		<official-title>To amend title XVIII of the Security Act to preserve
		  access to physicians' services under the Medicare program.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Save Medicare Act of
			 2008</short-title></quote>.</text>
		</section><section id="IDc281f1ad10c947e3806ddb8c5d421bfb"><enum>2.</enum><header>Increase in
			 Medicare physician payment update</header><text display-inline="no-display-inline">Section 1848(d) of the Social Security Act
			 (42 U.S.C. 1395w–4(d)), as amended by section 101 of the Medicare, Medicaid,
			 and SCHIP Extension Act of 2007 (Public Law 110–173), is amended—</text>
			<paragraph id="ID96f1f5b749a54f3facf732fe50d316c3"><enum>(1)</enum><text>in paragraph
			 (8)—</text>
				<subparagraph id="id359031A45A8D4B8AAD258111E4924636"><enum>(A)</enum><text>in the heading,
			 by striking <quote><header-in-text level="paragraph" style="OLC">a portion
			 of</header-in-text></quote>;</text>
				</subparagraph><subparagraph id="id8BFE84F6CF3E4EC4908BA783A89A21C4"><enum>(B)</enum><text>in subparagraph
			 (A)—</text>
					<clause id="idDAF69B5F57704E5DB283A2400038C170"><enum>(i)</enum><text>by
			 striking <quote>(A) <header-in-text level="subparagraph" style="OLC">In
			 general.—</header-in-text>Subject to</quote> and inserting
			 <quote>Notwithstanding</quote>; and</text>

				established in paragraph (1)(C) that would otherwise apply for 2009, the update
				to the single conversion factor shall be 1.8
				percent.</text>

			 physician quality reporting system</header>
			<subsection commented="no" display-inline="no-display-inline" id="idBE54AC3FDC8F47E4874B2F8C038D674A"><enum>(a)</enum><header>System</header><text>Section
			 1848(k)(2)(B) of the Social Security Act (42 U.S.C. 1395w–4(k)(2)(B)), as
			 amended by section 101 of the Medicare, Medicaid, and SCHIP Extension Act of
			 2007 (Public Law 110–173), is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idDC9335730F4D4950AF4489F2D8C4039E"><enum>(1)</enum><text>in the heading,
			 by striking <quote><header-in-text level="subparagraph" style="OLC">and
			 2009</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">, 2009, and
			 2010</header-in-text></quote>;</text>

			 Relief and Health Care Act of 2006 (42 U.S.C. 1395w–4 note), as amended by
			 section 101 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (Public
			 Law 110–173), is amended—</text>
				<paragraph id="H5FD3B737AC784CF598285137FCA519B4"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection" style="OLC">and
			 2008</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, 2008, and 2009</header-in-text></quote>;

			 medicare incentive payment program for physician scarcity areas</header><text display-inline="no-display-inline">Section 1833(u) of the Social Security Act
			 (42 U.S.C. 1395l(u)), as amended by section 102 of the Medicare, Medicaid, and
			 SCHIP Extension Act of 2007 (Public Law 110–173), is amended—</text>
			<paragraph id="ID0ea825a1997d44668a0f54ec69adb616"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>July 1, 2008</quote> and inserting <quote>January 1,
			 2010</quote>; and</text>
			</paragraph><paragraph id="ID09cd74766ff24273870faef2262aa0e0"><enum>(2)</enum><text>in subparagraph
			 (4)(D), by striking <quote>July 1, 2008</quote> and inserting <quote>January 1,
			 2010</quote>.</text>
			</paragraph></section><section id="H7C6BF9A6A0954ACFA38C097EE3AD5E5D"><enum>5.</enum><header>Extension of
			 floor on Medicare work geographic adjustment under the Medicare physician fee
			 schedule</header><text display-inline="no-display-inline">Section 1848(e)(1) of
			 the Social Security Act (42 U.S.C. 1395w–4(e)(1), as amended by section 103 of
			 the Medicare, Medicaid, and SCHIP Extension Act of 2007 (Public Law 110–173),
			 is amended—</text>
			<paragraph id="idF0B419D56F344CF98C33DE9DC5A002E3"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), in the matter
			 preceding clause (i), by striking <quote>subparagraphs (B)</quote> through
			 <quote>the Secretary</quote> and inserting <quote>the succeeding provisions of
			 this paragraph, the Secretary</quote>; and</text>
			</paragraph><paragraph id="id7C093AEE12874BD9AD91EE0739140E38"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking
			 <quote>July 1, 2008</quote> and inserting <quote>January 1,
			 2010</quote>.</text>
			</paragraph></section><section id="IDe377f71c2d344a4fa35ec7141c71640b"><enum>6.</enum><header>Extension of
			 accommodation of physicians ordered to active duty in the armed
			 services</header><text display-inline="no-display-inline">Section
			 1842(b)(6)(D)(iii) of the Social Security Act (42 U.S.C. 1395u(b)(6)(D)(iii)),
			 as amended by section 116 of the Medicare, Medicaid, and SCHIP Extension Act of
			 2007 (Public Law 110–173), is amended by striking <quote>July 1, 2008</quote>
			 and inserting <quote>January 1, 2010</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id6F4144CAB5964486BAB9BD3B843E3757" section-type="subsequent-section"><enum>7.</enum><header>Sense of the Senate
			 regarding fiscal responsibility</header><text display-inline="no-display-inline">It is the sense of the Senate that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idF51B5335FF6A424786071AFB8A8589D6"><enum>(1)</enum><text display-inline="yes-display-inline">the provisions of, and amendments made by,
			 this Act should be deficit neutral over the 5-year period beginning on October
			 1, 2008; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7AE72B6A15AF44E991BBC9A33B3B747B"><enum>(2)</enum><text display-inline="yes-display-inline">Congress should address the challenges
			 facing the Medicare program in a fiscally responsible manner.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id7C8AB5C35BF34F9698B02AEF7CB58F90" section-type="subsequent-section"><enum>8.</enum><header>Sense of the Senate
			 regarding quality</header><text display-inline="no-display-inline">It is the
			 Sense of the Senate that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idA4FA9A193ABE41EB9A51AF28F7A3F9A7"><enum>(1)</enum><text display-inline="yes-display-inline">the Medicare program should provide
			 payments to physicians and other health professionals that serve as positive
			 incentives for participation in voluntary initiatives to improve health care
			 quality;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC825D1F8C4A44597A7790CBC36D13A0F"><enum>(2)</enum><text display-inline="yes-display-inline">such initiatives should include
			 pay-for-reporting programs, programs to facilitate coordination of care, the
			 use of clinical appropriateness criteria developed by organizations
			 representing physicians and other health care professionals, grants for
			 developing and pilot testing data registry systems, grants for participation in
			 such data registries, and other appropriate initiatives; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37B022D67A7F4755AE1D14A6C7D3D3E9"><enum>(3)</enum><text display-inline="yes-display-inline">financing for such initiatives should be
			 non-punitive and exempt from the Medicare physician fee schedule budget
			 neutrality requirements.</text>
