			<subsection id="IDEDB3D86929CD4553BE618C8E0A9E2422"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Medicare Telehealth Improvement Act of
			 2008</short-title></quote>.</text>
			</subsection><subsection id="ID3E0A1D5B76F548BA9A93EDCC3DBCC83F"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents of this Act is as follows:</text>

			</subsection></section><section id="ID3D388B4D8E3942129E55E0A9A3F366EC"><enum>2.</enum><header>Increase in
			 number of types of originating sites</header>
			<subsection id="IDEA628769FA7D465DA6C089A5B1EA6321"><enum>(a)</enum><header>Increase</header><text>Section
			 1834(m)(4)(C)(ii) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395m(m)(4)(C)(ii)) is amended by adding at the end
			 the following new subclauses:</text>
				<quoted-block act-name="Social Security Act" id="ID291B3149F7EC438D973F9CDB46099519">
					<subclause id="ID85A0715972F6463A984660EA60F0A304"><enum>(VI)</enum><text>A skilled
				nursing facility (as defined in section 1819(a)).</text>
					</subclause><subclause id="ID4457B55E2BDF4903853ADF7E975C0285"><enum>(VII)</enum><text>A renal
				dialysis facility.</text>
					</subclause><subclause id="ID2C534DFE80D343B7B23D9486AB725E89"><enum>(VIII)</enum><text>A community
				mental health center (as defined in section 1861(ff)(3)(B)), a qualified
				community program described in 1913(b)(1) of the Public Health Service Act, and
				a county mental health clinic.</text>
					</subclause><subclause id="idA554A3452E6B4FA083DF889A947A0827"><enum>(IX)</enum><text>Any other site
				that has a telecommunications
				system.</text>
					</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID6184C35A2CF1475CA91F8A53E32841A0"><enum>(b)</enum><header>No facility fee
			 for certain originating sites</header><text>Section 1834(m)(2) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(m)(2)) is amended—</text>
				<paragraph id="idA987D3716D904DCAAF97DF88AF255198"><enum>(1)</enum><text>in subparagraph
			 (B), in the matter preceding clause (i), by striking <quote>With
			 respect</quote> and inserting <quote>Subject to subparagraph (D), with
			 respect</quote>; and</text>
				</paragraph><paragraph id="id2C885D19EA5D4AC682623D413C98F733"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id64C267BB205E49919B50C6A786AB1415" style="OLC">
						<subparagraph id="id14B09EEF1B1C452A948266AC3116C1F5"><enum>(D)</enum><header>No facility fee
				for certain originating sites</header>
							<clause id="id92B8591D1135408D8BED7665CD0E56E3"><enum>(i)</enum><header>In
				general</header><text>No facility fee shall be paid to an originating site
				described in paragraph (4)(C)(ii)(IX).</text>
							</clause><clause id="id11F3DD6348DC45E4B4101AC8C6A31123"><enum>(ii)</enum><header>No change in
				payment to distant site</header><text>Clause (i) shall not be construed to
				affect the payment to a distant site under subparagraph
				(A).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id0098ADB85833447BB89F60B6E4A4E0F2"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after the date that is 90 days after the date of enactment of
			 this Act.</text>
			</subsection></section><section id="id74C8E71700C94934AFD9F2209143FE60"><enum>3.</enum><header>Expansion of
			 practitioners eligible to furnish telehealth services</header>
			<subsection id="idF1A52F8404E14993A3C6B5CB7A3CAF71"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1834(m) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(m)) is amended—</text>
				<paragraph id="idFCB09794B0614FA8A22A24DC11E33301"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>(as defined in section 1861(r)) or a practitioner (described
			 in section 1842(b)(18)(C))</quote> and inserting <quote>or a
			 practitioner</quote>; and</text>
				</paragraph><paragraph id="id7FBC010A233045D89F4B7EC7CBDCCD07"><enum>(2)</enum><text>in paragraph (4),
			 by striking subparagraph (E) and inserting the following new
			 subparagraph:</text>
					<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="IDE00E489B0A984839A0B168EADEE189D7" style="OLC">
						<subparagraph id="IDD0DAA95941CA42E499BA656CA0B91BA1"><enum>(E)</enum><header>Practitioner</header><text>The
				term <term>practitioner</term> means—</text>
							<clause id="ID8DA2A4281904408E84E1352674756D39"><enum>(i)</enum><text>a
				practitioner described in section 1842(b)(18)(C);</text>
							</clause><clause id="ID594A24D7ADCE4650B3499924DF9AE417"><enum>(ii)</enum><text>a physical
				therapist (as described in section 1861(p));</text>
							</clause><clause id="ID297FE4CC95DA4001A60C4F7C91FDFFCF"><enum>(iii)</enum><text>an occupational
				therapist (as so described);</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDD806039EA03D4B76941359D596DFE476"><enum>(iv)</enum><text>a qualified
				speech-language pathologist (as defined in section 1861(ll)(3)(A));</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idC94E4E0940DA4947A4EA50F0117BAC38"><enum>(v)</enum><text>a qualified
				audiologist (as defined in section 1861(ll)(3)(B));</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id5914229ABCF64C769C8673CB0996480D"><enum>(vi)</enum><text>a certified
				provider (as described in section 1861(qq)(2)(A)); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9066B7331D7841198AAD80559A2D445B"><enum>(vii)</enum><text>any other
				individual or entity determined appropriate by the
				Secretary.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id60E7D56811B2425E8A2194665A2A1360"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 services furnished on or after the date that is 90 days after the date of
			 enactment of this Act.</text>
			</subsection></section><section id="id159EE128A3604D9CB6D30E294E217B41"><enum>4.</enum><header>Improvement of
			 process for updating the list of telehealth services</header>
			<subsection id="id8CDB8D1735A3492E979AA07BFEE72314"><enum>(a)</enum><header>In
			 general</header><text>Section 1834(m)(4)(F)(ii) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395m(m)(4)(F)(ii)) is amended by adding at the end the following sentences:
			 <quote>Such process shall require the Secretary to take into account the
			 recommendations of the Telehealth Advisory Committee (as established under
			 section 4(b) of the <short-title>Medicare Telehealth
			 Improvement Act of 2008</short-title>) when adding or deleting services (and
			 HCPCS codes). If the Secretary does not implement a recommendation of the
			 Telehealth Advisory Committee, the Secretary shall publish in the Federal
			 Register a statement regarding the reason such recommendation was not
			 implemented.</quote>.</text>
			</subsection><subsection id="idFA5A8DA05CC6476D9DC29153ABA90073"><enum>(b)</enum><header>Telehealth
			 Advisory Committee</header>
				<paragraph id="id234D0B324EC24EBAAA7B49F1C4260771"><enum>(1)</enum><header>Establishment</header><text>On
			 and after the date that is 6 months after the date of enactment of this Act,
			 the Secretary of Health and Human Services (in this subsection referred to as
			 the <quote>Secretary</quote>) shall have in place a Telehealth Advisory
			 Committee (in this subsection referred to as the <quote>Advisory
			 Committee</quote>) to make recommendations to the Secretary on the appropriate
			 addition or deletion of services (and HCPCS codes) to those specified in
			 paragraph (4)(F)(i) of section 1834(m) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395m(m)) for
			 authorized payment under paragraph (1) of such section.</text>
				</paragraph><paragraph id="id2496F73EF1CE4582849ED75D0D5A37B8"><enum>(2)</enum><header>Membership;
			 terms</header>
					<subparagraph id="idC21D45C4BA8649A2B3045E0F4ED0DC59"><enum>(A)</enum><header>Membership</header>
						<clause id="id22437DA301D94FACBB80E74B82CB0180"><enum>(i)</enum><header>In
			 general</header><text>The Advisory Committee shall be composed of 7 members, to
			 be appointed by the Secretary, of whom—</text>
							<subclause id="id776E8B0A26E6456E840BCFE22238AE95"><enum>(I)</enum><text>five shall be
			 practicing physicians; and</text>
							</subclause><subclause id="id3F26A1B412DE4BAA9BDF7DB4806F5EF2"><enum>(II)</enum><text>two shall be
			 practicing non-physician health care providers.</text>
							</subclause></clause><clause id="idB9AD1DAD365344F191A140895581948A"><enum>(ii)</enum><header>Requirements
			 for appointing members</header><text>In appointing members of the Advisory
			 Committee, the Secretary shall—</text>
							<subclause id="id0936B7A8F48D4FE79BDADF1C102AD75B"><enum>(I)</enum><text>ensure that each
			 member has prior experience with the practice of telemedicine or
			 telehealth;</text>
							</subclause><subclause id="idFC09169259B54EEAB7184D8A96D079A1"><enum>(II)</enum><text>give preference
			 to individuals who are currently providing telemedicine or telehealth
			 services;</text>
							</subclause><subclause id="idB6E6EE09DD8041319DA0D01544B6A1A2"><enum>(III)</enum><text>ensure that the
			 membership of the Advisory Committee represents a balance of specialties and
			 geographic regions; and</text>
							</subclause><subclause id="id000FD862803B45498236A8B172D5B145"><enum>(IV)</enum><text>take into
			 account the recommendations of stakeholders.</text>
							</subclause></clause></subparagraph><subparagraph id="id0BF8F81D89804E1795E88695A3E44099"><enum>(B)</enum><header>Terms</header><text>The
			 members of the Advisory Committee shall serve for such term as the Secretary
			 may specify.</text>
					</subparagraph></paragraph><paragraph id="id13BBCF7305FE40F593870F64C856999F"><enum>(3)</enum><header>Meetings</header><text>The
			 Advisory Committee shall meet twice per year and at such other times as the
			 Advisory Committee may provide.</text>
				</paragraph><paragraph id="IDF7FEE0C19C9B462AAD6F27C99F728EBB"><enum>(4)</enum><header>Permanent
			 committee</header><text>Section 14 of the Federal Advisory Committee Act (5
			 U.S.C. App.) shall not apply to the Advisory Committee.</text>
				</paragraph><paragraph id="IDFA0C3FEDDEBD479D8DDAAE1244F7BD60"><enum>(5)</enum><header>Waiver of
			 Administrative Limitation</header><text>The Secretary shall establish the
			 Advisory Committee notwithstanding any limitation that may apply to the number
			 of advisory committees that may be established (within the Department of Health
			 and Human Services or otherwise).</text>
