		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Owyhee Public Land Management Act of
			 2008</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="ID1efcbc62edf242969ce78e042d7a4565" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID9b4ae9e0bcb34f34a527f69bcf9cf05b"><enum>(1)</enum><header>Account</header><text>The
			 term <term>account</term> means the Owyhee Land Acquisition Account established
			 by section 6(b)(1).</text>
			</paragraph><paragraph id="id3A6777B8536E4C229D4B14AA66596B7A"><enum>(2)</enum><header>County</header><text>The
			 term <quote>County</quote> means Owyhee County, Idaho.</text>
			</paragraph><paragraph id="id414F3CB66E92459A9DE42D394E83C8D7"><enum>(3)</enum><header>Owyhee
			 Front</header><text>The term <quote>Owyhee Front</quote> means the area of the
			 County from Jump Creek on the west to Mud Flat Road on the east and draining
			 north from the crest of the Silver City Range to the Snake River.</text>
			</paragraph><paragraph id="id0D49799D28E340D5B98BBD9741BEACF9"><enum>(4)</enum><header>Plan</header><text>The
			 term <quote>plan</quote> means a travel management plan for motorized and
			 mechanized off-highway vehicle recreation prepared under section 8.</text>
			</paragraph><paragraph id="ID1ced9ab42b8d44b1ab0dac9dbc3cb203"><enum>(5)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term in section 103(e) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1702(e)).</text>
			</paragraph><paragraph id="IDa5313f4d7c0b4a4c88d8a50b2a8091b1"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="ID8bef29a8111e4d5a9151c1707f923fd8"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Idaho.</text>
			</paragraph><paragraph id="idA3617A93D18B44F6A992D2C532023938"><enum>(8)</enum><header>Tribes</header><text>The
			 term <quote>Tribes</quote> means the Shoshone Pauite Tribes of the Duck Valley
			 Reservation.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="ID71bf6724dcb84eeca894c61e5a11c13d" reported-display-style="strikethrough"><enum>3.</enum><header>Owyhee Science
			 Review and Conservation Center</header>
			<subsection id="ID7b98c8cc2ebd478faa984bb0de5814ab"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary, in coordination with the Tribes, State, and County, and in
			 consultation with the University of Idaho, Federal grazing permittees, and
			 public, shall establish the Owyhee Science Review and Conservation Center in
			 the County to conduct research projects to address natural resources management
			 issues affecting public and private rangeland in the County.</text>
			</subsection><subsection id="id63472D19F9554B0785B35F6CDD6D8057"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of the center established under subsection (a) shall be to facilitate
			 the collection and analysis of information to provide Federal and State
			 agencies, private landowners, and the public with information on improved
			 rangeland management.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID592a42cc32954ba6aa66e12914b11eee" reported-display-style="strikethrough"><enum>4.</enum><header>Wilderness
			 areas</header>
			<subsection id="IDaba1e57a3059488689515a092043c537"><enum>(a)</enum><header>Wilderness areas
			 designation</header>
				<paragraph id="idB54B777A362044D8AF2F24778C9DE45F"><enum>(1)</enum><header>In
			 general</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.), the following areas in the State are designated as wilderness areas and
			 as components of the National Wilderness Preservation System:</text>
					<subparagraph id="IDd239bf84b2c343f592708e27a48b0e68"><enum>(A)</enum><header>Big jacks creek
			 wilderness</header><text>Certain land comprising approximately 52,826 acres, as
			 generally depicted on the map entitled <quote>Little Jacks Creek and Big Jacks
			 Creek Wilderness</quote> and dated October 18, 2007, which shall be known as
			 the <quote>Big Jacks Creek Wilderness</quote>.</text>
					</subparagraph><subparagraph id="ID0ac2e2f98826441bb8f0af9023424a0e"><enum>(B)</enum><header>Bruneau-jarbidge
			 rivers wilderness</header><text>Certain land comprising approximately 90,007
			 acres, as generally depicted on the map entitled <quote>Bruneau-Jarbidge Rivers
			 Wilderness</quote> and dated October 18, 2007, which shall be known as the
			 <quote>Bruneau-Jarbidge Rivers Wilderness</quote>.</text>
					</subparagraph><subparagraph id="ID6adbda34553c468e8eef167ff55186e2"><enum>(C)</enum><header>Little jacks
			 creek wilderness</header><text>Certain land comprising approximately 51,021
			 acres, as generally depicted on the map entitled <quote>Little Jacks Creek and
			 Big Jacks Creek Wilderness</quote> and dated October 18, 2007, which shall be
			 known as the <quote>Little Jacks Creek Wilderness</quote>.</text>
					</subparagraph><subparagraph id="IDc11e7d8d905e487eadb32b66597e7a96"><enum>(D)</enum><header>North fork
			 owyhee wilderness</header><text>Certain land comprising approximately 43,413
			 acres, as generally depicted on the map entitled <quote>North Fork Owyhee and
			 Pole Creek Wilderness</quote> and dated October 18, 2007, which shall be known
			 as the <quote>North Fork Owyhee Wilderness</quote>.</text>
					</subparagraph><subparagraph id="IDad66733d947347bc842dc148064a91be"><enum>(E)</enum><header>Owyhee river
			 wilderness</header><text>Certain land comprising approximately 267,328 acres,
			 as generally depicted on the map entitled <quote>Owyhee River
			 Wilderness</quote> and dated October 18, 2007, which shall be known as the
			 <quote>Owyhee River Wilderness</quote>.</text>
					</subparagraph><subparagraph id="ID1b0c2b17ed494697b626343a92b707e2"><enum>(F)</enum><header>Pole creek
			 wilderness</header><text>Certain land comprising approximately 12,533 acres, as
			 generally depicted on the map entitled <quote>North Fork Owyhee and Pole Creek
			 Wilderness</quote> and dated October 18, 2007, which shall be known as the
			 <quote>Pole Creek Wilderness</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID65c4a5e5db0a4e80a400258f76f1ce73"><enum>(2)</enum><header>Maps and legal
			 descriptions</header>
					<subparagraph id="idD0CDC4E83557494DAB3CB72CF2A18C0C"><enum>(A)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives a map and legal description for each area designated as
			 wilderness by this Act.</text>
					</subparagraph><subparagraph id="idE6816C3EBAA94456A777305ED07736C6"><enum>(B)</enum><header>Effect</header><text>Each
			 map and legal description submitted under subparagraph (A) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct minor errors in the map or legal description.</text>
					</subparagraph><subparagraph id="id02536EE9B43544C2A90F99035B9A91F9"><enum>(C)</enum><header>Availability</header><text>Each
			 map and legal description submitted under subparagraph (A) shall be available
			 in the appropriate offices of the Bureau of Land Management.</text>
					</subparagraph></paragraph><paragraph id="idF388F7F04D0546A6BC4192FA50618382"><enum>(3)</enum><header>Release of
			 wilderness study areas</header>
					<subparagraph id="ID6df01db927f9415681055e6210dc0e1b"><enum>(A)</enum><header>In
			 general</header><text>Congress finds that, for the purposes of section 603(c)
			 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1782(c)), the
			 public land in the County administered by the Bureau of Land Management has
			 been adequately studied for wilderness designation.</text>
					</subparagraph><subparagraph id="IDfc0147abb03f47efa780bafd7d2bde5a"><enum>(B)</enum><header>Release</header><text>Any
			 public land referred to in subparagraph (A) that is not designated as
			 wilderness by this Act—</text>
						<clause id="ID2dca9c9debc14404b3009c0676edcfdd"><enum>(i)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1782(c)); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID3470d4fe034442f095cba989cbd18d70"><enum>(ii)</enum><text>shall be managed
			 in accordance with the applicable land use plan adopted under section 202 of
			 that Act (43 U.S.C. 1712).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDeed1a676026142c78d7e710ddb938337"><enum>(b)</enum><header>Administration</header>
				<paragraph id="ID582588d874fc4261b4653df26250ccac"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, each area designated as
			 wilderness by this Act shall be administered by the Secretary in accordance
			 with the Wilderness Act (16 U.S.C. 1131 et seq.), except that—</text>
					<subparagraph id="IDfb0224fedc4e42b7a3708b34bfae0ec5"><enum>(A)</enum><text>any reference in
			 that Act to the effective date shall be considered to be a reference to the
			 date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="ID3f86c9db4a1f47b2883f3a0a12c0e205"><enum>(B)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary of the Interior.</text>
					</subparagraph></paragraph><paragraph id="ID4f90de164b9049e69e395dd8b0074405"><enum>(2)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the Federal land designated as wilderness by this Act
			 is withdrawn from all forms of—</text>
					<subparagraph id="ID5a744d6384c64b688be8b1ab7f5859f6"><enum>(A)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
					</subparagraph><subparagraph id="IDc86ad836eba04299a99663d014767f94"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</subparagraph><subparagraph id="ID2de1a7992fbe45b7b900167b69f6f6cd"><enum>(C)</enum><text>disposition under
			 the mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</subparagraph></paragraph><paragraph id="ID2e45fd0e17be425c8bb3134e886c0430"><enum>(3)</enum><header>Livestock</header>
					<subparagraph id="id985F0FC43D494A94A7FA43E443BEDB80"><enum>(A)</enum><header>In
			 general</header><text>In the wilderness areas designated by this Act, the
			 grazing of livestock in areas in which grazing is established as of the date of
			 enactment of this Act shall be allowed to continue, subject to such reasonable
			 regulations, policies, and practices as the Secretary considers necessary,
			 consistent with section 4(d)(4) of the Wilderness Act (16 U.S.C. 1133(d)(4))
			 and the guidelines described in Appendix A of House Report 101–405.</text>
					</subparagraph><subparagraph id="idE37FA1FB1B4A4ECF803E8A8A7C921642"><enum>(B)</enum><header>Inventory</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 conduct an inventory of existing facilities and improvements associated with
			 grazing activities in the wilderness areas and wild and scenic rivers
			 designated by this Act.</text>
					</subparagraph><subparagraph id="IDa097ad81a93d4b718b014fd6065ea82c"><enum>(C)</enum><header>Fencing</header><text>The
			 Secretary may construct and maintain fencing around wilderness areas designated
			 by this Act as the Secretary determines to be appropriate to protect wilderness
			 values.</text>
					</subparagraph><subparagraph id="id55D052F448D44B21AF28A73C9B17E64C"><enum>(D)</enum><header>Donation of
			 grazing permits or leases</header>
						<clause id="idF15A28F102D94B4A975A606D0327E730"><enum>(i)</enum><header>Acceptance by
			 secretary</header><text>The Secretary shall accept the donation of any valid
			 existing permits or leases authorizing grazing on public land within the
			 wilderness areas designated by this Act.</text>
						</clause><clause id="id9DACABB3BFFB4ADB879411304FF1EE49"><enum>(ii)</enum><header>Termination</header><text>The
			 Secretary shall terminate any grazing permit or lease acquired under clause (i)
			 to ensure a permanent end to grazing on the land covered by the permit or
			 lease.</text>
						</clause><clause id="id5640A9A2462B49538655B1198FDA9447"><enum>(iii)</enum><header>Partial
			 donation</header>
							<subclause id="id6BBDFDBFE1AD4029A449066A6B92C123"><enum>(I)</enum><header>In
			 general</header><text>If a person holding a valid grazing permit or lease
			 donates less than the full amount of grazing use authorized under the permit or
			 lease, the Secretary shall—</text>
								<item id="id78A318C7F1A040B6BEC9B32D8F032B06"><enum>(aa)</enum><text>reduce the
			 authorized grazing level to reflect the donation; and</text>
								</item><item id="idB8A2A54A03A849D6A2E4BF28330A90F0"><enum>(bb)</enum><text>modify the permit
			 or lease to reflect the revised level of use.</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id75724CCCF4A3467D9CF79AF2C61A5819"><enum>(II)</enum><header>Authorized
			 level</header><text>To ensure that there is a permanent reduction in the level
			 of grazing on the land covered by a permit or lease donated under subclause
			 (I), the Secretary shall not allow grazing use to exceed the authorized level
			 established under that subclause.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="id2414E2984B994C74BA4D6D1D19DD2601"><enum>(4)</enum><header>Acquisition of
			 land and interests in land</header>
					<subparagraph id="idAB42D0CCAC6B4BDB93855A18905083BD"><enum>(A)</enum><header>In
			 general</header><text>Consistent with applicable law, the Secretary may acquire
			 land or interests in land within the boundaries of the wilderness areas
			 designated by this Act by purchase, donation, or exchange.</text>
					</subparagraph><subparagraph id="ID5d061292b87b44fa9172cb9307cf708d"><enum>(B)</enum><header>Incorporation of
			 acquired land</header><text>Any land or interest in land in, or adjoining the
			 boundary of, a wilderness area designated by this Act that is acquired by the
			 United States shall be added to, and administered as part of, the wilderness
			 area in which the acquired land or interest in land is located.</text>
					</subparagraph></paragraph><paragraph id="ID6e403c374e234df8ac3b08686eefe8d3"><enum>(5)</enum><header>Trail
			 plan</header>
					<subparagraph id="idE91CB7BCB43046C996D0C035F0CEDBB1"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, after providing opportunities for public
			 comment, shall establish a trail plan for public land in southwestern Idaho
			 that addresses hiking and equestrian trails on the land designated as
			 wilderness by this Act, in a manner consistent with the Wilderness Act (16
			 U.S.C. 1131 et seq.).</text>
					</subparagraph><subparagraph id="id4CF1E577C20B4B7392DF85C104064E4D"><enum>(B)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report that describes the implementation of the trail
			 plan.</text>
					</subparagraph></paragraph><paragraph id="ID6338351d6af147d7ad203c731c8570ca"><enum>(6)</enum><header>Outfitting and
			 guide activities</header><text>Consistent with section 4(d)(5) of the
			 Wilderness Act (16 U.S.C. 1133(d)(5)), commercial services (including
			 authorized outfitting and guide activities) are authorized in wilderness areas
			 designated by this Act to the extent necessary for activities that fulfill the
			 recreational or other wilderness purposes of the areas.</text>
				</paragraph><paragraph id="IDc22a4e89a28c483fa148861b8e8f5abe"><enum>(7)</enum><header>Access to
			 private property</header><text>In accordance with section 5(a) of the
			 Wilderness Act (16 U.S.C. 1134(a)), the Secretary shall provide any owner of
			 private property within the boundary of a wilderness area designated by this
			 Act adequate access to the property.</text>
				</paragraph><paragraph id="IDb625ce9db51644c89a479ef34e989e8d"><enum>(8)</enum><header>Fish and
			 wildlife</header>
					<subparagraph id="id28B563D81B114F60A6BCA3262EF97127"><enum>(A)</enum><header>In
			 general</header><text>Nothing in this Act affects the jurisdiction of the State
			 with respect to fish and wildlife on public land in the State.</text>
					</subparagraph><subparagraph id="id26118427AF0A4F94B7DA651853A74CC6"><enum>(B)</enum><header>Management
			 activities</header>
						<clause id="id03B927E0E7B349C786DD17F9BB3FDC92"><enum>(i)</enum><header>In
			 general</header><text>In furtherance of the purposes and principles of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), the Secretary may conduct any
			 management activities that are necessary to maintain or restore fish and
			 wildlife populations and habitats in the wilderness areas designated by this
			 Act, if the management activities are—</text>
							<subclause id="idECD907FD85B34809A799294FD17F85DE"><enum>(I)</enum><text>consistent with
			 relevant wilderness management plans; and</text>
							</subclause><subclause id="id0E82E962287E471B9B848354A8BB10DA"><enum>(II)</enum><text>conducted in
			 accordance with appropriate policies, such as the policies established in
			 Appendix B of House Report 101–405.</text>
							</subclause></clause><clause id="id4CBB338B13354F10865D9F3440EDB9C2"><enum>(ii)</enum><header>Inclusions</header><text>Management
			 activities under clause (i) may include the occasional and temporary use of
			 motorized vehicles, if the use, as determined by the Secretary, would promote
			 healthy, viable, and more naturally distributed wildlife populations that would
			 enhance wilderness values while causing the minimum impact necessary to
			 accomplish those tasks.</text>
						</clause></subparagraph><subparagraph id="idFB61FD8F33F44F03AC3F8FA21BD6BED6"><enum>(C)</enum><header>Existing
			 activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (16 U.S.C. 1133(d)(1)) and in accordance with appropriate policies, such as
			 those established in Appendix B of House Report 101–405, the State may use
			 aircraft (including helicopters) in the wilderness areas designated by this Act
			 to survey, capture, transplant, monitor, and provide water for wildlife
			 populations, including bighorn sheep, and feral stock, feral horses, and feral
			 burros.</text>
					</subparagraph></paragraph><paragraph id="ID084dcb69571a49b6880f8d1ce995e2c7"><enum>(9)</enum><header>Wildfire,
			 insect, and disease management</header><text>Consistent with section 4(d)(1) of
			 the Wilderness Act (16 U.S.C. 1133(d)(1)), the Secretary may take any measures
			 that the Secretary determines to be necessary to control fire, insects, and
			 diseases, including, as the Secretary determines appropriate, the coordination
			 of those activities with a State or local agency.</text>
				</paragraph><paragraph id="idB08E6F61CCE049B19EEC82AFDEF375AE"><enum>(10)</enum><header>Adjacent
			 management</header>
					<subparagraph id="id885BBF0C9B8542CFB8C77AC4538CCC63"><enum>(A)</enum><header>In
			 general</header><text>The designation of a wilderness area by this Act shall
			 not create any protective perimeter or buffer zone around the wilderness
			 area.</text>
					</subparagraph><subparagraph id="id7BBC0DFB06484D6582D921AD056FD9D5"><enum>(B)</enum><header>Nonwilderness
			 activities</header><text>The fact that nonwilderness activities or uses can be
			 seen or heard from areas within a wilderness area designated by this Act shall
			 not preclude the conduct of those activities or uses outside the boundary of
			 the wilderness area.</text>
					</subparagraph></paragraph><paragraph id="IDfaf42423b0094f3f80039bd0627662ce"><enum>(11)</enum><header>Military
			 overflights</header><text>Nothing in this Act restricts or precludes—</text>
					<subparagraph id="IDc9ace6231dc74eeda196f73516757265"><enum>(A)</enum><text>low-level
			 overflights of military aircraft over the areas designated as wilderness by
			 this Act, including military overflights that can be seen or heard within the
			 wilderness areas;</text>
					</subparagraph><subparagraph id="ID4d8f3015274f44e783eea4e9d0017beb"><enum>(B)</enum><text>flight testing and
			 evaluation; or</text>
					</subparagraph><subparagraph id="ID8646065a1c084fe8b2cf8b1f76b8f943"><enum>(C)</enum><text>the designation or
			 creation of new units of special use airspace, or the establishment of military
			 flight training routes, over the wilderness areas.</text>
					</subparagraph></paragraph><paragraph id="idF1E5CE8537D34F6B86E515B6AC528E8D"><enum>(12)</enum><header>Water
			 rights</header>
					<subparagraph id="idAD65D963F37C4F94A44298E8290E1749"><enum>(A)</enum><header>In
			 general</header><text>The designation of areas as wilderness in section 4 of
			 this Act shall not create an express or implied reservation by the United
			 States of any water or water rights for wilderness purposes with respect to
			 such areas.</text>
					</subparagraph><subparagraph id="idE27C5160348548079DA302D99D3C8AF5"><enum>(B)</enum><header>Exclusions</header><text>This
			 paragraph does not apply to any components of the National Wild and Scenic
			 Rivers System designated by section 5.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID39cfa8e5116a4f6b9fde936f3953fc08" reported-display-style="strikethrough"><enum>5.</enum><header>Designation of
			 wild and scenic rivers</header>
			<subsection id="IDb99fb1f4e2fb49169a57310562e62bca"><enum>(a)</enum><header>In
			 general</header><text>Section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C.
			 1274(a)) is amended—</text>
				<paragraph id="id6973EBFBC3D64D32958267865E977499"><enum>(1)</enum><text>by redesignating
			 paragraph (167) (relating to the Musconetcong River, New Jersey) as paragraph
			 (169);</text>

						</paragraph><paragraph id="ID7256f79363304839ad37e8228e83de4b"><enum>(184)</enum><header>South fork
				owyhee river, Idaho</header>

				segment of the South Fork of the Owyhee River upstream from the confluence with

				subparagraph (A), the 1.2-mile segment of the South Fork of the Owyhee River
				from the point at which the river enters the southernmost boundary to the point
				at which the river exits the northernmost boundary of private land in sec. 25
				and 26, T. 14 S., R. 5 W., Boise Meridian, shall be administered by the
				Secretary of the Interior as a recreational river.</text>
							</subparagraph></paragraph><paragraph id="IDdf233d0f0626442a80f6a0039c54a0cf"><enum>(185)</enum><header>Wickahoney
				creek, Idaho</header><text>The 1.5 miles of Wickahoney Creek from the
				confluence of Big Jacks Creek to the upstream boundary of the Big Jacks Creek
				Wilderness, to be administered by the Secretary of the Interior as a wild
				river.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID258886aac7db4a44b7e8b7934b64c83d"><enum>(b)</enum><header>Boundaries</header><text>Notwithstanding
			 section 3(b) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(b)), the
			 boundary of a river segment designated as a component of the National Wild and
			 Scenic Rivers System under this Act shall extend not more than the shorter
			 of—</text>
				<paragraph id="id0B9FC25ABD0E4AA798B12A8018650CFF"><enum>(1)</enum><text>an average
			 distance of <fraction>1/4</fraction> mile from the high water mark on both
			 sides of the river segment; or</text>
				</paragraph><paragraph id="id0770CB1E0E544D7683AF413448887AC3"><enum>(2)</enum><text>the distance to
			 the nearest confined canyon rim.</text>
				</paragraph></subsection><subsection id="IDb25b4b7f8999485f83d8fb95fb531f63"><enum>(c)</enum><header>Land
			 acquisition</header><text>The Secretary shall not acquire any private land
			 within the exterior boundary of a wild and scenic river corridor without the
			 consent of the owner.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID035dc57a27704aee842dab48de99b492" reported-display-style="strikethrough"><enum>6.</enum><header>Land identified
			 for disposal</header>
			<subsection id="ID78d5d89b78c14a01918d598ec647ab8c"><enum>(a)</enum><header>In
			 general</header><text>Consistent with applicable law, the Secretary may sell
			 public land located within the Boise District of the Bureau of Land Management
			 that, as of the date of enactment of this Act, has been identified for disposal
			 in appropriate resource management plans.</text>
			</subsection><subsection id="ID10b8d695621745e986ac4a6b0c084069"><enum>(b)</enum><header>Use of
			 proceeds</header>
				<paragraph id="idD64B7D5A1F0E42269606EBB083CDB3BE"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law (other than a
			 law that specifically provides for a proportion of the proceeds of a land sale
			 to be distributed to any trust fund of the State), proceeds from the sale of
			 public land under subsection (a) shall be deposited in a separate account in
			 the Treasury of the United States to be known as the <quote>Owyhee Land
			 Acquisition Account</quote>.</text>
				</paragraph><paragraph id="IDe1c4ae16f96d43f4b39283eb79f77f1a"><enum>(2)</enum><header>Availability</header>
					<subparagraph id="idD9B7CAFAB855484197F2B5693F6BC238"><enum>(A)</enum><header>In
			 general</header><text>Amounts in the account shall be available to the
			 Secretary, without further appropriation, to purchase land or interests in land
			 in, or adjacent to, the wilderness areas designated by this Act, including land
			 identified as <quote>Proposed for Acquisition</quote> on the maps described in
			 section 4(a)(2).</text>
					</subparagraph><subparagraph id="IDbb9265e74d7c438e81b2432bd45c1475"><enum>(B)</enum><header>Applicable
			 law</header><text>Any purchase of land or interest in land under subparagraph
			 (A) shall be in accordance with applicable law.</text>
					</subparagraph></paragraph><paragraph id="idF73D22DB649547A7B69E0D210DA3D779"><enum>(3)</enum><header>Applicability</header><text>This
			 subsection applies to public land within the Boise District of the Bureau of
			 Land Management sold on or after January 1, 2008.</text>
				</paragraph></subsection><subsection id="IDb64d69c559464e78bdcfe637ed515caf"><enum>(c)</enum><header>Termination of
			 authority</header>
				<paragraph id="id51C840469CE645B6898118D04D605F44"><enum>(1)</enum><header>In
			 general</header><text>The authority provided under this section terminates on
			 the earlier of—</text>
					<subparagraph id="id423BB772E3B74576B798577755343819"><enum>(A)</enum><text>the date that is
			 10 years after the date of enactment of this Act; or</text>
					</subparagraph><subparagraph id="id64529D766BA74ACC908AC9C58AEC29C8"><enum>(B)</enum><text>the date on which
			 a total of $8,000,000 from the account is expended.</text>
					</subparagraph></paragraph><paragraph id="id91F5821C8F0846928D4402DB4CF42826"><enum>(2)</enum><header>Availability of
			 amounts</header><text>Any amounts remaining in the account on the termination
			 of authority under this section shall be—</text>
					<subparagraph id="idDF266CD7C3BD485797AB2A13AAB4BF67"><enum>(A)</enum><text>credited as sales
			 of public land in the State;</text>
					</subparagraph><subparagraph id="idEA2B8A9F44FB4DF8A2F40525918E59E1"><enum>(B)</enum><text>transferred to the
			 Federal Land Disposal Account established under section 206(a) of the Federal
			 Land Transaction Facilitation Act (43 U.S.C. 2305(a)); and</text>
					</subparagraph><subparagraph id="id7E65E8B1E2834C9BB37488C1D074D87F"><enum>(C)</enum><text>used in accordance
			 with that Act.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID98f3d87d7d3f461fa270c282a91594a5" reported-display-style="strikethrough"><enum>7.</enum><header>Tribal cultural
			 resources</header>
			<subsection id="id0E89F369103E433E8DCE7BD66D903E1B"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate with the
			 Tribes in the implementation of the Shoshone Paiute Cultural Resource
			 Protection Plan.</text>
			</subsection><subsection id="idB36EF646BCBD4F6AAECEAE3B7C124049"><enum>(b)</enum><header>Agreements</header><text>The
			 Secretary shall seek to enter into agreements with the Tribes to implement the
			 Shoshone Paiute Cultural Resource Protection Plan to protect cultural sites and
			 resources important to the continuation of the traditions and beliefs of the
			 Tribes.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID7854c99aa039408ea1334634bd832750" reported-display-style="strikethrough"><enum>8.</enum><header>Recreational
			 travel management plans</header>
			<subsection id="IDab38a015fc6c447480dc7af8bbb0cbf0"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the Federal Land Policy and Management
			 Act of 1976 (43 U.S.C. 1701 et seq.), the Secretary shall, in coordination with
			 the Tribes, State, and County, prepare 1 or more travel management plans for
			 motorized and mechanized off-highway vehicle recreation for the land managed by
			 the Bureau of Land Management in the County.</text>
			</subsection><subsection id="ID6e3cc503673f45e6b7a622ea13c506ee"><enum>(b)</enum><header>Inventory</header><text>Before
			 preparing the plan under subsection (a), the Secretary shall conduct resource
			 and route inventories of the area covered by the plan.</text>
			</subsection><subsection id="ID7400f643ceb74d7c89b1ac26b30515d6"><enum>(c)</enum><header>Limitation to
			 designated routes</header>
				<paragraph id="id566310DEADE54E068EEA94DE69E41361"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the plan shall limit recreational motorized and mechanized
			 off-highway vehicle use to a system of designated roads and trails established
			 by the plan.</text>
				</paragraph><paragraph id="idA0D7E3493C1E43478E93250BB950665D"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to snowmobiles.</text>
				</paragraph></subsection><subsection id="IDffe7defec29f4d3ea280950fbef14806"><enum>(d)</enum><header>Temporary
			 limitation</header>
				<paragraph id="id372ECBA7FC65461D82055DC73CD3BB36"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), until the date on
			 which the Secretary completes the plan, all recreational motorized and
			 mechanized off-highway vehicle use shall be limited to roads and trails
			 lawfully in existence on the day before the date of enactment of this
			 Act.</text>
				</paragraph><paragraph id="id3CB8DA55CD424AEC8E69E7DF29ECDBA0"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to—</text>
					<subparagraph id="id16AF0D3C78024678B25C81EE18BCDE4E"><enum>(A)</enum><text>snowmobiles;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id286695563DD2494385B84629C852CF3D"><enum>(B)</enum><text>areas specifically
			 identified as open, closed, or limited in the Owyhee Resource Management
			 Plan.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdf091327641b4824829f993f20a40c55"><enum>(e)</enum><header>Schedule</header>
				<paragraph id="idC291B0F019D049E6B6574D5CF11338FE"><enum>(1)</enum><header>Owyhee
			 front</header><text>It is the intent of Congress that, not later than 1 year
			 after the date of enactment of this Act, the Secretary shall complete a
			 transportation plan for the Owyhee Front.</text>
				</paragraph><paragraph id="id32DE5F8191B34310A2126C0E019F980F"><enum>(2)</enum><header>Other bureau of
			 land management land in the County</header><text>It is the intent of Congress
			 that, not later than 3 years after the date of enactment of this Act, the
			 Secretary shall complete a transportation plan for Bureau of Land Management
			 land in the County outside the Owyhee Front.</text>
				</paragraph></subsection><subsection id="ID7f919ed2bb5048c3ab6617c59ddb7154"><enum>(f)</enum><header>Effect of
			 section</header><text>Nothing in this section precludes the Secretary from
			 addressing nonrecreational travel management as part of the plan.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID2fbf7d2fe5894c1d953103ae28210801" reported-display-style="strikethrough"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id4f07f822-bcd0-4f4a-8431-2ff82742b615" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Owyhee Public Land Management Act of
			 2008</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="id3d0f3854-299a-41eb-a730-d9e199b963d7" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id4a73bffe-45ae-4596-9cf9-b0de44864fd0"><enum>(1)</enum><header>Account</header><text>The
			 term <term>account</term> means the Owyhee Land Acquisition Account established
			 by section 6(b)(1).</text>
			</paragraph><paragraph id="id280b3bef-fd9b-410f-8911-7f338d778904"><enum>(2)</enum><header>County</header><text>The
			 term <quote>County</quote> means Owyhee County, Idaho.</text>
			</paragraph><paragraph id="id15aeb23c-1ca1-40da-93f8-2121a17d0753"><enum>(3)</enum><header>Owyhee
			 Front</header><text>The term <quote>Owyhee Front</quote> means the area of the
			 County from Jump Creek on the west to Mud Flat Road on the east and draining
			 north from the crest of the Silver City Range to the Snake River.</text>
			</paragraph><paragraph id="idef1d7c7f-e626-4ec5-8013-222315e658df"><enum>(4)</enum><header>Plan</header><text>The
			 term <quote>plan</quote> means a travel management plan for motorized and
			 mechanized off-highway vehicle recreation prepared under section 8.</text>
			</paragraph><paragraph id="id7032fe7d-b123-46d1-be0e-cf8dcf68e230"><enum>(5)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term in section 103(e) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1702(e)).</text>
			</paragraph><paragraph id="ide1f03045-4f7f-4001-a3d1-d339b4809107"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id79c4ec21-6aa9-4755-b49d-2edebdf3ea89"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Idaho.</text>
			</paragraph><paragraph id="id222ac640-3eb5-4d85-a7bd-f5f860c30f10"><enum>(8)</enum><header>Tribes</header><text>The
			 term <quote>Tribes</quote> means the Shoshone Pauite Tribes of the Duck Valley
			 Reservation.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="id989d154d-23ce-44a3-8a1f-8f595fc496ce" reported-display-style="italic"><enum>3.</enum><header>Owyhee Science Review
			 and Conservation Center</header>
			<subsection id="id9ad21f59-8583-44fe-aab4-12499eb6eb56"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary, in coordination with the Tribes, State, and County, and in
			 consultation with the University of Idaho, Federal grazing permittees, and
			 public, shall establish the Owyhee Science Review and Conservation Center in
			 the County to conduct research projects to address natural resources management
			 issues affecting public and private rangeland in the County.</text>
			</subsection><subsection id="id2f459d70-55eb-4d18-be0a-a4cc049e3e7f"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of the center established under subsection (a) shall be to facilitate
			 the collection and analysis of information to provide Federal and State
			 agencies, the Tribes, the County, private landowners, and the public with
			 information on improved rangeland management.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="ida1eef50e-2fc9-40e8-b914-c990b8456d7c" reported-display-style="italic"><enum>4.</enum><header>Wilderness
			 areas</header>
			<subsection id="id8f70646b-f04f-4fc7-a663-0010e5dba65c"><enum>(a)</enum><header>Wilderness areas
			 designation</header>
				<paragraph id="id00f762b6-9598-4676-9db2-00805f37b130"><enum>(1)</enum><header>In
			 general</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.), the following areas in the State are designated as wilderness areas and
			 as components of the National Wilderness Preservation System:</text>
					<subparagraph id="id0186240c-300d-44d0-9d35-a518129360b6"><enum>(A)</enum><header>Big jacks creek
			 wilderness</header><text>Certain land comprising approximately 52,826 acres, as
			 generally depicted on the map entitled <quote>Little Jacks Creek and Big Jacks
			 Creek Wilderness</quote> and dated May 5, 2008, which shall be known as the
			 <quote>Big Jacks Creek Wilderness</quote>.</text>

					</subparagraph><subparagraph id="ida7f8d6b5-2919-4dba-b131-19045eb832a6"><enum>(D)</enum><header>North fork owyhee
			 wilderness</header><text>Certain land comprising approximately 43,413 acres, as
			 generally depicted on the map entitled <quote>North Fork Owyhee and Pole Creek
			 Wilderness</quote> and dated May 5, 2008, which shall be known as the
			 <quote>North Fork Owyhee Wilderness</quote>.</text>
					</subparagraph><subparagraph id="id9c3c477e-1093-4372-8040-bf699e1d739a"><enum>(E)</enum><header>Owyhee river
			 wilderness</header><text>Certain land comprising approximately 267,328 acres,
			 as generally depicted on the map entitled <quote>Owyhee River
			 Wilderness</quote> and dated May 5, 2008, which shall be known as the
			 <quote>Owyhee River Wilderness</quote>.</text>
					</subparagraph><subparagraph id="ide27222be-6ab0-45a1-950d-a33d762beaad"><enum>(F)</enum><header>Pole creek
			 wilderness</header><text>Certain land comprising approximately 12,533 acres, as
			 generally depicted on the map entitled <quote>North Fork Owyhee and Pole Creek
			 Wilderness</quote> and dated May 5, 2008, which shall be known as the
			 <quote>Pole Creek Wilderness</quote>.</text>
					</subparagraph></paragraph><paragraph id="idc2b24430-2d44-4439-a1e1-30a85b9d6c38"><enum>(2)</enum><header>Maps and legal
			 descriptions</header>
					<subparagraph id="idd65ec1c9-1715-4e7c-9a0b-0f01d09f0015"><enum>(A)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives a map and legal description for each area designated as
			 wilderness by this Act.</text>
					</subparagraph><subparagraph id="idda0c26df-a9fc-4fdc-9fb9-1abd8f31f6ec"><enum>(B)</enum><header>Effect</header><text>Each
			 map and legal description submitted under subparagraph (A) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct minor errors in the map or legal description.</text>
					</subparagraph><subparagraph id="id542f832b-d673-4389-884a-9de98fc7ee2f"><enum>(C)</enum><header>Availability</header><text>Each
			 map and legal description submitted under subparagraph (A) shall be available
			 in the appropriate offices of the Bureau of Land Management.</text>
					</subparagraph></paragraph><paragraph id="idac32694a-db54-4c7a-aa65-bcd34e25b39b"><enum>(3)</enum><header>Release of wilderness
			 study areas</header>
					<subparagraph id="id39431e51-a495-4381-8a60-defe17c60390"><enum>(A)</enum><header>In
			 general</header><text>Congress finds that, for the purposes of section 603(c)
			 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1782(c)), the
			 public land in the County administered by the Bureau of Land Management has
			 been adequately studied for wilderness designation.</text>
					</subparagraph><subparagraph id="id6b5a2bdd-9950-4510-a31f-646680b6efb9"><enum>(B)</enum><header>Release</header><text>Any
			 public land referred to in subparagraph (A) that is not designated as
			 wilderness by this Act—</text>
						<clause id="idaec1775e-ee24-4288-bdd9-546472db12b3"><enum>(i)</enum><text>is no longer subject to
			 section 603(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1782(c)); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idc06dd147-ad97-4193-850b-0f2810ede35c"><enum>(ii)</enum><text>shall be managed in
			 accordance with the applicable land use plan adopted under section 202 of that
			 Act (43 U.S.C. 1712).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id79229309-f3a7-4ae1-8a21-331ac5e7682c"><enum>(b)</enum><header>Administration</header>
				<paragraph id="ide0f50cae-4ba7-46c4-b7a7-ef66eff9e525"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, each area designated as
			 wilderness by this Act shall be administered by the Secretary in accordance
			 with the Wilderness Act (16 U.S.C. 1131 et seq.), except that—</text>
					<subparagraph id="iddb25a72c-0bdd-43e9-be2e-4ec2f964e1d6"><enum>(A)</enum><text>any reference in that Act
			 to the effective date shall be considered to be a reference to the date of
			 enactment of this Act; and</text>
					</subparagraph><subparagraph id="ida0bb9614-3647-4d16-90d5-fbfdf992638c"><enum>(B)</enum><text>any reference in that Act
			 to the Secretary of Agriculture shall be considered to be a reference to the
			 Secretary of the Interior.</text>
					</subparagraph></paragraph><paragraph id="id671df7f4-3316-40b6-84b3-4d94d22ba6ad"><enum>(2)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the Federal land designated as wilderness by this Act
			 is withdrawn from all forms of—</text>
					<subparagraph id="id3cdb0f9b-b2ce-41c9-84b5-3ac8ec6498e2"><enum>(A)</enum><text>entry, appropriation, or
			 disposal under the public land laws;</text>
					</subparagraph><subparagraph id="id1b025ccd-16da-4208-bdb4-8f7d03da36eb"><enum>(B)</enum><text>location, entry, and
			 patent under the mining laws; and</text>
					</subparagraph><subparagraph id="idbeafb60d-43fd-40ec-9da5-4d0377a14227"><enum>(C)</enum><text>disposition under the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</subparagraph></paragraph><paragraph id="idcfe0c63e-9d53-411a-b46f-9d5f1cb4bfa1"><enum>(3)</enum><header>Livestock</header>
					<subparagraph id="id12c68d9c-b253-465a-bfa5-0b802f71ee56"><enum>(A)</enum><header>In
			 general</header><text>In the wilderness areas designated by this Act, the
			 grazing of livestock in areas in which grazing is established as of the date of
			 enactment of this Act shall be allowed to continue, subject to such reasonable
			 regulations, policies, and practices as the Secretary considers necessary,
			 consistent with section 4(d)(4) of the Wilderness Act (16 U.S.C. 1133(d)(4))
			 and the guidelines described in Appendix A of House Report 101–405.</text>
					</subparagraph><subparagraph id="id9731ddad-80f6-4a20-affe-041b2d98ff02"><enum>(B)</enum><header>Inventory</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 conduct an inventory of existing facilities and improvements associated with
			 grazing activities in the wilderness areas and wild and scenic rivers
			 designated by this Act.</text>
					</subparagraph><subparagraph id="id29b3fb69-3d95-4253-a7ec-749adac000d3"><enum>(C)</enum><header>Fencing</header><text>The
			 Secretary may construct and maintain fencing around wilderness areas designated
			 by this Act as the Secretary determines to be appropriate to enhance wilderness
			 values.</text>
					</subparagraph><subparagraph id="id6FF0CE6CCDF041E9A211F1C0F7A89779"><enum>(D)</enum><header>Donation of grazing
			 permits or leases</header>
						<clause id="ID3735b76bcc7a436492262a96c336a946"><enum>(i)</enum><header>Acceptance by
			 Secretary</header><text>The Secretary shall accept the donation of any valid
			 existing permits or leases authorizing grazing on public land, all or a portion
			 of which is within the wilderness areas designated by this Act.</text>
						</clause><clause id="IDf7a553458c9d4fa4a29eca5bc2d87cbf"><enum>(ii)</enum><header>Termination</header><text>With
			 respect to each permit or lease donated under clause (i), the Secretary
			 shall—</text>
							<subclause id="IDc5132f53270d483fb90b6211c52e0926"><enum>(I)</enum><text>terminate the grazing
			 permit or lease; and</text>
							</subclause><subclause id="IDf59c64f84a98484f9f0309c0bddf9eab"><enum>(II)</enum><text>except as provided in
			 clause (iii), ensure a permanent end to grazing on the land covered by the
			 permit or lease.</text>
							</subclause></clause><clause id="ID0d1f119570824297a22efd0269d555b3"><enum>(iii)</enum><header>Common
			 allotments</header>
							<subclause id="IDfe3416454bb24d8f92a0fd80ab7b88f1"><enum>(I)</enum><header>In
			 general</header><text>If the land covered by a permit or lease donated under
			 clause (i) is also covered by another valid existing permit or lease that is
			 not donated under clause (i), the Secretary shall reduce the authorized grazing
			 level on the land covered by the permit or lease to reflect the donation of the
			 permit or lease under clause (i).</text>
							</subclause><subclause id="IDa2964e893efd47ad932912025a2e65ae"><enum>(II)</enum><header>Authorized
			 level</header><text>To ensure that there is a permanent reduction in the level
			 of grazing on the land covered by a permit or lease donated under clause (i),
			 the Secretary shall not allow grazing use to exceed the authorized level
			 established under subclause (I).</text>
							</subclause></clause><clause id="ID1b9634fd8e2f4d459636159bca99fda3"><enum>(iv)</enum><header>Partial
			 donation</header>
							<subclause id="IDb841c4563dd0424da6d5151cfa3e5f22"><enum>(I)</enum><header>In
			 general</header><text>If a person holding a valid grazing permit or lease
			 donates less than the full amount of grazing use authorized under the permit or
			 lease, the Secretary shall—</text>
								<item id="IDf060244261db44279f7c383cb7d519db"><enum>(aa)</enum><text>reduce the authorized
			 grazing level to reflect the donation; and</text>
								</item><item id="IDa59b18702bb84eb9b37b70dc9e9b40cd"><enum>(bb)</enum><text>modify the permit or
			 lease to reflect the revised level of use.</text>
								</item></subclause><subclause id="IDd9b86d1399d14b54badea3d1aa58f71c"><enum>(II)</enum><header>Authorized
			 level</header><text>To ensure that there is a permanent reduction in the
			 authorized level of grazing on the land covered by a permit or lease donated
			 under subclause (I), the Secretary shall not allow grazing use to exceed the
			 authorized level established under that subclause.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="idf3efd9a9-0c00-42f8-b04c-0e48ad544c8a"><enum>(4)</enum><header>Acquisition of land and
			 interests in land</header>
					<subparagraph id="iddf888892-6048-40de-92b5-64cf99df1fd4"><enum>(A)</enum><header>In
			 general</header><text>Consistent with applicable law, the Secretary may acquire
			 land or interests in land within the boundaries of the wilderness areas
			 designated by this Act by purchase, donation, or exchange.</text>
					</subparagraph><subparagraph id="idefcfde68-7ca0-414a-832d-ce7176b88341"><enum>(B)</enum><header>Incorporation of
			 acquired land</header><text>Any land or interest in land in, or adjoining the
			 boundary of, a wilderness area designated by this Act that is acquired by the
			 United States shall be added to, and administered as part of, the wilderness
			 area in which the acquired land or interest in land is located.</text>
					</subparagraph></paragraph><paragraph id="id0f5d5b2c-c944-4f0a-b59c-884eb041d6ff"><enum>(5)</enum><header>Trail plan</header>
					<subparagraph id="id1ade3c19-1cf9-424b-9222-0f3204b610c4"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, after providing opportunities for public
			 comment, shall establish a trail plan that addresses hiking and equestrian
			 trails on the land designated as wilderness by this Act, in a manner consistent
			 with the Wilderness Act (16 U.S.C. 1131 et seq.).</text>
					</subparagraph><subparagraph id="idc96d298a-ad09-40c7-ab17-b3ab0e00a56a"><enum>(B)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report that describes the implementation of the trail
			 plan.</text>
					</subparagraph></paragraph><paragraph id="idfbd0f092-b398-434f-be49-dfcf029c8c8f"><enum>(6)</enum><header>Outfitting and guide
			 activities</header><text>Consistent with section 4(d)(5) of the Wilderness Act
			 (16 U.S.C. 1133(d)(5)), commercial services (including authorized outfitting
			 and guide activities) are authorized in wilderness areas designated by this Act
			 to the extent necessary for activities that fulfill the recreational or other
			 wilderness purposes of the areas.</text>
				</paragraph><paragraph id="id050ee9e4-1565-41d6-988b-91c30e6ae445"><enum>(7)</enum><header>Access to private
			 property</header><text>In accordance with section 5(a) of the Wilderness Act
			 (16 U.S.C. 1134(a)), the Secretary shall provide any owner of private property
			 within the boundary of a wilderness area designated by this Act adequate access
			 to the property.</text>
				</paragraph><paragraph id="id760eea99-d722-4e4a-982b-e8357f3f50c6"><enum>(8)</enum><header>Fish and
			 wildlife</header>
					<subparagraph id="idf67ea764-1dac-4c59-b75d-ab74d809de54"><enum>(A)</enum><header>In
			 general</header><text>Nothing in this Act affects the jurisdiction of the State
			 with respect to fish and wildlife on public land in the State.</text>
					</subparagraph><subparagraph id="iddacb2cce-b227-4854-9be3-4dc72102eae8"><enum>(B)</enum><header>Management
			 activities</header>
						<clause id="idea75c951-ca1f-4c64-9efe-a59a5ada4730"><enum>(i)</enum><header>In
			 general</header><text>In furtherance of the purposes and principles of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), the Secretary may conduct any
			 management activities that are necessary to maintain or restore fish and
			 wildlife populations and habitats in the wilderness areas designated by this
			 Act, if the management activities are—</text>
							<subclause id="id7ffa28cc-0b91-4fc1-bff1-ee86c2639eb5"><enum>(I)</enum><text>consistent with relevant
			 wilderness management plans; and</text>
							</subclause><subclause id="id44d94c2d-4893-400c-87dd-915daaffda38"><enum>(II)</enum><text>conducted in accordance
			 with appropriate policies, such as the policies established in Appendix B of
			 House Report 101–405.</text>
							</subclause></clause><clause id="id011a2e5c-9cf2-4462-b993-6259d1d8bf66"><enum>(ii)</enum><header>Inclusions</header><text>Management
			 activities under clause (i) may include the occasional and temporary use of
			 motorized vehicles, if the use, as determined by the Secretary, would promote
			 healthy, viable, and more naturally distributed wildlife populations that would
			 enhance wilderness values while causing the minimum impact necessary to
			 accomplish those tasks.</text>
						</clause></subparagraph><subparagraph id="id6e604d7a-f912-400f-9576-d1ed5b9d3180"><enum>(C)</enum><header>Existing
			 activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (16 U.S.C. 1133(d)(1)) and in accordance with appropriate policies, such as
			 those established in Appendix B of House Report 101–405, the State may use
			 aircraft (including helicopters) in the wilderness areas designated by this Act
			 to survey, capture, transplant, monitor, and provide water for wildlife
			 populations, including bighorn sheep, and feral stock, feral horses, and feral
			 burros.</text>
					</subparagraph></paragraph><paragraph id="id2b4c1b73-f67f-4ed8-925b-8a70c83b1e46"><enum>(9)</enum><header>Wildfire, insect, and
			 disease management</header><text>Consistent with section 4(d)(1) of the
			 Wilderness Act (16 U.S.C. 1133(d)(1)), the Secretary may take any measures that
			 the Secretary determines to be necessary to control fire, insects, and
			 diseases, including, as the Secretary determines appropriate, the coordination
			 of those activities with a State or local agency.</text>
				</paragraph><paragraph id="id573bed47-5e01-495e-af22-49709ca0304f"><enum>(10)</enum><header>Adjacent
			 management</header>
					<subparagraph id="idfe3ab1b6-f62b-4b3e-8b9a-49c087f61b73"><enum>(A)</enum><header>In
			 general</header><text>The designation of a wilderness area by this Act shall
			 not create any protective perimeter or buffer zone around the wilderness
			 area.</text>
					</subparagraph><subparagraph id="id476fea3a-d47e-4f53-962d-5710184800e6"><enum>(B)</enum><header>Nonwilderness
			 activities</header><text>The fact that nonwilderness activities or uses can be
			 seen or heard from areas within a wilderness area designated by this Act shall
			 not preclude the conduct of those activities or uses outside the boundary of
			 the wilderness area.</text>
					</subparagraph></paragraph><paragraph id="id55e07f64-9b2c-4250-af4f-20e4a9310fe2"><enum>(11)</enum><header>Military
			 overflights</header><text>Nothing in this Act restricts or precludes—</text>
					<subparagraph id="id51863cb4-5f65-4758-b55d-a56c0ecd92d6"><enum>(A)</enum><text>low-level overflights of
			 military aircraft over the areas designated as wilderness by this Act,
			 including military overflights that can be seen or heard within the wilderness
			 areas;</text>
					</subparagraph><subparagraph id="id38fbbd59-f57a-40c7-9d55-36b492494651"><enum>(B)</enum><text>flight testing and
			 evaluation; or</text>
					</subparagraph><subparagraph id="id5b9f4870-7a7b-49f3-a7cc-4a733cc8af09"><enum>(C)</enum><text>the designation or
			 creation of new units of special use airspace, or the establishment of military
			 flight training routes, over the wilderness areas.</text>
					</subparagraph></paragraph><paragraph id="id18c35378-2522-4fb9-9a7f-b07a713f3072"><enum>(12)</enum><header>Water rights</header>
					<subparagraph id="idb8e7c1f3-2653-4623-8212-5e417d7063a2"><enum>(A)</enum><header>In
			 general</header><text>The designation of areas as wilderness in section 4 shall
			 not create an express or implied reservation by the United States of any water
			 or water rights for wilderness purposes with respect to such areas.</text>
					</subparagraph><subparagraph id="idfcd3eb60-2cc5-48a7-b348-49fea4d85a65"><enum>(B)</enum><header>Exclusions</header><text>This
			 paragraph does not apply to any components of the National Wild and Scenic
			 Rivers System designated by section 5.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="idf686b404-83c0-4e00-82a3-82d73fcb9631" reported-display-style="italic"><enum>5.</enum><header>Designation of wild and
			 scenic rivers</header>
			<subsection id="idf90ca20e-ed90-472b-b6c4-9d5fd72b2e34"><enum>(a)</enum><header>In
			 general</header><text>Section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C.
			 1274(a)) is amended—</text>
				<paragraph id="id422c4089-a157-4998-8a4d-83c05284a529"><enum>(1)</enum><text>by redesignating
			 paragraph (167) (relating to the Musconetcong River, New Jersey) as paragraph
			 (169);</text>
				</paragraph><paragraph id="ide00df7f4-e276-4722-a820-9a72c370e461"><enum>(2)</enum><text>by designating the
			 undesignated paragraph relating to the White Salmon River, Washington, as
			 paragraph (167);</text>

				point at which it enters the NW <fraction>1/4</fraction> of sec. 26, T. 10 S.,
				R. 2 E., Boise Meridian, to be administered by the Secretary of the Interior as
				a wild river.</text>
						</paragraph><paragraph id="id97a9b354-bf8f-4b67-85de-598e02394a69"><enum>(172)</enum><header>Bruneau river,
				Idaho</header>
							<subparagraph id="id9e3d4772-cfd9-4140-85a9-bf337f8957c9"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the 39.3-mile
				segment of the Bruneau River from the downstream boundary of the
				Bruneau-Jarbidge Wilderness to the upstream confluence with the west fork of

							</subparagraph><subparagraph id="id5ca31c05-5fa7-491c-9314-7fad91d97654"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
				subparagraph (A), the 0.6-mile segment of the Bruneau River at the Indian Hot
				Springs public road access shall be administered by the Secretary of the
				Interior as a recreational river.</text>
							</subparagraph></paragraph><paragraph id="id7522224c-25e3-419b-bda2-2a06712525ec"><enum>(173)</enum><header>West fork bruneau
				river, Idaho</header><text>The approximately 0.35 miles of the West Fork of the
				Bruneau River from the confluence with the Jarbidge River to the downstream
				boundary of the Bruneau Canyon Grazing Allotment in the SE/NE of sec. 5, T. 13
				S., R. 7 E., Boise Meridian, to be administered by the Secretary of the
				Interior as a wild river.</text>
						</paragraph><paragraph id="id2024bce8-fa91-471d-8aca-d31a38b2bf2c"><enum>(174)</enum><header>Cottonwood creek,
				Idaho</header><text>The 2.6 miles of Cottonwood Creek from the confluence with
				Big Jacks Creek to the upstream boundary of the Big Jacks Creek Wilderness, to
				be administered by the Secretary of the Interior as a wild river.</text>
						</paragraph><paragraph id="idcbe61fc1-413e-4170-b289-7e748f280071"><enum>(175)</enum><header>Deep creek,
				Idaho</header><text>The 13.1-mile segment of Deep Creek from the confluence
				with the Owyhee River to the upstream boundary of the Owyhee River Wilderness
				in sec. 30, T. 12 S., R. 2 W., Boise Meridian, to be administered by the
				Secretary of the Interior as a wild river.</text>
						</paragraph><paragraph id="id038c326c-90d1-47e2-9c42-38e07269fd9f"><enum>(176)</enum><header>Dickshooter creek,
				Idaho</header><text>The 9.25 miles of Dickshooter Creek from the confluence
				with Deep Creek to a point on the stream <fraction>1/4</fraction> mile due west
				of the east boundary of sec. 16, T. 12 S., R. 2 W., Boise Meridian, to be
				administered by the Secretary of the Interior as a wild river.</text>

				with the West Fork Bruneau River to the upstream boundary of the
				Bruneau-Jarbidge Rivers Wilderness, to be administered by the Secretary of the
				Interior as a wild river.</text>
						</paragraph><paragraph id="idcf4b01f9-2bfe-4f16-a226-e82fdfc36845"><enum>(179)</enum><header>Little jacks creek,
				Idaho</header><text>The 12.4 miles of Little Jacks Creek from the downstream
				boundary of the Little Jacks Creek Wilderness, upstream to the mouth of OX
				Prong Creek, to be administered by the Secretary of the Interior as a wild
				river.</text>
						</paragraph><paragraph id="id25229512-8592-4206-ad9c-35722b737cd6"><enum>(180)</enum><header>North fork owyhee
				river, Idaho</header><text>The following segments of the North Fork of the
				Owyhee River, to be administered by the Secretary of the Interior:</text>
							<subparagraph id="id52854db5-0772-43ed-9bb1-0710ce70e569"><enum>(A)</enum><text>The 5.7-mile segment from
				the Idaho-Oregon State border to the upstream boundary of the private land at
				the Juniper Mt. Road crossing, as a recreational river.</text>
							</subparagraph><subparagraph id="id422730e1-9e6e-4e0f-b0c7-492b7ca2997e"><enum>(B)</enum><text>The 15.1-mile segment
				from the upstream boundary of the North Fork Owyhee River recreational segment
				designated in paragraph (A) to the upstream boundary of the North Fork Owyhee
				River Wilderness, as a wild river.</text>
							</subparagraph></paragraph><paragraph id="id36a3a4fd-19ee-432d-b531-f5106f01ceea"><enum>(181)</enum><header>Owyhee river,
				Idaho</header>
							<subparagraph id="ida46ca0d0-3a19-41a7-b6e5-b7f1c44975b8"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the 67.3 miles of the Owyhee
				River from the Idaho-Oregon State border to the upstream boundary of the Owyhee
				River Wilderness, to be administered by the Secretary of the Interior as a wild
				river.</text>
							</subparagraph><subparagraph id="id13ab2dc4-3ecd-49ef-9b88-3aebe1f53185"><enum>(B)</enum><header>Access</header><text>The
				Secretary of the Interior shall allow for continued access across the Owyhee
				River at Crutchers Crossing, subject to such terms and conditions as the
				Secretary of the Interior determines to be necessary.</text>
							</subparagraph></paragraph><paragraph id="ida1984fad-6650-41c3-82ee-62eaac8739e1"><enum>(182)</enum><header>Red canyon,
				Idaho</header><text>The 4.6 miles of Red Canyon from the confluence of the
				Owyhee River to the upstream boundary of the Owyhee River Wilderness, to be
				administered by the Secretary of the Interior as a wild river.</text>
						</paragraph><paragraph id="iddceb3f47-8faf-4f46-8b17-1fbe099d2595"><enum>(183)</enum><header>Sheep creek,
				Idaho</header><text>The 25.6 miles of Sheep Creek from the confluence with the
				Bruneau River to the upstream boundary of the Bruneau-Jarbidge Rivers
				Wilderness, to be administered by the Secretary of the Interior as a wild
				river.</text>
						</paragraph><paragraph id="id5532fc36-c08d-46a5-a68e-12cb2c04b836"><enum>(184)</enum><header>South fork owyhee
				river, Idaho</header>
							<subparagraph id="idca3ad7aa-0ed5-4a4f-ba6e-4ae74da0b8fa"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the 31.4-mile
				segment of the South Fork of the Owyhee River upstream from the confluence with
				the Owyhee River to the upstream boundary of the Owyhee River Wilderness at the
				Idaho–Nevada State border, to be administered by the Secretary of the Interior
				as a wild river.</text>
							</subparagraph><subparagraph id="id93220fbb-63c4-48f3-bf8c-3d6ab0dfa108"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
				subparagraph (A), the 1.2-mile segment of the South Fork of the Owyhee River
				from the point at which the river enters the southernmost boundary to the point
				at which the river exits the northernmost boundary of private land in sec. 25
				and 26, T. 14 S., R. 5 W., Boise Meridian, shall be administered by the
				Secretary of the Interior as a recreational river.</text>
							</subparagraph></paragraph><paragraph id="id115b5785-9acc-48ec-bd81-a8831aaa8a93"><enum>(185)</enum><header>Wickahoney creek,
				Idaho</header><text>The 1.5 miles of Wickahoney Creek from the confluence of
				Big Jacks Creek to the upstream boundary of the Big Jacks Creek Wilderness, to
				be administered by the Secretary of the Interior as a wild
				river.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id2a9cebed-e7d1-4d6e-b466-2b45d1667e38"><enum>(b)</enum><header>Boundaries</header><text>Notwithstanding
			 section 3(b) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(b)), the
			 boundary of a river segment designated as a component of the National Wild and
			 Scenic Rivers System under this Act shall extend not more than the shorter
			 of—</text>
				<paragraph id="id636350b7-1bac-470a-9c17-8b97ee2867ec"><enum>(1)</enum><text>an average distance of
			 <fraction>1/4</fraction> mile from the high water mark on both sides of the
			 river segment; or</text>
				</paragraph><paragraph id="ida51ab23c-c86c-40f4-b169-6bc177626e8b"><enum>(2)</enum><text>the distance to the
			 nearest confined canyon rim.</text>
				</paragraph></subsection><subsection id="id70ce505a-3e69-4d7d-ae9e-88818bb24592"><enum>(c)</enum><header>Land
			 acquisition</header><text>The Secretary shall not acquire any private land
			 within the exterior boundary of a wild and scenic river corridor without the
			 consent of the owner.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="id2c403ad8-ec73-4db7-9d3f-c0805e7962c6" reported-display-style="italic"><enum>6.</enum><header>Land identified for
			 disposal</header>
			<subsection id="id72aeedc0-d915-4b13-9fed-52293c6368e5"><enum>(a)</enum><header>In
			 general</header><text>Consistent with applicable law, the Secretary may sell
			 public land located within the Boise District of the Bureau of Land Management
			 that, as of the date of enactment of this Act, has been identified for disposal
			 in appropriate resource management plans.</text>
			</subsection><subsection id="id25df717a-d268-4d5b-94c3-beaf75b443f5"><enum>(b)</enum><header>Use of
			 proceeds</header>
				<paragraph id="iddf5b0c47-0f13-4ac6-9ef9-08e568eade64"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law (other than a
			 law that specifically provides for a proportion of the proceeds of a land sale
			 to be distributed to any trust fund of the State), proceeds from the sale of
			 public land under subsection (a) shall be deposited in a separate account in
			 the Treasury of the United States to be known as the <quote>Owyhee Land
			 Acquisition Account</quote>.</text>
				</paragraph><paragraph id="id5168cc4b-fa53-466a-a2ea-2e0233ad0330"><enum>(2)</enum><header>Availability</header>
					<subparagraph id="id2ab772ec-78a9-41f4-919c-fa297ef7ff8f"><enum>(A)</enum><header>In
			 general</header><text>Amounts in the account shall be available to the
			 Secretary, without further appropriation, to purchase land or interests in land
			 in, or adjacent to, the wilderness areas designated by this Act, including land
			 identified as <quote>Proposed for Acquisition</quote> on the maps described in
			 section 4(a)(1).</text>
					</subparagraph><subparagraph id="id954bf928-8367-471e-b1e7-bb57486f6ca5"><enum>(B)</enum><header>Applicable
			 law</header><text>Any purchase of land or interest in land under subparagraph
			 (A) shall be in accordance with applicable law.</text>
					</subparagraph></paragraph><paragraph id="idd78ceb92-71c4-408a-8bdf-63b0ea158f4c"><enum>(3)</enum><header>Applicability</header><text>This
			 subsection applies to public land within the Boise District of the Bureau of
			 Land Management sold on or after January 1, 2008.</text>
				</paragraph></subsection><subsection id="idd0ab3459-e79f-430a-9916-552d6ac96710"><enum>(c)</enum><header>Termination of
			 authority</header>
				<paragraph id="id6535888a-a1b3-4995-a172-e2c64be979ff"><enum>(1)</enum><header>In
			 general</header><text>The authority provided under this section terminates on
			 the earlier of—</text>
					<subparagraph id="id7c6e3485-9649-48bf-8360-3e566bccb1f8"><enum>(A)</enum><text>the date that is 10 years
			 after the date of enactment of this Act; or</text>
					</subparagraph><subparagraph id="id10f63d02-27a8-4111-b51b-514c6b9fb015"><enum>(B)</enum><text>the date on which a total
			 of $8,000,000 from the account is expended.</text>
					</subparagraph></paragraph><paragraph id="id6a4efb5d-4261-44b8-a385-621c4605767a"><enum>(2)</enum><header>Availability of
			 amounts</header><text>Any amounts remaining in the account on the termination
			 of authority under this section shall be—</text>
					<subparagraph id="idd82430ca-b70b-4ebb-8fbf-46b28c4e6527"><enum>(A)</enum><text>credited as sales of
			 public land in the State;</text>
					</subparagraph><subparagraph id="idc53a8031-46d3-4e57-85b2-b012b0c5f00c"><enum>(B)</enum><text>transferred to the
			 Federal Land Disposal Account established under section 206(a) of the Federal
			 Land Transaction Facilitation Act (43 U.S.C. 2305(a)); and</text>
					</subparagraph><subparagraph id="idc327fa0c-70bf-409e-8a20-36a80ed7768d"><enum>(C)</enum><text>used in accordance with
			 that Act.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="idaecabfd2-cd7f-4d1e-a8c8-e5758d66c7db" reported-display-style="italic"><enum>7.</enum><header>Tribal cultural
			 resources</header>
			<subsection id="id955aa81b-3a8e-4edf-913f-73da446a8ada"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate with the
			 Tribes in the implementation of the Shoshone Paiute Cultural Resource
			 Protection Plan.</text>
			</subsection><subsection id="id4e8a1d1a-edff-44cc-a006-3ef3f947febc"><enum>(b)</enum><header>Agreements</header><text>The
			 Secretary shall seek to enter into agreements with the Tribes to implement the
			 Shoshone Paiute Cultural Resource Protection Plan to protect cultural sites and
			 resources important to the continuation of the traditions and beliefs of the
			 Tribes.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="id3c969529-f6fd-449b-8752-120be9e378fc" reported-display-style="italic"><enum>8.</enum><header>Recreational travel
			 management plans</header>
			<subsection id="id7e992df2-1fef-48ef-b3fd-5b3d88f9ca5b"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the Federal Land Policy and Management
			 Act of 1976 (43 U.S.C. 1701 et seq.), the Secretary shall, in coordination with
			 the Tribes, State, and County, prepare 1 or more travel management plans for
			 motorized and mechanized off-highway vehicle recreation for the land managed by
			 the Bureau of Land Management in the County.</text>
			</subsection><subsection id="id5558116a-3094-4436-bf15-14ead14055c5"><enum>(b)</enum><header>Inventory</header><text>Before
			 preparing the plan under subsection (a), the Secretary shall conduct resource
			 and route inventories of the area covered by the plan.</text>
			</subsection><subsection id="id368fc857-5848-4b3b-aeda-b1240bff2833"><enum>(c)</enum><header>Limitation to
			 designated routes</header>
				<paragraph id="idbc572950-d16d-403e-86e0-185cad4b2f8b"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the plan shall limit recreational motorized and mechanized
			 off-highway vehicle use to a system of designated roads and trails established
			 by the plan.</text>
				</paragraph><paragraph id="id0a24420a-95ba-4ca6-a5ae-8e1a5b75435c"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to snowmobiles.</text>
				</paragraph></subsection><subsection id="idef9e41b9-31e6-4773-b884-301130ee777c"><enum>(d)</enum><header>Temporary
			 limitation</header>
				<paragraph id="idcd49d588-59ae-4994-9a70-47d65e7915b3"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), until the date on
			 which the Secretary completes the plan, all recreational motorized and
			 mechanized off-highway vehicle use shall be limited to roads and trails
			 lawfully in existence on the day before the date of enactment of this
			 Act.</text>
				</paragraph><paragraph id="id04dac13a-dc0f-42d6-ab42-34d6362f421f"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to—</text>
					<subparagraph id="idecad77ee-4f51-4296-bf01-2ae57bee3828"><enum>(A)</enum><text>snowmobiles; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31e325d5-278e-4159-b9b5-99abcd752215"><enum>(B)</enum><text>areas specifically
			 identified as open, closed, or limited in the Owyhee Resource Management
			 Plan.</text>
					</subparagraph></paragraph></subsection><subsection id="id2f6a5bb2-c796-422f-824e-29d7c3398b4f"><enum>(e)</enum><header>Schedule</header>
				<paragraph id="id18055028-c29c-4da2-9957-a906063b8a10"><enum>(1)</enum><header>Owyhee
			 front</header><text>It is the intent of Congress that, not later than 1 year
			 after the date of enactment of this Act, the Secretary shall complete a
			 transportation plan for the Owyhee Front.</text>
				</paragraph><paragraph id="id1f79498d-70d9-4f53-8d73-6b18efa384e9"><enum>(2)</enum><header>Other bureau of land
			 management land in the County</header><text>It is the intent of Congress that,
			 not later than 3 years after the date of enactment of this Act, the Secretary
			 shall complete a transportation plan for Bureau of Land Management land in the
			 County outside the Owyhee Front.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idbd690ed5-7bc2-4b2d-8800-7fe66f59c0fa" reported-display-style="italic" section-type="subsequent-section"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
