			 purposes</header>
			<subsection id="ID134A5F74B5A54E05BD170DF6CC39EF71"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="IDa8bda824e9694bd88e8bc2c56b8c7b47"><enum>(1)</enum><text>Cruise vessels
			 carry millions of people through North American waters each year, showcase some
			 of the most beautiful ocean areas in the United States, and provide
			 opportunities for passengers to relax and enjoy the oceans and marine
			 ecosystems.</text>
				</paragraph><paragraph id="ID3940f90890a54e9eb17397ffc142dfe6"><enum>(2)</enum><text>A single cruise
			 vessel generates a tremendous amount of waste each week, including an estimated
			 140,000 to 210,000 gallons of blackwater (sewage) and 1,000,000 gallons of
			 graywater (including wastewater from dishwashers, showers, laundry, baths, and
			 washbasins). Onboard amenities such as photo-processing, dry-cleaning, and
			 hairdressing also generate hazardous waste streams.</text>
				</paragraph><paragraph id="IDb7ba17d6ec2a448583c8ce5a53fe2dc6"><enum>(3)</enum><text>In its final
			 report, <quote>An Ocean Blueprint for the 21st Century</quote>, released in
			 2004, the United States Commission on Ocean Policy found that these waste
			 streams and the cumulative impacts caused when cruise vessels repeatedly visit
			 the same environmentally sensitive areas, <quote>if not properly disposed of
			 and treated, can be a significant source of pathogens and nutrients with the
			 potential to threaten human health and damage shellfish beds, coral reefs, and
			 other aquatic life,</quote> thus threatening the very environments cruise
			 vessel passengers seek to explore.</text>
				</paragraph><paragraph id="ID620983c28d914016b0cf04fc9fcb2bc0"><enum>(4)</enum><text>The cruise
			 industry has grown by more than 6 percent annually since 2003 and is projected
			 to continue growing. Cruise vessel capacity is also expanding dramatically;
			 today cruise vessels can transport 5,000 passengers and crew members, but the
			 next generation of cruise vessels is expected to carry 7,000 passengers and
			 crew members. As the total number of passengers increases and the number of
			 passengers per ship increases, the volume of waste entering these ocean
			 ecosystems and the impact of that waste on ocean ecosystems will also
			 increase.</text>
				</paragraph><paragraph id="IDd07c3e74b9224508a8ead8922ffbd915"><enum>(5)</enum><text>In a 2005 report
			 requested by the International Council of Cruise Lines, the Ocean Conservation
			 and Tourism Alliance (OCTA) Science Panel recommended that <quote>[a]ll
			 blackwater should be treated</quote>, that discharging treated blackwater
			 should be <quote>avoided in ports, close to bathing beaches or water bodies
			 with restricted circulation, flushing or inflow</quote>, and that blackwater
			 should not be discharged within 4 nautical miles of shellfish beds, coral
			 reefs, or other sensitive habitats.</text>
				</paragraph><paragraph id="ID1d77e4915e6942d896d68f51fb0d9128"><enum>(6)</enum><text>The OCTA Science
			 Panel further recommended that graywater be treated in the same manner as
			 blackwater and that sewage sludge be off-loaded to approved land-based
			 facilities.</text>
				</paragraph><paragraph id="ID8d388feb4e4f43b29d70f34295b14918"><enum>(7)</enum><text>The United States
			 lacks a comprehensive wastewater management policy for large passenger vessels,
			 and a new statutory regime for managing wastewater discharges from large
			 passenger vessels that applies throughout the United States is needed to
			 protect coastal and ocean areas from pollution generated by cruise vessels, to
			 reduce and better regulate discharges from cruise vessels, and to improve
			 monitoring, reporting, and enforcement of standards regarding
			 discharges.</text>
				</paragraph></subsection><subsection id="ID77C563CFCD304D6BAA7ABADD8D39C307"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to protect the health and beauty of the marine and
			 coastal ecosystems that cruise passengers enjoy, by—</text>
				<paragraph id="id1DCA35E71E44418D9775A423C6982A9C"><enum>(1)</enum><text>prohibiting the
			 discharge of any untreated sewage, graywater, or bilge water from a cruise
			 vessel calling on a port of the United States into the waters of the United
			 States;</text>
				</paragraph><paragraph id="IDC4EBB0666B5B42598B5EDC5E06F4B13A"><enum>(2)</enum><text>prohibiting the
			 discharge of any sewage sludge, incinerator ash, or hazardous waste from a
			 cruise vessel calling on a port of the United States into the waters of the
			 United States;</text>
				</paragraph><paragraph id="ID97D0AC7396834700A60BC4DBCD257729"><enum>(3)</enum><text>establishing new
			 national effluent limits for the discharge of treated sewage, treated
			 graywater, and treated bilge water from cruise vessels not less than 12 miles
			 from shore in any case in which the discharge is not within an area in which
			 discharges are prohibited; and</text>
				</paragraph><paragraph id="IDF339174EF51E4DA681593FF123678493"><enum>(4)</enum><text>ensuring that
			 cruise vessels calling on ports of the United States comply with all applicable
			 environmental laws.</text>
				</paragraph></subsection></section><section id="IDD0F640FCB2AE4E2F8174C80C3D628022"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDB837F65E5E14452FB3C441E9E733D34B"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
			</paragraph><paragraph id="ID0FC9F5005B894CA9835C3DA95E18494D"><enum>(2)</enum><header>Bilge
			 water</header><text>The term <term>bilge water</term> means waste water that
			 includes lubrication oils, transmission oils, oil sludge or slops, fuel or oil
			 sludge, used oil, used fuel or fuel filters, or oily waste.</text>
			</paragraph><paragraph id="ID13C2B67838D04663B54AC31A4BE5B54F"><enum>(3)</enum><header>Citizen</header><text>The
			 term <term>citizen</term> means a person that has an interest that is or may be
			 adversely affected by any provision of this Act.</text>
			</paragraph><paragraph id="IDCC99377521674B4CA4715332652C8F96"><enum>(4)</enum><header>Commandant</header><text>The
			 term <term>Commandant</term> means the Commandant of the Coast Guard.</text>
			</paragraph><paragraph id="ID938E21C77086462B8D1E604996095585"><enum>(5)</enum><header>Cruise
			 vessel</header><text>The term <term>cruise vessel</term>—</text>
				<subparagraph id="idB9BDABA0BC8145CE9F3658CB6BD02B55"><enum>(A)</enum><text>means a passenger
			 vessel (as defined in section 2101(22) of title 46, United States Code),
			 that—</text>
					<clause id="IDFC630C80DD3449B5BC08B2DEAFE98AC6"><enum>(i)</enum><text>is
			 authorized to carry at least 250 passengers; and</text>
					</clause><clause id="IDA8776CC689CD4257A7D7F3755398C7F0"><enum>(ii)</enum><text>has onboard
			 sleeping facilities for each passenger; and</text>
					</clause></subparagraph><subparagraph id="idAF23BEC0953F4C13A88D5AA25B786EEF"><enum>(B)</enum><text>does not
			 include—</text>
					<clause id="ID066AD7B1522B4968833FE771A74C7597"><enum>(i)</enum><text>a
			 vessel of the United States operated by the Federal Government; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID67044BEE007F4587A0E75E0502A68F1F"><enum>(ii)</enum><text>a vessel owned
			 and operated by the government of a State.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" id="ID72A4404908F445989623A670AF64DDB4"><enum>(6)</enum><header>Discharge</header><text>The
			 term <term>discharge</term>—</text>
				<subparagraph commented="no" id="id4AE066442D064BB4AD31FF075100D47B"><enum>(A)</enum><text>means a release,
			 however caused, of bilge water, graywater, hazardous waste, incinerator ash,
			 sewage, or sewage sludge from a cruise vessel; and</text>
				</subparagraph><subparagraph commented="no" id="idB9B247A7CAE142AA9814590C0306CEDB"><enum>(B)</enum><text>includes any
			 escape, disposal, spilling, leaking, pumping, emitting, or emptying of a
			 substance described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="IDA727B100CDB446F18E171B9E84EEFCC9"><enum>(7)</enum><header>Exclusive
			 economic zone</header><text>The term <term>exclusive economic zone</term> has
			 the meaning given that term in section 107 of title 46, United States
			 Code.</text>
			</paragraph><paragraph id="ID422E2AEC955C408689BAB9A53A74489D"><enum>(8)</enum><header>Graywater</header><text>The
			 term <term>graywater</term> means galley, dishwasher, bath, spa, pool, and
			 laundry waste water.</text>
			</paragraph><paragraph id="ID0DC44818ED5D4C708BE3F65F1EBA5F02"><enum>(9)</enum><header>Great
			 lake</header><text>The term <term>Great Lake</term> means—</text>
				<subparagraph id="ID9B0E20FBA4B04E5B92F218EF3DBAD28A"><enum>(A)</enum><text>Lake Erie;</text>
				</subparagraph><subparagraph id="ID657F2DE1636F4C1FA7CA42524F7C5579"><enum>(B)</enum><text>Lake Huron
			 (including Lake Saint Clair);</text>
				</subparagraph><subparagraph id="IDAC7432CB2B57426D9703D1FFAE4716D5"><enum>(C)</enum><text>Lake
			 Michigan;</text>
				</subparagraph><subparagraph id="IDE4CBCAD497B9406381ABFE1A26FF5DB2"><enum>(D)</enum><text>Lake Ontario;
			 or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE020B2641DF841B4BF4E2998E54204DC"><enum>(E)</enum><text>Lake
			 Superior.</text>
				</subparagraph></paragraph><paragraph commented="no" id="id5382809C66774C06A1A9AE5C0B02A3A5"><enum>(10)</enum><header>Hazardous
			 waste</header><text>The term <term>hazardous waste</term> has the meaning given
			 that term in section 1004 of the Solid Waste Disposal Act (42 U.S.C.
			 6903).</text>
			</paragraph><paragraph id="idFFD91844B6F84C6CB7A7E0A75980C396"><enum>(11)</enum><header>Incinerator
			 ash</header><text>The term <term>incinerator ash</term> means ash generated
			 during the incineration of solid waste or sewage sludge.</text>
			</paragraph><paragraph id="id682FD5E559364432ABEE18EE8EE964C5"><enum>(12)</enum><header>No discharge
			 zones</header><text>The term <term>no discharge zones</term> means important
			 ecological areas including marine sanctuaries, marine protected areas, marine
			 reserves, marine national monuments, national parks, and national wildlife
			 refuges.</text>
			</paragraph><paragraph id="ID34B443A92A2E485C8C91D60AC72E7E11"><enum>(13)</enum><header>Passenger</header><text>The
			 term <term>passenger</term> means a paying passenger.</text>
			</paragraph><paragraph id="IDBD810F9FDF5C439B8ED0CE373B3ECA6C"><enum>(14)</enum><header>Person</header><text>The
			 term <term>person</term> means—</text>
				<subparagraph id="IDD3D031A1059E49C2AF49AB89B4D7C0CD"><enum>(A)</enum><text>an
			 individual;</text>
				</subparagraph><subparagraph id="IDE574FB5557BB43D4B1EDE0B6D068B474"><enum>(B)</enum><text>a
			 corporation;</text>
				</subparagraph><subparagraph id="IDD3B76D3E249945BF80EA5BA8ED10A969"><enum>(C)</enum><text>a
			 partnership;</text>
				</subparagraph><subparagraph id="ID54DAD8ADAEBC41C8BE86CFD376F5367D"><enum>(D)</enum><text>a limited
			 liability company;</text>
				</subparagraph><subparagraph id="IDB667F67CBA0D43558A51EE28AFA88E27"><enum>(E)</enum><text>an
			 association;</text>
				</subparagraph><subparagraph id="IDCA1B01B5FF644B7C882205950B4766CD"><enum>(F)</enum><text>a State;</text>
				</subparagraph><subparagraph id="ID5E0087816B0D426BAED097800C3C644D"><enum>(G)</enum><text>a
			 municipality;</text>
				</subparagraph><subparagraph id="IDDF8CE2FC2BF8445BA2DAD65C509971DA"><enum>(H)</enum><text>a commission or
			 political subdivision of a State; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF3D2040F630E4E3DBCAAA5732D0D7F6E"><enum>(I)</enum><text>an Indian
			 tribe.</text>
				</subparagraph></paragraph><paragraph id="id8849E468ADC24C5590EC1D151B1E1222"><enum>(15)</enum><header>Sewage</header><text>The
			 term <term>sewage</term> means—</text>
				<subparagraph id="ID409F8F9422D3493B967083F327EACB28"><enum>(A)</enum><text>human body
			 wastes; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBB38B6A648564D8FA80C319EF2686F94"><enum>(B)</enum><text>the wastes from
			 toilets and other receptacles intended to receive or retain human body
			 wastes.</text>
				</subparagraph></paragraph><paragraph id="ID99470EA82CAF47C29EACCFE48A82A6DF"><enum>(16)</enum><header>Sewage
			 sludge</header><text>The term <term>sewage sludge</term>—</text>
				<subparagraph id="id534568FD53854C899C996DADCA9F10CB"><enum>(A)</enum><text>means any solid,
			 semi-solid, or liquid residue removed during the treatment of on-board
			 sewage;</text>
				</subparagraph><subparagraph id="ID99C83E51A08941AD98A1C49D91EF3692"><enum>(B)</enum><text>includes—</text>
					<clause id="ID518BBD71DBC34598B670CE8A9C927121"><enum>(i)</enum><text>solids removed
			 during primary, secondary, or advanced waste water treatment;</text>
					</clause><clause id="ID6EFD17AD6C6B4FD7AF336E73E4F3850F"><enum>(ii)</enum><text>scum;</text>
					</clause><clause id="ID24FE00AA684C4AE4A88DFC46BF7FCCA2"><enum>(iii)</enum><text>septage;</text>
					</clause><clause id="ID0EAC1A90A2A942088D3C3120293A3CAC"><enum>(iv)</enum><text>portable toilet
			 pumpings;</text>
					</clause><clause id="ID31F59C5ADAC447A6AB6E7A850BBEDDD5"><enum>(v)</enum><text>type III marine
			 sanitation device pumpings (as defined in part 159 of title 33, Code of Federal
			 Regulations); and</text>
					</clause><clause id="IDB3221513A56A4D089C41729D4F028432"><enum>(vi)</enum><text>sewage sludge
			 products; and</text>
					</clause></subparagraph><subparagraph id="ID26509E7E826046F1A4823FF1F598E823"><enum>(C)</enum><text>does not
			 include—</text>
					<clause id="ID2AB98B41369146F7B84C11C515A762C2"><enum>(i)</enum><text>grit or
			 screenings; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID1AE5DD66F77B4A928377A843A1E0C4CD"><enum>(ii)</enum><text>ash generated
			 during the incineration of sewage sludge.</text>
					</clause></subparagraph></paragraph><paragraph id="ID11DE2575E41C46D69B0ECF0C87858F12"><enum>(17)</enum><header>Territorial
			 sea</header><text>The term <term>territorial sea</term>—</text>
				<subparagraph id="id1B1F217894A44C86A1468FCFE9B63842"><enum>(A)</enum><text>means the belt of
			 the sea extending 12 nautical miles from the baseline of the United States
			 determined in accordance with international law, as set forth in Presidential
			 Proclamation number 5928, dated December 27, 1988; and</text>
				</subparagraph><subparagraph id="idB1DCE73EAA944105BA9C87C77864AE29"><enum>(B)</enum><text>includes the
			 waters lying seaward of the line of ordinary low water and extending to the
			 baseline of the United States, as determined under subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="IDF0072121911043118173BE00A9425780"><enum>(18)</enum><header>Waters of the
			 united states</header><text>The term <term>waters of the United States</term>
			 means the waters of the territorial sea, the exclusive economic zone, and the
			 Great Lakes.</text>
			</paragraph></section><section id="ID7D5DE6C1651E4145A767FFAAB91A602D"><enum>4.</enum><header>Prohibitions on
			 the discharge of sewage, graywater, bilge water, sewage sludge, incinerator
			 ash, and hazardous waste</header>
			<subsection id="IDF1A8A32B634A4F2EBA03EE63379A5B68"><enum>(a)</enum><header>Prohibitions on
			 discharge of sewage, graywater, and bilge water</header><text>Except as
			 provided in subsection (c) or section 6, no cruise vessel calling on a port of
			 the United States may discharge sewage, graywater, or bilge water into the
			 waters of the United States, unless—</text>
				<paragraph id="id61E795E9E7F340E9B79172446A60C329"><enum>(1)</enum><text>the effluent of
			 treated sewage, treated graywater, or treated bilge water meets all applicable
			 effluent limits established under this Act and is in accordance with all other
			 applicable laws;</text>
				</paragraph><paragraph id="id18EDF673ACE54E41B8A01BE97C78B08A"><enum>(2)</enum><text>the cruise vessel
			 is underway and proceeding at a speed of not less than 6 knots;</text>
				</paragraph><paragraph id="id50B8EC72C85149CB9E71A6AB780EEDC8"><enum>(3)</enum><text>the cruise vessel
			 is not less than 12 nautical miles from shore;</text>
				</paragraph><paragraph id="ID7E79D939CEF6455DA0A28FC0140A97A5"><enum>(4)</enum><text>the cruise vessel
			 is not discharging in no discharge zones; and</text>
				</paragraph><paragraph id="ID70BD661EA88E44A38A42985D180E7B92"><enum>(5)</enum><text>the cruise vessel
			 complies with all applicable management standards established under this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" id="idF7CAAF37BDAC4201BABAA63466E5B370"><enum>(b)</enum><header>Prohibition on
			 discharge of sewage sludge, incinerator ash, and hazardous
			 waste</header><text>No sewage sludge, incinerator ash, or hazardous waste may
			 be discharged into the waters of the United States. Such sewage sludge,
			 incinerator ash, and hazardous waste shall be off-loaded at an appropriate
			 land-based facility.</text>
			</subsection><subsection id="idEC034F00F2504DFB8D3987D174CEDB98"><enum>(c)</enum><header>Safety
			 exception</header>
				<paragraph id="IDC00FA447677748B29EF3F62102539F01"><enum>(1)</enum><header>Scope of
			 exception</header><text>The provisions of subsections (a) and (b) shall not
			 apply in any case in which—</text>
					<subparagraph id="ID417A406D22F5497D9BAAE1BD01278B27"><enum>(A)</enum><text>a discharge is
			 made solely for the purpose of securing the safety of the cruise vessel or
			 saving a human life at sea; and</text>
					</subparagraph><subparagraph id="IDBF4EDDEA816A4806B392624DDCC374BD"><enum>(B)</enum><text>all reasonable
			 precautions have been taken to prevent or minimize the discharge.</text>
					</subparagraph></paragraph><paragraph id="ID67D0473BB9994F74BB2DE7518A9994C1"><enum>(2)</enum><header>Notification of
			 commandant</header>
					<subparagraph id="IDEF70310143D54842B74C2A1D05D028DF"><enum>(A)</enum><header>In
			 general</header><text>If the owner, operator, master, or other individual in
			 charge of a cruise vessel authorizes a discharge described in paragraph (1),
			 such individual shall notify the Commandant of the decision to authorize the
			 discharge as soon as practicable, but not later than 24 hours, after
			 authorizing the discharge.</text>
					</subparagraph><subparagraph id="ID0CFBCA0D943A48C8A3A8AB17C5E3C3BB"><enum>(B)</enum><header>Report</header><text>Not
			 later than 7 days after the date on which an individual described in
			 subparagraph (A) notifies the Commandant of a decision to authorize a discharge
			 under paragraph (1), the individual shall submit to the Commandant a report
			 that includes—</text>
						<clause id="ID7D38B8C9A3AA4D86A2FBC3F360EA5E9C"><enum>(i)</enum><text>the
			 quantity and composition of each discharge authorized under paragraph
			 (1);</text>
						</clause><clause id="ID725263AEA60B42A0BEFB12FD871A96A5"><enum>(ii)</enum><text>the reason for
			 authorizing each such discharge;</text>
						</clause><clause id="ID3FC8DB79B7CA41AC9D4DAE0C00079639"><enum>(iii)</enum><text>the location of
			 the vessel during the course of each such discharge; and</text>
						</clause><clause id="ID6196CB2FE66445DEA7FBBD21DA2A7911"><enum>(iv)</enum><text>such other
			 supporting information and data as are requested by the Commandant.</text>
						</clause></subparagraph><subparagraph id="id6A21196A448E4A0D81A22F09C1CF2425"><enum>(C)</enum><header>Disclosure of
			 reports</header><text>Upon receiving a report under subparagraph (B), the
			 Commandant shall—</text>
						<clause id="id455A76FCACCA4E85AF4531964275D33D"><enum>(i)</enum><text>transmit a copy
			 of the report to the Administrator; and</text>
						</clause><clause id="id302D5F43836F4E65981B0BCA61C4A8AD"><enum>(ii)</enum><text>make the report
			 available to the public.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="IDB10997CAC47B487B92B84F5A3B065770"><enum>5.</enum><header>Effluent limits
			 for discharges of sewage, graywater, and bilge water</header>
			<subsection id="ID76F31938633E4D9CBF332352C7DB6FE5"><enum>(a)</enum><header>Effluent
			 limits</header>
				<paragraph id="ID3FCC065309124C27885186840E0DCC47"><enum>(1)</enum><header>In
			 general</header><text>Not later than 12 months after the date of the enactment
			 of this Act, the Administrator shall promulgate effluent limits for sewage,
			 graywater, and bilge water discharges from cruise vessels calling on ports of
			 the United States.</text>
				</paragraph><paragraph id="IDD1405D807B8E4535A79EC16A77360B47"><enum>(2)</enum><header>Requirements</header><text>The
			 effluent limits shall, at a minimum—</text>
					<subparagraph id="ID35C731618B2B4522A51547CD6A33DA78"><enum>(A)</enum><text>be consistent
			 with the capability of the best available technology to treat effluent;</text>
					</subparagraph><subparagraph id="ID34AB7BA4CBBF44F78692B721532EBD8C"><enum>(B)</enum><text>require
			 compliance with all relevant State and Federal water quality standards;
			 and</text>
					</subparagraph><subparagraph id="id11FCC04CF0D94F97AEB3476D157B6C0C"><enum>(C)</enum><text>take into account
			 the best available scientific information on the environmental effects of
			 sewage, graywater, and bilge water discharges, including levels of nutrients,
			 total and dissolved metals, pathogen indicators, oils and grease, classical
			 pollutants, and volatile and semivolatile organics.</text>
					</subparagraph></paragraph></subsection><subsection id="IDD2B12B7C5A354A86AA6F73CBBCCDFFE0"><enum>(b)</enum><header>Minimum
			 limits</header><text>The effluent limits promulgated under subsection (a) shall
			 require, at a minimum, that treated sewage, treated graywater, and treated
			 bilge water effluent discharges from cruise vessels, measured at the point of
			 discharge, shall, not later than the date described in subsection (d), meet the
			 following standards:</text>
				<paragraph id="ID0940243CA2DD4A988C79F370E8FBC16A"><enum>(1)</enum><header>In
			 general</header><text>The discharge shall satisfy the minimum level of effluent
			 quality specified in section 133.102 of title 40, Code of Federal Regulations
			 (or a successor regulation).</text>
				</paragraph><paragraph id="ID063A34ECCCF14CA1AD09725A9AB3313A"><enum>(2)</enum><header>Fecal
			 coliform</header><text>With respect to the samples from the discharge during
			 any 30-day period—</text>
					<subparagraph id="ID8180368FDB5E41408064FC736F6354AD"><enum>(A)</enum><text>the geometric
			 mean of the samples shall not exceed 20 fecal coliform per 100 milliliters;
			 and</text>
					</subparagraph><subparagraph id="IDEDEBD1909E35401A824A38FB82B85062"><enum>(B)</enum><text>not more than 10
			 percent of the samples shall exceed 40 fecal coliform per 100
			 milliliters.</text>
					</subparagraph></paragraph><paragraph id="ID5CA952AF57FB4066B61414390662E333"><enum>(3)</enum><header>Residual
			 chlorine</header><text>Concentrations of total residual chlorine in samples
			 shall not exceed 10 milligrams per liter.</text>
				</paragraph></subsection><subsection id="ID6193932213994DB0896B19DF4C52286C"><enum>(c)</enum><header>Review and
			 revision of effluent limits</header><text>The Administrator shall—</text>
				<paragraph id="ID6A3B4485B770425E825BFCF3D5ED2AB6"><enum>(1)</enum><text>review the
			 effluent limits promulgated under subsection (a) at least once every 5 years;
			 and</text>
				</paragraph><paragraph id="ID4597FE560D944E2DAC5F3C5CE54FC741"><enum>(2)</enum><text>revise the
			 effluent limits as necessary to incorporate technology available at the time of
			 the review in accordance with subsection (a)(2).</text>
				</paragraph></subsection><subsection id="idE928AD278F384D5D8030A4E031E81EBA"><enum>(d)</enum><header>Compliance
			 date</header>
				<paragraph id="id660561BE609644E1A88B98ED7A1AF292"><enum>(1)</enum><header>In
			 general</header><text>The date described in this subsection is—</text>
					<subparagraph id="id4227E3B1D85446F58D86EA33FF9CF3BD"><enum>(A)</enum><text>with respect to
			 new vessels put into water after the date of the enactment of this Act, 2 years
			 after such date of enactment; and</text>
					</subparagraph><subparagraph id="id6E727F927EAF4AEC89C8AFAACA03FFC6"><enum>(B)</enum><text>with respect to
			 vessels in use as of such date of enactment, 5 years after such date of
			 enactment.</text>
					</subparagraph></paragraph><paragraph id="id946D9A35AA9B445987C4C7E9E667B041"><enum>(2)</enum><header>New vessel
			 defined</header><text>In this subsection, the term <term>new vessel</term>
			 means a vessel the keel of which is laid, or that is at a similar stage of
			 construction, on or after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="IDDE03A25A1ECF4C1C9B04A3BC08FE18A8"><enum>6.</enum><header>Alaskan cruise
			 vessels</header>
			<subsection id="IDFA6859BD87EB473B9E6AE3C51F800008"><enum>(a)</enum><header>In
			 general</header><text>An Alaskan cruise vessel shall not be subject to the
			 provisions of this Act (including regulations promulgated under this Act) until
			 the date that is 10 years after the date of the enactment of this Act.</text>
			</subsection><subsection commented="no" id="ID489507550DB2436E8438210903B0496E"><enum>(b)</enum><header>Definition of
			 Alaskan cruise vessel</header><text>In this section, the term <term>Alaskan
			 cruise vessel</term> means a cruise vessel—</text>
				<paragraph commented="no" id="ID54A94216172349DB86C76BC69F50B7F6"><enum>(1)</enum><text>while the vessel
			 is operating in waters of the State of Alaska, as defined in section 159.305 of
			 title 33, Code of Federal Regulations; and</text>
				</paragraph><paragraph commented="no" id="ID5854F460D22F4123815E44F1C6FF8285"><enum>(2)</enum><text>that complies
			 with all relevant laws and regulations of the State of Alaska while in transit
			 from a port of call outside of the State of Alaska to the waters of the State
			 of Alaska.</text>
				</paragraph></subsection></section><section id="IDA8D1145C8CB7473D9A08FC44CB4A8A3D"><enum>7.</enum><header>Inspection and
			 sampling</header>
			<subsection id="ID095411B09E644E49A64A009A54EE5E15"><enum>(a)</enum><header>Development and
			 implementation of inspection program</header>
				<paragraph id="IDF6BF33D1BD9A4E8599D972F8FFADD5A2"><enum>(1)</enum><header>In
			 general</header><text>The Administrator shall promulgate regulations to
			 implement a sampling and testing program, and the Commandant shall promulgate
			 regulations to implement an inspection program, sufficient to verify that
			 cruise vessels calling on ports of the United States are in compliance
			 with—</text>
					<subparagraph id="IDA36A6D99EB114357AE1CE431AF82F4C0"><enum>(A)</enum><text>this Act
			 (including regulations promulgated under this Act);</text>
					</subparagraph><subparagraph id="IDCCB7BC5AC00444AE9B754D7BFF30D10A"><enum>(B)</enum><text>the
			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>
			 (33 U.S.C. 1251 et seq.) (including regulations promulgated under that
			 Act);</text>
					</subparagraph><subparagraph id="ID836AD89848854D0697AA0D4FCB678395"><enum>(C)</enum><text>other applicable
			 Federal laws and regulations; and</text>
					</subparagraph><subparagraph id="ID0157F9147FD946EBBF7855967732B7CD"><enum>(D)</enum><text>all applicable
			 requirements of international agreements.</text>
					</subparagraph></paragraph><paragraph id="ID347FEBF4DE7C4BDEBF5958F5A1BCC6E0"><enum>(2)</enum><header>Inspections</header><text>The
			 program shall require that—</text>
					<subparagraph id="ID2803A3D701D54593871DFC5BDE944376"><enum>(A)</enum><text>regular announced
			 and unannounced inspections be conducted of any relevant aspect of cruise
			 vessel operations, equipment, or discharges, including sampling and testing of
			 cruise vessel discharges; and</text>
					</subparagraph><subparagraph id="ID240FCA358185499280B4E9A0F5C2FE4F"><enum>(B)</enum><text>each cruise
			 vessel that calls on a port of the United States be subject to an unannounced
			 inspection at least once per year.</text>
					</subparagraph></paragraph></subsection><subsection id="ID11EA68038FC54370A8E67A7236DFBCBC"><enum>(b)</enum><header>Regulations</header>
				<paragraph id="idC3B05E714D104379929FE5A0AC30500F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Commandant, in consultation with the Administrator, shall
			 promulgate regulations that, at a minimum—</text>
					<subparagraph id="ID4E9D0C670DE040C7A18009C065DDDE1F"><enum>(A)</enum><text>require the
			 owner, operator, master, or other individual in charge of a cruise vessel to
			 maintain and submit annually a logbook detailing the times, types, volumes,
			 flow rates, origins, and specific locations of, and explanations for, any
			 discharges from the cruise vessel;</text>
					</subparagraph><subparagraph id="ID8A00272F56814A209081DDCA66539EA0"><enum>(B)</enum><text>provide for
			 routine announced and unannounced inspections of—</text>
						<clause id="ID9F16A8F5452C479284ECC4AED06FB382"><enum>(i)</enum><text>cruise vessel
			 environmental compliance records and procedures; and</text>
						</clause><clause id="IDC2EC2446A6974111B36302CC36B17C86"><enum>(ii)</enum><text>the
			 functionality and proper operation of installed equipment for abatement and
			 control of any cruise vessel discharge, including equipment intended to treat
			 sewage, graywater, or bilge water;</text>
						</clause></subparagraph><subparagraph id="ID0E08338193B240BAAB056699283356E6"><enum>(C)</enum><text>require the
			 sampling and testing of cruise vessel discharges that require the owner,
			 operator, master, or other individual in charge of a cruise vessel—</text>
						<clause id="ID1D0984E35F2442A7B1B67D31CE5A2352"><enum>(i)</enum><text>to
			 conduct that sampling or testing at the point of discharge; and</text>
						</clause><clause id="IDC5EC2330675B410DAEE0591DF57BDE59"><enum>(ii)</enum><text>to
			 produce any records of the sampling or testing;</text>
						</clause></subparagraph><subparagraph id="IDDFEBAA0E3CE94A0183AF6DA3907088A0"><enum>(D)</enum><text>require any
			 owner, operator, master, or other individual in charge of a cruise vessel who
			 has knowledge of a discharge from the cruise vessel in violation of this Act
			 (including regulations promulgated under this Act) to report immediately the
			 discharge to the Commandant, who shall provide notification of the discharge to
			 the Administrator; and</text>
					</subparagraph><subparagraph id="IDD08FB55AA855496588BCB33ABA732732"><enum>(E)</enum><text>require the
			 owner, operator, master, or other individual in charge of a cruise vessel to
			 provide to the Commandant and Administrator a blueprint of each cruise vessel
			 that includes the location of every discharge pipe and valve.</text>
					</subparagraph></paragraph><paragraph id="id997FCDA35DFA4E3E9246CB3480D09BCA"><enum>(2)</enum><header>Disclosure of
			 logbooks</header><text>Upon receiving a logbook described in paragraph (1)(A),
			 the Commandant shall—</text>
					<subparagraph id="idED017B4557554D1587338BF9FA9D3851"><enum>(A)</enum><text>transmit a copy
			 of the logbook to the Administrator; and</text>
					</subparagraph><subparagraph id="id38C74CF464C0472BABF80930F03B4664"><enum>(B)</enum><text>make the logbook
			 available to the public.</text>
					</subparagraph></paragraph></subsection><subsection id="IDF7186EF60EB14BA2B43816EB7AF51DEC"><enum>(c)</enum><header>Evidence of
			 compliance</header>
				<paragraph id="ID7ED4E2CAB6D5485496A0ECEE925AE90A"><enum>(1)</enum><header>Vessel of the
			 united states</header>
					<subparagraph id="IDD234E28AEA44424BAFDA9AE32DBC7D3E"><enum>(A)</enum><header>In
			 general</header><text>A cruise vessel registered in the United States to which
			 this Act applies shall have a certificate of inspection issued by the
			 Commandant.</text>
					</subparagraph><subparagraph id="IDB1BD4AE5CAEB415EB62580BC8C9D40AA"><enum>(B)</enum><header>Issuance of
			 certificate</header><text>The Commandant may issue a certificate described in
			 subparagraph (A) only after the cruise vessel has been examined and found to be
			 in compliance with this Act, including prohibitions on discharges and
			 requirements for effluent limits, as determined by the Commandant.</text>
					</subparagraph><subparagraph id="ID50FD3DC31B3A445FB675C3C4288B1C9B"><enum>(C)</enum><header>Validity of
			 certificate</header><text>A certificate issued under this paragraph—</text>
						<clause id="ID3773E41B65AB47F6A44141CCB677CBC3"><enum>(i)</enum><text>shall be valid
			 for a period of not more than 5 years, beginning on the date of issuance of the
			 certificate;</text>
						</clause><clause id="ID0109CA6F5DF74F349F203E5BE3343F34"><enum>(ii)</enum><text>may be renewed
			 as specified by the Commandant; and</text>
						</clause><clause id="ID5702620741EC4DE7829E04E355228EAE"><enum>(iii)</enum><text>shall be
			 suspended or revoked if the Commandant determines that the cruise vessel for
			 which the certificate was issued is not in compliance with the conditions under
			 which the certificate was issued.</text>
						</clause></subparagraph><subparagraph id="ID24355E0ED7CC415B9DAE7A40DA51A86B"><enum>(D)</enum><header>Special
			 certificates</header><text>The Commandant may issue special certificates to
			 certain vessels that exhibit compliance with this Act and other best practices,
			 as determined by the Commandant, after public notice and comment.</text>
					</subparagraph></paragraph><paragraph id="ID4A3D6C6519DE4BB7A9D47BE9C3A9ED02"><enum>(2)</enum><header>Foreign
			 vessel</header>
					<subparagraph id="IDF997748940C744D2B5381638EFE75982"><enum>(A)</enum><header>In
			 general</header><text>A cruise vessel registered in a country other than the
			 United States to which this Act applies may operate in the waters of the United
			 States, or visit a port or place under the jurisdiction of the United States,
			 only if the cruise vessel has been issued a certificate of compliance by the
			 Commandant.</text>
					</subparagraph><subparagraph id="ID619FBC5F6B2F413A96B557E506167104"><enum>(B)</enum><header>Issuance of
			 certificate</header><text>The Commandant may issue a certificate described in
			 subparagraph (A) to a cruise vessel only after the cruise vessel has been
			 examined and found to be in compliance with this Act, including prohibitions on
			 discharges and requirements for effluent limits, as determined by the
			 Commandant.</text>
					</subparagraph><subparagraph id="ID684EC517B5124DFAB139654CCE94222E"><enum>(C)</enum><header>Acceptance of
			 foreign documentation</header><text>The Commandant may consider a certificate,
			 endorsement, or document issued by the government of a foreign country under a
			 treaty, convention, or other international agreement to which the United States
			 is a party, in issuing a certificate of compliance under this paragraph. Such a
			 certificate, endorsement, or document shall not serve as a proxy for
			 certification of compliance with this Act.</text>
					</subparagraph><subparagraph id="ID692106797D6F4A51A7261D6478E4B7C7"><enum>(D)</enum><header>Validity of
			 certificate</header><text>A certificate issued under this section—</text>
						<clause id="ID8B55874E3370479C90BA10BD91EC38E5"><enum>(i)</enum><text>shall be valid
			 for a period of not more than 24 months, beginning on the date of issuance of
			 the certificate;</text>
						</clause><clause id="ID65C5A61B37FB42A397DCB3DBD75B1774"><enum>(ii)</enum><text>may be renewed
			 as specified by the Commandant; and</text>
						</clause><clause id="ID1CFC6C1858A84A639A3AEEAC50B1ED45"><enum>(iii)</enum><text>shall be
			 suspended or revoked if the Commandant determines that the cruise vessel for
			 which the certificate was issued is not in compliance with the conditions under
			 which the certificate was issued.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID3C09029117964AD1A2DEDFA3130390AC"><enum>(d)</enum><header>Cruise observer
			 program</header>
				<paragraph id="ID238BB1FED0BE4B7E81B9CC66838CEC51"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Commandant shall establish and carry out a program for the
			 placement of 1 or more trained independent observers on each cruise
			 vessel.</text>
				</paragraph><paragraph id="id63291EE315704E56BB773187E50546A8"><enum>(2)</enum><header>Purposes</header><text>The
			 purposes of the cruise observer program established under paragraph (1) are to
			 monitor and inspect cruise vessel operations, equipment, and discharges to
			 ensure compliance with—</text>
					<subparagraph id="IDE34D3C61A85F464ABB3CD0C4FFCFC021"><enum>(A)</enum><text>this Act
			 (including regulations promulgated under this Act); and</text>
					</subparagraph><subparagraph id="ID39128962A2A048FF8423B675B641E13D"><enum>(B)</enum><text>all other
			 relevant Federal laws, regulations, and international agreements.</text>
					</subparagraph></paragraph><paragraph id="ID9EC6FA67C6C040FEB36124FCCF99C710"><enum>(3)</enum><header>Responsibilities</header><text>An
			 observer described in paragraph (1) shall—</text>
					<subparagraph id="ID7CD6850BD645479E953C16AD1087EE47"><enum>(A)</enum><text>observe and
			 inspect—</text>
						<clause id="IDF0E015DCDA0D448C80AD5E99B72A6A7A"><enum>(i)</enum><text>onboard
			 environmental treatment systems;</text>
						</clause><clause id="ID89C85045CC864F089A8675A196159C1C"><enum>(ii)</enum><text>use of
			 shore-based treatment and storage facilities;</text>
						</clause><clause id="IDEF826DD7AF52462F8A94364B4FB19F98"><enum>(iii)</enum><text>discharges and
			 discharge practices; and</text>
						</clause><clause id="IDF6EC7BDD094E4AB885B3DA45B8563081"><enum>(iv)</enum><text>blueprints,
			 logbooks, and other relevant information, including fuel consumption and
			 atmospheric emissions;</text>
						</clause></subparagraph><subparagraph id="IDBD25D3C1CAB54AB792C90EC7C06C9C0B"><enum>(B)</enum><text>have the
			 authority to interview and otherwise query any crew member with knowledge of
			 vessel operations;</text>
					</subparagraph><subparagraph id="IDE6A14F0C769C4B6299044546EA4E3160"><enum>(C)</enum><text>have access to
			 all data and information made available to government officials under this
			 section;</text>
					</subparagraph><subparagraph id="ID1CC16BAECF834578AF67A3EFD2A0F508"><enum>(D)</enum><text>immediately
			 report any known or suspected violation of this Act or any other applicable
			 Federal law or international agreement to—</text>
						<clause id="ID188CDC6834874CF18DEEE4807FBA9E30"><enum>(i)</enum><text>the
			 Coast Guard; and</text>
						</clause><clause id="ID1592E3010D4446249B0018DEF1CA78C5"><enum>(ii)</enum><text>the
			 Environmental Protection Agency; and</text>
						</clause></subparagraph><subparagraph id="id1B401EFC377C4A4C8733B4D403322FD1"><enum>(E)</enum><text>maintain a
			 logbook to be submitted to the Commandant and the Administrator annually and to
			 be made available to the public.</text>
					</subparagraph></paragraph><paragraph commented="no" id="IDAA1475C86B6545F697F90A6E15C0AAC9"><enum>(4)</enum><header>Adaptive
			 management</header><text>The program established and carried out by the
			 Commandant under paragraph (1) shall also include—</text>
					<subparagraph commented="no" id="id0469C2D5826348ED8218B68FEC25953F"><enum>(A)</enum><text>a method for
			 collecting and reviewing data related to the efficiency and operation of the
			 program; and</text>
					</subparagraph><subparagraph commented="no" id="idF3A5FD61784C4C889319F6FCF42FABEB"><enum>(B)</enum><text>periodic
			 revisions to the program based on the data collected under subparagraph
			 (A).</text>
					</subparagraph></paragraph><paragraph id="idA876D92ADD8D4479AE0886B5013B3C00"><enum>(5)</enum><header>Report</header><text>Not
			 later than 3 years after the establishment of the program described in
			 paragraph (1), the Commandant shall submit to Congress a report
			 describing—</text>
					<subparagraph id="id56F3C403AFFC4995AD86B2C8C6AB6578"><enum>(A)</enum><text>the results of
			 the program;</text>
					</subparagraph><subparagraph id="id7B869A6BF3EA44AAA45354857A8585C9"><enum>(B)</enum><text>recommendations
			 for optimal observer coverage; and</text>
					</subparagraph><subparagraph id="idBC9F03C081D84AADA08E6CE14D74D593"><enum>(C)</enum><text>other
			 recommendations for improvement of the program.</text>
					</subparagraph></paragraph></subsection><subsection id="ID12D1F9873E7F4CA5BC02961A7F130F2B"><enum>(e)</enum><header>Onboard
			 monitoring system pilot program</header>
				<paragraph id="ID20C3DCE8AFA4434E8E8CCEEC7A89CDAC"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Administrator of the National Oceanic and Atmospheric
			 Administration, in consultation with the Administrator and the Commandant,
			 shall establish, and for each of fiscal years 2008 through 2013, shall carry
			 out, with industry partners as necessary, a pilot program to develop and
			 promote commercialization of technologies to provide real-time data to Federal
			 agencies regarding—</text>
					<subparagraph id="ID8117BC20330A47768235B01E8BE8D6A5"><enum>(A)</enum><text>discharges of
			 sewage, graywater, and bilge water from cruise vessels; and</text>
					</subparagraph><subparagraph id="ID8163FFB956D545D885DBD3DE9FD47A17"><enum>(B)</enum><text>functioning of
			 cruise vessel components relating to fuel consumption and control of air and
			 water pollution.</text>
					</subparagraph></paragraph><paragraph id="IDF736B61B2FF24E0582FF46D574965160"><enum>(2)</enum><header>Technology
			 requirements</header><text>Technologies developed under the program described
			 in paragraph (1)—</text>
					<subparagraph id="ID4F7643DC11794A71975E356917D13818"><enum>(A)</enum><text>shall have the
			 ability to record—</text>
						<clause id="ID30B36BDCBEA44824B4D4BA5781A7FAA2"><enum>(i)</enum><text>the
			 location and time of discharges from cruise vessels;</text>
						</clause><clause id="IDD54A4E8F84304CAFA7C0DAD8C58E3D4E"><enum>(ii)</enum><text>the source,
			 content, and volume of the discharges; and</text>
						</clause><clause id="ID12D1470F6F9D4CE79FC715E2FAA5F791"><enum>(iii)</enum><text>the state of
			 components relating to pollution control at the time of the discharges,
			 including whether the components are operating correctly; and</text>
						</clause></subparagraph><subparagraph id="ID9DEBB052C8E94976B3AA8DBF50189DA3"><enum>(B)</enum><text>shall be tested
			 on not less than 10 percent of all cruise vessels operating in the territorial
			 sea of the United States, including large and small vessels.</text>
					</subparagraph></paragraph><paragraph id="ID946E3EF4FAE541938962CBEB65C2669E"><enum>(3)</enum><header>Participation
			 of industry</header>
					<subparagraph id="IDFDA7FE93FAE64909AB3E71F9F2EE3A29"><enum>(A)</enum><header>Competitive
			 selection process</header><text>Industry partners willing to participate in the
			 program may do so through a competitive selection process conducted by the
			 Administrator of the National Oceanic and Atmospheric Administration.</text>
					</subparagraph><subparagraph id="ID39FC2CD12AE0424DA0BEA350D15BEED3"><enum>(B)</enum><header>Contribution</header><text>A
			 selected industry partner shall contribute not less than 20 percent of the cost
			 of the project in which the industry partner participates.</text>
					</subparagraph></paragraph><paragraph commented="no" id="idE7C15047897C43469E724004EABE282D"><enum>(4)</enum><header>Adaptive
			 management</header><text>The program established and carried out by the
			 Administrator of the National Oceanic and Atmospheric Administration pursuant
			 to paragraph (1) shall also include—</text>
					<subparagraph commented="no" id="id9BC201AF230F44FC8F02E0EB0928AAD4"><enum>(A)</enum><text>a method for
			 collecting and reviewing data related to the efficiency and operation of the
			 program; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36868332998E494D916364B476517268"><enum>(B)</enum><text>periodic
			 revisions to the program based on the data collected under subparagraph
			 (A).</text>
					</subparagraph></paragraph><paragraph id="IDA3DD0BC5AF644357A2D725CC27700F05"><enum>(5)</enum><header>Report</header><text>Not
			 later than 3 years after the date of the enactment of this Act, the
			 Administrator of the National Oceanic and Atmospheric Administration shall
			 submit to Congress a report describing—</text>
					<subparagraph id="idA23F67E43BDF440E83099789C586B177"><enum>(A)</enum><text>the results of
			 the program;</text>
					</subparagraph><subparagraph id="id3B9561917359480EA58CCD483FA6A3F6"><enum>(B)</enum><text>recommendations
			 for continuing the program; and</text>
					</subparagraph><subparagraph id="id23677476B28E408288DB55759B13B07D"><enum>(C)</enum><text>other
			 recommendations for improving the program.</text>
					</subparagraph></paragraph></subsection></section><section id="IDAD4B54F9ED804AE18D986914389302BF"><enum>8.</enum><header>Employee
			 protection</header>
			<subsection id="ID11D24C289460456897DB70ED92E01C71"><enum>(a)</enum><header>Prohibition of
			 discrimination against persons filing, instituting, or testifying in
			 proceedings under this Act</header><text>No person shall terminate the
			 employment of, or in any other way discriminate against (or cause the
			 termination of employment of or discrimination against), any employee or any
			 authorized representative of employees by reason of the fact that the employee
			 or representative—</text>
				<paragraph id="IDDB4B23D1CC444927A0D72C9BF23621FA"><enum>(1)</enum><text>has filed,
			 instituted, or caused to be filed or instituted any proceeding under this Act;
			 or</text>
				</paragraph><paragraph id="ID53FA3AA4621C460397323902B99F6CD0"><enum>(2)</enum><text>has testified or
			 is about to testify in any proceeding resulting from the administration or
			 enforcement of the provisions of this Act.</text>
				</paragraph></subsection><subsection id="IDBD9C8B81747C495EAFEF771263887BA1"><enum>(b)</enum><header>Application for
			 review; investigation; hearings; review</header>
				<paragraph id="IDCEE634042A4E4EF5874A1072A2120351"><enum>(1)</enum><header>In
			 general</header><text>An employee or a representative of an employee who
			 believes that the termination of the employment of the employee has occurred,
			 or that the employee has been discriminated against, as a result of the actions
			 of any person in violation of subsection (a) may, not later than 30 days after
			 the date on which the alleged violation occurred, apply to the Secretary of
			 Labor for a review of the alleged termination of employment or
			 discrimination.</text>
				</paragraph><paragraph id="ID3369B789A51E468CAB2E90AEE64439E1"><enum>(2)</enum><header>Application</header><text>A
			 copy of an application for review filed under paragraph (1) shall be sent to
			 the respondent.</text>
				</paragraph><paragraph id="ID8C6252A74F3E41DBB613D19D5C1B2ED9"><enum>(3)</enum><header>Investigation</header>
					<subparagraph id="ID4E295C1C1FE74E12A1A02649947B4E85"><enum>(A)</enum><header>In
			 general</header><text>On receipt of an application for review under paragraph
			 (1), the Secretary of Labor shall carry out an investigation of the alleged
			 violation.</text>
					</subparagraph><subparagraph id="IDE453B109784B49679C905D673A659357"><enum>(B)</enum><header>Requirements</header><text>In
			 carrying out this subsection, the Secretary of Labor shall—</text>
						<clause id="ID29CBBF66E83B475DBF0BFFF19BA4EFF9"><enum>(i)</enum><text>provide an
			 opportunity for a public hearing at the request of any party to the review to
			 enable the parties to present information relating to the alleged
			 violation;</text>
						</clause><clause id="ID8DE4691CED8542629B241493562604D0"><enum>(ii)</enum><text>ensure that, at
			 least 5 days before the date of the hearing, each party to the hearing is
			 provided written notice of the time and place of the hearing; and</text>
						</clause><clause id="ID10F2DB9CF3DF4F60A6C5FB084FAFBA1B"><enum>(iii)</enum><text>ensure that the
			 hearing is on the record and subject to section 554 of title 5, United States
			 Code.</text>
						</clause></subparagraph><subparagraph id="ID263878B0A5994A3B96165C3D346103FF"><enum>(C)</enum><header>Findings of
			 Secretary</header><text>On completion of an investigation under this paragraph,
			 the Secretary of Labor shall—</text>
						<clause id="IDFC4BD987F8054708BBFEDDACB44937E9"><enum>(i)</enum><text>make findings of
			 fact;</text>
						</clause><clause id="ID50A1231345D742E6B84A539552E409F7"><enum>(ii)</enum><text>if
			 the Secretary of Labor determines that a violation did occur, issue a decision,
			 incorporating an order and the findings, requiring the person that committed
			 the violation to take such action as is necessary to abate the violation,
			 including the rehiring or reinstatement, with compensation, of an employee to
			 the former position of the employee; and</text>
						</clause><clause id="IDE0B44828C0E54065B2211BEF0388560C"><enum>(iii)</enum><text>if the
			 Secretary of Labor determines that there was no violation, issue an order
			 denying the application.</text>
						</clause></subparagraph><subparagraph id="IDD300D9DA3A10427D8E6095E454AEE128"><enum>(D)</enum><header>Order</header><text>An
			 order issued by the Secretary of Labor under subparagraph (C) shall be subject
			 to judicial review in the same manner as orders and decisions of the
			 Administrator are subject to judicial review under this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="ID1A883F267A7C47A0BCFE8971265F6359"><enum>(c)</enum><header>Costs and
			 expenses</header><text>In any case in which an order is issued under this
			 section to abate a violation, at the request of the applicant, a sum equal to
			 the aggregate amount of all costs and expenses (including attorneys' fees), as
			 determined by the Secretary of Labor, to have been reasonably incurred by the
			 applicant for, or in connection with, the institution and prosecution of the
			 proceedings, shall be assessed against the person committing the
			 violation.</text>
			</subsection><subsection id="IDA14C6F0B9FD74BDDBABE574AE5F3D6A2"><enum>(d)</enum><header>Deliberate
			 violations by employees acting without direction from employer or
			 agent</header><text>This section shall not apply to any employee who, without
			 direction from the employer of the employee (or agent of the employer),
			 deliberately violates any provision of this Act.</text>
			</subsection></section><section id="ID1F3EF16A5834495BA417052253AA8C2D"><enum>9.</enum><header>Judicial
			 review</header>
			<subsection id="ID25961C0438E54101AE8069FA8781EAEF"><enum>(a)</enum><header>Review of
			 actions by Administrator or Commandant; selection of court; fees</header>
				<paragraph id="IDAF4E6F1D126746F1B20993AE231AD2E1"><enum>(1)</enum><header>Review of
			 actions</header>
					<subparagraph id="IDA0CC4D23D1444049AB363474975540DF"><enum>(A)</enum><header>In
			 general</header><text>Any interested person may petition for a review, in the
			 United States court of appeals for the circuit in which the person resides or
			 transacts business directly affected by the action of which review is
			 requested—</text>
						<clause id="IDFF5256979FB24E55AF75F16B05DCC112"><enum>(i)</enum><text>of
			 an action of the Administrator in promulgating any effluent limit under section
			 5; or</text>
						</clause><clause id="IDC347755D23254954990B3AEEC5CA5E27"><enum>(ii)</enum><text>of
			 an action of the Commandant or the Administrator in carrying out an inspection,
			 sampling, or testing under section 7.</text>
						</clause></subparagraph><subparagraph id="IDE06E23B4BB134104B9E7622955DEE52D"><enum>(B)</enum><header>Deadline for
			 review</header><text>A petition for review under subparagraph (A) shall be
			 made—</text>
						<clause id="IDF13799DD597E452BB6A85C8CA9FC94CB"><enum>(i)</enum><text>not
			 later than 120 days after the date of promulgation of the limit or standard
			 with respect to which the review is sought; or</text>
						</clause><clause id="ID1D52852E6C3C4EA89D0F59C6DD12F51C"><enum>(ii)</enum><text>if
			 the petition for review is based solely on grounds that arose after the date
			 described in clause (i), as soon as practicable after that date.</text>
						</clause></subparagraph></paragraph><paragraph id="ID8F69F89F4C574B85BDC72404307EDAB4"><enum>(2)</enum><header>Civil and
			 criminal enforcement proceedings</header><text>An action of the Commandant or
			 Administrator with respect to which review could have been obtained under
			 paragraph (1) shall not be subject to judicial review in any civil or criminal
			 proceeding for enforcement of such action.</text>
				</paragraph><paragraph id="IDBE910968D4AD4FE5B658D226D71E0D79"><enum>(3)</enum><header>Award of
			 fees</header><text>In any judicial proceeding under this subsection, a court
			 may award costs of litigation (including reasonable attorneys' and expert
			 witness fees) to any prevailing or substantially prevailing party in any case
			 in which the court determines such an award to be appropriate.</text>
				</paragraph></subsection><subsection id="IDEDB2E81C86ED401197E82F70C4CBC021"><enum>(b)</enum><header>Additional
			 evidence</header>
				<paragraph id="ID29B1FC08D4704A91825EDA2EFDCC07CA"><enum>(1)</enum><header>In
			 general</header><text>In any judicial proceeding instituted under subsection
			 (a) in which review is sought of a determination under this Act required to be
			 made on the record after notice and opportunity for hearing, if any party
			 applies to the court for leave to introduce additional evidence and
			 demonstrates to the satisfaction of the court that the additional evidence is
			 material and that there were reasonable grounds for the failure to introduce
			 the evidence in the proceeding before the Commandant or Administrator, the
			 court may order the additional evidence (and evidence in rebuttal of the
			 additional evidence) to be taken before the Commandant or Administrator, in
			 such manner and on such terms and conditions as the court determines to be
			 appropriate.</text>
				</paragraph><paragraph id="ID02EDCD17E6EA4BC29A529A7A8108B09D"><enum>(2)</enum><header>Modification of
			 findings</header><text>On admission of additional evidence under paragraph (1),
			 the Commandant or Administrator—</text>
					<subparagraph id="IDE73481600BC043A6AD799E2FABA81352"><enum>(A)</enum><text>may modify
			 findings of fact of the Commandant or Administrator, as the case may be,
			 relating to a judicial proceeding, or make new findings of fact, by reason of
			 the additional evidence; and</text>
					</subparagraph><subparagraph id="IDB13D3C6E36FF4835B699B9867A14A3C5"><enum>(B)</enum><text>shall file with
			 the return of the additional evidence any modified or new findings, and any
			 related recommendations, for the modification or setting aside of any original
			 determinations of the Commandant or Administrator.</text>
					</subparagraph></paragraph></subsection></section><section id="ID4683777077774B4E980B7F48086FC9CA"><enum>10.</enum><header>Enforcement</header>
			<subsection id="IDC93BB8CF0A5144E4A56BB3CFFA7AD53E"><enum>(a)</enum><header>In
			 general</header><text>Any person that violates a provision of section 4 or any
			 regulation promulgated under this Act may be assessed—</text>
				<paragraph id="ID532ABD6F4BB741FF80C5BE53079A994B"><enum>(1)</enum><text>a class I or
			 class II civil penalty described in subsection (b); or</text>
				</paragraph><paragraph id="IDC967BD44018B40229C21E788C7832002"><enum>(2)</enum><text>a civil penalty
			 in a civil action under subsection (c).</text>
				</paragraph></subsection><subsection id="ID297160C7A9534C94AB98E6B95756E1EE"><enum>(b)</enum><header>Amount of
			 administrative penalty</header>
				<paragraph id="ID075E1B494EF34BC08BC30C268371F028"><enum>(1)</enum><header>Class
			 i</header><text>The amount of a class I civil penalty under subsection (a)(1)
			 may not exceed—</text>
					<subparagraph id="IDD3852258414B420EAB05E82F46457A18"><enum>(A)</enum><text>$10,000 per
			 violation; or</text>
					</subparagraph><subparagraph id="IDF5C29E6CE32145C09547B54D9E10846A"><enum>(B)</enum><text>$25,000 in the
			 aggregate, in the case of multiple violations.</text>
					</subparagraph></paragraph><paragraph id="IDBF23CDE5D5A6400AB8E80714D12D090E"><enum>(2)</enum><header>Class
			 ii</header><text>The amount of a class II civil penalty under subsection (a)(1)
			 may not exceed—</text>
					<subparagraph id="ID21891523EF3F4FDCA052820A8814C73B"><enum>(A)</enum><text>$10,000 per day
			 for each day during which the violation continues; or</text>
					</subparagraph><subparagraph id="IDF9F63EF1442D42CE86D75E56C40B9441"><enum>(B)</enum><text>$125,000 in the
			 aggregate, in the case of multiple violations.</text>
					</subparagraph></paragraph><paragraph id="ID9517E819D7364E0F953F27D4E7E00686"><enum>(3)</enum><header>Separate
			 violations</header><text>Each day on which a violation continues shall
			 constitute a separate violation.</text>
				</paragraph><paragraph id="ID4A274CE3DB194E6AB6E5A6D2F14EE24F"><enum>(4)</enum><header>Determination
			 of amount</header><text>In determining the amount of a civil penalty under
			 subsection (a)(1), the Commandant or the court, as appropriate, shall
			 consider—</text>
					<subparagraph id="IDF0278C64826D4D5881E90105C527FE0E"><enum>(A)</enum><text>the seriousness
			 of the violation;</text>
					</subparagraph><subparagraph id="IDE94358C1D1644054AF6C7B969BCDD812"><enum>(B)</enum><text>any economic
			 benefit resulting from the violation;</text>
					</subparagraph><subparagraph id="ID0F8CB6C871B74218825B4B729E2BD625"><enum>(C)</enum><text>any history of
			 violations;</text>
					</subparagraph><subparagraph id="ID1E86398074BF49ABA84474FF03CD7DC3"><enum>(D)</enum><text>any good faith
			 efforts to comply with the applicable requirements;</text>
					</subparagraph><subparagraph id="IDAE13364F524F46B184E39650DF4065AB"><enum>(E)</enum><text>the economic
			 impact of the penalty on the violator; and</text>
					</subparagraph><subparagraph id="ID676EBEEEFC2549E68C482C9EAF8B5328"><enum>(F)</enum><text>such other
			 matters as justice may require.</text>
					</subparagraph></paragraph><paragraph id="ID396AD77295AA4A978D5DDE1AD1FBBAD9"><enum>(5)</enum><header>Procedure for
			 class i civil penalty</header>
					<subparagraph id="ID7C03D6C0E5E54A8C9C044AC6BBE15FEF"><enum>(A)</enum><header>In
			 general</header><text>Before assessing a civil penalty under this subsection,
			 the Commandant shall provide to the person to be assessed the penalty—</text>
						<clause id="ID656275D28C9F4873B6867516E7E1F877"><enum>(i)</enum><text>written notice of
			 the proposal of the Commandant to assess the penalty; and</text>
						</clause><clause id="ID6D94F17AD95F449EBC5B359A8A13C4B3"><enum>(ii)</enum><text>the opportunity
			 to request, not later than 30 days after the date on which the notice is
			 received by the person, a hearing on the proposed penalty.</text>
						</clause></subparagraph><subparagraph id="ID8A78D5D20C3149D68040E8A786EE7AEB"><enum>(B)</enum><header>Hearing</header><text>A
			 hearing described in subparagraph (A)(ii)—</text>
						<clause id="ID994D8CF8DC1F4F55BAF23E68690E3F46"><enum>(i)</enum><text>shall not be
			 subject to section 554 or 556 of title 5, United States Code; but</text>
						</clause><clause id="ID5A335D57F1AD4B67B774CD71FC21BD44"><enum>(ii)</enum><text>shall provide a
			 reasonable opportunity to be heard and to present evidence.</text>
						</clause></subparagraph></paragraph><paragraph id="ID1BA4A53323F64D09AC15FB8B5B5FD98C"><enum>(6)</enum><header>Procedure for
			 class ii civil penalty</header>
					<subparagraph id="IDE1CB3B5D1F25438E8738F30CA2C90870"><enum>(A)</enum><header>In
			 general</header><text>Except as otherwise provided in this subsection, a class
			 II civil penalty shall be assessed and collected in the same manner, and
			 subject to the same provisions, as in the case of civil penalties assessed and
			 collected after notice and an opportunity for a hearing on the record in
			 accordance with section 554 of title 5, United States Code.</text>
					</subparagraph><subparagraph id="IDE9FFD9E24A1C47F2912472CEBF7EAD1A"><enum>(B)</enum><header>Rules</header><text>The
			 Commandant may promulgate rules for discovery procedures for hearings under
			 this subsection.</text>
					</subparagraph></paragraph><paragraph id="ID41F20C9D332D4F169A8C3C9C93C54C5F"><enum>(7)</enum><header>Rights of
			 interested persons</header>
					<subparagraph id="ID5DF0DF05C8284467B69B86115E9B1A77"><enum>(A)</enum><header>Public
			 notice</header><text>Before issuing an order assessing a class II civil penalty
			 under this subsection, the Commandant shall provide public notice of, and
			 reasonable opportunity to comment on, the proposed issuance of each
			 order.</text>
					</subparagraph><subparagraph id="IDE4812D13B8DE4650A870EE16DEAC357A"><enum>(B)</enum><header>Presentation of
			 evidence</header>
						<clause id="ID4B47315D64EC45938A36DA909527B873"><enum>(i)</enum><header>In
			 general</header><text>Any person that comments on a proposed assessment of a
			 class II civil penalty under this subsection shall be given notice of—</text>
							<subclause id="ID62CCC18293C647ADB41AFF4FA72CD587"><enum>(I)</enum><text>any hearing held
			 under this subsection relating to such assessment; and</text>
							</subclause><subclause id="IDD1011B3B413D42F0B804841711633239"><enum>(II)</enum><text>any order
			 assessing the penalty.</text>
							</subclause></clause><clause id="ID935D599581A64043858B840070028B3F"><enum>(ii)</enum><header>Hearing</header><text>In
			 any hearing described in clause (i)(I), a person described in clause (i) shall
			 have a reasonable opportunity to be heard and to present evidence.</text>
						</clause></subparagraph><subparagraph id="ID048C4F22FB5944AAAC93E46B4F3B6501"><enum>(C)</enum><header>Rights of
			 interested persons to a hearing</header>
						<clause id="IDF50F9079CD7B470AA68E6D01456889BB"><enum>(i)</enum><header>In
			 general</header><text>If no hearing is held under subparagraph (B) before the
			 date of issuance of an order assessing a class II civil penalty under this
			 subsection, any person that commented on the proposed assessment may, not later
			 than 30 days after the date of issuance of the order, petition the
			 Commandant—</text>
							<subclause id="IDF38697C3973D4852BFEBE2E7D8680477"><enum>(I)</enum><text>to set aside the
			 order; and</text>
							</subclause><subclause id="ID1F2216260599494CA90B542330038B88"><enum>(II)</enum><text>to provide a
			 hearing on the penalty.</text>
							</subclause></clause><clause id="IDDAD86D995FFC493BB4B244FE631CCBF8"><enum>(ii)</enum><header>New
			 evidence</header><text>If any evidence presented by a petitioner in support of
			 the petition under clause (i) is material and was not considered in the
			 issuance of the order, as determined by the Commandant, the Commandant shall
			 immediately—</text>
							<subclause id="ID7AA8C52775A34EBC96BBDB9C32A37ABC"><enum>(I)</enum><text>set aside the
			 order; and</text>
							</subclause><subclause id="IDFB10C39BE6304E778D10B55B9457517C"><enum>(II)</enum><text>provide a
			 hearing in accordance with subparagraph (B)(ii).</text>
							</subclause></clause><clause id="ID675AEAD76EFE412F8390BF9500897B99"><enum>(iii)</enum><header>Denial of
			 hearing</header><text>If the Commandant denies a hearing under this
			 subparagraph, the Commandant shall provide to the petitioner, and publish in
			 the Federal Register, notice of and the reasons for the denial.</text>
						</clause></subparagraph></paragraph><paragraph id="ID7FD9BD0BD8044C58B49DA9D52EA9E8EE"><enum>(8)</enum><header>Finality of
			 order</header>
					<subparagraph id="IDC6EF1D836E034C909DB156F79A78C36A"><enum>(A)</enum><header>In
			 general</header><text>An order assessing a class II civil penalty under this
			 subsection shall become final on the date that is 30 days after the date of
			 issuance of the order unless, before that date—</text>
						<clause id="IDB1ACC86908874034ABCB9D90340245EC"><enum>(i)</enum><text>a
			 petition for judicial review is filed under paragraph (10); or</text>
						</clause><clause id="ID4CF77BC4A90C4D97A96AE26F1F34B5E3"><enum>(ii)</enum><text>a
			 hearing is requested under paragraph (7)(C).</text>
						</clause></subparagraph><subparagraph id="ID3CFB8D45A16D41019C58585C4B55824C"><enum>(B)</enum><header>Denial of
			 hearing</header><text>If a hearing is requested under paragraph (7)(C) and
			 subsequently denied, an order assessing a class II civil penalty under this
			 subsection shall become final on the date that is 30 days after the date of the
			 denial.</text>
					</subparagraph></paragraph><paragraph id="IDA3C6AA6DB5AD40EB904B3953B79D2001"><enum>(9)</enum><header>Effect of
			 action on compliance</header><text>No action by the Commandant under this
			 subsection shall affect the obligation of any person to comply with any
			 provision of this Act.</text>
				</paragraph><paragraph id="ID96A423822CB24C40A959ED7B44C63211"><enum>(10)</enum><header>Judicial
			 review</header>
					<subparagraph id="ID6C776F2621A24107A84DF2CBC3C83D9F"><enum>(A)</enum><header>In
			 general</header><text>Any person against which a civil penalty is assessed
			 under this subsection, or that commented on the proposed assessment of such a
			 penalty in accordance with paragraph (7), may obtain review of the assessment
			 in a court described in subparagraph (B) by—</text>
						<clause id="ID40AEC8FE483343A6ACACDB3F9116BBFC"><enum>(i)</enum><text>filing a notice
			 of appeal with the court within the 30-day period beginning on the date on
			 which the civil penalty order is issued; and</text>
						</clause><clause id="IDBADD372B2951466AB0AB0076E25857A2"><enum>(ii)</enum><text>simultaneously
			 sending a copy of the notice by certified mail to the Commandant and the
			 Attorney General.</text>
						</clause></subparagraph><subparagraph id="ID69B4AACD8F364B909B798FA684AB5022"><enum>(B)</enum><header>Courts of
			 jurisdiction</header><text>Review of an assessment under subparagraph (A) may
			 be obtained by a person—</text>
						<clause id="ID65629D487A8C4BF18A3195EB530C1F7E"><enum>(i)</enum><text>in
			 the case of assessment of a class I civil penalty, in—</text>
							<subclause id="IDD506FB3C5897443D821AFA022A0F810E"><enum>(I)</enum><text>the United States
			 District Court for the District of Columbia; or</text>
							</subclause><subclause id="ID6B913C74A05B486F9AC650A3CDADF6EB"><enum>(II)</enum><text>the district
			 court of the United States for the district in which the violation occurred;
			 or</text>
							</subclause></clause><clause id="ID1CA2E9A6DDBE41518CFC3DF55F021A27"><enum>(ii)</enum><text>in
			 the case of assessment of a class II civil penalty, in—</text>
							<subclause id="ID7AE134CFAAE644EBB28CDBC575B2703A"><enum>(I)</enum><text>the United States
			 Court of Appeals for the District of Columbia Circuit; or</text>
							</subclause><subclause id="IDE15144468BFE4959937BDC807BFB3735"><enum>(II)</enum><text>the United
			 States court of appeals for any other circuit in which the person resides or
			 transacts business.</text>
							</subclause></clause></subparagraph><subparagraph id="ID54947479BD85412DB00CE035F4D55647"><enum>(C)</enum><header>Copy of
			 record</header><text>On receipt of notice under subparagraph (A)(ii), the
			 Commandant shall promptly file with the appropriate court a certified copy of
			 the record on which the order assessing a civil penalty that is the subject of
			 the review was issued.</text>
					</subparagraph><subparagraph id="ID6C6968F31A33413C920201D7D217B9AB"><enum>(D)</enum><header>Substantial
			 evidence</header><text>A court with jurisdiction over a review under this
			 paragraph—</text>
						<clause id="ID9D04290368F74AB68A20EA49C7BBEB87"><enum>(i)</enum><text>shall not set
			 aside or remand an order described in subparagraph (C) unless—</text>
							<subclause id="IDE30954237AAC4461AA4D68E16C907745"><enum>(I)</enum><text>there is not
			 substantial evidence in the record, taken as a whole, to support the finding of
			 a violation; or</text>
							</subclause><subclause id="IDAD6507D0EAAE4971A88F398401F466E3"><enum>(II)</enum><text>the assessment
			 by the Commandant of the civil penalty constitutes an abuse of discretion;
			 and</text>
							</subclause></clause><clause id="IDC29EF87C6E68466CB17992CBDFE59EA0"><enum>(ii)</enum><text>shall not impose
			 additional civil penalties for the same violation unless the assessment by the
			 Commandant of the civil penalty constitutes an abuse of discretion.</text>
						</clause></subparagraph></paragraph><paragraph id="IDB513D76271B64180A916C1327C08DDE2"><enum>(11)</enum><header>Collection</header>
					<subparagraph id="ID7C3B34287DF8449AB8CB195585675CA7"><enum>(A)</enum><header>In
			 general</header><text>If any person fails to pay an assessment of a civil
			 penalty after the assessment has become final, or after a court in a proceeding
			 under paragraph (10) has entered a final judgment in favor of the Commandant,
			 the Commandant shall request the Attorney General to bring a civil action in an
			 appropriate district court to recover—</text>
						<clause id="IDFB7D06A146EE4EFE981A5C1BC8FB285A"><enum>(i)</enum><text>the
			 amount assessed; and</text>
						</clause><clause id="ID60953375260D4695BF75C8DE3A39D7F2"><enum>(ii)</enum><text>interest that
			 has accrued on the amount assessed, as calculated at currently prevailing rates
			 beginning on the date of the final order or the date of the final judgment, as
			 the case may be.</text>
						</clause></subparagraph><subparagraph id="ID0F58F1EE677E4D93A71A46F0B1D4E9F7"><enum>(B)</enum><header>Nonreviewability</header><text>In
			 an action to recover an assessed civil penalty under subparagraph (A), the
			 validity, amount, and appropriateness of the civil penalty shall not be subject
			 to judicial review.</text>
					</subparagraph><subparagraph id="ID01E95DF163F045FEA78A50EE2C218273"><enum>(C)</enum><header>Failure to pay
			 penalty</header><text>Any person that fails to pay, on a timely basis, the
			 amount of an assessment of a civil penalty under subparagraph (A) shall be
			 required to pay, in addition to the amount of the civil penalty and accrued
			 interest—</text>
						<clause id="ID2E4AC5876F4A45B6AF402ED59C310F14"><enum>(i)</enum><text>attorneys' fees
			 and other costs for collection proceedings; and</text>
						</clause><clause id="ID7F02DF3259274103B64B31090A1D2547"><enum>(ii)</enum><text>for each quarter
			 during which the failure to pay persists, a quarterly nonpayment penalty in an
			 amount equal to 20 percent of the aggregate amount of the assessed civil
			 penalties and nonpayment penalties of the person that are unpaid as of the
			 beginning of the quarter.</text>
						</clause></subparagraph></paragraph><paragraph id="IDC1DDF0B743794B0E9A312E6CB98A56C4"><enum>(12)</enum><header>Subpoenas</header>
					<subparagraph id="IDA4B5345C1E48451FB3F2C09FE0A9B612"><enum>(A)</enum><header>In
			 general</header><text>The Commandant may issue subpoenas for the attendance and
			 testimony of witnesses and the production of relevant papers, books, or
			 documents in connection with hearings under this subsection.</text>
					</subparagraph><subparagraph id="ID0C829DF933D44200A613B3BC3F5A0860"><enum>(B)</enum><header>Refusal to
			 obey</header><text>In case of contumacy or refusal to obey a subpoena issued
			 under this paragraph and served on any person—</text>
						<clause id="ID0D7B6E6C990C493392144F874487C114"><enum>(i)</enum><text>the
			 district court of the United States for any district in which the person is
			 found, resides, or transacts business, on application by the United States and
			 after notice to the person, shall have jurisdiction to issue an order requiring
			 the person to appear and give testimony before the Commandant or to appear and
			 produce documents before the Commandant; and</text>
						</clause><clause id="ID756849A5B0EB44E7A098F7EA92FB86A1"><enum>(ii)</enum><text>any failure to
			 obey such an order of the court may be punished by the court as a contempt of
			 the court.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID08DFE43B428A45018F400224DF64DCB9"><enum>(c)</enum><header>Civil
			 action</header><text>The Commandant may commence, in the district court of the
			 United States for the district in which the defendant is located, resides, or
			 transacts business, a civil action to impose a civil penalty under this
			 subsection in an amount not to exceed $25,000 for each day of violation.</text>
			</subsection><subsection id="ID9B8633332DBF423C9AB0AE0620649FB9"><enum>(d)</enum><header>Criminal
			 penalties</header>
				<paragraph id="ID888219EFC358445A8525E76337AE9CCB"><enum>(1)</enum><header>Negligent
			 violations</header><text>A person that negligently violates section 4 or any
			 regulation promulgated under this Act commits a Class A misdemeanor under title
			 18, United States Code.</text>
				</paragraph><paragraph id="ID6CA363391F194DDBBAC0947A7C266E83"><enum>(2)</enum><header>Knowing
			 violations</header><text>Any person that knowingly violates section 4 or any
			 regulation promulgated under this Act commits a Class D felony under title 18,
			 United States Code.</text>
				</paragraph><paragraph id="ID58B60F9C36904CEDBCC7E4385CCE120A"><enum>(3)</enum><header>False
			 statements</header><text>Any person that knowingly makes any false statement,
			 representation, or certification in any record, report, or other document filed
			 or required to be maintained under this Act or any regulation promulgated under
			 this Act, or that falsifies, tampers with, or knowingly renders inaccurate any
			 testing or monitoring device or method required to be maintained under this Act
			 or any regulation promulgated under this Act, commits a Class D felony under
			 title 18, United States Code.</text>
				</paragraph></subsection><subsection id="IDA257CEBB3EC149F2BCA9F33937129189"><enum>(e)</enum><header>Rewards</header>
				<paragraph id="ID7A6996F874CC4D9AA05FF700DC11BB69"><enum>(1)</enum><header>Payments to
			 individuals</header>
					<subparagraph id="IDDE0D4AA215DB4C6C9C83B0EC2603BCA7"><enum>(A)</enum><header>In
			 general</header><text>The Commandant or the court, as the case may be, may
			 order payment, from a civil penalty or criminal fine collected under this
			 section, of an amount not to exceed <fraction>1/2</fraction> of the civil
			 penalty or fine, to any individual who furnishes information that leads to the
			 payment of the civil penalty or criminal fine.</text>
					</subparagraph><subparagraph id="ID4C32B70F0E4246C5821B1EDDF026627F"><enum>(B)</enum><header>Multiple
			 individuals</header><text>If 2 or more individuals provide information
			 described in subparagraph (A), the amount available for payment as a reward
			 shall be divided equitably among the individuals.</text>
					</subparagraph><subparagraph id="ID39ECD553EF17434288076EB20526839D"><enum>(C)</enum><header>Ineligible
			 individuals</header><text>No officer or employee of the United States, a State,
			 or an Indian tribe who furnishes information or renders service in the
			 performance of the official duties of the officer or employee shall be eligible
			 for a reward payment under this subsection.</text>
					</subparagraph></paragraph><paragraph id="ID3AF9FAED8DE74D28B301CA28B7D67F4F"><enum>(2)</enum><header>Payments to
			 states or indian tribes</header><text>The Commandant or the court, as the case
			 may be, may order payment, from a civil penalty or criminal fine collected
			 under this section, to a State or Indian tribe providing information or
			 investigative assistance that leads to payment of the penalty or fine, of an
			 amount that reflects the level of information or investigative assistance
			 provided.</text>
				</paragraph><paragraph id="IDA2F5CCEA424944A7BA4CFA626523CC3D"><enum>(3)</enum><header>Payments
			 divided among states, indian tribes, and individuals</header><text>In a case in
			 which a State or Indian tribe and an individual under paragraph (1) are
			 eligible to receive a reward payment under this subsection, the Commandant or
			 the court shall divide the amount available for the reward equitably among
			 those recipients.</text>
				</paragraph></subsection><subsection id="ID16CD62585E4745F98251E608E1123987"><enum>(f)</enum><header>Liability in
			 rem</header><text>A cruise vessel operated in violation of this Act or any
			 regulation promulgated under this Act—</text>
				<paragraph id="ID820CEF152E014BD4B7112C14C308B97A"><enum>(1)</enum><text>shall be liable
			 in rem for any civil penalty or criminal fine imposed under this section;
			 and</text>
				</paragraph><paragraph id="ID68E4E288DF65487A98F0BDA61F9C3B37"><enum>(2)</enum><text>may be subject to
			 a proceeding instituted in the district court of the United States for any
			 district in which the cruise vessel may be found.</text>
				</paragraph></subsection><subsection id="IDA06AB5FFED3648BF96245EA7179E2D79"><enum>(g)</enum><header>Compliance
			 orders</header>
				<paragraph id="IDB3B4E669D2DF445198F26F6BCC10A835"><enum>(1)</enum><header>In
			 general</header><text>If the Commandant determines that any person is in
			 violation of section 4 or any regulation promulgated under this Act, the
			 Commandant shall—</text>
					<subparagraph id="IDB51F5B8BD72F4295B9F451B9792C625A"><enum>(A)</enum><text>issue an order
			 requiring the person to comply with such section or requirement; or</text>
					</subparagraph><subparagraph id="IDE2293E7C2B5F40ED9DAA31BB493A6452"><enum>(B)</enum><text>bring a civil
			 action in accordance with subsection (c).</text>
					</subparagraph></paragraph><paragraph id="ID2EF9B1A8ACE84910B51A8FBCCEC5126B"><enum>(2)</enum><header>Copies of
			 order; service</header>
					<subparagraph id="IDDAF6F0B73A234D119392CD842642D77E"><enum>(A)</enum><header>Corporate
			 orders</header><text>In any case in which an order under this subsection is
			 issued to a corporation, a copy of the order shall be served on any appropriate
			 corporate officer.</text>
					</subparagraph><subparagraph id="ID858045E226384481A477748A96DB8B7D"><enum>(B)</enum><header>Method of
			 service; specifications</header><text>An order issued under this subsection
			 shall—</text>
						<clause id="IDC2846D9CD36543D8B7798E086DC26DE7"><enum>(i)</enum><text>be
			 by personal service;</text>
						</clause><clause id="IDAA5014C2E4E14F70AA267B03A4CF1559"><enum>(ii)</enum><text>state with
			 reasonable specificity the nature of the violation for which the order was
			 issued; and</text>
						</clause><clause id="ID3C09194CAB9B4C2285B230D330FE9237"><enum>(iii)</enum><text>specify a
			 deadline for compliance that is not later than—</text>
							<subclause id="ID72EE4F224F7B41B5BC8A6192FD360BEA"><enum>(I)</enum><text>30 days after the
			 date of issuance of the order, in the case of a violation of an interim
			 compliance schedule or operation and maintenance requirement; or</text>
							</subclause><subclause id="IDECD361CD7CD341ECB0E0CD209CBADD8A"><enum>(II)</enum><text>such date as the
			 Commandant, taking into account the seriousness of the violation and any good
			 faith efforts to comply with applicable requirements, determines to be
			 reasonable, in the case of a violation of a final deadline.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID7462D5C0E76A491793A7CF731D83466D"><enum>(h)</enum><header>Civil
			 actions</header>
				<paragraph id="ID2278DCA3EE50488DBB3DAD95E1B07088"><enum>(1)</enum><header>In
			 general</header><text>The Commandant may commence a civil action for
			 appropriate relief, including a permanent or temporary injunction, for any
			 violation for which the Commandant is authorized to issue a compliance order
			 under this subsection.</text>
				</paragraph><paragraph id="IDFEFB9A6261874C0DBDFBA4F75DEAF9A5"><enum>(2)</enum><header>Court of
			 jurisdiction</header>
					<subparagraph id="ID1DA779E33DB9444F812D59DB8939701C"><enum>(A)</enum><header>In
			 general</header><text>A civil action under this subsection may be brought in
			 the district court of the United States for the district in which the defendant
			 is located, resides, or is doing business.</text>
					</subparagraph><subparagraph id="ID5CFF261C2E5D42A692F86455F0B54546"><enum>(B)</enum><header>Jurisdiction</header><text>A
			 court described in subparagraph (A) shall have jurisdiction to grant injunctive
			 relief to address a violation and require compliance by the defendant.</text>
					</subparagraph></paragraph></subsection></section><section id="ID7352FF8A04724D069C1198467D3F2E60"><enum>11.</enum><header>Citizen
			 suits</header>
			<subsection id="IDF5A8F433E63440ECA9238BDDF0359417"><enum>(a)</enum><header>Authorization</header><text>Except
			 as provided in subsection (c), any citizen may commence a civil action on the
			 citizen's own behalf—</text>
				<paragraph id="ID6DC5966A87214F37B3B495F1BC8D23E5"><enum>(1)</enum><text>against any
			 person (including the United States and any other governmental instrumentality
			 or agency to the extent permitted by the eleventh amendment to the Constitution
			 of the United States) that is alleged to be in violation of—</text>
					<subparagraph id="ID807C9E5EB0764DF087E3F34435E27474"><enum>(A)</enum><text>the conditions
			 imposed by section 4;</text>
					</subparagraph><subparagraph id="IDDE9E85AEEBD74839B0971443D82CE1FF"><enum>(B)</enum><text>an effluent limit
			 or performance standard under this Act; or</text>
					</subparagraph><subparagraph id="IDF63870ADDA4D47A7AE81BA67D00D8C71"><enum>(C)</enum><text>an order issued
			 by the Administrator or Commandant with respect to such a condition, an
			 effluent limit, or a performance standard; or</text>
					</subparagraph></paragraph><paragraph id="ID07F0E088DE6D4DDA8A7D05DA4E17E568"><enum>(2)</enum><text>against the
			 Administrator or Commandant, in a case in which there is alleged a failure by
			 the Administrator or Commandant to perform any nondiscretionary act or duty
			 under this Act.</text>
				</paragraph></subsection><subsection id="ID54D770B1997F42548853C94C0DD4B915"><enum>(b)</enum><header>Jurisdiction</header><text>The
			 district courts of the United States shall have jurisdiction, without regard to
			 the amount in controversy or the citizenship of the parties—</text>
				<paragraph id="ID1DF3D67A7B9C4BAF95FFEE2EAA6270F7"><enum>(1)</enum><text>to enforce a
			 condition, effluent limit, performance standard, or order described in
			 subsection (a)(1);</text>
				</paragraph><paragraph id="ID616794192E1B4554A6A980C7A44DA46D"><enum>(2)</enum><text>to order the
			 Administrator or Commandant to perform a nondiscretionary act or duty described
			 in subsection (a)(2); and</text>
				</paragraph><paragraph id="ID895DA004770F494892705A3889F258CF"><enum>(3)</enum><text>to apply any
			 appropriate civil penalties under section 10(b).</text>
				</paragraph></subsection><subsection id="ID42CC0F77215D4B239A747F2126D390B7"><enum>(c)</enum><header>Notice</header><text>No
			 action may be commenced under this section—</text>
				<paragraph id="ID24C50F73433F46548A394AD33A224472"><enum>(1)</enum><text>before the date
			 that is 60 days after the date on which the plaintiff gives notice of the
			 alleged violation—</text>
					<subparagraph id="IDE295ACEEB67A40FA8BA230718A85D551"><enum>(A)</enum><text>to the
			 Administrator or Commandant; and</text>
					</subparagraph><subparagraph id="ID00A9720BD3294BC7965EC880411AAC30"><enum>(B)</enum><text>to any alleged
			 violator of the condition, effluent limit, performance standard, or order
			 described in subsection (a)(1); or</text>
					</subparagraph></paragraph><paragraph id="ID2312C68B90E74E56A6537FAAE0A83AE7"><enum>(2)</enum><text>if the
			 Administrator or Commandant has commenced and is diligently prosecuting a civil
			 or criminal action on the same matter in a court of the United States (but in
			 any such action, a citizen may intervene as a matter of right).</text>
				</paragraph></subsection><subsection id="ID9D9027CD11B14A0B97492A811BBA4CC7"><enum>(d)</enum><header>Venue</header>
				<paragraph id="IDBC7C2057703F461388B32DFC9532148B"><enum>(1)</enum><header>In
			 general</header><text>Any civil action under this section shall be brought
			 in—</text>
					<subparagraph id="ID5D0C70882D64424B878C3DB436A75E71"><enum>(A)</enum><text>the United States
			 District Court for the District of Columbia; or</text>
					</subparagraph><subparagraph id="IDBF6C2C475486414CBA70C3124A2E55DF"><enum>(B)</enum><text>any other
			 district court of the United States for any judicial district in which a cruise
			 vessel or the owner or operator of a cruise vessel is located.</text>
					</subparagraph></paragraph><paragraph id="ID61A730353B014A0FA17B2527ACBBC5D1"><enum>(2)</enum><header>Intervention</header><text>In
			 a civil action under this section, the Administrator or the Commandant, if not
			 a party, may intervene as a matter of right.</text>
				</paragraph><paragraph id="ID14EE8CF0EE594959BC29D262D03C6601"><enum>(3)</enum><header>Procedures</header>
					<subparagraph id="IDAEDF8210857B40A8B2A72C8E6BD84969"><enum>(A)</enum><header>Service</header><text>In
			 any case in which a civil action is brought under this section in a court of
			 the United States, the plaintiff shall serve a copy of the complaint on—</text>
						<clause id="ID44270F9F209F45C496CB714D0D4B9F5E"><enum>(i)</enum><text>the
			 Attorney General;</text>
						</clause><clause id="ID1FA46ADFD73E4B00BC4A55174DA24E6E"><enum>(ii)</enum><text>the
			 Administrator; and</text>
						</clause><clause id="ID3347F2DEB92243A99BFFA93A8FBCD69E"><enum>(iii)</enum><text>the
			 Commandant.</text>
						</clause></subparagraph><subparagraph id="ID9EE4F01B921C42EB8AE7A368679F64A8"><enum>(B)</enum><header>Consent
			 judgments</header><text>No consent judgment shall be entered in a civil action
			 under this section to which the United States is not a party before the date
			 that is 45 days after the date of receipt of a copy of the proposed consent
			 judgment by—</text>
						<clause id="IDB26E2953E09E4C759C9C7D227EBFF2AE"><enum>(i)</enum><text>the
			 Attorney General;</text>
						</clause><clause id="IDE5FB46912FF74CD19A46E34E112A40DF"><enum>(ii)</enum><text>the
			 Administrator; and</text>
						</clause><clause id="IDAAB4925A56CF4899BF24C6F7FC266F37"><enum>(iii)</enum><text>the
			 Commandant.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDADDB9A5F48CF43958542ED8CAF2284D0"><enum>(e)</enum><header>Litigation
			 costs</header>
				<paragraph id="IDF9D6CA09A3954442A4DC2F634C06759D"><enum>(1)</enum><header>In
			 general</header><text>A court of jurisdiction, in issuing any final order in
			 any civil action brought in accordance with this section, may award costs of
			 litigation (including reasonable attorneys' and expert witness fees) to any
			 prevailing or substantially prevailing party, in any case in which the court
			 determines that such an award is appropriate.</text>
				</paragraph><paragraph id="ID38D1766233F24FEB9FBF0F5CCF9085CC"><enum>(2)</enum><header>Security</header><text>In
			 any civil action under this section, the court of jurisdiction may, if a
			 temporary restraining order or preliminary injunction is sought, require the
			 filing of a bond or equivalent security in accordance with the Federal Rules of
			 Civil Procedure.</text>
				</paragraph></subsection><subsection id="ID54B96630C28840D393925087F271599A"><enum>(f)</enum><header>Statutory or
			 common law rights not restricted</header><text>Nothing in this section
			 restricts the rights of any person (or class of persons) under any statute or
			 common law to seek enforcement or other relief (including relief against the
			 Administrator or Commandant).</text>
			</subsection><subsection id="ID07B33B05E81843DD9B98CE1869D69E8E"><enum>(g)</enum><header>Civil action by
			 State governors</header><text>A Governor of a State may commence a civil action
			 under subsection (a), without regard to the limitation under subsection (c),
			 against the Administrator or Commandant in any case in which there is alleged a
			 failure of the Administrator or Commandant to enforce an effluent limit or
			 performance standard under this Act, the violation of which is causing—</text>
				<paragraph id="IDA092789495E846B2BA94400F1DC65702"><enum>(1)</enum><text>an adverse effect
			 on the public health or welfare in the State; or</text>
				</paragraph><paragraph id="IDB25997E2D8074AA38544738667EF3B42"><enum>(2)</enum><text>a violation of
			 any water quality requirement in the State.</text>
				</paragraph></subsection></section><section id="id4F97DE44EDDC423DA2BB634061B4B3C3"><enum>12.</enum><header>Sense of
			 Congress on ballast water</header><text display-inline="no-display-inline">It
			 is the sense of Congress that action should be taken to enact legislation
			 requiring strong, mandatory standards for ballast water to reduce the threat of
			 aquatic invasive species.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id0202DA5B70EF4A94A56FFF3A28B29065" section-type="subsequent-section"><enum>13.</enum><header>Sense of Congress on
			 air pollution</header><text display-inline="no-display-inline">It is the sense
			 of Congress that action should be taken to enact legislation requiring strong,
			 mandatory standards for air quality with respect to incineration and engine
			 activities of cruise vessels to reduce the level of harmful chemical and
			 particulate air pollutants.</text>
		</section><section id="ID086650F5F57D4A348397A4D5C5D61E64"><enum>14.</enum><header>Funding</header>
			<subsection id="ID06D465C77D00430394FA6258661C961E"><enum>(a)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Commandant and the Administrator such sums as are necessary to carry out this
			 Act for each of fiscal years 2009 through 2013.</text>
			</subsection><subsection id="IDE962AC7F1D82477F8FDCE22156123A24"><enum>(b)</enum><header>Cruise Vessel
			 Pollution Control Fund</header>
				<paragraph id="ID1F22E9E108B042D0A41D407B50F80AE5"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the general fund of the Treasury a separate account to be
			 known as the <quote>Cruise Vessel Pollution Control Fund</quote> (referred to
			 in this section as the <quote>Fund</quote>).</text>
				</paragraph><paragraph id="ID2CB2723D181646EBBBDFB7D80BBE2597"><enum>(2)</enum><header>Amounts</header><text>The
			 Fund shall consist of such amounts as are deposited in the Fund under
			 subsection (c)(5).</text>
				</paragraph><paragraph id="ID7AC40058F19A4C30A666F3841BE5E1B4"><enum>(3)</enum><header>Use of amounts
			 in fund</header><text>The Administrator and the Commandant may use amounts in
			 the Fund, without further appropriation, to carry out this Act.</text>
				</paragraph></subsection><subsection id="ID80DA065B4F794ED288CAFA154A1B9E25"><enum>(c)</enum><header>Fees on cruise
			 vessels</header>
				<paragraph id="ID28F60C782FF841968359C0BF98A16329"><enum>(1)</enum><header>In
			 general</header><text>The Commandant shall establish and collect from each
			 cruise vessel a reasonable and appropriate fee for each paying passenger on a
			 cruise vessel voyage, for use in carrying out this Act.</text>
				</paragraph><paragraph id="ID41580B4FA7F640578E91DC318D2238D3"><enum>(2)</enum><header>Adjustment of
			 fee</header>
					<subparagraph id="IDCAD23EBB179F4918BB042143CA97673A"><enum>(A)</enum><header>In
			 general</header><text>The Commandant shall biennially adjust the amount of the
			 fee established under paragraph (1) to reflect changes in the Consumer Price
			 Index for All Urban Consumers published by the Department of Labor during each
			 2-year period.</text>
					</subparagraph><subparagraph id="IDA799FA18E1DA425291BDF1569E346065"><enum>(B)</enum><header>Rounding</header><text>The
			 Commandant may round the adjustment in subparagraph (A) to the nearest
			 <fraction>1/10</fraction> of a dollar.</text>
					</subparagraph></paragraph><paragraph id="ID0AD2C43D571B475DA5FDD3F5171D740B"><enum>(3)</enum><header>Factors in
			 establishing fees</header>
					<subparagraph id="ID808019D4350F4FADA8C0B0BA08EEA73D"><enum>(A)</enum><header>In
			 general</header><text>In establishing fees under paragraph (1), the Commandant
			 may establish lower levels of fees and the maximum amount of fees for certain
			 classes of cruise vessels based on—</text>
						<clause id="ID7D9682C5EE104D4CAEA6367DAE9CF39B"><enum>(i)</enum><text>size;</text>
						</clause><clause id="ID7E17EF8D1E234DB58C15D01F5677FAE9"><enum>(ii)</enum><text>economic share;
			 and</text>
						</clause><clause id="ID9BD95CB7C06B41BBB785C5546004D6AC"><enum>(iii)</enum><text>such other
			 factors as are determined to be appropriate by the Commandant and
			 Administrator.</text>
						</clause></subparagraph><subparagraph id="IDF0E7CDE9E7954AAB945B0BD0D3DBDB03"><enum>(B)</enum><header>Fee
			 schedules</header><text>Any fee schedule established under paragraph (1),
			 including the level of fees and the maximum amount of fees, shall take into
			 account—</text>
						<clause id="ID4612194A5CAE426AB57FE57CFE2B509A"><enum>(i)</enum><text>cruise vessel
			 routes;</text>
						</clause><clause id="ID11774B4AA9954DB994058C2A9C14F885"><enum>(ii)</enum><text>the frequency of
			 stops at ports of call by cruise vessels; and</text>
						</clause><clause id="IDF79031859144481CBF58036B3DAE39F3"><enum>(iii)</enum><text>other relevant
			 considerations.</text>
						</clause></subparagraph></paragraph><paragraph id="ID764970B03C03438AB1F62D2C28812344"><enum>(4)</enum><header>Collection of
			 fees</header><text>A fee established under paragraph (1) shall be collected by
			 the Commandant from the owner or operator of each cruise vessel to which this
			 Act applies.</text>
				</paragraph><paragraph id="IDDBCF959EF2F14C1CB15FB9AADA218647"><enum>(5)</enum><header>Deposits to
			 fund</header><text>Notwithstanding any other provision of law, all fees
			 collected under this subsection, and all penalties and payments collected for
			 violations of this Act, shall be deposited into the Fund.</text>
				</paragraph></subsection></section><section id="ID9649B166C9934274B5A4E17BA441C3E0"><enum>15.</enum><header>Effect on other
			 law</header>
			<subsection id="IDE5FF690787F245B19ACB43059BD1F7A1"><enum>(a)</enum><header>United
			 States</header><text>Nothing in this Act restricts, affects, or amends any
			 other law or the authority of any department, instrumentality, or agency of the
			 United States.</text>
			</subsection><subsection id="ID7DC307C783FC4F799F4241B150A2CB63"><enum>(b)</enum><header>States and
			 interstate agencies</header>
				<paragraph id="IDF31423198D484CF09F00413AE62BD241"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), nothing in this Act
			 precludes or denies the right of any State (including a political subdivision
			 of a State) or interstate agency to adopt or enforce—</text>
					<subparagraph id="IDF0AA0900D2564AF9853C04F1F25503B2"><enum>(A)</enum><text>any standard or
			 limit relating to the discharge of pollutants by cruise vessels; or</text>
					</subparagraph><subparagraph id="IDF7A09524ADAA4F3BB88505CE55724B0C"><enum>(B)</enum><text>any requirement
			 relating to the control or abatement of pollution.</text>
					</subparagraph></paragraph><paragraph id="ID0190D72C90024867B0FFBFC12EDA9656"><enum>(2)</enum><header>Exception</header><text>If
			 an effluent limit, performance standard, water quality standard, or any other
			 prohibition or limitation is in effect under Federal law, a State (including a
			 political subdivision of a State) or interstate agency may not adopt or enforce
			 any effluent limit, performance standard, water quality standard, or any other
			 prohibition that—</text>
					<subparagraph id="IDD799D53F84624E109BEC8F699F8153C0"><enum>(A)</enum><text>is less stringent
			 than the effluent limit, performance standard, water quality standard, or other
			 prohibition or limitation under this Act; or</text>
					</subparagraph><subparagraph id="IDB83C7743FB7D4DD18FD87B0D28FCB3B5"><enum>(B)</enum><text>impairs or in any
			 manner affects any right or jurisdiction of the State with respect to the
			 waters of the State.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
