		<official-title>To amend the Higher Education Act of 1965 to maintain
		  eligibility, for Federal PLUS loans, of borrowers who are 90 or more days
		  delinquent on mortgage loan payments, or for whom foreclosure proceedings have
		  been initiated, with respect to their primary residence.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>PLUS Loan Borrower Protection Act
			 of 2008</short-title></quote>.</text>
		</section><section id="idA213D47D98934671A700AB6735E3E76F"><enum>2.</enum><header>Special rules
			 for Federal PLUS loans</header><text display-inline="no-display-inline">Section
			 428B(a)(3) of the Higher Education Act of 1965 (20 U.S.C. 1078–2(a)(3)) is
			 amended—</text>
			<paragraph id="id1526B92C42C1468483F1984CBD8A1CC4"><enum>(1)</enum><text>by striking
			 <quote>Whenever</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5878D2A0FB6E421DB753CDB48166F56F" style="OLC">
					<subparagraph id="id1E80A7B3E9574747B754BEE47F5E2086"><enum>(A)</enum><header>Parent
				borrowers</header><text>Whenever</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id97F4964135054CABBC7A0FA43A22F18B"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE63B71CFD05D405DA6D2DDD8962D26B9" style="OLC">
					<subparagraph id="idDE795A44ED0C4265B223D42E5761F361"><enum>(B)</enum><header>Extenuating
				circumstances</header>
						<clause id="idF64EBAE6DED347E08DDDD0DE297A001B"><enum>(i)</enum><header>In
				general</header><text>For purposes of determining if a borrower has an adverse
				credit history under paragraph (1)(A) on the basis of a delinquency or
				foreclosure related to a mortgage loan, an extenuating circumstance exists if,
				during the period beginning January 1, 2007 and ending December 31, 2012, the
				borrower is 90 or more days delinquent on mortgage loan payments, or
				foreclosure proceedings have been initiated, with respect to the primary
				residence of the borrower.</text>

				term <term>mortgage loan</term> means an extension of credit that is secured by
				the primary residence of the
				borrower.</text>
