		<official-title>To prohibit the use of funds to promote the direct
		  deposit of Social Security benefits until adequate safeguards are established
		  to prevent the attachment and garnishment of such benefits.</official-title>

		<section id="id48E2E4185A404B05BEE9B7C97C4543BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Illegal Garnishment Prevention
			 Act</short-title></quote>.</text>
		</section><section id="id4FC5D7B1638E4F8AB1FB73D8497AD805"><enum>2.</enum><header>Prohibition on
			 use of funds to promote direct deposit of social security benefits until
			 assurance of protection from attachment or garnishment</header>
			<subsection id="id02A146348E2943FF9B53640FA9C9C302"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph id="id372CA23EB2624DECAE6A4059CEB1DCF7"><enum>(1)</enum><text>Section 207 of
			 the Social Security Act (42 U.S.C. 407) provides that Social Security benefits
			 shall not “be subject to execution, levy, attachment, garnishment, or other
			 legal process, or to the operation of any bankruptcy or insolvency
			 law.”.</text>
				</paragraph><paragraph id="id7C4156360DE84BD0810E50631A31ACFF"><enum>(2)</enum><text>Congress intended
			 for Social Security benefits to provide at least a minimum subsistence for our
			 nation's elderly and disabled.</text>
				</paragraph><paragraph id="id3AF41EA791414FB0AF4EBE64EF64AC29"><enum>(3)</enum><text><fraction></fraction>Social
			 Security benefits are the only source of income for over 20 percent of Social
			 Security recipients.</text>
				</paragraph><paragraph id="idFF1A399DF073454CA9A53C6949DF1301"><enum>(4)</enum><text>Many financial
			 institutions are garnishing accounts on behalf of creditors in order to recover
			 debt owed to them, and are assessing fees on bank accounts into which Social
			 Security benefits are electronically deposited.</text>
				</paragraph><paragraph id="id94748DE15B7B43B1A8362B0FB9AB5B37"><enum>(5)</enum><text>Many recipients
			 of these benefits are left temporarily destitute when financial institutions
			 freeze access to their only source of income.</text>
				</paragraph><paragraph id="id6C00B77B433B4EC7862AC00A19493F8C"><enum>(6)</enum><text>Despite the lack
			 of protections for direct deposit recipients of Social Security, the Treasury
			 is spending millions of dollars encouraging seniors and other recipients of
			 social security benefits to use direct deposit for receipt of their
			 benefits.</text>
				</paragraph></subsection><subsection id="idAFC148AC099F4F68A0D77A445E4E2AF0"><enum>(b)</enum><header>Prohibition</header><text>No
			 funds appropriated or otherwise made available to the Secretary of the Treasury
			 or the Commissioner of Social Security for fiscal year 2009 may be used to
			 promote or otherwise encourage recipients of old-age, survivors, or disability
			 insurance benefits paid under title II of the Social Security Act to use direct
			 deposit for payment of such benefits, or to otherwise promote the use of direct
			 deposit for such benefits until the Secretary of the Treasury promulgates rules
			 establishing procedures to ensure that such benefits are protected from
			 attachment and garnishment in accordance with the requirements of section 207
			 of the Social Security Act (42 U.S.C. 407), and at least 5 of the 7 members of
			 the advisory committee established under subsection (c) concur in advising the
			 Secretary of the Treasury that such procedures provide adequate
			 safeguards.</text>
			</subsection><subsection id="id804506A80AA8424FABC58A7A106EE81E"><enum>(c)</enum><header>Advisory
			 Committee</header>
				<paragraph id="id62EE8BA3955F4B2AA3B013362DC36E8E"><enum>(1)</enum><header>Establishment</header><text>There
			 is hereby established an Advisory Committee to be known as the <quote>Social
			 Security Benefits Protection from Attachment or Garnishment Advisory
			 Committee</quote>.</text>
				</paragraph><paragraph id="id34111121C9654D8499A43044FB637CF8"><enum>(2)</enum><header>Membership</header><text>The
			 Committee shall be comprised of 7 members comprised of, or appointed by the
			 following:</text>
					<subparagraph id="id978561A0D47D4378A72FEBAF4FF27819"><enum>(A)</enum><text>The Secretary of
			 the Treasury.</text>
					</subparagraph><subparagraph id="id852F52A500E54DB8BF73F93D466FA287"><enum>(B)</enum><text>The Chair of the
			 Committee on Ways and Means of the House of Representatives.</text>
					</subparagraph><subparagraph id="id02896CEF42C54A8982B70A3B71F51711"><enum>(C)</enum><text>The Ranking
			 Member of the Committee on Ways and Means of the House of
			 Representatives.</text>
					</subparagraph><subparagraph id="id8BCC210901D9458CA86D631B35216555"><enum>(D)</enum><text>The Chair of the
			 Committee on Finance of the Senate.</text>
					</subparagraph><subparagraph id="idBC45D5447D804CE7B1325C793BEDA815"><enum>(E)</enum><text>The Ranking
			 Member of the Committee on Finance of the Senate.</text>
					</subparagraph><subparagraph id="idAC519F7F06384B79BC51AA443F2DB83A"><enum>(F)</enum><text>The Chair of the
			 Special Committee on Aging of the Senate.</text>
					</subparagraph><subparagraph id="id5BB5015061B34866AF4D97F2D6DD995E"><enum>(G)</enum><text>The Ranking
			 Member of the Special Committee on Aging of the Senate.</text>
					</subparagraph></paragraph><paragraph id="idA9AFB8ECC51445D6B8B84BA5B30D0221"><enum>(3)</enum><header>Meetings</header><text>The
			 Secretary of the Treasury shall establish meetings of the Committee.</text>
				</paragraph><paragraph id="id31BF072C468C4214B6386D8D9CE80C9E"><enum>(4)</enum><header>Duties</header><text>The
			 Committee shall review the procedures promulgated by the Secretary of the
			 Treasury to carry out subsection (b) and, upon the concurrence of at least 5
			 members of the Committee, advise the Secretary of the Treasury as to the
			 adequacy of such procedures with respect to protecting old-age, survivors, or
			 disability insurance benefits paid under title II of the Social Security Act
			 from attachment and garnishment.</text>
				</paragraph><paragraph id="id825A8AFA277243B3A61F67B7C0937132"><enum>(5)</enum><header>FACA
			 exemption</header><text>The Committee shall not be subject to the Federal
			 Advisory Committee Act (5 U.S.C. App.).</text>
				</paragraph></subsection></section></legis-body>
