		<official-title>To authorize the Department of Homeland Security to use
		  an employer’s failure to timely resolve discrepancies with the Social Security
		  Administration after receiving a <quote>no match</quote> notice as evidence
		  that the employer violated section 274A of the Immigration and Nationality
		  Act.</official-title>

		<section id="id02EAC15B021342028134D78AAADE9F4B" section-type="section-one"><enum>1.</enum><header>Constructive knowledge that
			 employee is an unauthorized alien</header><text display-inline="no-display-inline">Section 274A(a) of the Immigration and
			 Nationality Act (8 U.S.C. 1324a(a)) is amended—</text>
			<paragraph id="id330992A29816413091888AADD8604D26"><enum>(1)</enum><text>in paragraph
			 (1)(A), by inserting <quote>, or having constructive knowledge that,</quote>
			 after <quote>knowing</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD38D2EFDEAB4B05922B777C52473785"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>, or
			 having constructive knowledge that,</quote> after <quote>knowing</quote>;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32E651A7CED74A1C8A607033F2ADF9EE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id030C8D95CCFC43BF8693E7F13B5A028B" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idB63BAABF302A4B608AA92A35D4A9C1FF"><enum>(8)</enum><header>Constructive
				knowledge defined</header><text>In this subsection, <term>constructive
				knowledge</term> is deemed to have been obtained by an employer that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id28C80F9483E74A63B1FEB7FCCBC62660"><enum>(A)</enum><text>receives a social
				security no-match letter notifying the employer that the Social Security
				Administration has been unable to match the employee’s name with the Social
				Security number provided by the employer; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id517FC25C09514EBF8848DD106EB66A65"><enum>(B)</enum><text>fails to take the
				corrective action suggested by the Social Security Administration or the
				Department of Homeland Security within 90 days of receiving the letter
				described in subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idA32D01C1065C43F1A1EF9DB08B96FF62"><enum>2.</enum><header>Termination of
			 employees based on constructive knowledge that employees are unauthorized
			 aliens is not an unfair immigration-related employment practice</header><text display-inline="no-display-inline">Section 274B(a)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1324b(a)(2)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id2D74D9CAF47F4F2FB3CAD818FE7ADC01"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking the comma
			 at the end and inserting a semicolon;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0246E7D4762487C86480A0460A2973D"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>, or</quote> and inserting a semicolon;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52F83B4100544AFD99EB252C42E6D6C2"><enum>(3)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB9748D42BA6444DDA8E4F8B5C0FD48D9"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3907EDF915B1406CB3E576CCBF7CAC1C" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="idB2D48A9E384D4F7BB36CE79ACCDE1C8E"><enum>(D)</enum><text>the firing of an
				employee by an employer that has constructive knowledge that the employee is
				not authorized to work in the United States based on the receipt of notice from
				the Social Security Administration that the name and number provided by the
				employee do not match, and can not be corrected to match, the records of the
				Social Security
				Administration.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id38E48420C61C4F289E95AACB290AB499"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall
			 promulgate regulations to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idA749D6261A70434AB7208FBD120EE8D2"><enum>(1)</enum><text>carry out the
			 amendment made by section 1; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20D8FE6C6382428A828B3B72576CADE6"><enum>(2)</enum><text>interpret the
			 exception contained in the amendment made by section 2.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id4FFCA9C2272F4B2FB34DB19B4CED0ABC"><enum>4.</enum><header>Disclosure of no
			 match letters</header><text display-inline="no-display-inline">Section 6103(l)
			 of the Internal Revenue Code of 1986 is amended by adding at the end the
			 following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="idEA2FEC03F13D4A90BB375799B7C3BFBF" style="OLC">
				<paragraph id="idA7356F69AA724C92814240AB58DB01F6"><enum>(21)</enum><header>Disclosure of
				certain taxpayer identity information by social security administration to
				department of homeland security</header><text>From taxpayer identity
				information which has been disclosed to the Social Security Administration, the
				Commissioner of Social Security shall disclose directly to officers and
				employees of the Department of Homeland Security—</text>
					<subparagraph id="id087FB868CCA04212B0FCA8F385D5F115"><enum>(A)</enum><text>the taxpayer
				identity information of each person who has filed in information return
				required by reason section 6051, which contains more than 10 names and taxpayer
				identifying numbers of employees (within the meaning of such section)—</text>
						<clause id="id53883FB735944F6D997F12D0D8AC9DD2"><enum>(i)</enum><text>that did not
				match the records maintained by the Commissioner of Social Security, or</text>
						</clause><clause id="id137FD2F6352246A3BD18F650DFD29E89"><enum>(ii)</enum><text>with the same
				taxpayer identification number, and</text>
						</clause></subparagraph><subparagraph id="id93D6204F5B2B457BB773F8E1E296CD86"><enum>(B)</enum><text>the number of
				employees described in clauses (i) and (ii) of subparagraph
				(A).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
