE2F774847A9B8280AE4093EECF6"><enum>(I)</enum><text display-inline="yes-display-inline">has completed 25 years of service as
			 defined under section <external-xref legal-doc="usc" parsable-cite="usc/5/8331">8331(12)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8401">8401(26)</external-xref> of title 5, United States Code;
			 or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idADD1593051364E52BDA35AFFB8FCF2EF"><enum>(II)</enum><text display-inline="yes-display-inline">has completed 20 years of such service and
			 is at least 50 years of age.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6EFBAE82795C42C4BF5DEF3F583651BB"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Paragraph (1)(B) shall not apply to a
			 covered individual who is terminated for cause.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa03771d4608444979c3223310fc217dc"><enum>(3)</enum><header display-inline="yes-display-inline">Treatment</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3059E22F31F54756AAA4EBCD0D1E383E"><enum>(A)</enum><header display-inline="yes-display-inline">Annuity</header><text display-inline="yes-display-inline">Notwithstanding any provision of chapter 83
			 or 84 of title 5, United States Code, an employee described under paragraph (1)
			 is entitled to an annuity which shall be computed consistent with the
			 provisions of law applicable to annuities under section 8336(d) or 8414(b) of
			 title 5, United States Code.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF0CDF9CDC9BB48BFA08FA900071779A8"><enum>(B)</enum><header display-inline="yes-display-inline">Separation during 90-day
			 period</header><text display-inline="yes-display-inline">For purposes of
			 chapter 83 or 84 of title 5, United States Code—</text>
						<clause commented="no" display-inline="no-display-inline" id="idAEFF56E659B64E50B11E5D3C78F7D2F7"><enum>(i)</enum><text display-inline="yes-display-inline">any period of continuous service performed
			 by a covered individual described under paragraphs (1)(B) and (2) as an
			 employee of a contractor shall be deemed to be a period of service as an
			 employee of the Architect of the Capitol; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id264C48BF902642108AA38D8C553C446B"><enum>(ii)</enum><text display-inline="yes-display-inline">any termination of employment of a covered
			 individual described under paragraphs (1)(B) and (2) with a contractor shall be
			 treated as a separation from service with the Architect of the Capitol.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0EC2C0A72F954EC89F2C7FECF354A603"><enum>(g)</enum><header display-inline="yes-display-inline">Congressional Accountability Act of
			 1995</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H97B259E6B27F48A798B841ACEB469427"><enum>(1)</enum><header display-inline="yes-display-inline">Employees of the Architect of the
			 Capitol</header><text display-inline="yes-display-inline">Section 101(5) of the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(5)</external-xref>) is amended by
			 striking <quote>, the Botanic Garden, or the Senate Restaurant</quote> and
			 inserting <quote>or the Botanic Garden</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4BF17708E76747B58845DF1A9875E632"><enum>(2)</enum><header display-inline="yes-display-inline">Disabilities</header><text display-inline="yes-display-inline">Section 210(a)(7) of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1331">2 U.S.C. 1331(a)(7)</external-xref>) is amended by striking
			 <quote>the Senate Restaurants and the Botanic Garden</quote> and inserting
			 <quote>the Botanic Garden</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBF80029D0F3B4513A09CE47C8512B987"><enum>(3)</enum><header display-inline="yes-display-inline">Continuing application to certain acts and
			 omissions</header><text display-inline="yes-display-inline">For purposes of the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) a covered
			 individual shall be treated as an employee of the Architect of the Capitol with
			 respect to any act or omission which occurred before the transfer date.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id319B340C6DC54AC69275C8019D42C05B"><enum>(h)</enum><header display-inline="yes-display-inline">Deposit of commissions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2B736586F2124076AB36E174E1413C30"><enum>(1)</enum><header display-inline="yes-display-inline">Senate Restaurants food services
			 contract</header><text display-inline="yes-display-inline">Any commissions paid
			 by a contractor under a food services contract shall be deposited in the
			 miscellaneous items account within the contingent fund of the Senate.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA36CDD1F272F4C07A954A65E10E991FC"><enum>(2)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Any funds deposited under paragraph (1)
			 shall be available for expenditure in the same manner as funds appropriated
			 into that account.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA0E0900E86CC485DAE1C78294308D608"><enum>(i)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This Act shall take
			 effect on the date of enactment of this Act and apply to the remainder of the
			 fiscal year in which enacted and each fiscal year thereafter.</text>
