		<official-title>To expand the definition of independent student under the
		  Higher Education Act of 1965 to include active members of the National Guard or
		  Reserve forces of the United States and to prevent payments of educational
		  assistance for veterans and members of the Selected Reserve from being offset
		  in the calculation of financial aid under such Act. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Student Veteran Financial Aid
			 Fairness Act of 2008</short-title></quote>.</text>
		</section><section id="id4AB4B829AEC94D4EA9383100177E141E"><enum>2.</enum><header>Independent
			 student</header>
			<subsection id="idB517A3476DB3456F8857F7748E8905E5"><enum>(a)</enum><header>Amendment to
			 current law</header>
				<paragraph id="id6757E3C6ED604B7DACD0F5586A79C95D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 480(d)(3) of
			 the Higher Education Act of 1965 (20 U.S.C. 1087vv(d)(3)) is amended by
			 inserting <quote>or is a current active member of the National Guard or Reserve
			 forces of the United States who has completed initial military training</quote>
			 after <quote>purposes</quote>.</text>
				</paragraph><paragraph id="idACFF600E8B6B481AB888E0C3C7407AD7"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall be effective on
			 July 1, 2008.</text>
				</paragraph></subsection><subsection commented="no" id="id04758C71848F478C9606AC49EBEDA10F"><enum>(b)</enum><header>Amendment to
			 law as amended by the college cost reduction and access act</header>
				<paragraph commented="no" id="id83C491C0EE01407181B51E5ACE6E9C31"><enum>(1)</enum><header>In
			 general</header><text>Section 480(d) of the Higher Education Act of 1965 (20
			 U.S.C. 1087vv(d)), as amended by section 604 of the College Cost Reduction and
			 Access Act (Public Law 110–84), is amended in paragraph (1)(D), by inserting
			 <quote>or is a current active member of the National Guard or Reserve forces of
			 the United States who has completed initial military training</quote> after
			 <quote>purposes</quote>.</text>
				</paragraph><paragraph commented="no" id="id6C4BAE4B55AB40C0BA364889A84D0333"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall be effective on
			 July 1, 2009.</text>
				</paragraph></subsection></section><section id="H56D5027F74E942D68D064C9EB28CC6EF"><enum>3.</enum><header>Treatment as
			 other financial aid</header><text display-inline="no-display-inline">Section
			 480(j)(1) of the Higher Education Act of 1965 (20 U.S.C. 1087vv(j)(1)) is
			 amended—</text>
			<paragraph id="H6BB97E216E814F36988907131CBC55CD"><enum>(1)</enum><text>by striking
			 <quote>veterans' education benefits as defined in subsection (c), and</quote>;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H169823D5BABF488FA3D30B527D7DAF1"><enum>(2)</enum><text>by inserting before
			 the period at the end the following: <quote>, but excluding any payments of
			 educational assistance to veterans under title 38, United States Code, and to
			 members of the Selected Reserve under chapters 1606 and 1607 of title 10,
			 United States Code</quote>.</text>
