		  to authorize the Secretary of Health and Human Services to negotiate for lower
		  prices for Medicare prescription drugs.</official-title>

		<section id="idD874E100A4184C7F8B22AB8526AEEA7E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prescription Drug and Health
			 Improvement Act of 2007</short-title></quote>.</text>
		</section><section id="id09832F88937D4F18BC6BBC61D90B5858" section-type="subsequent-section"><enum>2.</enum><header>Negotiating fair
			 prices for medicare prescription drugs</header>
			<subsection id="IDD957981F6BE741E382087FD1FE0B860C"><enum>(a)</enum><header>Negotiating
			 fair prices</header>
				<paragraph id="id8A7503A3469F44F5B96828557B005632"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–11 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395w–111) is
			 amended by striking subsection (i) (relating to noninterference) and by
			 inserting the following:</text>
					<quoted-block act-name="Social Security Act" id="ID95576C94CE384DCCB810F4AAB15B1895" style="OLC">
						<subsection id="ID73AC92EA6D0F4DD9A877301D1B94A701"><enum>(i)</enum><header>Authority To
				negotiate prices with manufacturers</header><text>In order to ensure that
				beneficiaries enrolled under prescription drug plans and MA–PD plans pay the
				lowest possible price, the Secretary shall have authority similar to that of
				other Federal entities that purchase prescription drugs in bulk to negotiate
				contracts with manufacturers of covered part D drugs, consistent with the
				requirements and in furtherance of the goals of providing quality care and
				containing costs under this
				part.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDC939CBFA45324369946A0D21C8C71757"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall take effect on the
			 date of enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0D4BB307C54245A99679BD7CA4B84420"><enum>(b)</enum><header>HHS reports
			 comparing negotiated prescription drug prices and retail prescription drug
			 prices</header><text>Beginning in 2008, the Secretary of Health and Human
			 Services shall regularly, but in no case less often than quarterly, submit to
			 Congress a report that compares the prices for covered part D drugs (as defined
			 in section 1860D–2(e) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395w–102(e)) negotiated by the Secretary pursuant to
			 section 1860D–11(i) of such Act (42 U.S.C. 1395w–111(i)), as amended by
			 subsection (a), with the average price a retail pharmacy would charge an
			 individual who does not have health insurance coverage for purchasing the same
			 strength, quantity, and dosage form of such covered part D drug.</text>
