<section id="id491F71895E0B49B3A8A430CFF7A51600" section-type="undesignated-section"><text display-inline="yes-display-inline">This Act may be cited as the
<quote><short-title>Land and Liberty Protection Act of
2008</short-title></quote>.</text>
</section><enum>II</enum>
<section id="id491F71895E0B49B3A8A430BFG7A51600" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
<quote><short-title>Protecting Americans From Violent
Crime Act of 2008</short-title></quote>.</text>
</section><section id="id491F71895E0B49B3A8A430BFF7A51600"><enum>2.</enum><header>Congressional
findings</header><text display-inline="no-display-inline">Congress finds the
following:</text>
<paragraph id="id32F38D58D5DE48CAACB3A82650E02E71"><enum>(1)</enum><text>The Second
Amendment to the Constitution provides that <quote>the right of the people to
keep and bear Arms, shall not be infringed</quote>.</text>
</paragraph><paragraph id="id46EC5A64A7854ED9A4AD1C180D55086A"><enum>(2)</enum><text>Section 2.4(a)(1)
of title 36, Code of Federal Regulations, provides that <quote>except as
otherwise provided in this section and parts 7 (special regulations) and 13
(Alaska regulations), the following are prohibited: (i) Possessing a weapon,
trap or net, (ii) Carrying a weapon, trap or net, (iii) Using a weapon, trap or
net</quote>.</text>
</paragraph><paragraph id="idB15C1680C4354D9CB6FC742C0CA943F9"><enum>(3)</enum><text>Section 27.42 of
title 50, Code of Federal Regulations, provides that, except in special
circumstances, citizens of the United States may not <quote>possess, use, or
transport firearms on national wildlife refuges</quote> of the United States
Fish and Wildlife Service.</text>
</paragraph><paragraph id="id731746B6D2B44D91A4BFFD01295FB53C"><enum>(4)</enum><text>The regulations
described in paragraphs (2) and (3) prevent individuals complying with Federal
and State laws from exercising the second amemdment rights of the individuals
while at units of—</text>
<subparagraph id="id2B38ED6295EC43F99735FE0F701BD327"><enum>(A)</enum><text>the National Park
System; and</text>
</subparagraph><subparagraph id="id9FAFA385FB674F00B173233EB08DA2DB"><enum>(B)</enum><text>the National
Wildlife Refuge System.</text>
</subparagraph></paragraph><paragraph id="idE2342CAB65484C3FAD45262478D625B0"><enum>(5)</enum><text>The existence of
different laws relating to the transportation and possession of firearms at
different units of the National Park System and the National Wildlife Refuge
System entraps law-abiding gun owners while at units of the National Park
System and the National Wildlife Refuge System.</text>
</paragraph><paragraph id="id6C024D82483841BB9F1C64CB3C1B94C9"><enum>(6)</enum><text>The Federal laws
should make it clear that the second amendment rights of an individual at a
unit of the National Park System or the National Wildlife Refuge System should
not be infringed.</text>
</paragraph></section><section id="id42CABCBD984D41C5A95E3AD2FADF5524"><enum>3.</enum><header>Protecting the
right of individuals to bear arms in units of the National Park System and the
National Wildlife Refuge System</header><text display-inline="no-display-inline">The Secretary of the Interior shall not
promulgate or enforce any regulation that prohibits an individual from
possessing a firearm including an assembled or functional firearm in any unit
of the National Park System or the National Wildlife Refuge System if—</text>
<paragraph id="idB935F13D86EE403CB68302A2A3FEED78"><enum>(1)</enum><text>the individual is
not otherwise prohibited by law from possessing the firearm; and</text>
</paragraph><paragraph id="id6E4031FCC1EA40FDB1F0F2DECCBB9F5D"><enum>(2)</enum><text>the possession of
the firearm is in compliance with the law of the State in which the unit of the
National Park System or the National Wildlife Refuge System is located.</text>
</paragraph></section><enum>III</enum>
<section id="idBCFEBD660084420CB9C2E4A6954818DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
<quote><short-title>Government Real Estate Accountability
and Transparency Act of 2008</short-title></quote>.</text>
</section><section id="id643CC61990C0479B92C5A68893B38002"><enum>2.</enum><header>Annual report
detailing amount of land owned by Federal Government and the cost of Government
land ownership to taxpayers</header>
<subsection id="id20BAB25555AB4AF4909533A2FE2B5D33"><enum>(a)</enum><header>Annual
Report</header>
<paragraph id="idD91AF62C257E4EDD9E65E03B1CA3DFA4"><enum>(1)</enum><header>In
general</header><text>Subject to paragraph (2), not later than May 15, 2009,
and annually thereafter, the Director of the Office of Management and Budget
(referred to in this section as the <quote>Director</quote>) shall ensure that
a report that contains the information described in subsection (b) is posted on
a publicly available website.</text>
</paragraph><paragraph id="id7A4EAF61494A42DF858A1B1A7B391168"><enum>(2)</enum><header>Extension
relating to certain segment of report</header><text>With respect to the date on
which the first annual report is required to be posted under paragraph (1), if
the Director determines that an additional period of time is required to gather
the information required under subsection (b)(3)(B), the Director may—</text>
<subparagraph id="id916391F77C2D4A86AB8D9D588C43258C"><enum>(A)</enum><text>as of the date
described in paragraph (1), post each segment of information required under
paragraphs (1), (2), and (3)(A) of subsection (b); and</text>
</subparagraph><subparagraph id="idBC611C7C0A104874B4FDB285F81E36EF"><enum>(B)</enum><text>as of May 15,
2010, post the segment of information required under subsection
(b)(3)(B).</text>
</subparagraph></paragraph></subsection><subsection id="id6A448494F700437DA283338DF33ABF5B"><enum>(b)</enum><header>Required
information</header><text>An annual report described in subsection (a) shall
contain, for the period covered by the report—</text>
<paragraph id="idFC53FADA70B04CB387D55C39CD99F4B2"><enum>(1)</enum><text>a description of
the total quantity of—</text>
<subparagraph id="id2EA3BF458FC346D8AACD2A445605A9EF"><enum>(A)</enum><text>land located
within the jurisdiction of the United States, to be expressed in acres;</text>
</subparagraph><subparagraph id="idF3976534D3C04696BCF36C922CDF6E1D"><enum>(B)</enum><text>the land
described in subparagraph (A) that is owned by the Federal Government, to be
expressed—</text>
<clause id="idD89BFBCB44A64BEA94839AD39EEA2724"><enum>(i)</enum><text>in
acres; and</text>
</clause><clause id="id94FCCF518C3F42579FC076676385A7E1"><enum>(ii)</enum><text>as
a percentage of the quantity described in subparagraph (A); and</text>
</clause></subparagraph><subparagraph id="id84817AD57A214B099C751585BA1FC980"><enum>(C)</enum><text>the land
described in subparagraph (B) that is located in each State, to be expressed,
with respect to each State—</text>
<clause id="id7AD26CFA79AB4CFF992F2D07362B3AAB"><enum>(i)</enum><text>in
acres; and</text>
</clause><clause id="idF7CC232EB57E4EE4AF16477A4725CDE7"><enum>(ii)</enum><text>as
a percentage of the quantity described in subparagraph (B);</text>
</clause></subparagraph></paragraph><paragraph id="idDF5BBDAD0AA7402DA16948B486A2D6E7"><enum>(2)</enum><text>a description of
the total annual cost to the Federal Government for maintaining all parcels of
administrative land and all administrative buildings or structures under the
jurisdiction of each Federal agency; and</text>
</paragraph><paragraph id="id0E4AD83294F94E50BA81533DCAB623F6"><enum>(3)</enum><text>a list and
detailed summary of—</text>
<subparagraph id="id175ECADCBFA64D938F9CAFB390396780"><enum>(A)</enum><text>with respect to
each Federal agency—</text>
<clause id="id71C7C3C4C2F34F82B325B42008E7E853"><enum>(i)</enum><text>the
number of unused or vacant assets;</text>
</clause><clause id="idBE00129C68FC43E59DA6077F5372B319"><enum>(ii)</enum><text>the replacement
value for each unused or vacant asset;</text>
</clause><clause id="idD5C186568DA344D4B75584FED9E2F35E"><enum>(iii)</enum><text>the total
operating costs for each unused or vacant asset; and</text>
</clause><clause id="id4AABC929B06D4D029099D84CD2EC0119"><enum>(iv)</enum><text>the length of
time that each type of asset described in clause (i) has been unused or vacant,
organized in categories comprised of periods of—</text>
<subclause id="idBCFD5ECBB721476E9D1A1496E348AA1B"><enum>(I)</enum><text>not more than 1
year;</text>
</subclause><subclause id="id0290927075D84FDA8582056EC0E3547F"><enum>(II)</enum><text>not less than 1,
but not more than 2, years; and</text>
</subclause><subclause id="idF6C86FC9D69345D2AF9F4ACAAE926FC5"><enum>(III)</enum><text>not less than 2
years; and</text>
</subclause></clause></subparagraph><subparagraph id="id5EF133336F134D598419C5128F328E40"><enum>(B)</enum><text>the estimated
costs to the Federal Government of the maintenance backlog of each Federal
agency, to be—</text>
<clause id="idF9D26FDAE92047F0881A18EE9817D4E7"><enum>(i)</enum><text>organized in
categories comprised of buildings and structures; and</text>
</clause><clause id="idDAE9DE5308D24F7FA140A479AE09FDAC"><enum>(ii)</enum><text>expressed as an
aggregate cost.</text>
</clause></subparagraph></paragraph></subsection><subsection id="id4FA403989310403EB79BBFACFC1A9932"><enum>(c)</enum><header>Use of existing
annual reports</header><text>An annual report required under subsection (a) may
be comprised of any annual report relating to the management of Federal real
property that is published by a Federal agency.</text>
</subsection></section><enum>IV</enum>
<section id="id0DC8BD6784EE46F184FAC39E93D8E689" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
<quote><short-title>No Trespassing Act of
2008</short-title></quote>.</text>
</section><section id="id211DA01FE3E549068F1C0877AA503C59"><enum>2.</enum><header>Notification
requirement</header><text display-inline="no-display-inline">The Secretary of
the Interior shall not approve a management plan for a National Heritage Area
unless the local coordinating entity of the proposed National Heritage Area
provides written notification through the United States mail of the designation
to each individual who resides, or owns property that is located, in the
proposed National Heritage Area.</text>
</section><section id="id5AB0B6DAD3AD46F58DD98CFC2BE1ED43"><enum>3.</enum><header>Written consent
requirement</header><text display-inline="no-display-inline">With respect to
each National Heritage Area, no employee of the National Park Service or member
of the local coordinating entity of the National Heritage Area (including any
designee of the National Park Service or the local coordinating entity) may
enter a parcel of private property located in the National Heritage Area
without the written consent of the owner of the parcel of property.</text>
</section><enum>V</enum>
<section id="idAEB51D2FA9EC408790A78B6724AECF00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
<quote><short-title>Taxpayer Property Protection Act of
2008</short-title></quote>.</text>
</section><section id="id12A07B1CFD93492DB4F085C7084B1489"><enum>2.</enum><header>Requiring
citizen approval of Government land grabs</header>
<subsection id="id57F88723C25D47C1B4F3F517BEED70BF"><enum>(a)</enum><header>In
general</header><text>Subject to subsections (b) and (c), the Department of the
Interior, the Department of Energy, and the Forest Service, acting individually
or in coordination, shall not assume control of any parcel of land located in a
State unless the citizens of each political subdivision of the State in which a
portion of the parcel of land is located approve the assumption of control by a
referendum.</text>
</subsection><subsection id="idF2FBF3DDC6004E20AA3D81D9269D59CE"><enum>(b)</enum><header>National
emergencies</header><text>The requirement described in subsection (a) shall not
apply in the case of a national emergency, as determined by the
President.</text>
</subsection><subsection id="id5F613FB297D14C52B65D772C687544DC"><enum>(c)</enum><header>Private
landowners</header><text>The requirement described in subsection (a) shall not
apply in the case of an exchange between a private landowner and the Federal
Government of a parcel of land.</text>
</subsection><subsection id="idD5AABCBED5EC45F38CB96D2C27036ECB"><enum>(d)</enum><header>Duration of
approval</header>
<paragraph id="id2D31DD57B7AB42ED85FE539D7FD74DFA"><enum>(1)</enum><header>In
general</header><text>With respect to a parcel of land described in subsection
(a), the approval of the citizens of each political subdivision in which a
portion of the parcel of land is located terminates on the date that is 10
years after the date on which the citizens of each political subdivision
approve the control of the parcel of land by the Department of the Interior,
the Department of Energy, or the Forest Service under that subsection.</text>
</paragraph><paragraph id="id751E7E8CD915492EABB23A8AF638EA93"><enum>(2)</enum><header>Renewal of
approval</header><text>With respect to a parcel of land described in subsection
(a), the Department of the Interior, the Department of Energy, or the Forest
Service, as applicable, may renew, by referendum, the approval of the citizens
of each political subdivision in which a portion of the parcel of land is
located.</text>
</paragraph></subsection></section><enum>VI</enum>
<section id="id150CE7E37F9B4A2E9C0DAFBEF4C2796F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
<quote><short-title>Do No Harm Act of
2008</short-title></quote>.</text>
</section><section id="idCFD4BD7FE74345469E581A909D776871"><enum>2.</enum><header>Guarantee of no
adverse affects to citizens as a result of a National Heritage Area
designation</header><text display-inline="no-display-inline">Each National
Heritage Area designation shall not take effect until the date on which the
President certifies that—</text>
<paragraph id="id5E49C0CC71FC41B882BDC95A6B4F859A"><enum>(1)</enum><text>the designation
of each proposed National Heritage Area will not cause an adverse impact
on—</text>
<subparagraph id="id3FF052C7F1AD48FFA9589404E640B132"><enum>(A)</enum><text>agricultural or
livestock production within the proposed National Heritage Area;</text>
</subparagraph><subparagraph id="idC527B62D763D46388D3E6E2B66D6D565"><enum>(B)</enum><text>energy
exploration and production within the proposed National Heritage Area;</text>
</subparagraph><subparagraph id="id6338D600A7614AF5B552CFD23EE2F5C0"><enum>(C)</enum><text>critical
infrastructure located within the proposed National Heritage Area, including
the placement and maintenance of—</text>
<clause id="idB74EA8EB1D8F4AB6A87F29F70BF988BD"><enum>(i)</enum><text>electric
transmission and distribution lines (including related infrastructure);
and</text>
</clause><clause id="id75E88FBA74B14CF791177157B34F8320"><enum>(ii)</enum><text>natural gas
pipelines (including related infrastructure); and</text>
</clause></subparagraph><subparagraph id="id5AD7E20A9EB240BEBDEC2E28EE89ABC6"><enum>(D)</enum><text>the affordability
of housing; and</text>
</subparagraph></paragraph><paragraph id="idC7DCFDB9F7044B52810B727CF2C43491"><enum>(2)</enum><text>with respect to
each State in which there is located a proposed National Heritage Area, the
total deferred maintenance backlog of the State is an amount not greater than
$50,000,000, as reported by the Director of the National Park Service to the
Federal Accounting Standards Advisory Board.</text>
