		<official-title>To amend title 38, United States Code, to improve
		  veterans' health care benefits, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title; references to title 38, United States Code</header>
			<subsection id="idE4F2E4343D1C45B186534BA1B984DF9F"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Veterans Health Care Act of
			 2008</short-title></quote>.</text>
			</subsection><subsection id="id646D705AD1274FE193F48DA9629ECAFD"><enum>(b)</enum><header>References</header><text>Except
			 as otherwise expressly provided, whenever in this Act an amendment or repeal is
			 expressed in terms of an amendment or repeal to a section or other provision,
			 the reference shall be considered to be made to a section or other provision of
			 title 38, United States Code.</text>
			</subsection></section><section id="id069E5D6AB71C440B8C0F85124590DF2C"><enum>2.</enum><header>Specialized
			 residential care and rehabilitation for certain veterans</header><text display-inline="no-display-inline">Section 1720 is amended by adding at the end
			 the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id210E33BA896542CF84F6FA5F0EAB5BE0" style="OLC">
				<subsection id="id1F3DFC2CA5194982AEFC6CDC693E7B46"><enum>(g)</enum><text>The Secretary may
				contract with appropriate entities to provide specialized residential care and
				rehabilitation services to a veteran of Operation Enduring Freedom or Operation
				Iraqi Freedom who the Secretary determines suffers from a traumatic brain
				injury, has an accumulation of deficits in activities of daily living and
				instrumental activities of daily living, and who, because of these deficits,
				would otherwise require admission to a nursing home even though such care would
				generally exceed the veteran's nursing
				needs.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idFC8AF97EE3774E019B08463AC0DB7C09"><enum>3.</enum><header>Reimbursement
			 for certain continuing education</header><text display-inline="no-display-inline">Section 7411 is amended to read:</text>
			<quoted-block display-inline="no-display-inline" id="id8BF6B23583CF4EF4B435E21A3FE21ADA" style="OLC">
				<subsection id="id9CC93D91E50B4444866E0AB817438410"><enum></enum><text>The Secretary
				shall provide full-time board-certified physicians and dentists appointed under
				section 7401(1) of this title the opportunity to continue their professional
				education through VA sponsored continuing education programs. The Secretary may
				reimburse the physician or dentist up to $1,000 per year for continuing
				professional education not available through VA
				sources.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idC9D69EBB48BD48ACBDA7F96637790573"><enum>4.</enum><header>Copayment
			 exemption for hospice care</header>
			<subsection id="id9CE305B235CF458BBD92F6BE5B791AFF"><enum>(a)</enum><text>Section
			 1710(f)(1) is amended by adding <quote>(except if such care constitutes hospice
			 care)</quote> after <quote>nursing home care</quote>;</text>
			</subsection><subsection id="idB8F754229AF44E2B84A47D0CE2EE739F"><enum>(b)</enum><text>Section
			 1710(g)(1) is amended by adding <quote>(except if such care constitutes hospice
			 care)</quote> after <quote>medical services</quote>.</text>
			</subsection></section><section id="id2C99D5FF74B64D41BDE4EFDF36693C11"><enum>5.</enum><header>Update of
			 voluntary HIV testing policy</header><text display-inline="no-display-inline">Section 124 of the Veterans' Benefits and
			 Services Act of 1988 (title I of Public Law 100–322, as amended; 38 U.S.C. 7333
			 note) is repealed.</text>
		</section><section id="id82F9B82142794D1280E8573B4BF6B91E"><enum>6.</enum><header>Disclosure of
			 medical records</header>
			<subsection id="idF49431EBE3FE4BEE8AC2BE51D1A7DDA3"><enum>(a)</enum><header>Limited
			 exception to confidentiality of medical records</header><text>Section 5701 is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idD103FD7178E3490CB2A2A34CE906C2D3" style="OLC">
					<subsection id="id753F1DD2A4E14D36B4A7FD6DECCCEBAB"><enum>(l)</enum><text>Under regulations
				that the Secretary shall prescribe, the Secretary may disclose the name or
				address, or both, of any individual who is a present or former member of the
				Armed Forces, or who is a dependent of a present or former member of the Armed
				Forces, to a third party, as defined in section 1729(i)(3)(D) of this title, in
				order to enable the Secretary to collect reasonable charges under section
				1729(a)(2)(E) of this title for care or services provided for a
				non-service-connected
				disability.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idA95FE018EC024C54AF21B6EFDB4DCB16"><enum>(b)</enum><header>Disclosures
			 from certain medical records</header><text>Section 7332(b)(2) is amended by
			 adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="idCB917C7C9DC7473B981E64C95920E542" style="OLC">
					<subparagraph id="id12FF96BADA344BEA94FA460B1728AAD8"><enum>(F)</enum><text>To a third party,
				as defined in section 1729(i)(3)(D) of this title, to collect reasonable
				charges under section 1729(a)(2)(E) of this title for care or services provided
				for a non-service-connected
				disability.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idA4A0EF663FAC4E69A07C56D777209674"><enum>7.</enum><header>Permanent
			 authority to carry out income verification</header><text display-inline="no-display-inline">Section 5317 is amended by striking
			 subsection (g).</text>
		</section><section id="id5B25859F07E147DFA11824F311420C75"><enum>8.</enum><header>Increase in
			 rates of disability compensation and dependency and indemnity
			 compensation</header>
			<subsection id="id661F7291449C4B07B511D94A0AF72FF6"><enum>(a)</enum><header>Rate
			 adjustment</header><text>The Secretary of Veterans Affairs shall, effective on
			 December 1, 2008, increase the dollar amounts in effect for the payment of
			 disability compensation and dependency and indemnity compensation by the
			 Secretary, as specified in subsection (b).</text>
			</subsection><subsection id="idA54088E633B448CAA6AAC43C934F3228"><enum>(b)</enum><header>Amounts To be
			 increased</header><text>The dollar amounts to be increased pursuant to
			 subsection (a) are the following:</text>
				<paragraph id="id5C20ACD726D843FD858BC7961B331F7E"><enum>(1)</enum><header>Compensation</header><text>Each
			 of the dollar amounts in effect under section 1114 of title 38, United States
			 Code;</text>
				</paragraph><paragraph id="idDCC39FE949C64825B9A0DF8120B6EB22"><enum>(2)</enum><header>Additional
			 compensation for dependents</header><text>Each of the dollar amounts in effect
			 under section 1115(1) of such title;</text>
				</paragraph><paragraph id="idE1D289C80CC5448280A4108261732D22"><enum>(3)</enum><header>Clothing
			 allowance</header><text>The dollar amount in effect under section 1162 of such
			 title;</text>
				</paragraph><paragraph id="id0F010FD91C524A15A5F6F93AF7EB0B0D"><enum>(4)</enum><header>New dic
			 rates</header><text>Each of the dollar amounts in effect under paragraphs (1)
			 and (2) of section 1311(a) of such title;</text>
				</paragraph><paragraph id="id669607D366394374B438DE896F3C22CB"><enum>(5)</enum><header>Old dic
			 rates</header><text>Each of the dollar amounts in effect under section
			 1311(a)(3) of such title;</text>
				</paragraph><paragraph id="idEE1BACD94FDB4A86AA496208C379BEAE"><enum>(6)</enum><header>Additional dic
			 for surviving spouses with minor children</header><text>The dollar amounts in
			 effect under section 1311(b) of such title;</text>
				</paragraph><paragraph id="id102CB1DCC8724EC28471C75C7BBE29C2"><enum>(7)</enum><header>Additional dic
			 for disability</header><text>Each of the dollar amounts in effect under
			 subsections (c) and (d) of section 1311 of such title;</text>
				</paragraph><paragraph id="idEBA3452AB5F74BCFB8A199347582B11A"><enum>(8)</enum><header>Dic for
			 dependent children</header><text>Each of the dollar amounts in effect under
			 sections 1313(a) and 1314 of such title;</text>
				</paragraph></subsection><subsection id="id31F67FD4A33B4D3DA6A9EF4247065BD1"><enum>(c)</enum><header>Determination
			 of increase</header>
				<paragraph id="id2471A1CCA36E412EA1A3AEAC02FF4CD0"><enum>(1)</enum><text>The increase
			 under subsection (a) shall be made in the dollar amounts specified in
			 subsection (b) as in effect on November 30, 2008.</text>
				</paragraph><paragraph id="id6A7889E55F754F9DAFA696AA06C2E926"><enum>(2)</enum><text>Except as
			 provided in paragraph (3), each such amount shall be increased by the same
			 percentage as the percentage by which benefit amounts payable under title II of
			 the Social Security Act (42 U.S.C. 401 et seq.) are increased effective
			 December 1, 2008, as a result of a determination under section 215(i) of such
			 Act (42 U.S.C. 415(i)).</text>
				</paragraph><paragraph id="id3FA21C9F8E844740B95EB204424049D7"><enum>(3)</enum><text>Each dollar
			 amount increased pursuant to paragraph (2) shall, if not a whole dollar amount,
			 be rounded down to the next lower whole dollar amount.</text>
				</paragraph></subsection><subsection id="idE4E5411274924A218EEA1228CD3E338A"><enum>(d)</enum><header>Special
			 rule</header><text>The Secretary may adjust administratively, consistent with
			 the increases made under subsection (a), the rates of disability compensation
			 payable to persons within the purview of section 10 of Public Law 85–857 (72
			 Stat. 1263) who are not in receipt of compensation payable pursuant to chapter
			 11 of title 38, United States Code.</text>
			</subsection><subsection id="idF73DE75F382D4196B01F4914C4CBBB17"><enum>(e)</enum><header>Publication of
			 adjusted rates</header><text>At the same time as the matters specified in
			 section 215(i)(2)(D) of the Social Security Act (42 U.S.C. 415(i)(2)(D)) are
			 required to be published by reason of a determination made under section 215(i)
			 of such Act during fiscal year 2009, the Secretary of Veterans Affairs shall
			 publish in the Federal Register the amounts specified in subsection (b), as
			 increased pursuant to subsection (a).</text>
