			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of Energy.</text>

			 resources</header>
			<subtitle id="idA7D79CA28F814253941E9673B1BBD974"><enum>A</enum><header>Outer Continental
			 Shelf</header>
				<section id="ID79484307572A4730AE2DB07A3B01ED54"><enum>101.</enum><header>Publication of
			 projected State lines on outer Continental Shelf</header><text display-inline="no-display-inline">Section 4(a)(2)(A) of the Outer Continental
			 Shelf Lands Act (43 U.S.C. 1333(a)(2)(A)) is amended—</text>
					<paragraph id="ID7117F4D8571F480AA5EBF378074F8C2A"><enum>(1)</enum><text>by designating
			 the first, second, and third sentences as clause (i), (iii), and (iv),
			 respectively;</text>
					</paragraph><paragraph id="ID217D456FEAC447BC8CDADD51977C75DF"><enum>(2)</enum><text>in clause (i) (as
			 so designated), by inserting before the period at the end the following:
			 <quote>not later than 90 days after the date of enactment of the
			 <short-title>American Energy Production Act of
			 2008</short-title></quote>; and</text>
					</paragraph><paragraph id="ID9B52818154A540B5A240520C9B83FA49"><enum>(3)</enum><text>by inserting
			 after clause (i) (as so designated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id72CAD9D9748746A083ECA7AEBCC000AF" style="OLC">
							<clause id="ID6DDE58F095B7488781C736A4DB4CB915" indent="up3"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="ID4E280BC708DD432C9239618434B62B40"><enum>(I)</enum><text>The projected lines
				shall also be used for the purpose of preleasing and leasing activities
				conducted in new producing areas under section 32.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDEAE13E66494D4C4186FA2D131121F2DD" indent="up1"><enum>(II)</enum><text>This clause shall not affect any
				property right or title to Federal submerged land on the outer Continental
				Shelf.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idEF179F59179D42F7857652B71DFD8F0F" indent="up1"><enum>(III)</enum><text>In carrying out this clause, the
				President shall consider the offshore administrative boundaries beyond State
				submerged lands for planning, coordination, and administrative purposes of the
				Department of the Interior, but may establish different
				boundaries.</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="ID2CE98CAC694A4B85AEBABD0BC3CD04C0"><enum>102.</enum><header>Production of
			 oil and natural gas in new producing areas</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (43
			 U.S.C. 1331 et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8BEB20A950374D15ADBDE0B6EAC54B55" style="OLC">
						<section id="IDE68D7EC09DA14C69B050EB7FADF47917"><enum>32.</enum><header>Production of
				oil and natural gas in new producing areas</header>
							<subsection id="ID02E7CBE27F3848F39FD1FBF5129984A7"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="IDF074F6D4DED1412DA0099DEB2F346A08"><enum>(1)</enum><header>Coastal
				political subdivision</header><text>The term <term>coastal political
				subdivision</term> means a political subdivision of a new producing State any
				part of which political subdivision is—</text>
									<subparagraph id="IDA86863A78125419F9BFFA2DF8F742C3D"><enum>(A)</enum><text>within the
				coastal zone (as defined in section 304 of the <act-name parsable-cite="CAMA72">Coastal Zone Management Act of 1972</act-name> (16
				U.S.C. 1453)) of the new producing State as of the date of enactment of this
				section; and</text>
									</subparagraph><subparagraph id="ID03B86967390D40248ED16C3E4F2221FD"><enum>(B)</enum><text>not more than 200
				nautical miles from the geographic center of any leased tract.</text>
									</subparagraph></paragraph><paragraph id="IDF1B0EC83E4E244BDAEC1D4C1426CCA28"><enum>(2)</enum><header>Moratorium
				area</header>
									<subparagraph id="id764B011E375F4A72BA80DB99EDEA27CC"><enum>(A)</enum><header>In
				general</header><text>The term <term>moratorium area</term> means an area
				covered by sections 104 through 105 of the Department of the Interior,
				Environment, and Related Agencies Appropriations Act, 2008 (Public Law 110–161;
				121 Stat. 2118) (as in effect on the day before the date of enactment of this
				section).</text>
									</subparagraph><subparagraph id="id1D9262D7C014400DAE4D286290B957EF"><enum>(B)</enum><header>Exclusion</header><text>The
				term <term>moratorium area</term> does not include an area located in the Gulf
				of Mexico.</text>
									</subparagraph></paragraph><paragraph id="ID69154E892D54464A908C3AE9876B9958"><enum>(3)</enum><header>New producing
				area</header><text>The term <term>new producing area</term> means any
				moratorium area within the offshore administrative boundaries beyond the
				submerged land of a State that is located greater than 50 miles from the
				coastline of the State.</text>
								</paragraph><paragraph id="id687873029E1D4FDF9A11D701E8E71CD8"><enum>(4)</enum><header>New producing
				State</header><text>The term <term>new producing State</term> means a State
				that has, within the offshore administrative boundaries beyond the submerged
				land of the State, a new producing area available for oil and gas leasing under
				subsection (b).</text>
								</paragraph><paragraph id="IDe8a1329f561c4ae0aee318905013aa49"><enum>(5)</enum><header>Offshore
				administrative boundaries</header><text>The term <term>offshore administrative
				boundaries</term> means the administrative boundaries established by the
				Secretary beyond State submerged land for planning, coordination, and
				administrative purposes of the Department of the Interior and published in the
				Federal Register on January 3, 2006 (71 Fed. Reg. 127).</text>
								</paragraph><paragraph id="IDA5D92BED407148618F60C025481A9038"><enum>(6)</enum><header>Qualified outer
				Continental Shelf revenues</header>
									<subparagraph id="IDD3CF9E2A4454488F928EB41272BF6461"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified outer Continental Shelf
				revenues</term> means all rentals, royalties, bonus bids, and other sums due
				and payable to the United States from leases entered into on or after the date
				of enactment of this section for new producing areas.</text>
									</subparagraph><subparagraph id="IDB31D081EDCE148EF93244B87726F8093"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>qualified outer Continental Shelf revenues</term> does not
				include—</text>
										<clause id="ID3e87a6d75e0f419d85c156d1d1cc6360"><enum>(i)</enum><text>revenues from a
				bond or other surety forfeited for obligations other than the collection of
				royalties;</text>
										</clause><clause id="ID3524a1b032634a67b6eccb148b5f30d0"><enum>(ii)</enum><text>revenues from
				civil penalties;</text>
										</clause><clause id="IDdb37b393ef2b49dda6868dcbad104e51"><enum>(iii)</enum><text>royalties taken
				by the Secretary in-kind and not sold;</text>
										</clause><clause id="ID66957ceae08547a79c102542370ecd5c"><enum>(iv)</enum><text>revenues
				generated from leases subject to section 8(g); or</text>
										</clause><clause id="ID3d3a733ff1f04f2d96c2c798d4f3c586"><enum>(v)</enum><text>any revenues
				considered qualified outer Continental Shelf revenues under section 102 of the
				Gulf of Mexico Energy Security Act of 2006 (43 U.S.C. 1331 note; Public Law
				109–432).</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID464EE0E3AA6A454687F8E2A65F995CE3"><enum>(b)</enum><header>Petition for
				Leasing New Producing Areas</header>
								<paragraph id="IDE864894638864F80B34407910793064E"><enum>(1)</enum><header>In
				general</header><text>Beginning on the date on which the President delineates
				projected State lines under section 4(a)(2)(A)(ii), the Governor of a State
				with a new producing area within the offshore administrative boundaries beyond
				the submerged land of the State may submit to the Secretary a petition
				requesting that the Secretary make the new producing area available for oil and
				gas leasing.</text>
								</paragraph><paragraph id="IDDE263D4AAFC44500A71EC488CFA77D78"><enum>(2)</enum><header>Action by
				Secretary</header><text>Notwithstanding section 18, as soon as practicable
				after receipt of a petition under paragraph (1), the Secretary shall approve
				the petition if the Secretary determines that leasing the new producing area
				would not create an unreasonable risk of harm to the marine, human, or coastal
				environment.</text>
								</paragraph></subsection><subsection id="idC5666DC283E54DFDA83BDD09854D04A3"><enum>(c)</enum><header>Disposition of
				qualified outer Continental Shelf revenues from new producing areas</header>
								<paragraph id="IDAB4B17C4149941259ADBEAE926CC11A2"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding section 9 and subject to the other
				provisions of this subsection, for each applicable fiscal year, the Secretary
				of the Treasury shall deposit—</text>
									<subparagraph id="ID8715D478A49A48FC9CE46C9AB4D8350A"><enum>(A)</enum><text>50 percent of
				qualified outer Continental Shelf revenues in the general fund of the Treasury;
				and</text>
									</subparagraph><subparagraph id="IDE6EC01AB2ADE41E8B22C6D2AD3BDA695"><enum>(B)</enum><text>50 percent of
				qualified outer Continental Shelf revenues in a special account in the Treasury
				from which the Secretary shall disburse—</text>
										<clause id="IDB6163135FC2748FDAF0048DD709236EC"><enum>(i)</enum><text>75 percent to new
				producing States in accordance with paragraph (2); and</text>
										</clause><clause id="IDA7E4C6A3E6894E2E909195205BBADFA0"><enum>(ii)</enum><text>25 percent to
				provide financial assistance to States in accordance with section 6 of the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of
				1965</act-name> (16 U.S.C. 460<added-phrase reported-display-style="italic">l</added-phrase>–8), which shall be considered
				income to the Land and Water Conservation Fund for purposes of section 2 of
				that Act (16 U.S.C. 460<added-phrase reported-display-style="italic">l</added-phrase>–5).</text>
										</clause></subparagraph></paragraph><paragraph id="ID19D89662DBD845E992BDBB4B347D6D15"><enum>(2)</enum><header>Allocation to
				new producing States and coastal political subdivisions</header>
									<subparagraph id="ID5983E9684A9842D29C307D6CF34A1696"><enum>(A)</enum><header>Allocation to
				new producing States</header><text>Effective for fiscal year 2008 and each
				fiscal year thereafter, the amount made available under paragraph (1)(B)(i)
				shall be allocated to each new producing State in amounts (based on a formula
				established by the Secretary by regulation) proportional to the amount of
				qualified outer Continental Shelf revenues generated in the new producing area
				offshore each State.</text>
									</subparagraph><subparagraph id="ID790DC22E508043E5B03E30E952DD3414"><enum>(B)</enum><header>Payments to
				coastal political subdivisions</header>
										<clause id="ID856313ADD8A3498F8754933519CD0804"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall pay 20 percent of the allocable share
				of each new producing State, as determined under subparagraph (A), to the
				coastal political subdivisions of the new producing State.</text>
										</clause><clause id="ID45D6BD88FF1B48A9875E453DDDE4CE88"><enum>(ii)</enum><header>Allocation</header><text>The
				amount paid by the Secretary to coastal political subdivisions shall be
				allocated to each coastal political subdivision in accordance with
				subparagraphs (B) and (C) of section 31(b)(4).</text>
										</clause></subparagraph></paragraph><paragraph id="ID998ee0f3863044baa72a224ddd3a5685"><enum>(3)</enum><header>Minimum
				allocation</header><text>The amount allocated to a new producing State for each
				fiscal year under paragraph (2) shall be at least 5 percent of the amounts
				available under for the fiscal year under paragraph (1)(B)(i).</text>
								</paragraph><paragraph id="ID3A89736CFDBA467FA1898DEE26BD424A"><enum>(4)</enum><header>Timing</header><text>The
				amounts required to be deposited under subparagraph (B) of paragraph (1) for
				the applicable fiscal year shall be made available in accordance with that
				subparagraph during the fiscal year immediately following the applicable fiscal
				year.</text>
								</paragraph><paragraph id="ID8A991050008D4AC88931400AE1D08F96"><enum>(5)</enum><header>Authorized
				uses</header>
									<subparagraph id="IDA794812614AE4EB39542B1AA550F0074"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), each new producing State and
				coastal political subdivision shall use all amounts received under paragraph
				(2) in accordance with all applicable Federal and State laws, only for 1 or
				more of the following purposes:</text>
										<clause id="IDCFA9335CF95A472DA2B9FF55D4397834"><enum>(i)</enum><text>Projects and
				activities for the purposes of coastal protection, including conservation,
				coastal restoration, hurricane protection, and infrastructure directly affected
				by coastal wetland losses.</text>
										</clause><clause id="IDA98C61A93CED43ABBEF5FAB869427826"><enum>(ii)</enum><text>Mitigation of
				damage to fish, wildlife, or natural resources.</text>
										</clause><clause id="IDE40EDA6DE1084AC9A1CFA85C41F4C6AB"><enum>(iii)</enum><text>Implementation
				of a federally approved marine, coastal, or comprehensive conservation
				management plan.</text>
										</clause><clause id="IDD31ECBD28B78409AAB10A7EA46476FE1"><enum>(iv)</enum><text>Mitigation of
				the impact of outer Continental Shelf activities through the funding of onshore
				infrastructure projects.</text>
										</clause><clause id="IDC6D3947F8CC94F5C9AA5328CEEB6D022"><enum>(v)</enum><text>Planning
				assistance and the administrative costs of complying with this section.</text>
										</clause></subparagraph><subparagraph id="ID7A6B90A3855143CBA51222E48A4EC35A"><enum>(B)</enum><header>Limitation</header><text>Not
				more than 3 percent of amounts received by a new producing State or coastal
				political subdivision under paragraph (2) may be used for the purposes
				described in subparagraph (A)(v).</text>
									</subparagraph></paragraph><paragraph id="IDFDD6716F0C4F4787BF6A94AA5B72D4FA"><enum>(6)</enum><header>Administration</header><text>Amounts
				made available under paragraph (1)(B) shall—</text>
									<subparagraph id="ID8B83E217372E4E73A5387711FFEBE84A"><enum>(A)</enum><text>be made
				available, without further appropriation, in accordance with this
				subsection;</text>
									</subparagraph><subparagraph id="ID57729C5704ED4995815633718ED40B0D"><enum>(B)</enum><text>remain available
				until expended; and</text>
									</subparagraph><subparagraph id="ID5339F774F350488F9D05EC7D720D11DC"><enum>(C)</enum><text>be in addition to
				any amounts appropriated under—</text>
										<clause id="ID1AE58C11528C4EE1A033FDB22AF3EA4E"><enum>(i)</enum><text>other provisions
				of this Act;</text>
										</clause><clause id="ID221FC0BC52CA433DB510DF7782770A95"><enum>(ii)</enum><text>the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of
				1965</act-name> (16 U.S.C. 460<added-phrase reported-display-style="italic">l</added-phrase>–4 et seq.); or</text>
										</clause><clause id="IDD6EFBDA236354B40AE62E07BBEB8E825"><enum>(iii)</enum><text>any other
				provision of law.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="idC57FD348934544F7B15433223F4A2962"><enum>(d)</enum><header>Disposition of
				qualified outer Continental Shelf revenues from other
				areas</header><text>Notwithstanding section 9, for each applicable fiscal year,
				the terms and conditions of subsection (c) shall apply to the disposition of
				qualified outer Continental Shelf revenues that—</text>
								<paragraph id="idF1D75E50326C46D4B6B3274710408E87"><enum>(1)</enum><text>are derived from
				oil or gas leasing in an area that is not included in the current 5-year plan
				of the Secretary for oil or gas leasing; and</text>
								</paragraph><paragraph id="id6FFE35F608E84DE296C21B76B6DF8147"><enum>(2)</enum><text>are not assumed
				in the budget of the United States Government submitted by the President under
				section 1105 of title 31, United States
				Code.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" display-inline="no-display-inline" id="idCB8BDE5A185045B19F220169AE149F16"><enum>103.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Sections 104 through
			 105 of the Department of the Interior, Environment, and Related Agencies
			 Appropriations Act, 2008 (Public Law 110–161; 121 Stat. 2118) are
			 repealed.</text>
				</section></subtitle><subtitle id="id49A2D5C839B24166ADC7723921DE7904"><enum>B</enum><header>Leasing program
			 for land within Coastal Plain</header>
				<section id="ID4e9a796bf5e74177ad0fc81905906d2b"><enum>111.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="ID47b396edd4dc4e04a7eaf4138ea49707"><enum>(1)</enum><header>Coastal
			 Plain</header><text>The term <term>Coastal Plain</term> means that area
			 identified as the <quote>1002 Coastal Plain Area</quote> on the map.</text>
					</paragraph><paragraph id="idA5ECCB29380B47D2AE423F4053A22DD7"><enum>(2)</enum><header>Federal
			 agreement</header><text>The term <term>Federal Agreement</term> means the
			 Federal Agreement and Grant Right-of-Way for the Trans-Alaska Pipeline issued
			 on January 23, 1974, in accordance with section 28 of the Mineral Leasing Act
			 (30 U.S.C. 185) and the Trans-Alaska Pipeline Authorization Act (43 U.S.C. 1651
			 et seq.).</text>
					</paragraph><paragraph id="idDBA4F7E2D7A84BD3BBC1FAB620F5F3A1"><enum>(3)</enum><header>Final
			 statement</header><text>The term <term>Final Statement</term> means the final
			 legislative environmental impact statement on the Coastal Plain, dated April
			 1987, and prepared pursuant to section 1002 of the Alaska National Interest
			 Lands Conservation Act (16 U.S.C. 3142) and section 102(2)(C) of the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id966D90EBFCCD4E37814E12C3DFDC9FD9"><enum>(4)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Arctic National Wildlife
			 Refuge</quote>, dated September 2005, and prepared by the United States
			 Geological Survey.</text>
					</paragraph><paragraph id="ID4a7356c932ba4dc29bf5ec63b50279d2"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior (or the
			 designee of the Secretary), acting through the Director of the Bureau of Land
			 Management in consultation with the Director of the United States Fish and
			 Wildlife Service and in coordination with a State coordinator appointed by the
			 Governor of the State of Alaska.</text>
					</paragraph></section><section id="ID889aaf0072184e539931d49f86ba4518"><enum>112.</enum><header>Leasing
			 program for land within the Coastal Plain</header>
					<subsection id="ID2f98fdc0a24e49bab1df5890d8a6bfd0"><enum>(a)</enum><header>In
			 general</header>
						<paragraph id="ID56ab21a606894a329255624c97cc4c04"><enum>(1)</enum><header>Authorization</header><text>Congress
			 authorizes the exploration, leasing, development, production, and economically
			 feasible and prudent transportation of oil and gas in and from the Coastal
			 Plain.</text>
						</paragraph><paragraph id="IDd6b6a4fe40fa4f638363560177501b4c"><enum>(2)</enum><header>Actions</header><text>The
			 Secretary shall take such actions as are necessary—</text>
							<subparagraph id="ID8a3afa33ba904f07a2be6609b373aea5"><enum>(A)</enum><text>to establish and
			 implement, in accordance with this subtitle, a competitive oil and gas leasing
			 program that will result in an environmentally sound program for the
			 exploration, development, and production of the oil and gas resources of the
			 Coastal Plain while taking into consideration the interests and concerns of
			 residents of the Coastal Plain, which is the homeland of the Kaktovikmiut
			 Inupiat; and</text>
							</subparagraph><subparagraph id="ID6be957b1e1a544debd11c2d7ad42c467"><enum>(B)</enum><text>to administer
			 this subtitle through regulations, lease terms, conditions, restrictions,
			 prohibitions, stipulations, and other provisions that—</text>
								<clause id="id0192541073494C31BEE6911C11AC0909"><enum>(i)</enum><text>ensure the oil
			 and gas exploration, development, and production activities on the Coastal
			 Plain will result in no significant adverse effect on fish and wildlife, their
			 habitat, subsistence resources, and the environment; and</text>
								</clause><clause id="id45C134A7F7B64600AD1A2AC129BEBBD0"><enum>(ii)</enum><text>require the
			 application of the best commercially available technology for oil and gas
			 exploration, development, and production to all exploration, development, and
			 production operations under this subtitle in a manner that ensures the receipt
			 of fair market value by the public for the mineral resources to be
			 leased.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDb8092d27dbc14ddbae4244978a8c99f0"><enum>(b)</enum><header>Repeal</header>
						<paragraph id="ID545351343f064191b485df77b9dee607"><enum>(1)</enum><header>Repeal</header><text>Section
			 1003 of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3143) is
			 repealed.</text>
						</paragraph><paragraph id="IDcbeeb834f994455082c352d90d9dcb60"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The table of contents contained in section 1 of that
			 Act (16 U.S.C. 3101 note) is amended by striking the item relating to section
			 1003.</text>
						</paragraph></subsection><subsection id="IDf0d70ebf58d94376bdfedc23ec82fb1c"><enum>(c)</enum><header>Compliance with
			 requirements under certain other laws</header>
						<paragraph id="IDca7477988a3342069237ebf398829b6c"><enum>(1)</enum><header>Compatibility</header><text>For
			 purposes of the National Wildlife Refuge System Administration Act of 1966 (16
			 U.S.C. 668dd et seq.)—</text>
							<subparagraph id="idCE8F08EBA973474394419C8EF11D4AFB"><enum>(A)</enum><text>the oil and gas
			 pre-leasing and leasing program, and activities authorized by this section in
			 the Coastal Plain, shall be considered to be compatible with the purposes for
			 which the Arctic National Wildlife Refuge was established; and</text>
							</subparagraph><subparagraph id="id0DD31ED74DF545AF94CD29203E6BE85E"><enum>(B)</enum><text>no further
			 findings or decisions shall be required to implement that program and those
			 activities.</text>
							</subparagraph></paragraph><paragraph id="ID4fa05e559e734d1faa8825a4dde85c33"><enum>(2)</enum><header>Adequacy of the
			 Department of the Interior's legislative environmental impact
			 statement</header><text>The Final Statement shall be considered to satisfy the
			 requirements under the National Environmental Policy Act of 1969 (42 U.S.C.
			 4321 et seq.) that apply with respect to pre-leasing activities, including
			 exploration programs and actions authorized to be taken by the Secretary to
			 develop and promulgate the regulations for the establishment of a leasing
			 program authorized by this subtitle before the conduct of the first lease
			 sale.</text>
						</paragraph><paragraph id="IDc9c33801be56487ea69bb3d121ba170a"><enum>(3)</enum><header>Compliance with
			 NEPA for other actions</header>
							<subparagraph id="id58B4D63A74CD4B12B826D98F1EDD7B85"><enum>(A)</enum><header>In
			 general</header><text>Before conducting the first lease sale under this
			 subtitle, the Secretary shall prepare an environmental impact statement in
			 accordance with the National Environmental Policy Act of 1969 (42 U.S.C. 4321
			 et seq.) with respect to the actions authorized by this subtitle that are not
			 referred to in paragraph (2).</text>
							</subparagraph><subparagraph id="idE072FF63C9B04A1F86A81679413C7D3B"><enum>(B)</enum><header>Identification
			 and analysis</header><text>Notwithstanding any other provision of law, in
			 carrying out this paragraph, the Secretary shall not be required—</text>
								<clause id="id32FC1DCC7290454BB571E2BED9C2B5AD"><enum>(i)</enum><text>to
			 identify nonleasing alternative courses of action; or</text>
								</clause><clause id="id54B6AAF2B8264C66AB16975798047C6A"><enum>(ii)</enum><text>to
			 analyze the environmental effects of those courses of action.</text>
								</clause></subparagraph><subparagraph id="idC16C34F9411A4F729983001D4F5B5914"><enum>(C)</enum><header>Identification
			 of preferred action</header><text>Not later than 18 months after the date of
			 enactment of this Act, the Secretary shall—</text>
								<clause id="id619D79F7D9254C74B941FE27B49A9656"><enum>(i)</enum><text>identify only a
			 preferred action and a single leasing alternative for the first lease sale
			 authorized under this subtitle; and</text>
								</clause><clause id="id85BAA185EFA54D098F9A9A4E1B4A2887"><enum>(ii)</enum><text>analyze the
			 environmental effects and potential mitigation measures for those 2
			 alternatives.</text>
								</clause></subparagraph><subparagraph id="id5B392E9F691E4223B39E53A046632169"><enum>(D)</enum><header>Public
			 comments</header><text>In carrying out this paragraph, the Secretary shall
			 consider only public comments that are filed not later than 20 days after the
			 date of publication of a draft environmental impact statement.</text>
							</subparagraph><subparagraph id="idED29943597F84BBBA395A966C2D45BDF"><enum>(E)</enum><header>Effect of
			 compliance</header><text>Notwithstanding any other provision of law, compliance
			 with this paragraph shall be considered to satisfy all requirements for the
			 analysis and consideration of the environmental effects of proposed leasing
			 under this subtitle.</text>
							</subparagraph></paragraph></subsection><subsection id="IDf17426dfa4954f3f8d395b5a95226c8c"><enum>(d)</enum><header>Relationship to
			 State and local authority</header><text>Nothing in this subtitle expands or
			 limits any State or local regulatory authority.</text>
					</subsection><subsection id="ID0e2a553b76db42848ec3541b94d1440d"><enum>(e)</enum><header>Special
			 areas</header>
						<paragraph id="id1D4EF748A8DC434A94B719E1CA22D277"><enum>(1)</enum><header>Designation</header>
							<subparagraph id="IDf5e37611b01b4a418ee7aca0de84af93"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, after consultation with the State of
			 Alaska, the North Slope Borough, Alaska, and the City of Kaktovik, Alaska, may
			 designate not more than 45,000 acres of the Coastal Plain as a special area if
			 the Secretary determines that the special area would be of such unique
			 character and interest as to require special management and regulatory
			 protection.</text>
							</subparagraph><subparagraph id="id163A0C6AF68747728ABC486CB4926F83"><enum>(B)</enum><header>Sadlerochit
			 spring area</header><text>The Secretary shall designate as a special area in
			 accordance with subparagraph (A) the Sadlerochit Spring area, comprising
			 approximately 4,000 acres as depicted on the map.</text>
							</subparagraph></paragraph><paragraph id="IDb1be8a81a93e4b40a91e6251d7cb7eef"><enum>(2)</enum><header>Management</header><text>The
			 Secretary shall manage each special area designated under this subsection in a
			 manner that—</text>
							<subparagraph id="idEA406688D44747D4AAB038D86F5B0A8A"><enum>(A)</enum><text>respects and
			 protects the Native people of the area; and</text>
							</subparagraph><subparagraph id="id1B9E7652FBAC4C5CB1354A5A410ADA1E"><enum>(B)</enum><text>preserves the
			 unique and diverse character of the area, including fish, wildlife, subsistence
			 resources, and cultural values of the area.</text>
							</subparagraph></paragraph><paragraph id="ID8ba091fcac394106a2eb17243fa29cdd"><enum>(3)</enum><header>Exclusion from
			 leasing or surface occupancy</header>
							<subparagraph id="id7C258B7A710441F3942F06D928375F8E"><enum>(A)</enum><header>In
			 general</header><text>The Secretary may exclude any special area designated
			 under this subsection from leasing.</text>
							</subparagraph><subparagraph id="id126D9EEC119D4CABA6B947FB9CA6A4CA"><enum>(B)</enum><header>No surface
			 occupancy</header><text>If the Secretary leases all or a portion of a special
			 area for the purposes of oil and gas exploration, development, production, and
			 related activities, there shall be no surface occupancy of the land comprising
			 the special area.</text>
							</subparagraph></paragraph><paragraph id="ID6dd021eea4c8465380569ed6e78b25db"><enum>(4)</enum><header>Directional
			 drilling</header><text>Notwithstanding any other provision of this subsection,
			 the Secretary may lease all or a portion of a special area under terms that
			 permit the use of horizontal drilling technology from sites on leases located
			 outside the special area.</text>
						</paragraph></subsection><subsection id="ID49ac219709474e86a2d7555bdaac5880"><enum>(f)</enum><header>Limitation on
			 closed areas</header><text>The Secretary may not close land within the Coastal
			 Plain to oil and gas leasing or to exploration, development, or production
			 except in accordance with this subtitle.</text>
					</subsection><subsection id="IDc589dfa72cd84a7c9619327f1b7185f0"><enum>(g)</enum><header>Regulations</header>
						<paragraph id="ID09118b3f361445a483f7400048bbe3eb"><enum>(1)</enum><header>In
			 general</header><text>Not later than 15 months after the date of enactment of
			 this Act, in consultation with appropriate agencies of the State of Alaska, the
			 North Slope Borough, Alaska, and the City of Kaktovik, Alaska, the Secretary
			 shall issue such regulations as are necessary to carry out this subtitle,
			 including rules and regulations relating to protection of the fish and
			 wildlife, fish and wildlife habitat, and subsistence resources of the Coastal
			 Plain.</text>
						</paragraph><paragraph id="IDa6d51b9f38a24fc4ac96f0f86cd6242f"><enum>(2)</enum><header>Revision of
			 regulations</header><text>The Secretary may periodically review and, as
			 appropriate, revise the rules and regulations issued under paragraph (1) to
			 reflect any significant scientific or engineering data that come to the
			 attention of the Secretary.</text>
						</paragraph></subsection></section><section id="ID8f083be956fc419cbbb4ac31e61f5e17"><enum>113.</enum><header>Lease
			 sales</header>
					<subsection id="IDaf799b786e5941a090af9afe6dddc7a0"><enum>(a)</enum><header>In
			 general</header><text>Land may be leased pursuant to this subtitle to any
			 person qualified to obtain a lease for deposits of oil and gas under the
			 Mineral Leasing Act (30 U.S.C. 181 et seq.).</text>
					</subsection><subsection id="IDb4d5cafd05b84535a8b89784bb30816c"><enum>(b)</enum><header>Procedures</header><text>The
			 Secretary shall, by regulation, establish procedures for—</text>
						<paragraph id="ID4c6cb6fc02084e5f8e00a5778dfdd944"><enum>(1)</enum><text>receipt and
			 consideration of sealed nominations for any area in the Coastal Plain for
			 inclusion in, or exclusion (as provided in subsection (c)) from, a lease
			 sale;</text>
						</paragraph><paragraph id="IDce73189744f149b6ba8e61bb4236f981"><enum>(2)</enum><text>the holding of
			 lease sales after that nomination process; and</text>
						</paragraph><paragraph id="IDb15e3d8ae8924d66b3715fdaf0d700d0"><enum>(3)</enum><text>public notice of
			 and comment on designation of areas to be included in, or excluded from, a
			 lease sale.</text>
						</paragraph></subsection><subsection id="IDe854008a3ca940fbb22b56c48393eeb8"><enum>(c)</enum><header>Lease sale
			 bids</header><text>Bidding for leases under this subtitle shall be by sealed
			 competitive cash bonus bids.</text>
					</subsection><subsection id="IDfb6ed3126a6f4cbea6b9c1460ba3eaf3"><enum>(d)</enum><header>Acreage minimum
			 in first sale</header><text>For the first lease sale under this subtitle, the
			 Secretary shall offer for lease those tracts the Secretary considers to have
			 the greatest potential for the discovery of hydrocarbons, taking into
			 consideration nominations received pursuant to subsection (b)(1), but in no
			 case less than 200,000 acres.</text>
					</subsection><subsection id="ID451642a2031f4e9c97e51ad373a0baa5"><enum>(e)</enum><header>Timing of lease
			 sales</header><text>The Secretary shall—</text>
						<paragraph id="IDfb26f6e16da348eea13a35a51f8d4903"><enum>(1)</enum><text>not later than 22
			 months after the date of enactment of this Act, conduct the first lease sale
			 under this subtitle;</text>
						</paragraph><paragraph id="ID41b70e7134ba47f6817bb1d64d36ee44"><enum>(2)</enum><text>not later than
			 September 30, 2012, conduct a second lease sale under this subtitle; and</text>
						</paragraph><paragraph id="IDe436a53f45964f049ae18388d3edcc54"><enum>(3)</enum><text>conduct
			 additional sales at appropriate intervals if sufficient interest in exploration
			 or development exists to warrant the conduct of the additional sales.</text>
						</paragraph></subsection></section><section id="IDb8b851cd962e49b6b39ccf738d779f00"><enum>114.</enum><header>Grant of
			 leases by the Secretary</header>
					<subsection id="ID5c0caed57f8c49d1acf56ef960755dfc"><enum>(a)</enum><header>In
			 general</header><text>Upon payment by a lessee of such bonus as may be accepted
			 by the Secretary, the Secretary may grant to the highest responsible qualified
			 bidder in a lease sale conducted pursuant to section 113 a lease for any land
			 on the Coastal Plain.</text>
					</subsection><subsection id="ID4b130bd6c66948f2bcb59274df4496b4"><enum>(b)</enum><header>Subsequent
			 transfers</header>
						<paragraph id="id4F4FAB88EBA14631A3E84B15A23FFAED"><enum>(1)</enum><header>In
			 general</header><text>No lease issued under this subtitle may be sold,
			 exchanged, assigned, sublet, or otherwise transferred except with the approval
			 of the Secretary.</text>
						</paragraph><paragraph id="id0CB39DCA414F40BAB8539D8C50246114"><enum>(2)</enum><header>Condition for
			 approval</header><text>Before granting any approval described in paragraph (1),
			 the Secretary shall consult with and give due consideration to the opinion of
			 the Attorney General.</text>
						</paragraph></subsection></section><section id="IDefd6e12ef8514bde89de0dc2fc2d109b"><enum>115.</enum><header>Lease terms
			 and conditions</header>
					<subsection id="ID2c4b6f82f115481b979d65e939387b27"><enum>(a)</enum><header>In
			 general</header><text>An oil or gas lease issued pursuant to this subtitle
			 shall—</text>
						<paragraph id="ID99a284cde5b3476da3759f9388b97e15"><enum>(1)</enum><text>provide for the
			 payment of a royalty of not less than 16½ percent of the amount or value of the
			 production removed or sold from the lease, as determined by the Secretary in
			 accordance with regulations applicable to other Federal oil and gas
			 leases;</text>
						</paragraph><paragraph id="ID7c352925494d4ded86a3241e04f725db"><enum>(2)</enum><text>provide that the
			 Secretary may close, on a seasonal basis, such portions of the Coastal Plain to
			 exploratory drilling activities as are necessary to protect caribou calving
			 areas and other species of fish and wildlife;</text>
						</paragraph><paragraph id="ID12531e09e5e04d8484f5cb2304fcbe4d"><enum>(3)</enum><text>require that each
			 lessee of land within the Coastal Plain shall be fully responsible and liable
			 for the reclamation of land within the Coastal Plain and any other Federal land
			 that is adversely affected in connection with exploration, development,
			 production, or transportation activities within the Coastal Plain conducted by
			 the lessee or by any of the subcontractors or agents of the lessee;</text>
						</paragraph><paragraph id="ID6c1f792c77c648b4b9840b87bd00a02a"><enum>(4)</enum><text>provide that the
			 lessee may not delegate or convey, by contract or otherwise, that reclamation
			 responsibility and liability to another person without the express written
			 approval of the Secretary;</text>
						</paragraph><paragraph id="ID3060d755055e46be8b211470f4046a8a"><enum>(5)</enum><text>provide that the
			 standard of reclamation for land required to be reclaimed under this subtitle
			 shall be, to the maximum extent practicable—</text>
							<subparagraph id="id6B5C33D881294161A937C4895D5B4881"><enum>(A)</enum><text>a condition
			 capable of supporting the uses that the land was capable of supporting prior to
			 any exploration, development, or production activities; or</text>
							</subparagraph><subparagraph id="id2021C7D1A56A4CAEB0EE43B9CCBFE588"><enum>(B)</enum><text>upon application
			 by the lessee, to a higher or better standard, as approved by the
			 Secretary;</text>
							</subparagraph></paragraph><paragraph id="ID4560710656704623bde65435189c5ad6"><enum>(6)</enum><text>contain terms and
			 conditions relating to protection of fish and wildlife, fish and wildlife
			 habitat, subsistence resources, and the environment as required under section
			 112(a)(2);</text>
						</paragraph><paragraph id="ID69c6485d0e1745ea8568a456438bd671"><enum>(7)</enum><text>provide that each
			 lessee, and each agent and contractor of a lessee, use their best efforts to
			 provide a fair share of employment and contracting for Alaska Natives and
			 Alaska Native Corporations from throughout the State of Alaska, as determined
			 by the level of obligation previously agreed to in the Federal Agreement;
			 and</text>
						</paragraph><paragraph id="ID9fcfb0479bb349a6b7e75debadc38844"><enum>(8)</enum><text>contain such
			 other provisions as the Secretary determines to be necessary to ensure
			 compliance with this subtitle and regulations issued under this
			 subtitle.</text>
						</paragraph></subsection><subsection id="ID6663471783d1446d833e06af08e1c06d"><enum>(b)</enum><header>Project labor
			 agreements</header><text>The Secretary, as a term and condition of each lease
			 under this subtitle, and in recognizing the proprietary interest of the Federal
			 Government in labor stability and in the ability of construction labor and
			 management to meet the particular needs and conditions of projects to be
			 developed under the leases issued pursuant to this subtitle (including the
			 special concerns of the parties to those leases), shall require that each
			 lessee, and each agent and contractor of a lessee, under this subtitle
			 negotiate to obtain a project labor agreement for the employment of laborers
			 and mechanics on production, maintenance, and construction under the
			 lease.</text>
					</subsection></section><section id="IDb715d31383244a52b20e661ef6f5a528"><enum>116.</enum><header>Coastal Plain
			 environmental protection</header>
					<subsection id="ID0ea79d2df5a34851aaa6e0778b4ab21e"><enum>(a)</enum><header>No significant
			 adverse effect standard To govern authorized coastal plain
			 activities</header><text>In accordance with section 112, the Secretary shall
			 administer this subtitle through regulations, lease terms, conditions,
			 restrictions, prohibitions, stipulations, or other provisions that—</text>
						<paragraph id="ID711ba77b4f5849f9a88d98c077d75b28"><enum>(1)</enum><text>ensure, to the
			 maximum extent practicable, that oil and gas exploration, development, and
			 production activities on the Coastal Plain will result in no significant
			 adverse effect on fish and wildlife, fish and wildlife habitat, and the
			 environment;</text>
						</paragraph><paragraph id="ID0b9f5988d7c04622883b4ab7be8a298e"><enum>(2)</enum><text>require the
			 application of the best commercially available technology for oil and gas
			 exploration, development, and production on all new exploration, development,
			 and production operations; and</text>
						</paragraph><paragraph id="IDb38f9619683f4a55b58ac9ecdac562ed"><enum>(3)</enum><text>ensure that the
			 maximum surface acreage covered in connection with the leasing program by
			 production and support facilities, including airstrips and any areas covered by
			 gravel berms or piers for support of pipelines, does not exceed 2,000 acres on
			 the Coastal Plain.</text>
						</paragraph></subsection><subsection id="IDd4930e0ae9b74cf280455841be21b9d5"><enum>(b)</enum><header>Site-specific
			 assessment and mitigation</header><text>The Secretary shall require, with
			 respect to any proposed drilling and related activities on the Coastal Plain,
			 that—</text>
						<paragraph id="ID789ea94bb3a94f6a9982ef42ec5cc4f6"><enum>(1)</enum><text>a site-specific
			 environmental analysis be made of the probable effects, if any, that the
			 drilling or related activities will have on fish and wildlife, fish and
			 wildlife habitat, subsistence resources, subsistence uses, and the
			 environment;</text>
						</paragraph><paragraph id="IDc79d60d288384a7d869ead77d2952724"><enum>(2)</enum><text>a plan be
			 implemented to avoid, minimize, and mitigate (in that order and to the maximum
			 extent practicable) any significant adverse effect identified under paragraph
			 (1); and</text>
						</paragraph><paragraph id="ID9719dd88ca734f5ca4d9b2f5a6fbeab4"><enum>(3)</enum><text>the development
			 of the plan occur after consultation with—</text>
							<subparagraph id="id034C2CB7F6B44AA9928B076CAB3A662D"><enum>(A)</enum><text>each agency
			 having jurisdiction over matters mitigated by the plan;</text>
							</subparagraph><subparagraph id="idEBEDC83241764C8D871E44EFEEF2FABF"><enum>(B)</enum><text>the State of
			 Alaska;</text>
							</subparagraph><subparagraph id="id38D2E4228E174E768B49CC152051E8BA"><enum>(C)</enum><text>North Slope
			 Borough, Alaska; and</text>
							</subparagraph><subparagraph id="id2E4A3F8839A34882B65538E7C1F8EFD9"><enum>(D)</enum><text>the City of
			 Kaktovik, Alaska.</text>
							</subparagraph></paragraph></subsection><subsection id="IDa5193f629bb740ce9cb252e8b3b2f94d"><enum>(c)</enum><header>Regulations To
			 protect Coastal Plain fish and wildlife resources, subsistence users, and the
			 environment</header><text>Before implementing the leasing program authorized by
			 this subtitle, the Secretary shall prepare and issue regulations, lease terms,
			 conditions, restrictions, prohibitions, stipulations, or other measures
			 designed to ensure, to the maximum extent practicable, that the activities
			 carried out on the Coastal Plain under this subtitle are conducted in a manner
			 consistent with the purposes and environmental requirements of this
			 subtitle.</text>
					</subsection><subsection id="ID3cc7a9ba70884dfdb094ea50e15ab9ab"><enum>(d)</enum><header>Compliance with
			 Federal and State environmental laws and other requirements</header><text>The
			 proposed regulations, lease terms, conditions, restrictions, prohibitions, and
			 stipulations for the leasing program under this subtitle shall require—</text>
						<paragraph id="id620EEE5785EF40D8850FDF89C4F1E19D"><enum>(1)</enum><text>compliance with
			 all applicable provisions of Federal and State environmental law (including
			 regulations);</text>
						</paragraph><paragraph id="ID8b865e509bf14068bd041ca997bda418"><enum>(2)</enum><text>implementation of
			 and compliance with—</text>
							<subparagraph id="idCB8F04702D624A939D41FF8CAFADF5CF"><enum>(A)</enum><text>standards that
			 are at least as effective as the safety and environmental mitigation measures,
			 as described in items 1 through 29 on pages 167 through 169 of the Final
			 Statement, on the Coastal Plain;</text>
							</subparagraph><subparagraph id="IDe9165eed88e2424e8a19e05ab26c5839"><enum>(B)</enum><text>seasonal
			 limitations on exploration, development, and related activities, as necessary,
			 to avoid significant adverse effects during periods of concentrated fish and
			 wildlife breeding, denning, nesting, spawning, and migration;</text>
							</subparagraph><subparagraph id="ID0b8483d24ce740b5bcbe4bac18991e57"><enum>(C)</enum><text>design safety and
			 construction standards for all pipelines and any access and service roads that
			 minimize, to the maximum extent practicable, adverse effects on—</text>
								<clause id="ID2b8c3be449e64cb49f8f5b1100f24f12"><enum>(i)</enum><text>the
			 passage of migratory species (such as caribou); and</text>
								</clause><clause id="ID55dd2f4c979f4a1a8c83f17ba1295df2"><enum>(ii)</enum><text>the flow of
			 surface water by requiring the use of culverts, bridges, or other structural
			 devices;</text>
								</clause></subparagraph><subparagraph id="ID19993ae94dce4107b3895644a9534d23"><enum>(D)</enum><text>prohibitions on
			 general public access to, and use of, all pipeline access and service
			 roads;</text>
							</subparagraph><subparagraph id="ID4cc920810b6b4aa5b227414069803416"><enum>(E)</enum><text>stringent
			 reclamation and rehabilitation requirements in accordance with this subtitle
			 for the removal from the Coastal Plain of all oil and gas development and
			 production facilities, structures, and equipment on completion of oil and gas
			 production operations, except in a case in which the Secretary determines that
			 those facilities, structures, or equipment—</text>
								<clause id="id0EB7CBD2EC714E2182214043A940CF3D"><enum>(i)</enum><text>would assist in
			 the management of the Arctic National Wildlife Refuge; and</text>
								</clause><clause id="id23CF756FB8B447A785B3D256F11F9BC0"><enum>(ii)</enum><text>are donated to
			 the United States for that purpose;</text>
								</clause></subparagraph><subparagraph id="IDcc46738c824d452b99afc634e9354d38"><enum>(F)</enum><text>appropriate
			 prohibitions or restrictions on—</text>
								<clause id="idFBC0D71CD7814A2EAB3D7F060CF6D462"><enum>(i)</enum><text>access by all
			 modes of transportation;</text>
								</clause><clause id="IDca4bc0b248a34cc5a937078e57c3a253"><enum>(ii)</enum><text>sand and gravel
			 extraction; and</text>
								</clause><clause id="IDdd8a1a8957ca4461883f1ad76c641784"><enum>(iii)</enum><text>use of
			 explosives;</text>
								</clause></subparagraph><subparagraph id="id6CE025E0CD404BF88027807155AF857F"><enum>(G)</enum><text>reasonable
			 stipulations for protection of cultural and archaeological resources;</text>
							</subparagraph><subparagraph id="ID4fee42d5679347e78854b2350dc8a745"><enum>(H)</enum><text>measures to
			 protect groundwater and surface water, including—</text>
								<clause id="id9956E27C49EF4C33B722CCD8627D9D06"><enum>(i)</enum><text>avoidance, to the
			 maximum extent practicable, of springs, streams, and river systems;</text>
								</clause><clause id="id82D4F9628CA64C12B6409DA75975003A"><enum>(ii)</enum><text>the protection
			 of natural surface drainage patterns and wetland and riparian habitats;
			 and</text>
								</clause><clause id="idB5ED6757D5CC4ABEB241F4A0C8F03DC7"><enum>(iii)</enum><text>the regulation
			 of methods or techniques for developing or transporting adequate supplies of
			 water for exploratory drilling; and</text>
								</clause></subparagraph><subparagraph id="IDcbc5bd2e0a514e748f28f950c7030587"><enum>(I)</enum><text>research,
			 monitoring, and reporting requirements;</text>
							</subparagraph></paragraph><paragraph id="ID678ada9890894beea69931d06cc07038"><enum>(3)</enum><text>that exploration
			 activities (except surface geological studies) be limited to the period between
			 approximately November 1 and May 1 of each year and be supported, if necessary,
			 by ice roads, winter trails with adequate snow cover, ice pads, ice airstrips,
			 and air transport methods (except that those exploration activities may be
			 permitted at other times if the Secretary determines that the exploration will
			 have no significant adverse effect on fish and wildlife, fish and wildlife
			 habitat, subsistence resources, and the environment of the Coastal
			 Plain);</text>
						</paragraph><paragraph id="ID090f709ffd714caf9b9b94fcc07a3e7a"><enum>(4)</enum><text>consolidation of
			 facility siting;</text>
						</paragraph><paragraph id="IDd73e973a046a4a6588536900ba028d6a"><enum>(5)</enum><text>avoidance or
			 reduction of air traffic-related disturbance to fish and wildlife;</text>
						</paragraph><paragraph id="ID205b0482e66b4d998cf2509f199cb92d"><enum>(6)</enum><text>treatment and
			 disposal of hazardous and toxic wastes, solid wastes, reserve pit fluids,
			 drilling muds and cuttings, and domestic wastewater, including, in accordance
			 with applicable Federal and State environmental laws (including
			 regulations)—</text>
							<subparagraph id="id04E1B396245C455AB38AD05A982529F1"><enum>(A)</enum><text>preparation of an
			 annual waste management report;</text>
							</subparagraph><subparagraph id="id798B032B4DF94C568DA8020494F0E62B"><enum>(B)</enum><text>development and
			 implementation of a hazardous materials tracking system; and</text>
							</subparagraph><subparagraph id="id4E8AA82501524E9DAFC657F74F27F15A"><enum>(C)</enum><text>prohibition on
			 the use of chlorinated solvents;</text>
							</subparagraph></paragraph><paragraph id="ID8633060b0fe64699966dd298989a8bbe"><enum>(7)</enum><text>fuel storage and
			 oil spill contingency planning;</text>
						</paragraph><paragraph id="ID0fd8e2c5a8ac4935a9bc9d2badd5f4c6"><enum>(8)</enum><text>conduct of
			 periodic field crew environmental briefings;</text>
						</paragraph><paragraph id="IDc6d77aa1707c4d1bb51ddf63cb43ac58"><enum>(9)</enum><text>avoidance of
			 significant adverse effects on subsistence hunting, fishing, and
			 trapping;</text>
						</paragraph><paragraph id="ID68c82c6063cd4bed89a5de385d8ca6bd"><enum>(10)</enum><text>compliance with
			 applicable air and water quality standards;</text>
						</paragraph><paragraph id="ID235d299d05cf4cc78401f7afc99104f7"><enum>(11)</enum><text>appropriate
			 seasonal and safety zone designations around well sites, within which
			 subsistence hunting and trapping shall be limited; and</text>
						</paragraph><paragraph id="IDe46a8b7bb1e342a68e289dd19db4196e"><enum>(12)</enum><text>development and
			 implementation of such other protective environmental requirements,
			 restrictions, terms, or conditions as the Secretary, after consultation with
			 the State of Alaska, North Slope Borough, Alaska, and the City of Kaktovik,
			 Alaska, determines to be necessary.</text>
						</paragraph></subsection><subsection id="ID68412f6ad5284f18ae60db81260e8063"><enum>(e)</enum><header>Considerations</header><text>In
			 preparing and issuing regulations, lease terms, conditions, restrictions,
			 prohibitions, or stipulations under this section, the Secretary shall take into
			 consideration—</text>
						<paragraph id="IDcb62e68e1d2e48f099fd7a4f86f92a48"><enum>(1)</enum><text>the stipulations
			 and conditions that govern the National Petroleum Reserve-Alaska leasing
			 program, as set forth in the 1999 Northeast National Petroleum Reserve-Alaska
			 Final Integrated Activity Plan/Environmental Impact Statement;</text>
						</paragraph><paragraph id="ID61dc68011e874ca199d5c88c80675d5c"><enum>(2)</enum><text>the environmental
			 protection standards that governed the initial Coastal Plain seismic
			 exploration program under parts 37.31 through 37.33 of title 50, Code of
			 Federal Regulations (or successor regulations); and</text>
						</paragraph><paragraph id="ID1abd4586c22742d58414fb4f8cd79e5f"><enum>(3)</enum><text>the land use
			 stipulations for exploratory drilling on the KIC–ASRC private land described in
			 Appendix 2 of the agreement between Arctic Slope Regional Corporation and the
			 United States dated August 9, 1983.</text>
						</paragraph></subsection><subsection id="ID4c8244c65e144c7696f84be6fd05788d"><enum>(f)</enum><header>Facility
			 consolidation planning</header>
						<paragraph id="ID9f4ea36f548c4e8e96948462ebc1562a"><enum>(1)</enum><header>In
			 general</header><text>After providing for public notice and comment, the
			 Secretary shall prepare and periodically update a plan to govern, guide, and
			 direct the siting and construction of facilities for the exploration,
			 development, production, and transportation of oil and gas resources from the
			 Coastal Plain.</text>
						</paragraph><paragraph id="ID3c6e56eebe0c4afebc2e67fdde4e4bd7"><enum>(2)</enum><header>Objectives</header><text>The
			 objectives of the plan shall be—</text>
							<subparagraph id="ID622dd8991d8a4a9cae7a98f22264a735"><enum>(A)</enum><text>the avoidance of
			 unnecessary duplication of facilities and activities;</text>
							</subparagraph><subparagraph id="ID134cd9af26e448229787ce393e2c3900"><enum>(B)</enum><text>the encouragement
			 of consolidation of common facilities and activities;</text>
							</subparagraph><subparagraph id="IDabde34cacd9d4989966db5c17b9721c4"><enum>(C)</enum><text>the location or
			 confinement of facilities and activities to areas that will minimize impact on
			 fish and wildlife, fish and wildlife habitat, subsistence resources, and the
			 environment;</text>
							</subparagraph><subparagraph id="ID7a79e9f08a3e43d7bd926687c3eceafc"><enum>(D)</enum><text>the use of
			 existing facilities, to the maximum extent practicable; and</text>
							</subparagraph><subparagraph id="IDb5f2af0eab2d4a75832aa4ca49bc7680"><enum>(E)</enum><text>the enhancement
			 of compatibility between wildlife values and development activities.</text>
							</subparagraph></paragraph></subsection><subsection id="IDad933e1fbdcd4744868fc25761e6ee9c"><enum>(g)</enum><header>Access to
			 public land</header><text>The Secretary shall—</text>
						<paragraph id="IDe691d89c04c14d7a933450bcc88646c5"><enum>(1)</enum><text>manage public
			 land in the Coastal Plain in accordance with subsections (a) and (b) of section
			 811 of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3121);
			 and</text>
						</paragraph><paragraph id="ID24114d61ed5e4b73bb7ca40db4e7bf28"><enum>(2)</enum><text>ensure that local
			 residents shall have reasonable access to public land in the Coastal Plain for
			 traditional uses.</text>
						</paragraph></subsection></section><section id="IDabe49cb9c91543bb8c1613eed64ffe1d"><enum>117.</enum><header>Expedited
			 judicial review</header>
					<subsection id="IDaac165196dcc47c08172e94ee8f7f17c"><enum>(a)</enum><header>Filing of
			 complaints</header>
						<paragraph id="IDf0f0cdb441cb4270b63bf136dc0ae58d"><enum>(1)</enum><header>Deadline</header><text>A
			 complaint seeking judicial review of a provision of this subtitle or an action
			 of the Secretary under this subtitle shall be filed—</text>
							<subparagraph id="IDcd58dddc953b4e50b1ad9eda0a1a5a2b"><enum>(A)</enum><text>except as
			 provided in subparagraph (B), during the 90-day period beginning on the date on
			 which the action being challenged was carried out; or</text>
							</subparagraph><subparagraph id="IDb9895e217e5e42218efc94dbc12402bd"><enum>(B)</enum><text>in the case of a
			 complaint based solely on grounds arising after the 90-day period described in
			 subparagraph (A), during the 90-day period beginning on the date on which the
			 complainant knew or reasonably should have known about the grounds for the
			 complaint.</text>
							</subparagraph></paragraph><paragraph id="ID5309f73742c6485bbace4f043028dd9f"><enum>(2)</enum><header>Venue</header><text>A
			 complaint seeking judicial review of a provision of this subtitle or an action
			 of the Secretary under this subtitle shall be filed in the United States Court
			 of Appeals for the District of Columbia.</text>
						</paragraph><paragraph id="ID2a947954207a4f9e92c9130123d648fe"><enum>(3)</enum><header>Scope</header>
							<subparagraph id="id49233FFDEC724D4F950F17B884C8051E"><enum>(A)</enum><header>In
			 general</header><text>Judicial review of a decision of the Secretary under this
			 subtitle (including an environmental analysis of such a lease sale) shall
			 be—</text>
								<clause id="idE3ACD539AD864F6B9E241D607C94092E"><enum>(i)</enum><text>limited to a
			 review of whether the decision is in accordance with this subtitle; and</text>
								</clause><clause id="idBD7ECACEB4EB48BCAD13693527C6A765"><enum>(ii)</enum><text>based on the
			 administrative record of the decision.</text>
								</clause></subparagraph><subparagraph id="idF4D50F3FD46D408B8FCDDF4E01F61348"><enum>(B)</enum><header>Presumptions</header><text>Any
			 identification by the Secretary of a preferred course of action relating to a
			 lease sale, and any analysis by the Secretary of environmental effects, under
			 this subtitle shall be presumed to be correct unless proven otherwise by clear
			 and convincing evidence.</text>
							</subparagraph></paragraph></subsection><subsection id="ID851c400e078e419594e73580633d0559"><enum>(b)</enum><header>Limitation on
			 other review</header><text>Any action of the Secretary that is subject to
			 judicial review under this section shall not be subject to judicial review in
			 any civil or criminal proceeding for enforcement.</text>
					</subsection></section><section id="IDfb526f6f4f9845e1bc3339dea8f4b46b"><enum>118.</enum><header>Rights-of-way
			 and easements across Coastal Plain</header><text display-inline="no-display-inline">For purposes of section 1102(4)(A) of the
			 Alaska National Interest Lands Conservation Act (16 U.S.C. 3162(4)(A)), any
			 rights-of-way or easements across the Coastal Plain for the exploration,
			 development, production, or transportation of oil and gas shall be considered
			 to be established incident to the management of the Coastal Plain under this
			 section.</text>
				</section><section id="ID39c37018eb834d63b4a3222d0df30589"><enum>119.</enum><header>Conveyance</header><text display-inline="no-display-inline">Notwithstanding section 1302(h)(2) of the
			 Alaska National Interest Lands Conservation Act (16 U.S.C. 3192(h)(2)), to
			 remove any cloud on title to land, and to clarify land ownership patterns in
			 the Coastal Plain, the Secretary shall—</text>
					<paragraph id="ID8b13eca8b9e4414c89ad2830a1bace2f"><enum>(1)</enum><text>to the extent
			 necessary to fulfill the entitlement of the Kaktovik Inupiat Corporation under
			 sections 12 and 14 of the Alaska Native Claims Settlement Act (43 U.S.C. 1611,
			 1613), as determined by the Secretary, convey to that Corporation the surface
			 estate of the land described in paragraph (1) of Public Land Order 6959, in
			 accordance with the terms and conditions of the agreement between the
			 Secretary, the United States Fish and Wildlife Service, the Bureau of Land
			 Management, and the Kaktovik Inupiat Corporation, dated January 22, 1993;
			 and</text>
					</paragraph><paragraph id="IDf5a9b0ad60314024b710654412ee8daf"><enum>(2)</enum><text>convey to the
			 Arctic Slope Regional Corporation the remaining subsurface estate to which that
			 Corporation is entitled under the agreement between that corporation and the
			 United States, dated August 9, 1983.</text>
					</paragraph></section><section id="ID0708914299e840138477871c48961f45"><enum>120.</enum><header>Local
			 government impact aid and community service assistance</header>
					<subsection id="IDb5ae7673346c4fdf89bc087fc2687809"><enum>(a)</enum><header>Establishment
			 of Fund</header>
						<paragraph id="ID78c71b619ab941bf8412b1c2abee73c8"><enum>(1)</enum><header>In
			 general</header><text>As a condition on the receipt of funds under section
			 122(2), the State of Alaska shall establish in the treasury of the State, and
			 administer in accordance with this section, a fund to be known as the
			 <quote>Coastal Plain Local Government Impact Aid Assistance Fund</quote>
			 (referred to in this section as the <term>Fund</term>).</text>
						</paragraph><paragraph id="IDa55cc278bd2f4570ba8c8a80b613614c"><enum>(2)</enum><header>Deposits</header><text>Subject
			 to paragraph (1), the Secretary of the Treasury shall deposit into the Fund,
			 $35,000,000 each year from the amount available under section 122(2)(A).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3c48b4801e1641038a98df2f2d6ca6af"><enum>(3)</enum><header>Investment</header><text>The
			 Governor of the State of Alaska (referred to in this section as the
			 <term>Governor</term>) shall invest amounts in the Fund in interest-bearing
			 securities of the United States or the State of Alaska.</text>
						</paragraph></subsection><subsection id="ID8250c2d120f54c7aad76f77cfe30693e"><enum>(b)</enum><header>Assistance</header><text>The
			 Governor, in cooperation with the Mayor of the North Slope Borough, shall use
			 amounts in the Fund to provide assistance to North Slope Borough, Alaska, the
			 City of Kaktovik, Alaska, and any other borough, municipal subdivision,
			 village, or other community in the State of Alaska that is directly impacted by
			 exploration for, or the production of, oil or gas on the Coastal Plain under
			 this subtitle, or any Alaska Native Regional Corporation acting on behalf of
			 the villages and communities within its region whose lands lie along the right
			 of way of the Trans Alaska Pipeline System, as determined by the
			 Governor.</text>
					</subsection><subsection id="id714959CF63CE41F1AB9F8951AE626D42"><enum>(c)</enum><header>Application</header>
						<paragraph id="idE4F33BCE2A3B4508822648DD229869C5"><enum>(1)</enum><header>In
			 general</header><text>To receive assistance under subsection (b), a community
			 or Regional Corporation described in that subsection shall submit to the
			 Governor, or to the Mayor of the North Slope Borough, an application in such
			 time, in such manner, and containing such information as the Governor may
			 require.</text>
						</paragraph><paragraph id="id21AAF14F51AD479C81465720A307CFE2"><enum>(2)</enum><header>Action by North
			 Slope Borough</header><text>The Mayor of the North Slope Borough shall submit
			 to the Governor each application received under paragraph (1) as soon as
			 practicable after the date on which the application is received.</text>
						</paragraph><paragraph id="id3233394518B04016B30167C2CCE903EF"><enum>(3)</enum><header>Assistance of
			 Governor</header><text>The Governor shall assist communities in submitting
			 applications under this subsection, to the maximum extent practicable.</text>
						</paragraph></subsection><subsection id="IDd5d9b4faa2c34a65800a0aebb1d94a84"><enum>(d)</enum><header>Use of
			 funds</header><text>A community or Regional Corporation that receives funds
			 under subsection (b) may use the funds—</text>
						<paragraph id="ID89278db248c24e079ae803e4a9a6bb55"><enum>(1)</enum><text>to plan for
			 mitigation, implement a mitigation plan, or maintain a mitigation project to
			 address the potential effects of oil and gas exploration and development on
			 environmental, social, cultural, recreational, and subsistence resources of the
			 community;</text>
						</paragraph><paragraph id="IDce9e3e927b9442368ba3bc167980faa9"><enum>(2)</enum><text>to develop, carry
			 out, and maintain—</text>
							<subparagraph id="id697424A38FEE4F0EA60ACF62B20A958F"><enum>(A)</enum><text>a project to
			 provide new or expanded public facilities; or</text>
							</subparagraph><subparagraph id="id2AF269E8E89B40F597AFC7F59EC31895"><enum>(B)</enum><text>services to
			 address the needs and problems associated with the effects described in
			 paragraph (1), including firefighting, police, water and waste treatment, first
			 responder, and other medical services;</text>
							</subparagraph></paragraph><paragraph id="ID04db7284c0a3423fa81d0fd2d2da855f"><enum>(3)</enum><text>to compensate
			 residents of the Coastal Plain for significant damage to environmental, social,
			 cultural, recreational, or subsistence resources; and</text>
						</paragraph><paragraph id="IDa3c1ce8e68c0433e989655180b0df2ab"><enum>(4)</enum><text>in the City of
			 Kaktovik, Alaska—</text>
							<subparagraph id="id40C19865CE1F4E02B34C700110BAD779"><enum>(A)</enum><text>to develop a
			 mechanism for providing members of the Kaktovikmiut Inupiat community an
			 opportunity to—</text>
								<clause id="id696655290CFA42E6818492B257480219"><enum>(i)</enum><text>monitor
			 development on the Coastal Plain; and</text>
								</clause><clause id="id3EAC63B52ADD406782FC1EAE8A53038A"><enum>(ii)</enum><text>provide
			 information and recommendations to the Governor based on traditional aboriginal
			 knowledge of the natural resources, flora, fauna, and ecological processes of
			 the Coastal Plain; and</text>
								</clause></subparagraph><subparagraph id="IDbfe908ab4eaa40cf93f764dda7c00bd0"><enum>(B)</enum><text>to establish a
			 local coordination office, to be managed by the Mayor of the North Slope
			 Borough, in coordination with the City of Kaktovik, Alaska—</text>
								<clause id="IDa97f19d1e1db46028106391eb65ae35b"><enum>(i)</enum><text>to
			 coordinate with and advise developers on local conditions and the history of
			 areas affected by development;</text>
								</clause><clause id="IDe90b9505ec244988bcdf1b69a228cbb6"><enum>(ii)</enum><text>to
			 provide to the Committee on Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate annual reports on the
			 status of the coordination between developers and communities affected by
			 development;</text>
								</clause><clause id="IDd6496ad441984f138e1fef8f006b1ec2"><enum>(iii)</enum><text>to collect from
			 residents of the Coastal Plain information regarding the impacts of development
			 on fish, wildlife, habitats, subsistence resources, and the environment of the
			 Coastal Plain; and</text>
								</clause><clause id="id9D97F95183F146BA871E8E18FBF4AEC7"><enum>(iv)</enum><text>to
			 ensure that the information collected under clause (iii) is submitted
			 to—</text>
									<subclause id="idFFF544C94FE446ADBA7EBE510EADB0A1"><enum>(I)</enum><text>developers;
			 and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idB4B65E8C9A814133A164902191EE9268"><enum>(II)</enum><text>any appropriate
			 Federal agency.</text>
									</subclause></clause></subparagraph></paragraph></subsection></section><section id="ID532dbae7f3a448a283f8206f780402dc"><enum>121.</enum><header>Prohibition on
			 exports</header><text display-inline="no-display-inline">An oil or gas lease
			 issued under this subtitle shall prohibit the exportation of oil or gas
			 produced under the lease.</text>
				</section><section id="IDf5b7cf02348b4ef9863860090d7030ad"><enum>122.</enum><header>Allocation of
			 revenues</header><text display-inline="no-display-inline">Notwithstanding the
			 <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (30 U.S.C. 181 et
			 seq.) or any other provision of law, of the adjusted bonus, rental, and royalty
			 receipts from Federal oil and gas leasing and operations authorized under this
			 subtitle:</text>
					<paragraph id="id3B99FC1C32B5463BB88ABDC1C48C557A"><enum>(1)</enum><text display-inline="yes-display-inline">50 percent shall be deposited in the
			 general fund of the Treasury.</text>
					</paragraph><paragraph id="IDe0b4035073ea4e1386f759b807176313"><enum>(2)</enum><text>The remainder
			 shall be available as follows:</text>
						<subparagraph id="id626A9A66DE9A4602A63914A8E067B442"><enum>(A)</enum><text>$35,000,000 shall
			 be deposited by the Secretary of the Treasury into the fund created under
			 section 120(a)(1).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21AFEC4CD6D5411CBC65C01B7AED5513"><enum>(B)</enum><text>The remainder
			 shall be disbursed to the State of Alaska.</text>
						</subparagraph></paragraph></section></subtitle><subtitle id="idC943DE5F872E447581E0A036FA6C93DA"><enum>C</enum><header>Permitting</header>
				<section id="idCE721119937D47CFA8C349B0187F6A9A"><enum>131.</enum><header>Refinery
			 permitting process</header>
					<subsection id="ID2d7f4c8bb7e34f7c9095a0e6d3f5c4c1"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="ID932ba679be0e451daf2c8ee38c2f927c"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
						</paragraph><paragraph id="ID198915a8ea3b47cda230f9441595e90c"><enum>(2)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
						</paragraph><paragraph id="ID5a6b87b7097244238556a45e4e0ee48f"><enum>(3)</enum><header>Permit</header><text>The
			 term <term>permit</term> means any permit, license, approval, variance, or
			 other form of authorization that a refiner is required to obtain—</text>
							<subparagraph id="ID422ba6bfe4e044d3afb1efb3e2e38318"><enum>(A)</enum><text>under any Federal
			 law; or</text>
							</subparagraph><subparagraph id="ID047bc6bd0d674fd5a4bbe822aec136b9"><enum>(B)</enum><text>from a State or
			 Indian tribal government agency delegated authority by the Federal Government,
			 or authorized under Federal law, to issue permits.</text>
							</subparagraph></paragraph><paragraph id="ID6a4fb8971dff432f85e48b3a78bc4147"><enum>(4)</enum><header>Refiner</header><text>The
			 term <term>refiner</term> means a person that—</text>
							<subparagraph id="ID90c93ac3c5ba45c3bd309ee271bd4a0f"><enum>(A)</enum><text>owns or operates
			 a refinery; or</text>
							</subparagraph><subparagraph id="ID0ded2afaa8e24c4a95049a4aed7c5329"><enum>(B)</enum><text>seeks to become
			 an owner or operator of a refinery.</text>
							</subparagraph></paragraph><paragraph id="IDad67c0396733441f9af4d5e6dfbf85e2"><enum>(5)</enum><header>Refinery</header>
							<subparagraph id="ID7a6a156d3d1b4b6fa4f11d59f52bd69c"><enum>(A)</enum><header>In
			 general</header><text>The term <term>refinery</term> means—</text>
								<clause id="ID48e611cb3dc44625aea4d69d48d7ebd7"><enum>(i)</enum><text>a
			 facility at which crude oil is refined into transportation fuel or other
			 petroleum products; and</text>
								</clause><clause id="ID4a8c89875c7641cda6ae8c3fab030d6a"><enum>(ii)</enum><text>a
			 coal liquification or coal-to-liquid facility at which coal is processed into
			 synthetic crude oil or any other fuel.</text>
								</clause></subparagraph><subparagraph id="IDbe0dd41979e34ee6ad04e1c1b02483e4"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>refinery</term> includes an expansion of a refinery.</text>
							</subparagraph></paragraph><paragraph id="IDa036e33c6666420a91da2b8c1c9de8e3"><enum>(6)</enum><header>Refinery
			 expansion</header><text>The term <term>refinery expansion</term> means a
			 physical change in a refinery that results in an increase in the capacity of
			 the refinery.</text>
						</paragraph><paragraph id="ID4dd107488d924a0ca70753eab834da25"><enum>(7)</enum><header>Refinery
			 permitting agreement</header><text>The term <term>refinery permitting
			 agreement</term> means an agreement entered into between the Administrator and
			 a State or Indian tribe under subsection (b).</text>
						</paragraph><paragraph id="ID1dc5cf22fbce4d41bf7b25ad14c96e8f"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
						</paragraph><paragraph id="ID01a322a24c8b4afb89cb57ccbb4c3bc7"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
							<subparagraph id="ID48f967f945444db98017b4b1f1e819ba"><enum>(A)</enum><text>a State;</text>
							</subparagraph><subparagraph id="IDa88a0a9fcc7742b6aefaf9cb9de7df43"><enum>(B)</enum><text>the District of
			 Columbia;</text>
							</subparagraph><subparagraph id="ID7fbe6a60bb9b4180952c9da57ca627d2"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico; and</text>
							</subparagraph><subparagraph id="ID04d372aeb5144ed6a522e8e0b671f063"><enum>(D)</enum><text>any other
			 territory or possession of the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="IDd1b08e50f7a2408198d40ab5d4e498d4"><enum>(b)</enum><header>Streamlining of
			 refinery permitting process</header>
						<paragraph id="ID4aea10b8567449038bf9cd2a2ce0a99e"><enum>(1)</enum><header>In
			 general</header><text>At the request of the Governor of a State or the
			 governing body of an Indian tribe, the Administrator shall enter into a
			 refinery permitting agreement with the State or Indian tribe under which the
			 process for obtaining all permits necessary for the construction and operation
			 of a refinery shall be streamlined using a systematic interdisciplinary
			 multimedia approach as provided in this section.</text>
						</paragraph><paragraph id="IDd0f36dd919014c319e49cdf2bfdc6636"><enum>(2)</enum><header>Authority of
			 Administrator</header><text>Under a refinery permitting agreement—</text>
							<subparagraph id="IDb75b01424dd84e0eb386b99fc0dffb9d"><enum>(A)</enum><text>the Administrator
			 shall have authority, as applicable and necessary, to—</text>
								<clause id="IDf81e1cd421294612a0a969b74534beb2"><enum>(i)</enum><text>accept from a
			 refiner a consolidated application for all permits that the refiner is required
			 to obtain to construct and operate a refinery;</text>
								</clause><clause id="ID685ec046c8f24cb09208b1a115f9e67d"><enum>(ii)</enum><text>in
			 consultation and cooperation with each Federal, State, or Indian tribal
			 government agency that is required to make any determination to authorize the
			 issuance of a permit, establish a schedule under which each agency
			 shall—</text>
									<subclause id="IDf5b5e1860aa9470b91d1cfec21855fb9"><enum>(I)</enum><text>concurrently
			 consider, to the maximum extent practicable, each determination to be made;
			 and</text>
									</subclause><subclause id="IDe68a1f45b5144f1ab1973811a50f074e"><enum>(II)</enum><text>complete each
			 step in the permitting process; and</text>
									</subclause></clause><clause id="ID25f5b324218f4b7b9e232f23708d304a"><enum>(iii)</enum><text>issue a
			 consolidated permit that combines all permits issued under the schedule
			 established under clause (ii); and</text>
								</clause></subparagraph><subparagraph id="IDc251e7c010084b8d95eb28e001c2db20"><enum>(B)</enum><text>the Administrator
			 shall provide to State and Indian tribal government agencies—</text>
								<clause id="IDd85437d911be4fb795ac10329ba71eea"><enum>(i)</enum><text>financial
			 assistance in such amounts as the agencies reasonably require to hire such
			 additional personnel as are necessary to enable the government agencies to
			 comply with the applicable schedule established under subparagraph (A)(ii);
			 and</text>
								</clause><clause id="IDe1e915cfcee54a928bf85baa57bf84c0"><enum>(ii)</enum><text>technical,
			 legal, and other assistance in complying with the refinery permitting
			 agreement.</text>
								</clause></subparagraph></paragraph><paragraph id="IDeeed00f3991540e59df5603358edc7cd"><enum>(3)</enum><header>Agreement by
			 the State</header><text>Under a refinery permitting agreement, a State or
			 governing body of an Indian tribe shall agree that—</text>
							<subparagraph id="ID83da773310414e36bebeca44a5c07973"><enum>(A)</enum><text>the Administrator
			 shall have each of the authorities described in paragraph (2); and</text>
							</subparagraph><subparagraph id="IDabea55733d9a4b9092ea52c81bebf64f"><enum>(B)</enum><text>each State or
			 Indian tribal government agency shall—</text>
								<clause id="ID522b06599f0f40e596a030c83d9ef91f"><enum>(i)</enum><text>in
			 accordance with State law, make such structural and operational changes in the
			 agencies as are necessary to enable the agencies to carry out consolidated
			 project-wide permit reviews concurrently and in coordination with the
			 Environmental Protection Agency and other Federal agencies; and</text>
								</clause><clause id="ID4dcc61addd08452abd58a077f401f23a"><enum>(ii)</enum><text>comply, to the
			 maximum extent practicable, with the applicable schedule established under
			 paragraph (2)(A)(ii).</text>
								</clause></subparagraph></paragraph><paragraph id="ID12af33901dfd419aa7efc52cfbc226ff"><enum>(4)</enum><header>Deadlines</header>
							<subparagraph id="IDa77ac710b20c4a408b26d99d1292d97c"><enum>(A)</enum><header>New
			 refineries</header><text>In the case of a consolidated permit for the
			 construction of a new refinery, the Administrator and the State or governing
			 body of an Indian tribe shall approve or disapprove the consolidated permit not
			 later than—</text>
								<clause id="ID2472bbac5937444caef1772b62294f0c"><enum>(i)</enum><text>360
			 days after the date of the receipt of the administratively complete application
			 for the consolidated permit; or</text>
								</clause><clause id="ID78acaa19614a411cb837b5f5cc42600c"><enum>(ii)</enum><text>on
			 agreement of the applicant, the Administrator, and the State or governing body
			 of the Indian tribe, 90 days after the expiration of the deadline established
			 under clause (i).</text>
								</clause></subparagraph><subparagraph id="IDa002b99209a14caeb0ea36f83af0abd9"><enum>(B)</enum><header>Expansion of
			 existing refineries</header><text>In the case of a consolidated permit for the
			 expansion of an existing refinery, the Administrator and the State or governing
			 body of an Indian tribe shall approve or disapprove the consolidated permit not
			 later than—</text>
								<clause id="ID03d602325b4149849a21333adabbc603"><enum>(i)</enum><text>120
			 days after the date of the receipt of the administratively complete application
			 for the consolidated permit; or</text>
								</clause><clause id="IDa3ef8624253d4598b8c147e579a54b21"><enum>(ii)</enum><text>on
			 agreement of the applicant, the Administrator, and the State or governing body
			 of the Indian tribe, 30 days after the expiration of the deadline established
			 under clause (i).</text>
								</clause></subparagraph></paragraph><paragraph id="IDdea46a01bbba4de1971485049ebe08db"><enum>(5)</enum><header>Federal
			 agencies</header><text>Each Federal agency that is required to make any
			 determination to authorize the issuance of a permit shall comply with the
			 applicable schedule established under paragraph (2)(A)(ii).</text>
						</paragraph><paragraph id="IDa69e9513854442938e8a487618b39e9f"><enum>(6)</enum><header>Judicial
			 review</header><text>Any civil action for review of any permit determination
			 under a refinery permitting agreement shall be brought exclusively in the
			 United States district court for the district in which the refinery is located
			 or proposed to be located.</text>
						</paragraph><paragraph id="ID7a98e4af4e5745c087b9a96516ac62db"><enum>(7)</enum><header>Efficient
			 permit review</header><text>In order to reduce the duplication of procedures,
			 the Administrator shall use State permitting and monitoring procedures to
			 satisfy substantially equivalent Federal requirements under this title.</text>
						</paragraph><paragraph id="ID3a42f7df4e3a4f5e838f00950b9cbbec"><enum>(8)</enum><header>Severability</header><text>If
			 1 or more permits that are required for the construction or operation of a
			 refinery are not approved on or before any deadline established under paragraph
			 (4), the Administrator may issue a consolidated permit that combines all other
			 permits that the refiner is required to obtain other than any permits that are
			 not approved.</text>
						</paragraph><paragraph id="ID379d6cd9f3654588b6a28141714cf90b"><enum>(9)</enum><header>Savings</header><text>Nothing
			 in this subsection affects the operation or implementation of otherwise
			 applicable law regarding permits necessary for the construction and operation
			 of a refinery.</text>
						</paragraph><paragraph id="ID8ef957648bbf4f6399130d0bc13bd153"><enum>(10)</enum><header>Consultation
			 with local governments</header><text>Congress encourages the Administrator,
			 States, and tribal governments to consult, to the maximum extent practicable,
			 with local governments in carrying out this subsection.</text>
						</paragraph><paragraph id="IDcdff144b59bf460aaf8d50b0bd6d342d"><enum>(11)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this subsection.</text>
						</paragraph><paragraph id="ID4570adc1e18b4895945fbaf675e9b98a"><enum>(12)</enum><header>Effect on
			 local authority</header><text>Nothing in this subsection affects—</text>
							<subparagraph id="IDee9a1031d44b48a6802dc1cb0c372c9e"><enum>(A)</enum><text>the authority of
			 a local government with respect to the issuance of permits; or</text>
							</subparagraph><subparagraph id="ID1342ba67c5aa48fe804ed58f496f2e90"><enum>(B)</enum><text>any requirement
			 or ordinance of a local government (such as a zoning regulation).</text>
							</subparagraph></paragraph></subsection><subsection id="IDc5032ab4edca4d498f78b4501da8cd03"><enum>(c)</enum><header>Fischer-Tropsch
			 fuels</header>
						<paragraph id="ID13f02966c1594809b389f8c877902695"><enum>(1)</enum><header>In
			 general</header><text>In cooperation with the Secretary of Energy, the
			 Secretary of Defense, the Administrator of the Federal Aviation Administration,
			 Secretary of Health and Human Services, and Fischer-Tropsch industry
			 representatives, the Administrator shall—</text>
							<subparagraph id="ID7253ff8f27e14fc38ec6d34a6bc82ea2"><enum>(A)</enum><text>conduct a
			 research and demonstration program to evaluate the air quality benefits of
			 ultra-clean Fischer-Tropsch transportation fuel, including diesel and jet
			 fuel;</text>
							</subparagraph><subparagraph id="ID23f32e96248343278d810af857058657"><enum>(B)</enum><text>evaluate the use
			 of ultra-clean Fischer-Tropsch transportation fuel as a mechanism for reducing
			 engine exhaust emissions; and</text>
							</subparagraph><subparagraph id="ID0ac2078aa4674d13b27b6e7020d38e11"><enum>(C)</enum><text>submit
			 recommendations to Congress on the most effective use and associated benefits
			 of these ultra-clean fuel for reducing public exposure to exhaust
			 emissions.</text>
							</subparagraph></paragraph><paragraph id="IDdfb326445f504a1a9af75be72bf1d982"><enum>(2)</enum><header>Guidance and
			 technical support</header><text>The Administrator shall, to the extent
			 necessary, issue any guidance or technical support documents that would
			 facilitate the effective use and associated benefit of Fischer-Tropsch fuel and
			 blends.</text>
						</paragraph><paragraph id="ID978da5db5ae84cfcaa02939858a07d21"><enum>(3)</enum><header>Requirements</header><text>The
			 program described in paragraph (1) shall consider—</text>
							<subparagraph id="ID197dab5eadb7475fa439e7920bd4272a"><enum>(A)</enum><text>the use of neat
			 (100 percent) Fischer-Tropsch fuel and blends with conventional crude
			 oil-derived fuel for heavy-duty and light-duty diesel engines and the aviation
			 sector; and</text>
							</subparagraph><subparagraph id="ID9e49868cfefd4be090588ad832770aa9"><enum>(B)</enum><text>the production
			 costs associated with domestic production of those ultra clean fuel and prices
			 for consumers.</text>
							</subparagraph></paragraph><paragraph id="ID4f1b9c0744584532bdb5654853ef53f4"><enum>(4)</enum><header>Reports</header><text>The
			 Administrator shall submit to the Committee on Environment and Public Works and
			 the Committee on Energy and Natural Resources of the Senate and the Committee
			 on Energy and Commerce of the House of Representatives—</text>
							<subparagraph id="IDe61d9188b1d94857b5c8a22f1b04221b"><enum>(A)</enum><text>not later than 1
			 year, an interim report on actions taken to carry out this subsection;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID857f13b2c84f447dba92fd239c52033d"><enum>(B)</enum><text>not later than 2
			 years, a final report on actions taken to carry out this subsection.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idCD30C8A289C44D84AF4D8AA728E1DB9A" section-type="subsequent-section"><enum>132.</enum><header display-inline="yes-display-inline">Removal of additional fee for new
			 applications for permits to drill</header><text display-inline="no-display-inline">The second undesignated paragraph of the
			 matter under the heading <quote><header-in-text level="appropriations-small" style="traditional">management of lands and resources</header-in-text></quote>
			 under the heading <quote><header-in-text level="appropriations-intermediate" style="traditional">Bureau of Land Management</header-in-text></quote> of title
			 I of the Department of the Interior, Environment, and Related Agencies
			 Appropriations Act, 2008 (Public Law 110–161; 121 Stat. 2098) is amended by
			 striking <quote>to be reduced</quote> and all that follows through <quote>each
			 new application,</quote>.</text>
				</section></subtitle><subtitle id="id188C4A7BABA04F029BF935DCCA842F36"><enum>D</enum><header>Strategic
			 Petroleum Reserve</header>
				<section id="idD46564D6597B444FA9033FB94CBD6491" section-type="subsequent-section"><enum>141.</enum><header>Suspension of
			 petroleum acquisition for Strategic Petroleum Reserve</header>
					<subsection id="IDf6b5315e5380494d9ef666162ce44de3"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b) and notwithstanding
			 any other provision of law, during the 180-day period beginning on the date of
			 enactment of this Act—</text>
						<paragraph id="ID599558c55e0d45deb0e7322e674bdd37"><enum>(1)</enum><text>the Secretary of
			 the Interior shall suspend acquisition of petroleum for the Strategic Petroleum
			 Reserve through the royalty-in-kind program; and</text>
						</paragraph><paragraph id="ID8b79a985d5d747a3b822aed79f8fc852"><enum>(2)</enum><text>the Secretary of
			 Energy shall suspend acquisition of petroleum for the Strategic Petroleum
			 Reserve through any other acquisition method.</text>
						</paragraph></subsection><subsection id="ID2457cc0f680d43b58bf137977502f5ce"><enum>(b)</enum><header>Resumption</header><text>Effective
			 beginning on the day after the end of the period described in subsection
			 (a)—</text>
						<paragraph id="ID7aa2a1acdcc340cc8b538830da3fc4d2"><enum>(1)</enum><text>the Secretary of
			 the Interior may resume acquisition of petroleum for the Strategic Petroleum
			 Reserve through the royalty-in-kind program; and</text>
						</paragraph><paragraph id="IDe38d846e498b45579facce32417508f3"><enum>(2)</enum><text>the Secretary of
			 Energy may resume acquisition of petroleum for the Strategic Petroleum Reserve
			 through any other acquisition method.</text>
						</paragraph></subsection></section></subtitle><subtitle id="idA8454C6C0D1E4764A47E757756EC0727"><enum>E</enum><header>Restoration of
			 State revenue</header>
				<section id="id675CC1F0EDCF47D7951470D022221DAD"><enum>151.</enum><header>Restoration of
			 State revenue</header><text display-inline="no-display-inline">The matter under
			 the heading <quote><header-in-text level="appropriations-small" style="traditional">administrative provisions</header-in-text></quote> under

			 title I of the Department of the Interior, Environment, and Related Agencies
			 Appropriations Act, 2008 (Public Law 110–161; 121 Stat. 2109) is amended by
			 striking <quote>Notwithstanding</quote> and all that follows through
			 <quote>Treasury.</quote>.</text>
				</section></subtitle></title><title id="id9421341400634401AD07E483449101B8"><enum>II</enum><header>Alternative
			 resources</header>
			<subtitle id="id37315687D8154871ADE23D43B98D723C"><enum>A</enum><header>Renewable fuel
			 and advanced energy technology</header>
				<section id="idE61EA8E913F141A594C29C973AAC5E8C"><enum>201.</enum><header>Definition of
			 renewable biomass</header><text display-inline="no-display-inline">Section
			 211(o)(1) of the Clean Air Act (42 U.S.C. 7545(o)(1)) is amended by striking
			 subparagraph (I) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4D82357FA1524C999E6FCE9BAB593341" style="OLC">
						<subparagraph id="idF77D5899E0A843348D3B1265BAE61736"><enum>(I)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> means—</text>
							<clause id="ID0799c926935145f68b2df76a04be35fb"><enum>(i)</enum><text>nonmerchantable
				materials or precommercial thinnings that—</text>
								<subclause id="ID7047d14945a6458c855a1647b2cd6bc4"><enum>(I)</enum><text>are byproducts of
				preventive treatments, such as trees, wood, brush, thinnings, chips, and slash,
				that are removed—</text>
									<item id="IDb859d713ea774e23bb3d0ae0eb1fc153"><enum>(aa)</enum><text>to
				reduce hazardous fuels;</text>
									</item><item id="IDd2a8ca53467f4405a342793a1ce69349"><enum>(bb)</enum><text>to
				reduce or contain disease or insect infestation; or</text>
									</item><item id="ID3a62cf50c3ef4e62993a5a0770c7b4e0"><enum>(cc)</enum><text>to
				restore forest health;</text>
									</item></subclause><subclause id="IDbaf2950bd17e48e499b3d42cba306bdb"><enum>(II)</enum><text>would not
				otherwise be used for higher-value products; and</text>
								</subclause><subclause id="ID3966eb5fbaa64ac5a5b452e6b78de9c3"><enum>(III)</enum><text>are harvested
				from National Forest System land or public land (as defined in section 103 of
				the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1702))—</text>
									<item id="IDc9c2dc641ba04acd9b14550eb1304f32"><enum>(aa)</enum><text>where permitted
				by law; and</text>
									</item><item id="ID49d67745b5404ddaa15099326f06ad21"><enum>(bb)</enum><text>in
				accordance with applicable land management plans and the requirements for
				old-growth maintenance, restoration, and management direction of paragraphs
				(2), (3), and (4) of subsection (e) and the requirements for large-tree
				retention of subsection (f) of section 102 of the Healthy Forests Restoration
				Act of 2003 (16 U.S.C. 6512); or</text>
									</item></subclause></clause><clause id="ID1e761e79d69e496282e03cbe72726fa4"><enum>(ii)</enum><text>any organic
				matter that is available on a renewable or recurring basis from non-Federal
				land or from land belonging to an Indian tribe, or an Indian individual, that
				is held in trust by the United States or subject to a restriction against
				alienation imposed by the United States, including—</text>
								<subclause id="ID9c55ef472f74480481ff6c000f83eccf"><enum>(I)</enum><text>renewable plant
				material, including—</text>
									<item id="IDbb3f43e258bf49f4931eee39e70f04f1"><enum>(aa)</enum><text>feed
				grains;</text>
									</item><item id="ID669befe8537b43d682de1e8a4028050d"><enum>(bb)</enum><text>other
				agricultural commodities;</text>
									</item><item id="IDd128aee36c8c48d4bc998d5f3a3af86f"><enum>(cc)</enum><text>other plants and
				trees; and</text>
									</item><item id="ID1e3d41f7354347a6a1c5db371b844c28"><enum>(dd)</enum><text>algae;
				and</text>
									</item></subclause><subclause id="ID8fe6a0b5fbb94a168c3e819d7dc85b23"><enum>(II)</enum><text>waste material,
				including—</text>
									<item id="IDcda5871b87884b1fb8c4f54bf1354e84"><enum>(aa)</enum><text>crop
				residue;</text>
									</item><item id="IDe1e8b91c8c114032a2945e13ed6211b0"><enum>(bb)</enum><text>other vegetative
				waste material (including wood waste and wood residues);</text>
									</item><item id="ID3e0a1796c9704f8ea83812106938d045"><enum>(cc)</enum><text>animal waste and
				byproducts (including fats, oils, greases, and manure); and</text>
									</item><item id="IDce4389613e1f42ba9184bf4661625475"><enum>(dd)</enum><text>food waste and
				yard
				waste.</text>
									</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="IDb530d6927d6944d79d61a3bd42501606"><enum>202.</enum><header>Advanced
			 battery manufacturing incentive program</header>
					<subsection id="IDd05a9cecb48145e980ce2155a2d0f592"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="IDea6b61aeba384dedb9304ee330246464"><enum>(1)</enum><header>Advanced
			 battery</header><text>The term <term>advanced battery</term> means an
			 electrical storage device suitable for vehicle applications.</text>
						</paragraph><paragraph id="ID704b2be7f40040a7becd5d083a501132"><enum>(2)</enum><header>Engineering
			 integration costs</header><text>The term <term>engineering integration
			 costs</term> includes the cost of engineering tasks relating to—</text>
							<subparagraph id="IDd5ade1e7cb7c451aafb5d1ec97d2151a"><enum>(A)</enum><text>incorporation of
			 qualifying components into the design of advanced batteries; and</text>
							</subparagraph><subparagraph id="IDd9d41a69b06642099ebfcd29dffdf7d3"><enum>(B)</enum><text>design of tooling
			 and equipment and developing manufacturing processes and material suppliers for
			 production facilities that produce qualifying components or advanced
			 batteries.</text>
							</subparagraph></paragraph></subsection><subsection id="ID67dde41971634fb9ac4627e38b824215"><enum>(b)</enum><header>Advanced
			 battery manufacturing facility</header><text>The Secretary shall provide
			 facility funding awards under this section to advanced battery manufacturers to
			 pay not more than 30 percent of the cost of reequipping, expanding, or
			 establishing a manufacturing facility in the United States to produce advanced
			 batteries.</text>
					</subsection><subsection id="IDb1abbd50a1824cd9900d7ddc9e205ac8"><enum>(c)</enum><header>Period of
			 availability</header><text>An award under subsection (b) shall apply to—</text>
						<paragraph id="IDdf4cb4b4f94a4cd8a285c3a6189d2296"><enum>(1)</enum><text>facilities and
			 equipment placed in service before December 30, 2020; and</text>
						</paragraph><paragraph id="ID464bdf7351ef471290de73ba20f6b0cb"><enum>(2)</enum><text>engineering
			 integration costs incurred during the period beginning on the date of enactment
			 of this Act and ending on December 30, 2020.</text>
						</paragraph></subsection><subsection id="IDcadcf651cf704378b91554fab774e10c"><enum>(d)</enum><header>Direct loan
			 program</header>
						<paragraph id="ID0e2a10efef2a43e08f111d02a947a987"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, and subject to the availability of appropriated funds, the Secretary shall
			 carry out a program to provide a total of not more than $25,000,000 in loans to
			 eligible individuals and entities (as determined by the Secretary) for the
			 costs of activities described in subsection (b).</text>
						</paragraph><paragraph id="IDd054e0d850f74a04bef2a46b07c82d52"><enum>(2)</enum><header>Selection of
			 eligible projects</header><text>The Secretary shall select eligible projects to
			 receive loans under this subsection in cases in which, as determined by the
			 Secretary, the award recipient—</text>
							<subparagraph id="ID2e9cb6402d3848eaa65abc9c53accd17"><enum>(A)</enum><text>is financially
			 viable without the receipt of additional Federal funding associated with the
			 proposed project;</text>
							</subparagraph><subparagraph id="IDdfe926b8d5304b9db9ae0692f9b22ed8"><enum>(B)</enum><text>will provide
			 sufficient information to the Secretary for the Secretary to ensure that the
			 qualified investment is expended efficiently and effectively; and</text>
							</subparagraph><subparagraph id="IDf659d104a752401f90b38a7b1f6d1010"><enum>(C)</enum><text>has met such
			 other criteria as may be established and published by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="ID99c008cbae28484eb40f3f9d6bebd61e"><enum>(3)</enum><header>Rates, terms,
			 and repayment of loans</header><text>A loan provided under this
			 subsection—</text>
							<subparagraph id="IDf0b0963eb2434732843b6e88706bce5d"><enum>(A)</enum><text>shall have an
			 interest rate that, as of the date on which the loan is made, is equal to the
			 cost of funds to the Department of the Treasury for obligations of comparable
			 maturity;</text>
							</subparagraph><subparagraph id="IDc527c622db754993a583797e4a0210a2"><enum>(B)</enum><text>shall have a term
			 equal to the lesser of—</text>
								<clause id="IDe970070b69c94cb0a11351e12bf66c10"><enum>(i)</enum><text>the
			 projected life, in years, of the eligible project to be carried out using funds
			 from the loan, as determined by the Secretary; and</text>
								</clause><clause id="ID3b28d488341e4986982fe25fbf3f5e0b"><enum>(ii)</enum><text>25
			 years;</text>
								</clause></subparagraph><subparagraph id="ID376a3e74d0944f3b947bd1342eff2b76"><enum>(C)</enum><text>may be subject to
			 a deferral in repayment for not more than 5 years after the date on which the
			 eligible project carried out using funds from the loan first begins operations,
			 as determined by the Secretary; and</text>
							</subparagraph><subparagraph id="ID97152f128bec455488b51f49fe033b6f"><enum>(D)</enum><text>shall be made by
			 the Federal Financing Bank.</text>
							</subparagraph></paragraph></subsection><subsection id="IDc21518b6a53b46f8b09dcc2840f2a683"><enum>(e)</enum><header>Fees</header><text>The
			 cost of administering a loan made under this section shall not exceed
			 $100,000.</text>
					</subsection><subsection id="ID4f41cb8afc614f9b96fa885cf8b0a117"><enum>(f)</enum><header>Set aside for
			 small manufacturers</header>
						<paragraph id="ID7d8893acb7fb4484902955c952e8f08d"><enum>(1)</enum><header>Definition of
			 covered firm</header><text>In this subsection, the term <term>covered
			 firm</term> means a firm that—</text>
							<subparagraph id="ID3e3692a542d3414a9a1cdc213c8e5a9f"><enum>(A)</enum><text>employs fewer
			 than 500 individuals; and</text>
							</subparagraph><subparagraph id="ID5a764992b5a643f6b226c3ee2c35d398"><enum>(B)</enum><text>manufactures
			 automobiles or components of automobiles.</text>
							</subparagraph></paragraph><paragraph id="ID9220efe660c845b0a904ad65306304b5"><enum>(2)</enum><header>Set
			 aside</header><text>Of the amount of funds used to provide awards for each
			 fiscal year under subsection (b), the Secretary shall use not less than 10
			 percent to provide awards to covered firms or consortia led by a covered
			 firm.</text>
						</paragraph></subsection><subsection id="ID364e35a7dd5e446ebf39d0b55ef24336"><enum>(g)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section for each of fiscal years 2009
			 through 2013.</text>
					</subsection></section><section id="idB0478E8C66644CAA8B26C7D4490E605E"><enum>203.</enum><header>Biofuels
			 infrastructure and additives research and development</header>
					<subsection id="idB0AA82CA52A94057A0CCFC5321C571CA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Assistant
			 Administrator of the Office of Research and Development of the Environmental
			 Protection Agency (referred to in this section as the <term>Assistant
			 Administrator</term>), in consultation with the Secretary and the National
			 Institute of Standards and Technology, shall carry out a program of research
			 and development of materials to be added to biofuels to make the biofuels more
			 compatible with infrastructure used to store and deliver petroleum-based fuels
			 to the point of final sale.</text>
					</subsection><subsection id="id448BE2B901DD4FD0ACACE166127129F3"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out the program described in
			 subsection (a), the Assistant Administrator shall address—</text>
						<paragraph id="ID459592c66c1847adbc86457c39270a5e"><enum>(1)</enum><text>materials to
			 prevent or mitigate—</text>
							<subparagraph id="IDeb3f3fad4ce34161871df12012a7a570"><enum>(A)</enum><text>corrosion of
			 metal, plastic, rubber, cork, fiberglass, glues, or any other material used in
			 pipes and storage tanks;</text>
							</subparagraph><subparagraph id="IDcfc6007862bc41f4a4c1b393cd05b698"><enum>(B)</enum><text>dissolving of
			 storage tank sediments;</text>
							</subparagraph><subparagraph id="IDa30c54dc58d8462f95f86bd7c38e477e"><enum>(C)</enum><text>clogging of
			 filters;</text>
							</subparagraph><subparagraph id="ID415a57dae43e483299eaee548797e625"><enum>(D)</enum><text>contamination
			 from water or other adulterants or pollutants;</text>
							</subparagraph><subparagraph id="ID77aff024ba7f4e6891ba650ea3e00168"><enum>(E)</enum><text>poor flow
			 properties relating to low temperatures;</text>
							</subparagraph><subparagraph id="ID97acff1ee26548d2b95abf71ae01edb5"><enum>(F)</enum><text>oxidative and
			 thermal instability in long-term storage and use; and</text>
							</subparagraph><subparagraph id="IDcd6f4e525ab646899e5f9449d5f1dcd6"><enum>(G)</enum><text>microbial
			 contamination;</text>
							</subparagraph></paragraph><paragraph id="IDe0d4259ad15b429ca823aead949fac88"><enum>(2)</enum><text>problems
			 associated with electrical conductivity;</text>
						</paragraph><paragraph id="IDf6a7260dde184beca0dc5b1707c0c289"><enum>(3)</enum><text>alternatives to
			 conventional methods for refurbishment and cleaning of gasoline and diesel
			 tanks, including tank lining applications;</text>
						</paragraph><paragraph id="ID5709d046ee0d40a8ab1b122cc2cff162"><enum>(4)</enum><text>strategies to
			 minimize emissions from infrastructure;</text>
						</paragraph><paragraph id="IDd50db81a00874705a243c13d1e54d0c5"><enum>(5)</enum><text>issues with
			 respect to certification by a nationally recognized testing laboratory of
			 components for fuel-dispensing devises that specifically reference
			 compatibility with alcohol-blended fuels and other biofuels that contain
			 greater than 15 percent alcohol;</text>
						</paragraph><paragraph id="IDdac4db9257454d3b832aec7e008363a2"><enum>(6)</enum><text>challenges for
			 design, reforming, storage, handling, and dispensing hydrogen fuel from various
			 feedstocks, including biomass, from neighborhood fueling stations, including
			 codes and standards development necessary beyond that carried out under section
			 809 of the Energy Policy Act of 2005 (42 U.S.C. 16158);</text>
						</paragraph><paragraph id="IDb4fd72d17ee54f7b9798d107917f8069"><enum>(7)</enum><text>issues with
			 respect to at which point in the fuel supply chain additives optimally should
			 be added to fuels; and</text>
						</paragraph><paragraph id="ID1106c59da14047ff81147d9d7c5be985"><enum>(8)</enum><text>other problems,
			 as identified by the Assistant Administrator, in consultation with the
			 Secretary and the National Institute of Standards and Technology.</text>
						</paragraph></subsection></section><section id="ID5f636c7aa3df461dbd5fa54aed97db3e"><enum>204.</enum><header>Study of
			 increased consumption of ethanol-blended gasoline with higher levels of
			 ethanol</header>
					<subsection id="ID1b02e0c7f5a044bb91d5f74986370c71"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, in cooperation with the Secretary of
			 Agriculture, the Administrator of the Environmental Protection Agency, and the
			 Secretary of Transportation, and after providing notice and an opportunity for
			 public comment, shall conduct a study of the feasibility of increasing
			 consumption in the United States of ethanol-blended gasoline with levels of
			 ethanol that are not less than 10 percent and not more than 40 percent.</text>
					</subsection><subsection id="IDe78030578842425f9becb3b940f2dada"><enum>(b)</enum><header>Study</header><text>The
			 study under subsection (a) shall include—</text>
						<paragraph id="ID9d34ba1187364f77bf1f98faba7fd40a"><enum>(1)</enum><text>a review of
			 production and infrastructure constraints on increasing consumption of
			 ethanol;</text>
						</paragraph><paragraph id="ID099a1dac2f02475e8f040ecc7f2bf715"><enum>(2)</enum><text>an evaluation of
			 the economic, market, and energy-related impacts of State and regional
			 differences in ethanol blends;</text>
						</paragraph><paragraph id="IDd7692776e95e447db124e0a3135f72af"><enum>(3)</enum><text>an evaluation of
			 the economic, market, and energy-related impacts on gasoline retailers and
			 consumers of separate and distinctly labeled fuel storage facilities and
			 dispensers;</text>
						</paragraph><paragraph id="ID3ed7e1918686459d9f552767b13c618b"><enum>(4)</enum><text>an evaluation of
			 the environmental impacts of mid-level ethanol blends on evaporative and
			 exhaust emissions from on-road, off-road, and marine engines, recreational
			 boats, vehicles, and equipment;</text>
						</paragraph><paragraph id="IDf78f782d148b498eb272b276c427a0ba"><enum>(5)</enum><text>an evaluation of
			 the impacts of mid-level ethanol blends on the operation, durability, and
			 performance of on-road, off-road, and marine engines, recreational boats,
			 vehicles, and equipment;</text>
						</paragraph><paragraph id="ID40bf6ba372d6426a8e8025293c080a5b"><enum>(6)</enum><text>an evaluation of
			 the safety impacts of mid-level ethanol blends on consumers that own and
			 operate off-road and marine engines, recreational boats, vehicles, or
			 equipment; and</text>
						</paragraph><paragraph id="ID88a19d144c154d948abe0edfff27f787"><enum>(7)</enum><text>an evaluation of
			 the impacts of increased use of renewable fuels derived from food crops on the
			 price and supply of agricultural commodities in both domestic and global
			 markets.</text>
						</paragraph></subsection><subsection id="IDe4de3f4a805d4d9ca2371bde0f2f908c"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report describing the results of the study conducted under
			 this section.</text>
					</subsection></section><section id="IDe18bdf7d3dfd4f56919fe2cd789dc588"><enum>205.</enum><header>Study of
			 diesel vehicle attributes</header>
					<subsection id="ID0146e80ac43841a8afd0fcfcb17e779e"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Administrator of
			 the Environmental Protection Agency and the Secretary of Transportation, shall
			 conduct a study to identify—</text>
						<paragraph id="ID59e14cb710344f18a8ae2d93f0b03ce1"><enum>(1)</enum><text>the environmental
			 and efficiency attributes of diesel-fueled vehicles as the vehicles compare to
			 comparable gasoline fueled, E–85 fueled, and hybrid vehicles;</text>
						</paragraph><paragraph id="ID4bd5fde2666e44d1acade62dc82fcbeb"><enum>(2)</enum><text>the technical,
			 economic, regulatory, environmental, and other obstacles to increasing the
			 usage of diesel-fueled vehicles;</text>
						</paragraph><paragraph id="IDa3b2089632f34ea1ba297a134a6e5ea2"><enum>(3)</enum><text>the legislative,
			 administrative, and other actions that could reduce or eliminate the obstacles
			 identified under paragraph (2); and</text>
						</paragraph><paragraph id="IDfca2e162d2aa4ba19e399f819368565c"><enum>(4)</enum><text>the costs and
			 benefits associated with reducing or eliminating the obstacles identified under
			 paragraph (2).</text>
						</paragraph></subsection><subsection id="IDef44bf9caa8d4389bee1db297e2ef252"><enum>(b)</enum><header>Report</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Secretary shall
			 submit to the Committee on Energy and Natural Resources of the Senate and the
			 Committee on Energy and Commerce of the House of Representatives a report
			 describing the results of the study conducted under subsection (a).</text>
					</subsection><subsection id="ID1dd3a30b06ea43d096b51a6c2ed3e58c"><enum>(c)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section.</text>
					</subsection></section></subtitle><subtitle id="idE02BB08435FE4E828DD4D13E0A9DFFDD"><enum>B</enum><header>Clean
			 coal-derived fuels for energy security</header>
				<section id="idF35B723F992C44B292781A8EADF0C68A" section-type="subsequent-section"><enum>211.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote>Clean Coal-Derived Fuels for Energy Security Act of
			 2008</quote>.</text>
				</section><section id="id233CE3238A21433B819CDFEB1E297C6D" section-type="subsequent-section"><enum>212.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idB4C37E5E6CA649EAB679E187C0608DE6"><enum>(1)</enum><header>Clean
			 coal-derived fuel</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF0197BCC62314358AD54BF3AAAA8D01A"><enum>(A)</enum><header>In
			 general</header><text>The term <term>clean coal-derived fuel</term> means
			 aviation fuel, motor vehicle fuel, home heating oil, or boiler fuel that
			 is—</text>
							<clause commented="no" display-inline="no-display-inline" id="idDB6A6BC2DF4743CFB61C1EED9F9E9A24"><enum>(i)</enum><text>substantially
			 derived from the coal resources of the United States; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id25C18DF3617A404C823BBCD8AF745CFD"><enum>(ii)</enum><text>refined or
			 otherwise processed at a facility located in the United States that captures up
			 to 100 percent of the carbon dioxide emissions that would otherwise be released
			 at the facility.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDDBC366CC8FB4EC798E74D20FD4E7227"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>clean coal-derived fuel</term> may include any other resource that
			 is extracted, grown, produced, or recovered in the United States.</text>
						</subparagraph></paragraph><paragraph id="id5E5985E2CCD9490A9E9B1D4250BD2F60"><enum>(2)</enum><header>Covered
			 fuel</header><text>The term <term>covered fuel</term> means—</text>
						<subparagraph id="id12E12A70B23E44DC9CB8E9230332F95E"><enum>(A)</enum><text>aviation
			 fuel;</text>
						</subparagraph><subparagraph id="idDF73A6E53B804AF39C315C557BB25A54"><enum>(B)</enum><text>motor vehicle
			 fuel;</text>
						</subparagraph><subparagraph id="id440DF3B447EE4E61AAF0ACF350429F22"><enum>(C)</enum><text>home heating oil;
			 and</text>
						</subparagraph><subparagraph id="id6E4281004616451BA98084095E74A738"><enum>(D)</enum><text>boiler
			 fuel.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4EBF7FC6736B46A389182DC0EBB433FB"><enum>(3)</enum><header display-inline="yes-display-inline">Small
			 refinery</header><text display-inline="yes-display-inline">The term <term>small
			 refinery</term> means a refinery for which the average aggregate daily crude
			 oil throughput for a calendar year (as determined by dividing the aggregate
			 throughput for the calendar year by the number of days in the calendar year)
			 does not exceed 75,000 barrels.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="id6295B1009051462FABF11C4E5DED52B5"><enum>213.</enum><header>Clean
			 coal-derived fuel program</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDFFA7CCF02E104C919B984F9CC550709E"><enum>(a)</enum><header>Program</header>
						<paragraph id="ID3C8C2D80A5C641F79C6EA15847597190"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the President shall promulgate regulations to ensure that covered fuel
			 sold or introduced into commerce in the United States (except in noncontiguous
			 States or territories), on an annual average basis, contains the applicable
			 volume of clean coal-derived fuel determined in accordance with paragraph
			 (4).</text>
						</paragraph><paragraph id="IDFD8EA7129091437D9B5C489AC4BDCD6C"><enum>(2)</enum><header>Provisions of
			 regulations</header><text>Regardless of the date of promulgation, the
			 regulations promulgated under paragraph (1)—</text>
							<subparagraph id="IDd250801e73154e35a5d6bbbc03305246"><enum>(A)</enum><text>shall contain
			 compliance provisions applicable to refineries, blenders, distributors, and
			 importers, as appropriate, to ensure that—</text>
								<clause id="IDe601b9ef3fcd4cb8a183aa36738eb6ad"><enum>(i)</enum><text>the
			 requirements of this subsection are met; and</text>
								</clause><clause id="ID5c4912af51574a5fb36a7cc8e1e03346"><enum>(ii)</enum><text>clean
			 coal-derived fuels produced from facilities for the purpose of compliance with
			 this subtitle result in life cycle greenhouse gas emissions that are not
			 greater than gasoline; and</text>
								</clause></subparagraph><subparagraph id="id9274F1BF3B664C15A21B0FD8836403C7"><enum>(B)</enum><text>shall not—</text>
								<clause id="ID217D11F1A81F4FFC997BEEFCAE703060"><enum>(i)</enum><text>restrict
			 geographic areas in the contiguous United States in which clean coal-derived
			 fuel may be used; or</text>
								</clause><clause id="IDA7F45E7DDA584075A5C764DA77E4D871"><enum>(ii)</enum><text>impose any
			 per-gallon obligation for the use of clean coal-derived fuel.</text>
								</clause></subparagraph></paragraph><paragraph id="id13AE8BD6160D4F89A4A02C0F62FDBF24"><enum>(3)</enum><header>Relationship to
			 other regulations</header><text>Regulations promulgated under this paragraph
			 shall, to the maximum extent practicable, incorporate the program structure,
			 compliance and reporting requirements established under the final regulations
			 promulgated to implement the renewable fuel program established by the
			 amendment made by section 1501(a)(2) of the Energy Policy Act of 2005 (Public
			 Law 109–58; 119 Stat. 1067).</text>
						</paragraph><paragraph id="IDE854E79144114F8F9CA44464BE2BFCBB"><enum>(4)</enum><header>Applicable
			 volume</header>
							<subparagraph id="id98082960EE1A439DB1080F5C1017CC9D"><enum>(A)</enum><header>Calendar years
			 2015 through 2022</header><text>For the purpose of this subsection, the
			 applicable volume for any of calendar years 2015 through 2022 shall be
			 determined in accordance with the following table:</text>

			 2023 and thereafter</header><text>Subject to subparagraph (C), for the purposes
			 of this subsection, the applicable volume for calendar year 2023 and each
			 calendar year thereafter shall be determined by the President, in coordination
			 with the Secretary and the Administrator of the Environmental Protection
			 Agency, based on a review of the implementation of the program during calendar
			 years 2015 through 2022, including a review of—</text>
								<clause commented="no" display-inline="no-display-inline" id="id52C0CB02AD3A4E34A8DF4D36D25AAA87"><enum>(i)</enum><text>the impact of
			 clean coal-derived fuels on the energy security of the United States;</text>
								</clause><clause id="ID0C995FCF132648338C940614966497D2"><enum>(ii)</enum><text>the expected
			 annual rate of future production of clean coal-derived fuels; and</text>
								</clause><clause id="ID4C7959F71F8D464E9CF1B595E523C138"><enum>(iii)</enum><text>the impact of
			 the use of clean coal-derived fuels on other factors, including job creation,
			 rural economic development, and the environment.</text>
								</clause></subparagraph><subparagraph id="IDFB75940B31E54B6ABDBC7D328B79B800"><enum>(C)</enum><header>Minimum
			 applicable volume</header><text>For the purpose of this subsection, the
			 applicable volume for calendar year 2023 and each calendar year thereafter
			 shall be equal to the product obtained by multiplying—</text>
								<clause id="IDC3B78AB698CA4C9DA0227AB4A277FAED"><enum>(i)</enum><text>the
			 number of gallons of covered fuel that the President estimates will be sold or
			 introduced into commerce in the calendar year; and</text>
								</clause><clause id="IDB81DB25CAE6F4940A96789A0B75E71AE"><enum>(ii)</enum><text>the ratio
			 that—</text>
									<subclause id="ID7956982E398D44B6AED722C2DDEF42BE"><enum>(I)</enum><text>6,000,000,000
			 gallons of clean coal-derived fuel; bears to</text>
									</subclause><subclause id="IDC21F0B9B77BD48688A21B0D734A1985D"><enum>(II)</enum><text>the number of
			 gallons of covered fuel sold or introduced into commerce in calendar year
			 2022.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBEB90ED19B944A1C9882461D4783687C"><enum>(b)</enum><header>Applicable
			 percentages</header>
						<paragraph id="IDA4780394076B40EA927C36AE90EFF747"><enum>(1)</enum><header>Provision of
			 estimate of volumes of certain fuel sales</header><text>Not later than October
			 31 of each of calendar years 2015 through 2021, the Administrator of the Energy
			 Information Administration shall provide to the President an estimate, with
			 respect to the following calendar year, of the volumes of covered fuel
			 projected to be sold or introduced into commerce in the United States.</text>
						</paragraph><paragraph id="ID0EA05C3E38524073A5AC614FB7A41198"><enum>(2)</enum><header>Determination
			 of applicable percentages</header>
							<subparagraph id="ID67C3250E70634BD4A15168C3A6406511"><enum>(A)</enum><header>In
			 general</header><text>Not later than November 30 of each of calendar years 2015
			 through 2022, based on the estimate provided under paragraph (1), the President
			 shall determine and publish in the Federal Register, with respect to the
			 following calendar year, the clean coal-derived fuel obligation that ensures
			 that the requirements of subsection (a) are met.</text>
							</subparagraph><subparagraph id="ID4614988BE3B642ED9B104B37785E9A76"><enum>(B)</enum><header>Required
			 elements</header><text>The clean coal-derived fuel obligation determined for a
			 calendar year under subparagraph (A) shall—</text>
								<clause id="ID6A9EFCCF8A4343259728B914A34ADA98"><enum>(i)</enum><text>be
			 applicable to refineries, blenders, and importers, as appropriate;</text>
								</clause><clause id="IDE70E92AE72714505A85EEE8EAA0F6028"><enum>(ii)</enum><text>be
			 expressed in terms of a volume percentage of covered fuel sold or introduced
			 into commerce in the United States; and</text>
								</clause><clause id="ID00A092AB634E499E9166248485829045"><enum>(iii)</enum><text>subject to
			 paragraph (3)(A), consist of a single applicable percentage that applies to all
			 categories of persons specified in clause (i).</text>
								</clause></subparagraph></paragraph><paragraph id="ID379A617DDA574C2A8DF34F781E7713D3"><enum>(3)</enum><header>Adjustments</header><text>In
			 determining the applicable percentage for a calendar year, the President shall
			 make adjustments—</text>
							<subparagraph id="ID8031BB40826D49B691A8156198EEF92C"><enum>(A)</enum><text>to prevent the
			 imposition of redundant obligations on any person specified in paragraph
			 (2)(B)(i); and</text>
							</subparagraph><subparagraph id="IDD35D90E583124059BEEE3566CC1F8756"><enum>(B)</enum><text>to account for
			 the use of clean coal-derived fuel during the previous calendar year by small
			 refineries that are exempt under subsection (f).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID09E791E35F684207B8894361D261308A"><enum>(c)</enum><header>Volume
			 conversion factors for clean coal-derived fuels based on energy
			 content</header>
						<paragraph id="IDd5e6f3195be043eb8c07d7b022701983"><enum>(1)</enum><header>In
			 general</header><text>For the purpose of subsection (a), the President shall
			 assign values to specific types of clean coal-derived fuel for the purpose of
			 satisfying the fuel volume requirements of subsection (a)(4) in accordance with
			 this subsection.</text>
						</paragraph><paragraph id="ID94a01ceddc4442b4908db9ffcec19f40"><enum>(2)</enum><header>Energy content
			 relative to diesel fuel</header><text>For clean coal-derived fuels, 1 gallon of
			 the clean coal-derived fuel shall be considered to be the equivalent of 1
			 gallon of diesel fuel multiplied by the ratio that—</text>
							<subparagraph id="IDb9a3c32cbabe44c1beaa994fc6a107ec"><enum>(A)</enum><text>the number of
			 British thermal units of energy produced by the combustion of 1 gallon of the
			 clean coal-derived fuel (as measured under conditions determined by the
			 Secretary); bears to</text>
							</subparagraph><subparagraph id="IDff2ec77f19af44b7b2781d9c1ab9bc2a"><enum>(B)</enum><text>the number of
			 British thermal units of energy produced by the combustion of 1 gallon of
			 diesel fuel (as measured under conditions determined by the Secretary to be
			 comparable to conditions described in subparagraph (A)).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF0D5B7DC8DAB49F395D1585744C60E7B"><enum>(d)</enum><header>Credit
			 program</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id7003EDF1208840B785DAB9C7EC2E810D"><enum>(1)</enum><header>In
			 general</header><text>The President, in consultation with the Secretary and the
			 clean coal-derived fuel requirement of this section.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id916D99CAE3184D6DADF14BBF021D5D2F"><enum>(2)</enum><header>Market
			 transparency</header><text>In carrying out the credit program under this
			 subsection, the President shall facilitate price transparency in markets for
			 the sale and trade of credits, with due regard for the public interest, the
			 integrity of those markets, fair competition, and the protection of
			 consumers.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE221A6D702564C54B81DCF7D3953E9F4"><enum>(e)</enum><header>Waivers</header>
						<paragraph id="ID554B5C8A61CF451B97F29945CEB71263"><enum>(1)</enum><header>In
			 general</header><text>The President, in consultation with the Secretary and the
			 Administrator of the Environmental Protection Agency, may waive the
			 requirements of subsection (a) in whole or in part on petition by 1 or more
			 States by reducing the national quantity of clean coal-derived fuel required
			 under subsection (a), based on a determination by the President (after public
			 notice and opportunity for comment), that—</text>
							<subparagraph id="ID7F44E5CB710E4819898347EB45514A9B"><enum>(A)</enum><text>implementation of
			 the requirement would severely harm the economy or environment of a State, a
			 region, or the United States; or</text>
							</subparagraph><subparagraph id="ID1C985CA180984C9BB905CF23680D01A9"><enum>(B)</enum><text>extreme and
			 unusual circumstances exist that prevent distribution of an adequate supply of
			 domestically produced clean coal-derived fuel to consumers in the United
			 States.</text>
							</subparagraph></paragraph><paragraph id="ID8D3E18BB02D14961A56A1551D8577997"><enum>(2)</enum><header>Petitions for
			 waivers</header><text>The President, in consultation with the Secretary and the
			 Administrator of the Environmental Protection Agency, shall approve or
			 disapprove a State petition for a waiver of the requirements of subsection (a)
			 within 90 days after the date on which the petition is received by the
			 President.</text>
						</paragraph><paragraph id="IDB600D160E5C742349CEA58A95ED07DC3"><enum>(3)</enum><header>Termination of
			 waivers</header><text>A waiver granted under paragraph (1) shall terminate
			 after 1 year, but may be renewed by the President after consultation with the
			 Secretary and the Administrator of the Environmental Protection Agency.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID91E4DEB40647460CACFD0D976C6062B5"><enum>(f)</enum><header>Small
			 refineries</header>
						<paragraph id="ID73426D9D588E470B965A1267A07A6821"><enum>(1)</enum><header>Temporary
			 exemption</header>
							<subparagraph id="ID3F72EF5821074831A0367C27C72110BA"><enum>(A)</enum><header>In
			 general</header><text>The requirements of subsection (a) shall not apply to
			 small refineries until calendar year 2018.</text>
							</subparagraph><subparagraph id="IDE2C6D23810B4475A98DAA348278AB84D"><enum>(B)</enum><header>Extension of
			 exemption</header>
								<clause id="ID184E803A48DA4F04A1643E30EAF01975"><enum>(i)</enum><header>Study by
			 Secretary</header><text>Not later than December 31, 2013, the Secretary shall
			 submit to the President and Congress a report describing the results of a study
			 to determine whether compliance with the requirements of subsection (a) would
			 impose a disproportionate economic hardship on small refineries.</text>
								</clause><clause id="ID92728B6C3074491CB6CA753144D11172"><enum>(ii)</enum><header>Extension of
			 exemption</header><text>In the case of a small refinery that the Secretary
			 determines under clause (i) would be subject to a disproportionate economic
			 hardship if required to comply with subsection (a), the President shall extend
			 the exemption under subparagraph (A) for the small refinery for a period of not
			 less than 2 additional years.</text>
								</clause></subparagraph></paragraph><paragraph id="ID29467E58924D43C09894780C23E4E794"><enum>(2)</enum><header>Petitions based
			 on disproportionate economic hardship</header>
							<subparagraph id="ID89C2AFE18B894C83AA31BDBD4CA4D866"><enum>(A)</enum><header>Extension of
			 exemption</header><text>A small refinery may at any time petition the President
			 for an extension of the exemption under paragraph (1) for the reason of
			 disproportionate economic hardship.</text>
							</subparagraph><subparagraph id="IDC905A7D813A8439A91DCACE4923A02CD"><enum>(B)</enum><header>Evaluation of
			 petitions</header><text>In evaluating a petition under subparagraph (A), the
			 President, in consultation with the Secretary, shall consider the findings of
			 the study under paragraph (1)(B) and other economic factors.</text>
							</subparagraph><subparagraph id="IDB3BC539F903140C68F0631C42037C2C1"><enum>(C)</enum><header>Deadline for
			 action on petitions</header><text>The President shall act on any petition
			 submitted by a small refinery for a hardship exemption not later than 90 days
			 after the date of receipt of the petition.</text>
							</subparagraph></paragraph><paragraph id="ID2CE9C556C5AC4331926C505D1721B48C"><enum>(3)</enum><header>Opt-in for
			 small refineries</header><text>A small refinery shall be subject to the
			 requirements of subsection (a) if the small refinery notifies the President
			 that the small refinery waives the exemption under paragraph (1).</text>
						</paragraph></subsection><subsection id="id4E8DA0592B95443CA14B3C41E6BD86C9"><enum>(g)</enum><header>Penalties and
			 enforcement</header>
						<paragraph id="ID2655567ed71c45a693a33572318aae5b"><enum>(1)</enum><header>Civil
			 penalties</header>
							<subparagraph id="id0C272811FF81438689E8297DE10FF34E"><enum>(A)</enum><header>In
			 general</header><text>Any person that violates a regulation promulgated under
			 subsection (a), or that fails to furnish any information required under such a
			 regulation, shall be liable to the United States for a civil penalty of not
			 more than the total of—</text>
								<clause id="id54C1215368D34B3C9C8AB61EF0932BA7"><enum>(i)</enum><text>$25,000 for each
			 day of the violation; and</text>
								</clause><clause id="idE46CA6ABF16A4D8BA5F69A7920C48495"><enum>(ii)</enum><text>the amount of
			 economic benefit or savings received by the person resulting from the
			 violation, as determined by the President.</text>
								</clause></subparagraph><subparagraph id="idC68C9D61730A4680AE5070C8F21B9DE1"><enum>(B)</enum><header>Collection</header><text>Civil
			 penalties under subparagraph (A) shall be assessed by, and collected in a civil
			 action brought by, the Secretary or such other officer of the United States as
			 is designated by the President.</text>
							</subparagraph></paragraph><paragraph id="ID908db9460cec4c05877fa498c16871f7"><enum>(2)</enum><header>Injunctive
			 authority</header>
							<subparagraph id="idB23C1D2424BB459FA1640B4808143F68"><enum>(A)</enum><header>In
			 general</header><text>The district courts of the United States shall have
			 jurisdiction to—</text>
								<clause id="id9FBFC1E7378249A4AA0DC73C73B0D2DC"><enum>(i)</enum><text>restrain a
			 violation of a regulation promulgated under subsection (a);</text>
								</clause><clause id="id6C6667A2CD784C079F547DC6CD778680"><enum>(ii)</enum><text>award other
			 appropriate relief; and</text>
								</clause><clause id="id9B9EB16AF8CF4965A52A01F50934C13A"><enum>(iii)</enum><text>compel the
			 furnishing of information required under the regulation.</text>
								</clause></subparagraph><subparagraph id="idA387552B24CD4A4D89760BD5696B52A2"><enum>(B)</enum><header>Actions</header><text>An
			 action to restrain such violations and compel such actions shall be brought by
			 and in the name of the United States.</text>
							</subparagraph><subparagraph id="id053BCA1B3E784AB6BFF56648C62B7916"><enum>(C)</enum><header>Subpoenas</header><text>In
			 the action, a subpoena for a witness who is required to attend a district court
			 in any district may apply in any other district.</text>
							</subparagraph></paragraph></subsection><subsection id="idB14B722B84274ADE9936F9B37BF72FD1"><enum>(h)</enum><header>Effective
			 date</header><text>Except as otherwise specifically provided in this section,
			 this section takes effect on January 1, 2016.</text>

					<subsection id="id8E44F27E8B8B44848D1656380EA48808"><enum>(a)</enum><header>Multiyear
			 contracts for the procurement of synthetic fuels authorized</header>
						<paragraph id="id2C302A84DB4F4E308F875DFA0767710A"><enum>(1)</enum><header>In
			 general</header><text>Chapter 141 of title 10, United States Code, is amended
			 by adding at the end the following new section:</text>

								<section id="id222FC676950249BBABD52C2E7026E083"><enum>2410r.</enum><header>Multiyear
				contract authority: purchase of synthetic fuels</header>
									<subsection id="id223946D5FD724EEF8DE24F032048B465"><enum>(a)</enum><header>Multiyear
				contracts authorized</header><text>The head of an agency may enter into
				contracts for a period not to exceed 25 years for the purchase of synthetic
				fuels.</text>
									</subsection><subsection id="id17025F0AFE6F4F97BA0BDC8CD908566C"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
										<paragraph id="id78CE0B09A2534BB79C6E9AC1DE0701AC"><enum>(1)</enum><text>The term
				<term>head of an agency</term> has the meaning given that term in section
				2302(1) of this title.</text>
										</paragraph><paragraph id="idAAB6C5E6DECC4DF8B4280A4CB4105CD2"><enum>(2)</enum><text>The term
				<term>synthetic fuel</term> means any liquid, gas, or combination thereof
				that—</text>
											<subparagraph id="idC1A12CE66ABD4548A837FC7848265229"><enum>(A)</enum><text>can be used as a
				substitute for petroleum or natural gas (or any derivative thereof, including
				chemical feedstocks); and</text>
											</subparagraph><subparagraph id="id689B0CC2B414495B922650FA25A01E21"><enum>(B)</enum><text>is produced by
				chemical or physical transformation of domestic sources of
				energy.</text>
											</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="idEC8112F194444D659CE183A9122E2431"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 141
			 of such title is amended by adding at the end the following new item:</text>

						</paragraph></subsection><subsection id="id41B66830838C4911B6F429E22F5628D2"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 120 days after the date of the enactment of this Act, the Secretary
			 of Defense shall prescribe regulations providing that the head of an agency may
			 initiate a multiyear contract as authorized by section 2410r of title 10,
			 United States Code (as added by subsection (a)), only if the head of the agency
			 has determined in writing that—</text>
						<paragraph id="id5D6C70368D5C4F0D967D734D92366D46"><enum>(1)</enum><text>there is a
			 reasonable expectation that throughout the contemplated contract period the
			 head of the agency will request funding for the contract at the level required
			 to avoid contract cancellation;</text>
						</paragraph><paragraph id="id8163B1ED97E14AF4ABAA84D376D3F99E"><enum>(2)</enum><text>the technical
			 risks associated with the technologies for the production of synthetic fuel
			 under the contract are not excessive; and</text>
						</paragraph><paragraph id="id80014EEBD12643399AC3F4A2E8D2BC51"><enum>(3)</enum><text>the contract will
			 contain appropriate pricing mechanisms to minimize risk to the Government from
			 significant changes in market prices for energy.</text>
						</paragraph></subsection><subsection id="id557909D2B131412A8C4D4EC5D77541BC"><enum>(c)</enum><header>Limitation on
			 use of authority</header><text>No contract may be entered into under the
			 authority in section 2410r of title 10, United States Code (as so added), until
			 the regulations required by subsection (b) are prescribed.</text>
