		<official-title>To prohibit aliens who are repeat drunk drivers from
		  obtaining legal status or immigration benefits.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Safe Roads Enhancement Act of
			 2008</short-title></quote>.</text>
		</section><section id="IDd6f48a36ab2245b0a424811ac3afd73d"><enum>2.</enum><header>Aggravated
			 felony drunk driving offenses</header><text display-inline="no-display-inline">Section 101(a)(43)(F) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(43)(F)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idBCCC8CE3AF3E4FF4AC2DE8B99F1F9DEA" style="OLC">
				<subparagraph id="IDa80e1b43b70f407ab40184fc21733615"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id6B3D162AF9ED4C43B74C24D7F69635DB"><enum>(i)</enum><text>a crime of violence (as
				defined in section 16 of title 18, United States Code) for which the term of
				imprisonment is at least 1 year, except for a purely political offense;
				or</text>
					</clause><clause id="id1FA65F1E3BF5447491D9BF4DCFE4FCFE" indent="up1"><enum>(ii)</enum><text>a third conviction for driving
				while intoxicated (including any conviction for driving while under the
				influence of, or impaired by, alcohol or drugs), without regard to whether the
				conviction is classified as a misdemeanor or felony under State
				law.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID0c1e68e823a04294b53f5fcc8f14108b"><enum>3.</enum><header>Inadmissibility
			 and deportability of drunk drivers</header>
			<subsection id="IDd8750a12a3de4130aa078b03e6b62141"><enum>(a)</enum><header>Inadmissibility</header><text>Section
			 212(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(2)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4CD81561642144FD8F06326BCFA077A6" style="OLC">
					<subparagraph id="ID930ad0ed44bb4ad492587238004502af"><enum>(J)</enum><header>Drunk
				drivers</header>
						<clause id="id216494E5991F4CA28F2B77A4C83914BC"><enum>(i)</enum><header>In
				general</header><text>Any alien who has been convicted of driving while
				intoxicated (including any conviction for driving while under the influence of,
				or impaired by, alcohol or drugs), without regard to whether the conviction is
				classified as a misdemeanor or felony under State law, for which the term of
				imprisonment is at least 1 year, is inadmissible.</text>
						</clause><clause id="id0FC6B62705AD4C91BD0A9F9CF7194D2C"><enum>(ii)</enum><header>Exceptions</header><text>Clause
				(i) shall not apply to any nonimmigrant described in subparagraph (F), (J), or
				(M) of section
				101(a)(15).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDccb1a95d47c84d6786e9b6f33e1e8bb7"><enum>(b)</enum><header>Deportability</header><text>Section
			 237(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1227(a)(2)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1DAD864C18FC44F7A2B8DDF096F72989" style="OLC">
					<subparagraph id="IDf3034e23f459447c85f09eb839d1be19"><enum>(F)</enum><header>Drunk
				drivers</header>
						<clause id="idB23D07725DF149C3B8832C8ABA80B3DB"><enum>(i)</enum><header>In
				general</header><text>Any alien who has been convicted of driving while
				intoxicated (including any conviction for driving while under the influence of,
				or impaired by, alcohol or drugs), without regard to whether the conviction is
				classified as a misdemeanor or felony under State law, for which the term of
				imprisonment is at least 1 year, is deportable.</text>
						</clause><clause id="id4B6A98E68F63408E88DCCC6FDB248465"><enum>(ii)</enum><header>Exceptions</header><text>Clause
				(i) shall not apply to any nonimmigrant described in subparagraph (F), (J), or
				(M) of section
				101(a)(15).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDf34793e0718c453faaebb6baae99e809"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) and (b)—</text>
				<paragraph id="id103CB58B8A45428BAAFE60A00D87C173"><enum>(1)</enum><text>shall take effect
			 on the date of the enactment of this Act; and</text>
				</paragraph><paragraph id="id687D2138CE3E412BB35A68A4BE45F7B8"><enum>(2)</enum><text>shall apply
			 to—</text>
					<subparagraph id="ID3e564eccd4bc4dcdbf0eb247cecf04cb"><enum>(A)</enum><text>any act or
			 conviction that occurred before, on, or after such date; and</text>
					</subparagraph><subparagraph id="ID840c50ba32364858924774be3eb971f3"><enum>(B)</enum><text>any application
			 or petition for a benefit, relief, waiver, or other matter under the
			 immigration laws of the United States, which is pending or was filed on or
			 after such date.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
