		<section id="id21A1DEBE187A43C5BDC1F6028341E58A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe School Lunch Act of
			 2008</short-title></quote>.</text>
		</section><section id="S1"><enum>2.</enum><header>Mandatory recall
			 authority</header>
			<subsection id="idC8CA1DE199F44799B7E98B316BE1182C"><enum>(a)</enum><header>Meat and meat
			 food products</header><text display-inline="yes-display-inline">Section 401 of
			 the Federal Meat Inspection Act (21 U.S.C. 671) is amended—</text>
				<paragraph id="id94ADAE7338404AE59206FB6A1A47DFE5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="section" style="OLC">Sec. 401.</header-in-text> The Secretary
			 may</quote> and inserting the following:</text>

				services</header>
							<subsection id="id2F23E29D102141A3AB0DB62D3F7AB622"><enum>(a)</enum><header>In
				general</header><text>The Secretary may</text>
							</subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id5AD3A7799E0B48CCAE33110BF2F6CD48"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8D805E824A3143B0B14F620ABAFBD559" style="OLC">
						<subsection id="id1BF850C4114743149914FA04CCC0984A"><enum>(b)</enum><header>Mandatory
				recall authority</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idA03C0CBA6C9A4C2C9395AF7C88BD8897"><enum>(1)</enum><header display-inline="yes-display-inline">Order to cease distribution</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id413D6559B16A4690A1DC92350DFE5AFB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If the Secretary
				finds that certain meat or meat food products may cause a serious, adverse
				health consequence or may be adulterated, the Secretary shall issue an order
				requiring the appropriate person (including a meat broker, packer,
				manufacturer, distributor, or retailer of the meat or meat food product) to
				immediately cease distribution of the meat or meat food product.</text>
								</subparagraph><subparagraph id="IDdd39c67e364a4e10995c51428a5e0563"><enum>(B)</enum><header>Informal
				hearing</header>
									<clause id="id00D6100088A9479EA1485E3BFEBB8E0B"><enum>(i)</enum><header>In
				general</header><text>An order under subparagraph (A) shall provide the person
				subject to the order with an opportunity for an informal hearing, to be held
				not later than 10 days after the date of the issuance of the order, on the
				actions required by the order and on whether the order should be amended to
				require a recall of the meat or meat food product involved.</text>
									</clause><clause id="id702706E3C015454F8107DA3C042B1A4E"><enum>(ii)</enum><header>Inadequate
				grounds</header><text>If, after providing an opportunity for a hearing under
				clause (i), the Secretary determines that inadequate grounds exist to support
				the actions required by the order, the Secretary shall vacate the order.</text>
									</clause></subparagraph></paragraph><paragraph id="IDbc51af3e851948f092dfab9f3857df17"><enum>(2)</enum><header>Order to
				recall</header>
								<subparagraph id="ID72f1bafcc0d640d19552586d0735477f"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), if, after
				providing an opportunity for an informal hearing under paragraph (1)(B)(i), the
				Secretary determines that the order should be amended to include a recall of
				the meat or meat food product with respect to which the order was issued, the
				Secretary shall amend the order to require a recall.</text>
								</subparagraph><subparagraph id="id7533BF9852194911B3008D6CE1CA3C9E"><enum>(B)</enum><header>Prohibition</header><text>An
				amended order under subparagraph (A) shall not include a recall of meat or meat
				food products from individual consumers.</text>
								</subparagraph><subparagraph id="idB20891B5281642B78771D3D5A7721F57"><enum>(C)</enum><header>Timetable</header><text>The
				Secretary shall—</text>
									<clause id="id0B08E5D62B0240E8B5FFB593340E51CC"><enum>(i)</enum><text>specify a
				timetable during which the meat or meat food product recall will occur;
				and</text>
									</clause><clause id="id233D2353C98E4727B45BB1BDE66906B7"><enum>(ii)</enum><text>require periodic
				reports to the Secretary describing the progress of the
				recall.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id38B1B06652A54C8CACC6632D04F1A5C7"><enum>(b)</enum><header>Poultry and
			 poultry products</header><text>Section 18 of the Poultry Products Inspection
			 Act (21 U.S.C. 467) is amended—</text>
				<paragraph id="id9D2A2C89789A4F54BE4C1CCB7923B5AD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="section" style="OLC">Sec. 18.</header-in-text> (a) The Secretary
			 may</quote> and inserting the following:</text>

			 <quote>(b) Upon the withdrawal</quote> and inserting the following:</text>

				recall authority</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id9ECECF5300DA43AD9E5E169A6FDD6A14"><enum>(1)</enum><header display-inline="yes-display-inline">Order to cease distribution</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id9F800A50A54B41F7B44AC70047BB9495"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If the Secretary
				finds that certain poultry or poultry products may cause a serious, adverse
				health consequence or may be adulterated, the Secretary shall issue an order
				requiring the appropriate person (including a poultry broker, packer,
				manufacturer, distributor, or retailer of the poultry or poultry product) to
				immediately cease distribution of the poultry or poultry product.</text>
								</subparagraph><subparagraph id="id2F54149E50A244AA8553ABC6E3F2EB0D"><enum>(B)</enum><header>Informal
				hearing</header>
									<clause id="id4CA93517A589437B9F115288E0E04877"><enum>(i)</enum><header>In
				general</header><text>An order under subparagraph (A) shall provide the person
				subject to the order with an opportunity for an informal hearing, to be held
				not later than 10 days after the date of the issuance of the order, on the
				actions required by the order and on whether the order should be amended to
				require a recall of the poultry or poultry product involved.</text>
									</clause><clause id="idB30DA81FCB8141628A0BD7C1DB2B2497"><enum>(ii)</enum><header>Inadequate
				grounds</header><text>If, after providing an opportunity for a hearing under

								<subparagraph id="idC8A4AB11D3404E5CB99D1BA10C6E3799"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), if, after
				providing an opportunity for an informal hearing under paragraph (1)(B)(i), the
				Secretary determines that the order should be amended to include a recall of
				the poultry or poultry product with respect to which the order was issued, the
				Secretary shall amend the order to require a recall.</text>
								</subparagraph><subparagraph id="idF4D5220DCFB342CFA1190262EB4F8676"><enum>(B)</enum><header>Prohibition</header><text>An
				amended order under subparagraph (A) shall not include a recall of poultry or
				poultry products from individual consumers.</text>
								</subparagraph><subparagraph id="id06CBB26430DE405CA2909448A58C41AD"><enum>(C)</enum><header>Timetable</header><text>The
				Secretary shall—</text>
									<clause id="idDE6293843F064B8595F316E9E771C630"><enum>(i)</enum><text>specify a
				timetable during which the poultry or poultry product recall will occur;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id307FD199A65C4FC193071E41A749422F"><enum>(ii)</enum><text>require periodic
				reports to the Secretary describing the progress of the
				recall.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id3F2835EEDC5C4C30A09C693F3369D7F1"><enum>3.</enum><header>Relationship to
			 school lunch program</header>
			<subsection id="id82144C1ACE3841A98F18B77BDE08480C"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Agriculture (referred to in this Act as
			 the <quote>Secretary</quote>) shall—</text>
				<paragraph id="id7F216413981A4D83A530CEE26094DF6A"><enum>(1)</enum><text>establish a
			 program to provide schools that participate in the school lunch program
			 established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (42 U.S.C. 1751 et
			 seq.) or the school breakfast program established by section 4 of the
			 <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (42
			 U.S.C. 1773) with training relating to—</text>
					<subparagraph id="id37938EB7D4DB415FBBF167F7E60A971E"><enum>(A)</enum><text>how to stay
			 informed about meat and meat food products subject to a recall under the
			 Federal Meat Inspection Act (21 U.S.C. 601 et seq.) and poultry or poultry
			 products subject to a recall under the Poultry Products Inspection Act (21
			 U.S.C. 451 et seq.), including any new recall procedures;</text>
					</subparagraph><subparagraph id="idABC2C07CAC44490185DC6E632BECAB3C"><enum>(B)</enum><text>how to dispose of
			 meat and meat food products or poultry and poultry products subject to a recall
			 under those Acts; and</text>
					</subparagraph><subparagraph id="idB4FE6B0DCC7E4A22A5B6B2CDFF6882B3"><enum>(C)</enum><text>how to properly
			 inform parents in a timely manner of a recall under those Acts; and</text>
					</subparagraph></paragraph><paragraph id="idDEA39B985A634B71ACE54C29D8259808"><enum>(2)</enum><text>make information
			 and training materials accessible to the schools through the information
			 clearinghouse established under subsection (b).</text>
				</paragraph></subsection><subsection id="idE7E8D314E8DA488B83370A47C04B9A8D"><enum>(b)</enum><header>Information
			 clearinghouse</header><text display-inline="yes-display-inline">The Secretary
			 shall ensure that the information provided on the website of the Department of
			 Agriculture relating to meat, meat food products, poultry, and poultry products
			 subject to inspection by the Secretary, including information about recalls
			 under the Federal Meat Inspection Act (21 U.S.C. 601 et seq.) and the Poultry
			 Products Inspection Act (21 U.S.C. 451 et seq.), is—</text>
				<paragraph id="idC18A9B5B599E436EB5D8ACCC61A4AE99"><enum>(1)</enum><text display-inline="yes-display-inline">up-to-date; and</text>
				</paragraph><paragraph id="id8D2DEDBECFBC42ADA3E0EB07CB85922E"><enum>(2)</enum><text>written in a
			 clear manner that is accessible by school employees and parents.</text>
				</paragraph></subsection><subsection id="IDcf7b1615827c490795289608190e8d2b"><enum>(c)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall promulgate regulations to ensure that the Secretary is able to trace all
			 meat, meat food products, poultry, and poultry products inspected by the
			 Secretary at all times from the slaughter premises to final distribution to
			 schools described in subsection (a)(1).</text>
			</subsection></section><section id="idEADDBE3613664ACC8003B4EA3AB2FF54"><enum>4.</enum><header>Food protection
			 review, evaluation, and report</header>
			<subsection id="id44F8432D4E634BAA82D121E5344CE1F9"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall conduct a review and evaluation of
			 the meat, meat food product, poultry, and poultry product inspection and recall
			 procedures of the Department of Agriculture.</text>
			</subsection><subsection id="idB457F56C79B84433B63E60F8FF086911"><enum>(b)</enum><header>Requirements</header><text>The
			 review and evaluation required under subsection (a) shall—</text>
				<paragraph id="id0F31DCF5111E48F186D820DC39992DD1"><enum>(1)</enum><text>focus on
			 achieving optimal consumer safety and protecting the food supply; and</text>
				</paragraph><paragraph id="id6220E35857ED4741851BFE5A3EB57731"><enum>(2)</enum><text>include—</text>
					<subparagraph id="id3DB792B0E9894F4F9CFF83A2372C1CE5"><enum>(A)</enum><text>a review of the
			 risks to consumer safety at all times from the initial production of a meat,
			 meat food product, poultry, or poultry product until consumption of the meat,
			 meat food product, poultry, or poultry product; and</text>
					</subparagraph><subparagraph id="idCB3B9EB7203F4200AD78F372BE79756F"><enum>(B)</enum><text>an evaluation of
			 methods to—</text>
						<clause id="id1915599677A447259E45A404C7552E77"><enum>(i)</enum><text>target resources
			 to achieve maximum risk reduction;</text>
						</clause><clause id="idA667A92AF7554BEBA46738D704C649ED"><enum>(ii)</enum><text>address both
			 unintentional and deliberate contamination; and</text>
						</clause><clause id="id5C1E44E2E98847A7987AE4CBB3041BF2"><enum>(iii)</enum><text>use science and
			 modern technology systems to improve protection of the food supply.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id28F65EB595904E2386025C5D8C588013"><enum>(c)</enum><header>Report</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall submit to the Committee on Agriculture of the House of Representatives
			 and the Committee on Agriculture, Nutrition, and Forestry of the Senate a
			 report describing the results of the review and evaluation conducted under
			 subsection (a).</text>
			</subsection></section><section id="id82EFB8409B7D487AA113B9DF39A73B40"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
