			 <quote><short-title>Wolf Livestock Loss Prevention and
			 Mitigation Act</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="id55A7EE7E46F54EC7BA2EDFCE9BD46E36" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(1)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the <act-name parsable-cite="ISDA">Indian
			 Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
			 450b).</text>
			</paragraph><paragraph id="idD18F2442ACE64BE98455CEA36B9828A6"><enum>(2)</enum><header>Livestock</header><text>The
			 term <term>livestock</term> means cattle, swine, horses, mules, sheep, goats,
			 livestock guard animals, and other animals, as determined by the
			 Secretary.</text>
			</paragraph><paragraph id="id22EB10D700AD4A1DAF1CB1FD544A9BDF"><enum>(3)</enum><header>Predatory
			 species</header><text>The term <term>predatory species</term> means gray
			 wolves, grizzly bear, and other predatory species, as determined by the
			 Secretary.</text>
			</paragraph><paragraph id="id5E57A76AD8BE461CBEB5AE5185E25994"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Director of the United States Fish and Wildlife Service.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="id2D2C0156645D4C23833C5E082949BF8C" reported-display-style="strikethrough"><enum>3.</enum><header>Grant
			 program</header>
			<subsection id="id30F9EB9481144B699B7C7B145BBD9EE4"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may provide grants to States and Indian
			 tribes described in subsection (b) to pay the Federal share of carrying out
			 programs to compensate livestock producers for—</text>
				<paragraph id="id7DE0D5C8E70F41F3826CDCF89375F698"><enum>(1)</enum><text>activities
			 undertaken to reduce the risk of livestock loss due to predation by predatory
			 species; or</text>
				</paragraph><paragraph id="idE1F0AB7C1F344F5FAAADE18706E786DE"><enum>(2)</enum><text>livestock losses
			 due to such predation.</text>
				</paragraph></subsection><subsection id="idF31044584D2E4F949A63A9031F3BF908"><enum>(b)</enum><header>Requirements</header>
				<paragraph id="id36EFF501162E4BA68E4579F9791EDFC9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall designate as eligible to receive
			 grants under this section—</text>
					<subparagraph id="idE7F7CBBD6079450AAF2BD48EDD883C48"><enum>(A)</enum><text>the States of
			 Montana, Wyoming, and Idaho; and</text>
					</subparagraph><subparagraph id="idC0DF465EF1484E56B1BBFCB8AF31B20A"><enum>(B)</enum><text>such other States
			 and Indian tribes as the Secretary determines from among States and Indian
			 tribes that have populations of predatory species.</text>
					</subparagraph></paragraph><paragraph id="idBD37D4E891854BD4B7BEFCBE0FED34D9"><enum>(2)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under subsection (a), a State or Indian tribe
			 shall—</text>
					<subparagraph id="idC44D67A65A924780BF7B7CB157273AB5"><enum>(A)</enum><text>designate an
			 appropriate agency in the State or Indian tribe to administer the 1 or more
			 programs funded by the grant;</text>
					</subparagraph><subparagraph id="idBD94056BF3D648D492F10507E78FCA75"><enum>(B)</enum><text>establish 1 or
			 more accounts to receive grant funds;</text>
					</subparagraph><subparagraph id="id0230FBA181A140A0B6ADBC2B253D40FF"><enum>(C)</enum><text>maintain files of
			 all claims received under programs funded by grant, including supporting
			 documentation;</text>
					</subparagraph><subparagraph id="idB9368C41FBE341B8886478B2641480BC"><enum>(D)</enum><text>submit to the
			 Secretary—</text>
						<clause id="id3D801CE0CED5409691EC6AD4D5DE03EF"><enum>(i)</enum><text>annual reports
			 that include—</text>
							<subclause id="id636826612B4B410DB122676CABFD1B0C"><enum>(I)</enum><text>a summary of
			 claims and expenditures under the program during the year; and</text>
							</subclause><subclause id="idAA3CCA5A0251423C8C97162796E47B75"><enum>(II)</enum><text>a description of
			 any action taken on the claims; and</text>
							</subclause></clause><clause id="id267965D0C856483FAAA6B6D8B1AD18EE"><enum>(ii)</enum><text>such other
			 reports as the Secretary may require to assist the Secretary in determining the
			 effectiveness of programs carried out under this section; and</text>
						</clause></subparagraph><subparagraph id="idFCD17CC27F4344AB9A881C1BCA1775BC"><enum>(E)</enum><text>promulgate rules
			 for reimbursing livestock producers under the program in accordance with
			 subsection (c).</text>
					</subparagraph></paragraph><paragraph id="id22115242E7B940629D008F752AB3D718"><enum>(3)</enum><header>Allocation of
			 funding</header><text>The Secretary shall allocate funding made available to
			 carry out this section among States and Indian tribes based on—</text>
					<subparagraph id="id2893ABB744EF4AA69854EEE09616B640"><enum>(A)</enum><text>the level of
			 livestock predation in the State or on the land owned by, or held in trust for
			 the benefit of, the Indian tribe;</text>
					</subparagraph><subparagraph id="id77367BE43236413B93DEDF6142EF482E"><enum>(B)</enum><text>whether the State
			 or Indian tribe is located in a geographical area that is at high risk for
			 livestock predation; or</text>
					</subparagraph><subparagraph id="id6F4DF2E2EB434D08B16B3ADBF4334656"><enum>(C)</enum><text>such other factors
			 as the Secretary determines.</text>
					</subparagraph></paragraph></subsection><subsection id="idB6F55551E21949A598D8F76FE9462F61"><enum>(c)</enum><header>Funded
			 programs</header>
				<paragraph id="id31A4B830D3D448F5A51470676835DE86"><enum>(1)</enum><header>Preventative
			 programs</header><text>A program funded by a grant under subsection (a)(1)
			 shall compensate livestock producers for activities that reduce the risk of
			 livestock loss due to predation, including—</text>
					<subparagraph id="id799C53E534ED4FF38F86E784025C1189"><enum>(A)</enum><text>fencing;</text>
					</subparagraph><subparagraph id="id4AB5B3949E2F474C95F41F0F9374796D"><enum>(B)</enum><text>fladry;</text>
					</subparagraph><subparagraph id="idCF523C2EDBB84FE88BDD043B4EE40C31"><enum>(C)</enum><text>night
			 penning;</text>
					</subparagraph><subparagraph id="idB448BB7616F54EF799FC1305EB819F45"><enum>(D)</enum><text>increased human
			 presence in the form of livestock herders and riders;</text>
					</subparagraph><subparagraph id="id8355BC38D72E44BE88396E2BFBC8DEE5"><enum>(E)</enum><text>guard
			 animals;</text>
					</subparagraph><subparagraph id="idC1A9128C8F264F109DF909B9F9249C30"><enum>(F)</enum><text>provision of hay
			 and dog food;</text>
					</subparagraph><subparagraph id="id38487964884A4A35ACB67BBE42A17FA0"><enum>(G)</enum><text>voluntary rental
			 of private land or alternative pasture allotments on a temporary basis;</text>
					</subparagraph><subparagraph id="idF61177A9FB4A415B9711467C8DBA5D39"><enum>(H)</enum><text>delayed turnouts;
			 and</text>
					</subparagraph><subparagraph id="idEDACA642941942F491B0DBBB25A8FF6E"><enum>(I)</enum><text>other successful
			 preventative measures, as determined by the agency administering the
			 program.</text>
					</subparagraph></paragraph><paragraph id="id820DF38C53FD46E8AEF3631D7BCAB6B0"><enum>(2)</enum><header>Compensatory
			 programs</header><text>A program funded by a grant under subsection (a)(2)
			 shall compensate livestock producers for losses due to predation of the
			 livestock of the livestock producers.</text>
				</paragraph><paragraph id="id208CED4A780F4468855C70F76411A6AB"><enum>(3)</enum><header>Eligible
			 land</header><text>Activities described in paragraph (1) and losses described
			 in paragraph (2) may occur on Federal, State, or private land, or land owned
			 by, or held in trust for the benefit of, an Indian tribe.</text>
				</paragraph><paragraph id="id9CF44E12502D43FE9AB65D74969DB4A1"><enum>(4)</enum><header>Federal cost
			 share</header><text>The Federal share of the cost of carrying out a program
			 described in paragraph (1) or (2) for any fiscal year shall not exceed 50
			 percent of the total annual cost of the program.</text>
				</paragraph></subsection><subsection id="idF2D401DF0F0B461EAE3AEB8CA1A83DAC"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out this section.</text>
			</subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id9BC29DB192B7437696B210FD40099927" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wolf Livestock Loss Prevention and
			 Mitigation Act</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="ID3f6956191efd46ddb092edcd2884f135" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDba254550fb8a42ddbc764c581201f3d4"><enum>(1)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
			</paragraph><paragraph id="ID25c33ce5dad14394ba011e925d63e86f"><enum>(2)</enum><header>Livestock</header><text>The
			 term <term>livestock</term> means cattle, swine, horses, mules, sheep, goats,
			 livestock guard animals, and other domestic animals, as determined by the
			 Secretary.</text>
			</paragraph><paragraph id="id6AF70F502F444613A211471904F17695"><enum>(3)</enum><header>Program</header><text>The
			 term <quote>program</quote> means the demonstration program established under
			 section 3(a).</text>
			</paragraph><paragraph id="idB51CCDEC588C4395A1C211B886E8AFD1"><enum>(4)</enum><header>Secretaries</header><text>The
			 term <quote>Secretaries</quote> means the Secretary of the Interior and the
			 Secretary of Agriculture, acting jointly.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="ID9a633722345b46cc9b9f29f3044d07da" reported-display-style="italic"><enum>3.</enum><header>Wolf compensation and
			 prevention program</header>
			<subsection id="ID4d68efa1d6e2418f9c0b43b52908f39b"><enum>(a)</enum><header>In
			 general</header><text>The Secretaries shall establish a 5-year demonstration
			 program to provide grants to States and Indian tribes—</text>
				<paragraph id="id94D223EE76924A72A5223DCAB0B681D1"><enum>(1)</enum><text>to assist livestock
			 producers in undertaking proactive, non-lethal activities to reduce the risk of
			 livestock loss due to predation by wolves; and</text>
				</paragraph><paragraph id="idD698C0248FB542119289FBD31B71B73A"><enum>(2)</enum><text>to compensate livestock
			 producers for livestock losses due to such predation.</text>
				</paragraph></subsection><subsection id="IDe5e8f1e9613f4b14a1030885cd028554"><enum>(b)</enum><header>Criteria and
			 Requirements</header><text>The Secretaries shall—</text>
				<paragraph id="id15FA0A2859384037B32111E88C34BCEA"><enum>(1)</enum><text>establish criteria and
			 requirements to implement the program; and</text>
				</paragraph><paragraph id="idFC28BD54F90B4411BF9C350D5AF7F1B4"><enum>(2)</enum><text>when promulgating
			 regulations to implement the program under paragraph (1), consult with States
			 that have implemented State programs that provide assistance to—</text>
					<subparagraph id="IDa4bb8668f1034bda912052a83a3ef732"><enum>(A)</enum><text>livestock producers to
			 undertake proactive activities to reduce the risk of livestock loss due to
			 predation by wolves; or</text>
					</subparagraph><subparagraph id="ID686641fdfdfa4b1c9f6ef46dc1891b88"><enum>(B)</enum><text>provide compensation to
			 livestock producers for livestock losses due to such predation.</text>
					</subparagraph></paragraph></subsection><subsection id="ID34abbd85e3684168bb8650bcee55ef63"><enum>(c)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under subsection (a), a State or Indian tribe
			 shall—</text>
				<paragraph id="IDebeabce6068544afbb07d200120909c2"><enum>(1)</enum><text>designate an appropriate
			 agency of the State or Indian tribe to administer the 1 or more programs funded
			 by the grant;</text>
				</paragraph><paragraph id="ID902bdd596332451392ef6749be17b816"><enum>(2)</enum><text>establish 1 or more
			 accounts to receive grant funds;</text>
				</paragraph><paragraph id="ID14575fddd6ee419c80b87a8ae7203ad7"><enum>(3)</enum><text>maintain files of all
			 claims received under programs funded by the grant, including supporting
			 documentation;</text>
				</paragraph><paragraph id="ID7e0bd9025bcd43b5a51ff014116cb9f9"><enum>(4)</enum><text>submit to the
			 Secretary—</text>
					<subparagraph id="ID38e261b516894d35b4dfabd3b2702a77"><enum>(A)</enum><text>annual reports that
			 include—</text>
						<clause id="ID60a4ad44e9c14bda95c47a280e02f87c"><enum>(i)</enum><text>a summary of claims and
			 expenditures under the program during the year; and</text>
						</clause><clause id="IDbf7f41b58c5042dc8be2f70002cef605"><enum>(ii)</enum><text>a description of any
			 action taken on the claims; and</text>
						</clause></subparagraph><subparagraph id="IDb051b5c712ce482d9a7a1c316f4b9d3c"><enum>(B)</enum><text>such other reports as the
			 Secretary may require to assist the Secretary in determining the effectiveness
			 of activities provided assistance under this section; and</text>
					</subparagraph></paragraph><paragraph id="ID3cb2b81236e94d87afce1bce2683f001"><enum>(5)</enum><text>promulgate rules for
			 reimbursing livestock producers under the program.</text>
				</paragraph></subsection><subsection id="IDbcbd38bd53fa4f26b78f5f55c8b2814c"><enum>(d)</enum><header>Allocation of
			 funding</header><text>The Secretaries shall allocate funding made available to
			 carry out this Act—</text>
				<paragraph id="IDe03ef48a94ce4460a60393f3e152cf76"><enum>(1)</enum><text>equally between the uses
			 identified in paragraphs (1) and (2) of subsection (a); and</text>
				</paragraph><paragraph id="ID1576023ab3e64c3298b5b267c4eeeace"><enum>(2)</enum><text>among States and Indian
			 tribes based on—</text>
					<subparagraph id="ID8e7d3ae4f1eb4e008a64b0b6e87f7ef2"><enum>(A)</enum><text>the level of livestock
			 predation in the State or on the land owned by, or held in trust for the
			 benefit of, the Indian tribe;</text>
					</subparagraph><subparagraph id="IDba03051ded2d472fb9291cb8d0727fba"><enum>(B)</enum><text>whether the State or
			 Indian tribe is located in a geographical area that is at high risk for
			 livestock predation; or</text>
					</subparagraph><subparagraph id="ID4e1c1165a5664583a46eb1ca13c7dbcc"><enum>(C)</enum><text>any other factors that
			 the Secretaries determine are appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdbd128ee7075431e9a547d09575656ea"><enum>(e)</enum><header>Eligible
			 land</header><text>Activities and losses described in subsection (a) may occur
			 on Federal, State, or private land, or land owned by, or held in trust for the
			 benefit of, an Indian tribe.</text>
			</subsection><subsection id="IDca29f90148c24c8cb035d94abd550ca2"><enum>(f)</enum><header>Federal cost
			 share</header><text>The Federal share of the cost of any activity provided
			 assistance made available under this Act shall not exceed 50 percent of the
			 total cost of the activity.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="IDa7a0845ef48748ca90a48a2ae70098ec" reported-display-style="italic"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to carry out this Act $1,000,000 for fiscal year
			 2009 and each fiscal year thereafter.</text>
