		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Prehistoric Trackways National
			 Monument Establishment Act</short-title></quote>.</text>
		</section><section id="id5875689E6D5F4B398257D0A8098E2C93"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idBA893CCEBF174EDDABD48089C2AF86F7"><enum>(1)</enum><header>Monument</header><text>The
			 term <quote>Monument</quote> means the Prehistoric Trackways National Monument
			 established by section 4(a).</text>
			</paragraph><paragraph id="ID385cba07286d4e1aa70806320cacd5a7"><enum>(2)</enum><header>Public
			 land</header><text>The term <quote>public land</quote> has the meaning given
			 the term <quote>public lands</quote> in section 103 of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1702).</text>
			</paragraph><paragraph id="ID09cc6e75b1bb409ebc2d61a1311c3e08"><enum>(3)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
			</paragraph></section><section id="id04A68E5F904640CCA19F10A57D9B11D2"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID618ec632e74f4c7093f43847f82fc651"><enum>(1)</enum><text>in 1987, a major
			 deposit of Paleozoic Era fossilized footprint megatrackways was discovered in
			 the Robledo Mountains in southern New Mexico;</text>
			</paragraph><paragraph id="ID5c08cdbc52b04b17aa1965fcc1ac5738"><enum>(2)</enum><text>the trackways
			 contain footprints of numerous amphibians, reptiles, and insects (including
			 previously unknown species), plants, and petrified wood dating back
			 approximately 280,000,000 years, which collectively provide new opportunities
			 to understand animal behaviors and environments from a time predating the
			 dinosaurs;</text>
			</paragraph><paragraph id="IDb2cf99db90244c6eb7865cdd5148c56d"><enum>(3)</enum><text>title III of
			 Public Law 101–578 (104 Stat. 2860)—</text>
				<subparagraph id="id129CE1E8CCD54A649687908BCF49752B"><enum>(A)</enum><text>provided interim
			 protection for the site at which the trackways were discovered; and</text>
				</subparagraph><subparagraph id="idB30DAFBB685444B3BC18D861A4573BDB"><enum>(B)</enum><text>directed the
			 Secretary of the Interior to—</text>
					<clause id="id5F5B9101F7E744BB9244C69AC1BCD610"><enum>(i)</enum><text>prepare a study
			 assessing the significance of the site; and</text>
					</clause><clause id="idC80BA4FA23D944C3900E61CB735D34B9"><enum>(ii)</enum><text>based on the
			 study, provide recommendations for protection of the paleontological resources
			 at the site;</text>
					</clause></subparagraph></paragraph><paragraph id="IDa10136db9b3f4e328bfd93e8933cae01"><enum>(4)</enum><text>the Bureau of
			 Land Management completed the Paleozoic Trackways Scientific Study Report in
			 1994, which characterized the site as containing <quote>the most scientifically
			 significant Early Permian tracksites</quote> in the world;</text>
			</paragraph><paragraph id="ID34265f564921458580a59aa78f4fe2c7"><enum>(5)</enum><text>despite the
			 conclusion of the study and the recommendations for protection, the site
			 remains unprotected and many irreplaceable trackways specimens have been lost
			 to vandalism or theft; and</text>
			</paragraph><paragraph id="IDef868318c9634a889376bfb668e7deed"><enum>(6)</enum><text>designation of
			 the trackways site as a National Monument would protect the unique fossil
			 resources for present and future generations while allowing for public
			 education and continued scientific research opportunities.</text>
			</paragraph></section><section id="id678DDA797D7844388522B8DC4589C36D"><enum>4.</enum><header>Establishment</header>
			<subsection id="ID8b1680e2b1824282a6b43eaa453d216c"><enum>(a)</enum><header>In
			 general</header><text>In order to conserve, protect, and enhance the unique and
			 nationally important paleontological, scientific, educational, scenic, and
			 recreational resources and values of the public land described in subsection
			 (b), there is established the Prehistoric Trackways National Monument in the
			 State of New Mexico.</text>
			</subsection><subsection id="IDa9fed2d1302a4bf1ab7e4fd5300731fc"><enum>(b)</enum><header>Description of
			 land</header><text>The Monument shall consist of approximately
			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">5,367</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">5,280</added-phrase>
			 acres of public land in Doña Ana County, New Mexico, as generally depicted on
			 the map entitled <quote>Prehistoric Trackways National Monument</quote> and
			 dated
			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">June 1,
			 2006</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">January 25,
			 2007</added-phrase>.</text>
			</subsection><subsection id="IDe665c30b85b2415da125533f5ba32958"><enum>(c)</enum><header>Map; legal
			 description</header>
				<paragraph id="id7BA347B3833345F88AC05C26ECD04F7D"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall prepare and submit to Congress an official map
			 and legal description of the Monument.</text>
				</paragraph><paragraph id="id818D5366321D477E8199BA259A150BE2"><enum>(2)</enum><header>Corrections</header><text>The
			 map and legal description submitted under paragraph (1) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct any clerical or typographical errors in the legal description and the
			 map.</text>
				</paragraph><paragraph id="ID8383c81af89e44ff931ef0e649b3ec4b"><enum>(3)</enum><header>Conflict
			 between map and legal description</header><text>In the case of a conflict
			 between the map and the legal description, the map shall control.</text>
				</paragraph><paragraph id="ID2ff4ad04b41b4891841c7cc99f292e96"><enum>(4)</enum><header>Availability of
			 map and legal description</header><text>Copies of the map and legal description
			 shall be on file and available for public inspection in the appropriate offices
			 of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="ID1d6a7ecc4a384452922e419bfd8cfd91"><enum>(d)</enum><header>Minor boundary
			 adjustments</header><text>If additional paleontological resources are
			 discovered on public land adjacent to the Monument after the date of enactment
			 of this Act, the Secretary may make minor boundary adjustments to the Monument
			 to include the resources in the Monument.</text>
			</subsection></section><section id="id2295027C644C404FBBD05B445D1E0F65"><enum>5.</enum><header>Administration</header>
			<subsection id="ID1406dc4c85be43059190d98a48628360"><enum>(a)</enum><header>Management</header>
				<paragraph id="id00A3B82EE1AE4893BED08B7B8BAB8702"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the Monument—</text>
					<subparagraph id="id8CEE1A614A054D4799B45F2FB364CEDF"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources and values of the Monument,
			 including the resources and values described in section 4(a); and</text>
					</subparagraph><subparagraph id="id1E39F81E57AB425D8E94A9946108BEAC"><enum>(B)</enum><text>in accordance
			 with—</text>
						<clause id="idBC5A5295883B47909ADF4BE002D37C6F"><enum>(i)</enum><text>this Act;</text>
						</clause><clause id="idE6375C3914F546ADBE26A588F0878941"><enum>(ii)</enum><text>the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43
			 U.S.C. 1701</external-xref> et seq.); and</text>
						</clause><clause id="idF779BD60E8F44AF7B3409B7912C243BB"><enum>(iii)</enum><text>other
			 applicable laws.</text>
						</clause></subparagraph></paragraph><paragraph id="ID4a158fcf67134c4d978b8809239b02d6"><enum>(2)</enum><header>National
			 landscape conservation system</header><text>The Monument shall be managed as a
			 component of the National Landscape Conservation System.</text>
				</paragraph><paragraph changed="deleted" committee-id="SSEG00" id="ID3a9c0c6c803b41ffa56591965ff148a0" reported-display-style="strikethrough"><enum>(3)</enum><header>Protection of
			 resources and values</header><text>The Secretary shall manage public land
			 adjacent to the Monument in a manner that is consistent with the protection of
			 the resources and values of the Monument.</text>
				</paragraph></subsection><subsection id="ID35d60589bff14acfaeb99fbf1f0e75a8"><enum>(b)</enum><header>Management
			 Plan</header>
				<paragraph id="id90A839BE4D554748A16CBC5107380E77"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall develop a comprehensive management plan for the
			 long-term protection and management of the Monument.</text>
				</paragraph><paragraph id="idCDD0207DCB094E108C492149CE374636"><enum>(2)</enum><header>Components</header><text>The
			 management plan under paragraph (1)—</text>
					<subparagraph id="id7CD1E967FF43493C86A518AF6A58F46D"><enum>(A)</enum><text>shall—</text>
						<clause id="id5C8A5BD033DC447B92D578B37ACA894D"><enum>(i)</enum><text>describe the
			 appropriate uses and management of the Monument, consistent with the provisions
			 of this Act; and</text>
						</clause><clause id="IDe1cefa262440417db57aeac930493c89"><enum>(ii)</enum><text>allow for
			 continued scientific research at the Monument during the development of the
			 management plan; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id862E367DF1F74C689D93B1E75BE2D7FA"><enum>(B)</enum><text>may—</text>
						<clause commented="no" display-inline="no-display-inline" id="idC03559E3FC18460F9372654CCE39C541"><enum>(i)</enum><text>incorporate any
			 appropriate decisions contained in any current management or activity plan for
			 the land described in section 4(b); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAF78BB6204F84239961CC218D26C4911"><enum>(ii)</enum><text>use information
			 developed in studies of any land within or adjacent to the Monument that were
			 conducted before the date of enactment of this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID6e71d0c2a05d4795b715baa32835fb2b"><enum>(c)</enum><header>Authorized
			 uses</header><text>The Secretary shall only allow uses of the Monument that the
			 Secretary determines would further the purposes for which the Monument has been
			 established.</text>
			</subsection><subsection id="ID6caa0733e4cd4aca9eb9c6283e04c518"><enum>(d)</enum><header>Interpretation,
			 education, and scientific research</header>
				<paragraph id="idCA880023DFAB43EB9181D68CEAE43F3E"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall provide for public interpretation of,
			 and education and scientific research on, the paleontological resources of the
			 Monument, with priority given to exhibiting and curating the resources in Doña
			 Ana County, New Mexico.</text>
				</paragraph><paragraph id="id1AEFE9528E0B407E986B435A8E0C2313"><enum>(2)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 with appropriate public entities to carry out paragraph (1).</text>
				</paragraph></subsection><subsection id="ID7c77ca5c5bfa4c949e5fa6a952f8120d"><enum>(e)</enum><header>Special
			 management areas</header>
				<paragraph id="id12356F8E36F04EAFB7B8A887D0978014"><enum>(1)</enum><header>In
			 general</header><text>The establishment of the Monument shall not change the
			 management status of any area within the boundary of the Monument that
			 is—</text>
					<subparagraph id="ID1de0ab6022384965a89d9c9f9cfb9da2"><enum>(A)</enum><text>designated as a
			 wilderness study area and managed in accordance with section 603(c) of the
			 Federal Land Policy and Management Act of 1976 (43 U.S.C. 1782(c)); or</text>
					</subparagraph><subparagraph id="ID01b8549ab6364f7ebdec5488becd156a"><enum>(B)</enum><text>managed as an
			 area of critical environment concern.</text>
					</subparagraph></paragraph><paragraph id="ID4e069dacd6614a3ea38d8cb5e980b514"><enum>(2)</enum><header>Conflict of
			 laws</header><text>If there is a conflict between the laws applicable to the
			 areas described in paragraph (1) and this Act, the more restrictive provision
			 shall control.</text>
				</paragraph></subsection><subsection id="IDe76664075252410ab755cab27b56b95c"><enum>(f)</enum><header>Motorized
			 vehicles</header>
				<paragraph id="idCD076863CA0342249635EDE0586F0D3C"><enum>(1)</enum><header>In
			 general</header><text>Except as needed for administrative purposes or to
			 respond to an emergency, the use of motorized vehicles in the Monument shall be
			 allowed only on roads and trails designated for use by motorized vehicles under
			 the management plan prepared under subsection (b).</text>
				</paragraph><paragraph id="IDcba44819dd3243d7a8ea988774383cc5"><enum>(2)</enum><header>Permitted
			 Events</header><text>The Secretary may issue permits for special recreation
			 events involving motorized vehicles within the boundaries of the Monument,
			 including the <quote>Chile Challenge</quote>—</text>
					<subparagraph id="id46E0A691975E43B4896A0BC70A861371"><enum>(A)</enum><text>to the extent the
			 events do not harm paleontological resources; and</text>
					</subparagraph><subparagraph id="idB974FCD65CA143A480237311138549CF"><enum>(B)</enum><text>subject to any
			 terms and conditions that the Secretary determines to be necessary.</text>
					</subparagraph></paragraph></subsection><subsection id="ID6a8ee765169b45c197f71d17a2abfac2"><enum>(g)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights, any Federal land within the Monument and any land or
			 interest in land that is acquired by the United States for inclusion in the
			 Monument after the date of enactment of this Act are withdrawn from—</text>
				<paragraph id="id067F8A0E1E2D4E66A576A2225F49AC3C"><enum>(1)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="idF896113649E04CDAA0CB9A0BB899A7FF"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="id963321428D334E1BA6152830869C682A"><enum>(3)</enum><text>operation of the
			 mineral leasing laws, geothermal leasing laws, and minerals materials
			 laws.</text>
				</paragraph></subsection><subsection id="ID149cef98a700420ea6a7de9babb7def3"><enum>(h)</enum><header>Grazing</header><text>The
			 Secretary may allow grazing to continue in any area of the Monument in which
			 grazing is allowed before the date of enactment of this Act, subject to
			 applicable laws (including regulations).</text>
			</subsection><subsection changed="deleted" committee-id="SSEG00" id="ID415652eddffb4d949b577b3793a68b25" reported-display-style="strikethrough"><enum>(i)</enum><header>Hunting</header>
				<paragraph id="id9D2A2E129697417D8D9503D450AE5C56"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this Act diminishes the jurisdiction of the
			 State of New Mexico with respect to fish and wildlife management, including
			 regulation of hunting on public land within the Monument.</text>
				</paragraph><paragraph id="id274D92BFC9884E4BA4450D7BD95BCCED"><enum>(2)</enum><header>Regulations</header><text>The
			 Secretary, after consultation with the New Mexico Department of Game and Fish,
			 may issue regulations designating zones in which and establishing periods
			 during which hunting shall not be allowed for reasons of public safety,
			 administration, or public use and enjoyment.</text>
				</paragraph></subsection><subsection changed="deleted" committee-id="SSEG00" id="IDcaf08eb1f2fe491fa59f74f718a2cc34" reported-display-style="strikethrough"><enum>(j)</enum><header>Water
			 Rights</header><text>Nothing in this Act constitutes an express or implied
			 reservation by the United States of any water or water rights with respect to
			 the Monument.</text>
			</subsection><subsection changed="added" committee-id="SSEG00" id="id0F9D46C700BF4358B1A2AEED0BDAC7A0" reported-display-style="italic"><enum>(i)</enum><header>Water
			 Rights</header><text>Nothing in this Act constitutes an express or implied
			 reservation by the United States of any water or water rights with respect to
			 the Monument.</text>
			</subsection></section><section id="IDa15f9508181b43ef9a3404790d3949b3"><enum>6.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
