			 Washington County Wilderness Map</header><text>The term <term>Northeastern
			 Washington County Wilderness Map</term> means the map entitled
			 <quote>Northeastern Washington County Wilderness</quote> and dated March 20,
			 2008.</text>
			</paragraph><paragraph id="idC892DB543C2641ED9DF15EECB8B00CC1"><enum>(4)</enum><header>Northwestern
			 Washington County Wilderness Map</header><text>The term <term>Northwestern
			 Washington County Wilderness Map</term> means the map entitled
			 <quote>Northwestern Washington County Wilderness</quote> and dated March 20,
			 2008.</text>
			</paragraph><paragraph id="id8BD9806E4F1A492BA4AD9D49A1C105C4"><enum>(5)</enum><header>Red Cliffs
			 National Conservation Area Map</header><text>The term <term>Red Cliffs National
			 Conservation Area Map</term> means the map entitled <quote>Red Cliffs National
			 Conservation Area</quote> and dated March 20, 2008.</text>
			</paragraph><paragraph id="idABDC9CB28B764961A4654C806B43305C"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id83F77FA59AC14788B2111FEFF46AD672"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Utah.</text>
			</paragraph><paragraph id="id7675F28C471B4176870B4BDC1A5A6B8A"><enum>(8)</enum><header>Washington

			 County Growth and Conservation Act Map</term> means the map entitled

			</paragraph></section><title id="id4106BA6A35884201AA381830E528A2F6"><enum>I</enum><header>Wilderness
			 areas</header>
			<section id="ID5fc905c929ff47ab9238038039d5f9d8"><enum>101.</enum><header>Additions to
			 National Wilderness Preservation System</header>
				<subsection id="IDb4dc7d7723de47a6805c429669d1f6da"><enum>(a)</enum><header>Additions</header><text>The
			 following land in the State is designated as wilderness and as components of
			 the National Wilderness Preservation System:</text>
					<paragraph id="ID085d4ea26c034c00bda99f2dd737c16f"><enum>(1)</enum><header>Beartrap
			 Canyon</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 40 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Beartrap Canyon Wilderness</quote>.</text>
					</paragraph><paragraph id="IDe2f4d9352aa44f17825d535c3989948d"><enum>(2)</enum><header>Blackridge</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 13,120 acres, as generally depicted on the Northeastern Washington County
			 Wilderness Map, which shall be known as the <quote>Blackridge
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="ID308e44ca8f1c4366bf9defda9841523a"><enum>(3)</enum><header>Canaan
			 mountain</header><text>Certain Federal land in the County managed by the Bureau
			 of Land Management, comprising approximately 44,395 acres, as generally
			 depicted on the Canaan Mountain Wilderness Map, which shall be known as the
			 <quote>Canaan Mountain Wilderness</quote>.</text>
					</paragraph><paragraph id="ID24909836eb344fdcbbfffa0d6b9d7cfd"><enum>(4)</enum><header>Cottonwood</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 11,650 acres, as generally depicted on the Red Cliffs National Conservation
			 Area Map, which shall be known as the <quote>Cottonwood
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="IDdf92157634e84b05b1b75ec98ab40fa6"><enum>(5)</enum><header>Cottonwood
			 forest</header><text>Certain Federal land managed by the Forest Service,
			 comprising approximately 2,643 acres, as generally depicted on the Red Cliffs
			 National Conservation Area Map, which shall be known as the <quote>Cottonwood
			 Forest Wilderness</quote>.</text>
					</paragraph><paragraph id="ID022657edb89a41088407340e1cb25449"><enum>(6)</enum><header>Cougar
			 canyon</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 10,409 acres, as generally depicted on the
			 Northwestern Washington County Wilderness Map, which shall be known as the
			 <quote>Cougar Canyon Wilderness</quote>.</text>
					</paragraph><paragraph id="ID085d7f52bcfd46e78921bd5a3c13df20"><enum>(7)</enum><header>Deep
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 3,284 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Deep Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="IDe03e7e906c4d4e9085a94c4694d302ad"><enum>(8)</enum><header>Deep Creek
			 North</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 4,262 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Deep Creek North Wilderness</quote>.</text>
					</paragraph><paragraph id="IDbec368307e0549f5a899f2f497d1444f"><enum>(9)</enum><header>Doc’s
			 Pass</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 17,294 acres, as generally depicted on the
			 Northwestern Washington County Wilderness Map, which shall be known as the
			 <quote>Doc’s Pass Wilderness</quote>.</text>
					</paragraph><paragraph id="IDf77dd25ced7a4d5fa7666c67ee9bc63f"><enum>(10)</enum><header>Dry
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 8,149 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Dry Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="ID54ade699acb148059e72d0e8c2855a8d"><enum>(11)</enum><header>Goose
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 98 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Goose Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="ID69eab566c49d4242a169c04cf6d1f2a3"><enum>(12)</enum><header>Laverkin
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 445 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>LaVerkin Creek Wilderness</quote> .</text>
					</paragraph><paragraph id="ID598fd2770c5246b0ad2f4a6745b7cddb"><enum>(13)</enum><header>Red
			 Butte</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 1,537 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Red Butte Wilderness</quote>.</text>
					</paragraph><paragraph id="ID5828d576958947dfaff3181bb551c113"><enum>(14)</enum><header>Red
			 Mountain</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 18,729 acres, as generally depicted on the
			 Red Cliffs National Conservation Area Map, which shall be known as the
			 <quote>Red Mountain Wilderness</quote>.</text>
					</paragraph><paragraph id="IDdf376c49e18943a9948f5ffd26c07189"><enum>(15)</enum><header>Slaughter
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 3,901 acres, as generally depicted on the
			 Northwestern Washington County Wilderness Map, which shall be known as the
			 <quote>Slaughter Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="ID625fc9f33f824c2b8a3834373342814b"><enum>(16)</enum><header>Taylor
			 Creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 32 acres, as generally depicted on the
			 Northeastern Washington County Wilderness Map, which shall be known as the
			 <quote>Taylor Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="IDa65e313bc64948f29cdb986520a86b9d"><enum>(17)</enum><header>Watchman</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 663 acres, as generally depicted on the Northeastern Washington County
			 Wilderness Map, which shall be known as the <quote>Watchman
			 Wilderness</quote>.</text>
					</paragraph></subsection><subsection id="id5EEDC2B9C76048C5B2D373C9CE4D7D69"><enum>(b)</enum><header>Maps and legal
			 descriptions</header>
					<paragraph id="idBD2B1389C6C447D1AA1ED1DAECE91A6D"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives a map and legal description of each wilderness area designated
			 by subsection (a).</text>
					</paragraph><paragraph id="id0D41D5A867A6478A9572C2F112445D52"><enum>(2)</enum><header>Force and
			 effect</header><text>Each map and legal description submitted under paragraph
			 (1) shall have the same force and effect as if included in this Act, except
			 that the Secretary may correct any clerical or typographical errors in the map
			 or legal description.</text>
					</paragraph><paragraph id="idEC5D2D7570DE439AB9B578FB1940A84B"><enum>(3)</enum><header>Availability</header><text>Each
			 map and legal description submitted under paragraph (1) shall be available in
			 the appropriate offices of—</text>
						<subparagraph id="id3733D0C77D0A47E49EF355DADF902D79"><enum>(A)</enum><text>the Bureau of
			 Land Management; and</text>
						</subparagraph><subparagraph id="id90ECD4D1447D4BAB9ADECCB635B101B1"><enum>(B)</enum><text>the Forest
			 Service.</text>
						</subparagraph></paragraph></subsection><subsection id="ID5cfd0f844d7141bf9c1334b44b3388e5"><enum>(c)</enum><header>Boundary</header><text>The
			 boundary of any portion of a wilderness area designated by subsection (a) that
			 is bordered by a road shall be at least 100 feet from the center line of the
			 road to allow public access.</text>
				</subsection></section><section id="ID629127a1ece348eaa276da0cbab44d1e"><enum>102.</enum><header>Administration
			 of wilderness areas</header>
				<subsection id="ID9fc8cb0ca8fb4ac1a53850b8dc3abaf1"><enum>(a)</enum><header>Management</header><text>Subject
			 to valid existing rights, each area designated as wilderness by section 101(a)
			 shall be administered by the Secretary in accordance with the Wilderness Act
			 (16 U.S.C. 1131 et seq.), except that—</text>
					<paragraph id="IDe73f2cb4cf8546d3aa8b5a2ae26eac49"><enum>(1)</enum><text>any reference in
			 that Act to the effective date shall be considered to be a reference to the
			 date of enactment of this Act; and</text>
					</paragraph><paragraph id="IDc48465b3692a47c69319cdf6e890725e"><enum>(2)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary with respect to land under the jurisdiction of the
			 Secretary.</text>
					</paragraph></subsection><subsection id="id6F0A905D375A4F91A5526990014737D9"><enum>(b)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, each area designated as wilderness by section 101(a)
			 is withdrawn from—</text>
					<paragraph id="id15C3440156A8430D99E8B91CEE9BE0D4"><enum>(1)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
					</paragraph><paragraph id="id039801144ACC4D42B53102CCE4CBE3B8"><enum>(2)</enum><text>location, entry,
			 and patenting under the mining laws; and</text>
					</paragraph><paragraph id="idF4C2E9885E874579B1C034CD9083B68A"><enum>(3)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</paragraph></subsection><subsection id="idC3D70807112B4A2887E9BF4C9766BA27"><enum>(c)</enum><header>Livestock</header><text>The
			 grazing of livestock in each area designated as wilderness by section 101(a),
			 where established before the date of enactment of this Act, shall be permitted
			 to continue—</text>
					<paragraph id="ID785a5520a21b44899ea0e89e4a12f81b"><enum>(1)</enum><text>subject to such
			 reasonable regulations, policies, and practices that the Secretary considers
			 necessary; and</text>
					</paragraph><paragraph id="id347A32EB8F8B4239916E0916F89AF756"><enum>(2)</enum><text>consistent
			 with—</text>
						<subparagraph id="id13D2CFC294CF4918B90160D10F956E59"><enum>(A)</enum><text>section 4(d)(4)
			 of the Wilderness Act (16 U.S.C. 1133(d)(4)); and</text>
						</subparagraph><subparagraph id="idD1BB3EDE0FDF422AB35FFE62A195EE4E"><enum>(B)</enum><text>the guidelines
			 set forth in Appendix A of House Report 101–405.</text>
						</subparagraph></paragraph></subsection><subsection id="ID524b12e9707342a9b33fd0e7b8ec952e"><enum>(d)</enum><header>Wildfire,
			 insect, and disease management</header><text>In accordance with section 4(d)(1)
			 of the Wilderness Act (16 U.S.C. 1133(d)(1)), the Secretary may take such
			 measures in each area designated as wilderness by section 101(a) as the
			 Secretary determines to be necessary for the control and prevention of fire,
			 insects, and diseases (including coordination of initiatives with any State or
			 local agency that the Secretary determines to be appropriate).</text>
				</subsection><subsection id="ID399b6ce63c234f59bcccc55975d31c59"><enum>(e)</enum><header>Buffer
			 zones</header>
					<paragraph id="IDb3b21c9406b64d82a202991ae0d1bf57"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this title creates a protective perimeter or
			 buffer zone around any area designated as wilderness by section 101(a).</text>
					</paragraph><paragraph id="ID293ce9c4cfea4d7990a57ea558afe0ea"><enum>(2)</enum><header>Activities
			 outside conservation area or wilderness</header><text>The fact that an activity
			 or use on land outside any area designated as wilderness by section 101(a) can
			 be seen or heard within the wilderness shall not preclude the activity or use
			 outside the boundary of the wilderness.</text>
					</paragraph></subsection><subsection id="IDd7473d4589cd41ae87fcefd4a6ea3177"><enum>(f)</enum><header>Military
			 overflights</header><text>Nothing in this title restricts or precludes—</text>
					<paragraph id="IDbaafdeb946c840ebb3576232f72f2979"><enum>(1)</enum><text>low-level
			 overflights of military aircraft over any area designated as wilderness by
			 section 101(a), including military overflights that can be seen or heard within
			 any wilderness area;</text>
					</paragraph><paragraph id="ID99279919861f4a678f95d8b6e405c2a9"><enum>(2)</enum><text>flight testing
			 and evaluation; or</text>
					</paragraph><paragraph id="IDe01c6dfb3672494984a1dca7f1484bef"><enum>(3)</enum><text>the designation
			 or creation of new units of special use airspace, or the establishment of
			 military flight training routes over any wilderness area.</text>
					</paragraph></subsection><subsection id="IDb0faa6eb71b2437793557c53086ae1c5"><enum>(g)</enum><header>Acquisition and
			 incorporation of land and interests in land</header>
					<paragraph id="idA4BDED3BCC6E442B87FDB14D21FCB8F3"><enum>(1)</enum><header>Acquisition
			 authority</header><text>In accordance with applicable laws (including
			 regulations), the Secretary may acquire from willing sellers, or through a
			 voluntary donation or exchange, any land or interest in land that is located in
			 any area designated as wilderness by section 101(a).</text>
					</paragraph><paragraph id="idD944D63BE97949DE9FB4439F7288E23A"><enum>(2)</enum><header>Incorporation</header><text>Any
			 land or interest in land acquired by the Secretary under paragraph (1) shall be
			 incorporated into, and administered as a part of, the wilderness area in which
			 the land or interest in land is located.</text>
					</paragraph></subsection><subsection id="IDb8edc217967748c485c9813b75cd977f"><enum>(h)</enum><header>Native American
			 cultural and religious uses</header><text display-inline="yes-display-inline">Nothing in this title diminishes—</text>
					<paragraph id="ID07274db08c7c436aa104dfd97bb52eac"><enum>(1)</enum><text>the rights of any
			 Indian tribe; or</text>
					</paragraph><paragraph id="IDbacfff5453594a16be0fcb1d1e7ffecf"><enum>(2)</enum><text>any tribal rights
			 regarding access to Federal land for tribal activities, including spiritual,
			 cultural, and traditional food-gathering activities.</text>
					</paragraph></subsection><subsection id="ID40b48f59a27142148eb10f18e48c5fdc"><enum>(i)</enum><header>Climatological
			 data collection</header><text>Consistent with the Wilderness Act (16 U.S.C.
			 1131 et seq.), subject to such terms and conditions as the Secretary may
			 prescribe, nothing in this title precludes the Secretary from authorizing the
			 installation and maintenance of hydrologic, meteorologic, or climatological
			 collection devices in the wilderness areas designated by section 101(a) if the
			 Secretary determines that the facilities and access to the facilities are
			 essential to flood warning, flood control, or water reservoir operation
			 activities.</text>
				</subsection><subsection id="IDf81d4be992704eca89e50870766f9ae3"><enum>(j)</enum><header>Water
			 rights</header>
					<paragraph id="ID1ca2be7d3435430e8367b29131642aa7"><enum>(1)</enum><header>Statutory
			 construction</header><text>Nothing in this title—</text>
						<subparagraph id="IDd5ab4997f7e34e15aebb70d0f0e76de6"><enum>(A)</enum><text>shall constitute
			 or be construed to constitute either an express or implied reservation by the
			 United States of any water or water rights with respect to the land designated
			 as wilderness by section 101(a);</text>
						</subparagraph><subparagraph id="ID8a13918ae8954c2daf001524236bc599"><enum>(B)</enum><text>shall affect any
			 water rights in the State existing on the date of enactment of this Act,
			 including any water rights held by the United States;</text>
						</subparagraph><subparagraph id="IDdfb430092d8f4f04bb7166bbc789dfb6"><enum>(C)</enum><text>shall be
			 construed as establishing a precedent with regard to any future wilderness
			 designations;</text>
						</subparagraph><subparagraph id="ID4d31c50a7d9d4fd4a175f44d5cde6c4e"><enum>(D)</enum><text>shall affect the
			 interpretation of, or any designation made pursuant to, any other Act;
			 or</text>
						</subparagraph><subparagraph id="IDd9d1f3cc604349c480e0449c956a80f8"><enum>(E)</enum><text>shall be
			 construed as limiting, altering, modifying, or amending any of the interstate
			 compacts or equitable apportionment decrees that apportion water among and
			 between the State and other States.</text>
						</subparagraph></paragraph><paragraph id="ID42da900c0ce74e2db5b0e94db14b0bda"><enum>(2)</enum><header>State water
			 law</header><text>The Secretary shall follow the procedural and substantive
			 requirements of the law of the State in order to obtain and hold any water
			 rights not in existence on the date of enactment of this Act with respect to
			 the wilderness areas designated by section 101(a).</text>
					</paragraph></subsection><subsection id="IDf2c2776c5bc74726be23604b054369eb"><enum>(k)</enum><header>Fish and
			 wildlife</header>
					<paragraph id="ID7b509af9dc524b208e1ac3846c377f42"><enum>(1)</enum><header>Jurisdiction of
			 State</header><text>Nothing in this title affects the jurisdiction of the State
			 with respect to fish and wildlife on public land located in the State.</text>
					</paragraph><paragraph id="ID02f34dc75b0248829f0bcddbba6ed767"><enum>(2)</enum><header>Authority of
			 Secretary</header><text>In furtherance of the purposes and principles of the
			 management activities under the Wilderness Act (16 U.S.C. 1131 et seq.), the
			 Secretary may carry out management activities to maintain or restore fish and
			 wildlife populations (including activities to maintain and restore fish and
			 wildlife habitats to support the populations) in any wilderness area designated
			 by section 101(a) if the activities are—</text>
						<subparagraph id="idC019D6F9DD464645AA9B85633B2FA007"><enum>(A)</enum><text>consistent with
			 applicable wilderness management plans; and</text>
						</subparagraph><subparagraph id="idC506B5D52EE14E3FA6F724E4A11C9E48"><enum>(B)</enum><text>carried out in
			 accordance with—</text>
							<clause id="id5292E49936F747A8B166B47034415521"><enum>(i)</enum><text>the
			 Wilderness Act (16 U.S.C. 1131 et seq.); and</text>
							</clause><clause id="id1D007E0FB9234E6481580FAF628A181D"><enum>(ii)</enum><text>applicable
			 guidelines and policies, including applicable policies described in Appendix B
			 of House Report 101–405, including the occasional and temporary use of
			 motorized vehicles if the Secretary determines that the use would—</text>
								<subclause id="id17630052D2DF44349E01769298D4B345"><enum>(I)</enum><text>promote healthy,
			 viable, and more naturally distributed wildlife populations that would enhance
			 wilderness values; and</text>
								</subclause><subclause id="id2B2A16DEDFC2482D858EC2CAFDF9C894"><enum>(II)</enum><text>ensure the
			 accomplishment of the goals described in subclause (I) with a minimal necessary
			 degree of impact to the wilderness.</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID345f384e2c994f2e8dff8c63411f67c5"><enum>(l)</enum><header>Use of aircraft
			 by State</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (16 U.S.C. 1133(d)(1)) and in accordance with appropriate policies such as
			 those set forth in Appendix B of House Report 101–405, the State may use
			 aircraft, including helicopters, to survey, capture, transplant, monitor, and
			 provide water for wildlife populations.</text>
				</subsection><subsection id="idCA0EA6E7669A47D6B08DAEB1242D78A2"><enum>(m)</enum><header>Wildlife water
			 development projects</header><text>Subject to subsection (n), the Secretary may
			 authorize structures and facilities, including existing structures and
			 facilities, for wildlife water development projects, including guzzlers, in the
			 wilderness areas designated by section 101(a) if—</text>
					<paragraph id="id4808AEE013EB4F789588DF85F262272B"><enum>(1)</enum><text>the structures
			 and facilities will, as determined by the Secretary, enhance wilderness values
			 by promoting healthy, viable, and more naturally distributed wildlife
			 populations; and</text>
					</paragraph><paragraph id="idDACD94991F104D5EB07887EAC2232E7A"><enum>(2)</enum><text>the visual
			 impacts of the structures and facilities on the wilderness areas can reasonably
			 be minimized.</text>
					</paragraph></subsection><subsection id="IDf363034140844fbda894e75fada9b37f"><enum>(n)</enum><header>Cooperative
			 agreement</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary shall enter into a cooperative agreement with the State
			 that specifies the terms and conditions under which the State or a designee of
			 the State may carry out wildlife management activities in the wilderness areas
			 designated by section 101(a).</text>
				</subsection></section><section id="ID46d6be71f1184065897fdfe488b646d5"><enum>103.</enum><header>Release of
			 wilderness study areas</header>
				<subsection id="ID51dd47253c164ffaa717b52a93901940"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that, for the purposes of section 603 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1782), any public land in the County
			 administered by the Bureau of Land Management has been adequately studied for
			 wilderness designation.</text>
				</subsection><subsection id="IDf5b8242c4f8647968d13f18d55e8fbea"><enum>(b)</enum><header>Release</header><text>Any
			 public land described in subsection (a) that is not designated as wilderness by
			 section 101(a)—</text>
					<paragraph id="IDaf5c6f84d76649c588f0baa2f0dc7c55"><enum>(1)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1782(c)); and</text>
					</paragraph><paragraph id="ID116fb4a6e82e4dc597562f4f47ba200e"><enum>(2)</enum><text>shall be managed
			 in accordance with land management plans adopted under section 202 of that Act
			 (43 U.S.C. 1712).</text>
					</paragraph></subsection></section></title><title id="idACABCC421BE24CA7BC42E6780A6E15C5"><enum>II</enum><header>Zion National
			 Park wilderness</header>
			<section id="idCBD7DD459422480AA51BDC3A2B9BEB3D"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="id3666B1320E8D40B4BA9B88925F3BF950"><enum>(1)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the parcel of
			 land—</text>
					<subparagraph id="id9754C276DCD14106B07E54D320E60FB0"><enum>(A)</enum><text>that is—</text>
						<clause id="idC2242D0A328E4A0FBE413B72E9804A94"><enum>(i)</enum><text>located in the
			 County; and</text>
						</clause><clause id="id59D07B1C74864C0485095CD1738C768C"><enum>(ii)</enum><text>managed by the
			 Director of the National Park Service;</text>
						</clause></subparagraph><subparagraph id="id4BE8BC89F2D04601B721578D4BE8FC99"><enum>(B)</enum><text>consisting of
			 approximately 123,743 acres; and</text>
					</subparagraph><subparagraph id="idD3C959529EEF4BD3851F8B7A1F45A3F9"><enum>(C)</enum><text>as generally
			 depicted on the Zion National Park Wilderness Map.</text>
					</subparagraph></paragraph><paragraph id="id331E08508072499187B31C03CF77B984"><enum>(2)</enum><header>Wilderness
			 Area</header><text>The term <term>Wilderness Area</term> means the Zion
			 Wilderness designated by section 202(a).</text>
				</paragraph><paragraph id="idF78BC9250AB544B3949D0D0DD42AEF42"><enum>(3)</enum><header>Zion National
			 Park Wilderness Map</header><text>The term <term>Zion National Park Wilderness
			 Map</term> means the map entitled <quote>Zion National Park Wilderness</quote>
			 and dated April 2008.</text>
				</paragraph></section><section id="id55217C6B5E3F429F928512D1F527C769"><enum>202.</enum><header>Zion National
			 Park wilderness</header>
				<subsection id="ID094a0da1691d4ddfacd19622b611d0ff"><enum>(a)</enum><header>Designation</header><text>Subject
			 to valid existing rights, there is designated as wilderness and as a component
			 of the National Wilderness Preservation System the Federal land, to be known as
			 the <quote>Zion Wilderness</quote>.</text>
				</subsection><subsection id="id4B735D0AF7E04722AF21D6382667BA58"><enum>(b)</enum><header>Incorporation
			 of acquired land</header><text>Any land located in the Zion National Park that
			 is acquired by the Director of the National Park Service through a voluntary
			 sale, exchange, or donation may, on the recommendation of the Secretary, become
			 part of the Wilderness Area, in accordance with the Wilderness Act (16 U.S.C.
			 1131 et seq.).</text>
				</subsection><subsection id="IDd9e13ef68ad3429b9094f38274174184"><enum>(c)</enum><header>Map and legal
			 description</header>
					<paragraph id="IDb787221d06cf49b48509fab5ec42e9cc"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives a map and legal description of the Wilderness Area.</text>
					</paragraph><paragraph id="IDb479df2d4a7e41ad9ecc8027d2fd0de6"><enum>(2)</enum><header>Force and
			 effect</header><text>The map and legal description submitted under paragraph
			 (1) shall have the same force and effect as if included in this Act, except
			 that the Secretary may correct any clerical or typographical errors in the map
			 or legal description.</text>
					</paragraph><paragraph id="IDce56deab20804aee86f5732991fd0820"><enum>(3)</enum><header>Availability</header><text>The
			 map and legal description submitted under paragraph (1) shall be available in
			 the appropriate offices of the National Park Service.</text>
					</paragraph></subsection></section></title><title id="id86B2B1BDFE144E2388C337BA6738F626"><enum>III</enum><header>Red Cliffs
			 National Conservation Area</header>
			<section id="idADFAA3C347CD4434B1E17650A662708C"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>Red Cliffs National Conservation Area Act</quote>.</text>
			</section><section id="id7968EB45382B4E30AC0EFA95824492EF"><enum>302.</enum><header>Red Cliffs
			 National Conservation Area</header>
				<subsection id="id6EE45A3BBD694CDE8955B1D4C00A3F68"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of this title are—</text>
					<paragraph id="id54BB2F29868D4AABBE4D605628443167"><enum>(1)</enum><text>to conserve,
			 protect, and enhance for the benefit and enjoyment of future generations the
			 ecological, wildlife, recreational, cultural, historical, natural, educational,
			 and paleontological resources of the National Conservation Area; and</text>
					</paragraph><paragraph id="id31823CD9603D47DD871A8E3EDC962E91"><enum>(2)</enum><text>to protect each
			 species that is—</text>
						<subparagraph id="id91925008E4B944908874ECB10143000A"><enum>(A)</enum><text>located in the
			 National Conservation Area; and</text>
						</subparagraph><subparagraph id="id811E3492387849B5B2E6D96625733775"><enum>(B)</enum><text>listed as an
			 endangered species on the list of endangered species published under section
			 4(c)(1) of the Endangered Species Act of 1973 (16 U.S.C. 1533(c)(1)).</text>
						</subparagraph></paragraph></subsection><subsection id="idD964825E733A4C2BAB575DEA0B6F7708"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id2DBAB52401B142008758B587658EC42F"><enum>(1)</enum><header>Habitat
			 conservation plan</header><text>The term <term>habitat conservation plan</term>
			 means the conservation plan entitled <quote>Washington County Habitat
			 Conservation Plan</quote> and dated December 1995.</text>
					</paragraph><paragraph id="id42A17D3617954AF08401C4EB4F4C5C2D"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the National Conservation Area developed by the Secretary under
			 subsection (d)(1).</text>
					</paragraph><paragraph id="id9A89E96B52DC4AE38BCB46EFB17611C8"><enum>(3)</enum><header>National
			 Conservation Area</header><text>The term <term>National Conservation
			 Area</term> means the Red Cliffs National Conservation Area that—</text>
						<subparagraph id="id739904A0B3C1453AAAA4AB7C8E5FB558"><enum>(A)</enum><text>consists of
			 approximately 44,695 acres of public land in the County, as generally depicted
			 on the Red Cliffs National Conservation Area Map; and</text>
						</subparagraph><subparagraph id="id35A5A2FEEC54471F8627975E04401E71"><enum>(B)</enum><text>is established by
			 subsection (c).</text>
						</subparagraph></paragraph><paragraph id="id0DBB55F40FF04B178C4C1AF889FBF782"><enum>(4)</enum><header>Public use
			 plan</header><text>The term <term>public use plan</term> means the use plan
			 entitled <quote>Red Cliffs Desert Public Use Plan</quote> and dated June 12,
			 2000.</text>
					</paragraph><paragraph id="id81480575795248AB8CE3C8EDD93865A9"><enum>(5)</enum><header>Resource
			 management plan</header><text>The term <term>resource management plan</term>
			 means the management plan entitled <quote>St. George Field Office Resource
			 Management Plan</quote> and dated March 15, 1999.</text>
					</paragraph></subsection><subsection id="id6C3AAA23214F4A6FA09183D947703ABA"><enum>(c)</enum><header>Establishment</header><text>Subject
			 to valid existing rights, there is established in the State the Red Cliffs
			 National Conservation Area.</text>
				</subsection><subsection id="idE7878F3A15FE4FF39FAD954426CB7555"><enum>(d)</enum><header>Management
			 plan</header>
					<paragraph id="id1E13D4835B774DD796D8F228EBE9C098"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, in accordance with paragraph (2), the Secretary shall develop a
			 comprehensive plan for the long-term management of the National Conservation
			 Area.</text>
					</paragraph><paragraph id="idFD257A1A4D2F4D6495A96351A8337B48"><enum>(2)</enum><header>Consultation</header><text>In
			 developing the management plan required under paragraph (1), the Secretary
			 shall consult with—</text>
						<subparagraph id="id00C8C9353BA949C5BD4394F8C567A1BD"><enum>(A)</enum><text>appropriate State
			 and local governmental entities; and</text>
						</subparagraph><subparagraph id="idAB77DCD3C2C5453997E61D2A091ACE23"><enum>(B)</enum><text>members of the
			 public.</text>
						</subparagraph></paragraph><paragraph id="idF08E449CE7E540ED9B657124BDAAE6EB"><enum>(3)</enum><header>Incorporation
			 of plans</header><text>In developing the management plan required under
			 paragraph (1), to the extent consistent with this title, the Secretary may
			 incorporate any provision of—</text>
						<subparagraph id="id38661069C5EA467B8E8C1932C2CA1484"><enum>(A)</enum><text>the habitat
			 conservation plan;</text>
						</subparagraph><subparagraph id="idDFDB6E03AD384E469614AE984D32E03A"><enum>(B)</enum><text>the resource
			 management plan; and</text>
						</subparagraph><subparagraph id="id4F1BA6672A5944F5BC5BE4E5DFE191A5"><enum>(C)</enum><text>the public use
			 plan.</text>
						</subparagraph></paragraph></subsection><subsection id="id79B810FF2C0A453EB8BA93C3D2353901"><enum>(e)</enum><header>Management</header>
					<paragraph id="id93BC9408890B498E83CF473D10E19D58"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the National Conservation
			 Area—</text>
						<subparagraph id="idBAA8E19388984C41B7C680748A938C48"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the National Conservation
			 Area; and</text>
						</subparagraph><subparagraph id="id37842F409F6C4CB4BF7F9F264E6467A1"><enum>(B)</enum><text>in accordance
			 with—</text>
							<clause id="id6E292149D36647BC9C0E0029A2BC5A9E"><enum>(i)</enum><text>the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1701 et seq.);</text>
							</clause><clause id="id2C979C9B7C0149FA9AFECA8550B0B259"><enum>(ii)</enum><text>this title;
			 and</text>
							</clause><clause id="id8A4D253F24B14E15B8168382B39B7370"><enum>(iii)</enum><text>any other
			 applicable law (including regulations).</text>
							</clause></subparagraph></paragraph><paragraph id="id2F11EF905CE446B6942B5A9209B34C3B"><enum>(2)</enum><header>Uses</header><text>The
			 Secretary shall only allow uses of the National Conservation Area that the
			 Secretary determines would further a purpose described in subsection
			 (a).</text>
					</paragraph><paragraph id="id55B7D9C062214343813BCB03D81FB8C8"><enum>(3)</enum><header>Motorized
			 vehicles</header><text>Except in cases in which motorized vehicles are needed
			 for administrative purposes, or to respond to an emergency, the use of
			 motorized vehicles in the National Conservation Area shall be permitted only on
			 roads designated by the management plan for the use of motorized
			 vehicles.</text>
					</paragraph><paragraph id="id2247F53C31994BC5A755F3B41327E227"><enum>(4)</enum><header>Grazing</header><text>The
			 Secretary shall allow grazing to continue in any area of the National
			 Conservation Area in which grazing is allowed before the date of enactment of
			 this Act—</text>
						<subparagraph id="id86178C87F73A459F96F0BB058AE20833"><enum>(A)</enum><text>subject to
			 any—</text>
							<clause id="idF47CBA4D4ED14074820B9A1FB5B26688"><enum>(i)</enum><text>applicable law
			 (including regulations); and</text>
							</clause><clause id="id90A99AA04C5A4F66BF3CC455F69EF637"><enum>(ii)</enum><text>Executive order;
			 and</text>
							</clause></subparagraph><subparagraph id="idC80AD085AEA247EDAD7427A16744F534"><enum>(B)</enum><text>in a manner
			 consistent with the purposes described in subsection (a).</text>
						</subparagraph></paragraph><paragraph id="id47143A48D65343CF8EF1924A0DFBC1F9"><enum>(5)</enum><header>Wildland fire
			 operations</header><text>Nothing in this title prohibits the Secretary, in
			 cooperation with other Federal, State, and local agencies, as appropriate, from
			 conducting wildland fire operations in the National Conservation Area.</text>
					</paragraph></subsection><subsection id="id073EE8F6110D475184E878F7365AB647"><enum>(f)</enum><header>Incorporation
			 of acquired land and interests</header><text>Any land or interest in land that
			 is located in the National Conservation Area that is acquired by the United
			 States shall—</text>
					<paragraph id="id2F2778E3A4684933AD9E02A17DAED1C1"><enum>(1)</enum><text>become part of
			 the National Conservation Area; and</text>
					</paragraph><paragraph id="id1F6445CF3A1C453B9F6452AFFE463CC9"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
						<subparagraph id="id44C1D5F5AFAF4D63AB744A29549F5826"><enum>(A)</enum><text>the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1701 et seq.);</text>
						</subparagraph><subparagraph id="idC1B406885E63449DA0E993A9B85EB2A2"><enum>(B)</enum><text>this title;
			 and</text>
						</subparagraph><subparagraph id="id18E8F610F2DE475781FC5F24B61010F7"><enum>(C)</enum><text>any other
			 applicable law (including regulations).</text>
						</subparagraph></paragraph></subsection><subsection id="idBA892692E43544FC90280B433B2F3575"><enum>(g)</enum><header>Withdrawal</header>
					<paragraph id="id1CAA7D410AB74718A72CA1DE8A032329"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, all Federal land
			 located in the National Conservation Area are withdrawn from—</text>
						<subparagraph id="id7BBAAE58E9544937BA8256A61BDCABD7"><enum>(A)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
						</subparagraph><subparagraph id="id69C26CAAB3344C2590998CA5D11E1257"><enum>(B)</enum><text>location, entry,
			 and patenting under the mining laws; and</text>
						</subparagraph><subparagraph id="id554BF2F54FC749B7B5EA2C905ED4AF73"><enum>(C)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
						</subparagraph></paragraph><paragraph id="id9494B714322A45D99CC4A8F7C0786E44"><enum>(2)</enum><header>Additional
			 land</header><text>If the Secretary acquires additional land that is located in
			 the National Conservation Area after the date of enactment of this Act, the
			 land is withdrawn from operation of the laws referred to in paragraph (1) on
			 the date of acquisition of the land.</text>
					</paragraph></subsection><subsection id="id97210A4D77434D69B40A980881309B9A"><enum>(h)</enum><header>Effect</header><text>Nothing
			 in this title prohibits the authorization of the development of water resources
			 within the National Conservation Area if the development is carried out in
			 accordance with—</text>
					<paragraph id="id90C9CCACD271463880FA193A5F99B40C"><enum>(1)</enum><text>each utility
			 development protocol described in the habitat conservation plan; and</text>
					</paragraph><paragraph id="id1F25C49CF8654565B158480C94165DB0"><enum>(2)</enum><text>any other
			 applicable law (including regulations).</text>
					</paragraph></subsection></section></title><title id="id323ED1168A2A4CB28A7E0DF7ACAA23B2"><enum>IV</enum><header>Beaver Dam Wash
			 National Conservation Area</header>
			<section id="IDa9a0fa4bd75742da9020ee4e01c1a0a3"><enum>401.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>Beaver Dam Wash National Conservation Area Act</quote>.</text>
			</section><section id="id61C02D4241AC48F4808F8DB3A58FFDD7"><enum>402.</enum><header>Beaver Dam
			 Wash National Conservation Area</header>
				<subsection id="IDad30e5ef2ef045cab088caf8faf18483"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this title is to conserve, protect, and enhance for the benefit and
			 enjoyment of future generations the cultural, archaeological, natural,
			 scientific, geological, historical, biological, wildlife, educational,
			 recreational, and scenic resources of the Beaver Dam Wash National Conservation
			 Area.</text>
				</subsection><subsection id="id825980C14B404221A462BA99B5A4086E"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="idF9C796421FAA47F9A470E5DE89BFD295"><enum>(1)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the National Conservation Area developed by the Secretary under
			 subsection (d)(1).</text>
					</paragraph><paragraph id="idFD820E798B28470BB3CE0BB08D31F070"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Beaver Dam Wash National
			 Conservation Area</quote> and dated March 20, 2008.</text>
					</paragraph><paragraph id="id501BD47DF2BC4E44827213B580226644"><enum>(3)</enum><header>National
			 Conservation Area</header><text>The term <term>National Conservation
			 Area</term> means the Beaver Dam Wash National Conservation Area that—</text>
						<subparagraph id="id91BA9B9C2595447FA66787E98EBABECB"><enum>(A)</enum><text>consists of
			 approximately 68,083 acres of public land in the County, as generally depicted
			 on the map; and</text>
						</subparagraph><subparagraph id="idCF8F4CD97D9F401BB130050D8A7C37BE"><enum>(B)</enum><text>is established by
			 subsection (c).</text>
						</subparagraph></paragraph></subsection><subsection id="id0B32D178B5FA4DCCA1DAB18FF3A95C89"><enum>(c)</enum><header>Establishment</header><text>Subject
			 to valid existing rights, there is established in the State the Beaver Dam Wash
			 National Conservation Area.</text>
				</subsection><subsection id="id351C75530160424B853A4A11BE4D47E5"><enum>(d)</enum><header>Management
			 plan</header>
					<paragraph id="id9B96ADCDECA04C98A0EB212BF36255C7"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, in accordance with paragraph (2), the Secretary shall develop a
			 comprehensive plan for the long-term management of the National Conservation
			 Area.</text>
					</paragraph><paragraph id="id4F6702C50F0245DAB88C69A24DB56D51"><enum>(2)</enum><header>Consultation</header><text>In
			 developing the management plan required under paragraph (1), the Secretary
			 shall consult with—</text>
						<subparagraph id="id9C222A55AA07484F90D1626E1226AF77"><enum>(A)</enum><text>appropriate State
			 and local governmental entities; and</text>
						</subparagraph><subparagraph id="id9119F1659E0446679EA15D5F1F529BB9"><enum>(B)</enum><text>members of the
			 public.</text>
						</subparagraph></paragraph></subsection><subsection id="ID254a97f036894186af98471804f606f9"><enum>(e)</enum><header>Management</header>
					<paragraph id="id8366FCBEF3A044728084A25F85124CF3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the National Conservation
			 Area—</text>
						<subparagraph id="id8C17F8B489B84C1884C54AFB857AC9CE"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the National Conservation
			 Area; and</text>
						</subparagraph><subparagraph id="id3908CCCD37C94DA08BBFA1BFCB5D522C"><enum>(B)</enum><text>in accordance
			 with—</text>
							<clause id="id935B3BC45EDC4C2789CC9A5D4242D847"><enum>(i)</enum><text>the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1701 et seq.);</text>
							</clause><clause id="id86CB320B27184B22B8F06A3060DE9097"><enum>(ii)</enum><text>this title;
			 and</text>
							</clause><clause id="idBF9A822807674DC4B4E36652983F1E23"><enum>(iii)</enum><text>any other
			 applicable law (including regulations).</text>
							</clause></subparagraph></paragraph><paragraph id="id0959BA05A072482E94339AE454527B40"><enum>(2)</enum><header>Uses</header><text>The
			 Secretary shall only allow uses of the National Conservation Area that the
			 Secretary determines would further the purpose described in subsection
			 (a).</text>
					</paragraph><paragraph id="ID63e6a6dedca245059923ba496c2ff6b8"><enum>(3)</enum><header>Motorized
			 vehicles</header><text>Except in cases in which motorized vehicles are needed
			 for administrative purposes, or to respond to an emergency, the use of
			 motorized vehicles in the National Conservation Area shall be permitted only on
			 roads designated by the management plan for the use of motorized
			 vehicles.</text>
					</paragraph><paragraph id="IDd936b24fec734142864f97336bb8c1af"><enum>(4)</enum><header>Grazing</header><text>The
			 Secretary shall allow grazing to continue in any area of the National
			 Conservation Area in which grazing is allowed before the date of enactment of
			 this Act—</text>
						<subparagraph id="id5BFDA6C57E0148DCB59C5F54FDAC021C"><enum>(A)</enum><text>subject to
			 any—</text>
							<clause id="id8DA5E9ED4A4549C7A3C08A1DAF159987"><enum>(i)</enum><text>applicable law
			 (including regulations); and</text>
							</clause><clause id="id670B4C69DAF9474D9B2D574C81C2E68B"><enum>(ii)</enum><text>Executive order;
			 and</text>
							</clause></subparagraph><subparagraph id="idC6F1458644EF4FBA83B4320199D87BE8"><enum>(B)</enum><text>in a manner
			 consistent with the purpose described in subsection (a).</text>
						</subparagraph></paragraph><paragraph id="ID70734cdca4fb47d6a5de85c3fd973078"><enum>(5)</enum><header>Wildland fire
			 operations</header><text>Nothing in this title prohibits the Secretary, in
			 cooperation with other Federal, State, and local agencies, as appropriate, from
			 conducting wildland fire operations in the National Conservation Area.</text>
					</paragraph></subsection><subsection id="ID989afe7494464f20b887f8c7bf22313c"><enum>(f)</enum><header>Incorporation
			 of acquired land and interests</header><text>Any land or interest in land that
			 is located in the National Conservation Area that is acquired by the United
			 States shall—</text>
					<paragraph id="id06FD52610A2D434F982287249D84AAAA"><enum>(1)</enum><text>become part of
			 the National Conservation Area; and</text>
					</paragraph><paragraph id="idF7AC95BEF0224916A92C07C04B313F16"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
						<subparagraph id="id35409F1EB343433292ED7CF92E8C7C0C"><enum>(A)</enum><text>the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1701 et seq.);</text>
						</subparagraph><subparagraph id="id419578A01D274269BC10B87E80499D7B"><enum>(B)</enum><text>this title;
			 and</text>
						</subparagraph><subparagraph id="idD36A6D21EA8D433387FD823DECB543AC"><enum>(C)</enum><text>any other
			 applicable law (including regulations).</text>
						</subparagraph></paragraph></subsection><subsection id="IDd65a4029a8e34683bd559ea4046fda2c"><enum>(g)</enum><header>Withdrawal</header>
					<paragraph id="id667E63081B384A708B719726903D9C13"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, all Federal land
			 located in the National Conservation Area are withdrawn from—</text>
						<subparagraph id="ID92db2d24394f40a9a0443b4260e3142d"><enum>(A)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
						</subparagraph><subparagraph id="ID87cdf61b1832488cb1d0dedc58f5b039"><enum>(B)</enum><text>location, entry,
			 and patenting under the mining laws; and</text>
						</subparagraph><subparagraph id="IDa0bf59c964e04fd88e146ad85192a1b2"><enum>(C)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
						</subparagraph></paragraph><paragraph id="idC97E04F29D3F4E38A1A044D8D03ECCA0"><enum>(2)</enum><header>Additional
			 land</header><text>If the Secretary acquires additional land that is located in
			 the National Conservation Area after the date of enactment of this Act, the
			 land is withdrawn from operation of the laws referred to in paragraph (1) on
			 the date of acquisition of the land.</text>
					</paragraph></subsection></section></title><title id="id1305A201B9704566ADEF348B082A0A75"><enum>V</enum><header>Wild
			 and scenic river designation</header>
			<section id="ID4409923403064f72bc8c5422bed9794f"><enum>501.</enum><header>Zion National
			 Park Wild and Scenic Rivers</header>
				<subsection id="idF883A45709AE4B7FA49DCF52EC545C9A"><enum>(a)</enum><header>Designation</header><text>Section
			 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) is amended—</text>
					<paragraph id="id6973EBFBC3D64D32958267865E977499"><enum>(1)</enum><text>by redesignating
			 paragraph (167) (relating to the Musconetcong River, New Jersey) as paragraph
			 (169);</text>

				Taylor Creek</header><text>The segment from the head of Middle Fork on Bureau
				of Land Management land to the junction with Taylor Creek and adjacent land

					</paragraph></subsection><subsection id="idBD992E69E7834600B7B6358A5FD724B8"><enum>(b)</enum><header>Incorporation
			 of acquired non-Federal land</header><text>If the United States acquires any
			 non-Federal land within or adjacent to Zion National Park that includes a river
			 segment that is contiguous to a river segment of the Virgin River designated as
			 a wild, scenic, or recreational river by paragraph (170) of section 3(a) of the
			 Wild and Scenic Rivers Act (16 U.S.C. 1274(a)), the acquired river segment
			 shall be incorporated in, and be administered as part of, the applicable wild,
			 scenic, or recreational river.</text>
				</subsection><subsection id="id069E86BE74C543029EE13A1101E99165"><enum>(c)</enum><header>Savings
			 clause</header><text>The amendment made by subsection (a)(4) does not affect
			 the agreement among the United States, the State, the Washington County Water
			 Conservancy District, and the Kane County Water Conservancy District entitled
			 <quote>Zion National Park Water Rights Settlement Agreement</quote> and dated
			 December 4, 1996.</text>
				</subsection></section></title><title id="id5998206CF27546B4BCE0D81BA24A0D06"><enum>VI</enum><header>Washington
			 County travel management plan</header>
			<section id="ID83258693627241f084128078fda6f824"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="id28E09BE51B264EEEB1AF747181D642C3"><enum>(1)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
					<subparagraph id="idA230DA7D1AE64ED5A8965B11429FD3C2"><enum>(A)</enum><text>the Secretary of
			 Agriculture (acting through the Chief of the Forest Service), with respect to
			 National Forest System land; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F5D46B4D2C44FA1BE152FE16CD9D388"><enum>(B)</enum><text>the Secretary,
			 with respect to land managed by the Bureau of Land Management.</text>
					</subparagraph></paragraph><paragraph id="id7053A351324F42B3AC7F3EE4AD6F5E36"><enum>(2)</enum><header>Trail</header><text>The
			 term <term>trail</term> means the High Desert Off-Highway Vehicle Trail
			 designated under section 603(a)(1).</text>
				</paragraph><paragraph id="ID9baf63d911f04a198aafa780e76346b0"><enum>(3)</enum><header>Travel
			 management plan</header><text>The term <term>travel management plan</term>
			 means the travel management plan developed under section 602(a)(1).</text>
				</paragraph></section><section id="IDb119d95ba1bd4e609cf834919ac089e1"><enum>602.</enum><header>Travel
			 management plan</header>
				<subsection id="ID5e9f60dc76064a29ad1297b0a505dc6c"><enum>(a)</enum><header>Development</header>
					<paragraph id="idA31AE1295E694770BE7CA86C72D98347"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, in accordance with the <act-name parsable-cite="FLPMA">Federal Land
			 Policy and Management Act of 1976</act-name> (43 U.S.C. 1701 et seq.), the
			 Secretary, in consultation with appropriate Federal agencies and State, local,
			 and tribal governments, shall develop a comprehensive travel management
			 plan—</text>
						<subparagraph id="IDde8ebd5faf574bb89497a8d67ab34b49"><enum>(A)</enum><text>to provide to the
			 public a clearly marked network of roads and trails with signs and maps to
			 promote—</text>
							<clause id="idBFBD95480B4D4E91B6A211F7B32DEF14"><enum>(i)</enum><text>public safety and
			 awareness; and</text>
							</clause><clause id="id55013CD2CC2544D7A664371080088389"><enum>(ii)</enum><text>enhanced
			 recreation opportunities;</text>
							</clause></subparagraph><subparagraph id="ID74bdc5cc70814fa1a75b885b847778bb"><enum>(B)</enum><text>to help reduce in
			 the County growing conflicts arising from interactions between—</text>
							<clause id="idB0D737B9B1A9409F9299EC25E520ADCE"><enum>(i)</enum><text>motorized
			 recreation; and</text>
							</clause><clause id="idC3071D66AD8542668B6F5599AFB93548"><enum>(ii)</enum><text>the important
			 resource values of public land;</text>
							</clause></subparagraph><subparagraph id="IDdcfc97d0a0cf4cf294b1b23c55df1a35"><enum>(C)</enum><text>to promote
			 citizen-based opportunities for—</text>
							<clause id="id8B2AF239D2494882A00618D353A1D9E1"><enum>(i)</enum><text>the
			 monitoring and stewardship of the trail; and</text>
							</clause><clause id="id9676105C1DC547D1B755D99AB27206FB"><enum>(ii)</enum><text>trail system
			 management; and</text>
							</clause></subparagraph><subparagraph id="ID0525021d063049c8a6102c18cbddd2a1"><enum>(D)</enum><text>to support law
			 enforcement officials in promoting—</text>
							<clause id="id876BA0E414F5462EBF0352C8332AC82A"><enum>(i)</enum><text>compliance with
			 off-highway vehicle laws (including regulations); and</text>
							</clause><clause id="id71ACB0EDAF9E4DC283E28B1ED48F97C8"><enum>(ii)</enum><text>effective
			 deterrents of abuses of public land.</text>
							</clause></subparagraph></paragraph><paragraph id="idB70FAA51899A4F0F80837F7BCB76757D"><enum>(2)</enum><header>Scope;
			 contents</header><text>In developing the travel management plan, the Secretary
			 shall—</text>
						<subparagraph id="id072A3A7ABB9B4344B8158222FF3EC05F"><enum>(A)</enum><text>design the travel
			 management plan for land that is—</text>
							<clause id="id02939C5528E543EAB20D45A667F1B13E"><enum>(i)</enum><text>located in the
			 County; and</text>
							</clause><clause id="id4B996B6009E7483F8FB86F318EC527B0"><enum>(ii)</enum><text>managed by the
			 Bureau of Land Management;</text>
							</clause></subparagraph><subparagraph id="id9AA0026E3A674A98838DD41EDAF0ECC4"><enum>(B)</enum><text>ensure that the
			 travel management plan contains a map that depicts the trail; and</text>
						</subparagraph><subparagraph id="idF4CC8C6513024F8CB2BFD457B8B0313C"><enum>(C)</enum><text>designate a
			 system of areas, roads, and trails for mechanical and motorized use on
			 land—</text>
							<clause id="id30B1EA0AD0D842F59FFD5725BF2ECFAA"><enum>(i)</enum><text>located in the
			 County; and</text>
							</clause><clause id="idB39352F7ABF1483E94FA024395089594"><enum>(ii)</enum><text>managed by the
			 Bureau of Land Management.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDfc2297ea90ca487f93c8f5c4bc28f679"><enum>(b)</enum><header>Northern
			 transportation route</header><text>In developing the travel management plan,
			 the Secretary, in consultation with appropriate Federal agencies, the State,
			 local governments (including the County and St. George City, Utah), and the
			 public, shall identify 1 or more alternatives for a northern transportation
			 route in the County.</text>
				</subsection></section><section id="ID63278d17abfc4071b27734edb1a364f1"><enum>603.</enum><header>Designation of
			 trail</header>
				<subsection id="IDbcdcd9a2dce943ddbb2742255f29a24e"><enum>(a)</enum><header>Designation</header>
					<paragraph id="idF0FF87DDF2E8423F83AAFC7A75B0CBF9"><enum>(1)</enum><header>In
			 general</header><text>In accordance with paragraph (2), the Secretary, in
			 coordination with the Secretary of Agriculture, shall designate a trail (which
			 may include a system of trails)—</text>
						<subparagraph id="idF5774D43FA9D4CEA8DB583B4C320E259"><enum>(A)</enum><text>to be designed
			 and constructed for use by off-highway vehicles; and</text>
						</subparagraph><subparagraph id="id2B080EA3D04546F8AAD5E94143FFBA54"><enum>(B)</enum><text>to be known as
			 the <quote>High Desert Off-Highway Vehicle Trail</quote>.</text>
						</subparagraph></paragraph><paragraph id="ID15e773f91193480e9d10243dc16ad380"><enum>(2)</enum><header>Requirements</header><text>In
			 designating the trail, the Secretary concerned shall only include trails that
			 are—</text>
						<subparagraph id="id23354265BB7E4F029D9AC31C4589DB6A"><enum>(A)</enum><text>as of the date of
			 enactment of this Act, approved for use by off-highway vehicles; and</text>
						</subparagraph><subparagraph id="id73E3BA8456164E0C8ABDDFEC4C10A0A4"><enum>(B)</enum><text>located on land
			 that is managed by—</text>
							<clause id="id420C5BF9D1EC4479AD90F88B4A1EF471"><enum>(i)</enum><text>the
			 Bureau of Land Management; or</text>
							</clause><clause id="id7CC98EF6C56B496E84615A7537408826"><enum>(ii)</enum><text>the Chief of the
			 Forest Service.</text>
							</clause></subparagraph></paragraph><paragraph id="id1631C2BE97A94800AE863FDCCD0F3451"><enum>(3)</enum><header>Map</header><text>A
			 map that depicts the trail shall be on file and available for public inspection
			 in appropriate offices of—</text>
						<subparagraph id="idB7128516C75D490B82251CE5DF9B4B6E"><enum>(A)</enum><text>the Office of the
			 Chief of the Forest Service; and</text>
						</subparagraph><subparagraph id="idA201AB527F864CF99669A7E66FECD180"><enum>(B)</enum><text>the Office of the
			 Director of the Bureau of Land Management.</text>
						</subparagraph></paragraph></subsection><subsection id="IDcfdc6d93cb584a72ad4d9a37fd9cbcfc"><enum>(b)</enum><header>Management</header>
					<paragraph id="ID331bd90ff4bf47de884e83a915eaa5f3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary concerned shall manage the trail—</text>
						<subparagraph id="id8B743FCB78C6455688D4BC05EE6913B5"><enum>(A)</enum><text>in accordance
			 with applicable laws (including regulations);</text>
						</subparagraph><subparagraph id="id707152F200B54BD4BDD0662CF6F8B81C"><enum>(B)</enum><text>to ensure the
			 safety of citizens who use the trail; and</text>
						</subparagraph><subparagraph id="idCF82D184833045788EB0DA60375F4912"><enum>(C)</enum><text>in a manner by
			 which to minimize any damage to sensitive habitat or cultural resources located
			 in close proximity to the trail.</text>
						</subparagraph></paragraph><paragraph id="IDea7ab00476564f7f96f2dea270295989"><enum>(2)</enum><header>Monitoring;
			 evaluation</header><text>To minimize the impacts of the use of the trail on
			 environmental and cultural resources located in close proximity to the trail,
			 the Secretary shall—</text>
						<subparagraph id="idD8813548BD364D4BA93155166489E546"><enum>(A)</enum><text>in cooperation
			 with the Secretary of Agriculture, annually assess the effects of the use of
			 off-highway vehicles on—</text>
							<clause id="id496B5907B29C4B61AA10696DFFFA47B3"><enum>(i)</enum><text>the
			 trail; and</text>
							</clause><clause id="id70E36175E6B84145BD9C80CE5B4A7331"><enum>(ii)</enum><text>land located in
			 close proximity to the trail; and</text>
							</clause></subparagraph><subparagraph id="id0A7EA6E4A3ED42198321BC075939626D"><enum>(B)</enum><text>in consultation
			 with the Utah Department of Natural Resources, annually assess the effects of
			 the use of the trail on wildlife and wildlife habitat.</text>
						</subparagraph></paragraph><paragraph id="ID13b3f5d76fb0494090f0930d4def605e"><enum>(3)</enum><header>Notice of
			 available routes</header><text>The Secretary, in coordination with the
			 Secretary of Agriculture, shall ensure that visitors to the trail have access
			 to adequate notice relating to the availability of trail routes through—</text>
						<subparagraph id="id0DC05D56C7E242FBB6B452C8498D6984"><enum>(A)</enum><text>the placement of
			 appropriate signage along the trail; and</text>
						</subparagraph><subparagraph id="idC457BDF08C094F0A935BB9E221D666E2"><enum>(B)</enum><text>the distribution
			 of maps, safety education materials, and other information that the Secretary,
			 in cooperation with the Secretary of Agriculture, determines to be
			 appropriate.</text>
						</subparagraph></paragraph></subsection><subsection id="ID3ff79ada24484c5e96390cdf750c2b20"><enum>(c)</enum><header>Effect</header><text>Nothing
			 in this section affects the ownership, management, or other rights relating to
			 any non-Federal land (including any interest in any non-Federal land).</text>
				</subsection></section></title><title id="id9753AF9003EA46B099C5680854CAB2FB"><enum>VII</enum><header>Land
			 disposal</header>
			<section id="IDbe3f812e02694f7ebc5dfa38bfcac0de"><enum>701.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="idE095EF3844744E81AD9AF5D872FA22D2"><enum>(1)</enum><header>Conservation
			 plan</header><text>The term <term>conservation plan</term> means the
			 conservation plan entitled <quote>Washington County Habitat Conservation
			 Plan</quote> and dated December 1995.</text>
				</paragraph><paragraph id="id5C8150BCADAB4C4586A339EB8EFEE761"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the Bureau of
			 Land Management St. George Field Office Resource Management Plan.</text>
				</paragraph><paragraph id="ID0194989339304c858ff23733a84d9f4f"><enum>(3)</enum><header>Special
			 account</header><text>The term <term>special account</term> means the special
			 account established under section 703(a)(3).</text>
				</paragraph><paragraph id="id3520508AC7E642238E03961ABE7D4462"><enum>(4)</enum><header>Vision Dixie
			 Land use and transportation plan</header><text>The term <term>Vision Dixie land
			 use and transportation plan</term> means the management plan—</text>
					<subparagraph id="idF6976D9FB425485A917DBFD13145FF62"><enum>(A)</enum><text>entitled
			 <quote>Vision Dixie 2035: Land Use and Transportation Vision</quote>;</text>
					</subparagraph><subparagraph id="idCC2D5510408B4DCA980201D21741D6AA"><enum>(B)</enum><text>adopted by the
			 Washington County Commission on February 4, 2008; and</text>
					</subparagraph><subparagraph id="idED4FD059B5754FF590C1C43A5D059034"><enum>(C)</enum><text>on file in the
			 Bureau of Land Management St. George Field Office.</text>
					</subparagraph></paragraph></section><section id="ID6bddd1db80c3493aa35e4c66fdd4712a"><enum>702.</enum><header>Conveyance of
			 public land in County</header>
				<subsection id="idBDDED23E65424652B657A86E3E1DB3AA"><enum>(a)</enum><header>In
			 general</header><text>In accordance with sections 202 and 203 of the Federal
			 Land Policy and Management Act of 1976 (43 U.S.C. 1712, 1713) and subject to
			 valid existing rights, the Secretary, in cooperation with the County, shall
			 conduct sales of the land described in subsection (b) to qualified bidders in
			 accordance with—</text>
					<paragraph id="id3EC8DDAACFD4495FAFC8636505010810"><enum>(1)</enum><text>other provisions
			 of that Act;</text>
					</paragraph><paragraph id="idC05A02AB4B944B479C53270B8117CDD6"><enum>(2)</enum><text>this title;
			 and</text>
					</paragraph><paragraph id="idFFB11DE496A0457E8E95B5714C5F9B2A"><enum>(3)</enum><text>any applicable
			 law (including regulations).</text>
					</paragraph></subsection><subsection id="ID0f8223b414904a64aa72cd354b08b31e"><enum>(b)</enum><header>Description of
			 Land</header><text>The land referred to in subsection (a) consists of—</text>
					<paragraph id="IDe29e20237bd44ac68bc490290df250e1"><enum>(1)</enum><text>the land
			 identified on the Washington County Growth and Conservation Act Map as
			 <quote>First Tier Lands</quote>, totaling approximately 906 acres;</text>
					</paragraph><paragraph id="id28C4813975CA48F1A7742B1A6AACA602"><enum>(2)</enum><text>the land
			 identified on the Washington County Growth and Conservation Act Map as
			 <quote>Second Tier Lands</quote>, totaling approximately 3,146 acres;
			 and</text>
					</paragraph><paragraph id="IDe101b89c8cf849ce87586316cc5e1854"><enum>(3)</enum><text>not more than
			 5,000 acres of land from the land that is identified for disposal by the Bureau
			 of Land Management through—</text>
						<subparagraph id="idE7B5A0092B5E401EBA5230CAE946046B"><enum>(A)</enum><text>the management
			 plan; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25C1CA2117A142FBB78A8A5A448858B0"><enum>(B)</enum><text>a subsequent
			 amendment to, or revision of, the management plan that is undertaken—</text>
							<clause commented="no" display-inline="no-display-inline" id="idF3007D4324344DAF874B0764874F1563"><enum>(i)</enum><text>with full public
			 involvement; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF80A020CCDF34680B8F41AE95EA239CC"><enum>(ii)</enum><text>in accordance
			 with—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idCDC4D143C4234184B30625D736EE350C"><enum>(I)</enum><text>sections 202 and
			 503 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1712,
			 1763); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idB27236F01A774FAFA0C72A7C0D5CE5F7"><enum>(II)</enum><text>the Vision Dixie
			 land use and transportation plan (including each principle described in the
			 Vision Dixie land use and transportation plan).</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="IDe4f731bb72b14ff6b5e4777fe90a2c74"><enum>(c)</enum><header>Joint Selection
			 Required</header><text display-inline="yes-display-inline">The Secretary and
			 the County shall jointly select which parcels of land described in subsection
			 (b)(3) to offer for sale.</text>
				</subsection><subsection id="ID6d64153d70e8402ca5dba39dcae8f1a6"><enum>(d)</enum><header>Compliance With
			 Local Planning and Zoning Laws</header><text>Before a sale of land under
			 subsection (a), the County shall submit to the Secretary a certification that
			 qualified bidders have agreed to comply with—</text>
					<paragraph id="IDb0e3f717216d45a397b923d52cd6fa29"><enum>(1)</enum><text>County and city
			 zoning and other applicable ordinances; and</text>
					</paragraph><paragraph id="IDab6353f8454d43bf90ff6a8ca880e427"><enum>(2)</enum><text>any general plan
			 for the area approved by the County, including any revision to the general plan
			 that is adopted by the County after the date of enactment of this Act.</text>
					</paragraph></subsection><subsection id="IDfc059ff7767a4915b70b9118e9961276"><enum>(e)</enum><header>Method of Sale;
			 Consideration</header><text>The sale of land under subsection (a) shall
			 be—</text>
					<paragraph id="ID412a39430fa44e32b07e87c740ba8da5"><enum>(1)</enum><text>consistent with
			 subsections (d) and (f) of section 203 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1713);</text>
					</paragraph><paragraph id="IDd931ffa5356f4cef808a351e00f8ccf8"><enum>(2)</enum><text>through a
			 competitive bidding process unless otherwise determined by the Secretary;
			 and</text>
					</paragraph><paragraph id="ID9fc3f6debb75446dbe58c36b7b3e4534"><enum>(3)</enum><text>for not less than
			 fair market value.</text>
					</paragraph></subsection><subsection id="ID597b851bf1db441ea32fd9676ec0a974"><enum>(f)</enum><header>Withdrawal</header>
					<paragraph id="IDc7364108aab14ae6bce8583b790469ac"><enum>(1)</enum><header>In
			 General</header><text>Subject to valid existing rights, and except as provided
			 in paragraph (2), the land described in subsection (b) is withdrawn
			 from—</text>
						<subparagraph id="IDc145152a4465437292e93bfda45d5394"><enum>(A)</enum><text>all forms of
			 entry and appropriation under the public land laws;</text>
						</subparagraph><subparagraph id="ID81b53d411e774d648057cebbbfda99d3"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
						</subparagraph><subparagraph id="ID2897cdea2d20408db87b1e189351fd60"><enum>(C)</enum><text>operation of the
			 mineral leasing, geothermal leasing, and mineral materials laws.</text>
						</subparagraph></paragraph><paragraph id="ID57f99d9c86924cd48772395253f81501"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1)(A) shall not apply to a competitive sale.</text>
					</paragraph></subsection><subsection id="ID449565773208405595b237af40d09d0c"><enum>(g)</enum><header>Timing of
			 sales</header>
					<paragraph id="ID4e07d5dbe7d44ac89fad3369087e79dd"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
						<subparagraph id="IDc989c3df2346432bb91ff793f4917868"><enum>(A)</enum><text>with respect to
			 the land described in subsection (b)(1)—</text>
							<clause id="IDce6f0940cb7349c5b825b03dde4f35d3"><enum>(i)</enum><text>not
			 later than 18 months after the date of enactment of this Act, offer for sale
			 the land identified on the Washington County Growth and Conservation Act Map as
			 <quote>First Tier Lands</quote>; and</text>
							</clause><clause id="ID5abcfa67e33d4c039fc0da19404eef4e"><enum>(ii)</enum><text>beginning 1 year
			 after the date of the sale of land under clause (i), and at least annually
			 thereafter until the date on which all of the parcels of land described in
			 subsection (b)(2) are sold, conduct sales of each unsold parcel of land
			 described in subsection (b)(2), except that all of the parcels of land shall be
			 offered for sale not later than January 1, 2013; and</text>
							</clause></subparagraph><subparagraph id="id43599946D9F0416FB2058E3A7FF9F0B1"><enum>(B)</enum><text>with respect to
			 the land described in subsection (b)(3), in accordance with this title and any
			 applicable law (including regulations), conduct sales of each parcel of land as
			 such parcels become available for sale.</text>
						</subparagraph></paragraph><paragraph id="ID5137d4d657084194b951f12487371ec3"><enum>(2)</enum><header>Postponement;
			 exclusion from sale</header>
						<subparagraph id="ID2bd68ea9dc2842e7b96febc9201cb6c3"><enum>(A)</enum><header>Request by
			 County for postponement or exclusion</header><text>At the request of the
			 County, the Secretary shall postpone or exclude from sale all or a portion of
			 the land described in paragraph (1), (2), or (3) of subsection (b).</text>
						</subparagraph><subparagraph id="ID43eabae192fb4a2fb0f5ca68060dd876"><enum>(B)</enum><header>Indefinite
			 postponement</header><text>Unless specifically requested by the County, a
			 postponement under subparagraph (A) shall not be indefinite.</text>
						</subparagraph></paragraph></subsection><subsection id="id6427A829BCD5418ABB04853149E89B9C"><enum>(h)</enum><header>Restrictive
			 covenants</header>
					<paragraph id="IDe3b45b47e023409a9ba5909b8830ad64"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may include in the deed of transfer of any
			 parcel of land disposed of under this section any restrictive covenant that the
			 Secretary determines to be necessary to protect the interests of the United
			 States.</text>
					</paragraph><paragraph id="ID92dbbce28d284e1aa58d2c6d7d554b8f"><enum>(2)</enum><header>Notice</header><text>Not
			 later than 30 days before the date on which a land sale is to be conducted
			 under this section, the Secretary shall publish in 1 or more local newspapers a
			 notice that describes any parcels of land that would be subject to a
			 restrictive covenant.</text>
					</paragraph></subsection></section><section id="IDb65010d81c8c44dba1df4aa08cb7436d"><enum>703.</enum><header>Disposition of
			 proceeds</header>
				<subsection id="ID1a02e5e52f9d4a9993db93c1bdd82775"><enum>(a)</enum><header>Disposition of
			 proceeds</header><text>Of the gross proceeds from a sale of land described in
			 section 702(b)—</text>
					<paragraph id="ID1043cad92e3d486c80f32dff1dd4bad3"><enum>(1)</enum><text>5 percent shall
			 be paid directly to the State for the support of schools in accordance with
			 section 9 of the Act of July 16, 1894 (28 Stat. 107, chapter 138);</text>
					</paragraph><paragraph id="IDb6685e9a09434134880cc4525e8d8fe1"><enum>(2)</enum><text>10 percent shall
			 be paid directly to the County for—</text>
						<subparagraph id="idAFE99ADB9B724CFBB24F7B34F16AEE20"><enum>(A)</enum><text>administrative
			 costs;</text>
						</subparagraph><subparagraph id="id7CC0DDE543CF46A480F1C4AC9C02BD04"><enum>(B)</enum><text>the costs of fire
			 protection, flood control, public safety, and transportation; and</text>
						</subparagraph><subparagraph id="idBABBC0B351244910BCB838197118BBA6"><enum>(C)</enum><text>costs arising
			 from—</text>
							<clause id="IDca914127846149689798fee1379fd6b4"><enum>(i)</enum><text>water
			 conservation, reuse, treatment, development, and delivery in accordance with
			 local and regional plans;</text>
							</clause><clause id="IDd9dd65475389439885e219283bc78b87"><enum>(ii)</enum><text>the protection
			 of open space;</text>
							</clause><clause id="idE7BDD6E40B604D5BB17583DDD6E4A4CB"><enum>(iii)</enum><text>the development
			 of parks and public recreation areas;</text>
							</clause><clause id="ID5f2f3dc0fd4d4d9589a8fea2b31a2c14"><enum>(iv)</enum><text>the development
			 and implementation of local and regional plans (including the Vision Dixie land
			 use and transportation plan); and</text>
							</clause><clause id="ID84f15f0fc2214066b743799a49c1d1a9"><enum>(v)</enum><text>conservation
			 projects carried out in the County; and</text>
							</clause></subparagraph></paragraph><paragraph id="ID8d4d4785c10c44938890aae8cef5fb3a"><enum>(3)</enum><text>the remainder
			 shall be deposited in a special account in the Treasury of the United States
			 and shall be available without further appropriation to the Secretary until
			 expended, of which—</text>
						<subparagraph id="idE094F7EB5F4449AEA62AE7292C768A63"><enum>(A)</enum><text>the lesser of 9
			 percent of the amount deposited in the special account or $15,000,000 shall be
			 used—</text>
							<clause id="id3EEA9C4FCA6E4D4B95B75993AF004593"><enum>(i)</enum><text>to
			 complete the management plan for the Red Cliffs National Conservation Area
			 under section 302(d)(1);</text>
							</clause><clause id="id8F38E0579CA84479B82E488E382B81CE"><enum>(ii)</enum><text>to
			 complete the management plan for the Beaver Dam Wash National Conservation Area
			 under section 402(d)(1);</text>
							</clause><clause id="id212F8E5EDEBD4824BBBF2CAF8E17CBDB"><enum>(iii)</enum><text>to complete the
			 travel management plan under section 602(a)(1);</text>
							</clause><clause id="idB7FCB42A45CF4CE89A1B3E00F2A413E8"><enum>(iv)</enum><text>to
			 designate the High Desert Off-Highway Vehicle Trail under section
			 603(a)(1);</text>
							</clause><clause id="idC1FA3C89F19845F8B40896F8A6E9B963"><enum>(v)</enum><text>to
			 carry out each wilderness area designated by section 101(a), including, with
			 respect to each wilderness area, costs arising from—</text>
								<subclause id="id01E91265AD1D464582F43AA82D4DF851"><enum>(I)</enum><text>the construction
			 of appropriate fencing;</text>
								</subclause><subclause id="idF1514DC7BC814F25BEA136BDE5128FD3"><enum>(II)</enum><text>the purchase of
			 appropriate signage;</text>
								</subclause><subclause id="id0A50B84798CD47DF8EAD893067767961"><enum>(III)</enum><text>public
			 education activities; and</text>
								</subclause><subclause id="id21B6FD1A6E2F457AABC36884122DE44D"><enum>(IV)</enum><text>enforcement
			 activities;</text>
								</subclause></clause><clause id="ID33511864a90d441aae5c006632590d3f"><enum>(vi)</enum><text>for the
			 reimbursement of costs incurred by the Utah State Office of the Bureau of Land
			 Management and the St. George Field Office of the Bureau of Land Management in
			 preparing for the sale of land described in section 702(b), including the costs
			 of—</text>
								<subclause id="ID99b2c3e9ffef4508966a9773dd5b1858"><enum>(I)</enum><text>surveys;</text>
								</subclause><subclause id="ID13a221a0895443799f08317fe6cf1226"><enum>(II)</enum><text>appraisals;
			 and</text>
								</subclause><subclause id="ID2685a36be54a44fc8cced3da6f7c4eb1"><enum>(III)</enum><text>activities
			 carried out to ensure compliance with—</text>
									<item id="ID1aada2cce81e4e9eaf9543a2141d52b4"><enum>(aa)</enum><text>the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text>
									</item><item id="ID534c82d2e5dc4dc0a5936dabc220d314"><enum>(bb)</enum><text>sections 201 and
			 202 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1711,
			 1712);</text>
									</item></subclause></clause><clause id="id7C1C1A0E98D24100B0B9E3201DF840D3"><enum>(vii)</enum><text>for the
			 reimbursement of administrative costs incurred by the St. George Field Office
			 of the Bureau of Land Management in carrying out this Act; and</text>
							</clause><clause id="id634692A330E44C528294927C04C80C1B"><enum>(viii)</enum><text>for each
			 conservation purpose described in section 901; and</text>
							</clause></subparagraph><subparagraph id="IDcfee6e85d7d1474db207005a7a94bfbf"><enum>(B)</enum><text>the remainder of
			 the amount deposited in the special account shall be used to acquire from a
			 willing seller any parcel of non-Federal land (including any interest in a
			 parcel of non-Federal land) located in the County including—</text>
							<clause id="IDb8966d41c10d413bae86342348805732"><enum>(i)</enum><text>any
			 parcel of non-Federal land located in—</text>
								<subclause id="id0C2CBFA1B743476292C0DC84B92C7631"><enum>(I)</enum><text>the Red Cliffs
			 National Conservation Area, established by section 302(c), in accordance with
			 the conservation plan;</text>
								</subclause><subclause id="id57C5669ED0BB43BB863307D784F34C12"><enum>(II)</enum><text>the Beaver Dam
			 Wash National Conservation Area, established by section 402(c);</text>
								</subclause><subclause id="id6FFB633D27744158B7B0629E2E1D42C0"><enum>(III)</enum><text>any wilderness
			 area designated by section 101(a);</text>
								</subclause><subclause id="id5F532927A54D4AAB8C8D226A60FCB60A"><enum>(IV)</enum><text>the Zion
			 National Park; and</text>
								</subclause><subclause id="idDAD9E2FA2A92406CB93864F8584988AB"><enum>(V)</enum><text>the Dixie
			 National Forest; and</text>
								</subclause></clause><clause id="id17F37FFF1BCB4961A8412E437A759A6D"><enum>(ii)</enum><text>any parcel of
			 land that—</text>
								<subclause id="id14B98191E4C5494E98272F264F3966E3"><enum>(I)</enum><text>is
			 environmentally sensitive;</text>
								</subclause><subclause id="id354E6CAA714949239A42CC79B025CF48"><enum>(II)</enum><text>is critical for
			 agriculture; or</text>
								</subclause><subclause id="idAAD8F987776342CEB7D1D0A632DF4D07"><enum>(III)</enum><text>has critical
			 open space, watershed, or natural values.</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID34c459bb980a4e52a5fee07ec2d06bd2"><enum>(b)</enum><header>Investment of
			 special account</header><text>Any amounts deposited in the special account
			 shall earn interest in an amount determined by the Secretary of the Treasury on
			 the basis of the current average market yield on outstanding marketable
			 obligations of the United States of comparable maturities, and may be expended
			 according to the provisions of this section.</text>
				</subsection><subsection id="ID8313a49a15c540d1b6e95a26f97c80f7"><enum>(c)</enum><header>Annual
			 report</header>
					<paragraph id="id2025446E9FBE440E8DA935B6BF6528CD"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act and annually thereafter, the Secretary shall submit to the appropriate
			 committees of Congress a report that contains, for the year covered by the
			 report, an itemized description of each activity carried out by the Secretary
			 using funds made available in accordance with subsection (a)(3).</text>
					</paragraph><paragraph id="id42E25C84680B4B0D8C25EF0807DDFC2E"><enum>(2)</enum><header>Public
			 availability</header><text>The Secretary shall make the report required under
			 paragraph (1) available to the public.</text>
					</paragraph></subsection></section></title><title id="id8D6C1C440E8547419C410985B790700E"><enum>VIII</enum><header>Rights-of-way</header>
			<section id="id19C49769974F45B881779EE53B3341A6"><enum>801.</enum><header>Definition of
			 Water District</header><text display-inline="no-display-inline">In this title,
			 the term <term>Water District</term> means the Washington County Water
			 Conservancy District.</text>
			</section><section id="id48E4A74EF74B4426B1912DAB4BA6F036"><enum>802.</enum><header>Rights-of-way</header>
				<subsection id="id578BB77CC468482DB4966A22BA351637"><enum>(a)</enum><header>In
			 general</header><text>In accordance with sections 202 and 503 of the Federal
			 Land Policy and Management Act of 1976 (43 U.S.C. 1712, 1763), and subject to
			 valid existing rights, the Secretary shall grant to the Water District
			 nonexclusive rights-of-way for each reservoir depicted on the Washington County
			 Growth and Conservation Act Map, totaling approximately 932 acres.</text>
				</subsection><subsection id="IDac78686b36814ce98fc531625f9011e5"><enum>(b)</enum><header>Duration;
			 waiver of fees</header><text>A right-of-way granted by the Secretary under
			 subsection (a) shall—</text>
					<paragraph id="idC528FA1173D94280A85F46FE217565B0"><enum>(1)</enum><text>be valid in
			 perpetuity; and</text>
					</paragraph><paragraph id="idF0931844FBE14A6CB45601393669AB99"><enum>(2)</enum><text>not require the
			 payment of rental fees.</text>
					</paragraph></subsection><subsection id="IDb373a0b5fd564cf8937ba724a0f1ac65"><enum>(c)</enum><header>Compliance with
			 National Environmental Policy Act of 1969</header><text>Before granting a
			 right-of-way under subsection (a), the Secretary shall comply with the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.), including any requirement of the Act
			 relating to the identification of potential impacts to fish and wildlife
			 resources and habitat.</text>
				</subsection><subsection id="idFCED44752C6948B8BBF810658F2E8AFB"><enum>(d)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, each area granted as a right-of-way by the Secretary
			 under subsection (a) is withdrawn from location, entry, and patent under the
			 mining laws.</text>
				</subsection></section></title><title id="id6B515AD4B98B4A4597017552A01023EE"><enum>IX</enum><header>Management of
			 priority biological areas</header>
			<section id="id409F4F6EDA024A0CB72527D46FD7A54E"><enum>901.</enum><header>Management of
			 priority biological areas</header>
				<subsection id="id02B7A667F5FF469694F3388DACBB3C1B"><enum>(a)</enum><header>In
			 general</header><text>In accordance with applicable Federal laws (including
			 regulations), the Secretary shall—</text>
					<paragraph id="id4A6710680223458B9B4A25043F74B94F"><enum>(1)</enum><text>identify each
			 priority biological area located in the County; and</text>
					</paragraph><paragraph id="idD36B411A07E64F1ABB4449F24033861A"><enum>(2)</enum><text>carry out the
			 management of plant and animal species and natural communities in each priority
			 biological area, including activities relating to conservation and
			 restoration.</text>
					</paragraph></subsection><subsection id="id16541D53269542F593010CB21BE5CC65"><enum>(b)</enum><header>Grants;
			 cooperative agreements</header><text>In carrying out subsection (a), the
			 Secretary may make grants to, or enter into cooperative agreements with, State
			 and local governmental entities and private entities to conduct research,
			 develop scientific analyses, and carry out any other initiative relating to the
			 restoration or conservation of the priority biological areas.</text>
				</subsection></section></title><title id="idDAE106CC267240D3B20F0C9F5CE48EE3"><enum>X</enum><header>Conveyance of
			 Dixie National Forest land</header>
			<section id="id1EFA0F5FDEE74221B84264FF5BA7C04C"><enum>1001.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="ID603d188da4d648ab8f4f0a2c0549106f"><enum>(1)</enum><header>Covered Federal
			 land</header><text>The term <term>covered Federal land</term> means the
			 approximately 112 acres of land in the Dixie National Forest in the State, as
			 depicted on the map.</text>
				</paragraph><paragraph id="idDB68FC7D7D7746838DCEA8D86DE882E9"><enum>(2)</enum><header>Landowner</header><text>The
			 term <term>landowner</term> means Kirk R. Harrison, who owns land in Pinto
			 Valley, Utah.</text>
				</paragraph><paragraph id="idC78771F8A33B4D3C89FC295DA093FFFA"><enum>(3)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Harrison Proposal</quote>
			 and dated February 26, 2008.</text>
				</paragraph><paragraph id="ID5f88badadba2424b87f7309a193219ec"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
				</paragraph></section><section id="ID470224e165a34ad3bd597ca3efada6f1"><enum>1002.</enum><header>Conveyance</header>
				<subsection id="idC5CB4EE586714CCF97D5C931EF70C7ED"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall convey to the landowner all right, title, and
			 interest of the United States in and to the covered Federal land (including any
			 improvements or appurtenances to the covered Federal land).</text>
				</subsection><subsection id="id41F363093A10486A8098237174E2A4FF"><enum>(b)</enum><header>Legal
			 description</header><text>The exact acreage and legal description of the
			 covered Federal land to be conveyed under subsection (a) shall be determined by
			 surveys satisfactory to the Secretary.</text>
				</subsection><subsection id="id9075001297CB4BA7A51A2A853F2E6307"><enum>(c)</enum><header>Consideration</header>
					<paragraph id="idDA2B83E4A86A4B82A58AC634B2A74829"><enum>(1)</enum><header>In
			 general</header><text>As consideration for the conveyance under subsection (a),
			 the landowner shall pay to the Secretary an amount equal to the fair market
			 value of the covered Federal land, as determined under paragraph (2).</text>
					</paragraph><paragraph id="idD5E295D806EE4EBEBA41FFB423E71610"><enum>(2)</enum><header>Appraisal</header><text>The
			 fair market value of the covered Federal land shall be determined by an
			 appraisal acceptable to the Secretary that is performed in accordance
			 with—</text>
						<subparagraph id="id6EC37F9FA1FF4D95B41930FDCB4EDE9C"><enum>(A)</enum><text>the Uniform
			 Appraisal Standards for covered Federal land Acquisitions, as developed by the
			 Interagency Land Acquisition Conference;</text>
						</subparagraph><subparagraph id="idCF1F7D1F07874AC5A74AC0FF1B7B8CBB"><enum>(B)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice; and</text>
						</subparagraph><subparagraph id="idF45AAA9265FD4A5C95ED1A46E1FA8586"><enum>(C)</enum><text>any other
			 applicable law (including regulations).</text>
						</subparagraph></paragraph></subsection><subsection id="id500A68E3E6244938B84CA4E7B1D573D7"><enum>(d)</enum><header>Disposition and
			 use of proceeds</header>
					<paragraph id="idC90F6407FEDF4EB287990D9DA168853E"><enum>(1)</enum><header>Disposition of
			 proceeds</header><text>The Secretary shall deposit the proceeds of the sale of
			 land under subsection (a) in the fund established under Public Law 90–171
			 (commonly known as the “Sisk Act”) (16 U.S.C. 484a).</text>
					</paragraph><paragraph id="id3EA3DE91A22045F2ACA54C14F464AF56"><enum>(2)</enum><header>Use of
			 proceeds</header><text>Amounts deposited under paragraph (1) shall be available
			 to the Secretary, without further appropriation and until expended, for the
			 acquisition of real property or interests in real property for inclusion in the
			 Dixie National Forest in the State.</text>
					</paragraph></subsection><subsection id="idA1FE19D9B337460FB4F4E9C55C0687A7"><enum>(e)</enum><header>Map</header>
					<paragraph id="id7810CF7756C24CBEA2D45BF23040F46C"><enum>(1)</enum><header>Availability</header><text>The
			 map shall be on file and available for public inspection in the office of the
			 Chief of the Forest Service.</text>
					</paragraph><paragraph id="id4F321E9FA334446AAA0CFC9A87A61344"><enum>(2)</enum><header>Technical
			 corrections</header><text>The Secretary may make technical corrections to the
			 map.</text>
					</paragraph></subsection><subsection id="id176A61F5AA184ADF8A7CBFF8CE45807E"><enum>(f)</enum><header>Additional
			 terms and conditions</header><text>The Secretary may require any additional
			 terms and conditions for the conveyance under subsection (a) that the Secretary
			 determines to be appropriate to protect the interests of the United
			 States.</text>
				</subsection></section></title><title id="id2EDFA4FB30144C6F908FA6BE3D2A1212"><enum>XI</enum><header>Authorization of
			 Appropriations</header>
			<section id="id8A7ECF6727B04E69BBA7D9ECB6E1965D"><enum>1101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this Act
			 and the amendments made by this Act.</text>
