		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fairness in Nursing Home
			 Arbitration Act</short-title></quote>.</text>
		</section><section id="idF665B0712DBA455C807D03F41BA2CBAF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1 of title 9, United States Code, is
			 amended—</text>
			<paragraph id="IDc5954494a28a4fc9a53325788128c48a"><enum>(1)</enum><text>by striking the
			 section heading and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA71A43106EE141A18139ADE3F43AECA4" style="USC">
					<section id="id5AEDA3D386964E1DBD7FFC1F829FFC4B"><enum>1.</enum><header>Definitions</header>
					</section><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID327e104cd38c495bb08e6cb4a8186110"><enum>(2)</enum><text>by inserting
			 before the first beginning quotation mark, the following: <quote>(a) As used in
			 this chapter, the term (1)</quote>;</text>
			</paragraph><paragraph id="id94660A1424E440E5B8E20C471356F00B"><enum>(3)</enum><text>by striking
			 <quote>Maritime</quote> and inserting <quote>maritime</quote>;</text>
			</paragraph><paragraph id="idFC9A8DF9B07C447D93F406CD66A326A9"><enum>(4)</enum><text>by striking
			 <quote>jurisdiction;</quote> and inserting <quote>jurisdiction; (2)</quote>;
			 and</text>
			</paragraph><paragraph id="idEB0067C9CF3543D7BB2A03D84D508D9B"><enum>(5)</enum><text>by striking the
			 period and inserting the following: “; (3) ‘long-term care facility’
			 means—</text>
				<quoted-block display-inline="no-display-inline" id="id9EA77FCFA05A44079764E106A41612EB" style="OLC">
					<subparagraph id="idA4409537ABDF41FCBBEB5D28D86C320E" indent="up1"><enum>(A)</enum><text>any skilled nursing facility, as
				defined in 1819(a) of the Social Security Act;</text>
					</subparagraph><subparagraph id="idD1A98B420C764E22BB147185523A779C" indent="up1"><enum>(B)</enum><text>any nursing facility as defined in
				1919(a) of the Social Security Act; or</text>
					</subparagraph><subparagraph id="idF045A1DFEF294B06AC2B0499D0220010" indent="up1"><enum>(C)</enum><text>a public facility, proprietary
				facility, or facility of a private nonprofit corporation that—</text>
						<clause id="IDf2300f20bd3548f69b69af005d3dcb3f"><enum>(i)</enum><text>makes available to adult residents
				supportive services to assist the residents in carrying out activities such as
				bathing, dressing, eating, getting in and out of bed or chairs, walking, going
				outdoors, using the toilet, obtaining or taking medication, and which may make
				available to residents home health care services, such as nursing and therapy;
				and</text>
						</clause><clause id="IDc15d4dac0a9440dc8b729b1e964b91f7"><enum>(ii)</enum><text>provides a dwelling place for
				residents in order to deliver such supportive services referred to in clause
				(i), each of which may contain a full kitchen and bathroom, and which includes
				common rooms and other facilities appropriate for the provision of supportive
				services to the residents of the facility; and</text>
						</clause></subparagraph><paragraph id="id9596BD99B1D24C22810FEE1318E4D7AF" indent="up1"><enum>(4)</enum><text><term>pre-dispute arbitration
				agreement</term> means any agreement to arbitrate disputes that had not yet
				arisen at the time of the making of the agreement.</text>
					</paragraph><subsection id="IDad7dce143bdb40ebb9e5ef174748769c"><enum>(b)</enum><text>The definition of
				<quote>long-term care facility</quote> in subsection (a)(3) shall not apply to
				any facility or portion of facility that—</text>
						<paragraph id="IDa8e0ffe2b3f74d929426bfd5a242bb33"><enum>(1)</enum><text>does not provide
				the services described in subsection (a)(3)(C)(i); or</text>
						</paragraph><paragraph id="IDb03c4c5fe73b430bb8560c3a122a1f61"><enum>(2)</enum><text>has as its
				primary purpose, to educate or to treat substance abuse
				problems.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idCE5F802C917547CF85B2C1C380CFBC0D"><enum>3.</enum><header>Validity and
			 enforcement</header><text display-inline="no-display-inline">Section 2 of title
			 9, United States Code, is amended—</text>
			<paragraph id="id0F97A50B067348BE84A11586D835C18E"><enum>(1)</enum><text>by striking the
			 section heading and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id34B8C069F6A943FB8509D000BC33F519" style="USC">
					<section id="id2A47DB1673DA478EA9F05E8B0B91E59B"><enum>2.</enum><header>Validity and
				enforceability</header>
					</section><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idA8580769C4C347F9855FC6F97C9068E4"><enum>(2)</enum><text>by striking
			 <quote>A written</quote> and inserting <quote>(a) A Written</quote>;</text>
			</paragraph><paragraph id="IDaf000f57812d466895b6c5ca3c536d16"><enum>(3)</enum><text>by striking
			 <quote>, save</quote> and all that follows through <quote>contract</quote>, and
			 inserting <quote>to the same extent as contracts generally, except as otherwise
			 provided in this title</quote>; and</text>
			</paragraph><paragraph id="id17CF8D4F7C694305A4F9223DF5F1E729"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD7FA084909734AB898EDE53C37186499" style="OLC">
					<subsection id="IDe391a500efbd42a8b10475d8a07ed4b0"><enum>(b)</enum><text>A pre-dispute
				arbitration agreement between a long-term care facility and a resident of a
				long-term care facility (or anyone acting on behalf of such a resident,
				including a person with financial responsibility for that resident) shall not
				be valid or specifically enforceable.</text>
					</subsection><subsection id="ID9af131b57f8849b8b871da4bb90b3cae"><enum>(c)</enum><text>This section
				shall apply to any pre-dispute arbitration agreement between a long-term care
				facility and a resident (or anyone acting on behalf of such a resident), and
				shall apply to a pre-dispute arbitration agreement entered into either at any
				time during the admission process or at any time thereafter.</text>
					</subsection><subsection id="ID2ce2cd75df4e4f928a9be62d93d58379"><enum>(d)</enum><text>A determination
				as to whether this chapter applies to an arbitration agreement described in
				subsection (b) shall be determined by Federal law. Except as otherwise provided
				in this chapter, the validity or enforceability of such an agreement to
				arbitrate shall be determined by the court, rather than the arbitrator,
				irrespective of whether the party resisting the arbitration challenges the
				arbitration agreement specifically or in conjunction with other terms of the
				contract containing such
				agreement.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id0F8D438419484482AEE5422DCF5E8542"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on the date of the enactment of
			 this Act and shall apply with respect to any dispute or claim that arises on or
			 after such date.</text>
