		<legis-type>A BILL</legis-type>
		<official-title>To amend the Federal Power Act to ensure that the mission
		  and functions of Regional Transmission Organizations and Independent System
		  Operators include keeping energy costs as low as reasonably possible for
		  consumers, and for other purposes.</official-title>

	<legis-body>
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Consumer Protection and Cost
			 Accountability Act</short-title></quote>.</text>
		</section><section id="idCDBF860C2E1C4B8CB908981F4F1F34C3"><enum>2.</enum><header>Requirements
			 relating to transmission organizations</header>
			<subsection id="idCD4B995428524A9BB2964F1D8D949C25"><enum>(a)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="idDC818C167405433B8661F16121505B9C"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Federal Energy Regulatory
			 Commission.</text>
				</paragraph><paragraph id="id02BDF35DA3DA4D9B9C795F66006A8CBB"><enum>(2)</enum><header>Lowest
			 reasonable cost</header><text>The term <term>lowest reasonable cost</term>
			 means the lowest total delivered cost to consumers consistent with the
			 provision of reliable service.</text>
				</paragraph><paragraph id="id187CF91A75384A3E8C61733E74BABB28"><enum>(3)</enum><header>Transmission
			 Organization</header><text>The term <term>Transmission Organization</term> has
			 the meaning given the term in section 3 of the Federal Power Act (16 U.S.C.
			 796).</text>
				</paragraph></subsection><subsection id="idD92E352E67B1457E8CB985B1EA2DCD75"><enum>(b)</enum><header>Rate and
			 charges; schedules; suspension of new rates</header><text display-inline="yes-display-inline">Section 205 of the Federal Power Act (16
			 U.S.C. 824d) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAD4B893BA71440C19C68BD613A547AE9" style="OLC">
					<subsection id="ID6f522433af94433aa5296f9e61f11149"><enum>(g)</enum><header>Requirements
				relating to Transmission Organizations</header>
						<paragraph id="id07BB2EA132AF4DE7805E03830EB9B53C"><enum>(1)</enum><header>Definition of
				lowest reasonable cost</header><text>In this subsection, the term <term>lowest
				reasonable cost</term> means the lowest total delivered cost to consumers
				consistent with the provision of reliable service.</text>
						</paragraph><paragraph id="id4FD8736CA1B64DC39626C2BDC0D15357"><enum>(2)</enum><header>Consideration
				of Transmission Organization rates</header><text>With respect to determining
				whether a rate or charge made, demanded, or received (including any rule or
				regulation promulgated by a Transmission Organization relating to a rate or
				charge made, demanded, or received) is consistent with each requirement
				described in subsection (a) or section 206, as applicable, the Commission shall
				consider whether the rate or charge (including each rule or regulation relating
				to the rate or charge) would enable the Transmission Organization to provide,
				or facilitate the provision of, reliable service to consumers at the lowest
				reasonable cost.</text>
						</paragraph><paragraph id="id7173CCA05D4640C2B73DF809D9122DA9"><enum>(3)</enum><header>Consideration
				of Transmission Organization rate changes</header><text>In determining whether
				any filing by a Transmission Organization to establish or change a rate or
				charge made, demanded, or received (including any rule or regulation
				promulgated by a Transmission Organization relating to a rate or charge made,
				demanded, or received) is consistent with each requirement described in
				subsection (a), the Commission shall consider whether the rate or charge
				(including each rule or regulation relating to the rate or charge)
				would—</text>
							<subparagraph id="id9EA44A299CE54B0BB2E37B8BF07AC476"><enum>(A)</enum><text>provide consumer
				benefits that outweigh any anticipated direct or indirect costs to consumers,
				as demonstrated by a cost-benefit analysis to be submitted by the Transmission
				Organization to the Commission; or</text>
							</subparagraph><subparagraph id="idFF5D508A51664F239172220C20F9F037"><enum>(B)</enum><text>have only a de
				minimus impact on the total delivered costs to consumer.</text>
							</subparagraph></paragraph><paragraph id="ID8f0e0c359a9546129c4d2710f5f55edf"><enum>(4)</enum><header>Biennial
				audits</header><text>The Commission shall ensure that each Transmission
				Organization is subject to biennial, independent audits that—</text>
							<subparagraph id="id9467D8C7A80B40179E0687389196BBB4"><enum>(A)</enum><text>include—</text>
								<clause id="id5D06CB99D2BF4EF88757AB8EF54EA4EB"><enum>(i)</enum><text>an assessment of
				the performance of the Transmission Organization; and</text>
								</clause><clause id="id664F90FBF85D4EA4AF1BC233885023F7"><enum>(ii)</enum><text>recommendations
				to lower the costs and improve the performance of the Transmission
				Organization; and</text>
								</clause></subparagraph><subparagraph id="id6DD030B21552407B87A04071BF073A3E"><enum>(B)</enum><text>are made
				available to the
				public.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id39113446E199485FB72EE5A0A8DEECA0"><enum>(c)</enum><header>Annual
			 reports</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, and annually thereafter, the
			 Commission shall submit to the appropriate committees of Congress a report
			 describing each determination of the Commission with respect to whether each
			 Transmission Organization provides, or facilitates the provision of, reliable
			 service at the lowest reasonable cost to consumers.</text>
			</subsection></section></legis-body>
