		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aging Water Infrastructure and
			 Maintenance Act</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="idEFB12C62AD4B482EA3474FA5E86EA0C3" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idE001A9274CB24759B790BF209B771F7D"><enum>(1)</enum><header>Inspection</header><text>The
			 term <term>inspection</term> means an inspection of a project facility carried
			 out by the Secretary—</text>
				<subparagraph id="id1FFBCC4B134C43629E20D81FFAE0BBDB"><enum>(A)</enum><text>to assess and
			 determine the general condition of the project facility; and</text>
				</subparagraph><subparagraph id="idE93374914B694F9A8AE8CA31050F882A"><enum>(B)</enum><text>to estimate the
			 value of property, and the size of the population, that would be at risk if the
			 project facility fails, is breached, or otherwise allows flooding to
			 occur.</text>
				</subparagraph></paragraph><paragraph id="id086C792F6F2D4B88A51DCEC860982C7C"><enum>(2)</enum><header>Project
			 facility</header><text>The term <term>project facility</term> means any part or
			 incidental feature of a reclamation or irrigation project (including any canal,
			 levee, tunnel, dike, pumping plant, dam, or reservoir) that is—</text>
				<subparagraph id="id372CCC22F4A44AF0B02BEDA1D4B1CD31"><enum>(A)</enum><text>under the
			 jurisdiction of the Secretary (including any facility owned by the Department
			 of the Interior); and</text>
				</subparagraph><subparagraph id="id0FBC7AA63BAB4822A0F46C74AC699188"><enum>(B)</enum><text>not covered by the
			 Reclamation Safety of Dams Act of 1978 (43 U.S.C. 506 et seq.).</text>
				</subparagraph></paragraph><paragraph id="id85D420A778554D3A9B823109C179A449"><enum>(3)</enum><header>Reserved project
			 facility</header><text>The term <term>reserved project facility</term> means
			 any project facility at which the Secretary carries out the operation and
			 maintenance of the project facility.</text>
			</paragraph><paragraph id="idD5F2423E9CB74421A56E8CD3B50F95C5"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Commissioner of Reclamation.</text>
			</paragraph><paragraph id="id5A05D305FC8844B297720A0ADBD770DE"><enum>(5)</enum><header>Transferred
			 project facility</header><text>The term <term>transferred project
			 facility</term> means a project facility the operation and maintenance of which
			 is carried out by a non-Federal entity.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="id49369C92E7AB44489D9688065A7CC622" reported-display-style="strikethrough"><enum>3.</enum><header>Inspection of
			 project facilities</header>
			<subsection id="id8E166B138375435497CB7CB15DD9C280"><enum>(a)</enum><header>Inspections</header>
				<paragraph id="idEB37E2B0B3B14BF292F1C2EA6E2788E8"><enum>(1)</enum><header>Initial
			 inspection period</header>
					<subparagraph id="idFEFE4AC91470449BAEB8E66BDD967DAF"><enum>(A)</enum><header>In
			 general</header><text>In accordance with subparagraph (B), not later than 1
			 year after the date of enactment of this Act, the Secretary shall conduct an
			 inspection of not less than 75 percent of all project facilities.</text>
					</subparagraph><subparagraph id="idF517BAD3A51F47D5818DDF165CFAADDC"><enum>(B)</enum><header>Selection of
			 project facilities</header><text>In selecting project facilities to inspect
			 during the initial inspection period under subparagraph (A), the Secretary
			 shall take into account the risk posed by each project facility to public
			 health or safety, or property.</text>
					</subparagraph></paragraph><paragraph id="id4D005F29C3BB481DAD9FA964EF5B7359"><enum>(2)</enum><header>Final inspection
			 period</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Secretary shall conduct an inspection of each project facility not
			 inspected by the Secretary during the initial inspection period under paragraph
			 (1)(A).</text>
				</paragraph><paragraph id="id20B75ED623E347169675C121E2F15BBE"><enum>(3)</enum><header>Reimbursement
			 relating to inspections of transferred project
			 facilities</header><text>Notwithstanding any applicable law (including
			 regulations), with respect to an inspection of a transferred project facility
			 carried out under this subsection, the Secretary may not request from the
			 non-Federal entity that carries out the operation and maintenance of the
			 transferred project facility reimbursement for costs arising from the
			 inspection.</text>
				</paragraph><paragraph id="idBDE19CE1E531433E98268CF338929DDC"><enum>(4)</enum><header>Periodic review
			 of inspections</header><text>Not later than 3 years after the date described in
			 paragraph (2) and every 3 years thereafter, the Secretary shall carry out a
			 review of each inspection carried out under paragraphs (1) and (2).</text>
				</paragraph></subsection><subsection id="id253E2A8EA0764135B4BD80616E15F610"><enum>(b)</enum><header>Use of
			 inspection data</header><text>The Secretary shall use the data collected by the
			 Secretary through the conduct of the inspections under paragraphs (1) and (2)
			 of subsection (a)—</text>
				<paragraph id="id4C8DC97765B34769A9DF5CB06C1C4BFA"><enum>(1)</enum><text>to develop for
			 each reserved project facility a detailed schedule for the conduct of regular
			 maintenance;</text>
				</paragraph><paragraph id="id46A9819419C94993BC207619DA229863"><enum>(2)</enum><text>to develop for,
			 and provide to, each non-Federal entity that carries out the operation and
			 maintenance of a transferred project facility—</text>
					<subparagraph id="id561FE5E87FD7431C931DEF5623A8E65D"><enum>(A)</enum><text>a detailed
			 schedule for the conduct of regular maintenance; and</text>
					</subparagraph><subparagraph id="id3EFC27ED83BB47A4913A3734E61A311C"><enum>(B)</enum><text>a document that
			 contains guidance describing the manner by which to comply with the schedule
			 described in subparagraph (A); and</text>
					</subparagraph></paragraph><paragraph id="id5FB8A1D698BF43AABC776AEC61143188"><enum>(3)</enum><text>to create a
			 national priorities list that contains a description of each project facility
			 that requires the most urgent maintenance with respect to the infrastructure of
			 the project facility.</text>
				</paragraph></subsection><subsection id="id9AADD9B1A2FE4B1CB45150FC41BD281F"><enum>(c)</enum><header>National
			 priorities list</header>
				<paragraph id="id223F733515CA440FA06F7EAD284901C6"><enum>(1)</enum><header>Annual
			 review</header><text>Not later than 1 year after the date on which the
			 Secretary develops the national priorities list under subsection (b)(3) and
			 annually thereafter, the Secretary shall carry out a review of each project
			 facility to update the list for the year covered by the review.</text>
				</paragraph><paragraph id="id96E41550ABFC42B3BA1E5A9A0268F6A6"><enum>(2)</enum><header>Publication</header><text>The
			 national priorities list shall be published by the Secretary in the budget
			 justification of the Department of the Interior for the year covered by the
			 national priorities list.</text>
				</paragraph></subsection><subsection id="idDBD7C374571346D2BD94480DDA3DD6A0"><enum>(d)</enum><header>State
			 participation</header><text display-inline="yes-display-inline">In conducting
			 an inspection of a project facility under subsection (a), the Secretary
			 shall—</text>
				<paragraph id="id598A2A440CBE47CFB585CE76DAECC76F"><enum>(1)</enum><text>notify the
			 appropriate State agency of the State in which the project facility is located
			 of the inspection;</text>
				</paragraph><paragraph id="idDE23431CF59F46E7AD9833E45D07E243"><enum>(2)</enum><text>allow the State
			 agency described in paragraph (1) to participate in the inspection of the
			 project facility; and</text>
				</paragraph><paragraph id="idDBC107141CA8498980523902E3F94396"><enum>(3)</enum><text>provide to the
			 State agency described in paragraph (1) a report that describes the results of
			 the inspection of the project facility.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="id9009054C13F541EDB0B11CBB685CC60C" reported-display-style="strikethrough"><enum>4.</enum><header>Federal standards
			 and guidelines for project facilities</header>
			<subsection id="idD495A925D4F244B3AF0ED9CBC69140FF"><enum>(a)</enum><header>Promulgation of
			 standards</header>
				<paragraph id="id0CB1C04851F34A4D98A0850E3F45742F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, in accordance with paragraph (2), the Secretary shall promulgate
			 final regulations to establish standards for the condition and maintenance of
			 project facilities.</text>
				</paragraph><paragraph id="id5F349ADE690C4CC5A2C105257799467E"><enum>(2)</enum><header>Contents</header><text>The
			 regulations promulgated by the Secretary under paragraph (1) shall contain a
			 detailed description of each condition with which a project facility shall
			 comply to be eligible to be considered by the Secretary—</text>
					<subparagraph id="id69B8F64115C24C5A994367898181A762"><enum>(A)</enum><text>to function
			 properly and in accordance with the objectives of the project facility;
			 and</text>
					</subparagraph><subparagraph id="id5D392FCF71D641A4A659D6905898C161"><enum>(B)</enum><text>to operate in a
			 manner to ensure, to the maximum extent practicable—</text>
						<clause id="id8F396A1704214D34939D0A8F8A41A50C"><enum>(i)</enum><text>the safety of
			 populations located in close proximity to the project facility; and</text>
						</clause><clause id="id15A23BD1A2784A9892C60A9FC4630CB3"><enum>(ii)</enum><text>the preservation
			 of property located in close proximity to the project facility.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idE29E9AE6703E4CEB820444EAC4ABCC55"><enum>(b)</enum><header>Promulgation of
			 guidelines</header>
				<paragraph id="id4915DC923B3743198790FA3658E9673A"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, in accordance with paragraph (2), the Secretary shall promulgate final
			 regulations to establish guidelines—</text>
					<subparagraph id="id8895E6B2ADA34C319FFFCAF2B3255A17"><enum>(A)</enum><text>to implement this
			 Act; and</text>
					</subparagraph><subparagraph id="idE19481253BD54FB5A9A7C7871DE53DBE"><enum>(B)</enum><text>to ensure
			 compliance with the regulations promulgated by the Secretary under subsection
			 (a).</text>
					</subparagraph></paragraph><paragraph id="id22D9736AA8F3428096A0A71DC397B19A"><enum>(2)</enum><header>Contents</header><text>The
			 regulations promulgated by the Secretary under paragraph (1) shall reflect an
			 agency-wide policy with respect to the type, and proportion of, activities
			 relating to the operation and maintenance of a project facility that may be
			 appropriately carried out by a non-Federal entity, taking into account—</text>
					<subparagraph id="idAF65EDB4116C4551A0FCCD2EFECDFF0E"><enum>(A)</enum><text>any economic
			 benefit that may result from the carrying out of the activities by a
			 non-Federal entity; and</text>
					</subparagraph><subparagraph id="id7B7DFE3834F04805B305AA1CB69B898D"><enum>(B)</enum><text>the capabilities
			 of the non-Federal entity to carry out the activities.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="id29C458E2032243F2878BA516F69CFB59" reported-display-style="strikethrough"><enum>5.</enum><header>Modification of
			 project facilities</header>
			<subsection id="idDB2AAE56B0904082A84EE98EB5237617"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall carry out or, in accordance with
			 subsection (b), provide to a non-Federal entity financial support to carry out,
			 any modification to a project facility that the Secretary determines to be
			 reasonably required to preserve the structural safety of the project
			 facility.</text>
			</subsection><subsection id="id47B1B24F2E9848EC848DA63B1F169EC7"><enum>(b)</enum><header>Reimbursement of
			 costs arising from the repair of structurally deficient transferred project
			 facilities</header>
				<paragraph id="id137CC0688A8F40D78496A4A5BD89AE55"><enum>(1)</enum><header>Compliant
			 transferred project facilities</header>
					<subparagraph id="id1385C501719243B1A0563EBD19B34220"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), to reimburse a non-Federal
			 entity for costs arising from the carrying out of repair activities to improve
			 the safety of a transferred project facility, the Secretary may provide to the
			 non-Federal entity an amount equal to 65 percent of the costs incurred by the
			 non-Federal entity to carry out the repair activities.</text>
					</subparagraph><subparagraph id="idD6530D9380E14F719C13E4B765062875"><enum>(B)</enum><header>Determination of
			 Secretary</header><text>The Secretary shall reimburse the non-Federal entity
			 described in subparagraph (A) if the Secretary determines that—</text>
						<clause id="id1C9B5CC4E7354439B52A66C7E0D25725"><enum>(i)</enum><text>the transferred
			 project facility of the non-Federal entity is structurally deficient;
			 and</text>
						</clause><clause id="id33E0AE6A07544B569910804EEF722BC8"><enum>(ii)</enum><text>the structural
			 deficiency is not a result of noncompliance with any regulation promulgated by
			 the Secretary under section 4.</text>
						</clause></subparagraph></paragraph><paragraph id="idC23484B808CC484185FC9D24DE5803FD"><enum>(2)</enum><header>Noncompliant
			 transferred project facilities</header>
					<subparagraph id="id94829BCA537D4148A5410C37995F11A4"><enum>(A)</enum><header>In
			 general</header><text>The Secretary may carry out any repair activity that the
			 Secretary determines to be necessary to minimize the risk of imminent harm to
			 public health or safety, or property—</text>
						<clause id="id544E9C907BCE4F668B8FE2A92BAC8C3B"><enum>(i)</enum><text>if the Secretary
			 determines that—</text>
							<subclause id="id1191B312567B4D57A473F38C19B665D2"><enum>(I)</enum><text>the transferred
			 project facility is structurally deficient; and</text>
							</subclause><subclause id="idCD4CA9805447494AA293C319C03026D6"><enum>(II)</enum><text>the structural
			 deficiency is a result of noncompliance with any regulation promulgated by the
			 Secretary under section 4; and</text>
							</subclause></clause><clause id="idA05B5370A0BD485388F63256F8D5666A"><enum>(ii)</enum><text>after the date on
			 which the Secretary consults with the non-Federal entity that carries out the
			 operation and maintenance of the transferred project facility.</text>
						</clause></subparagraph><subparagraph id="idBA6EC501EE5E417C89059CA07F7C7061"><enum>(B)</enum><header>Reimbursement</header><text>In
			 accordance with any applicable law (including regulations) or agreement, the
			 Secretary may seek reimbursement from the non-Federal entity that carries out
			 the operation and maintenance of the transferred project facility described in
			 subparagraph (A) for costs arising from each repair activity carried out by the
			 Secretary under that subparagraph.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="idD33A974B91A34DC2B7015DA4CD6B0D81" reported-display-style="strikethrough"><enum>6.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="id91F35ECDB12049C5A997706E62BA1F3A"><enum>(a)</enum><header>Inspection of
			 project facilities</header><text>There are authorized to be appropriated to the
			 Secretary to carry out section 3—</text>
				<paragraph id="idB95D372EA3E0462BBC5F5CBA66D66034"><enum>(1)</enum><text>$5,000,000 for
			 fiscal year 2009; and</text>
				</paragraph><paragraph id="id3CE51EAA5A09417296A3882F9BE4399F"><enum>(2)</enum><text>$1,500,000 for
			 each of fiscal years 2010 through 2013.</text>
				</paragraph></subsection><subsection id="idC400CD914C4D48659B5C0FDDEBFDE614"><enum>(b)</enum><header>Modification of
			 project facilities</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out section 5.</text>
			</subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="ID468dccecf9db4c40ac038edf4c351b47" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aging Water Infrastructure and
			 Maintenance Act</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="IDa66d2d237a0243d4ade98c2fdd3d3f08" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDa731b62242d64c61bbfe16c6dd00f547"><enum>(1)</enum><header>Inspection</header><text>The
			 term <term>inspection</term> means an inspection of a project facility carried
			 out by the Secretary—</text>
				<subparagraph id="ID004e191f2b6941eb9984754fd9961288"><enum>(A)</enum><text>to assess and determine
			 the general condition of the project facility; and</text>
				</subparagraph><subparagraph id="ID726645c86b704eeebb80145f7577490d"><enum>(B)</enum><text>to estimate the value of
			 property, and the size of the population, that would be at risk if the project
			 facility fails, is breached, or otherwise allows flooding to occur.</text>
				</subparagraph></paragraph><paragraph id="IDc6d8535c8ef34dddb97f62033c9d9c0c"><enum>(2)</enum><header>Project
			 facility</header><text>The term <term>project facility</term> means any part or
			 incidental feature of a project, excluding high- and significant-hazard dams,
			 constructed under the Federal reclamation law (the Act of June 17, 1902 (32
			 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act
			 (43 U.S.C. 371 et seq.).</text>
			</paragraph><paragraph id="ID80d637b225c44d11bfd86dbb6b0e996f"><enum>(3)</enum><header>Reserved
			 works</header><text>The term <term>reserved works</term> mean any project
			 facility at which the Secretary carries out the operation and maintenance of
			 the project facility.</text>
			</paragraph><paragraph id="ID2f60b116c3b8405698ee243411c0a8e0"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Commissioner of Reclamation.</text>
			</paragraph><paragraph id="ID2ab96c9815714e4ea8abfcceda0c71c1"><enum>(5)</enum><header>Transferred
			 works</header><text>The term <term>transferred works</term> means a project
			 facility, the operation and maintenance of which is carried out by a
			 non-Federal entity, under the provisions of a formal operation and maintenance
			 transfer contract.</text>
			</paragraph><paragraph id="ID84fa559fd6054d24a186a6c766ce3251"><enum>(6)</enum><header>Transferred works
			 operating entity</header><text>The term <term>transferred works operating
			 entity</term> means the organization which is contractually responsible for
			 operation and maintenance of transferred works.</text>
			</paragraph><paragraph id="IDb31d7eb8c3974e66872de49273b18ca7"><enum>(7)</enum><header>Extraordinary operation
			 and maintenance work</header><text>The term <term>extraordinary operation and
			 maintenance work</term> means major, nonrecurring maintenance to
			 Reclamation-owned or operated facilities, or facility components, that
			 is—</text>
				<subparagraph id="id1BE09DBB726842989008DF863C8CF555"><enum>(A)</enum><text>intended to ensure the
			 continued safe, dependable, and reliable delivery of authorized project
			 benefits; and</text>
				</subparagraph><subparagraph id="id5A75048347414E0DAC8C8F2AADD66CE4"><enum>(B)</enum><text>greater than 10 percent
			 of the contractor’s or the transferred works operating entity’s annual
			 operation and maintenance budget for the facility, or greater than
			 $100,000.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SSEG00" id="IDb04da3b5bf8444769461d9e1417b1dad" reported-display-style="italic"><enum>3.</enum><header>Guidelines and
			 inspection of project facilities and technical assistance to transferred works
			 operating entities</header>
			<subsection id="ID3abd6a4e0c6140c29c16f4d6fb705b92"><enum>(a)</enum><header>Guidelines and
			 inspections</header>
				<paragraph id="IDa24086d59ec2430cb4ac4d2537f5ce03"><enum>(1)</enum><header>Development of
			 guidelines</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary in consultation with transferred works operating
			 entities shall develop, consistent with existing transfer contracts, specific
			 inspection guidelines for project facilities which are in proximity to
			 urbanized areas and which could pose a risk to public safety or property damage
			 if such project facilities were to fail.</text>
				</paragraph><paragraph id="ID2ee8ec66af3c4a4fb4c254a369979c22"><enum>(2)</enum><header>Conduct of
			 inspections</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall conduct inspections of those project facilities,
			 which are in proximity to urbanized areas and which could pose a risk to public
			 safety or property damage if such facilities were to fail, using such specific
			 inspection guidelines and criteria developed pursuant to paragraph (1). In
			 selecting project facilities to inspect, the Secretary shall take into account
			 the potential magnitude of public safety and economic damage posed by each
			 project facility.</text>
				</paragraph><paragraph id="IDced305387a0048c0accb1f342252f043"><enum>(3)</enum><header>Treatment of
			 costs</header><text>The costs incurred by the Secretary in conducting these
			 inspections shall be nonreimbursable.</text>
				</paragraph></subsection><subsection id="ID6f06d986394e4494ab5ffcf44157c695"><enum>(b)</enum><header>Use of inspection
			 data</header><text>The Secretary shall use the data collected through the
			 conduct of the inspections under subsection (a)(2) to—</text>
				<paragraph id="IDaf10a5e785704777a85aea9822626ddb"><enum>(1)</enum><text>provide recommendations
			 to the transferred works operating entities for improvement of operation and
			 maintenance processes, operating procedures including operation guidelines
			 consistent with existing transfer contracts, and structural modifications to
			 those transferred works;</text>
				</paragraph><paragraph id="IDc330846b4b5440dab69d43b98f41f10d"><enum>(2)</enum><text>determine an appropriate
			 inspection frequency for such nondam project facilities which shall not exceed
			 6 years; and</text>
				</paragraph><paragraph id="IDedc3987363784250babd38541a3c8808"><enum>(3)</enum><text>provide, upon request of
			 transferred work operating entities, local governments, or State agencies,
			 information regarding potential hazards posed by existing or proposed
			 residential, commercial, industrial or public-use development adjacent to
			 project facilities.</text>
				</paragraph></subsection><subsection id="IDc44870a199c24af6b6caec62559b05cd"><enum>(c)</enum><header>Technical assistance to
			 transferred works operating entities</header>
				<paragraph id="IDcc8609b4e8134e05af268df000128f5a"><enum>(1)</enum><header>Authority of Secretary
			 to provide technical assistance</header><text>The Secretary is authorized, at
			 the request of a transferred works operating entity in proximity to an
			 urbanized area, to provide technical assistance to accomplish the following, if
			 consistent with existing transfer contracts:</text>
					<subparagraph id="IDb1f8aef3bab041428c2ed3217c09359b"><enum>(A)</enum><text>Development of documented
			 operating procedures for a project facility.</text>
					</subparagraph><subparagraph id="IDce2c20aefe0b40caa365730bf3fdf7a2"><enum>(B)</enum><text>Development of documented
			 emergency notification and response procedures for a project facility.</text>
					</subparagraph><subparagraph id="ID06bfa5f5777145e28b030499d205018e"><enum>(C)</enum><text>Development of facility
			 inspection criteria for a project facility.</text>
					</subparagraph><subparagraph id="ID4856ac863e004528a2d352833e6d47ec"><enum>(D)</enum><text>Development of a training
			 program on operation and maintenance requirements and practices for a project
			 facility for a transferred works operating entity’s workforce.</text>
					</subparagraph><subparagraph id="IDcd63e60db1a04c4a867a4e021c55d16f"><enum>(E)</enum><text>Development of a public
			 outreach plan on the operation and risks associated with a project
			 facility.</text>
					</subparagraph><subparagraph id="ID83e6011197d249b69e8a2d362e9d0066"><enum>(F)</enum><text>Development of any other
			 plans or documentation which, in the judgment of the Secretary, will contribute
			 to public safety and the sage operation of a project facility.</text>
					</subparagraph></paragraph><paragraph id="ID17dee6e0f9194e31b8ded7fbd69730fc"><enum>(2)</enum><header>Costs</header><text>The
			 Secretary is authorized to provide, on a non-reimbursable basis, up to 50
			 percent of the cost of such technical assistance, with the balance of such
			 costs being advanced by the transferred works operating entity or other
			 non-Federal source. The non-Federal 50 percent minimum cost share for such
			 technical assistance may be in the form of in-lieu contributions of resources
			 by the transferred works operating entity or other non-Federal source.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID4dd721bbebd940caab5c8a6f17f24907" reported-display-style="italic"><enum>4.</enum><header>Extraordinary operation
			 and maintenance work performed by the Secretary</header>
			<subsection id="IDa41f66f87be048639b7a3ae9caa7a8fd"><enum>(a)</enum><header>In
			 general</header><text>The Secretary or the transferred works operating entity
			 may carry out, in accordance with subsection (b) and consistent with existing
			 transfer contracts, any extraordinary operation and maintenance work on a
			 project facility that the Secretary determines to be reasonably required to
			 preserve the structural safety of the project facility.</text>
			</subsection><subsection id="ID6c780245e70a48f29a9863739e377855"><enum>(b)</enum><header>Reimbursement of costs
			 arising from extraordinary operation and maintenance work</header>
				<paragraph id="ID85732d2286f943fb9b05faae90f91754"><enum>(1)</enum><header>Treatment of
			 costs</header><text>For reserved works, costs incurred by the Secretary in
			 conducting extraordinary operation and maintenance work will be allocated to
			 the authorized reimbursable purposes of the project and shall be repaid within
			 50 years, with interest, from the year in which work undertaken pursuant to
			 this Act is substantially complete.</text>
				</paragraph><paragraph id="ID53c578ab7e194406a81d9deb8d06d15b"><enum>(2)</enum><header>Authority of
			 Secretary</header><text>For transferred works, the Secretary is authorized to
			 advance the costs incurred by the transferred works operating entity in
			 conducting extraordinary operation and maintenance work and negotiate
			 appropriate 50-year repayment contracts with project beneficiaries providing
			 for the return of reimbursable costs, with interest, under this subsection:
			 Provided, however, That no contract entered into pursuant to this Act shall be
			 deemed to be a new or amended contract for the purposes of section 203(a) of
			 the Reclamation Reform Act of 1982 (43 U.S.C. 390cc(a)).</text>
				</paragraph><paragraph id="ID3f4b6d2daa504356814acdaea6cd7666"><enum>(3)</enum><header>Determination of
			 interest rate</header><text>The interest rate used for computing interest on
			 work in progress and interest on the unpaid balance of the reimbursable costs
			 of extraordinary operation and maintenance work authorized by this Act shall be
			 determined by the Secretary of the Treasury, as of the beginning of the fiscal
			 year in which extraordinary operation and maintenance work is commenced, on the
			 basis of average market yields on outstanding marketable obligations of the
			 United States with the remaining periods of maturity comparable to the
			 applicable reimbursement period of the project, adjusted to the nearest
			 <fraction>1/8</fraction> of 1 percent on the unamortized balance of any portion
			 of the loan.</text>
				</paragraph></subsection><subsection id="ID5bf195169e024726a80514a94d87aaf3"><enum>(c)</enum><header>Emergency extraordinary
			 operation and maintenance work</header>
				<paragraph id="IDa9d77efedf8f4463b9bf958cac624962"><enum>(1)</enum><header>In
			 general</header><text>The Secretary or the transferred works operating entity
			 shall carry out any emergency extraordinary operation and maintenance work on a
			 project facility that the Secretary determines to be necessary to minimize the
			 risk of imminent harm to public health or safety, or property.</text>
				</paragraph><paragraph id="ID0af5aa26ce9344ec91d46b8f4eb96d5f"><enum>(2)</enum><header>Reimbursement</header><text>The
			 Secretary may advance funds for emergency extraordinary operation and
			 maintenance work and shall seek reimbursement from the transferred works
			 operating entity or benefitting entity upon receiving a written assurance from
			 the governing body of such entity that it will negotiate a contract pursuant to
			 section 4 for repayment of costs incurred by the Secretary in undertaking such
			 work.</text>
				</paragraph><paragraph id="ID4f187ff6c4b547cd8b32c53d41f5dd94"><enum>(3)</enum><header>Funding</header><text>If
			 the Secretary determines that a project facility inspected and maintained
			 pursuant to the guidelines and criteria set forth in section 3(a) requires
			 extraordinary operation and maintenance pursuant to paragraph (1), the
			 Secretary may provide Federal funds on a nonreimbursable basis sufficient to
			 cover 35 percent of the cost of the extraordinary operation and maintenance
			 allocable to the transferred works operating entity, which is needed to
			 minimize the risk of imminent harm. The remaining share of the Federal funds
			 advanced by the Secretary for such work shall be repaid under subsection
			 (b).</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID5f13bd67cd244cfe8c15f352a7febf9f" reported-display-style="italic"><enum>5.</enum><header>Relationship to
			 Twenty-First Century Water Works Act</header><text display-inline="no-display-inline">Nothing in this Act shall preclude a
			 transferred works operating entity from applying and receiving a loan-guarantee
			 pursuant to the Twenty-First Century Water Works Act (43 U.S.C. 2401 et
			 seq.).</text>
		</section><section changed="added" committee-id="SSEG00" id="IDc19e9ad326594aa8b0b49f1c50978c44" reported-display-style="italic"><enum>6.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
		</section><section changed="added" committee-id="SSEG00" id="ID1bfd89ff7e5d4551bad10aa2ba0a1d9c" reported-display-style="italic"><enum>7.</enum><header>Loan guarantee finance
			 demonstration program</header>
			<subsection id="IDa66ded1dce954a318bae7f6d62114438"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="IDd9db7848740942c492026f8e3bad45ee"><enum>(1)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="IDe1e0809db9684eae91f251876ff1e5d1"><enum>(2)</enum><header>Federal loan guarantee
			 and loan guarantee</header><text>The terms <term>Federal loan guarantee</term>
			 and <term>loan guarantee</term> have the meaning given the terms in the
			 Twenty-First Century Water Works Act (43 U.S.C. 2401 et seq.).</text>
				</paragraph><paragraph id="IDd35076fcaefd4d13817e1c5c6606615b"><enum>(3)</enum><header>Demonstration project
			 and project</header><text>The terms <term>demonstration project</term> and
			 <term>project</term> have the meaning given the term <term>project</term> in
			 section 202 of the Twenty-First Century Water Works Act (43 U.S.C.
			 2421).</text>
				</paragraph><paragraph id="IDa0bfbce467a24d9a91d0e07024a622c6"><enum>(4)</enum><header>Lender</header><text>The
			 term <term>lender</term> has the meaning given the term in section 202 of the
			 Twenty-First Century Water Works Act (43 U.S.C. 2421).</text>
				</paragraph><paragraph id="ID76d2790674ae4ee1b3c750b3d27c3f43"><enum>(5)</enum><header>Loan guarantee subsidy
			 cost</header><text>The term <term>loan guarantee subsidy cost</term> has the
			 meaning given under the <act-name parsable-cite="FCRA90">Federal Credit Reform
			 Act of 1990</act-name> (2 U.S.C. 661 et seq.) as the annual budget authority
			 needed to cover the portion of credit assistance estimated to be un-recovered
			 because of defaults, expressed as a percentage of the amount of each loan
			 approved for guarantee. This definition shall apply to loan guarantees given to
			 improve facilities to which the Federal Government holds title, as well as to
			 non-Federal facilities.</text>
				</paragraph></subsection><subsection id="ID768af0f2da6946528e726240649b3716"><enum>(b)</enum><header>Demonstration
			 program</header>
				<paragraph id="ID53cf44d2ac034296b61fe93e7f5f1fba"><enum>(1)</enum><header>Identification of
			 demonstration projects</header><text>Within 180 days of enactment of this Act,
			 the Secretary shall identify no more than 3 projects as eligible for Federal
			 loan guarantees. The identified projects shall include at least 1 project
			 involving extraordinary operation and maintenance work.</text>
				</paragraph><paragraph id="ID272d6f4d5f7f41519682c8f0a43a6bdc"><enum>(2)</enum><header>Memorandum of
			 agreement</header><text>Within 90 days of enactment of this Act, the Secretary
			 shall complete the Interagency Coordination and Cooperation actions in section
			 209 of the Twenty-First Century Water Works Act (43 U.S.C. 2428).</text>
				</paragraph><paragraph id="ID0ca2cd8ebab1450cb9773326ca5e9b8a"><enum>(3)</enum><header>Eligibility of
			 projects</header><text>Within 270 days of enactment of this Act, and in
			 accordance with an agreement with the entities seeking to carry-out the
			 projects identified under paragraph (1), the Secretary shall make available to
			 lenders Federal loan guarantees equal to the full cost of projects identified
			 in this section.</text>
				</paragraph><paragraph id="ID848b16ab285444eebac942c3246a782f"><enum>(4)</enum><header>Subsidy</header><text>The
			 loan guarantee subsidy cost shall be the greater of 2 percent or the subsidy
			 determined by the Secretary of Agriculture for covering the Federal cost of
			 guaranteeing loans to lenders financing water projects under the United States
			 Department of Agricultural Rural Development authorities.</text>
				</paragraph></subsection><subsection id="ID8af001d122754944bba74426d19559c9"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out this title, to remain available until
			 expended.</text>
