		  Excellence in Tribal Governance Foundation and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Mark O. Hatfield Scholarship and
			 Excellence in Tribal Governance Act of 2008</short-title></quote>.</text>
		</section><section id="ID6e7e200a28d64e958ad8d2024e3875e9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="IDc1e265c1f0644e1b8fe2453b4dfe9076"><enum>(1)</enum><text>Senator Mark O.
			 Hatfield served the United States with distinction and honor;</text>
			</paragraph><paragraph id="ID482deecdd1bf4ec8b6c6521630915e47"><enum>(2)</enum><text>Senator Hatfield
			 has had a lasting impact on the relationship between the United States and
			 Native Americans, restoring to Federal recognition the Grand Ronde, Coquille,
			 Cow Creek Band of Umpqua Indians, Confederated Tribes of the Coos, Lower Umpqua
			 and Siuslaw Indians, and Confederated Tribes of Siletz Indians;</text>
			</paragraph><paragraph id="ID45801a137c764e78be1cc43740ee1f08"><enum>(3)</enum><text>Senator Hatfield
			 has been a champion of the rights of Native Americans and Alaska Natives and
			 worked in Congress to strengthen tribal self-governance; and</text>
			</paragraph><paragraph id="IDd17b3e6763b948cd969d9bc978eac11b"><enum>(4)</enum><text>it is a fitting
			 tribute to the leadership, courage, and bipartisan spirit that Senator Mark O.
			 Hatfield exemplifies to establish in his name programs to encourage excellence
			 in tribal government.</text>
			</paragraph></section><section id="ID9efaa79df9614bc09975928effca2a49"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID95cda93abb014a059c5ad4a3066144d4"><enum>(1)</enum><header>Board</header><text>The
			 term <term>Board</term> means the Board of Trustees of the Foundation.</text>
			</paragraph><paragraph id="IDb66ebb5498b749e0830101ffc647b787"><enum>(2)</enum><header>Eligible
			 individual</header><text>The term <term>eligible individual</term> means a
			 citizen or national of the United States or a permanent resident alien of the
			 United States.</text>
			</paragraph><paragraph id="ID26df40b375404827b48c9e315fcec89f"><enum>(3)</enum><header>Foundation</header><text>The
			 term <term>Foundation</term> means the Mark O. Hatfield Scholarship and
			 Excellence in Tribal Governance Foundation established by section 4(a).</text>
			</paragraph><paragraph id="ID932cf3fe9a8040f1bfeac239c6705f49"><enum>(4)</enum><header>Institute</header><text>The
			 term <term>Institute</term> means the Institute for Tribal Government at
			 Portland State University.</text>
			</paragraph><paragraph id="id038688EF6D724E6FB527ABA0EF76DF94"><enum>(5)</enum><header>Institute
			 Policy Board</header><text>The term <term>Institute Policy Board</term> means
			 the Institute Policy Board for the Institute for Tribal Government at Portland
			 State University.</text>
			</paragraph><paragraph id="ID0a211d4194e6423887f511cfbf7229fa"><enum>(6)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given the term in section 101(a) of the Higher
			 Education Act of 1965 (20 U.S.C. 1001(a)).</text>
			</paragraph><paragraph id="IDd84950f6bd9c412eaadc03c2534821a1"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph id="IDe8817e2f21384536a0768f01cea41f24"><enum>(A)</enum><text>a State;</text>
				</subparagraph><subparagraph id="ID33c18eeb9e2f438d929af53814890107"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph id="IDa152d2132cd94539a6c77b8e3a04f40b"><enum>(C)</enum><text>American
			 Samoa;</text>
				</subparagraph><subparagraph id="IDbb131414d80546f8a56c91dfbb33c267"><enum>(D)</enum><text>the Commonwealth
			 of the Northern Mariana Islands;</text>
				</subparagraph><subparagraph id="IDad20d80d90a5468797695565e117802c"><enum>(E)</enum><text>Guam;</text>
				</subparagraph><subparagraph id="ID7f3e8deb563b47b79fd0aea0d4650541"><enum>(F)</enum><text>the Republic of
			 the Marshall Islands;</text>
				</subparagraph><subparagraph id="ID2d2c912d8f244a31997066cf8a7696a9"><enum>(G)</enum><text>the Federal
			 States of Micronesia;</text>
				</subparagraph><subparagraph id="ID43b3618f91c84698a8cfcead20cf192b"><enum>(H)</enum><text>the Republic of
			 Palau;</text>
				</subparagraph><subparagraph id="ID35a53d064e054423873107b429b9bf99"><enum>(I)</enum><text>the Commonwealth
			 of Puerto Rico; and</text>
				</subparagraph><subparagraph id="ID8731e49b495848238a250efdf5ce5995"><enum>(J)</enum><text>the United States
			 Virgin Islands.</text>
				</subparagraph></paragraph></section><section id="ID04a785f23fbe47ac887907a651fffdf0"><enum>4.</enum><header>Establishment of
			 the Mark O. Hatfield scholarship and excellence in tribal governance
			 foundation</header>
			<subsection id="id0D1AC7BCFCE7431B8712AF07F5D9A193"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established as an independent
			 entity in the Executive branch the Mark O. Hatfield Scholarship and Excellence
			 in Tribal Governance Foundation.</text>
			</subsection><subsection id="ID93ccd6f1e34e48d09caa1004b9e198d6"><enum>(b)</enum><header>Board of
			 Trustees</header>
				<paragraph id="id185CE0294FFE432A9DFEBCFA7238905F"><enum>(1)</enum><header>In
			 general</header><text>The Foundation shall be subject to the supervision and
			 direction of a Board of Trustees.</text>
				</paragraph><paragraph id="IDc99eb2b1bc864c5cae541c176c4a7f1a"><enum>(2)</enum><header>Membership</header><text>The
			 Board shall consist of the Institute Policy Board.</text>
				</paragraph></subsection><subsection id="ID80aef9dac6524b759d1da9d81188f483"><enum>(c)</enum><header>Location of
			 Foundation</header><text>The Foundation shall be located in Portland,
			 Oregon.</text>
			</subsection><subsection id="ID07f61a60a1e342699b7ac71078259e2e"><enum>(d)</enum><header>Executive
			 director</header>
				<paragraph id="IDcdab50a12e4d43dd9aabbd5bc8d74384"><enum>(1)</enum><header>In
			 general</header><text>There shall be an Executive Director of the Foundation,
			 who shall be appointed by the Board.</text>
				</paragraph><paragraph id="IDa8c3e11a2fa14529b5033a7857eec3d7"><enum>(2)</enum><header>Duties</header><text>The
			 Executive Director—</text>
					<subparagraph id="ID4697f1005a9e48b699234c4422103dfb"><enum>(A)</enum><text>shall be the
			 chief executive officer of the Foundation; and</text>
					</subparagraph><subparagraph id="ID67ae63fe225843e7bd3af3fe882834b3"><enum>(B)</enum><text>shall carry out
			 the functions of the Foundation, subject to the supervision and direction of
			 the Board, and such other functions consistent with this Act as the Board shall
			 prescribe.</text>
					</subparagraph></paragraph><paragraph id="ID3506ab5456c6466c923eff6e5c7a6923"><enum>(3)</enum><header>Compensation</header><text>The
			 Executive Director may be compensated at the rate specified for an employee in
			 level IV of the Executive Schedule under section 5315 of title 5, United States
			 Code.</text>
				</paragraph></subsection></section><section id="ID14febd027d104a9e968e867e9d5d78bb"><enum>5.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the Foundation shall
			 be—</text>
			<paragraph id="IDe3cba812159c49bda48f717e5c7f3ed2"><enum>(1)</enum><text>to develop
			 resources to properly train Native American and Alaska Native tribal council
			 members in self-government and related fields;</text>
			</paragraph><paragraph id="ID7957fa681a09475f9b686a34c7cc73f3"><enum>(2)</enum><text>to foster among
			 people in the United States greater recognition and understanding of the role
			 of tribal self-government in the development of the United States;</text>
			</paragraph><paragraph id="ID2d245019959c41c0a0ff034d47cccdf2"><enum>(3)</enum><text>to identify
			 critical issues facing tribal governments;</text>
			</paragraph><paragraph id="ID2035792d62a742fa98fe6af48c1f9be4"><enum>(4)</enum><text>to establish a
			 program for tribal governance research at the Institute; and</text>
			</paragraph><paragraph id="ID95246225ff374d92a1267afcfbe607cc"><enum>(5)</enum><text>to provide
			 educational outreach regarding tribal self-government.</text>
			</paragraph></section><section id="ID35f354552f0f4f40b8562e7937b40193"><enum>6.</enum><header>Authority of the
			 Foundation</header>
			<subsection id="IDb91a9d8224124810b1a9faee2b728a95"><enum>(a)</enum><header>In
			 general</header><text>The Foundation, in consultation with the Institute, may
			 identify and conduct such programs, activities, and services as the Foundation
			 considers appropriate to carry out the purposes of the Foundation.</text>
			</subsection><subsection id="ID83df8d92fd014a2190e49d68134661af"><enum>(b)</enum><header>Programs,
			 activities, and services</header><text>The Foundation may, in accordance with
			 this section—</text>
				<paragraph id="IDf27227075c0f4c9184fcc273b6cd9b32"><enum>(1)</enum><text>award
			 scholarships, fellowships, internships, and grants; and</text>
				</paragraph><paragraph id="IDbcffb2fb98f241bba1637831d431fe0e"><enum>(2)</enum><text>provide grants to
			 the Institute to carry out and manage other programs, activities, and
			 services.</text>
				</paragraph></subsection><subsection id="IDea028dcd5e6f4bd69e3d84ec9ad08c8c"><enum>(c)</enum><header>National
			 competition</header><text>The Foundation may provide, directly or by contract,
			 for the conduct of a national competition for the purpose of selecting
			 recipients of scholarships, fellowships, internships, and grants awarded under
			 this Act.</text>
			</subsection><subsection id="ID274e96b534b344c4a921e55ff1ef6fb8"><enum>(d)</enum><header>Award of
			 scholarships, fellowships, internships, and grants</header>
				<paragraph id="ID91246016dde64ee694dc6ee3ccd98438"><enum>(1)</enum><header>In
			 general</header><text>The Foundation may award scholarships, fellowships,
			 internships, and grants to eligible individuals who meet the minimum criteria
			 established by the Foundation, for study in fields relating to tribal
			 governance.</text>
				</paragraph><paragraph id="ID7c678a8ec41a407abcf2bf6605aaf7cb"><enum>(2)</enum><header>Mark o.
			 hatfield scholars</header><text>Recipients of scholarships, fellowships,
			 internships, and grants under this Act shall be known as <quote>Mark O.
			 Hatfield Scholars</quote>.</text>
				</paragraph></subsection><subsection id="IDf22c032576e94ac79b4780b27af18390"><enum>(e)</enum><header>Scholarships</header>
				<paragraph id="IDad37772b46434d71ba4eaa64b5d78ff6"><enum>(1)</enum><header>In
			 general</header><text>The Foundation may award scholarships to
			 outstanding—</text>
					<subparagraph id="ID3382e0b5d45c4d9891dba8c5b75e192d"><enum>(A)</enum><text>undergraduate
			 students who intend to pursue careers relating to tribal governance; and</text>
					</subparagraph><subparagraph id="IDe98d24ed19ab456da4c3b97e335dcda5"><enum>(B)</enum><text>Native American
			 and Alaska Native undergraduate students who intend to pursue careers in tribal
			 public policy.</text>
					</subparagraph></paragraph><paragraph id="ID3b19575e01f340af8788796e1a8314a0"><enum>(2)</enum><header>Payments</header><text>An
			 eligible individual awarded a scholarship under this Act may receive payments
			 under this Act only during such periods as the Foundation determines that the
			 eligible individual—</text>
					<subparagraph id="IDca3bf60ee4174469b67cf7bdc7d4a165"><enum>(A)</enum><text>is maintaining
			 satisfactory proficiency and devoting full time to study or research;
			 and</text>
					</subparagraph><subparagraph id="IDadcb9d53ecc64effbe43d962c0226829"><enum>(B)</enum><text>is not engaging
			 in gainful employment other than employment approved by the Foundation under
			 regulations of the Board.</text>
					</subparagraph></paragraph><paragraph id="IDbd537d51b8c443d4b706497882dc6adf"><enum>(3)</enum><header>Reports</header>
					<subparagraph id="ID720fa0c218ed46e1a379ea63039daeba"><enum>(A)</enum><header>In
			 general</header><text>The Foundation may require reports containing such
			 information, in such form, and to be filed at such times as the Foundation
			 determines to be necessary from any eligible individual awarded a scholarship
			 under this Act.</text>
					</subparagraph><subparagraph id="ID4ae9203ea5a044a6be1ed46a2b81eb29"><enum>(B)</enum><header>Certificate</header><text>Except
			 as otherwise provided under this subsection, a report under subparagraph (A)
			 shall be accompanied by a certificate from an appropriate official at the
			 institution of higher education, approved by the Foundation, stating that the
			 individual is making satisfactory progress in, and is devoting essentially full
			 time to, study or research.</text>
					</subparagraph></paragraph></subsection><subsection id="ID699fae048ded4f1993a3c708680ae5d8"><enum>(f)</enum><header>Fellowships</header><text>The
			 Foundation may award fellowships to—</text>
				<paragraph id="IDec7e1451c0f549cfb7b3247d89e3e70d"><enum>(1)</enum><text>outstanding
			 graduate students who intend to pursue advanced degrees in fields relating to
			 tribal governance;</text>
				</paragraph><paragraph id="IDf64cdb9e64a1491899d79f78cf2e3c5b"><enum>(2)</enum><text>outstanding
			 Native American and Alaska Native graduate students who intend to pursue
			 advanced degrees in tribal public policy, law, or medicine; and</text>
				</paragraph><paragraph id="IDd59d0d4982a74db5895d1ca7bc4185cc"><enum>(3)</enum><text>faculty from a
			 variety of disciplines to bring the expertise of the faculty to the
			 Foundation.</text>
				</paragraph></subsection><subsection id="ID61593f3a30ad4379ab30a807e1ac9bdf"><enum>(g)</enum><header>Internships</header><text>The
			 Foundation may award internships to deserving and qualified—</text>
				<paragraph id="ID4e24a87b4b504be38cb917948e75dcf4"><enum>(1)</enum><text>individuals, for
			 use in participating in internships in Federal, State, and local agencies or in
			 offices of major tribal governance organizations; and</text>
				</paragraph><paragraph id="ID0a5153bab4964d8e92de8240823dd05c"><enum>(2)</enum><text>Native American
			 and Alaska Native individuals, for use in participating in internships in
			 Federal, State, and local agencies or in offices of major public health or
			 public policy organizations.</text>
				</paragraph></subsection><subsection id="ID41305a55267048a0b9c0be78ed761290"><enum>(h)</enum><header>Grants</header><text>The
			 Foundation shall award grants to the Institute—</text>
				<paragraph id="IDab598c072a204f42a3b75fc2e842a9ab"><enum>(1)</enum><text>to provide for an
			 annual panel of experts to discuss contemporary tribal governance
			 issues;</text>
				</paragraph><paragraph id="IDdc6f4f99caa44016a38ac998d9d1beed"><enum>(2)</enum><text>to conduct tribal
			 governance policy research;</text>
				</paragraph><paragraph id="ID3a19a071abf845dc922c2cfd6d1081a2"><enum>(3)</enum><text>to conduct
			 research on Native American and Alaska Native tribal public policy issues;
			 and</text>
				</paragraph><paragraph id="ID1114268056ff4a1e8b908c451177b438"><enum>(4)</enum><text>to invite
			 visiting policymakers to share practical experiences with the
			 Foundation.</text>
				</paragraph></subsection><subsection id="ID9cfbf4b9003a4298ba34adb8d70e1c5a"><enum>(i)</enum><header>Coordination</header><text>The
			 Foundation shall assist in the development and implementation of a program for
			 tribal governance research to be located at the Institute.</text>
			</subsection><subsection id="ID94283a4b00c9438293bab60f00d69405"><enum>(j)</enum><header>Program
			 priorities</header>
				<paragraph id="ID6e7a10c1379548e6b55224831c43c408"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Foundation shall
			 determine—</text>
					<subparagraph id="ID0a810565ac8c461585323d326d3661ab"><enum>(A)</enum><text>the priority of
			 the programs to be carried out under this Act; and</text>
					</subparagraph><subparagraph id="ID353c62c2e58f4c89924318c88f34f0e5"><enum>(B)</enum><text>the amount of
			 funds to be allocated for the programs.</text>
					</subparagraph></paragraph><paragraph id="ID93b715054f694786bc6cd1f5dda3561e"><enum>(2)</enum><header>Requirements</header><text>Of
			 amounts made available to carry out this section—</text>
					<subparagraph id="IDc2c22181394d4bb08f9eadbb48b1f54e"><enum>(A)</enum><text>not less than 50
			 percent shall be used for the programs described in subsections (e), (f), and
			 (g);</text>
					</subparagraph><subparagraph id="IDfa6b8ba072d74976a48fe26b968aebcd"><enum>(B)</enum><text>not less than 20
			 percent shall be made available to the Institute to carry out subsections (h)
			 and (i), on the conditions that—</text>
						<clause id="ID95d5f427d179468daff3a3fad9bb796b"><enum>(i)</enum><text>a
			 25-percent matching share is provided from other non-Federal sources;
			 and</text>
						</clause><clause id="IDbe3614ed303f49e286d0bcc6afe0c375"><enum>(ii)</enum><text>adequate space
			 at the Institute is made available by the Institute for the Executive Director
			 and other appropriate staff of the Foundation; and</text>
						</clause></subparagraph><subparagraph id="ID83c3f5b158424b10adedf17acef2a5ab"><enum>(C)</enum><text>not more than 15
			 percent shall be used for salaries and other administrative purposes.</text>
					</subparagraph></paragraph></subsection></section><section id="IDad17a383cc8d411b989b7f222e0baea5"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
