		<section id="ID70D82CDA79924AA28FEE464318EDFF4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Independent Office of Advocacy and
			 Small Business Regulatory Reform Act of 2008</short-title></quote>.</text>
		</section><section id="IDFA6572AA933249689E5884E215C6B812"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="ID2B2E66476B874BC9836DDBC1D3FBBD7B"><enum>(1)</enum><text>to ensure that
			 the Office of Advocacy of the Small Business Administration (referred to in
			 this section as the <quote>Office</quote>) has adequate financial resources to
			 advocate for and on behalf of small business concerns;</text>
			</paragraph><paragraph id="ID554F6E56246A43FF8547F93200E2DDA8"><enum>(2)</enum><text>to provide a
			 separate authorization of appropriations for the Office; and</text>
			</paragraph><paragraph id="ID482A926D8A7946A087AD64C4B03FB209"><enum>(3)</enum><text>to enhance the
			 role of the Office pursuant to chapter 6 of title 5, United States Code.</text>
			</paragraph></section><section id="ID17A20A37353E48678634B1666D025DDA"><enum>3.</enum><header>Office of
			 Advocacy</header>
			<subsection id="IDCF2547B531D744489040AE2F3DCFF744"><enum>(a)</enum><header>In
			 general</header><text>Section 203 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law
			 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634a">15 U.S.C. 634c</external-xref>) is amended—</text>
				<paragraph id="id250C961BC2D5425BA9E2540889ECC5E6"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id933C881F575346B2BC34B18AB8A3FA08"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id0A6444B977DB4FADA7DA71B18D3C51A4"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

						<paragraph id="ID96DF289600B64B6A8DF6C8A5E92092D5"><enum>(6)</enum><text>carry out the
				responsibilities of the Office of Advocacy under chapter 6 of title 5, United
				States
				Code.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id9671C652AFB54A65B799A914306596CB"><enum>(b)</enum><header>Budgetary line
			 item and authorization of appropriations</header><text>Title II of
			 <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law
			 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634a">15 U.S.C. 634a</external-xref> et seq.) is amended
			 by striking section 207 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8A84CF8B7051401C9C568E584BD4B455" style="OLC">
					<section id="id0634E8D1133E4515B6EB192D90F6A6D0"><enum>207.</enum><header>Budgetary line
				item and authorization of appropriations</header>
						<subsection id="ID7DC70BAEECB7433F8E706F2FF54CA618"><enum>(a)</enum><header>Appropriation
				requests</header><text>Each budget of the United States Government submitted by
				the President under section 1105 of title 31, United States Code, shall include
				a separate statement of the amount of appropriations requested for the Office
				of Advocacy of the Small Business Administration, which shall be designated in
				a separate account in the General Fund of the Treasury.</text>
						</subsection><subsection id="idF0E7F36FD8BD45A88092CBD898EF1202"><enum>(b)</enum><header>Administrative
				operations</header><text>The Administrator of the Small Business Administration
				shall provide the Office of Advocacy with appropriate and adequate office space
				at central and field office locations, together with such equipment, operating
				budget, and communications facilities and services as may be necessary, and
				shall provide necessary maintenance services for such offices and the equipment
				and facilities located in such offices.</text>
						</subsection><subsection id="id389FD38F666441EF9416BC9B8BDBC220"><enum>(c)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated such
				sums as are necessary to carry out this title. Any amount appropriated under
				this subsection shall remain available, without fiscal year limitation, until
				expended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID870E85E9701F483DB60599A44CA3EC6C"><enum>4.</enum><header>Regulatory
			 flexibility reform for small businesses</header>
			<subsection commented="no" display-inline="no-display-inline" id="id887B9D60AE3142DAA155A3F4047D0B5A"><enum>(a)</enum><header>Requirements
			 providing for more detailed analyses</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7829FD4A955548A88D37F526ABC5FFAA"><enum>(1)</enum><header>Initial
			 regulatory flexibility analysis</header><text display-inline="yes-display-inline">Section 603 of title 5, United States Code,
			 is amended by adding at the end the following:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="idE3B0479B4FB641A59F3F0B060B4B8243" style="USC">
						<subsection commented="no" display-inline="no-display-inline" id="ID662fb572af074d9c904efc451880f1d8"><enum>(d)</enum><text display-inline="yes-display-inline">An agency shall notify the Chief Counsel
				for Advocacy of the Small Business Administration of any draft rules that may
				have a significant economic impact on a substantial number of small entities
				either—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDad5b2bd3ce7549bdb324acc5c779c911"><enum>(1)</enum><text display-inline="yes-display-inline">when the agency submits a draft rule to the
				Office of Information and Regulatory Affairs at the Office of Management and
				Budget under Executive Order 12866, if that order requires such submission;
				or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14691312087545a7ba2a923aec750173"><enum>(2)</enum><text display-inline="yes-display-inline">if no submission to the Office of
				Information and Regulatory Affairs is so required, at a reasonable time prior
				to publication of the rule by the
				agency.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD80EFA5ED9454694B6C165CA00C41283"><enum>(2)</enum><header>Final
			 regulatory flexibility analysis</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID6A1B4403AB4247B9B3CDF6DA33AB4090"><enum>(A)</enum><header>Inclusion of
			 response to comments on certification of proposed rule</header><text display-inline="yes-display-inline">Section 604(a)(2) of title 5, United States
			 Code, is amended by inserting <quote>(or certification of the proposed rule
			 under section 605(b))</quote> after <quote>initial regulatory flexibility
			 analysis</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB76DD3EE6E2645E0A05B8C5758722205"><enum>(B)</enum><header>Inclusion of
			 response to comments filed by Chief Counsel for Advocacy</header><text display-inline="yes-display-inline">Section 604(a) of title 5, United States
			 Code, is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="idFC6FA45E91144EC7ADFEC8BF591B28E9"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3), (4), and
			 (5) as paragraphs (4), (5), and (6), respectively; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id87AC4ADA202B401CA1046CAFC4A4616F"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the

			 regulatory flexibility analysis</header><text display-inline="yes-display-inline">Section 603 of title 5, United States Code,
			 as amended by this Act, is amended by adding at the end the following:</text>

			 regulatory flexibility analysis</header><text display-inline="yes-display-inline">Section 604(b) of title 5, United States
			 Code, is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="IDB5E8A877743F4B4F8AC4CF9FA6151D5B" style="OLC">
								<subsection commented="no" display-inline="no-display-inline" id="ID0A73D5DFDB244A0BB64F226671C5676A"><enum>(b)</enum><text display-inline="yes-display-inline">The agency shall make copies of the final
				regulatory flexibility analysis available to the public, including placement of
				the entire analysis on the website, and shall publish in the Federal Register
				the final regulatory flexibility analysis, or a summary thereof that includes
				the telephone number, mailing address, and link to the website where the
				complete analysis may be
				obtained.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB3A7E99920845C4B713F8F5E327D593"><enum>(3)</enum><header>Cross-References
			 to other analyses</header><text display-inline="yes-display-inline">Section
			 605(a) of title 5, United States Code, is amended to read as follows:</text>

				satisfying any requirement regarding the content of an agenda or regulatory
				flexibility analysis under section 602, 603, or 604, if such agency provides in

			 title 5, United States Code, is amended by inserting <quote>detailed</quote>
			 before <quote>statement</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCDCBFD83F37C4E13A50A5B09E2ED50F7"><enum>(5)</enum><header>Quantification
			 requirements</header><text display-inline="yes-display-inline">Section 607 of
			 title 5, United States Code, is amended to read as follows:</text>

				responsiveness to small business concerns; and</text>

				described in subparagraph (A), for each Federal agency and regional or program
				office of each Federal agency, as determined appropriate by the
				Ombudsman.</text>

				</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="id3B20580D373B4506B5D3E622C05D0F60"><enum>(2)</enum><text>in subsection
			 (d)(1), by inserting <quote>, in coordination with the Ombudsman,</quote> after
			 <quote>hold such hearings</quote>; and</text>
			</paragraph><paragraph id="idEE13989DFEAC498098618E7A9655777D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
