		<official-title>To increase the criminal penalties for illegally
		  reentering the United States and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Border Crossing Deterrence Act of
			 2008</short-title></quote>.</text>
		</section><section id="ID5f65421ffc77480180d8d063a8eb4ab5"><enum>2.</enum><header>Expansion of
			 Operation Streamline</header>
			<subsection id="id188C416ABDD544D6BA19134E76FF5495"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2009, the Secretary of Homeland Security, in Cooperation with the
			 Attorney General, shall expand Operation Streamline (the zero-tolerance
			 prosecution policy for illegal entry and reentry) to all 20 border
			 sectors.</text>
			</subsection><subsection id="IDc670842620ca45b388c08b797395eb56"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated
			 $500,000,000 for each of the fiscal years 2009 through 2018 to carry out this
			 section.</text>
			</subsection></section><section id="IDd2e1056ce65e432d96d6744003e81ee1"><enum>3.</enum><header>Mandatory
			 minimum sentences for illegal entry</header><text display-inline="no-display-inline">Section 275 of the Immigration and
			 Nationality Act (8 U.S.C. 1325) is amended—</text>
			<paragraph id="id2D576BCB7DB44E8EB176572B218F501E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as
			 subsections (d) and (e), respectively; and</text>
			</paragraph><paragraph id="idB7043DAE126E4A728127A647069BBA5A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idD34A0425F7F44F8E9B94A9155A3EAE85" style="OLC">
					<subsection id="IDf007aff051004021833fe7f5f14d7275"><enum>(c)</enum><header>Improper time
				or place; criminal penalties</header><text>Any alien who is apprehended while
				entering, or attempting to enter, the United States at a time and place other
				than as designated by immigration offices—</text>
						<paragraph id="IDb679c5405b684c86a7e46759880c3417"><enum>(1)</enum><text>in the case of a
				first violation of subsection (a), shall be sentenced to a term of imprisonment
				of not less than 10 days and not more than 364 days;</text>
						</paragraph><paragraph id="ID04c47dab35bb4c13900f8892e14c4327"><enum>(2)</enum><text>in the case of a
				second violation of subsection (a), shall be sentenced to a term of
				imprisonment of not less than 60 days and not more than 2 years; and</text>
						</paragraph><paragraph id="ID0db89486e57244b69b44894824feae1d"><enum>(3)</enum><text>in the case of a
				third or subsequent violation of subsection (a), shall be sentenced to a term
				of imprisonment of not less than 90 days and not more than 3
				years.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID209d4261dad74b23a7b46aaa0921c614"><enum>4.</enum><header>Mandatory
			 minimum sentences for illegal reentry</header><text display-inline="no-display-inline">Section 276 (8 U.S.C. 1326) is amended to
			 read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id2879131A9E15433A897B63C57F826522" style="OLC">
				<section id="id09399C3AA336470E8DDC2540724E57C9"><enum>276.</enum><header>Reentry of
				removed alien</header>
					<subsection id="ID49832af778f44daab7a82f867bbb5e51"><enum>(a)</enum><header>Reentry after
				removal</header><text>Any alien who has been denied admission, excluded,
				deported, or removed, or who has departed the United States while an order of
				exclusion, deportation, or removal is outstanding, and subsequently enters,
				attempts to enter, crosses the border to, attempts to cross the border to, or
				is at any time found in the United States, shall be fined under title 18,
				United States Code, and imprisoned not less than 90 days and not more than 2
				years.</text>
					</subsection><subsection id="ID819ac95390cb4733b3ff46289599b04d"><enum>(b)</enum><header>Reentry of
				criminal offenders</header><text>Notwithstanding the penalty prescribed under
				subsection (a), an alien described in that subsection who was—</text>
						<paragraph id="IDf9ddcf64a64e4ab9b2ca5fb72bc1f8a6"><enum>(1)</enum><text>convicted for 3
				or more misdemeanors or a felony before such removal or departure, shall be
				fined under title 18, United States Code, and imprisoned for not less than 1
				year and not more than 10 years;</text>
						</paragraph><paragraph id="IDb19b0bee25ce4b6090ea28e2635854af"><enum>(2)</enum><text>convicted for a
				felony before such removal or departure for which the alien was sentenced to a
				term of imprisonment of not less than 30 months, shall be fined under such
				title, and imprisoned for not less than 2 years and not more than 15
				years;</text>
						</paragraph><paragraph id="ID8f93d5806054451aa56b5156d88472bd"><enum>(3)</enum><text>convicted for a
				felony before such removal or departure for which the alien was sentenced to a
				term of imprisonment of not less than 60 months, shall be fined under such
				title and imprisoned for not less than 4 years and not more than 20
				years;</text>
						</paragraph><paragraph id="IDa112a9359c5f414d942b3fb95deb9ebc"><enum>(4)</enum><text>convicted for 2
				or more felonies before such removal or departure, shall be fined under such
				title and imprisoned for not less than 4 years and for not more than 20 years;
				or</text>
						</paragraph><paragraph id="ID71bc7063284842e0a9ad133be8f4de2f"><enum>(5)</enum><text>convicted, before
				such removal or departure, for murder, rape, kidnapping, for a felony offense
				described in chapter 77 (relating to peonage and slavery) or 113B (relating to
				terrorism) of such title, shall be fined under such title and imprisoned for
				not less than 5 years and not more than 20 years.</text>
						</paragraph></subsection><subsection id="IDd37fe849c14a41ff83ff35cbe5c4df15"><enum>(c)</enum><header>Reentry after
				repeated removal</header><text>Any alien who, after having been denied
				admission, excluded, deported, or removed 2 or more times, enters, attempts to
				enter, crosses the border to, attempts to cross the border to, or is at any
				time found in the United States, shall be fined under title 18, United States
				Code, and imprisoned for not less than 2 years and not more than 10
				years.</text>
					</subsection><subsection id="IDd3bc6b75b3ea43599849443c80b24d79"><enum>(d)</enum><header>Proof of prior
				convictions</header><text>The prior convictions described in subsection (b) are
				elements of the crimes described in that subsection, and the penalties in that
				subsection shall apply only in cases in which the conviction or convictions
				that form the basis for the additional penalty are—</text>
						<paragraph id="ID70ef1984ceba44e9af50c4e1814949d3"><enum>(1)</enum><text>alleged in the
				indictment or information; and</text>
						</paragraph><paragraph id="ID1735d4d85fd8410cb570dc44417b6d2a"><enum>(2)</enum><text>proven beyond a
				reasonable doubt at trial or admitted by the defendant.</text>
						</paragraph></subsection><subsection id="ID88b281f911b847029cb8c35dbda81c6d"><enum>(e)</enum><header>Affirmative
				defenses</header><text>It shall be an affirmative defense to a violation of
				this section that—</text>
						<paragraph id="ID04b9cbff56b94dcbae52e83f01a49e82"><enum>(1)</enum><text>the alien had
				sought and received, before the alleged violation, the express consent of the
				Secretary of Homeland Security to reapply for admission into the United
				States;</text>
						</paragraph><paragraph id="ID59570f80ae164f2cbd06229e26ec577e"><enum>(2)</enum><text>with respect to
				an alien previously denied admission and removed, the alien—</text>
							<subparagraph id="IDa93d9729cd72468bac4a4e766a2a17f3"><enum>(A)</enum><text>was not required
				to obtain such advance consent under the Immigration and Nationality Act or
				under any prior Act; and</text>
							</subparagraph><subparagraph id="IDad618508c75f4571b26a1086319ed8d4"><enum>(B)</enum><text>had complied with
				all other laws and regulations governing the alien’s admission into the United
				States; or</text>
							</subparagraph></paragraph><paragraph id="ID48cf6d530140423c8ca80a87cb00b4a8"><enum>(3)</enum><text>at the time of
				the prior exclusion, deportation, removal, or denial of admission alleged in
				the violation, the alien—</text>
							<subparagraph id="ID5cc3e6a1b7a3482dbaacc5cb85506ecf"><enum>(A)</enum><text>was younger than
				18 years of age; and</text>
							</subparagraph><subparagraph id="IDa1c227e97f314eb198d0d4e4d08f27c0"><enum>(B)</enum><text>had not been
				convicted of a crime or adjudicated a delinquent minor by a court of the United
				States, or a court of a State or territory, for conduct that would constitute a
				felony if committed by an adult.</text>
							</subparagraph></paragraph></subsection><subsection id="ID37a0234ffd614491ae0df19bbc1a47b3"><enum>(f)</enum><header>Limitation on
				collateral attack on underlying removal order</header><text>In a criminal
				proceeding under this section, an alien may not challenge the validity of any
				prior removal order concerning the alien unless the alien demonstrates by clear
				and convincing evidence that—</text>
						<paragraph id="IDf7fe0c36faf246ae86920448a1bd4cb4"><enum>(1)</enum><text>the alien
				exhausted all administrative remedies that may have been available to seek
				relief against the order;</text>
						</paragraph><paragraph id="IDb5c752f6a5d04afdb3ff98680f9fe8c1"><enum>(2)</enum><text>the removal
				proceedings at which the order was issued improperly deprived the alien of the
				opportunity for judicial review; and</text>
						</paragraph><paragraph id="IDb9ddbf5c3760499cabf85148c6094527"><enum>(3)</enum><text>the entry of the
				order was fundamentally unfair.</text>
						</paragraph></subsection><subsection id="ID7526443ec9a9435cb126808724cf4bc9"><enum>(g)</enum><header>Reentry of
				alien removed before completing term of imprisonment</header><text>Any alien
				removed pursuant to section 241(a)(4) who enters, attempts to enter, crosses
				the border to, attempts to cross the border to, or is at any time found in, the
				United States shall be—</text>
						<paragraph id="idB0A4CA21832A49619AB4FF292754C0E2"><enum>(1)</enum><text>incarcerated for
				the remainder of the term of imprisonment, which was pending at the time of
				deportation without any reduction for parole or supervised release unless the
				alien affirmatively demonstrates that the Secretary of Homeland Security has
				expressly consented to the alien's reentry; and</text>
						</paragraph><paragraph id="id40B9903D61F04CE6B5A0AC9FE5462D15"><enum>(2)</enum><text>subject to such
				other penalties relating to the reentry of removed aliens as may be available
				under this section or any other provision of law.</text>
						</paragraph></subsection><subsection id="IDdecf090f41b94ef2bc72ee10b10a4963"><enum>(h)</enum><header>Limitation</header><text>An
				individual who provides an alien with emergency humanitarian assistance,
				including emergency medical care and food, or transports the alien to a
				location where such assistance can be rendered without compensation or the
				expectation of compensation may not be prosecuted for aiding and abetting a
				violation of this section based on the provision of such humanitarian services
				.</text>
					</subsection><subsection id="IDb61ae25d28444047a7477d2ebc1911dc"><enum>(i)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="IDba34be0b17ab416c866ce61e5a1c1142"><enum>(1)</enum><header>Felony</header><text>The
				term <term>felony</term> means any criminal offense punishable by a term of
				imprisonment of more than 1 year under the laws of the United States, of any
				State, or of a foreign government.</text>
						</paragraph><paragraph id="IDc035d71cc43d4c28af030a8d02037c6b"><enum>(2)</enum><header>Misdemeanor</header><text>The
				term <term>misdemeanor</term> means any criminal offense punishable by a
				maximum term of imprisonment of not more than 1 year under the applicable laws
				of the United States, of any State, or of a foreign government.</text>
						</paragraph><paragraph id="IDd859dae0dc9d47679a2730632fb93df7"><enum>(3)</enum><header>Removal</header><text>The
				term <term>removal</term> includes any denial of admission, exclusion,
				deportation, or removal, or any agreement by which an alien stipulates or
				agrees to exclusion, deportation, or removal.</text>
						</paragraph><paragraph id="ID96edefd5c38e4839abebd7b0b5565641"><enum>(4)</enum><header>State</header><text>The
				term <term>State</term> means any of the several States of the United States,
				the District of Columbia, and any commonwealth, territory, or possession of the
				United
				States.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID3564413fd3c34bf88a51050251f945ee"><enum>5.</enum><header>Mandatory
			 minimum sentences for destroying border barriers or
			 infrastructure</header><text display-inline="no-display-inline">Section 1361 of
			 title 18, United States Code, is amended—</text>
			<paragraph id="id6C4C0FF1AAA14B17BB3E4AECD2EA5DC6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Whoever</quote> and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA0388034628349208C12230658B498CD" style="OLC">
					<subsection id="idB40A3D55EA25437C9AE4E6665DCF7A1E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idD77CE9FF001E41269AE844998277A10A"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id53264160CBE64843B731F17DB89F3410" style="OLC">
					<subsection id="id88943DE0DFAD45108D702A8C79DD588B"><enum>(b)</enum><header>Destruction of
				border barriers or infrastructure</header><text display-inline="yes-display-inline">Any alien who damages or destroys fencing
				or infrastructure, such as cameras, sensors, and vehicle barriers, that has
				been installed along the international border of the United States by the
				United States Government shall be fined under this title and imprisoned for not
				less than 5
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
