		<section id="id268F1D34E3CD43E7A9ED282F5CDE3D02" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Water Essential Storage To Enhance
			 Regions in Need Act</short-title></quote> or the <quote><short-title>WESTERN Act</short-title></quote>.</text>
		</section><section id="idEF8DB640A4B94C228B99C4DB50E0B6AF"><enum>2.</enum><header>Corps of
			 Engineers Board of Appeals for permits for certain water storage
			 projects</header><text display-inline="no-display-inline">Section 404(a) of the
			 Federal Water Pollution Control Act (33 U.S.C. 1344(a)) is amended—</text>
			<paragraph id="id3503BFE6280C4C66815B42C2AF9A9370"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary may
			 issue</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC83E6F7AAA3C4F33924F4C9752B46C0A" style="OLC">
					<paragraph id="idB8CE07DA48BC45249EF262078731B700"><enum>(1)</enum><header>In
				general</header><text>The Secretary may
				issue</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idEC8C0014B339484D9E7E2AAA93405850"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE29B40F23C234583A8ED8B1587767EA2" style="OLC">
					<paragraph id="idA31F64B893E1404E9161C85CCB07EF66"><enum>(2)</enum><header>Requirements</header>
						<subparagraph id="id55E6AD9F2F5A487EB1A171329A95D9C5"><enum>(A)</enum><header>Purpose and
				need statements</header>
							<clause id="id0CEDF96DA11A41D4B1ECDAF2CC923EF3"><enum>(i)</enum><header>In
				general</header><text>Not later than 90 days after the date of receipt of a
				complete application for a permit for a water storage project under this
				subsection, the Secretary shall develop and provide to each applicant a purpose
				and need statement that describes—</text>
								<subclause id="id6A5F069CA7BE42A2B1B539939341F7EC"><enum>(I)</enum><text>whether the
				Secretary concurs with the assessment of, and alternatives for, the purposes
				and needs of the water storage project, as proposed by the applicant;
				and</text>
								</subclause><subclause id="id332E405D82CA4C3BA8B41269BCC4F7D0"><enum>(II)</enum><text>in any case in
				which the Secretary does not concur with the assessment, an assessment
				developed by the Secretary of the purposes and needs of the project.</text>
								</subclause></clause><clause id="idAA68F93D5ACE4CF4A6DADCF7AEE8F66E"><enum>(ii)</enum><header>Effect on
				environmental impact statements</header><text>No environmental impact statement
				or similar analysis required under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
				U.S.C. 4321 et seq.) shall commence with respect to a water storage project for
				which a permit is sought under this subsection until the date on which the
				Secretary provides to each applicant for the permit the purpose and need
				statement under clause (i).</text>
							</clause></subparagraph><subparagraph id="id3A818E1A94D3405FA63F96EC80EF40FA"><enum>(B)</enum><header>Records of
				decision</header><text>Before the date on which the Secretary issues a permit
				under this subsection, the Secretary shall provide to each applicant for the
				permit a record of decision describing all applicable conditions that will
				apply to the permit.</text>
						</subparagraph></paragraph><paragraph id="id97D36EBC4EF5426CBF8DB33D51C21E11"><enum>(3)</enum><header>Corps of
				Engineers Board of Appeals</header>
						<subparagraph id="id0B0E73B306BC45FD956CC33E5E10F759"><enum>(A)</enum><header>Establishment</header><text>The
				Secretary shall establish a board of appeals, to be known as the <quote>Corps
				of Engineers Board of Appeals</quote> (referred to in this paragraph as the
				<term>Board</term>).</text>
						</subparagraph><subparagraph id="idBCF83E3BD1774DB0AE76448C502253D0"><enum>(B)</enum><header>Membership</header><text>The
				Board shall be composed of 5 members, to be appointed by the Secretary, of
				whom—</text>
							<clause id="idA30BE73B6A2D4E96A43AB52902D2BBA8"><enum>(i)</enum><text>3
				shall be representatives of State water development agencies; and</text>
							</clause><clause id="id94633068EDEB44C6A4BD7CA4C666CE21"><enum>(ii)</enum><text>2 shall be
				representatives of the Corps of Engineers.</text>
							</clause></subparagraph><subparagraph id="id425BFFBEF64046F2A072C27114386F3A"><enum>(C)</enum><header>Duties</header>
							<clause id="id9DFF28E1B599481780BC9A10FF8975B5"><enum>(i)</enum><header>In
				general</header><text>The Board shall make determinations on all appeals
				relating to permits issued pursuant to this subsection for water storage
				projects, including any appeal regarding—</text>
								<subclause id="ID0d386e19ad6b4a2da6569e46ca5d3fd5"><enum>(I)</enum><text>a purpose and
				need statement issued under paragraph (2)(A)(i);</text>
								</subclause><subclause id="idA9C7A19FF3BB419686B444100BBC2A93"><enum>(II)</enum><text>a record of
				decision issued under paragraph (2)(B), including any condition on a permit
				described in the record of decision; or</text>
								</subclause><subclause id="id11A0DF9E21FC462D89C580F604204CF5"><enum>(III)</enum><text>any final
				decision of the Secretary to approve or disapprove a permit under this
				subsection.</text>
								</subclause></clause><clause id="id0EEE37A9762141C8B65EB3B836AF43F0"><enum>(ii)</enum><header>Deadline</header><text>The
				Board shall make a determination regarding an appeal under clause (i) by not
				later than 90 days after the date on which the appeal is filed with the
				Board.</text>
							</clause></subparagraph><subparagraph id="id7D4555419BF44622BC1112823E4FF1A6"><enum>(D)</enum><header>Factors for
				consideration</header><text>In making a determination under subparagraph (C),
				the Board shall evaluate, as applicable—</text>
							<clause id="idDDFFB73ED68041C4B5AA9869BE834B72"><enum>(i)</enum><text>any field
				decision of the Corps of Engineers regarding the purposes or needs of the
				applicable water storage project;</text>
							</clause><clause id="id075D2083B10244A5972CFC7691188E52"><enum>(ii)</enum><text>any condition
				placed on a permit for the applicable project under this subsection, based on
				the record of decision for the project under paragraph (2)(B); and</text>
							</clause><clause id="idE2856C1E45B94BAFACDD4A286F78782A"><enum>(iii)</enum><text>any
				determination by the Secretary to deny a permit under this subsection for the
				applicable project.</text>
							</clause></subparagraph><subparagraph id="id84D566ED72034001AA6E3EA214B8B83D"><enum>(E)</enum><header>Treatment of
				determinations</header><text>Notwithstanding any other provision of law
				(including regulations), effective on the date of enactment of this paragraph,
				a determination by the Board under this paragraph shall supercede any other
				appellate determination of the Corps of Engineers regarding permits under this
				subsection.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
