		<official-title>To provide for research into the development of
		  energy-efficient technologies and renewable energy technologies and to foster
		  the introduction of energy-efficient technologies and renewable energy
		  technologies into the marketplace, with the goal of reducing United States oil
		  imports.</official-title>

		<section id="IDFD989329A7DD48F18BA06CFA497F6CBA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Energy Efficiency Development
			 Act</short-title></quote>.</text>
		</section><section id="IDEAB68AA3581F44528148CD7801DD5F02"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID7BFD7F12EAAA4AFD83FA5E2B72C18F44"><enum>(1)</enum><text>the welfare and
			 security of the United States require that adequate provision be made for
			 activities relating to the development of energy-efficient technologies and
			 renewable energy technologies; and</text>
			</paragraph><paragraph id="ID28F563E647424503A92DD79E242900D5"><enum>(2)</enum><text>those activities
			 should be the responsibility of, and should be directed by, an independent
			 establishment exercising control over activities relating to the development
			 and promotion of energy-efficient technologies and renewable energy
			 technologies sponsored by the United States.</text>
			</paragraph></section><section id="ID114CD8E9F32B4ED091977DD3651D3966"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish the
			 National Energy Efficiency Development Administration—</text>
			<paragraph id="idA10706DC87FF4D4793C87CCC9799E00C"><enum>(1)</enum><text display-inline="yes-display-inline">to develop technologies to increase energy
			 efficiency;</text>
			</paragraph><paragraph id="id1902DCA720AF4DC0914A949B22083B14"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce the demand for energy;</text>
			</paragraph><paragraph id="idD3ECD536C7554969B8B99E3D6FC0B533"><enum>(3)</enum><text>to develop
			 technologies to produce energy from renewable sources;</text>
			</paragraph><paragraph id="idE694265E3F644EE2995C5EAB0F6C0985"><enum>(4)</enum><text>to harness and
			 facilitate the ingenuity of the ongoing research and development of new energy
			 technology occurring throughout the United States; and</text>
			</paragraph><paragraph id="idFECD890C7DF2482DBE124A1F1D855907"><enum>(5)</enum><text>to facilitate the
			 commercialization of new energy-efficient technologies and renewable energy
			 technologies.</text>
			</paragraph></section><section id="IDF0E2790EC4F24B858E79CF7C3E456901"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID3C6F61FA1CD44DDD81A3841491B5F4A0"><enum>(1)</enum><header>Administration</header><text>The
			 term <term>Administration</term> means the National Energy Efficiency
			 Development Administration established by section 5(a).</text>
			</paragraph><paragraph id="ID49AD7E1B35B345178CE034823DFE007B"><enum>(2)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the head of the Administration appointed
			 under section 5(c)(1).</text>
			</paragraph><paragraph id="IDE3C8564F3A0A46D789438828B6B78577"><enum>(3)</enum><header>Advisory
			 Committee</header><text>The term <term>Advisory Committee</term> means the
			 Policy Advisory Committee established by section 7(a)(1).</text>
			</paragraph><paragraph id="ID0D89E0F03FB64F3A00C3815204E641A9"><enum>(4)</enum><header>Energy-efficient
			 technology</header><text>The term <term>energy-efficient technology</term>
			 means a technology that improves the energy efficiency of any sector of the
			 economy, including the transportation, building, energy generation, appliance,
			 power transmission, and industrial sectors.</text>
			</paragraph><paragraph id="ID76998BEE369D426BB4E22C98B587F813"><enum>(5)</enum><header>Renewable
			 energy technology</header><text>The term <term>renewable energy
			 technology</term> means a technology (including a technology invented after the
			 date of enactment of this Act) that produces energy from a sustainable biomass,
			 wind, hydroelectric, solar, geothermal, fuel cell, or other renewable
			 source.</text>
			</paragraph></section><section id="IDFB23743A3553421E9C2D2303E4AFC72E"><enum>5.</enum><header>National Energy
			 Efficiency Development Administration</header>
			<subsection id="ID83B2081C68A641AC99645FB74980E936"><enum>(a)</enum><header>Establishment</header><text>There
			 is established, as an independent agency, the National Energy Efficiency
			 Development Administration.</text>
			</subsection><subsection id="IDD2E71CF74EEC412A9660652EABEFCECC"><enum>(b)</enum><header>Mission</header><text>The
			 mission of the Administration shall be—</text>
				<paragraph id="idFB49F6A24879422B998CAEC8CEB81F87"><enum>(1)</enum><text>to increase the
			 efficiency of the production and use of energy in all sectors of the economy;
			 and</text>
				</paragraph><paragraph id="idA50044DB7DAB470E9EAEC0070236A5F0"><enum>(2)</enum><text>to reduce United
			 States imports of oil by—</text>
					<subparagraph id="ID385B11A856AD4B8E96FEDDCA00D9EE00"><enum>(A)</enum><text>5 percent by
			 2010;</text>
					</subparagraph><subparagraph id="IDDC2CA9B82D3B4E29AB47858EB6AB763F"><enum>(B)</enum><text>20 percent by
			 2013; and</text>
					</subparagraph><subparagraph id="ID0B885D7B8395465791FB37B5F5975CEA"><enum>(C)</enum><text>50 percent by
			 2020.</text>
					</subparagraph></paragraph></subsection><subsection id="ID1B85198BC61647E486722BFF65974589"><enum>(c)</enum><header>Administrator;
			 deputy Administrator</header>
				<paragraph id="ID382B240B3BEF43B2B3A79E2E994015C4"><enum>(1)</enum><header>Administrator</header>
					<subparagraph id="ID550F519716DF405CB01EC54DB8552D07"><enum>(A)</enum><header>Appointment</header>
						<clause id="idEA10E73D08404CF4B5153725A6F3E1DE"><enum>(i)</enum><header>In
			 general</header><text>The Administration shall be headed by an Administrator,
			 who shall be appointed by the President, by and with the advice and consent of
			 the Senate.</text>
						</clause><clause id="id465633FC03EF4D8FA3AD60E75564A2B1"><enum>(ii)</enum><header>Basis of
			 appointment</header><text>In appointing an individual to serve as
			 Administrator, the President—</text>
							<subclause id="id0EF06F1638B844FE902B39B6463D2BE3"><enum>(I)</enum><text>shall
			 consider—</text>
								<item id="id8F647AEF9BE2477584C0160923423C97"><enum>(aa)</enum><text>the
			 professional qualifications of the individual;</text>
								</item><item id="id92D05243B24A48C0A5307D04FFE12261"><enum>(bb)</enum><text>the
			 scientific or professional background of the individual; and</text>
								</item><item id="id3732DA9622ED400596CEC90EE871F0D6"><enum>(cc)</enum><text>the
			 length of experience of the individual in positions of management or energy
			 research and development; and</text>
								</item></subclause><subclause id="id427DAFF3559D41AC8467FB46E1AD5C30"><enum>(II)</enum><text>shall not
			 consider the political affiliation of the individual.</text>
							</subclause></clause></subparagraph><subparagraph id="IDD1574DADC1214C48AB4F5B1CD3054845"><enum>(B)</enum><header>Term of
			 office</header>
						<clause id="id97A7873C338C4D0A91D047C67A16C5F4"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the term of office of an
			 Administrator shall be 6 years.</text>
						</clause><clause id="idF1E5D537041745E898DFB3FDB6FAD392"><enum>(ii)</enum><header>Removal</header>
							<subclause id="id4AB9A47EC4DB40B2AE9C7D588299C056"><enum>(I)</enum><header>Removal by
			 President</header><text>The President may remove an Administrator from the
			 Administration based on just cause, as determined by the President.</text>
							</subclause><subclause id="idE4C48D5DDA724690944B19CFA759D48D"><enum>(II)</enum><header>Communication
			 of cause</header><text>In removing an Administrator from the Administration,
			 the President shall communicate to Congress each reason for removal.</text>
							</subclause></clause></subparagraph><subparagraph id="id1B140FAC15974F47B6ABDE6E5E7C5542"><enum>(C)</enum><header>Pay</header><text>Section
			 5313 of title 5, United States Code, is amended by adding at the end the
			 following:</text>

							<text display-inline="no-display-inline">Administrator, National Energy Efficiency
				Development
				Administration.</text>
							<after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id70170AB578514FADA5B356C8E4A672C4"><enum>(D)</enum><header>Authority of
			 Administrator</header>
						<clause id="id2667719ED8CC4CCC887689D52F3E9CAC"><enum>(i)</enum><header>In
			 general</header><text>The Administrator shall be the final authority for
			 carrying out all functions, powers, and duties of the Administration relating
			 to—</text>
							<subclause id="IDb375569ecb084f7f92a5f7318597c550"><enum>(I)</enum><text>the appointment
			 and employment of all officers and employees of the Administration (other than
			 Presidential and political appointees);</text>
							</subclause><subclause id="ID007cfc2012324b21b513afc7f92a6a5c"><enum>(II)</enum><text>the acquisition
			 and maintenance of property, services, and equipment of the
			 Administration;</text>
							</subclause><subclause id="id8A6CA4D45F054C65A85F2786A3DB353A"><enum>(III)</enum><text>the activities
			 of the Administration;</text>
							</subclause><subclause id="ID05f2c7968d1d40bf981f4f7adcf5dfe0"><enum>(IV)</enum><text>the promulgation
			 of regulations to carry out the functions of the Administration; and</text>
							</subclause><subclause id="id1A039AA166EC42E29DA99D2F6E59B6D6"><enum>(V)</enum><text>the publishing of
			 regulations, rules, orders, circulars, bulletins, and other official
			 publications of the Administration.</text>
							</subclause></clause><clause id="ID0F59E3D680824EA8B9262BE500B3F1EB"><enum>(ii)</enum><header>Limitation on
			 rulemaking authority</header><text>The Administrator shall not make any
			 modifications to energy-efficiency standards or related standards in effect on
			 the date of enactment of this Act that would result in a projected net
			 reduction of efficiency in the use of oil or other imported energy
			 sources.</text>
						</clause><clause id="idE729629152574DF59F155A3C66619268"><enum>(iii)</enum><header>Organization
			 of Administration</header>
							<subclause id="id403F6F7B1A174AD6968D75E06B68730E"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), the Administrator may
			 establish, alter, consolidate, or discontinue organizational units or
			 components within the Administration as the Administrator determines to be
			 necessary.</text>
							</subclause><subclause id="idE09C4C733BC94D98AF8A854E86C52B03"><enum>(II)</enum><header>Limitation of
			 authority</header><text>The Administrator shall not—</text>
								<item id="id04C78677989A429D98F6F2DBB7E5256E"><enum>(aa)</enum><text>abolish any
			 organizational unit or component established by this Act; or</text>
								</item><item id="id9571CF0BDB9D45F496D2C6CFF5FA55FA"><enum>(bb)</enum><text>transfer any
			 function vested by this Act in any organizational unit or component.</text>
								</item></subclause></clause></subparagraph><subparagraph id="ID45F1B941AAE34448AF6B3237F5F50010"><enum>(E)</enum><header>Duties of
			 Administrator</header>
						<clause id="ID783EBCE846B94482AF936B8DBDAF8451"><enum>(i)</enum><header>In
			 general</header><text>The Administrator shall—</text>
							<subclause id="ID91E031EBD645480BBC3E249B716F89AD"><enum>(I)</enum><text>plan, direct, and
			 conduct energy-efficient technology and renewable energy technology
			 activities;</text>
							</subclause><subclause id="ID0B6023D6330D47B3B4819691A3A24165"><enum>(II)</enum><text>provide for the
			 widest appropriate dissemination of information concerning the activities of
			 the Administration and the results of those activities;</text>
							</subclause><subclause id="ID2116436F83AC424183618F2365CE22E3"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id534177B971AE4112A9344E069BEFDB1D"><enum>(aa)</enum><text>improve existing
			 energy-efficient technologies and renewable energy technologies; or</text>
								</item><item id="id86DFDD32A29C4421BB0F76278D95F1DC" indent="up1"><enum>(bb)</enum><text>develop new energy-efficient
			 technologies and renewable energy technologies;</text>
								</item></subclause><subclause id="ID2511ADD784FB479391CD53CC95644F9D"><enum>(IV)</enum><text>identify and
			 implement mechanisms to introduce energy-efficient technologies and renewable
			 energy technologies into the marketplace; and</text>
							</subclause><subclause id="IDA60A60220F344FE8ADE800B7826BF210"><enum>(V)</enum><text>conduct studies
			 of—</text>
								<item id="ID9CCAFDA85690410586E5A10314B8BD9E"><enum>(aa)</enum><text>the
			 potential benefits gained, such as environmental protection, increasing energy
			 independence, and reducing costs to consumers; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="ID6D318A4A940E4E22B1F997956133F0C4"><enum>(bb)</enum><text>the costs of and
			 barriers to the development and use of energy-efficient technologies.</text>
								</item></subclause></clause><clause id="ID0728E497E015400B87753459ADBA0380"><enum>(ii)</enum><header>Objectives</header><text>The
			 energy-efficient technology and renewable energy technology activities of the
			 United States carried out by the Administrator or carried out with financial
			 assistance from the Administrator shall, as the Administrator determines to be
			 appropriate, be conducted so as to contribute significantly to 1 or more of the
			 following objectives:</text>
							<subclause id="ID2CFF0A73FD4F4920A1C56602AA7630FA"><enum>(I)</enum><text>Expansion of
			 knowledge about energy-efficient technologies and renewable energy technologies
			 and the use of those technologies.</text>
							</subclause><subclause id="id35261D17DDD14450AF2FA8D674D58E3F"><enum>(II)</enum><text>Facilitating the
			 market transformation of energy-efficient technologies and renewable energy
			 technologies.</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDBCBB33F36C154747B7D3F5E306AF65FA"><enum>(III)</enum><text>The most
			 effective use of the scientific resources of the United States, with close
			 cooperation among all interested agencies of the United States so as to avoid
			 duplication of effort, facilities, and equipment.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="ID1B68273DFFA24278BEA6CCFE5005AE2D"><enum>(2)</enum><header>Deputy
			 Administrator</header>
					<subparagraph id="ID012FA05311034081BC33CA6DA8AA8DAB"><enum>(A)</enum><header>Appointment</header><text>There
			 shall be in the Administration a Deputy Administrator, who shall be appointed
			 by the President, by and with the advice and consent of the Senate.</text>
					</subparagraph><subparagraph id="id59BE4B373D6D4557BDCE97F04F6FF320"><enum>(B)</enum><header>Basis of
			 appointment</header><text>In appointing a Deputy Administrator, the
			 President—</text>
						<clause id="id4EF3684EC4B9413BBF42F825A6B366AA"><enum>(i)</enum><text>shall
			 consider—</text>
							<subclause id="idE8B15E4A998E4843B2ABE54AEC866EC0"><enum>(I)</enum><text>the professional
			 qualifications of the individual;</text>
							</subclause><subclause id="idFE6E7DAC10C0403485758FFE861B93DC"><enum>(II)</enum><text>the scientific
			 or professional background of the individual; and</text>
							</subclause><subclause id="id06AE27139A5642448D346DBC5EF8A6D8"><enum>(III)</enum><text>the length of
			 experience of the individual in positions of management or research and
			 development; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA03455DAAA404A03B7E5E6D923E3E7F2"><enum>(ii)</enum><text>shall not
			 consider the political affiliation of the individual.</text>
						</clause></subparagraph><subparagraph id="id11B2C5AF800F4AC6A56A5D3EE958CA16"><enum>(C)</enum><header>Term of
			 office</header>
						<clause id="idD55234537FA14957BE8BF7ED5771617B"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the term of office of a Deputy
			 Administrator shall be 6 years.</text>
						</clause><clause id="id8694A525A54B4CC8A0E2707ED0DBE91D"><enum>(ii)</enum><header>Removal</header>
							<subclause id="id4E875033D8804712A963823B986893CC"><enum>(I)</enum><header>Removal by
			 President</header><text>The President may remove a Deputy Administrator from
			 the Administration based on just cause, as determined by the President.</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idB23877AA8A3C4306937DF832EA030A53"><enum>(II)</enum><header>Communication
			 of cause</header><text>In removing a Deputy Administrator from the
			 Administration, the President shall communicate to Congress each reason for
			 removal.</text>
							</subclause></clause></subparagraph><subparagraph id="ID1DE5B286299748C89CE20015F41EC394"><enum>(D)</enum><header>Pay</header><text>Section
			 5314 of title 5, United States Code, is amended by adding at the end the
			 following:</text>

							<text display-inline="no-display-inline">Deputy Administrator, National Energy
				Efficiency Development
				Administration.</text>
							<after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID693BFD3C3A0E4B388C9582FF62A02443"><enum>(E)</enum><header>Duties</header><text>The
			 Deputy Administrator shall—</text>
						<clause id="ID276C6B6C573642308B12FBC1471CD074"><enum>(i)</enum><text>supervise the
			 project development and engineering activities of the Administration;</text>
						</clause><clause id="IDA2032E7D7CE54579B3DA46BCFA531FBF"><enum>(ii)</enum><text>exercise such
			 other powers and perform such duties as the Administrator may prescribe;
			 and</text>
						</clause><clause id="ID07B3A0047B414155AAA63BF652D709E9"><enum>(iii)</enum><text>act for, and
			 exercise the powers of, the Administrator during the absence or disability of
			 the Administrator.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id4BD4E741F0E14748AB3E5B3CCA3063C1"><enum>(d)</enum><header>Personnel
			 plan</header><text display-inline="yes-display-inline">Not later than 180 days
			 after the date of enactment of this Act, the Administrator shall submit to
			 Congress a personnel plan for the Administration that—</text>
				<paragraph id="idF3227A6F7BEF46A69F0CDDA75D1748A5"><enum>(1)</enum><text>specifies the
			 initial number and qualifications of employees needed for the
			 Administration;</text>
				</paragraph><paragraph id="id79EC2A87C53C491EAB03A0949EC5B4B2"><enum>(2)</enum><text>describes the
			 functions and General Service classification and pay rates of the initial
			 employees; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99900D9E7EC84B6F906ABF101D905A98"><enum>(3)</enum><text>specifies how the
			 Administrator will adhere to or deviate from the civil service system.</text>
				</paragraph></subsection><subsection id="ID20AA8FCD146A486DB11F2FEBAA4BC62E"><enum>(e)</enum><header>Transfer of
			 functions</header>
				<paragraph id="ID9C30FA89E2E14A22B4E1001DF2BFD656"><enum>(1)</enum><header>Definition of
			 function</header><text>In this subsection, the term <term>function</term> means
			 any duty, obligation, power, authority, responsibility, right, privilege,
			 activity, or program.</text>
				</paragraph><paragraph id="ID0664C4627D1C41C197944E21D346E4DD"><enum>(2)</enum><header>Transfer of
			 functions</header>
					<subparagraph id="IDD9325806A2FE49048B19A636E72278C0"><enum>(A)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, there shall be transferred to the Administrator—</text>
						<clause id="ID350A1CF1D0CA4A3E00DE4F72F8DC4E1D"><enum>(i)</enum><text>all
			 functions exercised by the Assistant Secretary for Efficiency and Renewable
			 Energy as of the date of enactment of this Act; and</text>
						</clause><clause id="ID8FAE44543DEB4ACAB5F3D1EE6F4EDE6E"><enum>(ii)</enum><text>any authority to
			 promulgate regulations relating to fuel efficiency exercised by the Secretary
			 of Transportation as of the date of enactment of this Act.</text>
						</clause></subparagraph><subparagraph id="ID42DCD329AA5B4F92BAEC0010EABCBF17"><enum>(B)</enum><header>Inclusions</header><text>Functions
			 transferred under subparagraph (A) include all real and personal property,
			 personnel funds, and records of the Office of Energy Efficiency and Renewable
			 Energy of the Department of Energy.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7E12A88C34DA49668AA3F7550EE0A865"><enum>(C)</enum><header>Transition
			 plan</header><text>Not later than 180 days after the date of enactment of this
			 Act, the President shall submit to Congress a transition plan to transfer
			 functions of the Office of Energy Efficiency and Renewable Energy of the
			 Department of Energy in accordance with this Act.</text>
					</subparagraph></paragraph><paragraph id="IDDCB109A381204945851C53D901E1EBEC"><enum>(3)</enum><header>Presidential
			 transfers</header>
					<subparagraph id="ID5EAA4A51738E41138C33CF9300BA3F8F"><enum>(A)</enum><header>In
			 general</header><text>Not later than 4 years after the date of enactment of
			 this Act, the President (in consultation with Congress and the Administrator)
			 may transfer to the Administrator—</text>
						<clause id="ID2D445A180D744F6C83F9096E000047F3"><enum>(i)</enum><text>any
			 function of any other department or agency of the United States, or of any
			 officer or organizational entity of any department or agency, that relates
			 primarily to the duties of the Administrator under this Act; and</text>
						</clause><clause id="ID2DCFD099AB2F44EBBEC7E8D5E16BEF8B"><enum>(ii)</enum><text>any records,
			 property, personnel, and funds that are necessary to carry out that
			 function.</text>
						</clause></subparagraph><subparagraph id="ID953037BF943B426C9D31D2B813A78D31"><enum>(B)</enum><header>Reports</header><text>The
			 President shall submit to Congress a report that describes the nature and
			 effect of any transfer made under subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="ID05F0E71C569C44CA92148CDC84B0E114"><enum>(4)</enum><header>Abolishment of
			 office</header><text>On completion of the transfer of the functions described
			 in paragraph (2), the Office of Energy Efficiency and Renewable Energy of the
			 Department of Energy is abolished.</text>
				</paragraph></subsection></section><section id="IDD224B4E3F7114263938D967221C1F6D7"><enum>6.</enum><header>Administrative
			 powers</header><text display-inline="no-display-inline">The Administrator
			 shall—</text>
			<paragraph id="IDA44716C8FBB8448299637E00CCCB0500"><enum>(1)</enum><text>appoint and fix
			 the compensation of such officers and employees as are necessary to carry out
			 the functions of the Administration;</text>
			</paragraph><paragraph id="ID06D73304BA114FA9993600C090F1B400"><enum>(2)</enum><text>make appointments
			 of scientific, engineering, and professional personnel without regard to the
			 civil service laws;</text>
			</paragraph><paragraph id="idFC0652DD239E45CB8722BB21D041259E"><enum>(3)</enum><text>fix the
			 compensation of the personnel described in paragraph (2) at a rate to be
			 determined by the Administrator;</text>
			</paragraph><paragraph id="ID6AF9719FE5414D678F7CBAA79BF103DD"><enum>(4)</enum><text>acquire,
			 construct, improve, repair, operate, and maintain such laboratories, research
			 and testing sites and facilities, and such other real and personal property or
			 interests in real and personal property, as the Administrator determines to be
			 necessary for the performance of the functions of the Administration;</text>
			</paragraph><paragraph id="IDD738214D3AB24C5594A9880700E839F4"><enum>(5)</enum><text>enter into and
			 perform such contracts, leases, cooperative agreements, or other transactions
			 as are necessary in the performance of the duties of the Administrator with
			 any—</text>
				<subparagraph id="ID7A2DE7D4DEB64F45A51D8F2674A891C6"><enum>(A)</enum><text>agency or
			 instrumentality of the United States;</text>
				</subparagraph><subparagraph id="ID3466D02CEFB64459A9921DE7F28E8B00"><enum>(B)</enum><text>State, Territory,
			 or possession;</text>
				</subparagraph><subparagraph id="IDD4C084C6982D4933B2EF22FA7C893601"><enum>(C)</enum><text>political
			 subdivision of any State, Territory, or possession; or</text>
				</subparagraph><subparagraph id="ID3898F3BB3F024A1D96B818ECAB00A820"><enum>(D)</enum><text>person, firm,
			 association, corporation, or educational institution;</text>
				</subparagraph></paragraph><paragraph id="ID5B98923B2BA14922AA28727B4F298B4C"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID96AD97C8111B4849894E69AB234E9CCB"><enum>(A)</enum><text>with the consent of
			 Federal and other agencies, with or without reimbursement, use the services,
			 equipment, personnel, and facilities of those agencies; and</text>
				</subparagraph><subparagraph id="ID1DEB95A2C5CD4A048E8E007274A268F2" indent="up1"><enum>(B)</enum><text>cooperate with other public and
			 private agencies and instrumentalities in the use of services, equipment,
			 personnel, and facilities; and</text>
				</subparagraph></paragraph><paragraph id="ID38408F19F5004F7A9575BE006DA7F3B3"><enum>(7)</enum><text>establish within
			 the Administration such offices and procedures as the Administrator considers
			 appropriate to provide for the greatest possible coordination of the activities
			 of the Administration with related scientific and other activities of other
			 public and private agencies and organizations.</text>
			</paragraph></section><section id="ID226C3AA20F6C437CA66939D693458594"><enum>7.</enum><header>Organizational
			 structure</header>
			<subsection id="ID6D93FC2DC2A54D7680E93915E5B562CA"><enum>(a)</enum><header>Policy Advisory
			 Committee</header>
				<paragraph id="ID0017338CE91C47689F05CDD930D5A323"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Administration a Policy Advisory Committee.</text>
				</paragraph><paragraph id="ID0DA439B6DA884F2290A4AB0049044786"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="ID7E69011C1F2F4F5CBEFD2BF0DDFA9084"><enum>(A)</enum><header>Composition</header><text>The
			 Advisory Committee shall be composed of 12 members, of whom—</text>
						<clause id="IDF2E8FE83E2594E76AD31E52150ACEB49"><enum>(i)</enum><text>4
			 members shall be representatives of nongovernmental energy efficiency,
			 renewable energy, and environmental protection organizations;</text>
						</clause><clause id="IDED6FBF05C8E1435B95B748B1A338C853"><enum>(ii)</enum><text>4
			 members shall be representatives of—</text>
							<subclause id="IDCF07DD6717E44E12959703E39EEDAD06"><enum>(I)</enum><text>industries
			 involved in the generation, transmission, or distribution of energy products,
			 including manufacturers of equipment to generate efficient or renewable energy;
			 or</text>
							</subclause><subclause id="IDE53795AADA054286A621BF34EB34984C"><enum>(II)</enum><text>the
			 transportation industry; and</text>
							</subclause></clause><clause id="IDE79BC2B4C9B24ACA907E66765D6E22F0"><enum>(iii)</enum><text>4
			 members shall be representatives of the scientific and university research
			 community.</text>
						</clause></subparagraph><subparagraph id="ID0FD82D2F343D4B2B99DA82E790388396"><enum>(B)</enum><header>Appointment</header><text>The
			 Speaker of the House of Representatives, the minority leader of the House of
			 Representatives, the majority leader of the Senate, and the minority leader of
			 the Senate shall each appoint 1 member described in clauses (i), (ii), and
			 (iii) of subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="ID008C700FFD9943D48824143BEC4D59CB"><enum>(3)</enum><header>Duties</header><text>The
			 Advisory Committee shall—</text>
					<subparagraph id="ID0EFF520F45C14CADA33C51E19FFE1420"><enum>(A)</enum><text>act as a steering
			 committee for the Administration;</text>
					</subparagraph><subparagraph id="IDEE0588A301DC4218B464F3EDD300F5AD"><enum>(B)</enum><text>advise the
			 Administrator on the formulation of a long-term strategy for achieving the
			 mission of the Administration under section 5(b); and</text>
					</subparagraph><subparagraph id="IDA0335DADB312424BAEA4CC2045D2898C"><enum>(C)</enum><text>assist the
			 Administrator in identifying energy-efficient technologies and initiatives
			 that—</text>
						<clause id="IDF0EF824FCE53430EB003A36DC772F474"><enum>(i)</enum><text>have the
			 potential to increase energy efficiency over the long term; and</text>
						</clause><clause id="ID9981A4C366AB49ADB608E787CBD78390"><enum>(ii)</enum><text>should be
			 further explored by the Administration.</text>
						</clause></subparagraph></paragraph><paragraph id="ID2302FE923AC045F9B0624262131302F6"><enum>(4)</enum><header>Staff</header><text>The
			 Advisory Committee may appoint not more than 24 employees to assist in carrying
			 out the duties of the Advisory Committee, of whom—</text>
					<subparagraph id="ID5F99DC39EA9E4EDB95D9DF8626603521"><enum>(A)</enum><text>8 shall report to
			 the members appointed under paragraph (2)(A)(i);</text>
					</subparagraph><subparagraph id="ID8C9AD527C7644587BF074010CE00BD62"><enum>(B)</enum><text>8 shall report to
			 the members appointed under paragraph (2)(A)(ii); and</text>
					</subparagraph><subparagraph id="ID5C6F66C1E2FA4F4B84CDF713DB9758F5"><enum>(C)</enum><text>8 shall report to
			 the members appointed under paragraph (2)(A)(iii).</text>
					</subparagraph></paragraph><paragraph id="ID490FE4DA70A64287AD1343E9C4E762D9"><enum>(5)</enum><header>FACA</header><text>The
			 <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5
			 U.S.C. App.) shall apply to the Advisory Committee.</text>
				</paragraph></subsection><subsection id="IDE2D867757A8C4FFC8755E3AB1BD758AA"><enum>(b)</enum><header>Office of
			 Administration</header>
				<paragraph id="ID35F3758CF2784D5FA4D3AA003F039267"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Administration an Office of Administration.</text>
				</paragraph><paragraph id="IDAEA137C7716744E184B114F9BE2E73C1"><enum>(2)</enum><header>Assistant
			 Deputy Administrator</header><text>The head of the Office of Administration
			 shall be an Assistant Deputy Administrator for Administration, to be appointed
			 by the Administrator.</text>
				</paragraph><paragraph id="ID6F5AE38B2F074A6883FE1227CD252BE1"><enum>(3)</enum><header>Energy
			 Efficiency Economics Division</header>
					<subparagraph id="IDA0C3ADDBF65C40608B7B7D98206226D5"><enum>(A)</enum><header>Establishment</header><text>There
			 is established in the Office of Administration an Energy Efficiency Economics
			 Division.</text>
					</subparagraph><subparagraph id="ID1CA2E188F88A4342B86FB352CB006233"><enum>(B)</enum><header>Staff</header><text>The
			 Energy Efficiency Economics Division shall be composed of economists and
			 individuals with expertise in energy markets, consumer behavior, and the
			 economic impacts of energy policy.</text>
					</subparagraph><subparagraph id="ID0A15733B9DF04B4F863C3621B7C96536"><enum>(C)</enum><header>Duties</header><text>The
			 Energy Efficiency Economics Division shall—</text>
						<clause id="idD03B99E144F44A788D41FC9636EE04FB"><enum>(i)</enum><text>study the effects
			 of existing and proposed energy-efficient technologies on the economy of the
			 United States, with an emphasis on assessing—</text>
							<subclause id="ID556C284F96544121BA2C7B2B3216184D"><enum>(I)</enum><text>the impacts of
			 those technologies on consumers; and</text>
							</subclause><subclause id="ID9CC2B53387034DAE91A800AF0457CD00"><enum>(II)</enum><text>the
			 contributions of those technologies on the economic development of the United
			 States;</text>
							</subclause></clause><clause id="id11B687493B5F404F8B68429462680F67"><enum>(ii)</enum><text>conduct a study
			 of economic incentives that would assist the Administration in—</text>
							<subclause id="idBEFFEBE8D6774CDA86C4309C22CE72E2"><enum>(I)</enum><text>developing
			 energy-efficient technologies; and</text>
							</subclause><subclause id="idC930F851C6024DBD93B88C97CCCFE42C"><enum>(II)</enum><text>introducing
			 those technologies into the marketplace; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id508573D02101448FA44EEF6CA094086D"><enum>(iii)</enum><text>submit to
			 Congress a report on the results of the study conducted under clause
			 (ii).</text>
						</clause></subparagraph></paragraph><paragraph id="ID5DEC14A983E14FE5852E41D3316B37A9"><enum>(4)</enum><header>Education
			 Division</header>
					<subparagraph id="ID841AC927DD08478F9CE7A2E05BBFFDC1"><enum>(A)</enum><header>Establishment</header><text>There
			 is established in the Office of Administration an Education Division.</text>
					</subparagraph><subparagraph id="ID6931BF9673C84CB7AD584E70EBBBD58D"><enum>(B)</enum><header>Duties</header><text>The
			 Education Division shall—</text>
						<clause id="ID75BA6DA437EC4B57922DF3453C70A738"><enum>(i)</enum><text>provide to the
			 public, information concerning—</text>
							<subclause id="IDB7CE17C9C4C34B6290A400A903F84087"><enum>(I)</enum><text>how to conserve
			 energy; and</text>
							</subclause><subclause id="IDC3A96B7557FE4F4389CA5982CFF55328"><enum>(II)</enum><text>the importance
			 of conserving energy; and</text>
							</subclause></clause><clause id="IDFE74A4D981AD470DAE55EC0016C7B2AE"><enum>(ii)</enum><text>provide to
			 building owners, engineers, contractors, and other businesspeople training in
			 energy-efficient technologies.</text>
						</clause></subparagraph></paragraph><paragraph id="IDF11FC2E9B6104E1A90CD75D974C9F421"><enum>(5)</enum><header>General
			 Counsel</header><text>There is established in the Office of Administration the
			 position of General Counsel, to be appointed by the Administrator, to serve as
			 the chief legal officer of the Administration.</text>
				</paragraph></subsection><subsection id="IDC7B98AF3AC57488AA9EACFA23D36591D"><enum>(c)</enum><header>Office of
			 Policy, Research, and Development</header>
				<paragraph id="IDC0BD3AFAB3FD461D8594661FBF00529B"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Administration an Office of Policy, Research, and
			 Development.</text>
				</paragraph><paragraph id="idC553921365474677BA2E743E0A7FB222"><enum>(2)</enum><header>Duties</header><text>The
			 Office of Policy, Research, and Development shall—</text>
					<subparagraph id="id2BFBDD9EFFA849A988D9E130E3D7BE0B"><enum>(A)</enum><text>sponsor, manage,
			 and direct basic and applied research projects, including projects to
			 accelerate the development of energy-efficient technologies from fundamental
			 research to implementation; and</text>
					</subparagraph><subparagraph id="id1641CD37F32D4CC2ADCCF9F8E1E7F5E6"><enum>(B)</enum><text>provide technical
			 guidance to the Administrator.</text>
					</subparagraph></paragraph><paragraph id="IDFD0E411265404BF6B9F88E116829683C"><enum>(3)</enum><header>Assistant
			 Deputy Administrator</header><text>The head of the Office of Policy, Research,
			 and Development shall be an Assistant Deputy Administrator for Policy,
			 Research, and Development, to be appointed by the Administrator.</text>
				</paragraph><paragraph id="ID646041F0E4E2456500F411F13CA77C31"><enum>(4)</enum><header>Administration</header><text>In
			 carrying out this subsection, the Office of Policy, Research, and Development
			 shall consider the potential benefits of—</text>
					<subparagraph id="IDD5FE35009BCE48CDA8EE24B9003ECF2D"><enum>(A)</enum><text>a flat
			 organizational structure comprised of project-based teams;</text>
					</subparagraph><subparagraph id="ID2908B38A85CB447BBF165C1161E4FB8D"><enum>(B)</enum><text>coordination with
			 the private sector; and</text>
					</subparagraph><subparagraph id="IDEB662F4EA47F44258887F842C3C68F62"><enum>(C)</enum><text>organizational
			 models used by other Federal agencies conducting advanced research.</text>
					</subparagraph></paragraph></subsection><subsection id="ID03FCFBE9A46B4887B653B73512AC66E0"><enum>(d)</enum><header>Office of
			 market transformation</header>
				<paragraph id="IDACA81788C8874FA5A9AF599D5C602C8B"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Administration an Office of Market Transformation.</text>
				</paragraph><paragraph id="IDD0A5FA4D828A446D81A10600322F8731"><enum>(2)</enum><header>Assistant
			 Deputy Administrator</header><text>The head of the Office of Market
			 Transformation shall be an Assistant Deputy Administrator for Market
			 Transformation, to be appointed by the Administrator.</text>
				</paragraph><paragraph id="ID5BE26B241DE44A9D82DCB3B859D974F6"><enum>(3)</enum><header>Duties</header><text>The
			 Office of Market Transformation shall facilitate the implementation of new
			 energy-efficient technologies and renewable energy technologies in all sectors
			 of the economy by—</text>
					<subparagraph id="idF82679E8A33A487A8C0D27D12CEF0C87"><enum>(A)</enum><text>conducting
			 research—</text>
						<clause id="id0B27E20F22CA4BCABDA110C3F6B82695"><enum>(i)</enum><text>to
			 determine each barrier to market transformation; and</text>
						</clause><clause id="idB14F0FE2FCB04DEE9C150435BB048674"><enum>(ii)</enum><text>to
			 develop the means by which to remove each barrier;</text>
						</clause></subparagraph><subparagraph id="id71BC0FA36C5F436E8C158786EB3C2046"><enum>(B)</enum><text>conducting
			 education and marketing campaigns to encourage commercial and retail purchases
			 of new energy-efficient technologies and renewable energy technologies;</text>
					</subparagraph><subparagraph id="idE0B5A0A190EA4FAEBF18B5910EAD3015"><enum>(C)</enum><text>providing to
			 States, tribal governments, and units of local government information on codes
			 and regulations that interfere with or encourage the use of energy-efficient
			 technologies and renewable energy technologies;</text>
					</subparagraph><subparagraph id="id12CF06828A1B42138DB4390A4CCCCB16"><enum>(D)</enum><text>conducting
			 government buy-down programs for energy-efficient technologies and renewable
			 energy technologies;</text>
					</subparagraph><subparagraph id="id0534084978A3422AAE2EE8E80B235180"><enum>(E)</enum><text>providing grants
			 to low-income communities and nonprofit institutions to purchase appropriate
			 energy-efficient technologies and renewable energy technologies;</text>
					</subparagraph><subparagraph id="id0F89C495B2DA4A27974F6B97194D8B2B"><enum>(F)</enum><text>providing loan
			 guarantees to qualified companies that are developing energy-efficient
			 technologies and renewable energy technologies; and</text>
					</subparagraph><subparagraph id="idD5A79317C442452BAEED25B61151FA3F"><enum>(G)</enum><text>carrying out any
			 other activity or program that the Administrator determines will promote the
			 spread of energy-efficient technologies and renewable energy
			 technologies.</text>
					</subparagraph></paragraph><paragraph id="IDaa749ef861b94694b9382e812472ae16"><enum>(4)</enum><header>Coordination</header><text>The
			 Assistant Deputy Administrator for Market Transformation shall ensure, to the
			 maximum extent practicable, that the activities of the Office of Market
			 Transformation are coordinated with—</text>
					<subparagraph id="idD2A9FDF66B8B4A9B837D30118FB932AB"><enum>(A)</enum><text>the Federal
			 Government and State, tribal, and local governments and agencies; and</text>
					</subparagraph><subparagraph id="idB809D5B2993B467EB0FB48AB4E81B958"><enum>(B)</enum><text>appropriate
			 nongovernmental organizations (including organizations dedicated to market
			 transformation).</text>
					</subparagraph></paragraph></subsection></section><section id="IDF9407A0A85FD4CA392521129A0C3191E"><enum>8.</enum><header>Initial
			 technology solicitations</header>
			<subsection id="IDC9525C37EDDD41B89804B06FB4A3B723"><enum>(a)</enum><header>In
			 general</header><text>The Administrator (acting through the Office of Market
			 Transformation and the Office of Policy, Research, and Development) may, based
			 on the criteria described in subsection (b), initiate the development of
			 technologies for—</text>
				<paragraph id="IDFDBB9264262D4FE19144DFF365AF459D"><enum>(1)</enum><text>fuel
			 cells;</text>
				</paragraph><paragraph id="id41861C65B1854920B981C7221D79657B"><enum>(2)</enum><text>fuel-efficient
			 tires;</text>
				</paragraph><paragraph id="ID8FF34168A2D946BC87ABB77FB9E19136"><enum>(3)</enum><text>construction of a
			 hydrogen infrastructure;</text>
				</paragraph><paragraph id="IDC0C0D1244F584F64894DBE28FBC468BC"><enum>(4)</enum><text>high-temperature
			 superconducting cable;</text>
				</paragraph><paragraph id="ID644ABE5E659B403C9E00DCDFB25893E3"><enum>(5)</enum><text>improved
			 switches, resistors, capacitors, software and smart meters for electrical
			 transmission systems;</text>
				</paragraph><paragraph id="ID91ADB5C754994664B66387228345F200"><enum>(6)</enum><text>combined heat and
			 power;</text>
				</paragraph><paragraph id="IDC7EA932FDAA640419EF04755A9CD009C"><enum>(7)</enum><text>microturbines;</text>
				</paragraph><paragraph id="ID8739E7DCC2FC43BF97277E8D46907CDC"><enum>(8)</enum><text>energy-efficient
			 lighting;</text>
				</paragraph><paragraph id="ID016B253DCC9D4784A89D89C83E79F1D0"><enum>(9)</enum><text>energy efficiency
			 training for building contractors;</text>
				</paragraph><paragraph id="ID461177b726dd4da18a7fc4e7367002c9"><enum>(10)</enum><text>biogas recovery
			 systems;</text>
				</paragraph><paragraph id="IDd92a4142d4004e198e668953ac42c59e"><enum>(11)</enum><text>integrated
			 gasification combined cycle coal production;</text>
				</paragraph><paragraph id="ID4C5E7AE1D52F4A9694CE0478AE590401"><enum>(12)</enum><text>retrofitting or
			 rehabilitation of existing structures to incorporate energy-efficient
			 technologies;</text>
				</paragraph><paragraph id="ID86CC3AD405634D25B1D61BD9771D3100"><enum>(13)</enum><text>efficient
			 microchannel heat exchangers; and</text>
				</paragraph><paragraph id="id8AAE9114F65348F3B1C0DAD455767E42"><enum>(14)</enum><text>any other
			 appropriate technologies that need to be developed, as determined by the
			 Administrator.</text>
				</paragraph></subsection><subsection id="ID094298A903814C12B6D0E2FC93E255E0"><enum>(b)</enum><header>Criteria</header><text>In
			 determining which technologies to develop under subsection (a), the
			 Administrator shall consider—</text>
				<paragraph id="IDC1FE6DE413344B93A2CCDC5CFF75DF80"><enum>(1)</enum><text>the current
			 status of development of the technology;</text>
				</paragraph><paragraph id="ID78D1BE4A6AE441079BB01C1C275F64F8"><enum>(2)</enum><text>the potential for
			 widespread use of the technology in commercial markets;</text>
				</paragraph><paragraph id="ID3D2289984ABE48F98F4E7C53F9109041"><enum>(3)</enum><text>the time and
			 costs of efforts needed to bring the technology to full implementation;
			 and</text>
				</paragraph><paragraph id="ID409E2CAE943F4DCC8F750399C3591E02"><enum>(4)</enum><text>the potential of
			 the technology to contribute to the goals of the Administration.</text>
				</paragraph></subsection><subsection id="ID9B141C3088C4451FA0009BAB19FC8CD2"><enum>(c)</enum><header>Report</header><text>As
			 soon as practicable after the date of enactment of this Act, but not later than
			 1 year after the date of enactment of this Act, the Administrator shall submit
			 to Congress a report that—</text>
				<paragraph id="ID4907AA36B4E94BCE81D8FB3E7CC80038"><enum>(1)</enum><text>assesses the
			 potential for the technologies described in subsection (a) to contribute to the
			 goals of the Administration; and</text>
				</paragraph><paragraph id="ID86897FE817924834A8CFB9E8D39B00E0"><enum>(2)</enum><text>describes the
			 plans of the Administration to develop the technologies under subsection
			 (a).</text>
				</paragraph></subsection></section><section id="IDDE94B0698B074004B8A9D69932004000"><enum>9.</enum><header>Reports</header>
			<subsection id="ID10617B00CAFA4AC7A6CEB5C270F7B979"><enum>(a)</enum><header>Reports by
			 Administrator</header>
				<paragraph id="idF1FD1186D1B34A92A4B4518CEC1D23A5"><enum>(1)</enum><header>Activities and
			 accomplishments</header><text>Semiannually and at such other times as the
			 Administrator considers to be appropriate, the Administrator shall submit to
			 the President a report that describes the activities and accomplishments of the
			 Administration.</text>
				</paragraph><paragraph id="idA4C1EB2E4E264D32A47F32EA3F6EF585"><enum>(2)</enum><header>Report to
			 Congress</header><text>At the time at which the Administrator submits to the
			 President or the Director of the Office of Management and Budget any report
			 relating to any budget information, legislative recommendation, comment on
			 legislation about amounts made available under this Act, or prepared testimony
			 for a congressional hearing, the Administrator shall submit a copy of the
			 information, recommendation, comment, or testimony to each appropriate
			 committee of Congress.</text>
				</paragraph></subsection><subsection id="id47D759E0CBAE4E93B3ECF50DD14E473D"><enum>(b)</enum><header>Reports by
			 President</header><text>In January of each year, the President shall submit to
			 Congress a report that includes—</text>
				<paragraph id="IDD6E63AD269D848CC9CE7D1231EB9CB00"><enum>(1)</enum><text>a description of
			 the activities and accomplishments of all agencies of the United States in the
			 field of energy-efficient technology and renewable energy technology
			 development during the preceding calendar year;</text>
				</paragraph><paragraph id="IDADB5AF194BFA4574ADB0655597E4B711"><enum>(2)</enum><text>an evaluation of
			 the activities and accomplishments of the Administrator in attaining the
			 objectives of this Act; and</text>
				</paragraph><paragraph id="IDBAFFFE87D3B54D039F1E24B27B3870EF"><enum>(3)</enum><text>such
			 recommendations for additional legislation as the Administrator or the
			 President considers appropriate for the attainment of the objectives described
			 in this Act.</text>
