		<official-title>To amend the Reclamation Projects Authorization and
		  Adjustment Act of 1992 to require the Secretary of the Interior to take certain
		  actions to address environmental problems associated with the Leadville Mine
		  Drainage Tunnel in the State of Colorado, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Leadville Mine Drainage Tunnel
			 Environmental Improvement Act of 2008</short-title></quote>.</text>
		</section><section id="id49FDBFCB1DE54505BC2952A89EDE6660"><enum>2.</enum><header>Leadville Mine
			 Drainage Tunnel</header><text display-inline="no-display-inline">Section 705 of
			 the Reclamation Projects Authorization and Adjustment Act of 1992 (Public Law
			 102–575; 106 Stat. 4656) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id3BC326803C164B678861C16F4882A4C0" style="OLC">
				<section id="id1A6104CD67944050A71E77A95E865007"><enum>705.</enum><header>Leadville Mine
				Drainage Tunnel</header><text display-inline="no-display-inline">The Secretary
				shall operate and maintain the Leadville Mine Drainage Tunnel in a manner that
				protects human health and
				environment.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idBABCD3C2FFD947C993F61EFE4096471F"><enum>3.</enum><header>Water quality
			 investigations</header><text display-inline="no-display-inline">Section 708 of
			 the Reclamation Projects Authorization and Adjustment Act of 1992 (Public Law
			 102–575; 106 Stat. 4657) is amended—</text>
			<paragraph id="id321AF4F2925B4773ABBA356F3CD17742"><enum>(1)</enum><text display-inline="yes-display-inline">by striking sections (a) through (d) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id811F91853FAC4976BA4EB1C33CE7F1B2" style="OLC">
					<subsection id="IDfc5659d94d144839b4cb170736f3a766"><enum>(a)</enum><header>Definition of
				study area</header><text>In this section, the term <term>study area</term>
				includes—</text>
						<paragraph id="id01DB85FE876B4D9696CB7056795B8AB4"><enum>(1)</enum><text>the Leadville
				Mine Drainage Tunnel;</text>
						</paragraph><paragraph id="id7B250711B2D247958C495444325A4E4D"><enum>(2)</enum><text>groundwater and
				surface water, including tributaries, affected by any blockage of that Tunnel;
				and</text>
						</paragraph><paragraph id="id92BC144CC2054C41B7F3A91A6D1DE0D4"><enum>(3)</enum><text>the upper
				Arkansas River watershed, from the headwaters of the east fork of that River to
				the confluence with Two-Bit Gulch.</text>
						</paragraph></subsection><subsection id="ID147ed2ec8b2744ee99a5f61248bebaa3"><enum>(b)</enum><header>Study and
				report</header><text>The Secretary, in cooperation with the State of Colorado,
				the Administrator of the Environmental Protection Agency, and other Federal
				agencies, shall—</text>
						<paragraph id="idCC9F212BF695419D830739E598740F63"><enum>(1)</enum><text>investigate the
				study area; and</text>
						</paragraph><paragraph id="idA4840F2620EF4B8C91B1C9A36E25DC85"><enum>(2)</enum><text>not later than 1
				year after the date of enactment of the Leadville Mine Drainage Tunnel
				Environmental Improvement Act of 2008, and annually thereafter until the study
				required by this section is complete, submit to the State, the Administrator,
				and Congress a report that describes whether, and how, any blockages in the
				Leadville Mine Drainage Tunnel have affected, or are affecting, water quality
				and aquatic life in the study area.</text>
						</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idF296C26AAECC478DA489F88238050458"><enum>(2)</enum><text>in subsection
			 (e), by striking <quote>(e) Nothing</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0F0C80E77EB24B31AEA46130EB3D90C0" style="OLC">
					<subsection id="id62DA86ED7BF842269C5CF5D9717565E3"><enum>(c)</enum><header>CERCLA</header><text>Nothing</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id86147667EE424303BD47432D64D04F2D"><enum>(3)</enum><text>by striking
			 subsection (f) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE4558DC313E24D2C8231CA6B56481E7C" style="OLC">
					<subsection id="idC879CD3580B9428590E4BD4DF6D732D3"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated—</text>
						<paragraph id="id4FDD2931BB39494B99C3B315E7EBC810"><enum>(1)</enum><text>to carry out
				section 707, such sums as are necessary; and</text>
						</paragraph><paragraph id="id7EAD0E7635514E6A907C5B4FDA883BBD"><enum>(2)</enum><text>to carry out this
				section—</text>
							<subparagraph id="id7831DE66763B456C8D36DA24D9A84AB2"><enum>(A)</enum><text>$500,000 for use
				in planning and carrying out investigations; and</text>
							</subparagraph><subparagraph id="id216F1428E297431B847E0C0D99B52916"><enum>(B)</enum><text>such additional
				sums as are
				necessary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idDBBA2D45512E49DB8A29992F2D26298F"><enum>4.</enum><header>Environmental
			 remediation</header><text display-inline="no-display-inline">Title VII of the
			 Reclamation Projects Authorization and Adjustment Act of 1992 (Public Law
			 102–575; 106 Stat. 4655) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idEFAAA82E73CE40198ED1FA809D719615" style="OLC">
				<section id="idE8473147FE564007A6A406552183FD59"><enum>709.</enum><header>Environmental
				remediation</header>
					<subsection id="ID66d54df2987945e598c6975f0ef672eb"><enum>(a)</enum><header>Mine
				pool</header><text>The Secretary, in conjunction with the Administrator of the
				Environmental Protection Agency and the State of Colorado, shall—</text>
						<paragraph id="id037372FA24CA44CEA10446ABC2A38209"><enum>(1)</enum><text>immediately take
				such actions as are necessary to reduce the water level in the mine pool
				associated with the Leadville Mine Drainage Tunnel, in a manner consistent with
				subsection (b), to prevent the risk of a catastrophic rupture and flood;
				and</text>
						</paragraph><paragraph id="idD38C292CDAB54BF3A830AE6FB7DC0D0B"><enum>(2)</enum><text>thereafter, take
				such actions as are necessary—</text>
							<subparagraph id="id156E7A3F62FC4295BA31746FED9B9AF6"><enum>(A)</enum><text>to maintain the
				water level in the mine pool at a safe level; and</text>
							</subparagraph><subparagraph id="id21850B9C14BC41BD930343D1DEC753DE"><enum>(B)</enum><text>prevent further
				mine pool migration.</text>
							</subparagraph></paragraph></subsection><subsection id="ID823e0c8a6b824f4abe5d8ed06b687a61"><enum>(b)</enum><header>California
				Gulch Superfund Site Operable Unit 6</header>
						<paragraph id="id20B60E236E6C48CD99241D610DB1327B"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable after the date of enactment of
				this section, the Secretary, in conjunction with the Administrator of the
				Environmental Protection Agency and the State of Colorado, shall implement
				those portions of the remedy selected by the Administrator of the Environmental
				Protection Agency, dated September 2003, and any modifications or amendments to
				the remedy, including explanations of significant differences, for the
				California Gulch Superfund Site that pertain to managing the Leadville Mine
				Drainage Tunnel and related mine pool.</text>
						</paragraph><paragraph id="IDf52a93393e7245fbb9c860d5e42029e7"><enum>(2)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this subsection
				$40,000,000.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1CF11ADBD37A48C299007062F1F7B4CD"><enum>5.</enum><header>Technical
			 amendments</header><text display-inline="no-display-inline">The table of
			 contents for the Reclamation Projects Authorization and Adjustment Act of 1992
			 (Public Law 102–575; 106 Stat. 4600) is amended—</text>
			<paragraph id="idFCD53589FF4B4574AD82543713E64FD1"><enum>(1)</enum><text>by striking the
			 item relating to section 705 and inserting the following:</text>
